सूचना

यतः यात्री यानों और मालयाना को चलाने के लिए अन्तर्राज्यिक अनुज्ञाओं की मंजूरी देने तथा / या प्रतिहस्ताक्षर करने के लिए मध्यप्रदेश सरकार और महाराष्ट्र सरकार के बीच पारस्परिक परिवहन करार निष्पादित किया गया था, तथा जो 01 मार्च 2007 से प्रवृत्त हुआ है ।

और यतः, उपरोक्त दोनों राज्यों की सरकारें पुनः सहमत हैं कि उक्त करार को विखण्डित किया जाए तथा यात्री यानों और मालयानों को अन्तर्राज्यीय मार्गों पर चलाने को विनियमित करने तथा ऐसे यानों को चलाने के लिए अन्तर्राज्यिक अनुज्ञापत्रों की मंजूरी देने तथा / या प्रतिहस्ताक्षर करने के लिए दोनों राज्यों के बीच एक नया करार किया जाए ;

अतएव , करार का निम्नलिखित प्रारूपं, जो मध्यप्रदेश सरकार द्वारा महाराष्ट्र सरकार के साथ किया जाना प्रस्तावित है, मोटरयान अधिनियम , 1988 (1988 का 59) की धारा 88 की उप धारा (5) द्वारा अपेक्षित किए गए अनुसार ऐसे समस्त व्यक्तियों की, जिनके उससे प्रभावित होने की संभावना है, जानकारी के लिए एतद्वारा प्रकाशित किया जाता है तथा एतद्वारा यह सूचना दी जाती है कि "राजपत्र " में इस सूचना के प्रकाशन की तारीख से 30 दिन का अवसान होने पर उक्त प्रारूप करार पर विचार किया जाएगा । कोई अभ्यावेदन जो उक्त प्रारूप करार के संबंध में किसी व्यक्ति से उपरोक्त विनिर्दिष्ट कालावधि का अवसान होने पर या उसके पूर्व प्रमुख सचिव मध्यप्रदेश शासन , परिवहन विभाग, कक्ष क्रमांक 4.34.मंत्रालय, वल्लभ भवन, भोपाल में प्राप्त हो, विचार किया जाएगा ।

अभ्यावेदन , यदि कोई हो, दो प्रतियों में प्रमुख सचिव, मध्यप्रदेश सरकार, परिवहन विभाग, मंत्रालय , वल्लभ भवन, भोपाल 462004 को संबोधित होना चाहिए, अर्थातुः-

यह पारस्परिक परिवहन करार आज दिनांक 6.4.2018 को भोपा (स्थान ) पर महाराष्ट्र सरकार की कार्यपालिक शक्तियों का प्रयोग करते हुए प्रथम पक्ष महाराष्ट्र राज्य के राज्यपाल, जिनका कि प्रतिनिधित्व प्रमुख सचिव (परिवहन) गृह विभाग , जिसका कि मुख्यालय मुम्बई में स्थित है (जो इसमें इसके पश्चात् महाराष्ट्र राज्य के रूप में निर्दिष्ट है) (इस पद में जब तक कि उसके संदर्भ अथवा अर्थ से प्रतिकूल अभिप्रेत न हो इसके निष्पादक, प्रशासक तथा प्राधिकृत समनुदेशिती भी सम्मिलित है) द्वारा किया जा रहा है ; और

मध्यप्रदेश सरकार की कार्यपालिक शक्तियों का प्रयोग करते हुए मध्यप्रदेश के राज्यपाल , जिनका कि प्रतिनिधित्व अध्यक्ष राज्य परिवहन प्राधिकरण/ प्रमुख सचिव, मध्यप्रदेश शासन जिसका कि मुख्यालय भोपाल में स्थित है (जो इसमें इसके पश्चात् मध्यप्रदेश राज्य के रूप में निर्दिष्ट है) जिसकी अभिव्यक्ति जब तक कि उसके संदर्भ अथवा अर्थ के विरूद्ध अभिप्रेत न हो द्वितीय पक्ष के उसके निष्पादकों, प्रशासकों तथा प्राधिकृत समनुदेशितों को सम्मिलित समझा जाएगा । 932( 1) मध्यप्रदेश राजपत्र, दिनांक 23 अगस्त 2018

यतः देश में त्वरित आर्थिक विकास तथा मध्यप्रदेश और महाराष्ट्र के राज्य की समीपस्थता की दृष्टि में यह समीचीन समझा गया कि उक्त दोनों राज्यों के बीच यात्रियों और माल के लम्बी दूरी की अन्तर्राज्यिक परिवहन को प्रोत्साहित किया जाए और उनके प्रचालन को विनियमित, समन्वित और नियंत्रित किया जाए, उक्त पक्षकार एक त्वरित पारस्परिक परिवहन करार निष्पादित करने के लिए सहमत हैं ।

अब उक्त पक्षों द्वारा और उनके मध्य निम्नलिखित करार किया जाता है:-

यहकि, पारस्परिक परिवहन करार दिनांक ......2018 से प्रवृत्त होगा तथा उस समय तक विधिमान्य रहेगा, जब तक कि दोनों राज्यों की मध्य एक नया करार या उसका पुनर्विलोकन न हो जाए या दोनों में से किसी एक पक्ष द्वारा तीन माह की सूचना जारी करने के पश्चात् विद्यमान करार को विखण्डित न कर दिया जाए ।

इस करार के प्रवृत्त होने से मध्यप्रदेश राज्य और महाराष्ट्र राज्य के बीच सड़क परिवहन के मामले में किए गए समस्त पूर्ववर्ती द्विपक्षी करार अतिष्ठित हो जाएंगे ।

1. कराधान.- (क) मूल अनुज्ञापत्रों से आच्छादित प्रक्रम वाहन या मोटरयान अधिनियम, 1988 की धारा 87 (1 -घ) के अधीन मूल अनुज्ञापत्रों के नवीनीकरण लंबित रहने के दौरान जारी किए गए अस्थायी अनुज्ञापत्रों पर करार पाए गए मार्गों के भीतर और अन्य राज्य द्वारा प्रतिहस्ताक्षरित परमिटों के संबंध में पारस्परिक करारकर्ता राज्य में मोटरयान कर एकल बिन्दु कर के आधार पर देय होगा । महाराष्ट्र मोटरयान (यात्रियों का कर) अधिनियम, 1958 के अधीन यात्री कर उद्ग्रहणीय होगा ।

(ख) मालयानों के मूल अनुज्ञापत्रों पर, संचालित मोटरयान अधिनियम, 1988 की धारा 87 (1 -घ) अधीन मूल अनुज्ञापत्रों के नवीनीकरण लंबित रहने के दौरान जारी किए गए अस्थायी अनुज्ञापत्रों पर करार पाए गए कोटे के भीतर पारस्परिक करारकर्ता राज्य के परिवहन प्राधिकारी द्वारा प्रतिहस्ताक्षर परमिट पर एकल कर प्रणाली के आधार पर किया जाएगा, तथा अन्य राज्य में निम्नानुसार मुक्त रहेंगे:-

(एक) यदि मालयान मध्यप्रदेश राज्य से संबंधित हैं, महाराष्ट्र सरकार द्वारा समय- समय पर नियत मोटरयान कर छूट महाराष्ट्र में और शेष में (जैसे मोटरयान ऋणात्मक रियायती छूट) मोटरयान कर की रकम अग्रिम में एक वर्ष की कालावधि के लिए तथा प्रतिहस्ताक्षर कर के भुगतान के अध्यधीन वैध होंगे उपरोक्त छूट इसमें इसके पश्चात् " पारस्परिक कर छूट" कहलाएगी ।

(दो) यदि मालयान महाराष्ट्र राज्य से संबंधित है तो महाराष्ट्र राज्य के मोटरयान कर की सीमा तक मध्यप्रदेश में मोटरयान कर संदत्त से छूट प्राप्त होगी और मोटरयान कर की शेष रकम (अर्थात् मोटरयान कर रियायती छूट की रकम) एक वर्ष कालावधि के लिए अग्रिम संदाय की जाएगी और प्रतिहस्ताक्षर केवल कर के भुगतान के अध्यधीन विधिमान्य मध्यप्रदेश राजपत्र, दिनांक 23 अगस्त 2018

होगा । उपोक्त छूट इसमें इसके पश्चात् उपरोक्त रियायत छूट "पारस्परिक कर रियायत " कहलाएगी ।

(ग) स्पष्टीकरणः - इस करार के प्रयोजन के लिए.-

(1 ) सामान्य प्रक्रम/ माल वाहन परमिट, जो सम्यक्रूपेण प्रतिहस्ताक्षरित है, के लिए "एकल बिन्दु कर प्रणाली " से अभिप्रेत है -

(एक ) मध्यप्रदेश की प्रक्रम / माल वाहनों के संबंध में गृह राज्य के मोटरयान कर भुगतान का दायित्व किन्तु महाराष्ट्र राज्य का मोटरयान कर (रोड टैक्स) से छूट रहेगी तथापि महाराष्ट्र के लिए देय यात्री कर महाराष्ट्र मोटरयान यात्री कर अधिनियम, 1958 के अधीन मंजिली वाहनों पर देय होगा ।

(दो) महाराष्ट्र राज्य की प्रक्रम वाहन के संबंध में गृह राज्य के संबंध में मोटरयान कर के साथ मध्यप्रदेश मोटरयान कराधान अधिनियम, 1991 राज्य के लिए रियायती कर से देय मोटरयान कर में जैसा पारस्परिक करार के अंतर्गत अन्य राज्यों की मंजिली गाड़ियों के लिए विहित किया गया है, के भुगतान का दायी होगा ।

(2) किसी मोटरयान के संबंध में, शब्द " द्विबिन्दु कर आधार " से अभिप्रेत हैं, दोनों राज्यों में मोटरयान कर / टोल्स को सम्मिलित करते हुए सभी करों के संदाय का दायित्व है ।

2. करों के संदाय का प्रकार:-

(क) अनुज्ञापत्र जारी / प्रतिहस्ताक्षर करने वाला प्राधिकारी यह सुनिश्चित करेगा कि किसी अस्थायी अनुज्ञापत्र या विशेष अनुज्ञापत्र को जारी करने के पूर्व पारस्परिक करारकर्ता राज्य के समस्त कर संबंधित राज्य में प्रवृत्त इलेक्ट्रॉनिक रूप से ई-पेमेण्ट प्रणाली के द्वारा अधिमानता से संदत्त किए जाएंगे । दोनों राज्य किसी भी बैंक को उनके राज्य के लिए जारी किए गए परमिटों के विषय में इलेक्ट्रानिकली कर संग्रह करने के लिए प्राधिकृत कर सकते हैं ।

(ख) महाराष्ट्र राज्य के मामले में, समस्त अस्थायी अनुज्ञापत्रों तथा विशेष अनुज्ञापत्रों के बारे में जानकारी निम्नलिखित प्रपत्र में सचिव, राज्य परिवहन प्राधिकारी , मुम्बई महाराष्ट्र, को त्रैमासिक आधार पर तत्काल भेजी जाएगी तथा मध्यप्रदेश राज्य के संबंध में समस्त अस्थाई अनुज्ञापत्रों एवं विशेष अनुज्ञापत्रों के बारे में जानकारी सचिव , राज्य परिवहन प्राधिकारी , ग्वालियर, मध्यप्रदेश को त्रैमासिक आधार पर निम्नलिखित प्रपत्र में भेजी जाएगी:-

3. मालयान (मूल अनुज्ञा- पत्र):-

(क) यह करार पाया गया कि प्रत्येक राज्य से संबंधित कुल 12,000 (बारह हजार) मालयानों के लिए संबंधित राज्य / प्रादेशिक परिवहन प्राधिकारी की सिफारिश पर अन्य राज्य के परिवहन प्राधिकारियों द्वारा एकल बिन्दु कर आधार पर अनुज्ञापत्र प्रतिहस्ताक्षरित किए जाएंगे । ऐसे प्रतिहस्ताक्षर प्रत्येक राज्य द्वारा दिए जाएंगें समस्त राष्ट्रीय और राज्य मार्गों तथा अन्य लोक पथों पर यानों के परिचालन के लिए मंजूर किए जाएंगे , जिससे कि यान प्रतिबंधित मार्गों को छोड़कर उस क्षेत्र के समुदाय की आवश्यकताओं को पूरा करने में समर्थ हो सके ।

(ख) प्रतिहस्ताक्षरित अनुज्ञापत्रों के अधीन प्रचलित होने वाले मालयानों का उपयोग अनन्यतः पारस्परिक करारकर्ता राज्य के राज्य क्षेत्राधिकार के भीतर किन्हीं दो बिन्दुओं के बीच माल को चढ़ाने और उतारने के लिए नहीं किया जाएगा, अर्थात् यानों को अनन्यतः प्रतिहस्ताक्षरित करने वाले राज्य के राज्य क्षेत्राधिकार के भीतर माल के परिवहन का कोई कारबार करने से प्रतिषिद्ध किया जाएगा और वे ऐसे शर्तों के अध्यधीन होगा जैसी मोटरयान अधिनियम, 1988 की धारा 79 तथा 84 के अधीन संबंधित परिवहन प्राधिकारी अधिरोपित करना उचित समझें ।

(ग ) मूल प्रतिहस्ताक्षर परमिट के मालयान की समय सीमा प्रथम पंजीयन दिनांक से 12 वर्ष होगी । और माननीय उच्च न्यायालय मुम्बई द्वारा याचिका क्रमांक 1762/1999 में पारित आदेश के अनुसार ऐसे मालयान जो 8 वर्ष से अधिक पुराने है जब तक कि वह सी.एन.जी. एल.पी.जी. से चालित ना हो , मुम्बई नगर में प्रवेश हेतु प्रतिबंधित रहेंगे । समस्त परिवहन यान अर्थात् यात्री बस एवं मालयानों के लिए 8 वर्ष की शर्त लागू है । मध्यप्रदेश राजपत्र, दिनांक 23 अगस्त 2018

4. मालयान (अस्थायी अनुज्ञा- पत्र)- (क) प्रत्येक राज्य द्वारा अस्थाई अनुज्ञापत्रों को जारी करने की संख्या पर प्रतिबंध नहीं है । दोनों राज्यों के परिवहन प्राधिकारियों की सहमति के अध्यधीन , रहते हुए आवश्यकतानुसार दोनों में से किसी भी राज्य द्वारा प्रत्येक मामले में 30 दिन से अनधिक कालावधि के लिए पारस्परिक करारकर्ता राज्य के प्रतिबंधित मार्गों को छोड़कर दोनों ओर से चलाने के लिए मोटरयान अधिनियम, 1988 की धारा 87 (1 ) या 87 (2 ) के उपबंधों के अनुसार फेरों की संख्या पर किसी निर्बन्धनों के बिना और पारस्परिक करारकर्ता राज्य के राज्य परिवहन प्राधिकारी की प्रतिहस्ताक्षर किए बिना द्विबिन्दु कर आधार पर मालयान अस्थाई अनुज्ञापत्र आवश्यकतानुसार जारी किए जा सकेंगे ।

(ख) ये अनुज्ञा पत्र निम्नलिखित शर्तों के अध्यधीन रहते हुए जारी किए जांएगे : -

(एक) पारस्परिक करारकर्ता राज्य की अधिकारिता के भीतर पूर्णतः स्थित किन्हीं दो बिन्दुओं के बीच कोई माल न तो चढ़ाया जाएगा और न ही उतारा जाएगा, अर्थात् ऐसे अन्य राज्य के राज्य क्षेत्र के भीतर अनन्यतः परिवहन के किसी भी कारबार पर चलाए जाने के लिए प्रतिषिद्ध रहेंगे ।

(दो ) प्रचालक किन्हीं अन्य शर्तों का जिन्हें परिवहन प्राधिकारी मोटरयान अधिनियम, 1988 की धारा 79 (2) के अधीन अधिरोपित करना उचित समझे , पालन करेगा ।

5. ठेका गाड़ी मोटर कैब (अस्थायी अनुज्ञा- पत्र) तथा निजी सेवायान/ शैक्षणिक संस्थागत बस-

(क) इस करार के खण्ड-10 (क) के उपबंधों के अध्यधीन रहते हुए आवश्यकतानुसार एक राज्य के परिवहन प्राधिकार द्वारा पारस्परिक राज्य में विनिर्दिष्ट टर्मिनलो को जोड़ने वाले विनिर्दिष्ट मार्गों के लिए पारस्परिक करारकर्ता राज्य के परिवहन प्राधिकार द्वारा प्रतिहस्ताक्षर की अपेक्षा के बिना ठेका गाड़ी मोटर कैब, निजी सेवायान / शैक्षणिक संस्था बस के लिए अस्थायी अनुज्ञा जारी किए जा सकेंगे, ऐसे अस्थायी अनुज्ञापत्रों की विधिमान्यता 30 दिन से अधिक नहीं होगी । ऐसे अस्थाई अनुज्ञापत्रों पर संबंधित राज्य के लिए देय मोटरयान कर अधिमानता से इलेक्ट्रोनिकली संबंधित राज्य में प्रभावी ई- सिस्टम के माध्यम से अग्रिम परमिट जारी करने के पूर्व भुगतान किया जाएगा । ऐसे अस्थाई अनुज्ञापत्र इस शर्त के 932(5) मध्यप्रदेश राजपत्र, दिनांक 23 अगस्त 2018

अधीन होंगे कि एक ही पक्ष द्वारा यान किराए पर लिया जाए तथापि यदि किसी कारण से एक राज्य द्वारा जारी किए गए अनुज्ञापत्र की विधिमान्यता अन्य राज्य के राज्य क्षेत्र में समाप्त होती है तो ऐसे परिवहन प्राधिकारी से जिसकी अधिकारिता में उस समय यान हो, आवश्यक फीस और करों का संदाय करने के पश्चात् एक नया अस्थाई अनुज्ञापत्र प्राप्त किया जाएगा ।

(ख) दोनों राज्यों द्वारा अन्य राज्य के समीपस्थ क्षेत्र के लिए निजी सेवायानों / शैक्षणिक संस्था बसों के लिए प्रतिहस्ताक्षर की शर्त के अधीन अस्थाई अनुज्ञापत्र जारी कर सकेंगे ।

6. विशेष अनुज्ञा-पत्र. किसी भी राज्य के परिवहन प्राधिकारियों द्वारा मोटरयान अधिनियम, 1988 की धारा 88 (8) के अधीन जारी किए जाने वाले विशेष अनुज्ञापत्रों की संख्या पर कोई निर्बन्धन नहीं होगा । ऐसे अनुज्ञापत्र पारस्परिक करारकर्ता राज्य में 30 दिन से अनधिक कालावधि के लिए विधिमान्य होंगे और द्विबिन्दु कर आधार पर जारी किए जाएंगे ।

7. मंजिली गाड़ी सेवा (मूल अनुज्ञापत्र). निम्नलिखित सामान्य सिद्धान्तों पर करार किया गया:-

(क) अन्तर्राज्यिक मार्गों पर एकल बिन्दु कर आधार पर मंजिली गाड़ी पारस्परिक करार के परिशिष्ट उपाबंध- " अ " , "ब " तथा "स " में अन्तर्विष्ट ब्यौरे के अनुसार होंगे ।

(ख) समानता बनाए रखने की दृष्टि से कुल सेवा दूरी को जहां तक सेवा हो सके दोनों राज्यों के मध्य समान कराकर विभाजित किया जाएगा ।

ऐसे करार के प्रयोजन के लिए किसी फेरे से अभिप्रेत होगा कि एकल फेरा परिशिष्ट / उपाबंध "अ " , "ब " तथा "स" में वर्णित मार्गों से सदैव अभिप्रेत होगा , वर्णित मध्य मार्गों से होते हुए उक्त राज्यों में पड़ने वाले उक्त सीमान्तों को जोड़ने वाले सबसे कम दूरी का सीधा मार्ग और उक्त परिशिष्टों में प्रदर्शित माईलेज / किलोमीटर में बाद में पाई गई किसी विसंगति को दोनों राज्यों के परिवहन प्राधिकारियों के बीच तत्परता से पत्र-व्यवहार के माध्यम से ठीक किया जाएगा और उसे करार के उपान्तर के रूप में नहीं समझा जाएगा । मध्यप्रदेश राजपत्र, दिनांक 23 अगस्त 2018

(घ) परिशिष्ट "अ ", " ब " तथा " स " में समावेशित अन्तर्राज्यिक मार्ग के मार्गों की किसी विस्तारण जो अनन्यतः एक राज्य में पड़ती हो, उस राज्य के. परिवहन प्राधिकार द्वारा अन्य राज्य के परिवहन प्राधिकार की बिना पूर्व सहमति के उस राज्य के प्रचालकों द्वारा प्रचलित सेवाओं के संबंध में किया जा सकता है और इस तथ्य को अन्य राज्य परिवहन प्राधिकारी को सूचित किया जाएगा ।

(ङ) जहां पुरानी पारस्परिकता में मार्ग का करार किया गया हो किन्तु पश्चात्वर्ती पारस्परिकता में उसे विस्तारण करके उपांतरित किया गया हो तो पुरानी पारस्परिकता में करार किए गए मार्ग को पुनरीक्षित पारस्परिकता में करार पाए गए मार्ग के रूप में तब तक माना जाएगा जब तक कि अनुज्ञापत्र मंजूर करने वाले प्राधिकारी द्वारा उपांतरित मार्गों के लिए अनुज्ञा पत्र प्रदत्त नहीं कर दिए जाते ।

(च) प्रारंभिक समय सारणी का निर्धारण अनुज्ञा- पत्र मंजूर करने वाले प्राधिकारी द्वारा केवल अनन्तिम आधार पर किया जाएगा जो अधिकतम चार मास की कालावधि के लिए विधिमान्य होगा और सेवा का तत्काल प्रचालन करने के लिए ऐसा प्रतिहस्ताक्षर किया जाएगा । इस कालावधि के दौरान प्रतिहस्ताक्षर करने वाला प्राधिकारी अनुज्ञा- पत्र मंजूर करने वाले प्राधिकारी के परामर्श से समय - सारणी को अन्तिम रूप देगा ।

(छ) प्रत्येक राज्य के राज्य क्षेत्र के भीतर पड़ने वाले मार्गों पर प्रचालन के लिए किए जाने वाला अधिकतम किराया और भाड़ा संबंधित राज्य सरकारों द्वारा विहित किए गए, अनुसार होगा । एक राज्य में जारी किए गए टिकटों का प्रारूप अन्य राज्य में विधिमान्य समझा जाएगा ।

(ज) मोटरयान कराधान अधिनियम तथा पारस्परिक करारकर्ता राज्य के नियमों के प्रयोजनों के लिए एक राज्य का बेड़ा दूसरे राज्य में बेड़ा स्वामी के रूप में पहचाना जाएगा ।

(झ) परिशिष्ट उपाबंध- "अ" , "ब" तथा " स " अन्तर्राज्यिक मार्गों पर मंजिली गाड़ी का संचालन जैसे कि इस करार के खण्ड 1 में विहित किया है, मोटरयान कर , एकल बिन्दु आधार पर होगा । 932(7) मध्यप्रदेश राजपत्र, दिनांक 23 अगस्त 2018

( স) यह करार पाया गया कि महाराष्ट्र राज्य के परिवहन उपक्रम तथा मध्यप्रदेश राज्य के निजी प्रचालकों की आवश्यकतानुसार पारस्परिक करार में सम्मिलित किए गए मार्गों पर सेवाओं को परिवर्तित / कर्टेल मार्गों पर गृह राज्य परिवहन आयुक्त के अनुमोदन के आधार पर प्रचालन के लिए अनुज्ञात किए जाएंगे । यह व्यवस्था उभय राज्यों के राज्य परिवहन प्राधिकारों द्वारा परस्पर परामर्श के द्वारा की जा सकेगी । ( ट) दोनों में से एक राज्य के अंतर्गत पड़ने वाले अंतर्राज्यिक मार्गों पर किसी राज्य के प्रचालक जो अन्तर्राज्यिक मार्ग पर संचालन कर रहा है, मार्ग के दो बिन्दुओं पर रूकने, यात्रियों को चढ़ाना या उतारना, प्रतिषिद्ध रहेगा, सिवाय ऐसे मार्गों पर जो परिशिष्ट/ उपाबंध- अ. ख एवं समें विनिर्दिष्ट हैं ।

कर बकाया राशि आदि की वसूलीः- मंजिली गाड़ियों / ठेका गाड़ियों, मालयानों या अन्य यानों के लिए गृह राज्य के परिवहन प्राधिकारी अनुज्ञा- पत्र स्वीकृत करते समय पारस्परिक करारकर्ता राज्य के करों एवं बकाया रकम की वसूली के लिए सभी संभव ढंग से सहयोग करेंगे । 9.

राज्यों के नियमों का लागू होना- एक राज्य से दूसरे राज्य में चलते यान (फीस और करों के भुगतान संबंधी प्रावधानों को छोड़कर ) अपने पैतृक राज्य के नियमों एवं विनियमों जहां तक उनके विनिर्माण का संबंध है, से शासित होंगे ।

10. सामान्य.- अस्थायी अनुज्ञा- पत्र जारी करने के लिए साधारण सहमति:-

(क) एतद्वारा यह सहमति है कि दोनों राज्यों के राज्य परिवहन प्राधिकारी इस करार में खण्ड 4, 5 तथा 6 के अनुसरण में आवश्यकतानुसार मोटरयान अधिनियम, 1988 की धारा 88 (1 ) के अधीन प्रतिहस्ताक्षर की अपेक्षा के बिना मालयान और ठेका गाड़ियां (ओमनी बस और मोटर कैब) के लिए अस्थायी अनुज्ञा- पत्र जारी करने के लिए मोटरयान अधिनियम, 1988 की धारा 88 (7) के अधीन साधारण सहमति दे सकेंगे । मध्यप्रदेश राजपत्र , दिनांक 23 अगस्त 2018

(ख) पारस्परिक करारकर्ता राज्य इस करार के निर्बन्धनों के अनुसरण में चल रहे यान के संबंध में टैक्स टोकनों, टैक्स प्रमाण- पत्रों रजिस्ट्रीकरण , प्रमाण-पत्रों, परिचालकों की अनुज्ञप्तियों, परिवहन यान प्राधिकार / बिल्ला स्वस्थता प्रमाण-पत्र के प्रमाण-पत्रों को मान्यता देंगे ।

)عل( यान का भार पारस्परिक करारकर्ता राज्यों में अधिकतम अनुज्ञेय सकल यान भार से अधिक नहीं हो और अनुज्ञापत्रों पर प्रतिहस्ताक्षर करते समय इस करार की शर्त अधिरोपित की जा सकेगी ।

(घ) मोटरयान अधिनियम, 1988 की धारा 115 के अधीन हस्ताक्षरकर्ता राज्यों द्वारा अपने क्षेत्र में लागू किया गया कोई निर्बन्धन दोनों राज्यों के वाहनों के लिए समान रूप से लागू होगा ।

(ङ) (एक) स्थाई अनुज्ञापत्र से आच्छादित वाहन के आकस्मिक रूप से खराब होने की स्थिति में दोनों राज्य रिजर्व मंजिली गाड़ी अनुज्ञापत्र अन्य वाहन को प्रचालन के लिए जारी कर सकेंगे ।

(दो) दोनों राज्यों के परिवहन उपक्रम अपने बेड़े में से स्वामित्व की किसी यान अथवा पट्टा करार के अधीन अनुबंध पर ली गई यान द्वारा किसी मार्ग पर प्रचालन कर सकेंगे , बशर्तें ऐसे यान का पृष्ठांकन राज्य के सक्षम प्राधिकारी द्वारा किया गया हो ।

(च) दोनों राज्यों के सचिव / प्रमुख सचिव, परिवहन की आपसी सहमति से भविष्य में किन्हीं नए मार्गों / फेरों की संख्या में वृद्धि की जाती है तो, वह इस करार के भाग माने जाएंगे ।

(छ) मध्यप्रदेश राज्य सड़क परिवहन निगम की समाप्ति के बाद निगम (उपक्रम) के स्थान पर मध्यप्रदेश राज्य द्वारा नामनिर्दिष्ट संचालक (प्रावयेट संचालक) इन मार्गों पर चल सकेंगे और मध्यप्रदेश राज्य के नामनिर्दिष्ट प्रचालकों द्वारा संचालित बसें जिनके अनुज्ञापत्र मोटरयान अधिनियम, 1988 की धारा 88 (1 ) के अंतर्गत सम्यक् रूप से महाराष्ट्र राज्य द्वारा प्रतिहस्ताक्षरित हैं, महाराष्ट्र राज्य 932 (9) मध्यप्रदेश राजपत्र, दिनांक 23 अगस्त 2018

सड़क परिवहन निगम के बस स्टैण्डों पर पार्किंग के लिए अनुज्ञात रहेंगे ।

(ज) मध्यप्रदेश राज्य के नॉमिनी प्रचालकों द्वारा संचालित होने वाली मंजिली गाड़ियों के लिए मध्यप्रदेश मोटरयान नियम, 1994 में निर्धारित रंग योजना लागू होगी :

परन्तु यह कि मध्यप्रदेश सरकार के नामनिर्देशिती की बसो को विहित रंग योजना के अनुसार रंग नहीं किया गया है उन्हे वैध अनुज्ञापत्र के बिना चलने वाली बसों के रूप में माना जाएगा । (झ) वाहनों से होने वाले पर्यावरण के प्रदूशण को ध्यान में रखते हुए तथा माननीय उच्चतम न्यायालय द्वारा एम.सी. मेहता विरूद्ध भारत सरकार एवं अन्य एआईआर 2002 एससी 1696 एवं इंदौर टैम्पों यूनियन विरूद्ध मध्यप्रदेश शासन याचिका क्रमांक 25198-25199 / 2005 आदेश दिनांक 17 जुलाई, 2006 में पारित आदेशों को दृष्टिगत रखते हुए एवं माननीय उच्च न्यायालय, मुम्बई की याचिका क्रमांक 1762/1999 में पारित आदेश तथा मध्यप्रदेश उच्च न्यायालय , खण्डपीठ, इंदौर द्वारा याचिका क्रमांक 1010/2006 में पारित आदेश दिनांक 22 जनवरी 2007 को ध्यान में रखते हुए दोनों राज्यों में इस बिन्दु पर सहमति है कि:-

(1) यात्री वाहनों के संबंध में परस्पर राज्यों द्वारा जारी व प्रतिहस्ताक्षरित अनुज्ञा ऐसे वाहनों के संबंध में नहीं की जाएगी जिनकी आयु विनिर्माण वर्ष से 10 वर्ष से अधिक है परन्तु इस प्रकार यह इस करार के खण्ड 3 ' ग' के अध्यधीन रहेगा ।

(2) मालयानों के संबंध में अनुज्ञा तथा प्रतिहस्ताक्षर ऐसे मालयानों के लिए जारी नहीं किए जाए जिनकी आयु पंजीयन दिनांक से 12 वर्ष से अधिक हो ।

(ञ) पारस्परिक करार में शामिल ऐसे मार्गों के लिए , जिसमें करारकर्ता राज्यों के अलावा किसी तीसरे राज्य का भाग आता हो, तब तक ऐसी अनुज्ञा जारी नहीं की जाएगी जब तक कि उस संबंध में तीसरे राज्य की सहमति प्राप्त न हो जाए । मध्यप्रदेश राजपत्र , दिनांक 23 अगस्त 2018

(ट) करार के खण्ड (च), (छ) एवं (ज) का उल्लंघन होने पर परमिट का प्रतिहस्ताक्षर निरस्त किया जाएगा और मध्यप्रदेश के नामनिर्दिष्ट प्रचालकों की बसें महाराष्ट्र राज्य परिवहन निगम के बस स्टैण्डों पर प्रवेश हेतु अनुज्ञात नहीं होंगी ।

(ठ) इस करार के अधीन संचालित मंजिली गाड़ियों की बैठक क्षमता गृह राज्य में लागू विधि अनुसार होगी ।

(ड) दोनों राज्यों की बसों का संचालन स्थल एक ही होगा अर्थात् महाराष्ट्र राज्य की बसें मध्यप्रदेश राज्य के बस स्टैण्डों से तथा मध्यप्रदेश राज्य की बसें महाराष्ट्र राज्य के बस स्टेण्डों से, जैसी भी स्थिति हो, संचालित होगी ।

(ढ) परिशिष्ट/ उपाबंध -अ, ब तथा स में विनिर्दिष्ट मार्गों पर स्थाई अनुज्ञाएं निर्धारित फेरों व परमिटों की संख्या अनुसार स्वीकृत की जाएगी किन्तु यदि परिशिष्ट / उपाबंध -अ, ब तथा स में विनिर्दिष्ट मार्गों के लिए स्थाई अनुज्ञापत्र स्वीकृत करने के लिए प्राप्त आवेदनपत्रों का निराकरण किसी कारणवश संभव नहीं है तब उन मार्गों पर निर्धारित फेरों व परमिटों की सीमा के अधीन मोटरयान अधिनियम, 1988 की धारा 87 (1 ) (सी) के अंतर्गत अस्थाई अनुज्ञाएं जारी व प्रतिहस्ताक्षरित की जाए ।

परस्पर सहमति के पश्चात् इस करार के किसी भी खण्ड को संशोधित व कोई नया खण्ड किसी भी समय जोड़ा जा सकता है । (ण)

(त) अंतर्राज्यिक मार्ग पर संचालित किसी राज्य की बस अन्य राज्य के क्षेत्राधिकार में दुर्घटनाग्रस्त होती है, संबंधित राज्य के समीपस्थ डिपो द्वारा देखभाल की जाएगी और घायलों को समीप के अस्पताल में उपचार के लिए ले जाने की आवश्यक व्यवस्थाएं की जाएगी । जो यात्री घायल नहीं हैं और सुरक्षित हैं उनको भेजने की व्यवस्था किसी भी राज्य की संचालित अन्य बस के द्वारा की जाएगी । स्थानीय प्रशासन द्वारा चिकित्सा खर्च यदि कोई है (फाईलों को अस्थाई आर्थिक सहायता) स्थल पर भुगतान किया जाएगा । 932( 11) मध्यप्रदेश राजपत्र, दिनांक 23 अगस्त 2018

(थ) एक राज्य की बस यदि दूसरे राज्य के क्षेत्राधिकार के अंतर्गत खराब हो जाती है तो संबंधित राज्य के समीपस्थ स्थानीय प्रशासन द्वारा उसकी देखभाल की जाएगी । यात्रियों की असुविधा दूर करने के लिए यदि अपेक्षित है तो सहायता बस उपलब्ध कराई जाएगी ।

(द) इस करार के अधीन उभय राज्यों के मंजिली प्रचालकों द्वारा दूसरे राज्य के बसकर्मी दल को विश्राम कक्ष उपलब्ध कराएंगे ।

(ध) किसी राज्य की सम्यक् रूप से प्रतिहस्ताक्षरित परमिट पर प्रचालित मंजिली गाड़ी अन्य करारकर्ता राज्य के बस डिपो में पार्क के लिए अनुज्ञात रहेगी ।

(न ) यह समझौता तब तक प्रभावशील रहेगा जब तक इसका पुनरीक्षण अथवा नया करार ऐसे पुनरीक्षण या निरसन या दोनों राज्यों के द्वारा 3 माह की सूचना देने के पश्चात परस्पर सहमति से विखंडित न किया जाए ।

इस करार में पक्षकारों ने प्रथम ऊपर उल्लिखित दिनांक और वर्ष को इस करार पर हस्ताक्षर कर दिए हैं ।

NOTICE

F 22-16/2018/VIII Whereas the Reciprocal Transport Agreement for grant of and/or countersignature of interstate permit for plying of passenger vehicles and goods vehicles , was executed between the Government of the State of Madhya Pradesh and the Government of the State of Maharashtra and which has been in force since 01 March, 2007

And whereas , the Government of the aforesaid two States further agree to rescind the said agreement and enter into a fresh agreement to regulate the plying of passenger vehicles and goods vehicles on inter - state routes and for grant of and/or countersignature ofinterstate permit for plying such vehicles .

Now, therefore, the following draft agreement, which the Government of Madhya Pradesh has entered into with the Government of Maharashtra in exercise of the powers conferred by sub- section (5 ) of section 88 of the Motor Vehicles act, 1988 (No. 59 of 1988) is hereby published, as required by the said sub-section, for the information of the persons likely to be affected . Notice is hereby given that the said draft agreement will be taken up for consideration on the expiry of 30 days from the date of publication of the Notice in the "Madhya Pradesh Gazette " and the any objection, which may be receive with respect there to , by the Government of Madhya Pradesh before the date specified above, will be considered by the Principal Secretary to the Government of Madhya Pradesh, Transport Department in Room No. 434 Mantralaya, Vallabh Bhawan, Bhopal .

Objection or suggestions if any, should be addressed in duplicate to the Principal Secretary the Government of Madhya Pradesh, Transport Department Mantralaya Vallabh Bhawan, Bhopal-462004 .

This Reciprocal transport Agreement is made at 06-04-2018 between the Government of the state of Maharashtra exercising executive power of the Government of Maharashtra represented by the Principal Secretary (Transport) Home Department having office at Mumbai (hereinafter referred to as Maharashtra State ) (Which expression shall unless repugnant to the context or meaning there of be deemed to include his executors administrators and official assigns ) of the First part: and

The Governor of Madhya Pradesh exercising executive powers of the Government of Madhya Pradesh represented by the Chairman State Transport Authority/Principal Secretary, Government of Madhya Pradesh having office at Bhopal Madhya Pradesh 932( 13) मध्यप्रदेश राजपत्र, दिनांक 23 अगस्त 2018

(hereinafter referred to as Madhya Pradesh State) ( which expression shall unless repugnant to the context or meaning thereof be deemed to include his executors , administers and official assigns) of the Second Part .

Whereas in view of the rapid economic development of the country and the contiguity of the States of Madhya Pradesh and Maharashtra, it is considered expedient to encourage the long distance Inter - State transport of passengers and goods between the said two States and to regulate , co - ordinate and control their operations , the said parties agreed to execute a Reciprocal Transport Agreement.

It is now agreed by and between the above parties as follows : - the That this Reciprocal Transport Agreement shall be enforced from 2018 and shall be valid till such time as a new Agreement between the two States is arrived at or reviewed or the existing one is rescinded after issue of three month notice on either side,

From the coming into force of this Agreement , all previous bilateral agreements in the matter of road transport between the States of Madhya Pradesh and Maharashtra shall stand superseded.

1. Taxation: -

(a) There shall be single point Motor Vehicle Tax in the reciprocating State in respect of stage carriages covered by substantive permits , or temporary permits issued during the pendency of renewals of substantive permits under Section 87 (1 ) ( d) of the Motor Vehicles Act , 1988 , within the agreed routes and countersigned by the other State . There shall be tax on passengers leviable under मध्यप्रदेश राजपत्र, दिनांक 23 अगस्त 2018

the Maharashtra Motor Vehicle ( Taxation of Passengers ) Act , 1958 .

(b) Goods carriages plying on substantive permits , or temporary permits issued during the pendency of renewal of substantive permits under Section 87 ( 1) (d) of the Motor Vehicles Act , 1988 within the agreed quota and countersigned by the other State shall be exempted on single point tax basis in the other State as under : -

(i) If the goods carriage belong to the State of Madhya Pradesh , Motor Vehicle Tax exemption as fixed from time to time by the Government of Maharashtra shall be granted in Chairman , State Transportation / and the balance (i.e. M.V. Tax minus concessional exemption) amount of Motor Vehicle Tax shall be payable for a period of one year in advance and the countersignature shall be valid subject to payment of tax . The aforesaid exemption shall hereinafter be called " reciprocal tax exemption"

(ii) If the goods carriage belong to the State of Maharashtra , Motor Vehicle Tax exemption as fixed from time to time by the Government of Madhya Pradesh shall be granted in Madhya Pradesh and the balance ( i.e. M.V. Tax minus concessional exemption ) amount of Motor Vehicle Tax shall be payable for a period of one year in advance and the countersignature shall be valid subject to payment of tax . The aforesaid exemption shall hereinafter be called " reciprocal tax exemption" .

Explanation : - For the purpose of this Agreement : - 932( 15) मध्यप्रदेश राजपत्र, दिनांक 23 अगस्त 2018

(1) the words " single point of Motor Vehicle Tax" in respect of a stage/ goods carriage covered with a duly countersigned permit means: -

(i) In the case of stage / goods carriage of Madhya Pradesh , the liability of payment of motor vehicle tax in home state , but exemption from Motor Vehicle Tax in the State of Maharashtra . However , the passenger tax in Maharashtra State shall be leviable on stage carriages under the Maharashtra Motor Vehicle Taxation of Passenger Act , 1958 .

(ii) In the case of stage/ goods carriage of Maharashtra , the liability of payment of Motor Vehicle Tax (Road Tax) in home state along with the liability of payment of Motor Vehicle Tax of Madhya Pradesh at concessional rate applicable to the stage / goods carriage of the other States plying under a Reciprocal Agreement as provided in the Madhya Pradesh Motoryan Karadhan Adhiniyam , 1991 .

(2) The words "Double Point Tax" basis in respect of a motor vehicle means the liability of payment of all the taxes including motor vehicle tax / toll in the both the States .

2. Mode of payment of Taxes : -

(a) The permit issuing/ countersigning authority shall ensure that all taxes of the reciprocating State are paid in advance preferably electronically by system of e - payment in force in respective States before any permit (Including temporary permit or Special Permit) is issued . States can authorize any bank to collect the tax electronically in respect of the permits issued for their State .

(b) In the case of Maharashtra , information about all temporary permits and special permits in the following pro - forma shall immediately be sent on a quarterly basis to the Secretary, State Transport Authority , Maharashtra , Mumbai and in the case of Madhya Pradesh , information about all temporary permits / special permits shall be sent to the Secretary , State Transport Authority , Madhya Pradesh , Gwalior on quarterly basis in the following pro - forma: -

3. Goods carriage ( Substantive permits ) : -

(a) It is agreed that the permits for a total 12,000 (Twelve thousand) goods carriages belonging to each State shall be countersigned by the State Transport Authority of the reciprocating State on the recommendations of the State/Regional Transport Authority concerned of the Home State on single point tax basis . Such countersignatures shall be granted by each State for plying the vehicle on all National and State Highways and मध्यप्रदेश राजपत्र, दिनांक 23 अगस्त 2018

932( 17) other public road to enable the vehicle cater to the need of the community of that area except on prohibited routes .

(b) The goods carriages operating under countersignature shall not be used for picking up and setting down of goods between any two points lying exclusively within the territory of the reciprocating State , that is to say vehicles shall be prohibited from carrying on any business of transporting goods exclusively within the territory of the countersigning State and shall be subject to such conditions as the concerned Transport Authority may deem fit to impose under Section 79 and 84 of the Motor Vehicles Act , 1988 .

(c) The age limit for goods vehicle having substantive countersignature permits shall be 12 years from the date of its initial registration . Further , the goods carriage which are more than 8 years old , unless running on CNG / LPG are not allowed to enter the city of Mumbai , as per orders of the Hon'ble High Court , Bombay in the case W.P. No. 1762/1999, 8 years condition is applicable to all transport vehicle viz . Passenger buses & goods carriages .

4. Goods carriage ( Temporary Permits ) : -

(a) There is no limit on number of temporary permits being issued by each State . Subject to the concurrence of both the State Transport Authorities , temporary permits for goods carriages as per need may be issued for a period not exceeding 30 days in each case by either State in accordance with the provisions of Section 87 ( 1 ) or 87 (2 ) of the Motor Vehicles Act , 1988 except on prohibited routes in the reciprocating State , without any restrictions on the number of trips and without countersignature of the Transport Authority of reciprocating State , on the double point tax basis . from Madhya Pradesh State which are more than 8 years old shall not be allowed to enter the city of Mumbai unless they are converted to run on CNG /LPG .

(b) These permits shall be issued subject to the following conditions: -

(i) that no goods shall be picked up or set down between any two points lying wholly within the jurisdiction of the reciprocating State i.e. such vehicle shall be prohibited from doing business exclusively within the territory of the other State .

(ii) that the operator shall abide by the conditions imposed under Section 79 (2) and 84 of the Motor Vehicles Act , 1988 .

5. Contract Carriage Motor Cabs ( Temporary Permits ) and Private Service Vehicle / Educational Institutional Bus : - (a) Subject to the provisions of clause 10 (A) of this agreements temporary permits for contract carriage motor cabs , Private Service Vehicle/ Educational Institutional Buses may be issued as per the need by a Transport Authority of one State for a specified route connecting the specified terminals in the reciprocating States , without the requirement of countersignature by the Transport Authority of the reciprocating State . The validity of such temporary permits shall not exceed a period of thirty days . Motor Vehicle Tax on such temporary permits payable to the other State shall be paid in advance preferably electronically, by the system of e -payment in force in respective States before the permit is issued . Such temporary permit shall be subject to the condition that the vehicle shall be hired by a single party. Further , if validity of the temporary permit issued by one State expires in the territory of other Authority 932( 19) मध्यप्रदेश राजपत्र , दिनांक 23 अगस्त 2018

within whose jurisdiction the vehicle happens to be at that time , it can be extended by such other Authority after the payment of necessary fees and taxes .

(b) Both the States can issue temporary permits for adjoining areas of other State to the private service vehicles /educational institutional bus subject countersignature . to 6. Special Permits : - There shall be no restriction on the number of special permits to be issued under Section 88 (8) of the Motor Vehicles Act , 1988 by the Transport Authorities of either State . Such permits shall normally be valid for a period not exceeding 30 days in the reciprocating State and shall be issued on double point tax basis .

7 . Stage Carriage Services ( Substantive permit) : -

The following general principles are agreed to-

(a) the The Inter State routes for operation of Stage carriage as agreed upon shall be as shown in Appendices /Annexure " A " , "B " and " C" .

(b) The total service distance shall , as far as possible be equally distributed between the two States so as to maintain parity.

(c) mentioned in the A trip for the purposes of this Agreement will mean one single trip . The routes Appendices /Annexure " A " , " B " and " C " shall always mean the shortest direct route connecting terminals lying in the two States passing through the places mentioned and any discrepancy noticed later in the mileage/ KMs , shown in the said Appendix shall promptly be corrected through correspondence between the two State Transport मध्यप्रदेश राजपत्र, दिनांक 23 अगस्त 2018

Authorities and shall not be treated as modification of the Agreement .

(d) Any extension of the portion of an inter State route included in the Appendices / Annexure "A" , " B " and " C" which lies exclusively in one State may be made by the State Transport Authority of that State in respect of services run by operators of that State without prior consultation with the Transport Authority of the other State and the fact shall be intimated to the State Transport Authority of the other State .

(e) Where in the old reciprocity , the route is agreed but in the subsequent reciprocity it has been modified by giving extension , the route agreed to in the old reciprocity shall be treated as agreed route in the revised reciprocity till permits for modified routes are granted by the permit granting authority .

(f) The initial time table shall be fixed by the permit granting authority on purely provisional basis to be valid for a maximum period of four months and shall be countersigned as such , to enable immediate operation of the service . During this period , the countersigning authority shall in consultation with the permit granting authority finalize the time-table .

( g) The maximum fare and freight chargeable shall be as prescribed by the respective State Government for the operation of routes lying within the territory of each State . The form of tickets issued in one State shall be deemed to be valid in the other State .

(h) For the purpose of the respective Motor Vehicle Taxation Acts of both the States and Rules of the reciprocating

State , the fleet owners of one State shall be recognized as fleet owners of the other State .

(i) The operation of stage carriages on the inter State route as per the Appendices / Annexure "A " , " B " and " C" shall be on single point Motor Vehicle Tax as provided in clause 1 of this Agreement.

(j ) It is agreed that the S.T.U. of Maharashtra State and the private operator of M.P. State granted permit as nominee of the State, shall be allowed to divert/curtail services as per traffic passengers need on the routes incorporated in the Reciprocal Transport Agreement subject to the approval of the State Transport Commissioner of the home State . This can be done by mutual consultation of the STU.

(k) The operators of either State operating on the Inter State route shall not halt to pick up or drop passengers within any two points on the inter - state route lying in reciprocating State except as mentioned in Appendices /Annexure " A" , " B" and " C" on the specified routes.

8. Recovery of Arrears of taxes etc : - The Transport Authority of Home States , granting permit to stage carriages , contract carriages , goods carriages or other vehicles shall assist in the recovery of taxes and arrears of reciprocating State in all possible manner .

9. Applicability of States Rule : Vehicles of one State plying in the other State shall be governed by the rules and regulations मध्यप्रदेश राजपत्र, दिनांक 23 अगस्त 2018

(except the provision relating to paying of fees and taxes ) of the home State, so far as their construction etc. is concerned .

10. General: - General concurrence for issue of temporary permits: - (a) It is hereby agreed that State Transport Authorities of both the State may accord general concurrence under section 88 (7) of the Motor Vehicles Act , 1988 for the issuance of temporary permits for goods carriage and contract carriages ( Omni buses and motor cabs) in pursuance of the clauses 4, 5 and 6 of this agreement as per need without the requirement of countersignatures under section 88 (1 ) of the Motor Vehicles Act , 1988 .

(b) The reciprocating State shall accord recognition to tax tokens /tax certificates / registration certificates , conductor's transport vehicles authorization / badges , certificate of fitness in respect of license, the vehicles plying in accordance with the terms of this agreement.

(c) The gross load of the vehicle shall not exceed the maximum permissible gross vehicles weight in the respective State and conditions in this respect be imposed while countersigning the permits .

(d) Any restrictions imposed by the signatory State in its territory under section 115 of the Motor Vehicles Act , 1988 shall equally apply to vehicles of both the States .

(e)

Both the States can grant reserve stage carriage permit for permitting to ply a vehicle in case of any eventual situation in respect of a vehicle covered under regular permit . ( i) 932( 23) मध्यप्रदेश राजपत्र, दिनांक 23 अगस्त 2018

(ii) Both the States can ply any of the vehicles of their fleet which includes any vehicle owned by S.T.U.or taken on lease and it should be endorsed competent authority of the State .

(f) The new routes and trips can be added in future with the consent of both the Secretary / Principal Secretary of the States and this will be deemed as part of the Reciprocal Transport Agreement .

(g) After closure of the MPRTC the nominees of Madhya Pradesh State may ply on the routes which are now opened for nominees of Madhya Pradesh . Further the buses operated by the nominees of Madhya Pradesh State whose permits have been duly countersigned under section 88 ( 1 ) of the Motor Vehicles Act, 1988 by the State of Maharashtra , will only be allowed entry for parking in the bus Station of Maharashtra State Road Transport Corporation .

(h) Colour schemes prescribed under M.P. Motor Vehicles Rules , 1994 shall be applicable for stage carriages operated by the nominee of Govt . of Madhya Pradesh:

Provided that the buses of nominees of the Government of Madhya Pradesh not painted as per the prescribed colour scheme shall be treated as buses plying without a valid permit .

(i) Both States have expressed concerns about pollution caused by motor vehicles . In view of orders passed by Hon'ble Supreme Court in M.C. Mehta v/ s Union of India and others AIR 2002 SC 1696 , and in Indore Tempo Union v/ s Government of M.P. in W.P. No. 25198- 25199/2005 , Order dated 17th July 2006 and order passed by Hon'ble High Court , Mumbai in W.P. No.

1762/1999 and order passed by M.P. High Court , Indore in W.P. No. 1010/2006 , dated 22nd January 2007 is agreed upon : -

(1) that no permit shall be issued or countersigned by any State for passenger vehicles , which is of more than 10 years old from the year of manufacturing , but it will be subject to the restriction under clause 3 ( c) of this agreement .

(2) that in case of goods vehicles the above mentioned age limit shall be 12 years from the date of registration .

(j) The Routes which also cover third State apart from agreeing States will remain in Reciprocal Agreement However , the permits for such routes will be issued only after the consent of the third State .

(k) In case of any breach of clauses (f) , (g) & (h) above , the Countersignature granted to the permits shall be cancelled and buses of Madhya Pradesh nominees shall not be allowed entry in MSRTC bus stands .

(1) The seating capacity of stage carriages operating under this agreement shall be as per law applicable in home State.

(m) The operation point for the buses of both the State shall be same i.e. buses of Maharashtra shall operate from the bus stands of Madhya Pradesh and buses of Madhya Pradesh shall operate from the bus stands of Maharashtra , as the case may be .

(n) Permanent permit shall be granted and issued on the routes mentioned in Appendices /Annexure 'A ' B ' and 'C ' 932(25) मध्यप्रदेश राजपत्र, दिनांक 23 अगस्त 2018

under the fixed number of permits and trips . But if it is not possible for any reason to decide the applications received for grant of permanent permit for the routes mentioned in Appendices / Annexure 'A' B ' and 'C' then temporary permit may be issued and countersigned under Section 87 ( 1 ) (c) of the Motor Vehicle Act, 1988 under the limit fixed for permits and trips on these routes .

(0) Any clause in this Agreement may be amended or a new one added to it at any stage , after mutual agreement .

(p) If the bus of a State plying on inter - state route ; meets with an accident , in the jurisdiction of another State; it should be attended by the local administration of the concerned State , and necessary arrangements of taking injured to the nearby hospital for medical treatment , arrangements of travel of those commuters who are safe and not met with any injury , by other route buses of either State, spot payment ( temporary monitory assistance to the injured) medical expenses if any be made by the administration .

(9) If the bus of one State meets with the break down within the jurisdiction of another State , it should be attended by the nearest local administration of the concerned State . If required relief bus be provided to avoid inconvenience to the passengers .

(r) The stage carriage operators of both State under this Agreement should provide crew rest room for the crews of other State .

(s) The stage carriage bus of either State plying on duly countersignature permit be allowed to be parked in the bus depots and station of reciprocating State .

(t) This Agreement shall remain in force until it is reviewed & the new Agreement come into existence as a result of such review or until it is rescinded by mutual consent on three months notice on either side .
