क्र. एफ- 37-28-2018- बीस-3.- मध्यप्रदेश माध्यमिक शिक्षा अधिनियम, 1965 ( क्रमांक 23 सन् 1965) की धारा 27 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा , मध्यप्रदेश माध्यमिक एवं उच्चतर माध्यमिक शालाओं की मान्यता नियम, 2017 में निम्नलिखित संशोधन करती है, अर्थात्:-
संशोधन
उक्त नियमों में,-
1. नियम 10 में, उपनियम ( 2 ) में, खण्ड ( झ ) के स्थान पर निम्नलिखित खण्ड स्थापित किया जाए, अर्थात्:-
" ( झ ) समय - समय पर विद्यालयों के निरीक्षण के लिए वाहन किराए पर लेने अथवा क्रय करने हेतु. ".
2. नियम 12 में, निम्नलिखित अंतिम वाक्य का लोप किया जाए, अर्थात् :-
" मान्यता समिति का विनिश्चिय अंतिम तथा सोसायटी/ ट्रस्ट पर बंधनकारी होगा . ".
3. नियम 12 के पश्चात्, निम्नलिखित नियम जोड़ा जाए, अर्थात्: -
" 12क. सोसायटी/ट्रस्ट मान्यता समिति के द्वारा मान्यता नवीनीकरण के संबंध में पारित किसी आदेश के विरुद्ध आदेश पारित होने की दिनांक से 30 दिवस की कालावधि के भीतर पुनर्विलोकन हेतु आवेदन प्रस्तुत कर सकेगी. मान्यता समिति किसी आदेश का, जो उसके द्वारा पारित किया गया हो, पुनर्विलोकन कर सकेगी और ऐसा आदेश पारित करेगी जैसा कि वह उचित समझे. मान्यता समिति का विनिश्चिय अंतिम तथा सोसायटी/ट्रस्ट पर बंधनकारी होगा :

परन्तु शैक्षणिक सत्र 2018-19 में मान्यता नवीनीकरण हेतु मान्यता समिति के समक्ष द्वितीय अपील में प्रस्तुत प्रकरणों में पारित आदेश के संबंध में संबंधित सोसायटी/ट्रस्ट द्वितीय अपील में पारित आदेश दिनांक से 45 दिवस के अन्दर पुनर्विलोकन हेतु आवेदन प्रस्तुत कर सकेगी.".
No. F 37-28-2018 -XX- 3.- In exercise of the powers conferred by sub - section ( 1 ) of Section 27 of the Madhya Pradesh Secondary Education Act , 1965 (No. 23 of 1965 ) , the State Government , hereby, makes the following amendments in the "Madhya Pradesh Recognition of Secondary and Higher Secondary Schools Rules ,2017 , namely :-
AMENDMENTS
In the said rules ,-
1. In rule 10 , in sub - rules (2) , for clause (i ) the following clause shall be substituted, namely :-
"(i) To hire or purchase the vehicles for the inspection of schools from time to time. " .
2 . In rule 12, the following last sentence shall be omitted, namely
"The decision of the Recognition Committee will be final and binding upon the Society/Trust . " 3. After rule 12, the following rule shall be added, namely :-
"12(A) Society /Trust may submit application for review of any order passed regarding the renewal of recognition by the recognition committee within the period of 30 days from the date of passing the order. The Recognition Committee will be able to review any order that has been passed by it and will pass such order as it thinks fit . The decision of the Recognition Committee shall be final and binding on the society/trust:
Provided that in respect of order passed in cases presented in second appeal before the recognition committee for renewal of recognition in academic session 2018-19, the concerned society/trust may submit application for review within 45 days from the date of order passed in second appeal . " .
