सूचना
मध्यप्रदेश सिंचाई नियम, 1974 में संशोधन का निम्नलिखित प्रारूप , जिसे राज्य सरकार , मध्यप्रदेश सिंचाई अधिनियम , 1931 (क्रमांक 3 सन् 1931 ) की धारा 40, 92 एवं 93 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, बनाना प्रस्तावित करती है, उक्त अधिनियम की धारा 92 की उप -धारा (3 ) द्वारा यथा अपेक्षित किए गए अनुसार, उन समस्त व्यक्तियों की, जिनके कि उससे प्रभावित होने की संभावना है, जानकारी के लिए , एतद्द्वारा , प्रकाशित किया जाता है और एतद्वारा , यह सूचना दी जाती है कि उक्त संशोधन के प्रारूप पर इस सूचना के मध्यप्रदेश राजपत्र में प्रकाशन की तारीख से तीस दिन का अवसान होने पर विचार किया जाएगा ।
किसी भी ऐसी आपत्ति या सुझाव पर, जो उक्त संशोधन के प्रारूप के संबंध में किसी व्यक्ति से , ऊपर विनिर्दिष्ट कालावधि का अवसान होने के पूर्व या पर अपर मुख्य सचिव, जल संसाधन विभाग, मंत्रालय , वल्लभ भवन, भोपाल को प्राप्त हो, राज्य सरकार द्वारा विचार किया जाएगा ।

प्रारूप संशोधन
उक्त नियमों में, नियम 71 - क में, उप- नियम (3) में,-
(1) खण्ड (ग) , (घ) एवं (ङ) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए, अर्थात्ः-
" (ग ) यदि औद्योगिक इकाई जल आवंटन आदेश के जारी होने की तारीख से 48 माह के भीतर औद्योगिक उत्पादन प्रारंभ नहीं करती है, तो औद्योगिक इकाई वार्षिक आवंटित जल पर देय जलकर तथा उपकर के 5 प्रतिशत के समतुल्य जलकर का भुगतान करेगी । औद्योगिक इकाई को उपरोक्त फीस को एक वार्षिक किस्त में अथवा प्रतिमाह जमा कराने का विकल्प होगा:
परन्तु यह उपबंध मध्यप्रदेश पॉवर जनरेटिंग कम्पनी एवं न्यूक्लियर पॉवर कॉर्पोरेशन ऑफ इण्डिया लिमिटेड को लागू नहीं होगा ।
(घ) यदि औद्योगिक इकाई, जल आवंटन आदेश के जारी होने की तारीख से 72 माह तक या उसके लिए प्राधिकृत तौर पर बढ़ाई गई अवधि में औद्योगिक उत्पादन प्रारम्भ नहीं करती है, तो जल आवंटन आदेश निरस्त समझा जाएगा और उपरोक्त खण्ड (ख) में उल्लिखित प्रतिभूति रकम समपहृत हो जाएगीः
परन्तु यह उपबंध न्यूक्लियर पॉवर कॉर्पोरेशन ऑफ इण्डिया लिमिटेड को लागू नहीं होगा ।
(ङ) औद्योगिक इकाईयों को भिन्न- भिन्न इकाइयों में औद्योगिक उत्पादन प्रारंभ करने के लिए भिन्न-भिन्न तारीखें नियत करने का विकल्प होगाः
परंतु दो ऐसी इकाईयों के मध्य उत्पादन प्रारंभ होने की अवधि में छह माह से अधिक का अंतर न हो, यदि दो ऐसी इकाईयों में औद्योगिक उत्पादन प्रारंभ करने की तारीख अलग-अलग है और वह 6 माह से अधिक हो तो वार्षिक आवंटित जल की कुल मात्रा के 90 प्रतिशत की दर से जल कर एवं उप कर प्रभारित किया जाएगा :

NOTICE
The following draft of amendment in the Madhya Pradesh Irrigation Rules , 1974 , which the State Government proposes to make in exercise of the powers conferred by section 40 , 92 and 93 of the Madhya Pradesh Irrigation Act , 1931 (No. 3 of 1931) is hereby published as required by sub- section ( 3 ) of section 92 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft of amendment shall be taken into consideration on the expiry of thirty days from the date of publication of this notice in the Madhya Pradesh Gazette .
Any objection or suggestion which may be received by the Additional Chief Secretary, Water Resources Department , Mantralaya , Vallabh Bhawan , Bhopal from any person with respect to the said draft of amendment on or before the expiry of the period specified above shall be considered by the State Government .
DRAFT OF AMENDMENT
In the said rules , in rule 71 -A, in sub - rule (3 ) , -
for clause (c) , (d) and (e) , the following clauses shall be substituted , ( 1)
namely: -
"(c) if industrial unit does not start industrial production within 48 months from the date of issue of water allocation order, then the industrial unit shall pay water tax equivalent to 5 % of the water tax and cess payable on the annual allocation of water . The industrial unit shall have the option to deposit the above fees on a monthly basis or in a single annual instalment :

Provided that this provision shall not be applicable to the Madhya Pradesh Power Generating Company and Nuclear Power Corporation of India Limited .
(d) if the industrial unit does not start industrial production upto 72 months from the date of issuance of water allocation order or the authorized extended period therefor , then the water allocation order shall be deemed to be cancelled and the security amount mentioned in above clause (b) shall stand forfeited:
Provided that this provision shall not be applicable to the Nuclear Power Corporation of India Limited .
(e) the industrial units shall have an option to fix different dates for different units to commence the industrial production:
Provided that the difference between the period of commencement of the production in two such units is not more than six months . Ifcommencement dates of starting production in two units is different and is more than 6 months , then the water tax and cess shall be charged at the rate of 90 % of the total quantity of annual allocated water :
Provided further that this provision shall not be applicable to the Nuclear Power Corporation of India Limited . " .
