विभाग में चतुर्थ श्रेणी पदों के लिये संविदा आधार पर भर्ती से संबंधित निम्नलिखित नियम बनाते हैं ,
अर्थात:-
नियम
1- संक्षिप्त नाम, लागू होना तथा प्रारंभः-
(1 ) इन नियमों का संक्षिप्त नाम मध्यप्रदेश पशुपालन चतुर्थ श्रेणी संविदा सेवा (नियुक्ति तथा सेवा की शर्तें ) नियम , 2018 है ।
(2) ये नियम , इन नियमों के अधीन चतुर्थ श्रेणी के पदों पर नियुक्त संवर्ग को लागू होंगे ।
(3) ये नियम मध्यप्रदेश राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे । 2- परिभाषाएंः- इन नियमों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न होः- (क) "नियुक्ति प्राधिकारी" से अभिप्रेत है, संबंधित प्रवर्ग के लिये अनुसूची में वर्णित अधिकारी ,
(ख) "संविदा आधार पर चतुर्थ श्रेणी कर्मचारी" से अभिप्रेत है, इन नियमों के अधीन संविदा आधार पर नियुक्त चतुर्थ श्रेणी कर्मचारी ,
(ग) " संविदा सेवा" से अभिप्रेत है , इन नियमों के अधीन में संविदा आधार पर सेवा, (घ) "संविदा नियुक्ति" से अभिप्रेत है, इन नियमों के अधीन संविदा आधार पर की गई नियुक्ति,
(ड.) "जिला" से अभिप्रेत है , मध्यप्रदेश का राजस्व जिला,
(च) "सरकार" से अभिप्रेत है, मध्यप्रदेश सरकार,
(छ) "विभागाध्यक्ष" से अभिप्रेत है , संचालक, पशुपालन मध्यप्रदेश ,
(ज) "पद" से अभिप्रेत है, अनुसूची- एक के कालम (2) में उल्लिखित पद ,
(झ) "ग्रामीण क्षेत्र" से अभिप्रेत है , नगर पंचायत , नगर पालिका तथा नगर निगम क्षेत्र या क्षेत्र से भिन्न अन्य क्षेत्र , मध्यप्रदेश राजपत्र, दिनांक 27 सितम्बर 2018
1048 ( 1) (ञ) "अनुसूची" से अभिप्रेत है, इन, नियमों से संलग्न अनुसूची ,
(
ट) "चयन समिति" से अभिप्रेत है, संबंधित संवर्ग के लिये अनुसूची- एक में वर्णित समिति,
(চ) "राज्य" से अभिप्रेत है, मध्यप्रदेश राज्य ।
(
3) आयु:- संविदा सेवा के लिये उस वर्ष जनवरी के प्रथम दिन को , जिसमें कि नियुक्ति की जाना है , आयु सीमा 18 वर्ष तथा अधिकतम 40 वर्ष होगी , आयु सीमा में शिथिलीकरण निम्नानुसार होगाः-
5 वर्ष
(1 ) अनुसूचित जाति तथा अनुसूचित जनजाति के लिए
(2)
5 वर्ष
अन्य पिछड़े वर्गों के लिए
(3) विधवाओं के लिये
5 वर्ष
2 वर्ष :
(4) ग्रीन कार्ड धारको के लिए
परन्तु किसी भी स्थिति में आयु सीमा 45 वर्ष से अधिक नही होगी ।
(4) शैक्षणिक अर्हता: -
चतुर्थ श्रेणी संविदा कर्मचारी पद के लिये शैक्षणिक अर्हता इसके साथ संलग्न अनुसूची में विहित की गई है ।

5) नियुक्ति के लिए निरर्हता: -
कोई व्यक्तिः-
(क) जिस ने ऐसे व्यक्ति से विवाह किया है जिसके पहले से जीवित पति या पत्नी हो (ख) जिसकी जीवित पति या पत्नी हो, किसी व्यक्ति से विवाह करते है, सेवा में नियुक्ति के लिये पात्र नही होगें :
परन्तु यह कि राज्य सरकार यदि संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू व्यक्तिगत विधि के अन्तर्गत अनुज्ञेय है तथा ऐसा करने के लिए अन्य आधार हैं, इस उप- नियम के प्रवर्तन से किसी व्यक्ति को छूट दे सकेगी ।
(ग) जो शरीरिक और मानसिक रूप से अक्षम है ।
(घ) जिसे नैतिक अधमता के लिए सिद्धदोष ठहराया गया हो , सेवा में नियुक्ति के लिए पात्र नही होगा :
परन्तु नियुक्ति के पश्चात, नियुक्त व्यक्ति का चरित्र सत्यापन संबंधित पुलिस थाने से मगाया जायेगा तथा नियुक्त व्यक्ति को एक शपथ- पत्र प्रस्तुत करना होगा कि उसके विरूद्ध कोई आपराधिक मामला विधि के किसी न्यायालय में लंबित नही है अथवा कोई प्रथम सूचना रिपोर्ट दर्ज नही है । 1048 ( 2)

(6) भर्ती का तरीका : -
संविदा कर्मचारियों की नियुक्ति निम्नलिखित रीति से की जायेगी , अर्थातः- (1) विज्ञापनः
नियुक्ति प्राधिकारी , राज्य स्तरीय दो समाचार पत्रों में पदों का विज्ञापन करेगा तथा विज्ञापन की प्रति जिला कलेक्टर और जिला पंचायत कार्यालय के सूचना पटल पर भी चस्पा की जायेगी ।
(2) सिफारिशः
(क) चयन समिति, चयनित अभ्यर्थियों के बारे में अपनी अनुशंसा सक्षम प्राधिकारी को प्रस्तुत करेगी तथा चयनित अभ्यर्थियों की सूची की अनुशंसा करते समय यह सुनिश्चित करेगी कि-
(एक) अभ्यर्थी जिला रोजगार कार्यालय में पंजीबद्ध है ।
(दो) अभ्यर्थी संबंधित जिले का मूल निवासी हैः परन्तु यह कि स्थानीय अभ्यर्थियों को प्राथमिकता दी जायेगी । (ख) चयन समिति, प्राप्त आवेदनों की संवीक्षा करेगी और जैसे अनुसूचित जाति, अनुसूचित जनजाति तथा अन्य पिछडे वर्गो के अभ्यर्थियों की एक वर्गवार सूची तैयार करेगीः
परन्तु कुल रिक्तियों के 15 प्रतिशत अभ्यर्थियों को प्रतीक्षा सूची में रखा जायेगाः
परन्तु यह और भी कि श्योपुर, मुरैना, दतिया, ग्वालियर , भिण्ड, शिवपुरी, गुना तथा अशोक नगर जिले के सहारिया जनजाति और बालाघाट, मंडला, डिण्डोरी , शहडोल तथा उमरिया जिले के बैगा जनजाति तथा छिन्दवाडा जिले के तामिया विकासखण्ड के भारिया जनजाति के अभ्यर्थियों को इस नियम में उल्लिखित प्रक्रिया का पालन किए बिना विचार किया जाएगा ।
(ग) नियुक्ति प्राधिकारी , यदि प्राप्त आवेदनों की संख्या अधिक है । चयन प्रक्रिया का विनिश्चय करने के लिए सक्षम होगा ।
आरक्षणः-
(7)
मध्यप्रदेश लोक सेवा (अनुसूचित जातियों , अनुसूचित जनजातियों तथा अन्य पिछडे वर्गों के लिए आरक्षण ) अधिनियम , 1994 (क्रमांक 21 सन् 1994) तथा मध्यप्रदेश लोक सेवा (महिलाओं की नियुक्ति के लिये विशेष उपबन्ध) नियम , 1997 तथा राज्य सरकार द्वारा समय- समय पर जारी आदेश इन पदों पर लागू होगें । 1048 (3)

(8) पदस्थापना तथा संविदा नियुक्ति की कालावधिः-
(1 ) चतुर्थ श्रेणी संविदा कर्मचारियों के लिए न्यूनतम संविदा कालावधि दो वर्ष की होगी ।
(2) नियुक्ति प्राधिकारी , संविदा कालावधि पूर्ण होने के पश्चात , कार्य अनुपालन तथा चरित्र के आधार पर कालावधि को एक वर्ष के लिए बढा सकेगा । (9) अवचार या किसी आपराधिक गतिविधि में शामिल होने पर कार्यवाईः-
नियुक्ति प्राधिकारी , इन नियमों के अधीन नियुक्त व्यक्ति द्वारा किसी अवचार या किसी आपराधिक गतिविधि में शामिल होने पर सुनवाई का उपयुक्त अवसर देने के पश्चात संविदा नियुक्ति समाप्त कर सकेगा ।
(10) संविदा कालावधि के दौरान अनुशासन तथा नियंत्रणः-
इन नियमों के अधीन नियुक्त व्यक्ति, मध्यप्रदेश सिविल सेवा (आचरण) नियम, 1965 द्वारा शासित होगा ।
(11 ) नियंत्रण प्राधिकारीः-
उप संचालक, पशु चिकित्सा सेवाएं , कर्मचारियों के नियंत्रण प्राधिकारी /प्रशासनिक प्राधिकारी होगें तथा संस्था के प्रभारी के माध्यम से कर्मचारी पर नियंत्रण या प्रशासन करेगें ।
(12) अन्य शर्तेः-
(1 ) चयनित अभ्यर्थी, नियुक्ति अधिकारी के साथ रूपये 100/ - के गैर न्यायिक स्टांप पर एक अनुबंध निष्पादित करेगा । अनुबंध का व्यय , चयनित अभ्यर्थी द्वारा वहन किया जाएगा । चयनित अभ्यर्थी , पदस्थापना के स्थान का प्रभार लेने की तारीख से संविदा सेवा में समझा जाएगा ।
(2) नियुक्ति आदेश जारी होने के 15 दिनों के भीतर चतुर्थ श्रेणी संविदा कर्मचारी को पदस्थापना के स्थान पर कार्यभार ग्रहण करना अनिवार्य होगा । यदि वह दी गई कालावधि में कार्यभार ग्रहण में असफल रहता है, तो उसकी नियुक्ति स्वतः निरस्त हो जाएगी । चतुर्थ श्रेणी संविदा कर्मचारी द्वारा कार्यभार ग्रहण करने की सूचना उप संचालक, पशु चिकित्सा सेवा के माध्यम से संयुक्त संचालक, पशु चिकित्सा सेवा को भेजी जाएगी । (13) संविदा नियुक्ति की पदस्थापना तथा कालावधिः-
(1 ) चतुर्थ श्रेणी संविदा कर्मचारियों के लिए न्यूनतम संविदा कालावधि 2 वर्ष की होगी । मध्यप्रदेश राजपत्र, दिनांक 27 सितम्बर 2018

(2) नियुक्ति प्राधिकारी , संविदा कालावधि पूर्ण होने के पश्चात , कार्य अनुपालन तथा चरित्र एवं पिछले वर्ष की सेवा के प्रदर्शन के आधार पर कालावधि को एक वर्ष के लिए बढा सकेगा ।
(14) अवचार पर अनुशासनात्मक कार्रवाई: -
(1 ) निम्नलिखित कृत्यों को गंभीर कदाचार के रूप में समझा जाएगा यदि कर्मचारीः-
(क) न्यायालय द्वारा किसी आपराधिक कृत्य का दोषी पाया जाता है, (ख) अधिकारियों के आदेशों की अवज्ञा करने का दोषी पाया जाता है, (ग) शासकीय सेवा के दौरान नशे की स्थिति में पाया जाता है, (घ) राजनैतिक गतिविधियों में शामिल पाया जाता है,
(ड.) शासकीय कर्तव्य से निरंतर अनुपस्थित पाया जाता है ,
(च) कर्तव्य से 10 दिनों के लिए निरंतर अनुपस्थित रहता है,
(2) निम्नलिखित कृत्यों को सूक्ष्म कदाचार के रूप में समझा जाएगाः- (क) कर्तव्य पर बिलंब से उपस्थिति ।
(ख) बिना सूचना के कर्तव्य से अनुपस्थिति।
(3) गंभीर कदाचरण के लिए , कर्मचारी की सेवा समाप्त की जा सकेगी । सेवा समाप्त करने के दण्ड से दण्डित करने से पहले नैसर्गिक न्याय के नियम का पालन किया जाएगा । नियुक्ति आधिकारी द्वारा सेवा समाप्ति करने से संबंद्ध एक स्पष्ट तथा पूर्ण प्रमाणिक आदेश पारित किया जाएगा । इस आदेश में सेवा समाप्ति के कारणों को उल्लिखित किया जाएगा ।
(4) ऊपर यथा उल्लिखित छोटे कदाचरण की दशा में नियुक्ति प्राधिकारी संविदा वेतन से कटोत्रा कर सकेगा या संविदा वेतन का भुगतान रोक सकेगा । (15) नियंत्रण अधिकारीः-
संस्थान के संबंधित प्रभारी के माध्यम से उप संचालक, पशु चिकित्सा सेवा, संविदा कर्मचारी के नियंत्रक अधिकारी होंगे ।
(16) अन्य निबंधनः-
( 1 ) चयनित अभ्यर्थी, नियुक्ति आदेश प्राप्त करने के पश्चात नियुक्ति अधिकारी के साथ रूपये 100 / - के गैर न्यायिक स्टाम्प पर एक अनुबंध पर हस्ताक्षर करेगा । अनुबंध के खर्चे चयनित अभ्यर्थी द्वारा वहन किए जाएंगे । चयनित अभ्यर्थी पदस्थापना पर प्रभार लेने की तारीख से संविदा सेवा में माना जायेगा । मध्यप्रदेश राजपत्र, दिनांक 27 सितम्बर 2018
1048 ( 5) (2) अभ्यर्थी का चरित्र सत्यापन , शासकीय सेवकों के लिए लागू नियमों के अनुसार किया जाएगा । चरित्र पर अनुचित अभ्युक्तियों के मामले में , नियुक्ति अधिकारी द्वारा बिना कोई कारण बताए नियुक्ति निरस्त कर दी जाएगी ।
(3 ) प्रथम माह का संविदा पारिश्रमिक प्राप्त करने के पूर्व, संबंधित कर्मचारी जिला चिकित्सा बोर्ड के समक्ष स्वयं के व्यय पर चिकित्सीय परीक्षण हेतु उपस्थित होगा । चिकित्सीय अर्हता प्रमाण-पत्र प्राप्त करने के पश्चात्, संविदा नियुक्ति विधिमान्य समझी जाएगी ।
(4) अभ्यर्थी की नियुक्ति, विशिष्ट पशु चिकित्सालय /पशु औषधालय के लिए होगी तथा गैर स्थानांतरणीय होगी ।
(5) अभ्यर्थी कैलेण्डर वर्ष में अधिकतम 13 दिनों का आकस्मिक अवकाश तथा 3 दिन के ऐच्छिक अवकाश का लाभ ले सकेगा । इसके अलावा सरकार द्वारा घोषित सामान्य अवकाश भी लागू होंगे । वह एक समय में अधिकतम 3 दिन का अवकाश ले सकेगा/सकेगी । 2 से कम जीवित बच्चे रखने वाली महिला संविदा चतुर्थ श्रेणी सेवा, को प्रसूति अवकाश लेने का अधिकार होगा। अवकाश स्वीकृत करने की शक्ति , संबंधित उप संचालक, पशु चिकित्सा सेवा को होगी ।
(6) यदि कर्मचारी एक माह से अधिक के लिए कर्तव्य से अनुपस्थित रहता है तो उसकी सेवाएं अनुपस्थिति की तारीख से स्वतः ही समाप्त समझी जाएंगी ।
(7) कर्मचारी को सेवा में नियमित घोषित किए जाने का कोई अधिकार नही होगा ।
(8) कर्मचारी को पेंशन लाभ का कोई अधिकार नही होगा ।
(9 ) कर्मचारी की सेवाएं किसी भी पक्षकार द्वारा एक माह की सूचना या एक माह का संविदा वेतन जमा किए जाने पर समाप्त की जा सकेंगी । मध्यप्रदेश राजपत्र, दिनांक 27 सितम्बर 2018

(जो शपथ - पत्र में सुविधा हेतु द्वितीय पक्षकार से संबोधित होंगे ) अन्य ब्यौरे निम्नानुसार है : -
1- .पद पर यह कि द्वितीय पक्षकार का विभाग के अधीन स्वीकृत. केवल 2 वर्ष या संविधा कालावधि, जो भी पूर्वतर हो, के लिए चयन हुआ है । उसके पश्चात सेवाएं स्वयंमेव समाप्त मानी जाएगी । नियत कालावधि पूर्ण होने के पश्चात द्वितीय पक्षकार सेवा में नियमित होने का पात्र नही होगा । इस स्तर पर सेवा संबंधी किसी भी प्रकार का वाद विवाद या दावा आदि मान्य नही किया जाएगा ।
2- यह कि चयनित द्वितीय पक्षकार को 13 दिन का आकस्मिक अवकाश , 3 दिन का ऐच्छिक अवकाश तथा शासन द्वारा घोषित अन्य सार्वजनिक अवकाश के अतिरिक्त किसी भी प्रकार के अवकाश का कोई अधिकार नही होगा । मध्यप्रदेश राजपत्र, दिनांक 27 सितम्बर 2018

3- यह कि चयनित द्वितीय पक्षकार को शासन के नियमानुसार शासकीय कार्य हेतु यात्रा भत्ता देय होगा । उक्त भत्ते के अतिरिक्त शासन के कर्मचारियों के समान किसी भी प्रकार की अन्य सुविधााओं का लाभ नही दिया जाऐगा और न ही अन्य कोई भत्ते देय होंगे, जिसकी सहमति द्वितीय पक्षकार के द्वारा अनुबंध पत्र पर अपने हस्ताक्षर से प्रदान की जाती है ।
4- प्रथम पक्षकार को द्वितीय पक्षकार की सेवाए बिना सूचना समाप्त करने का अधिकार होगा यदि किसी भी समय अवचार की गंभीर शिकायत , अवांछनीय राजनैतिक गतिविधियों में गठबंधन का दोषी पाया जाता है । अतः प्रथम पक्षकार को उपरोक्त आरोप सिद्ध होने के पश्चात द्वितीय पक्षकार की सेवाएं समाप्त करने का अधिकार होगा तथा जिसके लिए द्वितीय पक्षकार को कोई आपत्ति नही होगी ।
5- संविदा की कालावधि के दौरान यदि द्वितीय पक्षकार किसी गंभीर क्षति को कारित करता है या विकलांग हो जाता है या उसकी मृत्यु हो जाती है, तो द्वितीय पक्षकार के परिवारिक सदस्यों के द्वारा कोई दावा मान्य नही किया जाएगा । उसकी मृत्यु के पश्चात परिवारिक सदस्यों को क्षतिपूर्ति आदि की कोई सेवाएं नही प्रदान की जाएंगी जिसके लिए पर द्वितीय पक्षकार को कोई आपत्ति नही होगी ।
6- यदि द्वितीय पक्षकार संविदा अवधि समाप्त होने के पूर्व या ऐसे ही सेवा त्यागना चाहता है, या उसे ऐसा करने के लिए एक माह पूर्व प्रथम पक्षकार को सूचना देनी होगी अन्यथा द्वितीय पक्षकार को एक माह का संविदा वेतन जमा करना होगा तथा अनापत्ति प्रमाण-पत्र प्राप्त करने के लिए पावती प्राप्त करनी होगी ।
7- यह कि द्वितीय पक्षकार की सेवाएं संतोषजनक नही पाये जाने या अन्य कारणों से, बिना सूचना के किसी भी समय समाप्त की जा सकती है, जिसके लिए द्वितीय पक्षकार को कोई आपत्ति नही होगी । 1048 ( 9)

8- उक्त भर्ती अनुबंध पत्र में यदि कोई तथ्य शेष रह जाता है या प्रथम पक्षकार द्वारा शासकीय नियमों में किसी संशोधन या परिवर्तन के कारण अनुबंध समाप्त किया जाता है तो ऐसी स्थिति में एक अनुपूरक अनुबंध रखा जाएगा , जोकि द्वितीय पक्षकार को मान्य होगा एवं जिस पर हस्ताक्षर करने हेतु द्वितीय पक्षक वचन देता है ।
मैने ऊपर वर्णित अनुबंध की शर्तों को ठीक से पढ़ लिया है । पूर्ण होशोहवास में बिना किसी डर या दवाब के दो गवाहों के समक्ष इस अनुबंध-पत्र पर हस्ताक्षर कर दिए है , ताकि जरूरत पर काम आए ।

No.F-3-2/2013/35 In exercise of the powers conferred by the proviso to article 309 of the Constitution of India , the Governor of Madhya Pradesh , hereby , makes the following rules relating to recruitment of class IV posts for on contract basis in the Animal Husbandry Department , namely : -
RULES
1. Short Title , Application and Commencement : -
(1) . These rules may be called the Madhya Pradesh Animal Husbandry Class IV Contract Service Rules (appointment and service condition ) Rules 2018.
(2) These rules shall apply to the Cadre , appointed on the class IV posts under these Rules.
(3) These rules shall come into force from the date of their publication in the Madhya Pradesh Gazette .
2. Definitions: - In these rules unless the context otherwise requires; - (a) " Appointing Authority " : means an Officer mentioned in the schedule for related cadre;
(b) "Contract basis class IV employee " : means the class IV employees appointed on Contract basis under these rules .
"Contract service" : means service on contract basis under these rules;
(c)
(d) "Contract appointments" : means the appointed made on contract basis under these rules;
"District" : - means revenue district of Madhya Pradesh;
(e)
(f) "Government " : - Means , Government of Madhya Pradesh;
(g) "Head of the Department" : means the Director of Animal Husbandry , Madhya Pradesh ;
"Post"- means post as mentioned in column (2) of schedule-l .
(h)
(i) "Rural areas " : - means the areas other than the area or Nagar Panchayat, Nagar Palika , Municipal Corporation area .
(j ) "Schedule" means schedule appended to these rules;

(k) "Selection Committee " means the committee mentioned in Schedule - I for related cadre;.
(m) "State" - means , the State of Madhya Pradesh .
3. Age : For contract service appointment the minimum age limit as on 1st January of the year wherein the appointment is to be made shall be 18 years and 40 years maximum .
The relaxation in age limit shall be as under: -

Provided that in no case the age limit shall exceed 45Years .
4. Educational Qualification: -
The educational qualification to the post of Class IV Contract employee has been prescribed in the Schedule annexd herewith .
5. Disqualification for appointment-
No Person-
(a) Who has entered into or contracted a marriage with a person having a spouse living ; or .
(b) Who , having a spouse living has entered into or contracted a marriage with any person shall be eligible for appointment to the service:
Provided that the State Government , if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and there are other grounds for doing so exempt any person from the operation of this sub-rule . may (c) who is physically and mentally unfit .
(d) who has been convicted for moral turpitude shall not be eligible for appointment to the service .

shall have to produce an affidavit that no criminal case is pending against him in any court of law or no FIR has been registered.
6. Modeof Appointment-
The appointment of the contract employees shall be made In the following manner , namely: -
(1) Advertisement :
The appointing authority shall advertise the post in Two state level news papers and the copy of advertisement shall also be pasted in the notice board of the District Collector and District Panchayat office .
(2) Recommendation:
(a) the selection committee shall submit its recommendations regarding the selected candidates to the competent authority and while recommending the list of selected candidates shall ensure that.
(i ) the candidates is registered in the district employment office.
( ii) thecandedates is a domicle of the concerned district: Provided that the local candidates shall be given priority.
(b) The selection committee shall made the scrutiny of the applications received and prepare a category wise list i.e Scheduled Castes , Scheduled Tribes and Other Backward Classes candidates:
Provided that 15% candidates of the total vancanceis shall be kept in waiting list.
Provided further that candidates of the Saharia Tribes of Sheopur , Morena , Datia , Gwalior , Bhind , Shivpuri , Guna and Ashoknagar districts and the Baiga Tribes of Balaghat , Mandla , Dindori , Shahdol and Umaria districts , and the Bhariya मध्यप्रदेश राजपत्र, दिनांक 27 सितम्बर 2018
1048 ( 13) Tribe of Tamiya Developmnt Bloc of Chhindwara District shall be considered without following the procedure mentioned in this rule
(c) The appointing authority shall be competent to decide the selection process , if the application received are more in numbers.
7. Reservation-
The provisions of Madhya Pradesh Lok Seva (Anusuchit Jatiyaon , Anusuchit Jan Jatiyon aur Anya Pichhade Vargon ke liye Arakshan ) , Adhiniyam , 1994 ( No.21of 1994) and the Madhya Pradesh Civil Service (special provision for appointment of women ) Rule , 1997. and the orders passed by the State Government from time to time Shall be applicable to these posts.
8. Posting and period of contract appointments :-
(1) . The minimum contract period for class IV contract employees shall be two years.
(2). The appointing authority may extend the period for a year after completion of the contract period on the basis of performance of work and character.
9. Action on misconduct or involvement in any criminal activity- The appointing authority may on any misconduct or involvement in any criminal activity by the person appointed under these rules , terminate the contract appointment after giving a reasonable opportunity of being heard.
10 Disciplinary and control during contract period -
Any person appointed under these rules shall be governed by the Madhya Pradesh Civil Service( Conduct ) Rules ,1965.
11. Controlling Authority-
The Deputy Director of Veterinary Services shall be the controlling authority/administrative authority of the employee and shall control or administer the employee through in - charge of the Institution .

12 Other conditions: -
(1). The selected candidate shall execute an agreement with the appointing officer on a Rs . 100/- Non -Judicial stamp . The expenses of agreement shall be borne by the selected candidate . The Selected candidate shall be deemed to be in contract service from the date of taking charge of the posting place.
(2). Itshall be compulsory for a class IV contract employee to join at the place of posting within 15 days from the issue of appointment order. If He fails to join in given period , his appointment shall be stand cancelled automatically. The intimation of joining by the class - IV contract employee shall be sent to the Joint Director , Veterinary Services through the Deputy Director Veterinary Services .
13. Posting and period of contract appointments
(1). The minimum contract period shall be 2 years for contract class IV employees.
(2). After the completion of contract period , the appointing authority may extend the period for a year on the basis of work done , and his character and presentation of past years service .
14. Disciplinary action on mis - conduct -
(1) The following acts shall be deemed as serious misconduct if the employee is found-.
(a) guilty of any criminal act by the Court.
(b) guilty ofdis- obedience of orders of officers.
(c) in Intoxicated state during Government duty.
(d) involved in political activities.
(e) absent continuosouly from government duty .
(f) Continues absence from duty for 10 days .
(2) The Following acts shall be deemed as small misconduct .
(A) Delayed presence on duty .
(B) Absence from duty without intimation .

(3) For serious misconduct , the employee may be punished by terminating from service . Before punishing by terminating from service, the rule of natural Justice shall be followed . An explicit and a full proof order shall be passed by the appointing officer pertaining to termination from service . In this order, the reason of termination shall be mentioned .
15. Controlling officer- The Deputy Director of Veterinary Service, through concerned in - charge of the institution shall be controlling officer of the contract employee.
16. Other terms-
(1). After receiving the appointment order the selected candidate will sign an agreement with the appointing officer on a Rs . 100/- Non -Judicial stamp. The expenses of agreement would be borne by the selected candidate . Selected candidate would be assumed contract service from the date of taking charge of the posting place.
(2) . The character verification of the candidate shall be be done as per rules applicable for Government servants . In case of un - fair remarks on character, the appointment shall be cancelled by the appointing officer without assigning any reason .
(3) . Before receiving the 1st month's contract wages the concerned employee shall appear before the District Medical Board for medical examination at his/ her own cost After obtaning the medical fitness certificate, the contract appointment shall be treated as legal .
(4) .. candidates appointments shall be made for specific Veterinary Hospital / Veterinary Dispensaries and shall be non -transferrable.
(5) . candidates may avail maximum 13 days casual leave and 3 days optional leave in a calendar year . Apart from this the general holidays declared by the Government would also be applicable . he/she can मध्यप्रदेश राजपत्र, दिनांक 27 सितम्बर 2018

avail maximum 3 days leave at a time . Women contract class IV service having less than 2 childrens alive will have the right to avail the maternity leave. The power to sanction the leaves rests with the concerned Deputy Director of Veterinary Services.
(6).. If employee remain absent from duty for more than a month , his services shall be deemed to be terminated from the date of absence automatically.
(7) . The employee shall have no right to be declared permanent in service .
(8). Theemployee shall have no right for pension benefit .
(9) The services of employee may be terminated by any party by giving one month notice or by depositing 1 month contract salary.

1. That the 2nd party has been selected on the sanctioned postunder the department on Monthly contract wages for 2 years only or for contract period, which ever is earlier . acceptable . No service would be offered in compensation etc. to any family members after his death . for which 2nd party will have no objection .
7. If the 2nd party wants to leave the service before the completion of contract period or so, he will have to give the intimation to the 1st party a month before , otherwise atthe 2nd party will have to deposit one month contract wages , and get the receipt to acquire NOC.
8. That the services of 2nd party if not found satisfactory or due to the other reasons may be terminated without any intimation at any time . for which 2nd party will no objection
9. It any fact remain left in the above recruitment agreement or the agreement is terminated by 1st party due to any amendment or change in government rules , then at this stage supplementary agreement would be placed , which would be agreed by the 2nd party and 2nd party promises to sign in the agreement .
