क्र. 15- वि निर्वा.-चार-2018.- यतः , भारत के संविधान के अनुच्छेद 172 के खण्ड ( 1 ) के उपबन्धों के अनुसार मध्यप्रदेश राज्य की विद्यमान विधान सभा , यदि शीघ्र विघटित न हो , दिनांक 7 जनवरी 2019 को सम्मिलित करते हुये, उस तिथि तक चालू रहेगी और उसके पश्चात् उसकी पदावधि के अवसान पर भंग मानी जाएगी; और

यतः, लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43 ) की धारा 15 की उपधारा ( 1 ) की शर्तों पर राज्य की नई विधान सभा के गठन के प्रयोजन से साधारण निर्वाचन कराया जाना है ;

अतः , अब , लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43 ) की धारा 15 की उपधारा ( 2 ) के अनुसरण में, भारत निर्वाचन आयोग की सिफारिश के अनुसार, मध्यप्रदेश राज्य के राज्यपाल , राज्य के प्रत्येक विधान सभा निर्वाचन क्षेत्र से यह अपेक्षा करते हैं कि वे उक्त अधिनियम के उपबन्धों और तद्धीन बनाए गए नियमों और किए गए आदेशों के अनुसार, राज्य की विधान सभा के लिए सदस्य निर्वाचित करें .

No. 15- vi.Nirva . - IV- 2018.- WHEREAS , in accordance with the provisions of clause ( 1 ) of Article 172 of the Constitution of India , the existing Legislative Assembly of the State of Madhya Pradesh , unless sooner dissolved shall continue upto and including the 7th January, 2019 and shall , thereafter , stand dissolved on the expiration of its duration; and

WHEREAS, in terms of sub - section ( 1 ) of Section 15 of the Representation of the People Act, 1951 (43 of 1951 ) , a General Election has to be held for the purpose of constituting a new Legislative Assembly of the State ;

NOW, THEREFORE , as recommended by the Election Commission of India , in pursuance of sub - section (2) of Section 15 of the Representation of the People Act, 1951 (43 of 1951 ) , the Governor of the State of Madhya Pradesh is hereby pleased to call upon all the Assembly Constituencies in the State , to elect members to the Legislative Assembly of the State , in accordance with the provisions of the said Act and of the rules and orders made thereunder .

अधिसूचना

संख्या 464- म.प्र. - वि.स. 2018.- यतः , मध्यप्रदेश राज्य के राज्यपाल ने लोक प्रतिनिधित्व अधिनियम, 1951 ( 1951 का 43 ) की धारा 15 की उपधारा ( 2 ) के अधीन जारी और 2 नवम्बर 2018 को राज्य के शासकीय राजपत्र में प्रकाशित अधिसूचना के द्वारा राज्य के सभी विधान सभा निर्वाचन क्षेत्रों, में से प्रत्येक से यह अपेक्षा करते हैं कि वे उक्त अधिनियम और तद्धीन बनाए गए नियमों और किए गए आदेशों के उपबन्धों के अनुसार राज्य की विधान सभा के लिए सदस्य निर्वाचित कर दें;

अतः, अब, उक्त अधिनियम की धारा 30 और 56 के अनुसरण में, भारत निर्वाचन आयोग , एतद्वारा :-

प्रत्येक निर्वाचन क्षेत्र से , उक्त निर्वाचन के सम्बन्ध में नियत करता है :-

( अ)

(क) दिनांक 09 नवम्बर , 2018 ( शुक्रवार ) नाम निर्देशन करने की अन्तिम तिथि के रूप.

(ख) दिनांक 12 नवम्बर , 2018 ( सोमवार) नाम निर्देशनों की संवीक्षा की तिथि के रूप .

(ग) दिनांक 14 नवम्बर , 2018 ( बुधवार ) अभ्यर्थिताएं वापस लेने की अन्तिम तिथि के रूप.

(घ) दिनांक 28 नवम्बर, 2018 ( बुधवार ) मतदान की तिथि के रूप

(ङ) दिनांक 13 दिसम्बर, 2018 ( गुरुवार) वह तिथि, जिससे पूर्व निर्वाचन सम्पन्न करा लिया जाएगा ; और (आ) पूर्वाहन 8.00 बजे से अपराह्न 5.00 बजे तक का समय , ऐसे समय के रूप में नियत करता है जिसके दौरान, यदि आवश्यक हुआ तो , बालाघाट जिले में शामिल 108- बैहर ( अ.ज.जा. ) , 109- लांजी और 110- परसवाड़ा नामक 03 ( तीन) 1184(1 )

विधान सभा निर्वाचन क्षेत्रों को छोड़कर शेष सभी विधान सभा निर्वाचन क्षेत्रों में निर्वाचन के लिए उपरोक्त निर्दिष्ट तिथि को, यदि आवश्यक हुआ, मतदान होगा और पूर्वाह्न 7.00 बजे से अपराह्न 3.00 बजे तक का समय ऐसे समय के रूप में नियत करता है जिसके दौरान 108 - बैहर ( अ.ज.जा. ) , 109- लांजी और 110- परसवाड़ा विधान सभा निर्वाचन क्षेत्रों के संबंध में निर्वाचन के लिए उपरोक्त निर्दिष्ट तिथि को यदि आवश्यक हुआ, मतदान होगा.

NOTIFICATION

No. 464 - MP -LA- 2018.- WHEREAS , the Governor of the State of Madhya Pradesh has , by notification issued under sub - section (2) of Section 15 of the Representation of the People Act , 1951 (43 of 1951) , published in the official Gazette of the State on the 2nd November 2018 , been pleased to call upon all the Assembly Constituencies in the State of Madhya Pradesh , to elect members of the Legislative Assembly of the State , in accordance with the provisions of the said Act and of the rules and orders made thereunder ;

NOW, THEREFORE , in pursuance of Sections 30 and 56 of the said Act, the Election Commission of India hereby,-

(A) appoints , with respect to the said election in each of the Constituencies :-

(a) the 9th November , 2018 (Friday ) , as the last date for making nominations ;

(b) the 12th November, 2018 ( Monday) , as the date for scrutiny of nominations ;

(d) the 28th November , 2018 ( Wednesday) , as the date on which a poll shall , if necessary , be taken and;

(e) the 13th December , 2018 ( Thursday ) , as the date before which the election shall be completed; and

(B) Fixes the hours from 8.00 A.M. to 5.00 P.M. as the hours during which the poll shall , if necessary, be taken on the date specified above , for the election in respect of all the Assembly Constituencies except 03 (three) assembly constituencies comprised within the district of Balaghat , namely :- 108- Baihar ( ST) , 109 - Lanji and 110- Paraswada ; and fixes the hours from 7.00 AM to 3.00 PM as the hours during which the poll shall , if necessary, be taken on the date specified above , for the election in respect of 108 - Baihar ( ST) , 109- Lanji and 110 -Paraswada Assembly Constituencies .
