भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए तथा इस निमित्त पूर्व में जारी समस्त अनुदेशों परिपत्रों को अतिष्ठित करते हुए , मध्यप्रदेश के राज्यपाल , एतद्द्वारा , विभागीय परीक्षा के लिए निम्नलिखित नियम बनाते हैं , अर्थात्ः-
नियम
1. संक्षिप्त नाम और प्रारंभ . ( 1 ) इन नियमों का संक्षिप्त नाम मध्यप्रदेश प्रशासनिक सेवा विभागीय परीक्षा नियम , 2018 है ।
(2) ये राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. परिभाषाएं.-(क ) " परिशिष्ट " से अभिप्रेत है , इन नियमों से संलग्न परिशिष्ट;
(ख) "विभाग " से अभिप्रेत है , सामान्य प्रशासन विभाग;
(ग) " विभागीय परीक्षा " से अभिप्रेत है , नियम में यथा उपबंधित विभागीय परीक्षा ;
(घ) " पाठ्यक्रम " से अभिप्रेत है , अनुसूची में यथा विनिर्दिष्ट पाठ्यक्रम ।
3. लागू होना . ये नियम भारतीय प्रशासनिक सेवा के सहायक कलक्टरों तथा राज्य प्रशासनिक सेवा के डिप्टी कलक्टरों को लागू होंगे ।

4. विभागीय परीक्षा की तारीख और स्थान.-
(1 ) भारतीय प्रशासनिक सेवा , मध्यप्रदेश संवर्ग के अधिकारियों के लिए विभागीय परीक्षा , आर.सी.वी.पी. नरोन्हा प्रशासन अकादमी ( जिसे आगे अकादमी कहा जाएगा) में राज्य प्रशिक्षण पूर्ण करने के तत्काल पश्चात् संचालित की जाएगी । (2) राज्य प्रशासनिक सेवा के अधिकारियों के लिए परीक्षाएं परिचयात्मक प्रशिक्षण के तत्काल पश्चात् संचालित की जाएंगी ।
(3) विभागीय परीक्षा प्रत्येक वर्ष कम से कम दो बार समुचित समय पर अकादमी में संचालित की जाएगी ।
5. विभागीय परीक्षा के विषय.-
(क) विभागीय परीक्षा निम्न विषयों में संचालित की जाएंगी , अर्थात्: -
(1 ) प्रशासनिक, राजस्व एवं दाण्डिक विधि एवं प्रक्रिया।
(2) सिविल विधि एवं प्रक्रिया, वित्त एवं लेखा तथा स्थानीय शासन। (3) राजस्व विधि एवं प्रक्रिया आदेश लेखन।
(4) दाण्डिक विधि एवं प्रक्रिया आदेश लेखन।
(5) प्रकरण अध्ययन (केस स्टडी)
(6) हिन्दी (गैर हिन्दी भाषी अधिकारी प्रशिक्षुओं के लिए)
टीप- ऐसे समस्त अधिकारी गैर हिन्दी भाषी समझे जाएंगे -
(एक) जिन्होंने हाईस्कूल ( मैट्रिक ) या उसके समकक्ष परीक्षा हिन्दी माध्यम से या हिन्दी विषय लेकर उत्तीर्ण नहीं की हो, या
(दो) जिनकी मातृ भाषा हिन्दी नहीं हो, या
(तीन) जिन्होंने हाईस्कूल (मैट्रिक) या उसके समकक्ष घोषित की गई हिन्दी की कोई भी परीक्षा उत्तीर्ण नहीं की हो । 1242 ( 1 )

6. विभागीय परीक्षा का पाठ्यक्रम.- (1) विभागीय परीक्षा के लिए पाठ्यक्रम परिशिष्ट-अ में वर्णित किया गया है ।
(2) प्रकरण अध्ययन (केस स्टडी) यह प्रश्न पत्र प्रशिक्षण के दौरान दी गई जानकारी पर आधारित होगा । उक्त आगत से अपनी रुचि के अनुसार चयनित विषय पर केस स्टडी तैयार की जाएगी। जिसका प्रस्तुतीकरण प्रशिक्षण के अंत में किया जाएगा । इस प्रश्न पत्र में 50 प्रतिशत अंक प्राप्त करना अनिवार्य होगा । प्रस्तुतीकरण के सबंध में विस्तृत अनुदेश अकादमी द्वारा आंतरिक रूप से निर्धारित होंगे । इस प्रश्न पत्र में उत्तीर्ण होना अनिवार्य होगा।
7. विभागीय परीक्षा उत्तीर्ण होने का स्तर. उत्तीर्ण होने के लिए निम्नानुसार न्यूनतम अंक अर्जित किए जाने होंगे.-

हिन्दी (गैर हिन्दी भाषी प्रशिक्षु अधिकारियों के लिए)
टीप:-
1. दृष्टि बाधित अभ्यर्थियों को, विभागीय परीक्षा में उत्तीर्ण होने के लिए न्यूनतम अंकों में कालम क्रमांक 05 में यथावर्णित उत्तीर्ण अंकों में 15 अंक ग्रेस के दिए जाएंगे । पूर्णतः दृष्टिबाधित अभ्यर्थियों को परीक्षा में लेखन एवं आवश्यक सहायता उपलब्ध कराने हेतु एक सहायक की अनुमति दी जा सकेगी, किन्तु ऐसा सहायक , अभ्यर्थी के समकक्ष या अधिक शैक्षणिक योग्यता का नहीं होना चाहिए एवं राजस्व सेता का शासकीय कर्मी नहीं होना चाहिए । दृष्टिबाधित अभ्यर्थी को प्रत्येक एक घंटे के लिए 20 मिनट का अतिरिक्त समय दिया जाएगा ।
2. शासकीय सेवक जो विधि स्नातक हैं प्रश्न पत्र 1 के भाग 3 से छूट रहेगी । 3. ऐसे अभ्यर्थी जो नियम 10 तथा नियम 5 ( क) के अनुसार इन नियमों के पूर्व में संचालित परीक्षाओं के अधीन प्रश्नपत्र 1 या प्रश्नपत्र-2 के एक अधिक भागों में छूट के पात्र हैं उनके लिए शेष भाग/ भागों हेतु पूर्णांक के 60 प्रतिशत अंक न्यूनतम उत्तीर्णांक होंगे ।
8 अधिकारियों के लिए वेतनवृद्धियों का विनियमन तथा अनुत्तीर्ण होने पर शास्तियां-
ऐसे अधिकारी , जो प्रश्नपत्रों में उत्तीर्ण करने में असफल रहते हैं , वे राज्य सरकार द्वारा यदा- कदा विभिन्न शास्तियों के अध्यधीन हैं, इसके बारे में प्रचलित ब्यौरे , परिशिष्ट - 1242 ( 3 )

ख में संलग्न हैं, जो मध्यप्रदेश सरकार द्वारा जब कभी आवश्यक हों , संशोधित किए जा सकते हैं ।
9. अभिकरण एवं विभागीय परीक्षा का संचालन -
(क) परीक्षा अकादमी द्वारा आयोजित की जाएगी ।
(ख) परीक्षा अकादमी के नियंत्रणाधीन संचालित की जाएगी।
(ग) प्रश्नपत्रों के समूह को प्राप्त करने तथा मुद्रण , उत्तर पुस्तिकाओं की जांच कराना एवं परिणाम तैयार कराने का शेष दायित्व प्रशासन अकादमी का होगा । (घ) "आदेश लेखन" के प्रश्न पत्र छोड़कर सभी प्रश्न पत्र अंग्रेजी एवं हिन्दी दोनों भाषाओं में तैयार किए जाएंगे। आदेश लेखन के प्रश्न पत्र हिन्दी भाषा में तैयार किए जाएंगे ।
(ङ) प्रश्न पत्र क्रमांक 1 एवं 2 वस्तुनिष्ठ प्रकार के होंगे तथा शेष प्रश्न पत्र विवरणात्मक प्रकार के होंगे ।
(च) प्रारूपण आदेश के प्रश्न पत्र में 70 प्रतिशत अंक प्रारूपण भाग के लिए , तथा 30 प्रतिशत अंक आदेश से सबंधित प्रश्नों के उत्तरों के लिए होंगे । (छ) प्रश्न पत्रों को तैयार किए जाने के दौरान गोपनीयता रखे जाने का सम्पूर्ण दायित्व अकादमी , प्राश्निक ( सेटर) , पारितूलक ( माडरेटर) एवं मूल्यांकनकर्ता (वेल्यूअर) का होगा ।
(ज) अकादमी को परितूलक द्वारा परिवर्तित प्रश्नपत्रों को प्राप्त करने, संशोधन के अनन्य अधिकार होंगे ।
0. इन नियमों से पूर्व उत्तीर्ण परीक्षाओं के लिए छूट: -
पूर्व परीक्षा अनुसूची में 10 प्रश्न पत्र होते थे। जिन अभ्यर्थियों द्वारा इनमें से कुछ प्रश्न पत्र उत्तीर्ण कर लिए गए हैं उनके लिए निम्नानुसार छूट दी जाएगी -

In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and in supersession of all instructions/ circulars issued earlier in this behalf, the Governor of Madhya Pradesh , hereby , makes the following rules for departmental examination , namely: -
RULES
1. Short title and commencement-
(1) These rules may be called the Madhya Pradesh Administrative Service Departmental Examination Rules , 2018.
(
2) They shall come into force from the date of their publication in the Gazette.
2. Definitions-
" Appendix " means appendix appended to these rules;
(a)
(b) " Department " means the GAD;
(c ) " Departmental Examination " means Departmental Examination as provided in rule;
(d) " Syllabus " means syllabus as specified in Schedule.
3. Application- These rules shall apply to the Assistant collectors of Indian administration Service and Deputy Collector of State Administrative Service.
4. Date and Venue of the Departmental Examination
(1) Departmental Examination for officers of Indian Administrative Service , Madhya Pradesh Cadre will be conducted in RCVP Noronha Academy ( hereafter , to be called as Academy ) of Administration just after the completion of state training .

(2) Examination for officers of State Administrative Service shall be conducted just after the completion of induction training .
(3 ) Departmental examination will be conducted in the Academy every year at least twice on appropriate time .
5. Subjects of Departmental Examination -
(a) The Departmental Examination shall be conducted in the following subjects , namely: -
(1 ) Administrative , Revenue , and Penal Law and Procedure.
(2) Civil Law and Procedure , Finance and Accounts and Local Government .
(3) Revenue Law and Procedure - Order Writing .
(4) Penal Law and Procedure - Order Writing.

Note - All such officers shall be deemed non Hindi speaking-
(i) Who has not passed matriculation or equivalent examination inHindi medium or with Hindi as a subject or ,
Whose mother tongue is not Hindi , or,

(iii ) Who has not passed any of the examinations of Hindi , declared as equivalent to Matriculation.
5. Syllabus of the Departmental Examination
( 1) Syllabus of departmental examination has been described in appendix -A.
(2) Case Studies This paper shall be based on the information provided during the training . Case studies shall be done selecting 1242 ( 13 )

the topic according to one's interest from the said inputs . Which shall be presented towards the end of training . Securing 50 % of marks shall be compulsory in this paper. Comprehensive instructions regarding presentation shall be determined internally at the Academy . To qualify this paper shall be compulsory

Note
1. For the visually impaired candidates , 15 grace marks will be given in the minimum pass marks as mentioned in column no . 5 , for passing departmental examination . The completely visually impaired candidates may be allowed an assistant for writing the examination, and provide necessary assistance , but such assistant should not have educational qualification equal to or more than the candidate and should not be the government servant of revenue service . Visually impaired candidate shall be given 20 minutes of extra time for each hour.
2. The govt . servants who are Law Graduates shall be exempted from section 3 of Question Paper - 1.
3. For the candidates who are eligible for exemption from one or more sections of question paper -1 or question paper -2 under the examination conducted prior to these rules in accordance with rule -10 and rule 5 (a) , minimum pass mark shall be 60% of the maximum marks for remaining section/sections .

The Regulation of increments and penalties on failing for officers officers who fail to qualify the papers , are subject to different penalties by the state Government occasionally . The current details regarding it , is enclosed in appendix - B , which may be amended by the Madhya Pradesh Government as and when necessary .
9. Agency and conduct of the Departmental examination-
Examination shall be organised by Academy .
(a)
Examination shall be conducted under the control of Academy .
(b)
(c) The responsibilities of getting the question papers set and printed , answer books checked and results prepared shall rest with the Administration Academy .

(d) All question papers except " Order Writing " question paper shall be prepared in both the languages English and Hindi . Order Writing question paper shall be prepared in Hindi language .
(e) The Question Paper No.1 and 2 shall be Objective Type , and rest of the question papers shall be descriptive type .
(f) The question paper of Drafting Order shall have 70 % marks for drafting parts , and 30% marks for answering the questions related to order .
(g) The entire responsibility of maintaining confidentiality in the preparation of question papers shall be that of the Academy , the Setter , the Moderator, and the Valuer .
(h) The Academy shall have the exclusive right to get the question papers moderated , amendment by the moderator.
10 . Exemption for examinations cleared prior to these rules- There were 10 question papers in earlier examination schedule . The candidates who have passed some of these question paper shall be given exemption as described below.-
