मध्यप्रदेश सिंचाई अधिनियम, 1931 (क्रमांक 3 सन् 1931 ) की धारा 40, 92 एवं 93 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार, एतद्वारा , मध्यप्रदेश सिंचाई नियम, 1974 में निम्नलिखित संशोधन करती है, जो उक्त अधिनियम की धारा 92 की उप-धारा (3 ) द्वारा अपेक्षित किए गए अनुसार पूर्व में प्रकाशित किये जा चुके हैं, अर्थात्:-

उक्त नियमों में, नियम 71 - क में, उप नियम (3) में, -
(1) खण्ड (ग) , (घ) एवं (ङ) के स्थान पर, निम्नलिखित खण्ड स्थापित किए जाएं,
अर्थात्:-
"(ग) यदि औद्योगिक इकाई जल आबंटन आदेश के जारी होने की तारीख से 48 माह के भीतर औद्योगिक उत्पादन प्रारंभ नहीं करती है , तो औद्योगिक इकाई जल के वार्षिक आबंटन पर देय जल कर तथा उपकर के 5 प्रतिशत के समतुल्य जल कर का भुगतान करेगी । औद्योगिक इकाई को उपरोक्त फीस जल के मासिक आधार पर या एक वार्षिक किस्त में जमा करने का विकल्प होगा: 55 56

परन्तु यह उपबंध मध्यप्रदेश पॉवर जनरेटिंग कम्पनी एवं न्यूक्लियर पॉवर कॉर्पोरेशन ऑफ इण्डिया लिमिटेड को लागू नहीं होगा ।
(घ) यदि औद्योगिक इकाई , जल आबंटन आदेश के जारी होने की तारीख से 72 माह या उसके लिए प्राधिकृत तौर पर बढ़ाई गई अवधि तक औद्योगिक उत्पादन प्रारम्भ नहीं करती है, तो जल आबंटन आदेश निरस्त समझा जाएगा और उपरोक्त खण्ड (ख) में उल्लिखित प्रतिभूति रकम समपहृत हो जाएगी:
परन्तु यह उपबंध न्यूक्लियर पॉवर कॉर्पोरेशन ऑफ इण्डिया लिमिटेड को लागू नहीं होगा ।
(ङ) औद्योगिक इकाइयों को भिन्न-भिन्न इकाइयों के लिए औद्योगिक उत्पादन प्रारंभ करने हेतु भिन्न-भिन्न तारीखें नियत करने का विकल्प होगा:
परन्तु दो ऐसी इकाइयों में उत्पादन के प्रारंभ होने की अवधि के मध्य अंतर छह माह से अधिक का न हो । यदि दो इकाइयों में औद्योगिक उत्पादन प्रारंभ करने की तारीखें भिन्न- भिन्न हों और वह 6 माह से अधिक हों तो जल कर एवं उपकर वार्षिक आबंटित जल की कुल मात्रा के 90 प्रतिशत की दर से प्रभारित किया जाएगा:
परन्तु यह और कि यह उपबंध न्यूक्लियर पॉवर कॉर्पोरेशन ऑफ इण्डिया लिमिटेड को लागू नहीं होगा । " । मध्यप्रदेश राजपत्र, दिनांक 16 जनवरी 2018
56 (1) No. 18-01-91- Medum - XXXI - 04
In exercise of the powers conferred by Sections 40 , 92 and 93 of the Madhya Pradesh Irrigation Act, 1931 (No. 3 of 1931), the State Government, hereby, makes the following amendment in the Madhya Pradesh Irrigation Rules , 1974, the same having been previously published as required by sub - section (3 ) of Section 92 of the said Act, namely : -
AMENDMENT
In the said rules, in rule 71 -A, in sub - rule (3 ), -
(1) for clause (c), (d) and (e), the following clauses shall be substituted, namely : - "(c) if industrial unit does not start industrial production within 48 months from the date of issue of water allocation order , then the industrial unit shall pay water tax equivalent to 5% of the water tax and cess payable on the annual allocation of water . The industrial unit shall have the option to deposit the above fees on a monthly basis or in a single annual instalment:
Provided that this provision shall not be applicable to the Madhya Pradesh Power Generating Company and Nuclear Power Corporation of India Limited.
(d) ifthe industrial unit does not start industrial production upto 72 months from the date of issuance of water allocation order or the authorized extended period therefore , then the water allocation order shall be deemed to be cancelled and the security amount mentioned in above clause (b) shall stand forfeited:
Provided that this provision shall not be applicable to the Nuclear Power Corporation of India Limited.

(e) the industrial units shall have an option to fix different dates for different units to commence the industrial production:
Provided that the difference between the period of commencement of the production in two such units is not more than six months . If commencement dates of starting production in two units are different and is more than 6 months , then the water tax and cess shall be charged at the rate of 90% of the total quantity of annual allocated water:
Provided further that this provision shall not be applicable to the Nuclear Power Corporation of India Limited . " .
