अधिसूचना

क्र. एफ- 44-10/2016/20-2 :: मध्यप्रदेश राज्य मुक्त स्कूल शिक्षा परिषद्, भोपाल के ज्ञापन 1995 के नियम 15 (15.2) एवं 16(16.1 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , परिषद्, एतद्वारा , परिषद् के कर्मचारियों की भर्ती तथा सेवा शर्तों से संबंधित निम्नलिखित विनियम बनाती है, अर्थात्ः-

विनियम

1. संक्षिप्त नाम और प्रारंभ :-

(1) इन विनियमों का संक्षिप्त नाम मध्यप्रदेश राज्य मुक्त स्कूल शिक्षा परिषद्(भर्ती तथा सेवा की शर्तें) विनियम, 2018 है ।

(2) ये मध्यप्रदेश राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. परिभाषाएं:-

इन विनियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो :-

(क) सेवा के संबंध में " नियुक्ति प्राधिकारी " से अभिप्रेत है , अनुसूची- एक में उल्लिखित प्राधिकारी;

(ख

) "अध्यक्ष" से अभिप्रेत है, राज्य मुक्त स्कूल शिक्षा परिषद् के कार्यपालिक समिति का अध्यक्ष;

(ग) "समिति" से अभिप्रेत है, इन विनियमों के अधीन भर्ती तथा पदोन्नति हेतु अनुसूची-तीन तथा अनुसूची - चार में उल्लिखित समिति;

( घ) "प्रतियोगिता परीक्षा एवं चयन प्रक्रिया " से अभिप्रेत है, इन विनियमों के अधीन भर्ती हेतु आयोजित प्रतियोगिता परीक्षा एवं चयन प्रक्रिया;

"संचालक" से अभिप्रेत है , राज्य मुक्त स्कूल शिक्षा परिषद् का संचालक;

(ङ)

(च) "कार्यपालिक समिति" से अभिप्रेत है, राज्य मुक्त स्कूल शिक्षा परिषद् की कार्यपालिक समिति;

"शासन " से अभिप्रेत है , मध्यप्रदेश शासन ;

(छ)

(ज) "अन्य पिछड़ा वर्ग " से अभिप्रेत है, राज्य सरकार की अधिसूचना क्रमांक ए-8-5/पच्चीस-4-48 दिनांक 26 दिसम्बर, 1984 द्वारा समय - समय पर यथाविनिर्दिष्ट नागरिकों के अन्य पिछड़े वर्ग;

(झ) "पद" से अभिप्रेत है, राज्य मुक्त स्कूल शिक्षा परिषद् मंडल के अधीन पूर्णकालिक सेवा के पद किन्तु उनमें ऐसे नियोजन सम्मिलित नहीं है जहां कर्मचारियों का भुगतान आकस्मिकता निधि से होता है ;

(

ञ) "विनियम" से अभिप्रेत है, मध्यप्रदेश राज्य मुक्त स्कूल शिक्षा परिषद् के विनियम, 2018;

(ट) "नियम" से अभिप्रेत है, मध्यप्रदेश राज्य मुंक्त स्कूल शिक्षा परिषद् ज्ञापन तथा नियम, 1995;

"अनुसूची" से अभिप्रेत है, इन विनियमों से संलग्न अनुसूची;

(ड

) " अनुसूचित जाति" से अभिप्रेत है, किसी जाति मूलवंश या जनजाति या किसी जाति, मूलवंश या जनजाति के भाग या किसी जाति, मूलवंश या जनजाति के भीतर के समूह जोकि भारत के संविधान के अनुच्छेद 341 के अधीन मध्यप्रदेश राज्य के संबंध में अनुसूचित जाति के रूप में विनिर्दिष्ट किया गया है;

(ढ़) "अनुसूचित जनजाति " से अभिप्रेत है किसी जनजाति, जनजाति समुदाय या किसी जनजाति या जनजाति समुदाय का भाग या किसी जनजाति समुदाय के भीतर के समूह जोकि भारत के संविधान के अनुच्छेद 342 के अधीन मध्यप्रदेश राज्य के संबंध में अनुसूचित जनजाति के रूप में विनिर्दिष्ट किया गया है;

(ण) "सेवा " से अभिप्रेत है, मध्यप्रदेश राज्य मुक्त स्कूल शिक्षा परिषद् सेवा;

(त) "राज्य" से अभिप्रेत है , मध्यप्रदेश राज्य;

(थ) "राज्य मुक्त स्कूल शिक्षा परिषद् " से अभिप्रेत है , मध्यप्रदेश राज्य मुक्त स्कूल शिक्षा परिषद्।

3. विस्तार तथा लागू होनाः-

मध्यप्रदेश सिविल सेवा (सेवा की सामान्य शर्तें) नियम, 1961 में अन्तर्विष्ट उपबंधों की व्यापकता पर प्रतिकूल प्रभाव डाले बिना, ये विनियम सेवा के प्रत्येक कर्मचारी पर लागू होंगे ।

4. सेवा का गठनः-

सेवा निम्नलिखित व्यक्तियों से मिलकर गठितहोगी, अर्थात्:-

(1 ) ऐसे व्यक्ति जो इन विनियमों के प्रारंभ होने के समय अनुसूची - एक में विनिर्दिष्ट पदों को मूलरूप से या स्थानापन्न रूप से या प्रतिनियुक्ति पर धारण करते हैं । (2) इन विनियमों के प्रारंभ होने से पूर्व सेवा में भर्ती किए गए व्यक्ति ।

(3) इन विनियमों के उपबंधों के अनुसार सेवा में भर्ती या पदोन्नत किए गए व्यक्ति । 5. वर्गीकरण तथा वेतनमान आदिः-

सेवा का वर्गीकरण , उसके लिए वेतनमान तथा उसमें सम्मिलित पदों की संख्या अनुसूची- एक में दिए गए उपबंधों के अनुसार होंगीः परन्तु, राज्य मुक्त स्कूल शिक्षा परिषद् सेवा में सम्मिलित पदों की संख्या में समय - समय पर स्थाई या अस्थाई रूप से वृद्धि या कमी कर सकेगा ।

6. भर्ती की तरीकाः-

(1 ) इन विनियमों के प्रारंभ होने के पश्चात् सेवा में भर्ती निम्नलिखित तरीकों से की जाएगी:-

(क) प्रतियोगिता परीक्षा के माध्यम से सीधी भर्ती या चयन द्वारा;

(ख) सेवा के कर्मचारियों की पदोन्नति द्वारा (अनुसूची- चार के कॉलम (3) में यथा विनिर्दिष्ट);

(ग) ऐसे व्यक्तियों के स्थानांतरण द्वारा, जो राज्य मुक्त स्कूल शिक्षा परिषद् सेवा में मूलरूप से/ स्थानापन्न या स्थायी रूप से उक्त पद धारण करता हों । मध्यप्रदेश राजपत्र, दिनांक 6 फरवरी 2019

(2) उपरोक्त उप- विनियम (1 ) के खण्ड (ख) एवं (ग) के अधीन भर्ती किए गए व्यक्तियों की संख्या किसी भी समय, अनुसूची- एक में उल्लिखित पदों की संख्या, के अनुसूची- दो में दर्शाई गई प्रतिशतता से अधिक नहीं होगी ।

(3) इन विनियमों के उपबंधों के अध्यधीन रहते हुए , सेवा में किसी विशेष अवधि के दौरान भरे जाने के लिए अपेक्षित सेवा की किसी भी विशिष्ट रिक्त या रिक्तियों को भरने के प्रयोजन के लिए अपनाया जाने वाला भर्ती का तरीका या तरीके तथा प्रत्येक तरीके द्वारा भर्ती किए जाने वाले व्यक्तियों की संख्या प्रत्येक अवसर पर सरकार के परामर्श से नियुक्त प्राधिकारी द्वारा अवधारित की जाएगी ।

(4) उप-विनियम (1 ) में अंतर्विष्ट किसी बात के होते हुए भी, यदि संचालक की राय में सेवा की अत्यावश्यकताओं को देखते हुए ऐसा करना अपेक्षित हो , तो अध्यक्ष की पूर्व सहमति के साथ उक्त उप - विनियम में विनिर्दिष्ट सेवा में भर्ती के उन तरीकों से भिन्न, ऐसे तरीकों को, जिन्हें इस निमित्त जारी किए गए आदेश द्वारा विहित किया जाए , अपना सकेगा ।

7. सेवा में नियुक्तिः-

इन विनियमों के प्रारंभ होने के पश्चात् सेवा में समस्त नियुक्तियां, नियुक्ति प्राधिकारी द्वारा की जाएगी और ऐसी नियुक्ति विनियम 6 में उल्लिखित भर्ती के तरीकों में से किसी एक तरीके द्वारा चयन करने के बाद ही की जाएगी ।

8. सीधी भर्तीके लिए अभ्यर्थियों की पात्रता कीशर्तें:-

(1) आयुः

परीक्षा /चयन में स्पर्धा के लिए पात्र होने के क्रम में अभ्यर्थी को निम्नलिखित शर्तें पूरी करनी हांगीअर्थात्: -

(क) परीक्षा/ चयन वर्ष प्रारंभ होने की तिथि से आगामी जनवरी के प्रथम दिन को उसने अनुसूची-तीन के कॉलम (3) में विनिर्दिष्ट न्यूनतम आयु पूर्ण कर ली हो किन्तु, उक्त अनुसूची के कॉलम (4 ) में बिनिर्दिष्ट अधिकतम आयु पूर्ण न की हो ।

(ख) अभ्यर्थियों के संबंध में , जो मध्यप्रदेश राज्य मुक्त स्कूल शिक्षा परिषद् के कर्मचारी हैं या रह चुके हैं, उच्चतर आयु सीमा नीचे विनिर्दिष्ट की गई सीमा तथा शर्तों के अध्यधीन रहते हुए , शिथिलनीय होगी:-

(एक) अभ्यर्थी, जो छंटनी किया गया मुक्त स्कूल कर्मचारी हो उसे, उसकी आयु में से उसके द्वारा पहले की गई संपूर्ण अस्थाई सेवा की अवधि से अधिक से अधिक 7 वर्ष तक की अवधि, भले ही वह अवधि एक से अधिक बार की गई सेवाओं के कारण हो, कम करने के लिए अनुज्ञात किया जाएगा:

परंतु उसके परिणामस्वरूप जो आयु निकले वह अधिकतम आयु सीमा से 3 वर्ष से अधिक न हो ।

स्पष्टीकरण:-

शब्द छंटनी किए गए मुक्त स्कूल कर्मचारी से द्योतक है ऐसा व्यक्ति जो इस संस्था अथवा संस्था की संघटक इकाई की अस्थाई सेवा में कम से कम छह 96 (3)

माह तक निरन्तर रहा हो तथा जो रोजगार कार्यालय में अपना पंजीयन कराने अथवा राज्य ओपन स्कूल सेवा में नियोजन हेतु अन्यथा आवेदन पत्र करने की तारीख से अधिकतम 3 वर्ष पूर्व कर्मचारियों की संख्या में कमी किए जाने के कारण सेवामुक्त किया गया हो ।

(दो) ऐसा अभ्यर्थी, जो भूतपूर्व सैनिक हो, उसे अपनी आयु में से उसके द्वारा पहले की गई समस्त सेवा की अवधि कम करने के लिए अनुज्ञात किया जाएगा । बशर्ते कि इसके परिणाम स्वरूप जो आयु निकले वह अधिकतम आयु से तीन वर्ष से अधिक न हो ।

स्पष्टीकरण:-

शब्द "भूतपूर्व सैनिक " से द्योतक है ऐसे व्यक्ति, जो निम्नलिखित प्रवर्गों में से किसी एक प्रवर्ग में रहा हो तथा जो भारत सरकार के अधीन कम से कम छह माह की अवधि तक निरन्तर सेवा करता रहा हो तथा जिसका किसी भी रोजगार कार्यालय में अपना पंजीयन कराने अथवा मध्यप्रदेश राज्य मुक्त स्कूल शिक्षा परिषद् सेवा में नियोजन हेतु अन्यथा आवेदन करने की तारीख से अधिक से अधिक तीन वर्ष पूर्व मितव्ययिता इकाई की सिफारिशों के फलस्वरूप अथवा कर्मचारियों की संख्या में सामन्य रूप से कमी की जाने के कारण छंटनी की गई हो अथवा जो आवश्यक कर्मचारियों की संख्या से अधिक घोषित किया गया हो ।

(1) ऐसे भूतपूर्व सैनिक जिन्हें समय पूर्व सेवानिवृत्ति रियायतों (मस्टरिंग आऊट कन्सेशन) के अधीन सेवा मुक्त कर दिया गया है ।

( 2) ऐसे भूतपूर्व सैनिक जिन्हें दोबारा भर्ती किया गया हो ; और

(क) नियुक्ति की अल्पकालीन अवधि पूर्ण हो होने पर ;

(ख) भर्ती संबंर्धी शर्तें पूर्ण हो जाने पर सेवामुक्त कर दिया गया हो ।

(3) मद्रास सिविल इकाई (यूनिट) के भूतपूर्व सैनिक ।

(4) ऐसे अधिकारी (सैनिक अथवा असैनिक), (जिसमें अल्पावधि सेवा नियमित कमीशंड अधिकारी भी सम्मिलत हैं) जिन्हें उनकी संविदा पूर्ण होने पर सेवोन्मुक्त किया गया है ।

(5) ऐसे अधिकारी , जिन्हें अवकाश रिक्तियों पर छह माह से अधिक समय तक निरंतर कार्य करलेने के पश्चात् सेवोन्मुक्त किया गया हो ।

(6) ऐसे भूतपूर्व सैनिक, जिन्हें अशक्त होने के कारण सेवोन्मुक्त कर दिया गया हो ।

(7) ऐसे भूतपूर्व सैनिक, जिन्हें इस आधारपर सेवोन्मुक्त कर दिया गया हो कि वे दक्ष सैनिक बनने के योग्य नहीं रहे ।

(8) ऐसे भूतपूर्व सैनिक, जिनको गोली लग जाने के परिणामस्वरूप घाव आदि हो जाने के कारण चिकित्सीय आधार पर सेवा से अलग कर दिया गया हो ।

(घ) मध्यप्रदेश सिविल सेवा (महिलाओं की नियुक्ति के लिए विशेष उपबंध) नियम, 1997 के अनुसार महिला अभ्यर्थियों के मामले में सामान्य अधिकतम आयु सीमा नियमानुसार शिथिलनीय होगी । मध्यप्रदेश राजपत्र, दिनांक 6 फरवरी 2019

(ड) जनजाति, अनुसूचित जाति तथा पिछड़ा वर्ग कल्याण विभाग के अंतर्जातीय विवाह प्रोत्साहन योजना के अधीन किसी दम्पत्ति में से उच्चतर जाति के पुरस्कृत पति या पत्नी के मामले में सामान्य आयु सीमा में नियमानुसार छूट दी जाएगी ।

(च) उन खिलाड़ी अभ्यर्थियों के संबंध में, जिन्होंने " विक्रम पुरस्कार" प्राप्त किया हो सामान्य उच्चतर आयु सीमा में नियमानुसार छूट दी जाएगी ।

(छ) अनारक्षित / आरक्षित महिला / पुरुष, शासकीय निगम / मण्डल / स्वशासीसंस्था के कर्मचारी तथा नगर सैनिक/ निःशक्तजनों के संबंध में अधिकतम आयु सीमा में छूट सामान्य प्रशासन विभाग द्वारा जारी निर्देशों के अनुसार होगी । शैक्षणिक अर्हताएं :-

(2)

अभ्यर्थी के पास, सेवा के लिए विहित शैक्षणिक अर्हताएं होनी चाहिए ।

(3) फीसः अभ्यर्थी को नियुक्ति प्राधिकारी द्वारा विहित फीस का भुगतान करेगा । 9. निरर्हताः-

(1 ) अभ्यर्थी की ओर से अपनी अभ्यर्थिता के लिए किन्हीं भी साधनों द्वारा समर्थन अभिप्राप्त करने के लिए किसी भी प्रयास को, नियुक्ति प्राधिकारी / आयोग द्वारा परीक्षा चयन के लिए निरर्हता माना जा सकेगा ।

(2) कोई भी अभ्यर्थी, जिसकी दो से अधिक जीवित संतान हों, जिसमें से एक का जन्म 26 जनवरी, 2001 या उसके पश्चात् हुआ हो, किसी सेवा या पद के लिए पात्र नहीं होगा:

परन्तु कोई भी अभ्यर्थी, जिसकी पहले से एक जीवित संतान है तथा आगामी प्रसव 26 जनवरी , 2001 को या उसके पश्चात् हुआ हो , जिसमें दो या दो से अधिक संतान का जन्म होता है, किसी सेवा या पद पर नियुक्ति के लिए निरर्हित नहीं होगा ।

(3) कोई भी अभ्यर्थी, जिसे महिलाओं के विरूद्ध किसी अपराध का सिद्धदोष ठहराया गया हो , सेवा में या पद पर नियुक्ति के लिए पात्र नहीं होगा ।

(4) कोई भी अभ्यर्थी, जिसकी एक से अधिक जीवित पत्नियां हों और कोई भी महिला अभ्यर्थी जिसने ऐसे व्यक्ति से विवाह किया है , जिसकी पहले से एक पत्नी जीवित हो, सेवा या पद पर नियुक्ति के लिए पात्र नहीं होगा :

परंतु यह कि उसकी नियुक्ति का मामला आपराधिक मामलें का अंतिम विनिश्चय होने तक लंबित रखा जाएगा ।

10. अभ्यर्थियों की पात्रता के संबंध में नियुक्ति प्राधिकारी का विनिश्चय अंतिम होगाः-

चयन के लिए किसी भी अभ्यर्थी की पात्रता या अन्यथा के संबंध में नियुक्ति प्राधिकारी का विनिश्चय अंतिम होगा ।

11. प्रातियोगिता परीक्षा/ चयन द्वारा सीधी भर्तीः-

(1 ) सीधी भर्ती में चयन के लिए एक समिति गठित की जाएगी , उक्त समिति मेंऐसे सदस्य होगे , जैसे कि अनुसूची- तीनमें उल्लिखित हैं ।

(2) किसी वर्ष में उद्भूत होने वाली रिक्तियों के संबंध में विभिन्न वर्गों के आरक्षण का प्रतिशत एवं केरी फारवर्ड के लिए अवधि शासन के नियमों के अनुसार होगा । 96 (5)

(3) जहां सीधी भर्ती द्वारा भरे जाने वाले पदों के लिए कतिपय कालावधि का अनुभव आवश्यक शर्त के रूप में विहित किया गया है और नियुक्ति प्राधिकारी की राय में यह पाया जाए कि आरक्षित पदों पर भर्ती के लिए अपेक्षित अनुभव रखने वाले अनुसूचित जाति, अनुसूचित जनजाति एवं अन्य पिछड़े वर्ग के अभ्यर्थियों को पर्याप्त संख्या में उपलब्ध होने की संभावना नहीं है तो वहां कार्यपालिक समिति के अनुमोदन के पश्चात् नियुक्ति प्राधिकारी अनुसूचित जाति/ अनुसूचित जनजाति/ अन्य पिछड़े वर्ग के अभ्यर्थियों के बारे में अपेक्षितअनुभव की शर्त को शिथिल कर सकेगा ।

(4) सीधी भर्ती के लिए उपलब्ध रिक्तियों में से उन अभ्यर्थियों के लिए पद आरक्षित रखे जाएंगे जो मध्यप्रदेश लोक सेवा आयोग (अनुसूचितजाति, अनुसूचितजनजाति और अन्य पिछड़े वर्ग के लिए आरक्षण ) अधिनियम , 1994 (क्रमांक 21 सन् 1994) के उपबंधों के अनुसार आरक्षित किएजाएंगे ।

(5) सामान्य प्रशासन विभाग द्वारा जारी निर्देशानुसार विकलांग अभ्यर्थियों के लिए पद आरक्षित रहेंगे ।

(6) मध्यप्रदेश सिविल सेवा (महिलाओं की नियुक्ति हेतु विशेष उपबंध) नियम, 1997 के उपबंधों/ शर्तों के अनुसार सीधी भर्ती के प्रक्रम में महिला अभ्यर्थियों के लिए 33 प्रतिशत पद आरक्षित रहेंगे ।

सीधी भर्ती के लिए समिति द्वारा सिफारिश किए गए अभ्यर्थियों की सूची:-

(1) समिति, ऐसे अभ्यर्थियों तथा अनुसूचितजातियों, अनुसूचितजनजातियों, अन्य पिछड़े वर्गों तथा महिला अभ्यथियों को जो ऐसे स्तर से अर्ह हों, जिसे नियुक्ति प्राधिकारी अवधारित करें, की मानक क्रम से बनाई गई सूची, नियुक्ति प्राधिकारी को अग्रेषित करेगी ।

(2) इन विनियमों तथा मध्यप्रदेश सिविल सेवा (सेवा की सामान्य शर्तें) नियम , 1961 के उपबन्धों के अध्यधीन रहते हुए उपलब्ध रिक्तियों पर अभ्यर्थियों के चयन के लिए उसी क्रम में विचार किया जाएगा, जिसमें कि उनके नाम सूची में आए हैं ।

(3) चयन सूची में किसी अभ्यर्थी का नाम सम्मिलित किए जाने से ही उसे तब तक नियुक्ति का कोई अधिकार प्राप्त नहीं होता, जब तक कि नियुक्ति प्राधिकारी को ऐसी जांच करने के पश्चात् जैसा कि वह आवश्यक समझे, यह समाधान नहीं हो जाए कि अभ्यर्थी सेवा में नियुक्ति के लिए सभी प्रकार से उपयुक्त है ।

(4) सेवा में भर्ती के लिए प्रतियोगिता परीक्षा ऐसे अन्तरालोंमें, की जाएगी , जिसे शासन समय- समय पर आयोग से परामर्श कर सुनिश्चित करे तथा शासन द्वारा जारी ऐसे आदेशों के अनुसार की जाएगी ।

(5) 16 प्रतिशत पद अनुसूचित जाति, 20 प्रतिशत अनुसूचित जनजाति तथा 14 प्रतिशत पद अन्य पिछड़े वर्ग के अभ्यर्थियों के लिए आरक्षित रखे जाएंगे । मध्यप्रदेश सिविल सेवा (महिलाओं की नियुक्ति के लिए विशेष उपबंध) नियम, 1997 के उपबंधों के अनुसार महिला अभ्यर्थियों के लिए पद आरक्षित रखे जाएंगे ।

(6) इस प्रकार आरक्षित रिक्तियों को भरते समय अनुसूचित जाति,अनुसूचित जनजाति एवं अन्य पिछड़े वर्ग के अभ्यर्थियों की नियुक्ति पर विचार विनियम 12 में निर्दिष्ट सूची में आए नामों के अनुसार किया जाएगा चाहे अन्य अभ्यर्थियों की तुलना में उनका सापेक्षिक पद कुछ भी क्यों न हो । मध्यप्रदेश राजपत्र, दिनांक 6 फरवरी 2019

(7) यदि अनुसूचित जाति, अनुसूचित जनजाति के अभ्यर्थियों की अपेक्षित संख्या उनके लिए आरक्षित समस्त रिक्तियों को भरने के लिए उपलब्ध नही है, तो शेष रिक्तियां राज्य सरकार की पूर्व अनुमति के बिना अन्य अभ्यर्थियों से नहीं भरी जाएंगी । उन्हें अन्य अभ्यर्थियों से रिक्तियों को भरने के लिए अनारक्षित घोषित नहीं किया जाएगा ।

(8) विकलांग व्यक्तियों के अभ्यर्थियों के लिए पद आरक्षित होंगे । आरक्षण क्षैतिज एवं प्रभाग बार (कम्पार्टमेंट वाइस ) होगा ।

13. पदोन्नति द्वारा नियुक्ति:-

(1 ) पदोन्नति हेतु प्रारंभिक चयन करने के लिए एक समिति गठित की जाएगी , जिसमें अनुसूची- चार में उल्लिखित सदस्य होंगे , किन्तु पीठासीन अधिकारी को छोड़कर,नामनिर्दिष्ट किए गए सदस्यों में यदि कोई सदस्य अनुसूचितजाति, अनुसूचित जनजाति का प्रतिनिधित्व नहीं करता है, तो उक्त प्रवर्गों के समान स्तर के किसी एक अधिकारी को पदोन्नति समिति में सम्मिलित किया जाएगा और पदोन्नति समिति के सदस्यों की संख्या उस सीमा तक बढ़ा दी जाएगी ।

(2) समिति अपनी बैठक ऐसे अन्तरालों में करेगी , जो साधारणतः एक वर्ष से अधिक न हो ।

(3) आरक्षित रिक्तियोंमें पदोन्नति करने की प्रक्रिया शासन के सामान्य प्रशासन विभाग द्वारा समय- समय पर जारी किए गए अनुदेशों के अनुसार होगी ।

(4) आरक्षण तथा विचारण क्षेत्र सामान्य प्रशासन विभाग द्वारा जारी आदेश/ नियम अनुसार होगा ।

14. पदोन्नति के लिए पात्रता संबंधी शर्ते :-

(1 ) उप-विनियम (2 ) के उपबंधों के अध्यधीन रहते हुए, समिति उन सभी व्यक्तियों के मामलों पर विचार करेगी, जिन्होंने उस वर्ष की पहली जनवरी को, उन पदों पर, जिनसे की पदोन्नति की जानी है , (चाहे स्थानापन्न या मूल रूप में) उतने वर्ष की सेवा पूर्ण करली हो जितनी कि अनुसूची- चार में विनिर्दिष्ट है ।

(2) अनुसूची - चार के कालम (3 ) में दर्शाए गए पद हेतु कॉलम (4) में विहित अर्हताधारी अभ्यर्थी उपलब्ध, नहीं होने की दशा में, ऐसे रिक्त पद कार्यपालिक समिति के अनुमोदन के पश्चात् सीधी भर्ती/ चयन द्वारा भरे जाएंगे ।

(3) जांच सेवा में पदोन्नत प्रत्येक व्यक्ति दो वर्ष की कालावधि के लिए परीक्षण पर नियुक्त किया जाएगा ।

15. पदोन्नति के लिए उपयुक्त अभ्यर्थियों की सूची:-

(1) समिति ऐसे व्यक्तियों की सूची तैयार करेगी, जो उपरोक्त विनियम 14 में विहित शर्तों को पूरा करते हैं तथा जिन्हें समिति, सेवा में पदोन्नति के लिए उपयुक्त समझती है । यह सूची तैयार करने की तारीख से, एक वर्ष के कालावधि के दौरान सेवानिवृति तथा पदोन्नति के कारण होने वाली प्रत्याशित रिक्तियों को भरने के लिए पर्याप्त होगी ।

(2) ऐसी सूची में सम्मिलित करने के लिए चयन, ज्येष्ठता का सम्यक् ध्यान रखते हुए सभी दृष्टि से योग्यता तथा उपयुक्तता पर आधारित होगा । मध्यप्रदेश राजपत्र, दिनांक 6 फरवरी 2019

96(7) (3) इस प्रकार तैयार की गई पदोन्नति सूची एक वर्ष की कालावधि तक प्रभावशील रहेगी ।

(4) यदि इस प्रकार के चयन , पुनर्विलोकन अथवा पुनरीक्षण की प्रक्रिया प्रस्तावित की जाती है तो सेवा बोर्ड के किसी सदस्य का अधिक्रमण किया जाए, तो समिति प्रस्तावित अधिक्रमण के संबंध में अपने कारण को लेखबद्ध करेगी ।

(5) समिति द्वारा अंतिम रूप से तैयार की गई तथा नियुक्ति प्राधिकारी द्वारा अनुमोदित इकजाई सूची , सेवा के सदस्यों को अनुसूची- चार के कॉलम (3) में अंकित पदों में से पदोन्नति करने के लिए चयन सूची होगी ।

स्पष्टीकरण:

ऐसे किसी व्यक्ति को जिसका नाम चयन सूची में सम्मिलित किया गया हो, किन्तु जो सूची की विधिमान्यता के दौरान पदोन्नत न किया गया हो, केवल इसके पूर्वतर चयन के तथ्य से ही उन के ऊपर जिन पर पश्चात्वर्ती चयन में विचार किया गया है, वरिष्ठता का दावा नहीं रहेगा ।

16. चयन सूची से सेवा में नियुक्ति:-

चयन सूची में सम्मिलित व्यक्तियों की सेवा के संवर्ग पदों पर नियुक्तियां उसी क्रम से की जाएंगी, जिस क्रम से नियुक्ति आरक्षण विद्यमान नियमों/ रोस्टर के उपबंधों के अधीन आदेश के किए जाने का उपबंध है ।

17. परिवीक्षा:-

सेवा में सीधी भर्ती से नियुक्त किया गया प्रत्येक व्यक्ति दो वर्ष की अवधि के लिए परिवीक्षा पर नियुक्त किया जाएगा ।

18. निर्वचन:-

यदि इन विनियमों के निर्वचन के संबंध में कोई प्रश्न उद्भूत होता है तो इसे अध्यक्ष को निर्दिष्ट किया जाएगा और इस पर अध्यक्ष का निर्णय अंतिम होगा ।

19. शिथिलीकरण :-

इन विनियमों की किसी बात का यह अर्थ नहीं लगाया जाएगा कि वह किसी ऐसे व्यक्ति के मामलें में , जिसेये विनियम लागू होते हैं, अध्यक्ष की, ऐसी रीति में जो उसे न्यायसंगत तथा साम्यापूर्ण प्रतीत होती हों, कार्यवाही करने की शक्ति को सीमित या कम करती है :

परंतु कोई मामला किसी ऐसी रीति से कार्रवाई नहीं की जाएगी , जो इन विनियमों में उपबंधित रीति की अपेक्षा उसके लिए कम अनुकूल हो ।

20. निरसन तथा व्यावृत्ति:-

(1) इन विनियमों के तत्स्थानी और इनके प्रारंभ होने के ठीक पूर्व लागू समस्त विनियम, इन विनियमों के अन्तर्गत आने वाले विषयों के संबंध में एतद्वारा निरसित किए जाते हैं :

परन्तु, इस प्रकार निरसित विनियमों के अधीन किए गए कोई भी आदेश या की गई किसी कार्रवाई इन विनियमों के तत्स्थानी उपबंधों के अधीन किया गया आदेश या की गई कार्रवाई समझी जाएगी ।

2) इन विनियमों की कोई भी बात राज्य सरकार द्वारा , समय- समय पर जारी किए (

गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों एवं महिलाओं के लिए उपबंधित किए जाने वाले आरक्षण तथा अन्य अपेक्षित शर्तों को प्रभावित नहीं करेगी । 6 (8)

า No. F -44-10/2016/20-2 :: In exercise of the powers conferred by rule 15( 15.2) and 16 ( 16.1 ) of the memorandum 1995 of the Madhya Pradesh State Open School Education Council , Bhopal , the Council , hereby makes the following regulation relating to the recruitment and service conditions of the employees ofthe council , namely: -

REGULATIONS

Short Title and Commencement: -

(1) These regulations may be called the Madhya Pradesh State Open School Education Council ( Recruitment and Conditions of Service) Regulations, 2018.

) They shall come into force from the date of their publication in theMadhya Pradesh Gazette .

2. Definitions: -

In these regulations , unless the context otherwise requires: -

(a) " Appointing Authority " in respect of the service , means authority mentioned in Schedule- l;

( b) "Chairman" means Chairman of the Executive Committee of the State Open School Education Council ;

( c) "Committee" means the committee mentioned in Schedule III and IV for recruitment and promotion under these regulations;

(d) "Competitive Examination and Selection Procedure " means the Competitive Examination and Selection Procedure conducted for recruitment under these regulations ;

(e) "Director " means the DirectorState Open School Education Council;

(f) "Executive Committee " means the Executive Committee of State OpenSchool Education Council;

(g) "Government " means the Government of Madhya Pradesh;

(h) "Other Backward Classes " means the other backward classes of citizens as specified by the State Government vide Notification No. F - 8-5 /XXV- 4-84.dated 26 December, 1984 as specified from time to time;

(i ) " Post " means the post of whole time service under the State OpenSchool Council Board but does not include any employment wherethe employee is paid from contingency fund;

(j ) " Regulations " means the Madhya Pradesh State Open School Education Council Regulation , 2018;

(k) "Rules" means the Madhya Pradesh State Open School Education Council Memorandum and Rules 1995

(1) "Schedule" means schedules appended to these regulations;

(m) "Scheduled Caste " means any caste, race or tribe or part of or group within caste , race or tribe specified as Scheduled Caste with respect to the State of Madhya Pradesh under Article 341 of the Constitution of India;

(n) "Scheduled Tribe " means any tribe, tribal community or part of or group within tribe or tribal community specified as Scheduled Tribeswith respect to the State of Madhya Pradesh under Article 342 of the Constitution of India;

( 0) "Service" means the Madhya Pradesh State Open School Education Council Service;

(q) "State Open School Education Council " means , the Madhya Pradesh State Open School Education Council .

3. SCOPE AND APPLICATION : -

Without prejudice to the generality of the provisions contained in the Madhya Pradesh Civil Services ( General Conditions of Services), Rules, 1961, these regulations shall apply to every employee of the service .

4. Constitution of the Service: -

The service shall consist of the following persons, namely:-

(1)

Persons who at the time of commencement of these regulations are holding substantively or officiating capacity or on deputation the posts specified in Schedule I.

(2)

Persons recruited to the service before the commencement ofthese regulations .

( 3)

Persons recruited or promoted to the service in accordance with the provision of these regulations.

5. Classification and Scale of pay etc.:-

Theclassification of service , the number of posts included in the services and the scale of pay attached thereto shall be as specified in Schedule-l :

Provided that the State Open School Education Council may, from time to time, add to or reduce the number of posts included in the serviceeither on a permanent or temporary basis .

Modeof recruitment: -

(1) Recruitment to the services , after the commencement of these regulations shall be made by one of the following modes , namely:-

(a) By direct recruitment or by selection through competitive examination;

(b) By promotion of the employees of service (as specified in column (3) of Schedule iv);

(c) By transfer of persons who hold in a substantive/ officiating capacity or temporary such posts in State Open School Education Council Service as may be specified in this behalf.

(

2) The number of persons recruited under clause ( b) and (c) of sub- regulation ( 1) above shall not , at any time , exceed the percentage shown in Schedule II of the number of posts specified in Schedule- l .

(3) Subject to the provisions of these rules the method or methods of filling any Particular vacancy or vacancies in the service as may be required to be filled during any particular period of recruitment and the number of persons to be recruited by each method shall be determined on each occasion by the Appointing Authority in consultation with the Government .

(4) Notwithstanding anything contained in sub-rule (1) , if in the opinion ofthe Director the exigencies of the service requires , it may, with the prior concurrence of the Chairman , adopt such methods of recruitment to the service other than those specified in the said sub- rule, as it may, by order issued in this behalf, prescribe.

7. Appointment to the services : -

All appointments to the services , after the commencement of these regulations shall be made by the appointing authority and no such appointment shall be made except after selection by one of the modes of recruitment specified in regulation 6.

8. Conditions of eligibility of candidates for direct recruitment: -

(1)Age:

In order to be eligible to compete at the examination/selection a candidate must satisfy the following conditions , namely: -

(a) The candidate must have attained the age as specified in column( 3 ) ofSchedule III but not have attained the age as specified in column (4) of the said Schedule on the first day of January next following year in which Examination /Selection is to be made;

(b) Theupper age limit shall also be relaxable in respect of candidates, who are or who have been the employees of Madhya Pradesh State OpenSchool Education Council to the extent and subject to the conditions specified below: -

(i ) A candidate, who is retrenched employee of the Open School shall be allowed to deduct from his age the period of all temporary service previously rendered by him upto a maximum limit of 7 years even if it represents more than one spell:

Provided that the resultant age does not exceed the upper age limit by more than three years .

Explanation: -

The term " Retrenched employee of the open school " denotes a person who was in temporary services of the Institution or any of the constituent units of the Institution for a continuous period of not less than six months and who was discharged because of reduction in establishment not more than three years prior to the date of his registration at the Employment Exchange or of application made otherwise for employment in Open School Service .

( ii ) A candidate, who is an Ex-Serviceman shall be allowed to deduct मध्यप्रदेश राजपत्र , दिनांक 6 फरवरी 2019

from his age the period of all defence service previously rendered by him , provided that the resultant age does not exceed the upper age limit by more than three years .

Explanation: -

The term " Ex -Serviceman " denotes a person who belonged to any of the following categories and who was employed under the Government of India for a continuous period of not less than six months and who was retrenched or declared surplus as a result or recommendations of the Economy Units or due to normal reduction on any Employment Exchange or application made otherwise for employment in Government service .

(1) Ex-Servicemen released under mustering out concession .

Ex-Servicemen enrolled for the second time and discharged on : - (2)

(a) Completion of short - term engagement .

(b) Fulfilling the conditions of enrolment.

(3) Ex-Servicemen of Madras Civil Unit .

(4) Officers (Military and Civil ) discharged on completion of their contract (including short service Regular Commission Officers) (5) Officer discharged after working for more than six months continuously against leave vacancies .

(6) Ex-Servicemen invalidated out of service .

(7) Ex-Servicemen discharged on the ground that they are unlikely to become efficient soldiers .

(8) Ex- Servicemen , who are medically boarded out on account of gun-shot, wounds etc.

(d) The general upper age limit shall be relaxables as per rules for the women candidates in accordance with the provision of Madhya Pradesh Civil Service (Special provision for appointment of women ) Rules, 1997 .

96 (21 ) (e) The general upper age limit shall be relaxable as per rules in respect of awarded superior caste partners of a couple under the inter-caste marriage incentive scheme of the Tribal, Scheduled Caste and Backward Classes Welfare Department .

(f) The general upper age limit shall be relaxable as per rules in respect of those sports - men candidates who are " Vikram Award " holders .

(g) Relaxable in the upper age limit in respect of Unreserved/Unreserved female/male, Government Corporation/Board/Autonomousinstitute and Home Guard/Handicap shall be as per the instruction issued by the General Administration Department .

(2) Educational Qualifications: -

The candidates must possess the educational qualifications prescribed for the service as shown in Schedule-III .

Fees:-

(3)

The candidate shall pay the fees prescribed by the appointing authority.

9. Disqualification: -

) Any attempts on the part of a candidate to obtain support for his candidature by any means may be held by the Appointing Authority to disqualify him for examination/selection .

(2) No candidate shall be eligible for any service or post if he/she has more than two living children one of whom is born on or after 26th January, 2001 :

Provided that no candidate shall be disqualified for appointment to a service or post, who has already one living child and next delivery takes place on or after 26th day of January 2001, in which two or more than two children are born .

( 3) No candidateshall be eligible for appointment to a service or post , who has been convicted of an offence against women:

Provided that his appointment shall be kept pending till the final decision of the criminal case .

(4) Amale candidate who has more than one wives alive and female candidates who marries with male who has already one wife alive shall not be eligible for appointment to the service or post.

10. Appointing Authority's decision about the eligibility of candidates shall befinal:-

The decision of appointing authority as to the eligibility or otherwise of a candidate for selection shall be final .

11. Direct recruitment by competitive examination/selection: -

( 1)

A committee shall be constituted for selection to direct recruitment ; the members of such committee shall be such as ismentioned in Schedule III

(2) In relation to the vacancies arising during a year the percentage of reservation for various categories and the provision for carry forward shall be as per the rules of the Government;

(3) When the experience of a particular period has been prescribed as a necessary condition for filling the post by direct recruitment and it is found in the opinion of appointing authority that there is no possibility of being available in sufficient number the candidates of scheduled caste and scheduled tribe and other backward classes having requires experiences , the appointing authority may after the approval of the " Executive Committee " relax the condition regarding experience in relation to the candidates of scheduled caste/ scheduled tribes /other backward classes .

( 4)

At the stage of direct recruitment posts shall be kept reserved for the candidates in accordance with the provisions of Madhya Pradesh LokSeva (AnusuchitJatiyon, AnusuchitJanjatiyonaurPichhadeVargonkeliyaArakshan ) Adhiniyam ,1994 ( No 21 of 1994).

96 (23 ) accordance with the instruction issued by the General Administration Department .

(6) Atthe stage of direct recruitment, 33percent posts shall be reserved for the women candidates in accordance with the provision /conditions of Madhya Pradesh Civil Service (Special Provisions for appoint of women ) Rules , 1997.

12. List of candidates recommended by the committee for directrecruitment : -

(1) Thecommittee shall forward to the appointing authority a list arranged in order of merit of the candidates and other candidates belonging to the scheduled castes , Scheduled tribes , women and other backward classes who have qualified by such standards as the appointing authority may determine.

(2) Subjects to the provisions of these regulation and Madhya Pradesh Civil Services (General Conditions of Services ) Rules , 1964 the candidates shall be considered for selection to the available vacancies from the list in the order in which their namesappear in the list.

(3) The inclusion of candidate's name in the select list confers no right to appointment unless the appointing authority is satisfied, after such enquiry as he may deem necessary, that the candidate is suitable in all respect for appointment to the service.

(4) Competitive examination for recruitment to the service shall be held at such intervals as the Government with the constitution of the Commission may determine and in accordance with the orders that may be issued by the Government in this behalf.

(5) There shall be 16 percent and 20 percent reserved posts for the candidates belonging to the Schedule Castes , Schedule Tribes मध्यप्रदेश राजपत्र , दिनांक 6 फरवरी 2019

and 14 percent for Other BackwardClasses . There shall be reserved posts for women candidates in accordance with the provision of Madhya Pradesh Civil Service (Special Provision of appointment of women ) Rules, 1997 .

(6) In filing up the vacancies so reserved , candidates who are members of the Scheduled Castes, Scheduled Tribes and Other Backward Classes , shall be considered for appointment in order in which their names appear in the list referred to in regulation 12 irrespective of their relative rank as compared to other candidates.

(7) If the required number of candidates of Scheduled Caste , Scheduled Tribes are not available to fill all the vacancies reserved for them , then the remaining vacancies shall not be filled from other candidates without prior permission of the StateGovernment . They shall not be declared unreserved to fill the vacancies from other candidates .

(8) Posts shall be reserved for candidates who are disabled persons . The said reservation shall be horizontal and compartment wise.

13. Appointment by Promotion: -

(1) There shall be constituted a committee consisting of the members mentioned in Schedule IV for making a preliminary selection for promotion but if any of the nominated members , excluding the officer presiding, does not represent the Schedule Caste, Schedule Tribe, an officer of equal rank belonging to these categories will be included in Promotion Committee and the numbers of the members of Promotion Committee shall be extended to that limit.

(2) The committee shall meet at an interval ordinarily not exceeding one year .

96 (25) shall be in accordance with the instruction issued by Government in the General Administration Department from time to time .

(4) Reservation and zone of consideration will be in accordance with instructions issued by the General Administration Department.

14. Condition of eligibility for promotion :

(1) Subject to the provision of sub - regulation (2) the committee shall consider the case of all persons who on the 1st day of January of that year had completed such number of years of service(whether officiating or substantive ) on the posts from which promotion is to be made, as specified in Schedule IV;

(2) For the post shown in column (3) of Schedule IV in case a candidate possessing any of the qualification prescribed in column (4) is not available , such vacant post shall be filled in by direct recruitment/ selection after the approval of Executive Committee.

(3) Every person promoted in the testing service will be appointed on trial for a period of two years .

15. List of suitable candidates for promotion :

(1) The committee shall prepare a list of such persons as satisfy the conditions prescribed in regulation 14 above and as are held by the committee to be suitable for promotion to the service . The list shall be sufficient to cover the anticipated vacancies on account of retirement and promotion during the course of one year from the date of preparation of the select list.

(2) The selection for inclusion in such list shall be based on merit and suitability in all respect with due regards to seniority.

(3) The promotion list so prepared shall remain in force for a period of one year.

( 4) If in the process of selection , review or revision it is proposed to supersede any member of the Board Service , the committee shall record its reasons for the proposed supersession.

( 5) The list finally prepared by the committee and approved by appointing authority shall form the select list for promotion of themembers of the service to the post shown in column (3) of ScheduleIV.

(6) For promotion there shall be relaxation in educational qualification as per the rules of the State Government .

Explanation:

A person whose name is included in a select list but who is not promoted during the validity of the list shall have no claim to seniority over those considered in a subsequent selection nearly, by the fact of his earlier selection .

16. Appointment to the service from the select list:

Appointment of the person included in the select list to post borne onthe cadre of the service shall follow the order under the provision of rules/ roster relating to appointment provided that the names of such persons should be in the select list under reserved categories .

17. Probation:

Every person directly recruited to the service shall be appointed on probation for a period of two years:

Provided that a permanent post is available for him otherwise all appointment shall be temporary and in officiating capacity.

18. Interpretation:

If any question arises relating to the interpretation of these regulations it shall be referred to the Chairman and whose decision thereon shall be final .

96 (27) 19. Relaxation:

Nothing in these Regulation shall be construed to limit or abridge the powers of the Chairman to deal with the case of any person to whom these regulation apply in such manner as may appear to him to be just and equitable:

Provided that the case shall not be dealt with in any manner less favourable to him than provided in these regulations.

20. Repeal and saving:

(1) All regulation corresponding to these regulation and in force immediately before their commencement of the regulation are, hereby, repealed in respect of matters covered by these regulation:

Provided that any order made or action taken under these regulation so repealed shall be deemed to have been made or taken under the corresponding provision of the regulation .

(2) Nothing in this regulation shall over- ride the reservation and other conditions required being provided for the Schedule Caste and Schedule Tribes and Other Backward Classes and women in accordance with the orders issued by the State Government from time to time as plus regard .
