THE MADHYA PRADESH MUNICIPALITIES (AMENDMENT) BILL, 2019 ABill further to amend the Madhya Pradesh Municipalities Act , 1961 .
Be it enacted by the Madhya Pradesh Legislature in the seventieth year of the Republic of India as follows :-
Short title.
1. This Act may be called the Madhya Pradesh Municipalities (Amendment ) Act , 2019 .
Amendment of Section 35.
2. In Section 35 of the Madhya Pradesh Municipalities Act, 1961 (No. 37 of 1961 ) , clause (f) shall be omitted.
STATEMENT OF OBJECTS AND REASONS
In Writ Petition (Civil ) No. 1151/2017 Vidhi Centre for Legal Policy versus Union of India and others , pending in the Supreme Court of India, the issue pertains to abolition/ amedment of various States and Central enactment where persons suffering from leprosy have been treated in discriminatory manner , despite leprosy is now a curable disease . In this regard Section 35 of the Madhya Pradesh Municipalities Act , 1961 (No. 37 of 1961) has been identified which contains discriminatory provisions in regard to leprosy patients . Therefore , it is decided to make suitable amendment .
