क्रमांक एफ 44-23-2015- बीस-2.-निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार अधिनियम, 2009 ( 2009 का 35 ) की धारा 38 की उपधारा ( 1 ) तथा ( 2 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा , निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार नियम, 2011 में निम्नलिखित संशोधन करती है , अर्थात् :-

उक्त नियमों में,-
1. नियम 10 के पश्चात्, निम्नलिखित नियम अन्तःस्थापित किया जाए, अर्थात्:-
" 10- क( 1 ) प्रत्येक अकादमिक वर्ष के अंत में कक्षा 5वीं एवं कक्षा 8वीं की नियमित परीक्षा होगी.
(2) परीक्षा में बैठने वाला कोई बालक परीक्षा में उत्तीर्ण घोषित किया जाएगा यदि वह राज्य शिक्षा केन्द्र द्वारा विनिश्चित किये गये अंक या ग्रेड प्राप्त करता है .
(3 ) यदि कोई बालक उपनियम ( 1 ) में निर्दिष्ट परीक्षा में अनुत्तीर्ण होता है तो उसे अतिरिक्त शिक्षण दिया जाएगा और परीक्षा परिणाम घोषित होने की तारीख से दो माह की कालावधि के भीतर उसे पुनर्परीक्षा का अवसर प्रदान किया जाएगा.

(4) किसी बालक के उपनियम ( 3 ) में निर्दिष्ट पुनर्परीक्षा में अनुत्तीर्ण होने की दशा में, उसे कक्षा पांचवीं या कक्षा आठवीं, जो भी लागू हो, वो वापस रखा जाएगा.
2. प्रारूप-2 में, मद क्रमांक 7 में, खण्ड ( एक) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए, अर्थात्:-
" (एक) स्कूल में प्रारम्भिक शिक्षा पूर्ण होने तक किसी बालक को स्कूल से निष्कासित नहीं किया जाएगा.".
No. F 44-23-2015 -XX - 2.- In exercise of the powers conferred by the sub- section ( 1 ) and (2) of Section 38 of the Right of Children to Free and Compulsory Education Act , 2009 (No. 35 of 2009 ) , the State Government, hereby , makes the following amendments in the Right of Children to Free and Compulsory Education Rules , 2011 , namely :-
AMENDMENT
In the said rules ,_
1. After rule 10 following rule 10 -A shall be inserted , namely
10-A( 1 ) There shall be a regular examination in the fifth class and in the eighth class at the end of every academic year.
(2) A child appearing in the examination shall be declared passed in the examination if he obtains the marks or grades as decided by the Rajya Shiksha Kendra .
(3) If the child fails in the examination referred to in sub -rules ( 1) , he shall be given additional teaching and granted opportunity for re - examination within a period of two months from the date of declaration of the result .
(4) In case the child fails in the re - examination referred to in sub- rule (3) he shall be retained in the fifth class and in the eighth class , whichever is applicable .
2. In Form- 2, in item No. 7 , for clause (i ) , the following clause shall be substituted , namely :-
"( i) No child shall be expelled from school till the completion of elementary education in the school; " .
