मध्यप्रदेश माल और सेवा कर अधिनियम, 2017 (क्रमांक 19 सन् 2017) ( जिसे इस आदेश में इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 52 की उपधारा (4) में यह उपबंधित है कि प्रत्येक प्रचालक, जो उपधारा ( 1 ) में विनिर्दिष्ट रकम का संग्रहण करता है, उसके द्वारा की जाने वाली माल या सेवाओं या दोनों की जावक पूर्तियों, जिसके अंतर्गत उसके द्वारा वापस की गई माल या सेवाओं या दोनों की पूर्तियां भी हैं, के ब्यौरे और मास के दौरान उपधारा ( 1 ) के अधीन संगृहीत रकम के ब्यौरों को अंतर्विष्ट करते हुए ऐसे प्ररूप और ऐसी रीति में, जो विहित की जाए, ऐसे मास के अंत के पश्चात् दस दिन के भीतर इलैक्ट्रानिक रूप से एक विवरण प्रस्तुत करेगा ;
और कतिपय प्रचालक, जो सामान्य पोर्टल पर उनके द्वारा तकनीकी कठिनाईयों का सामना करने के कारण रजिस्ट्रीकरण अभिप्राप्त करने में असमर्थ रहे थे किंतु उन्होंने अक्टूबर , नवंबर और दिसंबर , 2018 मास के लिए रकम का संग्रहण किया था, जिसके परिणामस्वरूप उक्त अधिनियम की धारा 52 की उपधारा (4) के अधीन वे विवरण प्रस्तुत नहीं कर सकें और जिसके कारण उक्त उपधारा के उपबंधों को प्रभावी करने में कतिपय कठिनाईयां उद्भूत हुई हैं;

अतः , अब, राज्य सरकार , मध्यप्रदेश माल और सेवा कर अधिनियम , 2017. ( क्रमांक 19 सन् 2017) की धारा 172 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , परिषद् की सिफारिशों पर कठिनाईयों को दूर करने के लिए निम्नलिखित आदेश करती है , अर्थात्:--
1. संक्षिप्त नाम- इस आदेश का संक्षिप्त नाम मध्यप्रदेश माल और सेवा कर (द्वितीय कठिनाईयों को दूर करना) आदेश , 2019 है ।
2. मध्यप्रदेश माल और सेवा कर अधिनियम , 2017 ( क्रमांक 19 सन् 2017 ) की धारा 52 की उप-धारा (4) के स्पष्टीकरण में , "31 जनवरी , 2019" अंकों और शब्दों के स्थान पर "07 फरवरी, 2019" अंक और शब्द रखे जाएंगे ।
3. यह आदेश दिनांक 1 फरवरी , 2019 से प्रवृत्त समझा जायेगा।

क्रमांक एफ ए- 3-10-2019-1- पांच. भारत के संविधान के अनुच्छेद 348 के खण्ड ( 3 ) के अनुसरण में, इस आशय की अधिसूचना क्र. एफ ए- 3-10-2019-1-पांच, ( 26 ) दिनांक 6 मार्च 2019 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्वारा प्रसारित किया जाता है.
मध्यप्रदेश के राज्यपाल के नाम से तथा आदेशानुसार,

WHEREAS, sub- section (4) of section 52 of the Madhya Pradesh Goods and Services Tax Act , 2017 (19 of 2017 ) ( hereafter in this Order referred to as the said Act ) provides that every operator who collects the amount specified in sub - section (1) shall furnish a statement , electronically, containing the details of outward supplies of goods or services or both effected through it , including thesupplies of goods or services or both returned through it, and the amount collected under sub- section(1) during a month , in such form and manner as may be prescribed, within ten days after the end of such month;
AND WHEREAS, certain operators , were unable to obtain registration because of technical issues being faced by them on the common portal but they collected the amount for the months of October, November and December 2018 , as a result whereof, the statement under subsection (4) of section 52 of the said Act could not be furnished and because of that certain difficulties have arisen in giving effect to the provisions of the said sub- section ;
NOW, THEREFORE, in exercise of the powers conferred by section 172 of the Madhya Pradesh Goodsand Services Tax Act , 2017, the State Government, on recommendations of the Council, hereby makes the following Order, to remove the difficulties , namely:-
1. Short title . This Order may be called the Madhya Pradesh Goods and Services Tax (Second Removal of Difficulties) Order, 2019.
2. In section 52 of the Madhya Pradesh Goods and Services Tax Act, 2017 ( No. 19 of 2017) insub- section (4), in the Explanation , for the figures, letters and word "31st January, 2019", thefigures, letters and word "07th February, 2019 ", shall be substituted.
3. This order shall deemed to have come into effect from 1st day of February, 2019 .
