NOTIFICATION
Whereas , the schedule for the General Elections to the House of the People , 2019 , State Legislative Assemblies of Andhra Pradesh , Arunachal Pradesh , Odisha & Sikkim 2019 and bye- elections in the State Legislative Assemblies of Bihar , Goa , Gujarat , Madhya Pradesh , Maharashtra , Meghalaya, Mizoram . Nagaland, Puducherry , Tamil Nadu , Uttar Pradesh & West Bengal , were announced by the Commission vide Press Notes bearing No. No. ECI / PN/ 23 / 2019 dated 10th March , 2019 , ECI /PN /26/ 2019 dated 13th March , 2019 and ECI / PN /28/ 2019 dated 14th March, 2019 .
2. And whereas , as per the provisions of Section 126A of The Representation of the People Act , 1951 ( in short R.P. Act , 1951 ) there shall be restrictions on conduct of any exit poll and publication and dissemination of result of such exit poll during such period , as may be notified by the Election Commission in this regard:

3. Now , therefore , in exercise of the powers under sub- Section ( 1 ) of Section 126A of the R.P. Act , 1951 , the Election Commission , having regard to the provisions of sub - Section ( 2 ) of the said Section, hereby notifies the period between 7.00 A.M on 11th April, 2019 (Thursday ) and 6:30 PM on 19th May , 2019 ( Sunday ) as the period during which conducting any exit poll and publishing or publicizing by means of the print or electronic media or dissemination in any other manner whatsoever , the result of any exit poll in connection with the current General Elections to the House of the People, 2019, and the State Legislative Assemblies of Andhra Pradesh , Arunachal Pradesh, Odisha & Sikkim 2019, and bye- elections from assembly constituencies announced vide Press Notes referred to above , to be held simultaneously with the general election to Lok Sabha , shall be prohibited .
4. It is further clarified that under Section 126 ( 1 ) ( b ) of the R.P. Act , 1951 , displaying any election matter including results of any opinion poll or any other poll survey , in any electronic media , would be prohibited during the period of 48 hours ending with the hours fixed for conclusion of poll in the respective polling areas in connection with aforesaid General elections and bye - elections .

अधिसूचना
यतः , लोक सभा के साधारण निर्वाचन, 2019 तथा आंध्र प्रदेश, अरुणाचल प्रदेश, ओडिशा एवं सिक्किम विधान सभा के साधारण निर्वाचन, 2019 और बिहार, गोवा , गुजरात , मध्य प्रदेश, महाराष्ट्र, मेघालय, मिजोरम, नागालैण्ड, पुड्डुचेरी , तमिलनाडु, उत्तर प्रदेश, एवं पश्चिम बंगाल की राज्य विधान सभाओं के लिए उप-निर्वाचनों की घोषणा आयोग की दिनांक 10 मार्च , 2019 , के प्रेस नोट संख्या ईसीआई/ पीएन/23/ 2019; 13 मार्च, 2019 के ईसीआई/पीएन/26/2019 और 14 मार्च , 2019 के ईसीआई/पीएन/28/ 2019 के द्वारा कर दी गई थी ;
2. और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 (संक्षेप में लो. प्र.अधिनियम , 1951 ) की धारा 126 क के प्रावधानों के अनुसार इस संबंध में निर्वाचन आयोग द्वारा यथा अधिसूचित, इस अवधि के दौरान किसी भी प्रकार के एक्जिट पोल के संचालन और उसके परिणामों तथा ऐसे एक्जिट पोल के परिणाम के प्रसार पर प्रतिबंध होगा;
3. यतः, अब, लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 126क की उप- धारा ( 1 ) के अधीन शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग , उक्त धारा की उप- धारा (2 ) के उपबंधों के संबंध में एतद्वारा , 11 अप्रैल, 2019 ( बृहस्पतिवार) को पूर्वाह्न 07:00 बजे तथा 19 मई , 2019 (रविवार ) को अपराह्न 06:30 बजे के बीच की अवधि को, ऐसी अवधि के रूप में अधिसूचित करता है जिसके दौरान वर्तमान लोक सभा के साधारण निर्वाचन, 2019 तथा आंध्र प्रदेश, अरुणाचल प्रदेश, ओडिशा एवं सिक्किम विधान सभा के साधारण निर्वाचन, 2019 और उपरोक्त संदर्भित प्रेस नोट के माध्यम से घोषित राज्य विधान सभा के लिए उप- निर्वाचनों, जो कि लोकसभा साधारण निर्वाचनों के साथ- साथ आयोजित होंगे, के संबंध में किसी भी प्रकार के एक्ज़िट पोल का संचालन तथा प्रिंट या इलेक्ट्रॉनिक मीडिया द्वारा इसका प्रकाशन या प्रचार अथवा किसी भी अन्य तरीके से उसके प्रसार पर प्रतिबंध रहेगा ।
4. इसके अतिरिक्त यह भी स्पष्ट किया जाता है कि लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 126(1 ) (ख) के अधीन उपर्युक्त साधारण निर्वाचनों तथा उप निर्वाचनों के संबंध में संबंधित मतदान क्षेत्रों में मतदान की समाप्ति के लिए नियत समय के साथ समाप्त होने वाले 48 घंटों की अवधि के दौरान किसी भी प्रकार के निर्वाचन संबंधी मामले का, किसी भी ओपीनियन पोल या अन्य किसी पोल सर्वे के परिणामों सहित , प्रदर्शन किसी भी इलेक्ट्रॉनिक मीडिया से करने पर प्रतिबंध रहेगा ।
