अधि. क्र. 04-एफ-1-52-2017-अठारह 3.- मध्यप्रदेश नगरपालिक निगम अधिनियम, 1956 ( क्रमांक 23 सन् 1956 ) की धारा 14 की उपधारा ( 2 ) एवं धारा 433 तथा मध्यप्रदेश नगरपालिका अधिनियम, 1961 ( क्रमांक 37 सन् 1961 ) की धारा 355 के साथ पठित धारा 32 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, राज्य निर्वाचन आयोग के परामर्श से, एतद्वारा , मध्यप्रदेश नगरपालिका निर्वाचन नियम, 1994 में निम्नलिखित संशोधन करती है, अर्थात्ः-

उक्त नियमों में, अध्याय-नौ के पश्चात्, निम्नलिखित अध्याय जोड़ा जाए, अर्थात्ः-
"अध्याय- दस
81. महापौर/अध्यक्ष अभ्यर्थियों द्वारा निर्वाचन व्यय एवं संपरीक्षा का प्रस्तुत किया जानाः -
( 1 ) अभ्यर्थी जो महापौर/ अध्यक्ष के पद के लिए चुनाव लड़ रहे हैं उन्हें नामनिर्देशन प्रस्तुत करने के पूर्व किसी राष्ट्रीयकृत बैंक में उनके स्वयं के नाम खाता खोलना अपेक्षित होगा. जिसमें निर्वाचन की प्राप्तियों एवं व्ययों के पूर्ण ब्यौरे नियत होंगे . खाते के ब्यौरे रिटर्निंग ऑफिसर को दिए जाएंगे.
(2) दस हजार रुपयों से अधिक के व्यय चैक/इलेक्ट्रॉनिक माध्यम से किए जाएंगे.
(3) राज्य निर्वाचन आयोग , यथास्थिति, मध्यप्रदेश नगरपालिक निगम अधिनियम , 1956 की धारा 14-क की उपधारा ( 3 ) के उपबंधों के अधीन महापौर अभ्यर्थियों के लिए एवं मध्यप्रदेश नगरपालिका अधिनियम, 1961 की धारा 32 - क की उपधारा ( 3 ) के अधीन अध्यक्ष अभ्यर्थियों के लिए, अभ्यर्थियों द्वारा निर्वाचन व्यय प्रस्तुत करने की प्रक्रिया निर्धारित करते हुए आदेश जारी करेगा, और राजपत्र में उसको प्रकाशित करेगा. निर्वाचन व्यय लेखा में ऐसी विशिष्टियां अंतर्विष्ट होंगी जैसी कि राज्य निर्वाचन आयोग द्वारा विहित की जा सकें. ये आयोग द्वारा दी गई सिफारिशों से अनुपूरित होंगी.

(4) राज्य सरकार, राज्य निर्वाचन आयोग के परामर्श से निर्वाचन व्यय की अधिकतम सीमा निर्धारित करेगी.
82. महापौर/अध्यक्ष के पद के लिए अभ्यर्थियों के निर्वाचन व्यय के लेखों का दाखिल किया जानाः - मध्यप्रदेश नगरपालिक निगम अधिनियम, 1956 (क्रमांक 23 सन् 1956 ) की धारा 14 -ख के अनुसार, महापौर का निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को एवं मध्यप्रदेश नगरपालिका अधिनियम , 1961 (क्रमांक 37 सन् 1961 ) की धारा 32- ख में अभ्यर्थी जो नगरपालिका में निर्वाचन अध्यक्ष का चुनाव लड़ रहे हैं, राज्य निर्वाचन आयोग द्वारा अधिसूचित प्राधिकृत अधिकारी के समक्ष मतगणना की तारीख के लिए, निर्वाचन तारीख से 30 दिनों के भीतर उनके लेखे एवं व्यय विवरण प्रस्तुत करने होंगे.
83. मेयर/अध्यक्ष पद के लिए अभ्यर्थियों की निरर्हताः-
कोई अभ्यर्थी जो मध्यप्रदेश नगरपालिक निगम अधिनियम , 1956 की धारा 14- ग या मध्यप्रदेश नगरपालिका अधिनियम, 1961 की धारा 32 - ग के अधीन महापौर एवं अध्यक्ष के पद के लिए चुनाव लड़ रहे हैं , महापौर या अध्यक्ष का चुनाव लड़ने के लिए निरर्ह होंगे यदि वह उपरोक्त नियम 81 एवं 82 के अनुसार बिना किसी उचित कारण के निर्वाचन व्यय खाता प्रस्तुत करने में असफल रहते हैं, तथा निर्वाचन आयोग द्वारा यथाविनिर्दिष्ट ऐसी कालावधि के लिए पार्षद के उक्त पद या पद का चुनाव लड़ने के लिए भी निरर्हित होंगे.
84. निरर्हता कालावधि का हटाया जाना या कम किया जानाः-
राज्य चुनाव आयोग , इन नियमों के नियम 83 के अधीन निरर्हित किए गए अभ्यर्थियों से आवेदन प्राप्त करने पर निरर्हित कालावधि को कम करने या हटाने के लिए अभिलिखित कारणों के पश्चात् आदेश कर सकेगा. ".

अधि. क्र. 04- एफ-1-52-2017-अठारह 3.- भारत के संविधान के अनुच्छेद 348 के खण्ड ( 3 ) के अनुसरण में, इस विभाग की अधिसूचना क्र. 04- एफ-1-52-2017 -अठारह -3 , दिनांक 1 जून 2019 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्वारा प्रकाशित किया जाता है .

No. 04-F 1-52-2017 - XVIII - 3 .-- In exercise of the powers conferred by sub-section (2) of Section 14 and Section 433 of the Madhya Pradesh Municipal Corporation Act, 1956 (No. 23 of 1956) and sub- section (2) of Section 32 read with Section 355 of the Madhya Pradesh Municipalities Act, 1961 ( No. 37 of 1961) , the State Government , with the consultation of the State Election Commission, hereby, makes the following amendments in the Madhya Pradesh Nagarpalika Nirvachan Niyam , 1994, namely:-

In the said rules , after chapter IX, the following chapter shall be added, namely :-
"CHAPTER -X
81. Submission of Election expenditure and audit by the Mayor/President candidates:-
(1 ) The Candidates who are contesting for the post of Mayor /President are be required to open an account in their own name in any nationalized bank, before filing nomination. In which full details of receipts and expenses of the election shall remain fixed . The details of the account shall be given to the returning officer.

(2) Expenditure of more then ten thousand rupees shall be made through check/electronic medium.
(3) The State Election Commission , as the case may be , under the provisions of sub - section (3) of Section 14- A of the Madhya Pradesh Municipal Corporation Act, 1956 for Mayor candidates and sub - section (3) of Section 32 - A of madhya Pradesh Municipalities Act, 1961 for President candidates , shall issue orders dertermining the process to submit the election expenditure by the candidates , and publish it in the Gazette . The Election Expenditure Account shall contain such specifications as may be prescribed by the State Election Commission . These shall be supplemented by the recommendations given by the Commission.
(4) The State Government in consulation with the State Election Commission , shall determine the maximum limit of the election expenditure .
82. Filing of accounts of election expenditure of candidates for the post of Mayor/President:-
As per section 14-B of the Madhya Pradesh Municipal Corporations Act, 1956 (No. 23 of 1956) , every candidate who is contesting Mayor's election and Section 32- B of the Madhya Pradesh Municipalities Act, 1961 (No. 37 of 1961) , the candidate who is contesting President's election in municipalies shall have to submit their accounts and expenditure statement within 30 days from the date of election, to the counting date before the authorized officer notified by the State Election Commission.
83. Disqualification of candidature for Mayor /President post;-
Any candidate who is contesting for the post of Mayor or President under section 14 - C of the Madhya Pradesh Municipal Corporation Act , 1956 or under section 32 - C of the Madhya Pradesh Municipalities Act , 1961 shall be disqualified for contesting the election of Mayor or President , if he/ she fails to submit election expenditure account without any proper reason as per rule 81 and 82 above and shall remain disqualified for contesting such post or the post of Counsellor also , for such period as may be specified by the Election Commission.
84. Removal or reduction of disqualification period .
The State Election Commission , upon receving the application from the candidates who have been disqualified under rule 83 of these rules may after recording the reasons order for reduction or removal of the disqualified period . " .
