क्र. 1410-957-2018- दस- 2.-जैवविविधता अधिनियम , 2002 (2003 का 18 ) की धारा 63 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा, मध्यप्रदेश जैवविविधता नियम, 2004 में निम्नालिखित संशोधन करती है , अर्थात्ः-

.. उक्त नियमों में,
नियम 17 में, उप- नियम ( 1) के स्थान पर, निम्नलिखित उप- नियम स्थापित किया जाए अर्थात्:-
(1) वाणिज्यिक उपयोग के लिये जैव संसाधनों तथा उनसे सम्बद्ध जानकारी तक पहुंच उनका संग्रहण चाहने वाला कोई व्यक्ति इन नियमों से संलग्न प्रारूप -1 में बोर्ड को आवेदन करेगा । वाणिज्यिक उपयोग के प्रत्येक आवेदन के लिए रूपए 1000/- की फीस होगी और वह चेक या डिमान्ड ड्राफ्ट के रूप में होगी । " ।

2. नियम 23 में:-
(1) उप-नियम (1 ) के स्थान पर, निम्नलिखित उप - नियम स्थापित किया जाए , अर्थात्:-
" (1 ) प्रत्येक स्थानीय निकाय अपनी अधिकारिता के क्षेत्र के भीतर एक जैवविविधता प्रबंधन समिति का गठन करेगा । तदनुसार, जिला पंचायत, जनपद पंचायत, ग्राम पंचायत एवं ग्राम सभा स्तर के साथ- साथ नगर पंचायत, नगरपालिका एवं नगर निगम के वार्ड स्तर पर भी जैवविविधता प्रबंधन समितियों का गठन किया जाएगा । ग्राम सभा, ग्राम पंचायत, जनपद पंचायत एवं जिला पंचायत, नगर पंचायत, नगरपालिका एवं नगर निगम स्तर की जैवविविधता प्रबंधन समितियां कार्यपालिक समितियां होंगी । " ।
( 2) उप-नियम (2 ) के स्थान पर, निम्नलिखित उप-नियम स्थापित किया जाए, अर्थात्:-
" (2) यदि स्थानीय निकाय का यह समाधान हो जाए कि जैवविविधता प्रबंधन समितियों के कृत्य का निर्वहन स्थानीय निकाय की सामान्य सभा या इसकी विद्यमान समितियों में से किसी एक या ग्राम सभा स्तर पर मध्यप्रदेश वन विभाग के संकल्प क्रमांक 16-4-91-10-2 दिनांक 22-10-2001 के अधीन गठित वन समिति (जे एफ एम एस) द्वारा किया जा सकता है, तो इसे ऐसे स्थानीय निकाय द्वारा सम्यक प्रक्रिया का अनुसरण करते हुए पारित संकल्प के रूप में अभिलिखित किया जाएगा । यदि वन विभाग के संकल्प में उल्लिखित समिति को जैवविविधता प्रबंधन समितियों की जिम्मेदारी सौंपी जाती है, तो ऐसी समिति " वन समिति (जे एफ एम एस) सह जैवविविधता प्रबंधन समिति" कहलाएगी । " ।
( 3) उप-नियम (6) के. पश्चात्, निम्नलिखित उप-नियम अन्तःस्थापित किया जाए , अर्थात्:-
:
"(6क) जैवविविधता प्रबंधन समिति (बी एम सी) का अध्यक्ष, जैवविविधता समिति के सम्मिलन में उपस्थित होने के लिए जैवविविधता बोर्ड द्वारा यथा विनिश्चित बैठक भत्ते का हकदार होगा । " ।
( 4) उप-नियम (7) के पश्चात्, निम्नलिखित उप- नियम अन्तःस्थापित किया जाए;
अर्थात्:-
" (7क) जैवविविधता प्रबंधन समिति का अध्यक्ष प्रत्येक 3 माह में जैवविविधता प्रबंधन समिति का सम्मिलन बुलाएगा । " ।

2. प्रस्तावित जैवसंसाधनों के संग्रहण से पारिस्थितिकी तंत्र के लिए कोई खतरा उत्पन्न नहीं करेगा :
3. प्रस्तावित जैवसंसाधनों के संग्रहण से आनुवांशिक विविधता, प्रजातियां तथा पारिस्थितिकी तंत्र स्तर सहित जैवविविधता के लिए कोई खतरा उत्पत्र नहीं करेगा । 4. प्रस्तावित जैवसंसाधनों का संग्रहण स्थानीय समुदायों पर प्रतिकूल प्रभाव नहीं पड़ेगा;

(2) भारत का ऐसा नागरिक जो आयकर अधिनियम, 1961 (1961 का 43) की धारा 2 के खंड (30) में यथा परिभाषित अनिवासी है ।
(3) ऐसा निगमित निकाय, संगम या संगठन जो-
(एक) भारत में निगमित या रजिस्ट्रीकृत नहीं है ; या
(दो) तत्समय प्रवृत्त किसी विधि के अधीन भारत में निगमित या रजिस्ट्रीकृत है, जिससे उसकी शेयर पूंजी या प्रबंधन न में कोई गैर-- भारतीय भागीदारी है ।

No. 1410-957-2018 -X- 2 . In exercise of the powers conferred by sub - section ( 1 ) of Section 63 of the Biological Diversity Act, 2002 ( 18 of 2003) , the State Government , hereby, makes the following amendments in the Madhya Pradesh Biological Diversity Rules , 2004 , namely :-
AMENDMENT
In the said Rules , -
1. In rule 17, for sub- rule (1) , the following sub - rule shall be substituted , namely: -
"(1) Any person seeking access to /collection of biological resources and associated knowledge for commercial utilization shall make an application to the Board in Form- 1 appended to these rules . Every application for commercial utilization , shall be accompanied by a fee of Rs. 1000/ - in the form of a cheque or demand draft. " .
2. In rule 23,
(1) for sub - rule (1) , the following sub- rule shall be substituted, namely: -
"(1) Every local body shall constitute a Biodiversity Management Committee within its area of jurisdiction . Accordingly, Biodiversity Management: Committees are to be constituted at Zila Panchayat, Janpad Panchayat, Gram Panchayat and Gram Sabha level as well as at ward level in Nagar Panchayat , Municipality and Municipal Corporation. Gram Sabha , Gram Panchayat , Janpad Panchayat and Zila Panchayat, Nagar Panchayat , Municipality and Municipal Corporation level Biodiversity Management Committees shall be Executive Committees." .

(2) for sub - rule ( 2) , the following sub - rule shall be substituted , namely:-
"(2) If the local body is satisfied that the function of the Biodiversity Management Committee can be discharged by the general assembly of the local body, or by one of its existing committees or Forest Committee ( JFMCs) constituted under Govt . of M. P. , Forest Dept's resolution no . 16-4-91-10-2 dated 22.10.2001 at Gram Sabha level , the same should be recorded as resolution passed by such local body, following due procedure . If Committee mentioned in Forest Dept. resolution is given the responsibility of BMCs , such Committee will be called as "Forest Committee ( JFMCs ) Biodiversity Management Committee." . cum
(3) after sub- rule (6) , the following sub - rule shall be inserted, namely:-
"( 6a) The Chairperson of Biodiversity Management Committee ( BMC) shall be entitled for meeting allowance for attending meeting of Biodiversity Management Committee as decided by the Board." .
(4) after sub- rule (7) , the following sub - rule shall be inserted, namely:-
" ( 7a) The Chairperson of Biodiversity Management Committee shall convene the meeting of Biodiversity Management Committee in every 3 months ." .
