अधि.क्र.- 11 एफ-1-02-2016- अठारह - 3.- मध्यप्रदेश नगरपालिक निगम अधिनियम , 1956 (क्रमांक 23 सन् 1956) की धारा 433 तथा मध्यप्रदेश नगरपालिका अधिनियम, 1961 (क्रमांक 37 सन् 1961 ) की धारा 355 तथा 356 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार , एतद्वारा, मध्यप्रदेश नगरीय क्षेत्रों में विशेष आवश्यकताओं एवं आकस्मिक प्रयोजनों के लिए राशि के उपयोग के नियम , 2006 में निम्नलिखित और संशोधन करती है, अर्थात्:-

उक्त नियमों में,
1. नियम के स्थान पर , निम्नलिखित नियम स्थापित किया जाएं अर्थात्:-
"3 आबंटित निधि के उद्देश्य. इस निधि का गठन , मध्यप्रदेश नगरपालिक निगम अधिनियम, 1956 (क्रमांक 23 सन् 1956) तथा मध्यप्रदेश नगरपालिका अधिनियम 1961 (क्रमांक 37 सन् 1961 ) द्वारा या उनके अधीन नगरीय स्थानीय निकायों को, उन्हें सौंपे गए अनिवार्य और स्वैच्छिक कर्तव्यों के निर्वहन में समर्थ बनाने के उद्देश्य से किया गया है. यह विनिश्चत किया गया है, कि नगरीय प्रशासन तथा विकास विभाग को शीर्ष "मूलभूत सेवाएं (वाणिज्यिक कर, राज्य वित्त आयोग तथा सड़कों का पुनर्निर्माण) " के अधीन बजट के गैर - योजना शीर्ष में उपलब्ध कराई गई निधि में से निधि की 20 प्रतिशत राशि राज्य स्तर पर रखी जाएगी तथा शेष राशि विशेष आवश्यकताओं एवं आकस्मिक प्रयोजनों के लिए नगरीय स्थानीय निकायों को राज्य वित्त आयोग की अनुशंसा पर, राज्य सरकार द्वारा किए गए विनिश्चय के अनुरूप आबंटित की जाएगी . वह निधि, जो राज्य स्तर पर रखी गई है वह विशेष आवश्यकताओं एवं आकस्मिक प्रयोजनों के लिए छोटे तथा मध्यम शहरों की जल आपूर्ति योजनाओं को पूरा करने के लिए अपेक्षित वास्तविक लागत एवं अनुमोदित राशि के अन्तर की प्रतिपूर्ति करने के लिए तथा नगरीय स्थानीय निकायों को कॉलोनियों को नियमित करने हेतु अधोसंरचना विकास के लिए अनुदान उपलब्ध कराने के लिए आबंटित की जाएगी. यदि वर्ष के अंत में फिर भी कोई राशि बची रहती है , तो वह राज्य सरकार द्वारा नगरीय स्थानीय निकायों को आबंटित कर दी जाएगी . "

2. नियम 5 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए , अर्थात्:-
"बजट.- नियम 3 में विनिर्दिष्ट उद्देश्यों की पूर्ति हेतु निधि की बीस प्रतिशत राशि आरक्षित होगी , जो कि नगरीय प्रशासन एवं विकास विभाग के गैर - योजना बजट में उपलब्ध कराई गई है, जिसमें तीन उपशीर्ष यथा मूलभूत सेवाएं (वाणिज्यिक कर पर अधिभार ) , राज्य वित्त आयोग तथा सड़कों का पुनर्निर्माण तथा मरम्मत अंतर्विष्ट है. इस आरक्षित निधि को, नगरीय स्थानीय निकायों की आकस्मिक या विशेष आवश्यकताओं के प्रयोजन के लिए , छोटे तथा मध्यम शहरों की जल आपूर्ति योजनाओं को पूरा करने के लिए अपेक्षित वास्तविक लागत एवं अनुमोदित राशि के अंतर की प्रतिपूर्ति करने के लिए तथा नगरीय स्थानीय निकायों को कॉलोनियों को नियमित करने हेतु अधोसंरचना विकास के लिए अनुदान उपलब्ध कराने के लिए व्यय किया जाएगा. "
3. नियम 6 में, उप- नियम (1 ) में, -
(क) खण्ड (दो) के स्थान पर , निम्नलिखित खण्ड स्थापित किया जाए , अर्थात्:-
"(दो) एक वर्ष की कालावधि के दौरान नगर परिषद् के लिए एक करोड़ रुपए तथा नगरपालिका के लिए एक करोड़ पचास लाख रुपये तथा पांच लाख तक की जनसंख्या वाले नगरपालिक निगम के लिए दो करोड़ पचास लाख रुपए तथा पांच लाख से अधिक जनसंख्या वाले नगरपालिक निगम के लिए पांच करोड़ रुपए की अधिकतम राशि जारी की जा सकेगी. "
(ख) खण्ड (छह ) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए, अर्थात्:-
" ( छह) राज्य स्तर पर रखी गई निधि की 20 प्रतिशत राशि ऊपर खण्ड (एक ) से (छह ) में विनिर्दिष्ट निबंधनों और शर्तों के अधीन आकस्मिक एवं विशेष आवश्यकताओं के लिए आबंटित की जाएगी तथा निधि की शेष राशि छोटे तथा मध्यम शहरों की जल आपूर्ति योजनाओं को पूरा करने के लिए अपेक्षित वास्तविक लागत एवं अनुमोदित राशि के अन्तर की प्रतिपूर्ति करने के लिए तथा नगरीय स्थानीय निकायों के प्रस्ताव, जिसमें मेयर- इन- काउंसिल / प्रेसीडेंट- इन- काउंसिल के संकल्प भी सम्मिलित हैं, के आधार पर, नगरीय स्थानीय निकायों की कॉलोनियों को राज्य सरकार के निर्देशों के अनुसार नियमित करने हेतु अधोसंरचना विकास के लिए अनुदान उपलब्ध कराने , प्रधानमंत्री आवास योजना के अधीन सीवरेज कार्य तथा शहरी अधोसंरचना के लिए आबंटित की जाएगी. "

No.11 F - 1-02-2016 - XVIII - 3.- In excercise of the powers conferred by section 433 ofthe Madhya PradeshMuncipal Corporation Act , 1956 (No. 23 of 1956) and the section 355 and 356 of the Madhya Pradesh Municipalities Act , 1961 (No. 37 of 1961 ), the State Government , hereby, makes the follow- ing further amendments in the Madhya Pradesh Utilization of Funds for Contingent and Specific Purposes in the Urban Local Bodies Rules , 2006 , namely : -
AMENDMENTS
In the said rules , -
1. For rule 3 , the Following rule shall be substituted , namely :-
"3. Objects of allocated fund - This fund has been constituted with the objects to enable the urban Local Bodies for discharging their mandatory and Voluntary duties entrusted by or under the Madhya Pradesh Muncipal Corporation Act, 1956 (No. 23 of 1956) and the Madhya Pradesh Muncipal Act , 1961 (No. 37 of 1961 ). It has been decided that out of the fund provided in the non -plan head of the budget to the Urban Administration and Devlopment Department under the head "Basic Services (Commercial Tax, State Finance Commision and Re - construction of Road) " , 20% amount of the fund shall be retained at the State level and the remaining amount shall be allotted to the Urban Local Bodies for contingent and specific purposes on the recommendation of the State Finance Com- mission in conformity with the decision taken by the State Government . The fund which retained at the State Level shall be expended for contingent and specific purposes for compensating the differ- ence of the actual cost and approved amount required for completing water supply schemes of small and Medium Towns and to provide grant to Urban Local Bodies for infrastructure development to regularize the colonies . If any amount still remain in hand at the end of the year, then the same shall be allotted to the Urban Local Bodies by the State Government . "
2. For rule 5, the following rule shall be substituted, namely : -
Budget. For the fulfilment of the objects specified in rule 3 , the amount of 20% non- plan head of the budget of the Urban Administration and Devlopment Department which contains three sub heads viz . Basic services , ( surcharge on commercial tax) , State Finance Commission and Reconstruction and Repair of Roads . The reserved fund shall be expended for the purpose of contin- gent or specific requirments of Urban Local Bodies , for compensating the difference of the actual cost and approved amount required for completing water supply schemes of small and medium Towns and to provide grant to Urban local Bodies for infrastructure devlopment to regularize the colonies . " 3. In rule 6, in sub - rule ( 1 ) , -
(a) For clause ( ii) , the following clause shall be substituted , namely : -
"(ii) The maximum amount of rupees one crore for Nagar Parishad and rupees one crore and fifty lac to Municipality and rupees two crore fifty lac to Muncipal Corporation having population upto five lac and of rupees five core to Muncipal Corporation having population more than five lac may be issued during the pe- riod of one year, " मध्यप्रदेश राजपत्र , दिनांक 8 जुलाई 2019

(b) For clause (vi ) , the following clause shall be substituted, namely: -
"(vi) 20% amount of fund kept at State level amount shall be alloted for contingent and specified requirments under the terms and condition specified in clauses (i ) to (vi ) above and the remaining amount of fund shall be alloted for compensating the difference of the actual cost and approved amount required for completing water supply schemes of small and medium Towns and to provide grant to Urban local Bodies for insfrastructure devlopment to regularize the colonies as per directions of the State Government on the basis of the proposal of Urban Local Bodies in- cluding the resolution of Mayur - in- council /President- in Council , Sewege Work and urban Infrastructure under the Pradhan Mantri Awas Yojana . " .
