क्र. एफ- 22-43-2019- आठ.- मध्यप्रदेश मोटरयान नियम , 1994 में संशोधन का निम्नलिखित प्रारूप, जिसे राज्य सरकार, मोटरयान अधिनियम, 1988 ( 1988 का 59 ) की धारा 28 की उपधारा ( 2 ) के खण्ड ( घ ) , धारा 38 की उपधारा ( 2 ) के खण्ड ( ज ) , धारा 96 तथा 111 की उपधारा ( 1 ) तथा ( 2 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए बनाना प्रस्तावित करती है, उक्त अधिनियम की धारा 212 की उपधारा ( 1 ) द्वारा अपेक्षित किए गए अनुसार, उन समस्त व्यक्तियों की, जिनके कि उससे प्रभावित होने की संभावना है , जानकारी के लिए, एतद्वारा प्रकाशित किया जाता है और एतद्वारा यह सूचना दी जाती है कि उक्त प्रारूप पर इस सूचना के " मध्यप्रदेश राजपत्र " में प्रकाशन की तारीख से तीस दिवस का अवसान होने पर, विचार किया जाएगा.
किसी भी ऐसी आपत्ति या सुझाव पर, जो उक्त संशोधन प्रारूप के संबंध में , किसी व्यक्ति से ऊपर विनिर्दिष्ट कालावधि का अवसान होने के पूर्व या पर प्रमुख सचिव, मध्यप्रदेश शासन , परिवहन विभाग , कक्ष क्रमांक ए-103 , वल्लभ भवन-2, मंत्रालय, भोपाल को प्राप्त हो, विचार किया जाएगा.
प्रारूप संशोधन
उक्त नियमों में,-
1. नियम 9 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए, अर्थात्ः-
" 9. लोक सेवायान के चालक के लिए वर्दी - लोक सेवा यान का चालक वर्दी पहनेगा.
क. नीली शर्ट या कोट जिस पर फ्लैप लगी दो जेबे लगी हों;
ख. काली पतलूनः

परन्तु राज्य सरकार, सामान्य या विशेष आदेश द्वारा , सभी या ऐसे चालकों के किसी वर्ग को इस नियम के प्रवर्तन से ऐसी अवधि के लिए छूट दे सकेगी , जैसा कि आदेश में विनिर्दिष्ट की जाये. ".
2. नियम 36 के स्थान पर, निम्नलिखित नियम, स्थापित किया जाए, अर्थात्ः-
" 36. मंजिली गाड़ियों के परिचालक की वर्दी:-
क. नीली बुशर्ट या कोट जिस पर फ्लैप सहित, दो जेबें लगी हों तथा दोनों बाहों के ऊपर काले रंग से " परिचालक " लिखा हुआ फ्लैप लगा हो.
ख. काली पतलून.".
3. नियम 77 में, -
(1) उप - नियम ( 1 - क) में, खण्ड ( चार ) में, उपखण्ड 1 , 2 तथा 3 के स्थान पर, निम्नलिखित उपखण्ड स्थापित किए जाएं, अर्थात्ः-
35+1 से कम सीट न हो
" 1. डीलक्स/वातानुकुलित बस
45+1 से कम सीट न हो
2. एक्सप्रेस बस
50+ 1 से कम सीट न हो
3. साधारण बस
(2) उपनियम ( 1 ख ) का लोप किया जाए.
NOTICE
No. F- 22-43-2019 - VIII . The following draft of amendment in the Madhya Pradesh Motor Vehicles Rules , 1994 which the State Government proposes to make in exercise of the powers conferred by clause (d) of sub- section (2) of Section 28 , clause (h) of section (2) of section 38 , section 96 and sub- section ( 1 ) and (2) of section 111 of the Motor Vehicles Act, 1988 (No. 59 of 1988 ) , is hereby published as required by sub - section ( 1 ) of section 212 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft shall be taken into consideration on the expiry of 30 days from the date of publication of this notice in the "Madhya Pradesh Gazette" .
Any objection or suggestion which may be received from any person with respect to the said draft of amendment on or before the expiry of the period specified above shall be considered by the Principal Secretary, Government of Madhya Pradesh , Transport Department, Room No. A- 103 , Vallabh Bhavan- 2, Mantralaya , Vallabh Bhawan , Bhopal .
DRAFT OF AMENDMENT
In the said rules ,-
1. For Rule 9 , the following Rule shall be substituted , namely:-
"9. Uniform for driver of Public Service Vehicle : The driver of a public service vehicle shall wear the uniform-
(a) Blue shirt or coat with two pockets with flaps ;
(b) Black trouser :
Provided that the state Government may, by general or special order , exempt all or any class of such derivers from the operation of this rule for such period as may be specified in the order. " .

584 (1) 2. For Rule 36, the following Rule shall be substituted , namely :-
"36. Uniform of conductor of stage Carriages :-
(a) Blue Bushirt or coat with two pockets with flaps and a flap inscribed on both sleeved "Conductor " in black colour shall be affixed .
(b) Black trouser." .
3. In rule 77 ,-
(1) in sub -rule ( la) in clause ( iv) , for sub - clause 1 , 2 and 3 , the following sub - clause shall be substituted , namely:-
not less than 35 + 1 seats
1. Deluxe/Air conditioner bus
not less than 45 + 1 seats
2. Express bus
not less than 50 + 1 seats
3. Ordinary bus
