क्र. एफ 22-124-2019- आठ. मध्यप्रदेश मोटरयान कराधान अधिनियम , 1991 (क्रमांक 25 सन 1991 ) की धारा 21 की उपधारा (1 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा , इस अधिसूचना के प्रकाशन से पूर्व रजिस्ट्रीकृत समस्त प्रवर्गों तथा आयु- सीमा के मोटरयानों को मोटरयान कर तथा शास्ति के शोध्यों के भुगतान से निम्नानुसार छूट प्रदान करती है: - 1. पथभ्रष्ट यानों पर कर की छूटः- इस प्रवर्ग के यानों को देय मोटर यान कर एवं उस पर शास्ति की देय रकम परं 90 प्रतिशत छूट निम्नलिखित निबंधनों एवं शर्तों पर प्रदान की जाएगी ।
(1 ) ऐसे यान जो विनिर्माण की तारीख से 20 वर्ष पूर्ण कर चुके हों तथा परिवहन विभाग में अभी भी रजिस्ट्रीकृत हैं ।
(2) ऐसे यान जिन पर मोटर यान कर या शास्ति अथवा दोनों लंबित हैं तथा वाहन स्वामी स्वेच्छा से वाहन का रजिस्ट्रीकरण निरस्त कराना चाहता है ।
(3 ) ऐसे यान जिनके लिए अनुज्ञापत्र, फिटनेस प्रमाण-पत्र तथा बीमा नहीं लिया गया हो और इस अधिसूचना के जारी होने की तारीख से विगत पांच वर्षों के भीतर किसी अपराध के लिए यान के विरूद्ध कोई प्रकरण दर्ज न किया गया हो;
परंतु स्वामी द्वारा शपथ-पत्र अथवा सक्षम प्राधिकारी द्वारा जारी इस प्रभाव का एक प्रमाण-पत्र प्रस्तुत किया जाएगा ।
(4) छूट प्राप्त मोटर यान कर एवं शास्ति के भुगतान की समय- सीमा अधिसूचना के जारी किए जाने की तारीख से 31 मार्च 2020 तक होगी ।

2.एकमुश्त भुगतान के लिए छूट-
(1 ) यानों पर अप्राप्त मोटर यान कर एवं शास्ति के एकमुश्त भुगतान के लिए छूट उप- नियम( 2) में वर्णित निबंधनों तथा शर्तों के अध्ययीन रहते हुए निम्नानुसार होगी : -

40प्रतिशत 2. अधिसूचना की तारीख से 5 वर्ष से अधिक किन्तु 10 वर्ष से अनधिक पुराने रजिस्ट्रीकृत यान ।
50 प्रतिशत 3. अधिसूचना की तारीख से 10 वर्ष से अधिक किन्तु 15 वर्ष से अनधिक पुराने रजिस्ट्रीकृत यान।
70प्रतिशत 4. अधिसूचना की तारीख से 15 वर्ष से अधिक पुराने रजिस्ट्रीकृत यान ।
(2) निबंधन तथा शर्तें : -
(क) छूट प्राप्त मोटरयान कर एवं शास्ति के भुगतान के लिए समय - सीमा अधिसूचना जारी किए जाने की तारीख से 31 मार्च 2020 तक होगी ।
(ख) ऐसे यान जिससे मोटरयान कर तथा शास्ति अप्राप्त है, आयु- सीमा की गणना अधिसूचना जारी किए जाने की तारीख से की जाएगी ।
(ग) अधिसूचना जारी किए जाने की तारीख के पश्चात् के यानों के मोटर यान कर एवं शास्तिकी गणना विधमान दरों के अनुसार की जाएगी ।

F 22-124 / 2019 / VIII , In exercise of the powers conferred by sub - section ( 1) of section 21 of the Madhya Pradesh Motoryan Karadhan Adhiniyam , 1991 ( No. 25 of 1991 ) , the State Government , hereby , exempts the motor vehicles of all categouries and age limit registered before the publication of this notification from the payment of dues of motor vehicle tax and penalty as under: - 678(1)

1. Exemption of taxes on Astray Vehicles.- The vehicle of this categourie shall be given 90 percent discount on the payable amount of motor vehicle tax and penalty thereon , subject to the following terms and conditions: - (1 )Vehicles which have completed 20 years from the date of manufacture and are still registered in the Transport Department .
(2) Vehicles on which motor vehicle tax or penalty or both are pending and the vehicle owner voluntarily wants to cancel the registration of the vehicle .
(3) Such vehicles for which Permit, Fitness Certificate and Insurance have not been taken and no case has been registered on the vehicle for any crime within last five years from the date of issue of this notification:
Provided that an affidavit by the owner or a certificate to this effect is issued by the competent authority shall be submitted.
(4)The time limit for payment of discounted motor vehicle tax and penalty shall be 31st March , 2020 from the date of issue of notification .

2. Discount for one time payment : -
(1) Discount for one time payment of default motor vehicle tax and penalty on vehicles shall be as follows subject of the terms and conditions described in sub rule (2): -

(2) Terms and conditions : -
(a) The time limit for payment of discounted motor vehicle tax and penalty shall be 31st March , 2020 from the date of issuance of Notification .
(b) The age limit of the vehicles which have default motor vehicle tax and penalty shall be counted from the date of issuance of the Notification .
(c) After the date of issue of notification the motor vehicle tax and penalty of vehicles shall be counted as per the existent rates .

उक्त नियमों में, नियम 2 के खण्ड (ड. ) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए , अर्थात :-
"(ड.) "मास " से अभिप्रेत है, ब्रिटिश कलेण्डर का संपूर्ण मास या उसका भाग; ";

For clause (e) of rule 2 , the following clause shall be substituted, namely: -
" (e) " month" means a complete month of a Calendar or part thereof; British
