क्रमांक- एफ-22-170-2019-आठ. योजना का निम्नलिखित प्रारूप जिसे राज्य सरकार मोटरयान अधिनियम 1988 की धारा 96 की उपधारा (2) के खण्ड (तैतीस) , धारा 111 , धारा 117 एवं धारा 138 की उपधारा (2) के खण्ड (ञ) सहपठित धारा 67 की उपधारा (3) द्वारा प्रदत्त इसे इस दिशा में सक्षम बनाने वाली अन्य सभी शक्तियों का प्रयोग करते हुये और माननीय उच्च न्यायालय ग्वालियर द्वारा अवमानना याचिका क्रमांक 608/2013 में, पारित स्कूल जाने वाले विद्यार्थियों का परिवहन करने वाले वाहनों के लिये विनियामक प्रावधान बनाये जाने के आदेश दिनांक 08.12.2017 के पालन में, राज्य सरकार एतद् द्वारा "विद्यार्थियों के सुरक्षित परिवहन हेतु शैक्षणिक वाहनों के नियंत्रण एवं विनियमन योजना-2019" बनाना प्रस्तावित करती है । उक्त अधिनियम की धारा 212 की उपधारा (1 ) द्वारा अपेक्षित किये गये अनुसार उन समस्त व्यक्तियों की, जिनसे कि उससे प्रभावित होने की सम्भावना है , जानकारी के लिये एतद् द्वारा प्रकाशित किया जाता है और एतद् द्वारा यह सूचना दी जाती है कि उक्त प्रारुप पर, इस सूचना के "मध्यप्रदेश राजपत्र" में प्रकाशन की तारीख से पन्द्रह दिन का अवसान हो जाने के पश्चात् विचार किया जावेगा ।
किसी भी ऐसी आपत्ति या सुझाव पर जो कि, उक्त प्रारुप के संबंध में ऊपर विनिर्दिष्ट कालावधि का अवसान होने के पूर्व किसी व्यक्ति से प्राप्त हो , प्रमुख सचिव, परिवहन विभाग, मध्यप्रदेश शासन मंत्रालय, भोपाल द्वारा विचार किया जायेगा ।

: योजना का प्रारूपः
1. संक्षिप्त नाम , विस्तार और प्रारंभ:-
(1) इस योजना का संक्षिप्त नाम "विद्यार्थियों के सुरक्षित परिवहन हेतु शैक्षणिक वाहनों के नियंत्रण एवं विनियमन योजना 2019 " है ।
(2) इस का विस्तार संपूर्ण मध्यप्रदेश राज्य में होगा ।
(3) यह मध्यप्रदेश राजपत्र में उनके प्रकाशन के दिनांक से प्रवृत होगी ।
2. परिभाषाऐं:- इस योजना में जब तक संदर्भ से अन्यथा अपेक्षित न हो
(क) " अधिनियम" से अभिप्रेत है मोटरयान अधिनियम, 1988 (1988 का 59) ;
(ख ) " शैक्षणिक वाहन" से अभिप्रेत है विद्यार्थियों के वहन हेतु परिकल्पित तथा निर्मित यात्री वाहन, उसमें सम्मिलित है शैक्षणिक ऑटो रिक्शा, शैक्षणिक वेन, संस्थागत शैक्षणिक बस तथा गैर संस्थागत शैक्षणिक बस ;
(ग ) " शैक्षणिक ऑटो रिक्शा' से अभिप्रेत है चालक को छोड़कर 6 सवारियों तक की बैठक क्षमता वाला 3. पहिया यात्री वाहन;
(घ)" शैक्षणिक वैन " से अभिप्रेत है चालक को छोड़कर 12 सवारियों तक की बैठक क्षमता वाला 4 पहिया यांत्री वाहन;
(ड.)"असंस्थागत शैक्षणिक बस " से अभिप्रेत है चालक को छोड़कर 13 या 13 से अधिक सवारियों की बैठक क्षमता वाला यात्री वाहन जो कि किसी शैक्षणिक संस्था के नाम पर पंजीकृत नहीं है;
(च)"संस्थागत शैक्षणिक बस " से अभिप्रेत है चालक को छोड़कर 7 या 7 से अधिक सवारियों की बैठक क्षमता वाला यात्री वाहन जो कि शैक्षणिक संस्था के नाम पर पंजीकृत है/ शैक्षणिक संस्था द्वारा लीज पर लिया गया है;
टिप्पणः-शैक्षणिक संस्था द्वारा लीज पर लिये गये वाहन के पंजीयन कार्ड पर शैक्षणिक संस्था का नाम लीजधारक रूप में दर्ज होना अनिवार्य होगा तथा ऐसे वाहन का परमिट शैक्षणिक संस्था के नाम से ही जारी किया जाएगा ।
(2) इस योजना में प्रयुक्त कोई भी शब्द या अभिव्यक्ति, जिसे यहां पर परिभाषित नहीं किया गया है, उसका वही अर्थ होगा जैसा उसे मोटरयान अधिनियम, 1988 एवं उसके अर्न्तगत बने नियमों में समनुदेशित किया गया है ।
3. शैक्षणिक वाहनों हेतु मापदण्ड:-
(1) सभी शैक्षणिक वाहनों के पंजीयन हेतु सभी परिवहन कार्यालयों में "EV" पंजीयन सिरीज आरक्षित रखी जाएंगी । 776(1)

(2) सभी शैक्षणिक वाहन विनिर्माण वर्ष से 15 वर्ष से अधिक पुराने नहीं होंगे । (3) सभी शैक्षणिक वाहनों के अंदर तथा पिछले बाहरी हिस्से पर डायल 100 हेल्प लाइन नंबर काले रंग से लिखा जाकर सुस्पष्ट रूप से प्रदर्शित होगा।
(4) सभी शैक्षणिक वाहनों में अधिकतम 40 कि.मी. प्रतिघंटे की गति नियंत्रित करने हेतु अधिकृत गति नियंत्रक लगा होगा ।
(5) सभी शैक्षणिक वाहनों में व्हीकल ट्रेकिंग डिवाइस (VTD), कैमरे तथा पेनिक बटन लगे होंगे । VTD का परिवहन विभाग के सेन्ट्रल सर्वर से एन्टीग्रेशन अनिवार्य होगा तथा वाहन में परिवहन किए जाने वाले विद्यार्थियों के अभिभावकों एवं संबंधित शैक्षणिक संस्था को इसका ऐक्सेस प्रदान करना भी आवश्यक होगा । (6) सभी शैक्षणिक वाहनों में प्रथम उपचार पेटी एवं वाहन अनुसार निर्धारित मात्रा का अग्निशमन यंत्र लगा होगा। अग्निशमन यंत्र की मात्रा निम्नानुसार निर्धारित होगी:-

(7) सभी शैक्षणिक वाहनों की खिड़कियों पर विद्यार्थियों की सुरक्षा हेतु नियमानुसार हॉरीझोन्टल बार लगे होंगे जिनकी आपस मे दूरी 5 सें.मी. से अधिक नहीं होगी।
(8) सभी शैक्षणिक वाहनों की खिड़कियों पर काले कॉच या परदे नहीं लगे होंगे तथा शैक्षणिक वाहनों के अंदर की गतिविधि सदैव वाहन के बाहर से स्पष्ट रूप से दृश्यमान होनी चाहिए ।
(9) सभी शैक्षणिक वाहनों के दरवाजे की लॉकिंग प्रणाली सदैव अच्छी स्थिति में होगी ।
(10) सभी शैक्षणिक वाहनों में विद्यार्थियों को चढ़ाते एंव उतारते समय, वाहन के अग्र एवं पृष्ठ भाग के सभी साईड इंडिकेटरों को एक साथ क्रियाशील किए जाने की व्यवस्था उपलब्ध होगी । :
(11 ) संस्थागत शैक्षणिक बस तथा असंस्थागत शैक्षणिक बस AIS- 063 अनुसार पीले रंग की होगी । मध्यप्रदेश राजपत्र, दिनांक 18 सितम्बर 2019

(12) संस्थागत शैक्षणिक बस तथा असंस्थागत शैक्षणिक बस के बाहरी अग्र एवं पृष्ठ भाग पर काले रंग से "शैक्षणिक वाहन " लिखा जाकर सुस्पष्ट रूप से प्रदर्शित होगा ।
(13) 13 या 13 से अधिक सवारियों की बैठक क्षमता वाली सभी शैक्षणिक वाहन AIS- 063 सह AIS- 052 के मानदण्ड अनुसार निर्मित होगी ।
(14) शैक्षणिक ऑटो रिक्शा तथा शैक्षणिक वैन के बाहरी अग्र एवं पृष्ठ भाग पर पीले रंग पर काले रंग से "शैक्षणिक वाहन" लिखा होगा ।
(15) संस्थागत शैक्षणिक बस के बाहरी अग्र , पृष्ठ, दांये तथा बांये भाग पर शैक्षणिक संस्था का नाम, पता एवं दूरभाष नंबर काले रंग से लिखा जाकर सुस्पष्ट रूप से प्रदर्शित होगा।.
(16) संस्थागत शैक्षणिक बसों तथा असंस्थागत शैक्षणिक बसों में सीटों के नीचे विद्यार्थियों के बस्ते, टिफिन तथा पानी की बाटल रखने हेतु पर्याप्त एवं सुरक्षित स्थान होगा ।
(17) शैक्षणिक ऑटो रिक्शा तथा शैक्षणिक वैन की छत के ऊपर विद्यार्थियों के बस्ते, टिफिन तथा पानी की बाटल रखने हेतु पर्याप्त, जलरोधी एवं सुरक्षित स्थान . होगा ।
(18 ) "शैक्षणिक वैन" की हॉर्ड टॉप बॉडी होना अनिवार्य हैं ।
(19) शैक्षणिक वाहनों का एल.पी.जी. ईधन द्वारा संचालन प्रतिबंधित रहेगा ।
4. शैक्षणिक वाहनों के चालकों एवं परिचालकों की नियुक्ति की शर्ते उनके कर्तव्य एवं आचरण
(1) संस्थागत शैक्षणिक बसों तथा असंस्थागत शैक्षणिक बसों के चालकों के पास भारी परिवहन यान चलाने का कम से कम 5 वर्ष पुराना व्यवसायिक ड्रायविंग लायसेंस हो ।
(2) शैक्षणिक ऑटो रिक्शा तथा शैक्षणिक वैन के चालकों के पास हल्के परिवहन यान चलाने का कम से कम 5 वर्ष पुराना ड्रायविंग लायसेंस हो ।
(3) ऐसे चालक जिनका वर्ष में 2 बार से अधिक रेड लाईट जंपिंग , लेन अनुशासन के उल्लंघन के अपराध में चालान किया गया हो तो ऐसे चालक को कार्य पर नहीं रखा जाएगा ।
(4) ऐसे चालक जिनका वर्ष में एक बार भी अत्यधिक गति से वाहन चलाने, खतरनाक तरीके से वाहन चलाने, नशे की स्थिति में वाहन चलाने, अपराधिक व्यक्ति द्वारा वाहन चलवाने या केन्द्रीय मोटरयान नियम, 1989 के नियम 21 में उल्लिखित किसी कृत्य के, अपराध में चालान किया गया हो तो ऐसे चालक को कार्य पर नहीं रखा जाएगा ।
(5) परिचालकों की आयु 21 वर्ष से कम तथा 60 वर्ष से अधिक नहीं होगी । 776(3)

(6) शैक्षणिक वाहन जिनमें संपूर्ण मार्ग या मार्ग के किसी भाग में केवल छात्राओं का ही परिवहन किया जाता है, तो महिला परिचालक की नियुक्ति अनिवार्य होगी । (7) सभी शैक्षणिक वाहनों के चालकों/ परिचालकों का पुलिस द्वारा चरित्र सत्यापन कराया जाना अनिवार्य होगा ।
(8) शैक्षणिक वाहनों के चालकों को प्रति वर्ष कम से कम MBBS स्तर की योग्यता वाले चिकित्सक से स्वास्थय परीक्षण तथा नेत्ररोग विशेषज्ञ से आँखों की जाँच कराना होगा । परिक्षण उपरांत चिकित्सक द्वारा जारी फिटनेस प्रमाण पत्र की प्रति उन सभी शैक्षणिक संस्थाओं को प्रदान करना होंगी जहाँ के विद्यार्थियों का परिवहन किया जाता हैं ।
(9) शैक्षणिक वाहन के चालक एवं परिचालक वाहन चलाते समय मोटरयान चालन विनियम, 2017 का पालन करेगा । यदि उनके द्वारा कर्तव्यों का पालन नहीं किया जाता है, तो इसकी व्यक्तिगत जिम्मेदारी चालक एवं परिचालक के साथ-साथ संबंधित शैक्षणिक संस्था प्रबंधन और प्राचार्य की होगी ।
(10) शैक्षणिक वाहन के वाहन चालक निर्धारित वैध दस्तावेजों के बिना वाहन का * संचालन नहीं करेंगे ।
(11 ) शैक्षणिक वाहन का चालक वाहन चलाते समय मोबाईल फोन का उपयोग नहीं करेगा, धूम्रपान नहीं करेगा तथा न ही किसी भी नशे की हालत में वाहन चलाएगा ।
(12) शैक्षणिक वाहन के चालक द्वारा लॉगबुक संधारित की जाएगी जिसमे वाहन में परिलक्षित त्रुटियों का दिनांकवार उल्लेख किया जाएगा तथा त्रुटियों को ठीक कराने हेतु यथाशीघ्र पहल की जाएगी ।
(13) शैक्षणिक वाहनों के चालक शैक्षणिक वाहनों को सदैव साफ सुथरी स्थिति में रखने हेतु उत्तरदायी होगा ।
(14) विद्यार्थियों के परिवहन के दौरान कोई असामान्य घटना घटित हो तो जानकारी तुरन्त शैक्षणिक संस्था को देना होगी ।
(15) शैक्षणिक वाहनों में छोटे बच्चों को सुरक्षित रूप से चढ़ाने एवं उतारने का उत्तरदायित्व परिचालकों का होगा ।
(16) शैक्षणिक वाहनों के चालकों / परिचालकों द्वारा 10 वर्ष से कम आयु के बच्चों को अभिभावक या अभिभावक द्वारा नियुक्त व्यक्ति की अनुपस्थिति में वाहन से नहीं उतारा जाएगा, चालक / परिचालक द्वारा ऐसे बच्चों के अभिभावकों से फोन पर संपर्क कर उनके द्वारा नाम निर्देशित व्यक्ति के ही सुपुर्द किया जाएगा । यदि चालक / परिचालक का अभिभावक से संपर्क नहीं हो पाता है तो ऐसे बच्चों को वापस शैक्षणिक संस्था में लाकर संस्था के जिम्मेदार व्यक्ति के सुपुर्द किया जाएगा ।
(17) शैक्षणिक वाहनों में निर्धारित क्षमता से अधिक विद्यार्थी ले जाने के लिए वाहन के चालक/ परिचालक प्रत्यक्ष रूप से जिम्मेदार होंगे । मध्यप्रदेश राजपत्र , दिनांक 18 सितम्बर 2019

(18) संस्थागत शैक्षणिक बसों के चालकों तथा पुरूष परिचालकों की वर्दी मध्यप्रदेश मोटरयान नियम 9 एवं नियम 36 के अनुसार निम्नानुसार होगी
1. चालक
(क) नीली शर्ट या कोट जिस पर फ्लेप सहित दो जेबें लगी हों, (ख) काली पतलून
2. परिचालक-
(क) नीली शर्ट या कोट जिस पर फ्लेप सहित दो जेबें लगी हों तथा दोनों बांहों के ऊपर काले रंग से " परिचालक" लिखा हुआ फ्लेपं लगा हो,

(19) सुभी शैक्षणिक वाहनों के चालकों और परिचालकों द्वारा अपनी वर्दी पर नेमप्लेट लगाना अनिवार्य होगा । काले रंग की नेमप्लेट धातु या प्लास्टिक की होंगी जिसका आकार 8x2 से.मी. का होगा । नेमप्लेट पर देवनागरी लिपि हिंदी में 6 मि.मि. आकार के सफेद मोटे अक्षरों में चालक / परिचालक का नाम उत्कीर्ण होगा ।
5. शैक्षणिक वाहनों के परमिट तथा मोटरयान कर :-
) सभी शैक्षणिक वाहनों के परमिट जारी करने/ नवीनीकरण के लिए प्ररूप -1 में (1
आवेदन करना होगा, आवेदन के साथ-
(एक) निर्धारित फीस,
(दो) कर बकाया न होने का प्रमाण पत्र,
(तीन) वैध बीमा प्रमाण पत्र,
(चार) वैध फिटनेस प्रमाण पत्र तथा
(पॉच) इस आशय का शपथ पत्र प्रस्तुत करना होगा कि वाहन पर अधिकतम 40 कि.मी. प्रतिघंटे की गति नियंत्रित करने हेतु अधिकृत गति नियंत्रक उपकरण लगा है साथ ही वाहन में व्हीकल ट्रेकिंग डिवाइस (VTD) , केमरे, पेनिक बटन, प्रथम उपचार पेटी एवं वाहन अनुसार निर्धारित मात्रा का अग्निशमन यंत्र लगा है तथा शपथ पत्र में यह भी घोषणा करना होंगी कि वाहन विद्यार्थियों के परिवहन हेतु पूर्ण रूप से सुरक्षित है । (2) सभी शैक्षणिक वाहनों के परमिट प्ररूप-2 में जारी किए जाएंगे । परमिट जारी /नवीनीकरण दिनांक से 5 वर्ष की अवधि के लिए वैध होगा । शैक्षणिक संस्था की विधिमान्यता समाप्त होने की स्थिति में जारी किया गया परमिट स्वतः समाप्त माना जाएगा । 776(5)

(3) शैक्षणिक वाहनों के परमिट जारी करने/ नवीनीकरण के लिए फीस मध्यप्रदेश मोटरयान नियम, 1994 के नियम 145 में विहित किये गये अनुसार होगी - (4) शैक्षणिक वाहनों पर निम्नानुसार मोटरयान् कर देय होगा -
(क) शैक्षणिक ऑटो रिक्शा तथा शैक्षणिक वैन
मोटरयान कराधान अधिनियम, 1991 की द्वितीय अनुसूची के. अनुसार जीवनकाल कर
(ख ) असंस्थागत शैक्षणिक बस
मोटरयान कराधान अधिनियम, 1991 की प्रथम अनुसूची की मद (छह) के अनुसार
(ग) संस्थागत शैक्षणिक बस
भोटरयान कराधान अधिनियम, 1991 की प्रथम अनुसूची की मद (सात) के अनुसार
(5) विद्यार्थियों के परिवहन समय के अतिरिक्त समय में असंस्थागत शैक्षणिक बस, शैक्षणिक ऑटो रिक्शा तथा शैक्षणिक वैन नियमानुसार परमिट प्राप्त कर लोक सेवा यान के रूप में संचालित की जा सकती हैं ।
(6) असंस्थागत शैक्षणिक बस तथा संस्थागत शैक्षणिक बस द्वारा स्वयं के शैक्षणिक संस्था स्टॉफ का परिवहन किया जा सकता हैं ।
6. विद्यार्थियों के सुरक्षित परिवहन हेतु शैक्षणिक संस्थाओं का उत्तरदायित्व एवं कर्तव्य:-
(1) सभी शैक्षणिक संस्थाओं द्वारा अपने शैक्षणिक संस्था के विद्यार्थियों का वहन करने वाले शैक्षणिक ऑटो रिक्शा, शैक्षणिक वैन तथा असंस्थागत शैक्षणिक बस * के स्वामियों के साथ अनुबंध निष्पादित करना होगा, जिसके अंतर्गत विद्यार्थियों के सुरक्षित परिवहन हेतु आवश्यक शर्तों का समावेश होगा ।
(2) सभी शैक्षणिक संस्थाओं द्वारा अपने शैक्षणिक संस्था में ट्रॉसपोर्ट मैनेजर की नियुक्ति करना अनिवार्य होगा । विद्यार्थियों के सुरक्षित परिवहन को सुनिश्चित करने की जिम्मेदारी ट्रॉसपोर्ट मैनेजर की होगी ।
(3) प्रत्येक शैक्षणिक संस्था को नया सत्र प्रारंभ होने के 15 दिवस के अंदर उनके संस्थान मे संचालित समस्त शैक्षणिक वाहनों की सूची हार्ड एवं साफ्ट कॉपी में पुलिस विभाग , परिवहन विभाग एवं शिक्षा विभाग को प्रदान करना होंगी तथा सूची में फेरबदल की सूचना, फेरबदल के 7 दिवस के अंदर प्रदान करना होंगी । (4) सभी शैक्षणिक वाहनों के अंदर एक रजिस्टर रखना अनिवार्य होगा जिसमें परिवहन किए जाने वाले विद्यार्थियों का नाम, विद्यार्थियों का ब्लड ग्रुप, अभिभावक का नाम, पता, फोन नंबर, विद्यार्थियों की कक्षा तथा शैक्षणिक संस्था का नाम दर्ज होगा ।
(5) सभी शैक्षणिक वाहनों के साथ परमिट, बीमा प्रमाण पत्र, फिटनेस प्रमाण पत्र, मोटरयान कर जमा होने का प्रमाण पत्र तथा प्रदूषण नियंत्रण प्रमाण पत्र की प्रमाणित प्रतिलिपि होना अनिवार्य हैं । मध्यप्रदेश राजपत्र, दिनांक 18 सितम्बर 2019

(6) सभी शैक्षणिक वाहनों में विद्यार्थियों की बैठक क्षमता म.प्र.मोटरयान नियम, 1994 के नियम 93 के अनुसार निर्धारित होगी । निर्धारित बैठक क्षमता से अधिक विद्यार्थियों का वहन नहीं किया जाएगा ।
(7) शैक्षणिक वाहनों के स्टॉप ऐसे स्थान पर निर्धारित हों जहाँ विद्यार्थियों को वाहन मे चढ़ाने उतारने में खतरा ना हो, न ही सड़क पर जाम की स्थिति निर्मित हो । (8) प्रत्येक शैक्षणिक संस्था को शैक्षणिक वाहन में आने वाले विद्यार्थियों का ऐक्सेल फार्मेट में कम्प्यूट्रीकृत अद्यतन रिकार्ड संधारित करना होगा जिसके अंतर्गत विद्यार्थियों का नाम, विद्यार्थियों का ब्लड ग्रुप, अभिभावक का नाम, पता, फोन * नंबर, विद्यार्थियों की कक्षा, शैक्षणिक वाहन क्रमांक तथा वाहन ट्रिप कमांक दर्ज होगा ।
(9) शैक्षणिक संस्था प्रबंधन, उनके शिक्षण संस्थान के विद्यार्थियों का परिवहन करने वाले शैक्षणिक वाहनों का नियमित निरीक्षण कर यह सुनिश्चित करेंगे कि वाहनों पर निर्धारित गति नियंत्रक उपकरण (SLD) , व्हीकल ट्रेकिंग डिवाइस (VTD ), कैमरे, पेनिक बटन, प्रथम उपचार पेटी एवं वाहन अनुसार निर्धारित मात्रा का.. अग्निशमन यंत्र लगे हैं जो अच्छी एवं वर्किंग स्थिति में है तथा वाहन विद्यार्थियों के परिवहन हेतु पूर्ण रूप से सुरक्षित हैं ।
(10) शैक्षणिक संस्था प्रबंधन को, उनके शिक्षण संस्थान के विद्यार्थियों का परिवहन करने वाले शैक्षणिक वाहनों के परमिट, बीमा प्रमाण पत्र, फिटनेस प्रमाण पत्र, प्रदूषण नियंत्रण प्रमाण पत्र तथा चालक के ड्रायविंग लायसेंस का रिकार्ड संधारित करना होगा तथा किसी भी दस्तावेज की विधिमान्यता समाप्त होने पर संबंधित वाहन का संचालन तत्काल प्रभाव से बंद किया जाना सुनिश्चित करना होगा ।.
(11) शैक्षणिक संस्था प्रबंधन, उनके शिक्षण संस्थान के विद्यार्थियों का परिवहन करने वाले शैक्षणिक वाहनों का नियमित निरीक्षण कर यह सुनिश्चित करेंगे कि वाहनों में निर्धारित क्षमता से अधिक विद्यार्थियों का वहन ना किया जाए ।
(12) शैक्षणिक संस्था प्रबंधन द्वारा , उनके शिक्षण संस्थान के विद्यार्थियों का परिवहन करने वाले शैक्षणिक वाहनों के चालक/ परिचालकों की वर्ष में एक बार कार्यशाला का आयोजन किया जाएगा जिसमें सड़क परिवहन के विशेषज्ञों द्वारा सुरक्षित वाहन चालन पर आडियो विजुअल के माध्यम से व्याख्यान दिए जाएंगे । 7. विद्यार्थियों के सुरक्षित परिवहन हेतु पालकों का उत्तरदायित्व एवं कर्तव्य : -
(1 ) प्रत्येक पालक को अपने बच्चे का परिवहन करने वाली शैक्षणिक वाहन का समय समय पर निरीक्षण कर यह सुनिश्चित करना चाहिए कि वाहनों पर गति नियंत्रक उपकरण (SLD) , व्हीकल ट्रेकिंग डिवाइस (VTD ) , कैमरे, पेनिक बटन, प्रथम उपचार पेटी एवं वाहन अनुसार निर्धारित मात्रा का अग्निशमन यंत्र लगे हैं तथा वाहन विद्यार्थियों के परिवहन हेतु पूर्ण रूप से सुरक्षित है यदि वाहन में किसी भी प्रकार की त्रुटि पाई जाती हैं तो इसकी सूचना तत्काल संबंधित थाने, आर.टी.ओ. आफिस तथा शैक्षणिक संस्था प्रबंधन को करना होगी । 776(7)

(2) प्रत्येक पालक को अपने बच्चे का परिवहन करने वाली शैक्षणिक वाहन के परमिट, बीमा प्रमाण पत्र, फिटनेस प्रमाण पत्र तथा चालक के ड्रायविंग लायसेंस का निरीक्षण का अधिकार होगा तथा अभिलेख के व्यवस्थित न पाए जाने की दशा में इसकी सूचना संबंधित थाने, आर.टी.ओ. आफिस तथा शैक्षणिक संस्था प्रबंधन को करना चाहिए ।
(3) प्रत्येक पालक यह सुनिश्चित करेंगे कि शैक्षणिक वाहनों में निर्धारित क्षमता से अधिक विद्यार्थियों का वहन न किया जाए । यदि किसी शैक्षणिक वाहन में निर्धारित क्षमता से अधिक विद्यार्थियों का वहन किया जाना पाया जाता है तो इसकी सूचना तत्काल संबंधित थाने, आर.टी.ओ. आफिस तथा शैक्षणिक संस्था प्रबंधन को करना चाहिए ।
(4) प्रत्येक पालक को अपने बच्चे का परिवहन करने वाली शैक्षणिक वाहन से संबंधित या चालक/ परिचालक से संबंधित किसी भी प्रकार की शिकायत हो तो इसकी सूचना तत्काल संबंधित शैक्षणिक संस्था प्रबंधन को करना चाहिए । (5) प्रत्येक पालक बस स्टॉप पर बच्चों को निर्धारित समय पर छोड़ने व लेने जाए ताकि शैक्षणिक वाहनों का बस स्टॉप पर अनावश्यक रूकने के कारण ट्रैफिक जाम की स्थिति निर्मित न हो ।
8. पालक शिक्षक संघ:-
(1 ) गठन :- विद्यार्थियों का सुरक्षित परिवहन सुनिश्चित करने हेतु प्रत्येक शैक्षणिक संस्था द्वारा संस्था के प्राचार्य/ प्रधानाचार्य की अध्यक्षता में पालक शिक्षक संघ का गठन किया जाएगा, जिसमें शैक्षणिक वाहन द्वारा परिवहन किए जाने वाले विद्यार्थियों के पालक तथा शैक्षणिक वाहनों के चालक व परिचालक प्रतिनिधि होंगे ।.
(2) कृत्य:-
(एक) पालक शिक्षक संघ की बैठक प्रति माह आयोजित की जाएगी । पालकों से प्राप्त सुझाव तथा शिकायतों को प्राचार्य/प्रधानाचार्य द्वारा लेखबद्ध किया जाकर शिकायतों के समाधान के लिए त्वरित कार्यवाही की जाएगी ।
(दो) पालक शिक्षक संघ द्वारा विद्यार्थियों के सुरक्षित परिवहन सुनिश्चित करने हेतु विचार विमर्श किया जाकर कार्ययोजना विकसित की जाएगी । (तीन) पालक शिक्षक संघ द्वारा द्वारा शैक्षणिक वाहनों के परमिट, बीमा प्रमाण पत्र, फिटनेस प्रमाण पत्र, प्रदूषण नियंत्रण प्रमाण पत्र तथा चालकों के ड्रायविंग लायसेंस का सत्यापन किया जाएगा तथा यह भी सुनिश्चित किया जाएगा कि वाहनों पर निर्धारित गति नियंत्रक उपकरण (SLD), व्हीकल ट्रेकिंग डिवाइस (VTD ) , कैमरे, पेनिक बटन, प्रथम उपचार पेटी एवं वाहन अनुसार निर्धारित मात्रा का अग्निशमन यंत्र लगे हैं जो अच्छी मध्यप्रदेश राजपत्र, दिनांक 18 सितम्बर 2019

एवं वर्किंग स्थिति में हैं तथा वाहन विद्यार्थियों के परिवहन हेतु पूर्ण रूप से सुरक्षित है ।
(चार) पालक शिक्षक संघ द्वारा बैठक का कार्यवाही विवरण अंतर-विभागीय जिला स्तरीय समिति को भेजा जायेगा ।
9. अंतर-विभागीय जिला स्तरीय समिति:-
(1) गठन :- विद्यार्थियों के सुरक्षित परिवहन से संबंधित विषयो के संबंध में विचार-विमर्श कर निश्चय करने हेतु कलेक्टर / अपर कलेक्टर की अध्यक्षता मे अंतर-विभागीय जिला स्तरीय समिति का गठन किया जायेगा, जिसमें निम्नांकित अधिकारी प्रतिनिधि होगे-
(एक) क्षेत्रीय / अतिरिक्त क्षेत्रीय / जिला परिवहन अधिकारी (सदस्य- सचिव ) ।। (दो) अतिरिक्त पुलिस अधिक्षक ।
(तीन) जिला शिक्षा अधिकारी ।
(2) कार्य:-
(एक) अंतर-विभागीय जिला स्तरीय समिति की बैठक छः माह में एक बार आयोजित की जायेगी । समिति द्वारा इस विनियमन योजना के प्रावधानो का पालन सुनिश्चित करने हेतु शैक्षणिक वाहनों की ऑकस्मिक जॉच करने के लिए कार्ययोजना विकसित की जायेगी ।
(दो) अंतर-विभागीय जिला स्तरीय समिति द्वारा इस विनियमन योजना के प्रावधानो का पालन सुनिश्चित करने हेतु उड़नदस्तो का गठन किया जायेगा ।
(तीन) शैक्षणिक वाहनों की जॉच के लिए कार्ययोजना इस प्रकार विकसित की जायेगी कि प्रत्येक शैक्षणिक वाहन की वर्ष में कम से कम एक बार जॉच हो सके । (चार) अंतर-विभागीय जिला स्तरीय समिति के पास यह शक्ति निहित होगी कि उसके सुझाव पर किसी भी शैक्षणिक वाहन का फिटनेस प्रमाण पत्र निलंबित या रद्द किया जा सके ।

No.- F 22-170-2019 - VIII- The following draft of scheme which the State Government proposes to make in exercise of the powers conferred by clause (XXXIII ) of Sub -section 96, Section 111 , section 117, clause (i ) of sub - section (2) of section 138 read with sub - section (3 ) of section 67 of the Motor Vehicles Act, 1988 and all other powers enabling it in this behalf and in persuance of Hon'ble High Court of Madhy Pradesh Bench Gwallor Order dated 08.12.2017 passed in Contempt Petition No. 608/2013 directing state to make regulatory provisions for vehicles transporting school going students , is hereby, published as required by sub-section ( 1 ) of section 212 of the said Act for the information of all persons Ilkely to be affected there by and notice is here by given that the said draft shall be taken in to consideration on the expiry of 15 days From the date of Publication of this notice in the Madhya Pradesh Gazette .
Any Objection or suggestion , which may be received from any person with respect to the said draft on or before the expiry of the period specified above shalll be considered by the Principal Secretary , Transport Department , Government of Madhya Pradesh , Mantralaya , Vallabh Bhawan , Bhopal .
:DRAFT OF SCHEME :
1. Short title, extension and commencement: -
(1) The Short title of this scheme is "Control and Regulation Scheme of Educational Vehicles for safe Transportation of Students " , 2019 .
They extend to the whole of the state of Madhya Pradesh .
(2)
(3 ) This Scheme shall come into force from the date of its publication in the Madhya Pradesh Gazette.
2. Definitions:-
"Act " means the Motor Vehicles Act , 1988 ( No. 59 of 1988).
(a )
(b) "Educational Vehicle " means a passenger Vehicle designed and manufactured for the carrying of students. This includes educational auto rickshaws , educational vans, and Institutional educational Buses and non- institutional educational buses .
(c
) " Educational Auto Rickshaw " means 3 wheel Passenger Vehicle with a seating capacity of 6 Passenger excluding driver .

(d) "Educational Van" means 4 wheel passenger vehicle with a seating capacity of 12 passenger excluding driver;
(e) "Institutional Educational Bus " means passenger vehicle with a seating capacity of 7 or more passengers excluding driver which is registered in the name of the educational institution/ leased by the educational institution;
(1) "Non - Institutional Educational Bus " means passenger vehicle with a seating capacity of 13 or more than 13 passengers excluding driver which is not registered in the name of any educational institution;
Note: It shall be mandatory to register the name of the educational institution in the form of a lease holder on the registration card of the vehicle leased by the educational institution and the permit of such vehicle shall be issued in the name of the educational institution itself.
(2) Any term of expression used in this scheme , but not defined in this scheme shall have the same meaning as specified in the Motor Vehicles Act , 1988 and the rules made thereunder .
3. Criteria for Education Vehicles.-
(1) For registration of all educational vehicles , " EV" registration series shall be reserved in all transport offices .
(2) All educational vehicles shall not be more than 15 years old from the manufacturing year .
(3) The dial 100 helpline number written in black shall clearly be displayed on the inside and rear side exterior of all educational vehicles .
(4) An authorized speed limiting device upto 40 km . per hour maximum speed shall be installed in all educational vehicles to control the speed.
(5) All educational vehicles shall be equipped with Vehicle Tracking Devices (VTD) , cameras and panic buttons . Entry of VTD from the central server of the transport department must be done and it will also be necessary to provide access to the parents of मध्यप्रदेश राजपत्र, दिनांक 18 सितम्बर 2019
776(13) the students being transported in the vehicle and the concerned educational institution .
(6) Inall educational vehicles , the First Aid Box and the prescribed number of fire fighting equipment shall be installed. The number of fire fighting equipment shall be determined as follows: -

One near the driver's seat and another near the emergency gate (7) All educational vehicles shall have horizontal bars on windows which have a distance of not more than 5 cm between them as per rules , for the safety of students .
(8) Black windows or curtains shall not be placed on the windows of all educational vehicles and the activities inside the educational vehicles should always be clearly visible from outside the vehicle .
(9) The door locking system of all educational vehicles will always be in good condition.
(10) At the time of boarding and deboarding the students in all educational vehicles , arrangements will be made to activate all the side indicators of the front and back of the vehicle simultaneously .
(11) All institutional educational bus and non -institutional educational bus will be in yellow colour as per AIS - 063 .
(12) On the outer front and back part of the institutional bus and non- institutional bus " Educational Vehicle " written in black shall be displayed clearly.

(13) All educational vehicles with a seating capacity of 13 or more passengers shall be manufactured according to the norms of AIS 063 read with AIS - 052 .
(14) On the outer front and back of the educational autos and educational vehicles . "Educational Vehicle " written in black on the yellow coloured .
(15) The name , address and telephone number of the educational institution shall be displayed in black colour on the outer front , back, right and left part of the institutional educational bus .
(16) Institutional educational buses and non - institutional educational buses shall have adequate and safe space for students to keep their bags , tiffins and water bottles under the seats .
(17) There shall be adequate , waterproof and safe space for students to keep their bags , tiffins and water bottles above the roof of educational auto rickshaws and educational vans .
(18) "Educational Van " must have a hard top body.
( 19) Operation of educational vehicles by LPG fuel shall be restricted .
4. Conditions of appointment of drivers and attendants of educational vehicles , their duties and conduct.-
(1) Drivers of institutional educational buses and Non- institutional educational buses must have at least 5 years old professional driving licence for driving a heavy transport vehicle .
(2) Drivers of educational auto rickshaw and educational van must have at least 5 years old driving licence to drive a light transport vehicle .
(3) Such drivers who have been chrged for more than, 2 times in a year for the offence of red light jumping, violation of lane discipline, will not be kept on duty.
(4) Such drivers who have been charged for offences of driving a vehicle at a high speed even once in a year , driving in a dangerous manner , in a drunken state , allow to be driven by a criminal or any of the acts mentioned in rule 21 of the Central Motor Vehicles Rules , 1989 shall not be kept on duty.

(5) The age of the conductors shall not be less than 21 years and not more than 60 years .
(6) Educational vehicles in which only the girl students are transported on the entire route or any part of the route , appointment of a female conductor shall be mandatory .
(7) Character verification of drivers / conductors of all educational vehicles by police shall be mandatory
(8) The drivers of educational vehicles shall have to undergo health examination from atleast a M.B.B.S level qualified doctor and eye examination from an ophthalmologist every year. examination , a copy of his fitness certificate issued by the doctor shall have to be provided to all educational institutions of which students are transported . After (9) The driver and attendant of the educational vehicle shall abide by the Motor Vehicle Driving Regulations , 2017 while driving . If the duties are not performed by them , then it will be the personal responsibility of the driver and the conductor as well as the management and principal of the educational institution concerned.
(10) The driver of the educational vehicle shall not operate the vehicle without valid documents prescribed for the vehicle .
(11) The driver of an educational vehicle shall not use the mobile phone while driving, shall not smoke , nor drive the vehicle under any intoxicating condition .
(12) The logbook shall be maintained by the driver of the educational vehicle , in which the errors reflected in the vehicle shall be mentioned in date- wise manner and to initiate for removing the errors as soon as possible .
(13). The driver of the educational vehicles shall be responsible for keepingthe educational vehicle in a clean condition ..
(14) If any unusual incident occurs during the transportation of students , it shall be immediately reported to the educational institution by driver/ conductor of the vehicle .
(15) It will be the responsibility of the attendants to safe boarding and deboarding of small children in educational vehicles .

(16) The children below the age of 10 years shall not be taken off by the drivers or conductor or the person appointed by the guardian , the driver/conductor shall contact the parents of such children on the phone and will be handed over to only those nominated by them . If the driver/ conductor is not able to contact the guardian, then such children will be driven back to the educational institution and shall be handed over to the person responsible for the institution.
(17) The driver /conductor shall be directly responsible for carrying more students then prescribed capacity in educational vehicles .
(18) According to the Rule 9 and Rule 36 of the Madhya Pradesh Motor Vehicles Rules , 1994 , uniforms of drivers and male conductors shall be as follows
1. Driver -
(a) Blue Shirt or coat with two pockets with flaps , (b) Black Trouser .
2. Conductor -
(a) Blue Shirt or coat with two pockets with flaps and a flap inscribed on both sleeved " conductor " in black colour shall be affixed .
(b) Black Trouser .
(19) It shall be compulsory for drivers and conductors of all educational vehicles to put nameplates on their uniforms . The black nameplate will be of metal or plastic in 8x2 size . The driver's name will be engraved in white bold letters of Devanagari script in Hindi on nameplate in 6 mm size .
5. Permits and Motor Vehicle Taxes for Educational Vehicles.-
(1) For issuance / renewal of all educational vehicle permits , one has to apply in Form - 1 , along with the application consisting of the following-
(1) Prescribed fees ,
(ii) No-dues certificate of tax ,
(ii) Valid insurance certificate ,
(iv) Valid fitness certificate , and
(v) An affidavit stating that a speed limiting device to control speed, vehicle tracking device (VTD ) , camera , panic button , first aid box and a fire fighting device as per the prescribed volume has been installed on the vehicle , shall be submitted . The affidavit will also have

a declaration that the vehicle is completely safe for transportation of students .
(2) Permits for all educational vehicles will be issued in Form- 2 . The permit shall be valid for a period of 5 years from the date of issue / renewal . In the event of termination of the validation of the educational institution the permit issued shall be deemed to be automatically terminated .
(3) The fees for issuance / renewal of permits for educational vehicles shall be as prescribed in Rule 145 of the Madhya Pradesh Motor Vehicle Rules , 1994 .
(4) Motor vehicle tax of educational vehicles will be payable as follows- (a)
Lifetime tax as per Second Schedule ofMadhya Pradesh Motor Vehicle Taxation Act , 1991
Educational Auto Rickshaw Educational Vehicles and
(b) Non - institutional Educational Bus
According to item (six) of First Schedule of Madhya Pradesh Motor Vehicle Taxation Act, 1991
(c) Institutional Educational Bus
According to item(seven) of first schedule of Madhya Pradesh Motor Vehicle Taxation Act , 1991
(5) Educational auto rickshaws , educational vans and non- institutional educational buses can be operated as a public service vehicle by obtaining a permit as per the rules , in addition to the students transportation time.
(6) Transportation of staff of their own educational institution can be done by non- institutional educational bus and institutional educational bus :
6. Responsibilities and Duties of Educational Institutions for Safe Transport of Students.-
(1) All educational institutions shall execute a contract with the owners of institutional educational bus , non institutional educational bus , educational auto rickshaw and educational van, which will comprise the necessary conditions for safe transportation of students .

(2) All educational institutions shall appoint a Transport Manager in their educational institution , who shall be responsible for ensuring safe transportation of the students .
(3) Every educational institution will have to provide the list of all the educational vehicles operated in their institute in hard and soft copy to the police department , transport department and education department within 15 days of the start of the new session and the information about the reshuffle in the list shall be provided within 7 days.
(4) It will be compulsory to keep a register inside all the educational vehicles which will include the name of the students to be transported , the blood group of the students , the name of the parent , address , phone number, the class of the students to be transported and the name of the educational institution .
( 5) It is mandatory for all educational vehicles to have a valid copy of permit, insurance certificate , fitness certificate , motor vehicle tax deposit certificate and certified copy of pollution control certificate .
(6) The seating capacity of students in all educational vehicles shall be determined as per Rule 93 of the Motor Vehicles Rules , 1994 .
(7) The stop of educational vehicles should be fixed at a place where the students are not at risk of landing in the vehicle, nor a situation of jam on the road.
(8) Every educational institution shall maintain a computerized updated record in Excel format of the students coming in the educational vehicle mentioning the students name , students blood group, parent's name, address , phone number , students class , educational vehicle number and trip number .
(9) The management of the educational institution shall regularly inspect the vehicles transporting the students of their institutions to ensure that the fixed Speed Limit Devices ( STO) , Vehicle Tracking Devices (VTD) , cameras , panic buttons , first aid boxes and fire fighting equipments of fixed volume and number are in good working condition and the vehicle is absolutely safe for students to transport .
(10) The management of the educational institution shall maintain a record of permits , insurance certificates , fitness certificate , pollution control certificate and driving license of the driver for driving vehicles of their educational institutions . On expiry of validation of any 776(19)

document the operation of the vehicle concerned will have to be stopped with immediate effect .
(11) The educational institution management shall make regular inspection of the vehicles , to ensure that the vehicles do not carry more than the prescribed capacity.
(12) The management shall organize workshop once a year for drivers/operators of educational vehicles transporting students of which lectures on safe driving by road transport experts shall be given through audio visuals .
7. Responsibility and Duties of Parents.-
(1) All the parents shall periodically inspect the educational vehicle transporting their child to ensure that the Speed Limiting Device (SLD) , Vehicle Tracking Device (VTD ) , Cameras , panic buttons , first aid box and prescribed fire fighting equipment are installed on the vehicles , and are fully protected . If any error is found in any vehicle it shall be reported to the police station , R.T.O. office and the management of the educational institution.
(2) Every parent shall have the right to inspect the personal record i.e. driving licence , police verification report of the driver of the bus transporting the students and in case record is not found proper, they may report to the police station or R.T.O. (3) Every parent shall ensure that no vehicle exceeds the prescribed capacity in the educational vehicles and if any vehicle is found to be carrying more than the prescribed capacity the matter shall be reported to the concerned police station , R.T.O. office and management of the institution .
(4) In case any parent have any complaint about the vehicle or driver such parent shall report the matter to the management ofthe concerned educational institution .

(5) Every parent should go to the bus stop to pick up the children at the scheduled time so that traffic jam situation is not created due to unnecessary stoppage of the educational vehicles at the bus stop .
8. Parent Teachers Association.-
(1) Constitution . There shall be constituted a parent teacher association for safe transportation , in each educational institution under the chairmanship of the Principal/Head Master of the institution in which the parents , students , drivers and attendants of the vehicles shall be the representatives .
Functions : -
(2)
(i) A meeting of the Parents Teachers Association will be held every month , suggestions and complaints received from parents will be recorded by the Principal / Head Master and prompt action will be taken to resolve the complaints .
(ii ) To ensure safe transportation of students , an action plan will be developed after consultation by Parents Teachers Association .
(iii) The Parents Teachers Association will verify the permit , insurance certificate , fitness certificate , pollution control certificate and driving license of drivers and also ensure that the Speed Limiting Device (SLD) , Vehicle Tracking Device (VTD) , Camera , Panic button , First aid box and fire fighting devices are fixed on the vehicles , are in good working condition and the vehicle is completely safe for transportation of students .
(iv) The proceeding details of the Parents Teachers Association meeting shall be sent to the inter- departmental District Level Committee by the Parents Teachers Association .

9. Inter- departmental District Leval Committee: -
(1) Constitution: Inter-departmental District Level Committee will be constituted under the chairmanship of Collector / Additional Collector to discuss and decide on the topics related to safe transportation of students, in which the following officers will be the representative -
(1) Regional/Additional Regional/District Transport officer (Member - Secretary) .
(2) Additional Superintendent of Police.
(3) District Education Officer .
(2) Functions: -
(1) The meeting of the inter-departmental district level committee will be held once in six months . To ensure adherence to the provisions of this regulation scheme, an action plan will be developed by the committee to conduct surprise checks of educational vehicles .
(2) Flying Squads will be constituted by the inter- departmental district level committee to ensure compliance witrh the provisions of this regulation scheme.
(3) The action Plan will be developed for testing of educational vehicles in such a way that every educational vehicle can be tested at least once a year . The inter- departmental district level committee will have the power to suspend or cancel the fitness certificate of any educational vehicle on its suggestion .
