क्र. एफ 44-23-2015- बीस- 2.-निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार अधिनियम, 2009 ( 2009 का 35 ) की धारा 38 की उपधारा ( 1 ) तथा ( 2 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा , निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार नियम, 2011 में निम्नलिखित संशोधन करती है , अर्थात् :-

उक्त नियमों में, नियम 12 में , उपनियम ( 2 ) के स्थान पर, निम्नलिखित उप-नियम स्थापित किया जाए, अर्थात्:-
" ( 2) ( क) समिति का गठन.-
(एक) प्रत्येक स्कूल की समिति में 18 सदस्य होंगे . उनमें से कम से कम तीन चौथाई, स्कूल में नामांकित बच्चों के पालकों या अभिभावकों में से समिति के सदस्य होंगे . वंचित समूह और कमजोर वर्ग से संबंधित बच्चों के पालकों या अभिभावकों का समिति में प्रतिनिधित्व कुल नामांकित बच्चों के अनुपात में होगा.
(दो) दो सदस्य स्थानीय प्राधिकरण के निर्वाचित प्रतिनिधि होंगे . प्रधान शिक्षक या स्कूल की वरिष्ठतम महिला शिक्षक, समिति की सदस्य होंगी. प्रधान शिक्षक या वरिष्ठतम शिक्षक समिति का पदेन सदस्य सचिव होगा.
(तीन ) समिति के सदस्यों में से 50 प्रतिशत महिलाएं होंगी.
(चार) समिति का एक अध्यक्ष और एक उपाध्यक्ष होगा. इनका निर्वाचन समिति के निर्वाचित पालकों या अभिभावकों में से किया जाएगाः
परंतु यदि अध्यक्ष महिला नहीं है, तो उपाध्यक्ष कोई महिला ही होगी.

(ख ) समिति निम्नानुसार गठित की जाएगी .-
(एक) समिति के 18 सदस्यों में से 14 सदस्य, जिनमें सात महिला सदस्य सम्मिलित हैं , स्कूल में नामांकित बच्चों के पालकों या अभिभावकों में से होंगे . शैक्षणिक वर्ष के प्रारंभ में समिति का सदस्य- सचिव, उप- नियम ( 2 ) ( क) के उपबंधों के अनुसार स्कूल में नामांकित वंचित समूह और कमजोर वर्ग से संबंधित बालकों के पालकों या अभिभावकों के 14 सदस्यों को आनुपातिक रूप से नियत करेगा तथा समिति में सदस्य के रूप में सम्मिलित होने वाले पालकों/ अभिभावकों की संख्या का वर्गीकरण स्कूल के सूचना पट्ट पर निम्नलिखित रीति में प्रदर्शित करेगा :-

परंतु यदि स्कूल समेकित ( कक्षा -1 से कक्षा -8 ) है , तो शाला प्रबंधन समिति के पालक सदस्यों में उसके प्राथमिक खंड ( कक्षा-1 से कक्षा -5 ) और मिडिल खंड ( कक्षा 6 से कक्षा -8 ) का समान प्रतिनिधित्व बनाए रखा जाएगा. इस प्रकार समेकित स्कूल के प्राथमिक खंड के 7 सदस्यों और मिडिल खंड के 7 सदस्यों में वंचित समूह , कमजोर वर्ग और अन्य के आनुपातिक प्रतिनिधित्व का निर्धारण पृथक् पृथक् किया जाएगा .
(दो ) समिति के शेष सदस्य निम्नानुसार होंगे :-
(क) नगरीय क्षेत्रों में उस वार्ड का पार्षद और ग्रामीण क्षेत्रों में उस वार्ड का पंच , जहां कि स्कूल अवस्थित है ;
(ख) नगरीय क्षेत्रों में उस नगरीय स्थानीय निकाय के महापौर/ अध्यक्ष द्वारा नामनिर्दिष्ट एक महिला पार्षद तथा ग्रामीण क्षेत्रों में उस ग्राम पंचायत के सरपंच द्वारा नामनिर्दिष्ट एक महिला पंच, जहां कि स्कूल अवस्थित है ;
(ग ) स्कूल का प्रधान शिक्षक या प्रधान शिक्षक की अनुपस्थिति में वरिष्ठतम शिक्षक; और
(घ) स्कूल की वरिष्ठतम महिला शिक्षक.
(तीन ) सदस्य- सचिव, प्रवेश की अंतिम तिथि के पश्चात् या जैसा कि आयुक्त , राज्य शिक्षा केन्द्र द्वारा निर्देशित किया जाये, स्कूल में नामांकित बच्चों के सभी पालकों या अभिभावकों की बैठक बुलाएगा . तब वह पालकों या अभिभावकों में से समिति के 14 सदस्यों, जिनमें सात महिला सदस्य सम्मिलित है, के लिये निर्वाचन की प्रक्रिया प्रारंभ करेगा. सदस्य- सचिव, उन बच्चों के, जिन्होंने गत शैक्षणिक वर्ष के वार्षिक मूल्यांकन में ए + ग्रेड अर्जित किया है, महिला पालकों/ अभिभावकों में से समिति की सात महिला सदस्यों के पर्ची द्वारा नाम निकालेगा. इसी प्रकार, वह उन बच्चों के, जिन्होंने गत शैक्षणिक वर्ष के वार्षिक मूल्यांकन में ए+ ग्रेड अर्जित किया है, पुरूष पालकों/अभिभावकों में से समिति के सात पुरुष सदस्यों के पर्ची द्वारा नाम निकालेगा. पुरूष एवं महिला सदस्यों में से वंचित समूह और कमजोर वर्ग का अनुपात उप-नियम ( 2 ) ( ख ) ( एक ) के अनुसार होगाः
परन्तु किसी बच्चें के महिला पालक/ अभिभावक का नाम महिला सदस्य के रूप से सम्मिलित होने पर उस बच्चे के पुरूष पालक/अभिभावक को पुरूष सदस्यों के चयन में विचार में नहीं लिया जाएगाः
परन्तु यह और कि यदि ए+ ग्रेड के बच्चों की कुल संख्या 7 से कम है तो सदस्यों का चयन ए+ ग्रेड से एक ग्रेड नीचे अर्जित करने वाले बच्चों के पालकों/ अभिभावकों में से किया जाएगा .

(चार ) इस प्रक्रिया के पूरा होने के पश्चात् सदस्य - सचिव, सदस्य पालकों या अभिभावकों में से अध्यक्ष के निर्वाचन की प्रक्रिया प्रारंभ करेगा. वह इच्छुक अभ्यर्थियों से नामांकन प्राप्त करेगा और निर्वाचन संचालित करेगा. अध्यक्ष के निर्वाचन के पश्चात् सदस्य- सचिव , उप - नियम ( 2 ) ( क) ( चार ) के उपबंधों को ध्यान में रखते हुए सदस्य पालकों या अभिभावकों में से उपाध्यक्ष का निर्वाचन संचालित करेगाः
परन्तु निर्वाचित प्रतिनिधि, पार्षद/पंच तथा शिक्षक जिसमें प्रधान शिक्षक या वष्ठितम शिक्षक सम्मिलित हैं, निर्वाचन में भाग लेने के लिये पात्र नहीं होंगे, न ही उन्हें कोई मत देने का अधिकार होगा .
No. F - 44-23-2015 - XX- 2.- In excercise of the powers conferred by the sub- section ( 1) and (2) of Section 38 of the Right of Children to Free and Compulsory Education Act, 2009 (No. 35 of 2009) , the State Government , hereby, makes the following amendments in the Right of Children to Free and Compulsory Education Rules , 2011 , namely :-
AMENDMENTS
In the said rules , in rule , for sub- rule (2) , the following sub- rule shall be substituted , namely:-
"(2) (a) Constitution of the Committee-
(i) Every school shall have 18 members in the committee , Amongh theme minimum three fourth members of the committee shall be parents or guardians of the children enrolled in the school . The parents or guardians belonging to disadvantaged group and weaker section shall be represented in the committee in proportion of the children to the total enrolment .
(ii) Two members shall be the elected representatives of the local authority . The head teacher or the senior most female teacher of the school shall be member of the committee . The head teacher or the senior most teacher shall be ex - officio member- secretary of the committee.
(iii) Fifty percent of members of the committee shall be women .
( iv) There shall be a chairperson and vice- chairperson of the committee. They shall be elected from among the elected parents or guardians of the committee:
Provided that if the chairperson is not a woman , the vice- chairperson shall be a woman .
(b) The committee shall be constituted as under:-
(i) Among the 18 members of the committee, 14 members including seven woman shall be from the parents or guardians of the children enrolled in the school . At the beginning of the academic year, the member secretary of the committee shall fix the proportionate representative of 14 members of the parents or guardians of the children enrolled in the school belonging to disadvantage group and weaker section according to the provisions of sub - rule (2) (a) , and shall display the classification of number of parents/guardians to be included in the committee as a member in the following manner on the notice board of the school:-

Provided that if the school is integrated (Class - 1 to class 8) , equal representation of primary section (class - 1 to class -5) and middle section (Class - 6 to class 8 ) of the school shall be maintained in parents members of school management committee . Thus determination of proportionate representation of disadvantaged group , weaker section and others in primary section for 7 members and middle section for 7 members of the integrated school , shall be done separately.
(ii) Remaining membars of the committee shall be as under:-
(a) Councillor of the ward in urban areas and Panch of the ward in rural area, where the school is situated;
(b) One woman Councillor nominated by Mayor/Chairperson of the urban local body in urban areas and one woman Panch nominated by Sarpanch of the Gram Panchayat in rural area where the school is situated;
(c) Head teacher of the school or the senior most teacher in absence of head teacher ; and (d) Senior most female teacher of the school .
(iii) The member - secretary, after the last date of admission or as may be directed by the Commissioner, Rajya , Shiksha Kendra, shall convene the meeting of all the parents or guardians of the children enrolled in the school , He/she shall then start process of election for fourteen membars from among the parents or guardians includes seven female membars .
The member secretary shall draw lots for seven female membars of the committee from among the female parents /guardians of the children, who have scored A+ grade in annual evaluation of previous academic year. Similarly , he/she shall draw lots for seven male members from among the male parents/guardians of the children who have scored A+ grade in annual evaluation of previous academic year. Proportion of disadvantaged group and weaker section among a male and female members shall be as per sub - rule (2) (b) ( i) :
Provided that the name of a female parent/ guardian of a child who has become a female member , the male parent/guardian of the child shall not be considered in election of male members :
Provided further that if the total number of children A+ grade are less than seven, the members shall be chosen by considering the names of the parents/guardians of children that have scored a grade lower than A+ .
(iv) After this process is over the member secretary shall start process of election of chairperson among the member parents or guardians . He/she shall seek nominations from the aspiring candidates and conduct election . After the election of the chairperson the member secretary shall conduct the election of the Vice- chairperson among the member parents or guardians keeping the provision of sub - rule (2) (a) ( iv) :
Provided that elected representatives , Councillor/Panch and the teachers including head teacher or the senior most teacher shall neither be eligible for participating in election nor they shall have any voting right . "
