अधिसूचना
क्रमांकः एफ 4-4 (4-2)/2014/29-1 , चूंकि राज्य सरकार की यह राय है कि प्याज के उचित मूल्य पर साम्यपूर्ण वितरण तथा उपलब्धता सुनिश्चित करने के लिए ऐसा करना आवश्यक तथा समीचीन है ,
अतएव भारत सरकार के उपभोक्ता मामले, खाद्य और सार्वजनिक वितरण मंत्रालय (उपभोक्ता मामले विभाग) की अधिसूचना जो एस.ओ 3540 (ई) दिनांक 29.09.2019 जी.एस.आर 929 (ई) दिनांक 29.09.2016 के साथ पठित आवश्यक वस्तु अधिनियम, 1955 ( 1955 का सं . 10) की धारा 3 एवं केन्द्र सरकार के कृषि एवं सिंचाई मंत्रालय (खाद्य विभाग ) के जी.एस.आर. 800 दिनांक 9 जून , 1978 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार, एतद् द्वारा , निम्नलिखित आदेश करती है, अर्थात्ः-
आदेश
1. संक्षिप्त नाम , विस्तार तथा प्रारम्भः-

(एक) इस आदेश का संक्षिप्त नाम " मध्यप्रदेश प्याज व्यापारी (स्टॉक सीमा तथा जमाखोरी पर निर्बन्धज) आदेश , 2019" है।
(दो) इसका विस्तार सम्पूर्ण मध्यप्रदेश पर है ।
(तीन) यह आदेश राजपत्र में प्रकाशन की तारीख से प्रवृत्त होगा तथा दिनांक 30 नवंबर , 2019 तक अथवा भारत सरकार द्वारा इस संबंध में समय-समय पर अधिसूचित विस्तारित दिनांक तक प्रभावी होगा।
2. परिभाषाएं:-
इस आदेश में , जब तक सन्दर्भ से अन्यथा अपेक्षित न हो -
(क) " कमीशन अभिकर्ता " से अभिप्रेत है, ऐसा व्यक्ति जो किसी अन्य व्यापारी की ओर से किसी अन्य व्यापारी को कमीशन पर विक्रय के लिए क्रय , विक्रय और प्रेषण तथा संग्रहण के कारोबार में लिप्त है ।
(ख) " प्ररुप" से अभिप्रेत है , इस आदेश से संलग्न प्ररुप ।
(ग) " मण्डी" से अभिप्रेत है मध्यप्रदेश कृषि उपज मण्डी अधिनियम , 1972 (क्रमांक 24 सन् 1973 ) में विनिर्दिष्ट मण्डी।
(घ) " फुटकर व्यापारी " से अभिप्रेत है , ऐसा प्याज व्यापारी जो थोक विक्रेता नहीं है एवं सीधे उपभोक्ताओं को विक्रय करता है ।
(ड. ) 'राज्य सरकार' से अभिप्रेत है , मध्यप्रदेश सरकार ।
(च) . "व्यापारी " से अभिप्रेत है ऐसा व्यक्ति या उसका प्रतिनिधि जिसमें "कमीशन अभिकर्ता " भी सम्मिलित है जो एक समय में प्याज का फुटकर एवं थोक व्यापारी के रुप में इस आदेश की अनुसूची एक में उल्लेखित सीमा तक क्रय , विक्रय या विक्रय हेतु संग्रह करता है या करने का आशय रखता है , जिसमें उसके द्वारा वैयक्तिक खेती द्वारा उत्पादित प्याज का स्टॉक सम्मिलित नहीं है ।
(छ) " थोक व्यापारी " से अभिप्रेत है , ऐसा व्यापारी जो प्याज को सीधे अन्य व्यापारियों को विक्रय करता है । 828( 1)

3. अधिकतम स्टॉक सीमाः-
कोई भी व्यापारी किसी भी समय प्याज का अनुसूची- एक में निर्धारित स्टॉक सीमा से अधिक स्टॉक नहीं रखेगा ।
4. प्याज के क्रय , विक्रय एवं भंडारण पर निर्बन्धनः-
( 1 ) प्रत्येक थोक व्यापारी अथवा कमीशन अभिकर्ता, जिसके द्वारा अनुसूची- एक में वर्णित प्याज का क्रय , विक्रय के लिए संग्रह किया जाता है वह क्रय , विक्रय एवं संग्रहण के सुसंगत लेखे , अनुसूची- दो के नियत प्ररूप 'अ' में दैनिक स्टॉक पंजी , क्रय विक्रय के पक्के बीजक एवं मण्डी की रसीद सम्मिलित है, रखेगा एवं निरीक्षण के समय मांगे जाने पर प्रस्तुत करेगा ।
(2) प्रत्येक व्यापारी प्याज का संव्यवहार भौतिक रूप से करेगा तथा ऐसी सट्टे वाली रीति से नहीं करेगा जिससे बाजार में उसकी सुगम उपलब्धता पर विपरीत प्रभाव पड़ता हो ।
(3) प्रत्येक व्यापारी अपनें कारोबार के परिसर के प्रवेश द्वार या किसी अन्य सहज दृश्य स्थान पर विक्रय के लिए रखी गई प्याज की मूल्य सूची एवं स्टाक का बोर्ड देवनागरी लिपि में सुपाठ्य रूप से लिखी हुई प्रदर्शित करेगा जिसमें प्रतिदिन का प्याज का मूल्य और प्रारंभिक स्टाक पृथक- पृथक उपदर्शित करेगा।
(4) कोई व्यापारी उसके कब्जे में विक्रय हेतु रखी गई प्याज को विक्रय करने से इन्कार नहीं करेगा ।
(5) प्रत्येक थोक व्यापारी अथवा उसका कमीशन अभिकर्ता , विहित माह की 15 तारीख को समाप्त होने वाले पक्ष की उसी माह की 20 तारीख तक तथा मास के अंत में को समाप्त होने वाले पक्ष की आगामी माह की 5 तारीख तक विवरणी भेजना सुनिश्चित करेगा ।
5. आदेश का उल्लंघनः-
कोई भी व्यापारी या उसका अभिकर्ता या सेवक या उसकी ओर से कार्य करने वाला कोई अन्य व्यक्ति, इस आदेश के किन्हीं उपबन्धों का उल्लंघन नहीं करेगा । 6. प्रवेश, तलाशी तथा अभिग्रहण की शक्तियां-

राज्य सरकार के खाद्य , नागरिक आपूर्ति एवं उपभोक्ता संरक्षण विभाग के कनिष्ठ आपूर्ति अधिकारी या नापतौल निरीक्षक से अनिम्न स्तर का अधिकारी, या राजस्व विभाग के नायब तहसीलदार से अनिम्न स्तर का अधिकारी या उद्यानिकी एवं खाद्य प्रसंस्करण के सहायक संचालक से अनिम्न स्तर का अधिकारी अपने पदस्थापना जिले/विहित क्षेत्राधिकार के अंतर्गत ऐसी सहायता, यदि कोई हो , जैसी कि वह उचित समझे के साथ-
(क) किसी स्थान, परिसर , यान या जलयान के जिसके संबंध में उसे यह विश्वास करने का कारण हो कि इस आदेश अथवा उसके उपबंधों का उल्लंघन हुआ है , किया जा रहा है या किया जाने वाला है, स्वामी, अधिभोगी अथवा अन्य किसी भारसाधक व्यक्ति से, ऐसे उल्लंघन से संबंधित संव्यवहारों को दर्शाने वाली पुस्तकें, लेखे या अन्य अभिलेखों को प्रस्तुत करने की अपेक्षा कर सकेगा ।
(ख) ऐसे स्थान , परिसर , यान या जलयान में जिसके संबंध में उसे यह विश्वास करने का कारण हो कि इस आदेश के किन्हीं उपबन्धों का उल्लंघन हुआ है , किया जा रहा है या किया जाने वाला है, प्रवेश कर सकेगा , उसका निरीक्षण कर सकेगा या उसे खोल सकेगा तथा उसकी तलाशी ले सकेगा ।
(ग) ऐसे उल्लंघनों से संबंधित संव्यवहारों को दर्शाने वाले रजिस्टर , बिल बुक या किसी दस्तावेजों का अभिग्रहण कर सकेगा या अभिग्रहित करवा सकेगा ।
(घ) प्याज के स्टॉक को तथा इस आदेश के उपबन्धों के उल्लंघन में उक्त प्याज को ले जाने के लिए उपयोग में लाए जा रहे पशुओं, यानों, जलयानों या अन्य वाहनों की तलाशी ले सकेगा, उनका अभिग्रहण कर सकेगा और उन्हें हटा सकेगा और तत्पश्चात् ऐसे समस्त उपाय करेगा या करने के लिए प्राधिकृत कर सकेगा जो इस प्रकार अभिग्रहण किए गए प्याज के स्टॉक तथा पशुओं , यानों, जलयानों या अन्य वाहनों का सक्षम न्यायालय के समक्ष पेश किया जाना सुनिश्चित करने के लिए 828(3)

तथा इस प्रकार पेश किए जाने तक उसकी सुरक्षित अभिरक्षा के लिए आवश्यक हों ।
(2) दण्ड प्रक्रिया संहिता , 1973 ( 1974 का सं 2) के उपबन्ध जो तलाशी तथा अभिग्रहण से संबंधित हैं यथासंभव इस खण्ड के अधीन तलाशियों तथा अभिग्रहण को लागू होंगे।
7. छूट:-
राज्य सरकार, साधारण या विशेष आदेश द्वारा व्यक्तियों के किसी वर्ग को इस आदेश के समस्त या किन्हीं भी उपबन्धों से छूट दे सकेगी और किसी भी समय ऐसी छूट को निलंबित या निरस्त कर सकेगी।

NOTIFICATION
No. F 4-4(4-2) -2014 - XXIX - 1.-Whereas in th opinion of the State Government it has become necessary and expendient to ensure equitable distribution and availability of onion at reasonable prices ;
Therefore , in exercise of the powers conferred under section 3 of the Essential Commodities Act , 1955 ( No. 10 of 1955 ) read with the notification No. S.O. 3540 (E) dated 29.09.2019 & GSR 929 ( E ) dated 29.09.2016 of the Ministry of Consumer Affairs , Food and Public Distribution ( Department of Consumer Affairs ) , Government of India and GSR 800 dated 9 June 1978 of Department of Food , Ministry of Agriculture and irrigation , the State Government, hereby, makes the following order , namely: -
ORDER
1. Short title , extent and commencement :
( 1) This order may be called as the Madhya Pradesh Onion Traders ( Stock - Limit and Restriction on Hoarding) Order , 2019 .
(2) This order shall extend to the whole of Madhya Pradesh .
(3) This order shall come into force from the date of its publication in the Madhya Pradesh Gazette and shall be effective upto 30th November 2019 or till the extended 828( 6 )

date as may be notified by the Government of India in this regard from time to time .
2. Definitions :
In this order , unless the context otherwise requires-
(a) " Commission agent " means a person who is engaged on behalf of any other trader for purchase , sale , transport and receipt to another trader on commission basis .
(b) " Forms " means the forms attached to this order .
(c) "Mandi " means the mandi specified in the Madhya Pradesh Agricultural Produce Market Act , 1972 (No. 24 of 1973) .
(d) "Retailer" means such onion trader who is not a wholesaler and sells directly to the consumers .
(e) ' State Government ' means the Government of Madhya Pradesh .
(f) " Trader " means a person or his representative , which includes a commission agent who purchases , sells or stores for sale or intends to purchase , sell or storage for sale of onion at any time in such limit as mentioned in Scheduled - I of this order but it does not include the stock of onions produced by him through individual farming.
(g) "Wholesaler" means such a trader who sells onion to other traders .

3. Maximum stock limit :
No trader shall have the stock of onion at any time in excess of the stock limit mentioned in Schedule - I of this order .
4. Restriction on purchase , sale and storage of onion :
( 1) Every wholesaler or commission agent by whom the onion mentioned in Schedule - I is received for purchase , sale , shall maintain the proper account of the purchase , sale and storage of the onion including stock register prescribed in Form 'A' , invoice of the sale and receipt of the mandi , and shall submit them on demand at the time of inspection .
(2) Every trader shall deal with the onion materially and not in a speculative manner which adversely affects its easy availability in the market .
(3 ) Every trader shall display the price list and stock of onion kept for sale on a board at the entrance of the premises or at any conspicuous place of his / her business premises written in legible Devnagari script in which the price of the onion and the opening stock of the onion shall be displayed separately .
(4) No trader shall refuse to sell the onions kept in his/ her possession for sale .
(5) Every wholesaler or his commission agent shall submit the details of transaction prescribed in Form ' B ' by 20th of the current month for the fortnight ending on 15th of 828 (8)

the same month , and by 5th of the succeeding month for the fortnight ending on last date of the previous month 5. Violation of order :
No trader or his commission agent or his servant or any other person acting on his behalf shall violate any of the provisions of this order .
6. Powers of entry , search and seizure etc:
(1 ) In order to ensure proper compliance of the provisions of this order , an officer not below the rank of junior supply officer or an inspector of the weights & measures of the Food , Civil Supplies and Consumer Protection Department or Naib Tehsildar of the Revenue Department or Assistant Director of the Department of Horticulture and Food Processing of the State Government , within their respective district /jurisdiction , with such assistance as he thinks fit: -
(a) shall expect the submission of the documents , accounts and other records related with the violated transactions in respect of a premise , vehicle , vessel whereof, he has reason to believe that the provisions of this order has been violated , is being violated or to be violated , from the owner or his manager or any other person in charge .
(b) enter and inspect or open or search such a place , premises , vehicle or vessel in respect of which it has reason to believe that any of the provisions of this 828( 9)

order has been violated , is being violated or is about to be violated .
(c) may seize or cause to be seized the register , bill book or any other documents related to such violated transactions .
(d) shall search animals / vehicles /vessels or other conveyances being used in carrying the stock of onion in violation of provisions of this order and shall seize and remove them and thereafter , shall do or shall authorize to do such other activities which are essential for the presentation of the stock of onion and animals , vehicles , vessels or other conveyances before the competent court and for ensuring it safe custody until it is presented before court .
(2) The provisions of the Code of Criminal Procedure , 1973 ( No 2 of 1974) which relate to search and seizure shall apply to search and seizure under this section as far as possible .
7. Exemption :
The State Government may , by ordinary or special order , exempt any class of persons from all or any of the provisions of this order and may suspend or revoke such exemption at any time.
