अधि. क्र. 02- एफ-1-76-2019- अठारह -3 .- मध्यप्रदेश नगरपालिका अधिनियम , 1961 (क्रमांक सन् 1961 ) की धारा 43 तथा धारा 55 के साथ पठित धारा 355 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा , राज्य निर्वाचन आयोग के परामर्श से निम्नलिखित नियम बनाती है , अर्थात्ः-
नियम
1. संक्षिप्त नाम तथा प्रारंभ. ( 1 ) इस नियम का संक्षिप्त नाम मध्यप्रदेश नगरपालिका अध्यक्ष तथा उपाध्यक्ष का निर्वाचन नियम, 2019 है.
(2) यह नियम मध्यप्रदेश राजपत्र में प्रकाशन की तारीख से प्रवृत्त हुए समझे जाएंगे.
2. परिभाषाएं.-( 1 ) इन नियमों में जब तक संदर्भ से अन्यथा अपेक्षित न हो, -
(क) " अधिनियम " से अभिप्रेत है , मध्यप्रदेश नगरपालिका अधिनियम , 1961 ( क्रमांक 37 सन् 1961 ) ;
(ख) " पार्षद " से अभिप्रेत है, निर्वाचित पार्षद;
(ग ) " प्ररूप" से अभिप्रेत है , इन नियमों में संलग्न प्ररूप ;
(घ) " सम्मिलन " से अभिप्रेत है, अधिनियम की धारा 43 के साथ पठित धारा 55 के अधीन परिषद का प्रथम सम्मिलन;

(ङ) " प्राधिकृत अधिकारी " से अभिप्रेत है, ऐसा अधिकारी जिसे राज्य निर्वाचन आयोग द्वारा निर्वाचन का संचालन करने के प्रयोजन के लिये निर्वाचन की शक्तियां प्रत्यायोजित करते हुए प्राधिकृत अधिकारी के रूप में नियुक्त किया गया हो, अर्थात्ः-
( एक) जिला मुख्यालय की नगरपालिका परिषद एवं नगर परिषद के अध्यक्ष तथा उपाध्यक्ष पद के निर्वाचन हेतु- कलेक्टर;
(दो) जिला मुख्यालय से भिन्न नगरपालिका परिषद एवं नगर परिषद के अध्यक्ष तथा उपाध्यक्ष के निर्वाचन हेतु- अपर कलेक्टर/डिप्टी कलेक्टर/अनुविभागीय अधिकारी/तहसीलदार/नायब तहसीलदार;
( 2 ) के अधीन कलेक्टर द्वारा नियुक्त अधिकारी.
(च) " पीठासीन अधिकारी " से अभिप्रेत है, धारा 55 की उपधारा
गया है. (2) इन नियमों में प्रयुक्त किन्तु अपरिभाषित शब्दों तथा अभिव्यक्तियों का वही अर्थ होगा जो उनके लिये अधिनियम में दिया 3. निर्वाचन का समय तथा स्थान. ( 1 ) अध्यक्ष तथा उपाध्यक्ष का निर्वाचन ऐसे समय तथा स्थान पर होगा जैसा आयोग द्वारा प्राधिकृत अधिकारी द्वारा इस संबंध में अवधारित किया जाएः
परंतु निर्वाचन की संपूर्ण प्रक्रिया नामनिर्देशन पत्र प्रस्तुत करने से लेकर मतदान तक निर्वाचन की तारीख को अपरान्ह पांच बजे तक पूर्ण कर ली जाएगी.
(2 ) पीठासीन अधिकारी, सम्मिलन की सूचना में उपनियम ( 1 ) के अधीन अवधारित की गई तारीख , समय और स्थान विनिर्दिष्ट करेगा और ऐसी सूचना द्वारा ऐसे निर्वाचनों के लिए अभ्यर्थियों के नामनिर्देशन पत्र आमंत्रित करेगा तथा वह तारीख तथा स्थान विनिर्दिष्ट करेगा , जहां नामनिर्देशन पत्र प्रस्तुत किये जा सकेंगे .
(3 ) सम्मिलन की सूचना प्रत्येक पार्षद को भेजी जाएगी और वह सम्मिलन से कम से कम सात दिन पूर्व परिषद कार्यालय में भी प्रदर्शित की जाएगी.
(4) सम्मिलन की अध्यक्षता पीठासीन अधिकारी द्वारा की जायेगीः
परन्तु निर्वाचन के लिए पीठासीन अधिकारी ऐसा अधिकारी होगा जो क्रमशः कलेक्टर, अपर कलेक्टर या संयुक्त कलेक्टर, उपखंड अधिकारी या उप जिलाध्यक्ष या तहसीलदार तथा नायब तहसीलदार संवर्ग के अधिकारियों की पद श्रेणी से निम्न पद श्रेणी का अधिकारी न हो.
(5) पीठासीन अधिकारी अध्यक्ष तथा उपाध्यक्ष के निर्वाचन का कार्यक्रम तैयार करेगा और सम्मिलन में इसकी घोषणा करेगा. प्रथमतः अध्यक्ष तत्पश्चात् उपाध्यक्ष का निर्वाचन सम्पन्न कराया जायेगा.
4. नाम निर्देशन पत्रों का प्रस्तुत किया जाना.-( 1 ) अध्यक्ष तथा उपाध्यक्ष पद के निर्वाचन के लिए अभ्यर्थी को ' प्ररुप अ ' में नाम निर्देशन - पत्र द्वारा नामनिर्दिष्ट किया जाएगा, जिसे अभ्यर्थी द्वारा व्यक्तिगत रूप से या उसके प्रस्तावक या समर्थक द्वारा नियम 3 के अधीन नियत की गई तारीख, समय तथा स्थान पर पीठासीन अधिकारी को दिया जाएगा.
(2) कोई भी पार्षद एक से अधिक अभ्यर्थी के नामनिर्देशन का प्रस्ताव या समर्थन नहीं करेगा.
5. नामनिर्देशन पत्र के प्राप्त होने पर अपनाई जाने वाली प्रक्रिया.- पीठासीन अधिकारी , नामनिर्देशन पत्र प्रस्तुत किये जाने पर उनके प्रस्तुत किये जाने की तारीख तथा समय दर्शाने वाला एक प्रमाण - पत्र लिखकर हस्ताक्षर करेगा और उस पर अनुक्रमांक डालेगा.

66( 1) 6. नामनिर्देशनों की संवीक्षा.-पीठासीन अधिकारी , निर्वाचन के लिए नियत किए गए समय के पूर्व, सम्मिलन में उपस्थित पार्षदों के नाम निर्देशन पत्रों की जांच करने के लिये सभी समस्त युक्तियुक्त सुविधाएं देने के पश्चात् नामनिर्देशन पत्रों की जांच करेगा और ऐसी समस्त आपत्तियों का विनिश्चिय करेगा जैसा कि नाम निर्देशन के संबंध में की जाएँ.
(2) पीठासीन अधिकारी या तो आपत्तियों पर या स्वप्रेरणा से संक्षिप्त जांच, यदि कोई हो, जो उसे आवश्यक प्रतीत हो, करने के पश्चात् किसी नामनिर्देशन पत्र को निम्नलिखित में से किसी भी आधार पर अस्वीकार कर सकेगा , अर्थात्ः-
(क) यह कि नामनिर्देशन पत्र विहित की गई समय - सीमा के भीतर प्राप्त नहीं हुआ था; या
(ख) यह कि अभ्यर्थी इस अधिनियम के अधीन अध्यक्ष तथा उपाध्यक्ष के रूप में निर्वाचन के लिए पात्र नहीं है; या यह कि अभ्यर्थी, प्रस्तावक या समर्थक का हस्ताक्षर असली नहीं है या कपट द्वारा अभिप्राप्त किया गया है ; या ग)
यह कि पार्षद ने या तो प्रस्तावक या समर्थक के रूप में एक से अधिक अभ्यर्थियों के नामनिर्देशन पत्रों पर (
हस्ताक्षर किए हैं. (घ)
(3 ) पीठासीन अधिकारी प्रत्येक नामनिर्देशन पत्र पर उसे स्वीकार करने या अस्वीकार करने का अपना निर्णय पृष्ठांकित करेगा और यदि नामनिर्देशन पत्र अस्वीकार कर दिया जाए, तो वह उसे अस्वीकार करने के अपने कारणों का एक संक्षिप्त विवरण अभिलिखित करेगा.
(4) पीठासीन अधिकारी का विनिश्चिय अंतिम होगा.
7. अभ्यिर्थिता का वापस लिया जाना.-कोई भी सम्यरूपेण नामनिर्दिष्ट अभ्यर्थी मतदान से पूर्व, लिखित में आवेदन पत्र देकर अपनी अभ्यर्थिता वापस ले सकेगा.
8. नामनिर्देशन.- पीठासीन अधिकारी , नामनिर्देशन पत्रों की संवीक्षा करने के पश्चात् सम्मिलन में उपस्थित पार्षदों के समक्ष निम्नलिखित बातें पढ़कर सुनाएगा.
(क) उन अभ्यर्थियों के नाम, जिनके नामनिर्देशन पत्र अविधिमान्य घोषित कर दिए गए हों और तत्संबंधी कारण ;
(ख) उन अभ्यर्थियों के नाम , जिन्होंने अपने नाम वापस ले लिए हों; और
(ग) उन अभ्यर्थियों के नाम जिनके नामनिर्देशन पत्र अंतिम रूप से स्वीकार कर लिए गए हों.
9. प्रक्रिया.- ( 1 ) जब केवल एक ही अभ्यर्थी का नामनिर्देशन पत्र विधिमान्य पाया गया हो, तो पीठासीन अधिकारी , ऐसे अभ्यर्थी को, यथास्थिति, अध्यक्ष या उपाध्यक्ष पद के लिए सम्यरूपेण निर्वाचित घोषित करेगा.
( 2 ) जब सम्यरूपेण नामनिर्दिष्ट अभ्यर्थियों की संख्या एक से अधिक हो, तब उनका निर्वाचन गुप्त मतदान द्वारा किया जाएगा.
10. मतपेटी और मतदान की रीति.- ( 1 ) जब निर्वाचन मतपत्रों द्वारा किया जाना हो, तब पीठासीन अधिकारी एक ऐसी मतपेटी की व्यवस्था करेगा, जो इस ढंग से बनी होगी कि उसमें मतपत्र डाले तो जा सकते हों, किन्तु ताला खोले बिना निकाले नहीं जा सकते हों.
(2) पीठासीन अधिकारी , मतदान प्रारंभ होने के ठीक पूर्व उपस्थित पार्षदों को यह बतलाएगा कि मतपेटी खाली है और फिर उसे ताला लगाकर बंद कर देगा और मतदान के लिए रख देगा .
(3 ) सम्मिलन में उपस्थित प्रत्येक पार्षद को, पीठासीन अधिकारी द्वारा अधोहस्ताक्षरित मतपत्र दिया जाएगा जिस पर निर्वाचन में भाग लेने वाले सभी अभ्यर्थियों के नाम प्ररूप ' आ ' में मुद्रलिखित या सुवाच्य अक्षरों में लिखे होंगे.
(4) प्रत्येक पार्षद मतदान के प्रयोजन के लिये नियत स्थान पर पीठासीन अधिकारी द्वारा विहित क्रम से जाएगा और जिस अभ्यर्थी को वह मत देना चाहे, उसके नाम के सामने ( x ) चिन्ह लगायेगा. कोई भी पार्षद एक से अधिक अभ्यर्थी को मत नहीं देगा. इसके बाद मतपत्र मोड़ा जाएगा और मतपेटी में डाल दिया जाएगा.

11. निरक्षर, नेत्रहीन तथा शिथिलांग पार्षदों की मतदान में सहायता. ( 1 ) ऐसा पार्षद जो निरक्षर, नेत्रहीन या शिथिलांग है और अभ्यर्थी का नाम पढ़ने में असमर्थ है , या बिना किसी की सहायता के मतपत्र पर अपनी पसंद के अनुसार चिन्ह लगाने में असमर्थ है, तो ऐसे पार्षद को मतपत्र पर अभ्यर्थी के नाम के सामने नियम 10 के उपनियम ( 4 ) के उपबंध के अनुसार अपनी पसंद के अनुसार चिन्ह लगाने के लिए मतदान कक्ष में अपने साथ अपने किसी ऐसे साथी को, जिसकी आयु 18 वर्ष से कम न हो, ले जाने के लिए पीठासीन अधिकारी अनुज्ञा देगाः
परन्तु किसी व्यक्ति को एक से अधिक पार्षद के साथी के रूप में कार्य करने के लिए अनुज्ञात नहीं किया जाएगाः परन्तु यह और कि इस नियम के अधीन किसी व्यक्ति को किसी पार्षद के साथी के रूप में कार्य करने के लिए अनुज्ञात किए जाने के पूर्व उससे प्ररूप - ब में यह घोषणा करने की अपेक्षा की जाएगी कि उसने किसी पार्षद के साथी के रूप में अब तक कार्य नहीं किया है:
परन्तु यह और भी कि मतदाता को निरक्षरता का लाभ नहीं मिलेगा यदि उसके पास साक्षर होने का प्रमाण - पत्र हो तथा शारीरिक निःशक्तता ऐसी होनी चाहिए कि वो मतदान न कर सके और यदि मतदाता विकलांग है तो विकलांगता का प्रमाण- पत्र प्रस्तुत करना आवश्यक है.
(2) पीठासीन अधिकारी , इस नियम के अधीन समस्त मामलों का अभिलेख रखेगा.
12. मतपेटी खोले जाने पर अपनाई जाने वाली प्रक्रिया तथा मतगणना.-पीठासीन अधिकारी , मतपेटी खोलेगा और मतपत्रों की संवीक्षा प्रारंभ करेगा. यदि किसी मतपत्र पर एक से अधिक नामों के सामने गुणन (x ) चिन्ह लगे हों या मतपत्र पर कोई ऐसा चिन्ह या संकेत हो जिससे मतदाता को पहचाना जा सके, तो ऐसा मतपत्र अविधिमान्य माना जाएगा और उसकी गणना नहीं की जाएगी . इस संबंध में पीठासीन अधिकारी का निर्णय अंतिम होगा. इसके पश्चात् पीठासीन अधिकारी विधिमान्य मतों की गणना करेगा और प्रत्येक अभ्यर्थी से संबंधित मतपत्र जमाएगा.
13. मतों की समानता.- मतगणना पूर्ण हो जाने के पश्चात् किन्हीं भी अभ्यर्थियों को प्राप्त मतों की संख्या समान पाई जाए और उसमें से किसी एक के मतों में एक मत जोड़ देने से वह अभ्यर्थी निर्वाचित घोषित किए जाने का हकदार हो जाए तो पीठासीन अधिकारी ऐसी रीति में लाट डालकर तत्काल निर्णय करेगा जो वह निर्धारित करें, और यह मानकर कि जिस अभ्यर्थी के नाम लाट में निकला हो, उसे एक अतिरिक्त मत मिला है, अगली कार्यवाही करेगा.
14. निर्वाचन के परिणामों की घोषणा.- मतगणना पूरी हो जाने पर, पीठासीन अधिकारी नियम 13 के उपबंधों के अध्यधीन रहते हुए, यदि और जहां तक वे विशिष्ट मामले पर लागू होते हों, जिस अभ्यर्थी को सबसे अधिक विधिमान्य मत दिये गये हों, उसे निर्वाचित घोषित करेगा और निर्वाचन की विवरणी तैयार करेगा, पूरा करेगा और प्रमाणित करेगा.
15. मतदान की गोपनीयता बनाए रखना.- प्रत्येक व्यक्ति जो किसी निर्वाचन में मतदान या मतगणना से संबंधित किसी कर्तव्य का पालन कर रहा है, मतदान की गोपनीयता बनाए रखेगा और किसी भी व्यक्ति को ऐसी कोई भी जानकारी ( किसी विधि द्वारा या उसके अधीन प्राधिकृत किसी प्रयोजन को छोड़कर ) नहीं देगा जिससे ऐसी गोपनीयता भंग होने की संभावना हो.
16. निर्वाचन पत्रों का निपटारा.- नाम निर्देशनपत्र , मतपत्र चाहे विधिमान्य हो या अस्वीकृत और निर्वाचन से संबंधित अन्य समस्त कागज पत्र, पीठासीन अधिकारी द्वारा आयोग के प्राधिकृत अधिकारी अर्थात् कलक्टर कार्यालय में निर्वाचन की तारीख से पांच वर्ष की कालावधि तक सील बंद लिफाफों में सुरक्षित अभिरक्षा में रखे जाएंगे और तत्पश्चात् उसके द्वारा नष्ट किए जा सकेंगे .
17. आकस्मिक रिक्त. - अध्यक्ष तथा उपाध्यक्ष के पद की आकस्मिक रिक्ति होने की स्थिति में, ऐसे रिक्त स्थानों को भरने की कार्यवाही धारा 43 के उपबंधों के अध्यधीन रहते हुए उसी रीति से तत्काल की जाएगी जैसी कि मूल निर्वाचन में की जाती है. जिला कलेक्टर यथाशक्य शीघ्र अधिनियम/नियम के प्रावधानों के अनुसार रिक्ति को भरने हेतु कदम उठायेंगे .
18. यदि किसी पार्षद का पद रिक्त रह भी जाता है तो अध्यक्ष , उपाध्यक्ष का निर्वाचन रोका नहीं जाएगा. ऐसी आकस्मिक रिक्तिको शीघ्र भरने की कार्यवाही प्रचलित की जायेगी.

19. आरक्षण के मामले में सहायता.- राज्य सरकार द्वारा आरक्षण की कार्यवाही की जायेगी. अध्यक्ष पद का आरक्षण विहित प्राधिकारी द्वारा किया जाएगा तथा मध्यप्रदेश राजपत्र असाधारण में प्रकाशित किया जायेगा.
20. निर्वाचन कर्मचारिवृन्द की नियुक्ति. प्राधिकृत अधिकारी इन नियमों के अधीन निर्वाचन के प्रयोजन के लिये, प्रत्येक निर्वाचन में एक पीठासीन अधिकारी नियुक्त करेगा. वह निर्वाचन कार्य में सहायता के लिये एक या एक से अधिक सहायक पीठासीन अधिकारी भी नियुक्त कर सकेगा. ऐसे अधिकारी या तो नाम से या पदेन नियुक्त किये जा सकेंगे . प्राधिकृत अधिकारी निर्वाचन कार्य के लिये यथा आवश्यक पदाधिकारियों की नियुक्ति भी कर सकेगा..
21. नियंत्रण.-पीठासीन अधिकारी, सहायक पीठासीन अधिकारी और अन्य समस्त ऐसे व्यक्ति जो इन नियमों से संबंधित किसी मामले के लिये नियुक्त किये गये हों, प्राधिकृत अधिकारी के मार्गदर्शन, अधीक्षण और नियंत्रण के अधीन कार्य करेंगे.
22. निर्देश जारी करने की शक्ति. इन नियमों में अन्तर्विष्ट किसी बात के होते हुए भी राज्य निर्वाचन आयोग ऐसे विशेष या सामान्य आदेश या निर्देश जारी कर सकेगा जो निष्पक्ष और स्वतंत्र चुनाव कराने के लिये अधिनियम के उपबंधों से असंगत न हों.
23. पीठासीन अधिकारी का सामान्य कर्तव्य.- पीठासीन अधिकारी का यह सामान्य कर्तव्य होगा कि वह निर्वाचन के लिए बुलाये गये सम्मिलन में व्यवस्था बनाये रखे , देखें कि निर्वाचन उचित रूप से हो रहा है.
24. आपात परिस्थितियों में निर्वाचन का स्थगन. ( 1 ) यदि किसी बैठक में दंगों या खुली हिंसा या पर्याप्त कारण से चुनाव की प्रक्रिया में व्यवधान आता है तो पीठासीन अधिकारी निर्वाचन को बाद में तय की जाने वाली तारीख तक स्थगित कर देगा, जहां इस प्रकार पीठासीन अधिकारी द्वारा निर्वाचन रोका गया है वहां वह तत्काल इसकी सूचना जिला कलक्टर तथा प्राधिकृत अधिकारी को देगा.
(2 ) जहां भी उपनियम ( 1 ) के अधीन निर्वाचन स्थगित किया जाता है तो जिला कलक्टर ऐसी स्थिति की सूचना तत्काल मध्यप्रदेश राज्य निर्वाचन आयोग को देगा.
25. निरसन.-इन नियमों के प्रारम्भ होने के तत्काल पूर्व इस विषय पर प्रचलित समस्त नियम , उपविधियां व आदेश, यदि कोई हों, एतद्वारा निरसित किए जाते हैं.

In exercise of the powers conferred by sections 43 and 55 read with section 355 of Madhya Pradesh Municipality Act , 1961 (No . 37of 1961 ) , the State Government , in consultation with the State Election Commission , hereby makes the following rules , namely: -
RULES
1. Short title and Commencement.-
(1) These rules shall be called the Madhya Pradesh Nagarpalika Adhyaksh Tatha Upadhyaksh ka Nirvachan Niyam , 2019 .
(2) These rules shall be deemed to come into force from the date of their publication in the Madhya Pradesh Gazette .
2. Definitions ...
(1) In these rules unless the context otherwise requires , -
(a) " Act" means Madhya Pradesh Municipality Act , 1961 ( No . 37 of 1961) ;
(b) "Councillor" means the elected councillor ;
( c) "Form" means form appended to these rules ;
(d) 'Meeting' means the first meeting of the Council under section 43 read with section 55 of the Act;
(d - a) " Authorised Officer " means such officer who have been appointed as authorised officer by designating the powers of election for the purpose of conducting the election by the State Election Commission , namely: -
(i) For the election of President and Vice - President ofMunicipality and Municipal Council of district headquarter- Collector
(ii) For the election of President and Vice- President of Municipality and Municipal Council of other than district headquarter- Upper Collector/ Deputy Collector/ Sub divisional Officer/ Tehsildar/ Nayab Tehsildar ; :

(e) " Presiding Officer" means the officer appointed by the Collector under sub - section (2) of section 55.
(2) The words and expression used but not defined in these rules shall have the same meaning as assigned to them in the Act .
3. Time and Place of Election .
(1). The election of President and Vice - President shall be held at such time and place as may be determined in this regard by the officer authorized by the Commission:
till Provided that whole procedure of the election from submission of nomination form to the voting , shall be completed five PM on the date of election .
(2) In the notice of the meeting the presiding officer shall specify the date , time and place fixed under sub - rule ( 1 ) and by such notice shall invite the nomination forms of the candidates for election and shall specify the date and place where the nomination forms may be submitted .
(3) The notice of the meeting shall be sent to each councillor and the same shall also be displayed in the council office at least seven days prior to meeting .
(4) The meeting shall be presided over by any officer nominated by the authorized officer , who hereinafter shall be called presiding officer :
Provided that for election such officer shall be the Presiding Officer who shall be not be below the rank of the officer of cadre of Collector, Additional Collector or Joint Collector , Sub- Divisional Officer or Deputy Collector or Tehsildar and Nayab Tehsildar ;
(5) The Presiding Officer shall prepare the programme of the election of President and Vice - President and announce it in the meeting. At first the election of President shall be held and thereafter the election of Vice- President .
4. Submission of nomination forms./
(1) the For the election of the post of President and Vice- President candidate shall be nominated by the nomination form in "Form-A" , which shall be submitted by the candidate personally or by his / her मध्यप्रदेश राजपत्र, दिनांक 28 जनवरी 2020

proposer or supporter to the presiding officer on the date , time and place fixed under rule 3 .
(2) No Councillor shall propose or support the nomination of more than one candidate .
5. The Procedure to be adopted on the Receipt of the Nomination Form.
On the submission of nomination form the presiding officer shall write and sign a certificate showing date and time of the submission of nomination form and shall put its serial number on it .
6. Scrutiny of Nominations.-
(1) The Presiding Officer, before the time fixed for election , after providing all reasonable opportunities for the inquiry of nomination forms to Councillors present in the meeting, shall checkout the nomination forms and shall decide all such objections that may be raised with regard to any of the nomination .
(2) Presiding officer, either on the objections or suo- moto , after carrying out further summary inquiry, if any, that seems necessary to him , may reject any nomination form on any of the following grounds , namely: -
「 (a) that the nomination form was not received within the prescribed time limit; or
(b) that the candidate is not eligible for election as President and Vice- President under this Act; or
(c) that the signature of the proposer or supporter is not original or has been obtained fraudulently; or
(d) that the Councillor has signed the nomination forms of more than one candidate either as proposer or the supporter .
(3) The Presiding Officer on each nomination form, shall endorse his decision of accepting or rejecting it and if the nomination form is rejected then he shall record a brief detail of his reasons for rejecting the same.
(4) The decision of the Presiding Officer shall be final .

7. Withdrawal of candidature .
Any duly nominated candidate may withdraw his/ her candidature by giving an application in writing prior to the voting.
8. Nomination ..
The Presiding Officer , after the scrutiny of the nomination forms , shall read out the following things before the councillors present. in the meeting-
(a) name of those candidates whose nomination forms are declared invalid and the reason thereof;
(b) name of those candidates , who have withdrawn their names ; and
(c) name of the candidates , whose nomination forms are accepted finally.
9. Procedure.-
(1) When the nomination form of only one candidate has been found valid , then the Presiding Officer shall declare such candidate to be duly elected for the post of the President or the Vice-President as the case may be ...
(2) When the number of duly nominated candidates is more than one , then their election shall be made through secret voting .
10. Ballot Box and Voting method . ")
(1) When the election is to be done through ballot papers , then the Presiding Officer shall arrange for such a ballot box, to be made in such a manner that ballots can be casted in it but cannot be removed without opening the lock.
(2) The Presiding Officer , immediately before the commencement of voting, shall inform the councillors present that the ballot box is empty and shall then lock it and place it for voting.

(3). Each councillor present in the meeting shall be given a ballot paper signed by the Presiding Officer, on which names of all the candidates participating in the election shall be printed in Form-A or shall be written in the legible letters .
(4) Each Councillor shall go to the place appointed for the purpose of voting in the order prescribed by the Presiding Officer and put a mark of (x) against the candidate to whom he wishes to vote . No Councillor shall vote for more than one candidate . After this the ballot will be folded and the vote will be casted in the box .
11. Assistance in voting to illiterate , blind and senile councillors .
(1) Ifa Councillor who is illiterate , blind or senile and is unable to read the name of the candidate or is unable to mark the ballot as per his/her choice without any assistance , then the Presiding Officer shall give permission to such a Councillor to carry any of his /her companion , who is not less than 18 years of age, with his/her in to the voting room to put the mark as per his / her choice as per sub - rule (4) of rule 10 against the name of the candidate:
Provided that no person shall be allowed to work as a companion with more than one Councillor :
Provided further that before allowing any person to work as a companion of any Councillor , he/she shall be required to make this declaration in Form -B that he/she has not worked with any Councillor as companion:
Provided also that the voter shall not get the benefit of illiteracy , if he/ she has a certificate of being literate and the physical disability shall be such that he cannot vote , and if the voter is handicapped then it is necessary to produce disability certificate ,
(2) The Presiding Officer shall keep the record of all the cases under this rule.

12. The procedure to be adopted on opening of ballot box and counting of votes ..
The Presiding Officer shall open the ballot box and start the scrutiny of ballots , if there are marks of (x) against more than one numbers or there is any such mark or sign , by which the voter can be identified, then such a ballot shall be treated as invalid and shall not be counted. After this , the Presiding Officer shall count the valid votes and arrange the ballots related to each candidate.
13. Equality of Votes ..
After completion of counting of votes , if the number of votes received by any of the candidates are found to be equal and if by adding a vote to the votes of any of them, that candidate shall become entitled to be declared elected then the Presiding Officer shall make the decision forthwith by putting in a manner that he may determine and shall take the next action assuming the person whose name has been found in lot, have got an additional vote .
14. Declaration of election results.-
On the completion of counting of votes the Presiding Officer, subject to the provisions of rule 13 , if and to the extent that are applicable to the particular case shall declare the candidate getting most, valid votes elected and shall prepare complete and certify the return of the election .
Maintaining the secrecy of voting.-
15.
Every person performing any duty related to voting or counting in any election shall maintain the confidentiality of voting and shall not give any such information (except the purpose authorised by or under any law) to any person , by which there is possibility of breach of such confidentiality.

Disposal of election documents .
16.
Nomination forms , ballot paper , whether valid or rejected and all other papers related to the election shall be kept by the Presiding Officer in the safe custody of the authorised officer of the Commission i.e. the Collector for the period of five years from the date of election and thereafter it may be destroyed by him .
17. Casual vacancy.-
In the event of casual vacancy of the post of President and Vice- President, the process to fill such vacancy shall be carried out , subject to the provisions of section 43 , immediately in . the same manner as it is carried out the in original election . The District Collector will take steps to fill the vacancy as soon as possible as per the provisions of the Act/Rules .
18. If the post of any councilor remains vacant , then the election of the President and Vice- President will not be stopped . Process to fill such casual vacancy will be commenced soon .
Assistance in case of Reservation.-
19.
Reservation process shall be made by the State Government. The reservation of the post of President shall be made by the prescribed authority and will be published in the Madhya Pradesh Gazette Extraordinary .
Appointment of Election Staff..
20.
The authorized officer , for the purpose of election under these rules , shall appoint a Presiding Officer in each election . He may also appoint one or more Assistant Presiding Officers to assist in the election work . Such officers may be appointed either by name or as ex- officio . The authorized officer may also appoint officials as necessary for the election work.

66(13) 21. Control ..
The Presiding Officer, Assistant Presiding Officer and all other persons who have been appointed for any matter related to these rules shall work under the guidance , superintendence and control of the Authorized Officer .
22. Notwithstanding anything contained in these rules , the State Election Commission may issue such special or general orders or directions for conducting fair and free elections which are not inconsistent with the provisions of the Act .
23. General duty of the Presiding Officer.-
It shall be the general duty of the Presiding Officer to maintain order in the meetings convened for election , to see that the election is being conducted properly .
24. Postponement of election in emergent circumstances ..
(1) If process of election is disturbed by riots or open violence or due to sufficient reasons in a meeting, the Presiding Officer shall postpone the election till the date to be fixed later , where the election is thus withheld by the Presiding Officer, he will immediately inform it to " the District Collector and Authorized Officer" .
(2) Wherever the election under sub - rule ( 1 ) is postponed, the District Collector shall immediately inform the Madhya Pradesh State Election Commission .
25. Repeal.-
Immediately before the commencement of these rules , all rules , bye -laws and orders , if any , prevailing on this subject are hereby repealed .
