क्रमांक . एफ- 19-2-2019 - बारह - 1 - पार्ट. - खान एवं खनिज (विकास एवं विनियमन ) अधिनियम , 1957 (1957 का 67) की धारा १ ख के साथ पठित धारा 15 एवं धारा 23 (ग) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतदद्वारा , मध्यप्रदेश रेत , (खनन, परिवहन , भण्डारण तथा व्यापार) नियम , 2019 में निम्नलिखित संशोधन करती है , अर्थात्ः-
संशोधन
उक्त नियमों में, -
1. नियम 7 में, उपनियम (2) के अंत में , पूर्णविराम के स्थान पर, कालन स्थापित किया जाए तथा तत्पश्चात् निम्नलिखित परन्तुक जोड़ा जाए , अर्थात्ः- " परन्तु किसी समूह के प्रारंभिक आधार मूल्य की गणना हेतु रेत की

मांग के आंकलन के आधार पर समस्त खदानों की मात्रा के कुल योग से भिन्न मात्रा भी निर्धारित की जा सकती है । " ।
नियम 11 मे, 2.
(1) उप नियम ( 1 ) में , अंक तथा शब्द " 03 कार्य दिवस " के स्थान पर, अंक तथा शब्द " 15 कार्य दिवस " स्थापित किए जाएं ।
(2) उप नियम (2 ) में , अंक तथा शब्द " 03 दिवस " के स्थान पर, अंक तथा शब्द " 15 दिवस " स्थापित किए जाएं ।
3. नियम 13 मे , उप नियम (2) के स्थान पर, निम्नलिखित उप नियम स्थापित किया जाए , अर्थात्ः- है।
" (2) उपरोक्तानुसार वचनबंध प्रस्तुत करने की तिथि से 15 दिवस के भीतर प्ररूप- पांच में पृथक् पृथक् खदानवार ठेका अनुबंध का निष्पादन कराया जा सकेगा । अनुबंध निष्पादन की औपचारिकताएँ पूर्ण होने पर ठेका अनुबंध का भारतीय रजिस्ट्रीकरण अधिनियम , 1908 ( 1908 का क्रमांक 16 ) के उपबंधों के अधीन पंजीकरण कराया जायेगा । " ।
4. नियम 26 में , उपनियम (2) में विद्यमान पेरा को खण्ड (क) के रूप में क्रमांकित किया जाए और तत्पश्चात् निम्नलिखित खण्ड अंतःस्थापित किया जाए , अर्थात्ः-
"(ख) पंचायतों को अंतरित रेत खदानों की समस्त वैधानिक स्वीकृतियां नवीन समूह के ठेकेदार के पक्ष में अंतरित की जाएंगी । इस हेतु संबंधित पंचायत के जनपद क्षेत्र के मुख्य कार्यपालन अधिकारी को अनापत्ति / सहमति जारी करने के लिए पंचायतों को अंतरित खदानों में पूर्व नियमों के अंतर्गत हस्तांतरणकर्ता की क्षमता में अधिकृत किया जाता है । " । ?
5. यह अधिसूचना 30 अगस्त, 2019 से प्रवृत्त हुई समझी जाएगी । मध्यप्रदेश राजपत्र, दिनांक 7 फरवरी 2020
100 ( 1 ) No. F - 19-2-2019 -XII - 1 -Part.- In exercise of the powers conferred by section 15 and section 23C read with section 9B of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957) , the State Government, hereby , makes the following amendments in the Madhya Pradesh Sand (Mining , Transportation, Storage and Trading) Rule, 2019 , namely: -
AMENDMENT
In above rules , -
1. In rule 7, in the end of sub - rule (2) , for fulstop, the colon shall be substituted and thereafter, the following proviso shall be added, namely:-
"Provided that , based on the estimation of the demand for sand for calculating the initial base price of a group, a different quantity can also be determined from the total sum of the quantity of all the mines . " .
2. In rule 11 , -
(1) In sub rule ( 1 ) , for the figure and words " 03 working days " , the figure and words " 15 working days " shall be substituted.
(2) In sub rule (2) , for the figure and words " 03 days " , the figure and words " 15 days " shall be substituted .
3. In rule 13 , for sub - rule (2) , the following sub - rule shall be substituted, namely: -
"(2). The quarry wise contract agreement may be executed separately in Form - V within 15 days from the date of submission of the 100 (2)

undertaking . Agreement Shall be registered under the provision of Indian Stamp and Registration Act, 1908 (No. 16 of 1908) . " .
4. In rule 26, in sub -rule (2) , existing para shall be numbered as clause (a) and thereafter , the following clause shall be inserted , namely: - " (b) All statutory clearances of sand mines transferred to Panchayats will be transferred in favor of the new group contractor . For this , the Chief Executive Officer of the janpad area of the concerned Panchayat is authorized to issue NOCs / consent to the capacity of transferor in the mines transferred under the earlier rules to the Panchayat." .
5. This notification shall be deemed to have come into force from 30th August, 2019 .
