क्र. एफ ए- 3-33-2017-1 - पांच ( 05 ) .- मध्यप्रदेश माल और सेवा कर अधिनियम , 2017 ( क्रमांक 19 सन् 2017 ) की धारा 9 की उपधारा ( 1 ) और धारा 15 की उपधारा ( 5 ) में प्रदत्त शक्तियों का प्रयोग करते हुए राज्य सरकार, परिषद् की सिफारिशों पर इस विभाग की अधिसूचना क्रमांक एफ ए- 3-33-2017-1- पांच ( 42 ) , दिनांक 5 अगस्त, 2017 में निम्नलिखित और आगे भी संशोधन करती है , यथा :-
उक्त अधिसूचना में, -
क. अनुसूची I 2.5% में, -
(i) क्रम सं. 33क तथा उससे संबंधित प्रविष्टियों का लोप किया जाएगा;
(ii) क्रम सं. 164 के समक्ष स्तम्भ (3 ) की प्रविष्टि में , मद ii के बाद निम्नलिखित मद को अंतःस्थापित किया जाएगा, यथा :-
मैरीन फ्यूल 0.5% ( एफओ ) ";
(iii) क्रम सं. 224 के समक्ष , स्तम्भ ( 2 ) की प्रविष्टि के स्थान पर प्रविष्टि " 63 [ 6305 32 00, 6305 33 00, 6309 ] " को प्रतिस्थापित किया जाएगा;
(iv) क्रम सं. 234ख और इसमें दी गयी प्रविष्टियों के बाद निम्नलिखित क्रम सं. और प्रविष्टियों को अंतःस्थापित किया जायेगा, यथा :-

अन्य रेल लोकोमोटिव्स; लोकोमोटिव परिचारक; जैसे कि डीजल- विद्युत्लोकोमोटिव्स, भाप से चलने वाले लोकोमोटिव्स और इसके परिचारक.
स्वतःनोदित रेलवे या टामवे कोचेस , वैन और ट्रक, जो शीर्ष 8604 से भिन्न हो.
रेल या ट्राम अनुरक्षण या सर्विस यान, चाहे स्वतः नोदित हैं या नहीं (उदाहरणार्थ , कर्मशाला क्रेने , ब्लास्ट टैंपर्स, ट्रैक लाइनर, परीक्षण कोच और पथ निरीक्षणयान).
रेलवे या ट्रामवे यात्री कोचेस जो स्वतःनोदित न हों; मालगाड़ी, डाकघर के कोचेस और अन्य विशेष प्रयोजन के लिये रेलवे या टामवे कोचेस, जो कि स्वतःनोदित न हों ( शीर्ष 8604 से भिन्न) .
रेलवे या ट्रामवे मालगाड़ी और वैगन, जो स्वतःनोदित न हों रेलवे या ट्रामवे लोकोमोटिव्स या रॉलिंग स्टॉक; जैसे कि रेल डिब्बे , बिसल - रेल डिब्बे, एक्सल्स और पहिये , और इनके पुर्जे.
रेलवे या ट्रामवे की पटरियों को फिक्स और फिट करने के लिए ; यांत्रिक सिगनल ( विद्युत्- यांत्रिक सहित ) , रेलवे, ट्रामवे, सड़क, इन्लैंड वाटर वेज़, पार्किंग सुविधाओं, पत्तन स्थापना या एयरफील्ड की सुरक्षा या ट्रफिक नियंत्रण यंत्र; उपरोक्त के पुर्जे" ;
क्रम सं. 231 ख के समक्ष, कॉलम ( 3 ) में " स्लाइड फास्टर्नर्स " शब्द के बाद, " और इसके पुर्जे " , शब्दों को अंतः स्थापित किया जाएगा ;
ग. अनुसूची III 9% में, -
(i) क्रम सं. 24क के समक्ष, कॉलम ( 3 ) में शब्द " नारियल पानी ", के पश्चात् शब्द " कैफीनेटेड पेय " , प्रतिस्थापित किए जाएंगे ;

122( 1) क्रम सं. 108 के समक्ष, कॉलम ( 3 ) में शब्द " प्लास्टिक के क्लोजर्स " के पश्चात् कोष्ठक, अक्षर और अंक " [ अनुसूची (ii) क्रम संख्या 80कक के अंतर्गत आने वाले मदों को छोड़कर ] " को अंतःस्थापित किया जाएगा; (ii)
(ii) क्रम सं. 400 के समक्ष , कॉलम ( 3 ) की प्रविष्टि में,
"निम्नलिखित मोटर वाहन जिनकी लम्बाई 4000 एमएम , से अधिक न हो, यथा :- "
(क) पेट्रोल, लिक्यूफाइड पेट्रोलियम गैंसे ( एलपीजी ) या कम्प्रेस्ड नेचुरल गैस ( सीएनजी ) से चलने वाले वाहन जिनकी इंजन क्षमता 1200 सीसी से अधिक न हो; और
(ख) डीजल से चलने वाले वाहन जिनकी इंजन क्षमता 1500 सीसी से अधिक न हो दिव्यांग व्यक्तियों के लिये, बशर्ते कि :
भारत सरकार के भारी औद्योगिक विभाग के उप सचिव रैंक से अन्यन कोई अधिकारी से यह प्रमाणित करवाना होगा कि उक्त माल का प्रयोग दिव्यांग व्यक्तियों वाले व्यक्ति द्वारा किया जाएगा ; और जैसा कि उक्त विभाग द्वारा जारी दिशानिर्देश के अनुसार किया जाएगा " , को प्रतिस्थापित किया जाएगा;
क्रम सं. 446 तथा उससे संबंधित प्रविष्टियों का लोप किया जाएगा; ( iv)
घ. अनुसूची IV 14% में, -
(i) क्रम सं . 12 , और इसमें दी गयी प्रविष्टियों के बाद निम्नलिखित क्रम सं. और प्रविष्टियों को अंतःस्थापित किया जायेगा, यथा :-

च. अनुसूची VI 0.125% में, -
(i) क्रम सं. 2 में कॉलम ( 3 ) की प्रविष्टि के स्थान पर, प्रविष्टि " बहुमूल्य रत्न ( हीरे से भिन्न) और उप रत्न चाहे ये कर्मित किए गए हों या नहीं या श्रेणित हों या नहीं लेकिन इनको पिरोया, आरुढ़ या जड़ा न गया हो; अन्य श्रेणित बहुमूल्य रत्न ( हीरे से भिन्न ) और उप रत्न जो परिवहन की सुविधा के लिये अस्थायी रूप से गूंथे गए हो" को प्रतिस्थापित किया जाएगा ;
(ii) क्रम सं. 2क और उससे संबंधित प्रविष्टियों का लोप किया जाएगा;
(iii) क्रम सं. 3 में, कॉलम ( 3 ) की प्रविष्टि के स्थान पर, प्रविष्टि, " संश्लिष्ट या पुनसंनिर्मित रत्न या उप रत्न चाहे कर्मित या श्रेणीकृत हैं या नहीं, किन्तु जो गूंथे, आरुढ़ या जड़े नहीं हैं; अश्रेणीकृत , संश्लिष्ट या पुनः संनिर्मित रत्न जो परिवहन की सुविधा के लिये अस्थायी रूप से गूंथे गए हैं, को प्रतिस्थापित किया जाएगा;
(iv) क्रम सं. 4 और उससे संबंधित प्रविष्टियों को लोप किया जाएगा;
2. यह अधिसूचना दिनांक 01 अक्टूबर, 2019 से प्रवृत्त समझी जायेगी .

In exercise of the powers conferred by sub -section ( 1 ) of Section 9 and sub - section (5) of Section 15 of the Madhya Pradesh Goods and Services Tax Act , 2017 ( 19 of 2017 ) , the State Government , on the recommendations of the Council , hereby makes the following further amendments in this department's notification No. F- A3-33-2017 - I -V (42) dated the 29th June , 2017 , namely :-
In the said notification ,-
A. in Schedule I - 2.5 %
(i) S. No. 33A and the entries relating thereto shall be omitted;
( ii) against S. No. 164 , in the entry in column ( 3) , after item ii , the following item shall be inserted, namely :-

(iii) in S. No. 400 , for the entry in column (3 ) , the entry, "Following motor vehicles of length not exceeding 4000 mm , namely :
(a) Petrol , Liquefied petroleum gases ( LPG ) or compressed natural gas ( CNG) driven vehicles of engine capacity not exeeding 1200 cc ; and
(b) Diesel driven vehicles of engine capacity not exceeding 1500 cc for persons with orthopedic physical disability , subject to the condition that an officer not below the rank of Deputy Secretary to the Government of India in the Department of Heavy Industries certifies that the said goods shall be used by the persons with orthopedic physical disability in accordance with the guidelines issued by the said Department " , shall be substituted;
(iv) S. No. 446 , and the entires relating thereto shall be omitted;

2. This notification shall deemed to have come into effect on the 1st day of October, 2019 .
