क्र. एफ- 37-2-2020- बीस- 3.- मध्यप्रदेश माध्यमिक शिक्षा अधिनियम , 1965 ( क्रमांक 23 सन् 1965 ) की धारा 27 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा, मध्यप्रदेश माध्यमिक एवं उच्चतर माध्यमिक शालाओं की मान्यता नियम, 2017 में निम्नलिखित संशोधन करती है , अर्थात्ः-
संशोधन
उक्त नियमों में, -
1. नियम 2 में, खण्ड (घ) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए । " (घ) " निजी विद्यालय " से अभिप्रेत है , किसी सोसाइटी / ट्रस्ट द्वारा केन्द्रीय / राज्य अधिनियमों के उपबंधों के अधीन सम्यक् रूप से गठित तथा रजिस्ट्रीकृत रूप से संचालित समस्त विद्यालय; " .
2. नियम 3 में, उप - नियम (1 ) , में खण्ड (5) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए ।
"(5) लोक शिक्षण संचालनालय में पदस्थ विद्या शाखा
सदस्य- सचिव " का कार्य देख रहे संयुक्त संचालक से अनिम्न

द्वारा इस कार्य हेतु प्राधिकृत किया जाए
3. नियम 5 में,
(1 ) उपनियम (2 ) में , खण्ड (क) के स्थान पर , निम्नलिखित खण्ड स्थापित किया जाए , अर्थात्ः-
"(क) नवीन मान्यता- हाईस्कूल या / और उच्चतर माध्यमिक विद्यालय की नवीन मान्यता हेतु भूमि तथा भवन के संबंध में संबंधित सोसायटी/ ट्रस्ट / कंपनी को निम्नलिखित शर्तों का पालन करना होगाः-
(एक) शाला भवन तथा शाला की खुली भूमि एकीकृत रूप से एक ही भूमि का हिस्सा होंगे , जिस पर मापदण्ड अनुसार समुचित खेल मैदान व अन्य सुविधाएं स्थापित होंगी । शाला परिसर क्षेत्र पक्की एवं पर्याप्त ऊंचाई की बाउंड्रीवॉल से संरक्षित होगा ।
(दो) उपरोक्तानुसार भूमि की उपलब्धता निम्नानुसार होनी चाहिए तथा निर्मित क्षेत्र राष्ट्रीय भवन संहिता , 2005 में विनिर्दिष्ट मानकों के अनुसार होना चाहिए: -
अ. नवीन मान्यता हेतु सोसायटी / ट्रस्ट के पास हाई व हायर सेकेण्डरी स्कूल हेतु न्यूनतम आधा एकड़ भूमि होना चाहिए । यदि विद्यालय कक्षा 1 से 12 अथवा कक्षा 6 से 12 तक एक ही परिसर में संचालित होता है तो न्यूनतम भूमि उपलब्धता एक एकड़ होनी चाहिए ।
(तीन) मान्यता नवीनीकरण- शैक्षणिक सत्र 2020-21 तक की मान्यता प्राप्त संस्थाओं के पास हाई स्कूल के लिए न्यूनतम 4,000 वर्गफीट तथा हायर सेकेण्डरी के लिए न्यूनतम 5,600 वर्गफीट भूमि होना चाहिए । उक्त भूमि में से हाई स्कूल के लिए न्यूनतम 2,000 वर्गफीट निर्मित भूतल पर तथा 2,000 वर्गफीट खुली भूमि मध्यप्रदेश राजपत्र, दिनांक 3 मार्च 2020
184( 1) एवं हायर सेकेण्डरी के लिये न्यूनतम 2,600 वर्गफीट निर्मित भूतल पर तथा 3,000 वर्गफीट खुली भूमि होना चाहिए ।
(चार) उपरोक्त निर्धारित न्यूनतम सीमा की बाध्यता के अंतर्गत रहते हुये नवीन एवं नवीनीकरण मान्यता संबंधी प्रकरणों में संस्था में दर्ज प्रति छात्र 10 वर्गफीट निर्मित क्षेत्र एवं प्रति छात्र 5 वर्गफीट खुली भूमि होना चाहिए , यदि कोई विद्यालय दो पारियों में संचालित है तो प्रत्येक पारी में अध्ययनरत् छात्रों की संख्या के अनुपात में उपरोक्त मान से न्यूनतम क्षेत्रफल की गणना की जायेगी । " ।
(2) उप-नियम (3 ) एवं (4) के स्थान पर, निम्नलिखित उप - नियम स्थापित किए जाएं, अर्थात्ः-
"(3) अध्यापन कक्ष- नवीन मान्यता के प्रकरणों में उप - नियम 5 (2 ) (क) अनुसार न्यूनतम अधोसंरचना के साथ प्रत्येक कक्षा , वर्ग , संकाय तथा अध्ययन का माध्यम हेतु पृथक् पृथक् अध्यापन कक्ष होंगे । प्रत्येक कक्ष का न्यूनतम क्षेत्रफल 400 वर्गफुट होगा । अध्यापन कक्षों के साथ - साथ प्राचार्य कक्ष, स्टॉफ कक्ष व कार्यालय कक्ष इत्यादि भी होगें ।
नवीन मान्यता एवं मान्यता नवीनीकरण के समय कितने वर्गों के लिए मान्यता चाहता है उसका उल्लेख करना आवश्यक होगा । प्रत्येक वर्ग में विद्यार्थियों की अनुकूलतम संख्या 40 होगी ।
कक्षा 9वीं एवं 11 वीं से उसी विद्यालय से उत्तीर्ण छात्र तथा कक्षा 10 वीं एवं 12 वीं के प्रथम वर्ष अनुत्तीर्ण हुए छात्र, कक्षा 10वीं एवं 12वीं में प्रवेश ले सकेंगे । कक्षा 10वीं एवं कक्षा 12 वीं में प्रवेश के लिए स्थानान्तरण आदि प्रकरणों में 10 प्रतिशत तक प्रवेश संबंधित संस्था प्रमुख दे सकेंगे , विशेष परिस्थितियों में 20 प्रतिशत तक प्रवेश संबंधित जिला शिक्षा अधिकारी की अनुमति से दिए जा सकेंगे । अपरिहार्य स्थितियों में 20 प्रतिशत से अधिक विद्यार्थियों का प्रवेश मध्यप्रदेश राजपत्र, दिनांक 3 मार्च 2020

लोक शिक्षण संचालनालय की अनुमति से दिया जा सकेगा ।
(4) (क) प्रयोगशाला- प्रत्येक हाई स्कूल में एक सामूहिक प्रयोगशाला होगी । उच्चतर माध्यमिक विद्यालयों में भौतिकशास्त्र , रसायनशास्त्र तथा जीव विज्ञान के लिए पृथक् पृथक् प्रयोगशालाएं, पाठ्यक्रम अनुसार विनिर्दिष्ट संख्या में आवश्यक उपकरणों के साथ होंगी ।
नवीन मान्यता प्रकरणों में उच्चतर माध्यमिक विद्यालयों में भौतिकशास्त्र , रसायनशास्त्र तथा जीव विज्ञान के साथ- साथ गणित विषय के लिए पृथक् पृथक् प्रयोगशालाएं , पाठ्यक्रम अनुसार विनिर्दिष्ट संख्या में आवश्यक उपकरणों के साथ होंगी । प्रत्येक प्रयोगशाला कक्ष का आकार 500 वर्गफुट से कम नहीं होगा ।
(ख) कम्प्यूटर लैब- नवीन मान्यता प्रकरणों में विद्यालय के पास न्यूनतम 20 कम्प्यूटर सहित समुचित कम्प्यूटर लैब की सुविधा हो जिसका क्षेत्रफल लगभग 400 वर्गफीट होना चाहिए । कम्प्यूटर व विद्यार्थी का अनुपात 1:20 से कम न हो । इस लैब में इंटरनेट की सम्यक व्यवस्था होना चाहिए । 400 से अधिक नामांकन की स्थिति में इसी अनुपात में प्रत्येक अतिरिक्त 400 विद्यार्थियों के लिए इसी तरह की सुविधा प्रदान करनी होगी । विद्यालय को साइबर सेफ्टी प्रावधानों का पालन करना होगा तथा शिक्षकों की निगरानी में ही विद्यार्थियों को कम्प्यूटर लैब में कार्य करने की अनुमति होगी । " ।

3 ) उपनियम (5 ) में, खण्ड (ख ) के पश्चात्, निम्नलिखित खण्ड जोड़ा जाए , अर्थात्ः-
"(ग ) नवीन मान्यता प्रकरणों में पुस्तकालय कक्ष न्यूनतम 400 वर्गफुट का होगा जो सर्वसुविधा संपन्न होगा तथा जिसमें विद्यार्थियों के लिए समुचित अध्ययन व्यवस्था उपलब्ध होगी । पुस्तकालय में उपरोक्त कण्डिका (क ) अनुसार पुस्तकों के साथ साथ विद्यार्थियों की आयु के अनुरूप पुस्तकें भी उपलब्ध होंगी जिसमें ई- बुक्स / मैगजीन का भी समावेश किया जाएगा । " ।
(4) उपनियम (6) एवं (7 ) के स्थान पर, निम्नलिखित उपनियम स्थापित किए जाएं, अर्थात्ः- मध्यप्रदेश राजपत्र, दिनांक 3 मार्च 2020
184(3) "(6) खेल मैदान तथा सुविधाएं- मान्यता नवीनीकरण संबंधी प्रकरणों में शाला के पास शाला प्रांगण में कम से कम दो खेलों जैसे बैडमिंटन / टेबल टेनिस / कबड्डी / खो- खो / वॉलीबाल / बास्केटबाल आदि की सुविधा होगी ।
नवीन मान्यता संबंधी प्रकरणों में खुला क्षेत्र खेलों के लिए मैदान के रूप में विकसित होगा । कबड्डी, खो- खो , वॉलीबाल , बास्केटवाल, बैडमिंटन , क्रिकेट आदि आउटडोर खेलों में से कम से कम दो खेलों के लिए आवश्यक व्यवस्था निर्मित होगी । इसके साथ - साथ नवीन तथा नवीनीकरण मान्यता प्रकरणों में न्यूनतम दो इनडोर गेम्स हेतु भी आवश्यक व्यवस्था हो ।
(7) प्रसाधन- विद्यालय के प्रत्येक तल पर बालक एवं बालिकाओं के लिए पृथक- पृथक व स्वच्छ प्रसाधनों की समुचित व्यवस्था होनी चाहिए । यदि विद्यालय में प्राथमिक / पूर्व माध्यमिक कक्षाओं का भी संचालन किया जा रहा हो तो प्राथमिक / पूर्व माध्यमिक कक्षाओं के विद्यार्थियों एवं स्टॉफ के लिए प्रसाधन की व्यवस्था अन्य विद्यार्थियों से पृथक- पृथक होना चाहिए ।
नवीन मान्यता प्रकरणों में विशेष आवश्यकता वाले विद्यार्थियों के लिए प्रत्येक शौचालय के प्रवेश एवं निकास पर रैम्प आदि की पर्याप्त व्यवस्था होनी चाहिए । " ।
(5) उपनियम (9) के स्थान पर, निम्नलिखित उपनियम स्थापित किए जाएं, अर्थात्ः-
" (9) पेयजल व्यवस्था- विद्यार्थियों तथा स्टॉफ के लिए शुद्ध पेयजल को प्रदाय करने की समुचित व्यवस्था प्रत्येक तल पर होगी । " ।
(6) उपनियम (20 )-
(क) खण्ड (3 ) को विलोपित किया जाए ।
(ख) खण्ड (9 ) के पश्चात्, निम्नलिखित खण्ड जोड़े जाएं, अर्थात्ः-
" (10 ) विद्यार्थियों की सुरक्षा के संबंध में विद्यालय निम्नलिखित मार्गदर्शी सिद्धांतों का पालन करेंगा- मध्यप्रदेश राजपत्र, दिनांक 3 मार्च 2020

1. मान. सर्वोच्च न्यायालय द्वारा रिट पिटीशन (सिविल) क 483/2004 अविनाश मल्होत्रा विरूद्ध युनियन ऑफ इंडिया एवं अन्य में जारी किए गए दिशा निर्देश ।
2. राष्ट्रीय आपदा प्रबंधन प्राधिकरण द्वारा स्कूल सेफ्टी पॉलिसी 2016 के तहत जारी दिशा निर्देश ।
3. राष्ट्रीय बाल अधिकार संरक्षण आयोग द्वारा विकसित मेन्युअल ऑन सेफ्टी एण्ड सिक्युरिटी ऑफ चिल्ड्रन इन स्कूल्स ।
4. राष्ट्रीय भवन संहिता 2005 , जैसा कि समय समय पर संशोधित किया गया है ।
( 11 ) प्रदेश में संचालित किसी भी अशासकीय हाई स्कूल / हायर सेकेण्ड्री विद्यालय के पास दोहरी मान्यता नहीं होनी चाहिए । यदि कोई संस्था किसी अन्य बोर्ड से मान्यता प्राप्त कर लेती है तो उसे मध्यप्रदेश शासन की मान्यता स्वतः ही समाप्त हो जाएगी । इस आशय की सूचना संस्था को संबंधित संभागीय संयुक्त संचालक कार्यालय एवं लोक शिक्षण कार्यालय में देनी अनिवार्य होगी ।
इन नियमों के तहत संचालित विद्यालय के परिसर / भवन में किसी दूसरे बोर्ड का कोई दूसरा विद्यालय संचालन नहीं किया जा सकेगा ।
(12) इस नियम के तहत संचालित सभी अशासकीय हाई स्कूल / हायर सेकेण्डरी विद्यालयों में कक्षा 9 वीं से 12 वीं तक मध्यप्रदेश शासन द्वारा निर्धारित पाठ्यक्रम पढ़ाया जाना अनिवार्य होगा, साथ ही मध्यप्रदेश पाठ्यपुस्तक निगम के द्वारा मुद्रित पुस्तकों के द्वारा ही विद्यालय में शिक्षण कार्य कराया जाएगा । विद्यालय आवश्यकतानुसार नियत पाठ्यक्रम के अंतर्गत अन्य सहायक पुस्तकें नियत संख्या में उपयोग में ला सकेंगे जैसा कि शासन द्वारा विर्निदिष्ट किया जाए । " । मध्यप्रदेश राजपत्र, दिनांक 3 मार्च 2020
184(5) 4. नियम 6 में, -
(1 ) उपनियम (2) के स्थान पर, निम्नलिखित उपनियम स्थापित किया जाए , अर्थात्ः-
" (2) संस्था के द्वारा आवेदन पत्र के साथ भवन की सुदृढता एवं सुरक्षा, अग्नि सुरक्षा तथा स्वास्थ्य एवं स्वच्छता संबंधी ऐसे सक्षम प्राधिकारी द्वारा जारी प्रमाण पत्र प्रस्तुत किया जाएगा जैसा कि शासन द्वारा विनिर्दिष्ट किया जाए । " ।
(2) उपनियम (6) में, खण्ड (ख ) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए , अर्थात्ः-
" (ख) समस्त अध्यापकों की कक्षावार तथा विषयवार सूची उनकी शैक्षणिक अर्हता के साथ जैसे स्नातक, स्नातकोत्तर, व्यावसायिक योग्यता, डी. एड / बी.एड आदि की अंकसूचियां विद्यालय के प्राचार्य द्वारा प्रमाणित प्रतियों के साथ मान्यता नवीनीकरण आवेदन के साथ अपलोड की जाएगी ।
नवीन मान्यता प्रकरणों में शपथ पत्र प्रस्तुत करना होगा कि सत्र प्रारंभ के पूर्व नियमानुसार स्टाफ की नियुक्ति कर ली जाएगी । मान्यता प्राप्त होने पर स्टॉफ सूची मय शैक्षणिक प्रमाण पत्र सत्र प्रारंभ होने के पूर्व अपलोड करनी होगी । " ।
(3) उपनियम ( 11 ) के पश्चात् निम्नलिखित उपनियम जोड़ा जाए, अर्थात्ः-
" (12) प्रकिया प्रतिवर्ष 01 जनवरी से प्रारंभ की जाकर 31 अक्टूबर तक पूर्ण की जाएगी । अपरिहार्य कारणों से उक्त अवधि को घटाने / बढ़ाने के लिए मान्यता समिति सक्षम होगी । " ।
5. नियम 7 के स्थान पर,, निम्नलिखित नियम स्थापित किया जाए , अर्थात्ः-
"7. मान्यता के लिए समयावधि - किसी समिति ट्रस्ट को प्रारम्भ में पांच वर्ष की कालावधि के लिए मान्यता प्रदान की जाएगी । पूर्व से ही मान्यता प्राप्त विद्यालयों को तत्पश्चात् पांच वर्ष के लिए मान्यता की वृद्धि हेतु अनुज्ञात किया जाएगा । किसी सोसायटी / ट्रस्ट को एक ही शैक्षणिक वर्ष में कक्षा नवीं और मध्यप्रदेश राजपत्र , दिनांक 3 मार्च 2020

दसवीं या कक्षा ग्यारहवीं या बारहवीं के लिए एक ही साथ मान्यता नहीं दी जाएगी । किन्तु अर्हता शर्तों के पूर्ण होने पर कक्षा नवीं या कक्षा ग्यारहवीं या दोनों के लिए मान्यता एक ही वर्ष में दी जा सकेगी । " ।
6. नियम 9 में, उपनियम (7 ) के पश्चात्, निम्नलिखित उपनियम जोड़े जाएं, अर्थातः- " (8 ) विद्यालय प्रबंधन समिति द्वारा शिक्षकों / कर्मचारियों के सेवा संबंधी नियमों को पारित किया जाना चाहिए जिसमें निम्नानुसार बिन्दु अनिवार्य रूप से सम्मिलित हों:-
1. शिक्षक / कर्मचारियों की नियुक्ति/ स्थायीकरण के संबंध में ।
2. शिक्षक / कर्मचारियों के सेवा आचरण नियम ।
3. शिक्षक / कर्मचारियों के वेतन भत्ते।
4. शिक्षक/ कर्मचारियों की सेवानिवृत्त आयु के संबंध में ।
5. शिक्षक / कर्मचारियों को ई.पी.एफ. / पेंशन स्कीम के संबंध में ।
6. शिक्षक / कर्मचारियों के अवकाश के संबंध में ।
7. शिक्षक / कर्मचारियों की सेवा पुस्तिका संधारण के संबंध में ।
8. शिक्षकों/ कर्मचारियों की अनुशासनात्मक कार्यवाही एवं सेवा समाप्ति के संबध में। " ।
7. नियम 10 में, उपनियम (1 ) में, -
(1 ) खण्ड (क) में, अंक " 20000 /- " और " 25000 / - " के स्थान पर, क्रमशः अंक " 32000 /- " और " 40000 / - " स्थापित किए जाए ।
(2) खण्ड (च) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए, अर्थात्ः- " (च) स्थान परिवर्तन के प्रकरणों को नवीन मान्यता की तरह माना जाएगा तथा इस हेतु रूपये 20,000 /- का शुल्क देय होगा । इस हेतु पोर्टल पर वर्ष भर सुविधा उपलब्ध रहेगी किन्तु स्थान परिवर्तन आगामी सत्र से लागू मान्य किया जाएगा । " । 184( 7)

(3) खण्ड (च) के पश्चात् निम्नलिखित खण्ड जोड़ा जाएं, अर्थात्ः-
"(छ) स्कूल का नाम परिवर्तन हेतु समिति / सोसायटी सर्वसम्मिति से प्रस्ताव पारित कर ऑनलाइन आवेदन कर सकेगी । आवेदन पत्र के. साथ समिति/ विद्यालय के ऊपर कोई देनदारी नहीं है इस आश्य का शपथ पत्र भी प्रस्तुत करना होगा । स्कूल के नाम परिवर्तन हेतु राशि रूपये 10,000 / - का शुल्क देय होगा । संबंधित संभागीय संयुक्त संचालक नियमानुसार निराकरण के लिए सक्षम अधिकारी होंगे । इस हेतु पोर्टल पर वर्ष भर सुविधा उपलब्ध रहेगी किन्तु नाम परिवर्तन आगामी सत्र से लागू मान्य किया जाएगा । " ।
8. नियम 11 में, उपनियम (2 ) के स्थान पर, निम्नलिखित उपनियम स्थापित किया जाए , अर्थात्ः-
" (2) कारण बताओ सूचना पत्र जारी किए जाने की दशा में और यदि सोसायटी / ट्रस्ट से प्राप्त उत्तर से संभागीय संयुक्त संचालक का समाधान नहीं होता है तो वह संबंधित को सुनवाई का अवसर प्रदान करने के पश्चात् विद्यालय पर अधिकतम रूपये एक लाख शास्ति अधिरोपित कर सकेगा । " । 9. नियग 12 में, पैराग्राफ को उपनियम (1 ) के रूप में कमांकित किया जाए और इस प्रकार क्रमांकित उप- नियम (1 ) के पश्चात निम्नलिखित उप - नियम जोड़ा जाए , अर्थात्ः-
" (2) मान्यता समिति, प्रथम अपील / द्वितीय अपील के निपटारे हेतु निर्धारित समय - सीमा अपरिहार्य कारणों से घटाने / बढ़ाने हेतु सक्षम होगी । " ।
10. नियम 12 क विलोपित किया जाए । मध्यप्रदेश राजपत्र, दिनांक 3 मार्च 2020

No. F 37-2-2020- XX- 3 . In exercsie of the powers conferred by Section 27 of the Madhya Pradesh Secondary Education Act , 1965 (No. 23 of 1965 ) , the State Government , hereby, makes the following amendemnts in the Madhya Pradesh Recognition of Secondary and Higher Secondary School (Amendment ) Rules , 2017 , namely:-
AMENDMENTS
In the said rules , -
1. In rule 2 , for clause (d) , the following clause shall be substituted , namely : -
" (d) " Private School " means all the schools run by a Society / Trust duly constituted and registered under the provisions ofCentral / State Acts ; " .
2. In rule 3 , in sub - rule ( 1 ) , for clause (5) , the following clause shall be substituted , namely: -
Member Secretary ." .
" (5) Officer not below the rank of Joint Director , in - charge Academic Section , of Directorate Public Instructions as the Commissioner Public Instructions may authorize for the task.
3. in rule 5 , -
( 1 ) in sub - rule ( 2) , for clause ( a) , the following clause shall be substituted , namely: -
"( a) New Recognition For new recognition of high school or/ and higher secondary school , the following conditions shall be fulfilled by the concerned society / trust / company in relation to the land and buildings : - ( i) School Building and the open land of the school shall be constructed on a single plot of the land on which playing ground and other facilities shall be annexed according to the norms . The school campus should be protected with concrete and sufficient height of the boundary wall .

( ii ) Availability of land as specified above should be as indicated below , provided the built up area should be as per the standards specified in the National Building Code 2005 :-
For new recognition of the Society / Trust should have minimum half acre of land for High and Higher Secondary School . If the school operates in the same campus from class 1 to 12 or class 6 to 12 , the minimum land availability should be one acre .
( iii) Renewal of Recognition- For the renewal of recognition , the institutions should have a minimum of 4,000 square feet and 5,600 square feet of land for high school and higher secondary school respectively , out of this land , for high school minimum built up area on ground floor would be 2,000 square feet and open area would be 2000 square feet , and for higher secondary school minimum built up area on ground floor would be 2,600 square feet and open area would be 3000 square feet .
(iv) Subject to the above prescribed minimum area of land, in new and renewal of recognition related matters , the institution should have 10 square feet ofbuilt - up area and 5 square feet of open land per student . If the institution is operative in two shifts , the minimum area requirement should be calculated on the basis of the number of students studying in each shift and as per the given minimum area requirement . " ;
(2) for sub - rules (3) and (4) , the following sub - rules shall be substituted , namely: - मध्यप्रदेश राजपत्र , दिनांक 3 मार्च 2020

" ( 3 ) Teaching rooms : In cases of new recognition , as per sub - rule 5 ( 2 ) ( a) , there will be separate teaching rooms for each class , section , stream and medium of instruction , with minimum infrastructure . Each room shall have a minimum area of 400 sq ft . There shall be a principle room , staff room , office space etc. in addition to the class rooms .
At the time of new recognition and renewal of recognition , it shall be mandatory to mention that for how many classes recognition is required . The optimum number of students shall be 40 in each section .
Students who passed in class 9th and 11th and those who failed in class 10th and 12th for the first time from the same school , shall be admitted to class 10th and 12th . The concerned institution heads would give admissions in class 10th and class 12th up to the limit of 10 percent , in cases of transfer etc. In extra ordinary circumstances , up to 20 percent admissions would be given after due permission of the concerned District Education Officer , and more than 20 percent students would be admitted after due permission of Directorate of Public Instruction .

(4) ( a) Laboratory- Each high school shall have a Composite laboratory. The higher secondary schools shall have separate laboratories for physics , chemistry and biology , with specified number of required equipment as per syllabus .
In new recognition cases , higher secondary schools should have separate provision for Mathematics laboratory in addition to Physics , Chemistry and Biology laboratory with specified number of required equipment as per syllabus . The size of each laboratory room shall not be less than 500 sq ft .
(b) Computer Laboratory- In new recognition cases , the school should have a proper computer lab having a minimum of 20 computers and area of the laboratory should be approx 400 square feet . Computer to student ratio of 1:20 shall be maintained . There should be proper internet access in this lab . In case enrolment is more than 400 then similar facilities shall be provided for every additional 400 students . The school shall follow cyber safety provisions and students should be allowed in computer labs under the supervision of teachers only . " .
(3) in sub - rule (5 ) , after clause (b) , the following clause shall be added , namely: -
"(c) In new recognition cases , the library shall be of minimum 400 square feet area , which will be fully equipped and with proper arrangement available for studying to the students . Books will be available in the library along with books as ( a) above , as per the age of the students , e - books / magazines will also be included . " मध्यप्रदेश राजपत्र, दिनांक 3 मार्च 2020

(4) for sub - rules ( 6) and ( 7) , the following sub - rules shall be substituted , namely: -
" ( 6 ) Playground and facilities In case of renewal of recognition , the school shall provide the facility of at least two sports in the school premises such as badminton / table tennis / kabaddi / kho - kho / volleyball / basketball etc.
In case of new recognition , the open area should be developed as a ground for the games , necessary arrangements shall be made at least two or more outdoor sports like Kabaddi , Kho - Kho , Volleyball , Basketball , Badminton , Cricket etc.
In addition to above , necessary facilities for minimum two indoor games shall be provided in both the new and renewal of recognition .
(7) Toilet On each floor of the school , there should be separate and clean arrangements of toilets for boys and girls . If primary / pre - secondary classes are also being run in the school , the toilet arrangements for students and staff of primary / pre - secondary classes should be separate from those to other students .
In new recognition cases , there should be adequate arrangements for ramps etc. at the entry and exit of each toilet for students with special needs . " .
(5) for sub - rule (9 ) , the following sub - rule shall be substituted , namely: -
" (9) Drinking Water Facility Proper arrangements will be made on each floor to supply pure drinking water for students and staff . "

184( 13) ( a) clause (3) shall be deleted ;
(b) after clause ( 9) , the following clauses shall be added , namely: -
" ( 10 ) Regarding the safety of students , the school shall follow the following guidelines-
1. Guidelines issued by the Hon'ble Supreme Court of India in Writ Petition (Civil) no . 483 of 2004 in the matter of Avinash Malhotra ( Petitioner) Versus Union of India & Others (Respondents) .
2. The Guidelines on School Safety Policy 2016 issued by the National Disaster Management Authority which is statutory in nature .
3. Manual on Safety and Security of Children in Schools developed by the National Commission for Protection of Child Rights .
4. National Building Code 2005 , as amended from time to time .
( 11) Any non - government high school / higher secondary school operating in the state should not have dual recognition . If any institution gets recognition from any other board , then the recognition of Madhya Pradesh government shall be automatically withdrawn . It shall be mandatory on the part of institution to inform the respective Divisional Joint Director Office and Directorate of Public Instruction Office in this regards . No other school of any other board could be operated in the same campus / building of a recognized school under this rule .

( 12) For all high / higher secondary schools operated under this act , it would be mandatory to teach the syllabus prescribed by the Madhya Pradesh Government from class 9th to 12th , as well as teaching in the school only through books printed by the Madhya Pradesh Text Book Corporation . The school would be allowed to use other supporting books as per requirement under the prescribed as specified by the government . " . curriculum ,
4. in rule 6 , -
(1) for sub - rules ( 2 ) , the following sub - rule shall be substituted , namely: -
" (2) The institution has to produce a certificate issued by such competent authority as specified by the government regarding the strength & safety of building , fire safety and health & hygiene . " .
(2) in sub - rules ( 6 ) , for clause (b) , the following clause shall be substituted , namely: -
" ( b) The class wise and subject wise list of all the teachers along with the attested copies of mark sheets of their educational qualifications like undergraduate , postgraduate , professional qualification , D.Ed./B.Ed etc. by the Principal of the school would be uploaded along with the renewal of recognition application .
In case of new recognition an affidavit has to be submitted by the principal or the management of the school that the staff would be appointed as per rules before the commencement of the session . On receiving due recognition , a list of all the staff members with मध्यप्रदेश राजपत्र, दिनांक 3 मार्च 2020
184( 15) their educational qualification certificates , would be uploaded before the commencement of the session . " .
(3 ) after sub- rules ( 11 ) , the following sub - rule shall be added , namely: -
" ( 12) The process of new recognition / renewal of recognition for the upcoming academic sessions will be started from January 01 every year and will be completed by October 31. The recognition committee will be able to reduce / extend the said period due to unavoidable reasons . " .
5. for rule 7 , the following rule shall be substituted , namely : - " 7. Time period of recognition - Initially a society trust will be given recognition for a period of five years . The schools already recognized shall be allowed to increase the recognition for five years thereafter . No society / trust will be recognized simultaneously for Class IX and X or Class XI or XII in the same academic year . But on completion of the qualification conditions , recognition for class IX or class XI or both can be given in the same year . " .
6. in rule 9 , after sub - rule (7) , the following sub - rule shall be added , namely: -
" ( 8) Service rules of teachers / staff shall be framed by the school management committee comprising the following points: - Appointment/ confirmation of teachers / staff.

2. Service conduct rules for teachers / employees .
Salary allowances of teachers / employees .
3.
Age of retirement of the teachers / staff .
4.
EPF / Pension Scheme for Teachers / Staff .

6. Teacher's / employees ' leave .
7. Maintenance of service manual for teacher / staff.
8. Disciplinary proceedings against teachers / employees and termination of service thereof . " .
7. in rule 10 , in sub - rule ( 1 ) , -
(1) in clause (a) , for the figure " 20000 / - " and " 25000 / - " , the figure " 32000 / - " and " 40000/ - " shall be substituted respectively.
(2) for the clause ( f) , the following clause shall be substituted , namely: -
"(f) The relocation. shall be treatedcase as a new shall be recognition and process fee of Rs . 20,000 / payable . This facility shall be available on the portal throughout the year to apply for relocation , but the location shall be changed from the next session . " .
(3) after clause (f) , the following clause shall be added , namely: -
"(g) The committee / society may apply for change of name of the school online by passing a unanimous resolution . Along with the application form , an affidavit of this purpose on that there is no liability the committee /school would also be submitted . A fee of Rs . 10,000/ will be payable for change of name of the school . The respective divisional joint directors would be competent officers for disposal as per rules and this facility shall be available on the portal throughout the year to change the name , but the change of name shall be effective from the next session . " .
8. In rule 11 , for sub - rule (2 ) , the following sub - rule shall be substituted , namely: - मध्यप्रदेश राजपत्र, दिनांक 3 मार्च 2020
184(17) " ( 2) In case any Show Cause Notice is issued and if the divisional joint Director is not satisfied with the reply received from the society / trust , then after giving and opportunity of hearing to the concerned , Joint Director would impose a penalty of one lakh rupees maximum. " 9. in rule 12 , the Para shall be numbered as sub - rule ( 1 ) and after so numbered sub - rule ( 1 ) , the following sub - rule shall be added , namely: -
" ( 2) The recognition committee would be competent to reduce / increase the time limit prescribed for the disposal of first appeal / second appeal due to unavoidable reasons . " .
10. Rule 12 (A) shall be deleted .
