एफ 4-3/2020/29-1 , आवश्यक वस्तु अधिनियम , 1955 ( 1955 का सं. 10) की धारा 3 और धारा 5 के साथ पठित एस.ओ. 681 (ई) दिनांक 30.11.1974 तथा भारत सरकार के उपभोक्ता मामले, खाद्य और सार्वजनिक वितरण मंत्रालय (उपभोक्ता मामले विभाग ) की अधिसूचना जो का.आ. 1087 (अ) दिनांक 13.03.2020 के अनुसरण में प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार , एतद् द्वारा , निम्नलिखित आदेश करती है , अर्थात्: -
आदेश
1. संक्षिप्त नाम , विस्तार तथा प्रारम्भः-
(1) इस आदेश का संक्षिप्त नाम " मध्यप्रदेश मास्क (2 प्लाई एवं 3 प्लाई सर्जिकल मास्क, एन 95 मास्क) और हैण्ड सैनिटाइजर नियंत्रण आदेश , 2020" है ।
(2) इसका विस्तार सम्पूर्ण मध्यप्रदेश पर है।

(3) यह आदेश मध्यप्रदेश राजपत्र में प्रकाशन की तारीख से प्रवृत्त होगा तथा दिनांक 30 जून , 2020 तक अथवा भारत सरकार द्वारा इस संबंध में अधिसूचित दिनांक तक प्रभावी होगा।
2. परिभाषाएं:-
इस आदेश में , जब तक सन्दर्भ से अन्यथा अपेक्षित न हो -
(क) "परिशिष्ट" से अभिप्रेत है , इस आदेश से संलग्न परिशिष्ट;
(ख ) "व्यापारी " से अभिप्रेत है, मास्क (2 प्लाई एवं 3 प्लाई सर्जिकल मास्क, एन 95 मास्क) और हैण्ड सैनिटाइजर के क्रय- विक्रय के कारोबार में संलग्न कोई भी व्यक्ति, संस्था, फर्म अथवा कंपनी जो उक्त आवश्यक वस्तुओं का थोक अथवा फुटकर विक्रेता के रूप में संव्यवहार करता है।
3. स्टॉक एवं कीमत का प्रदर्शनः-
व्यापारी द्वारा अपने कारोबार स्थल पर मास्क (2) प्लाई एवं 3 प्लाई सर्जिकल मास्क, एन 95 मास्क) और हैण्ड सैनिटाइजर के उपलब्ध स्टॉक एवं उसकी निर्धारित कीमत का पटल पर प्रतिदिन प्रदर्शन किया जाएगा ।
4. व्यापारी कंडिका ( 3 ) में उल्लेखित आवश्यक वस्तु को किसी भी ग्राहक को बेचने से इंकार नहीं करेगा।
5. व्यापारी मुनाफाखोरी के उद्देश्य से ऐसा कोई कृत्य नहीं करेगा , जिससे कंडिका (3 ) में उल्लेखित आवश्यक वस्तुओं का बाजार में कृत्रिम अभाव उत्पन्न हो ।
6. व्यापारी कंडिका (3 ) में उल्लेखित आवश्यक वस्तुओं के क्रय एवं विक्रय की विवरणी पाक्षिक रूप से परिशिष्ट 1 में जिला स्थित खाद्य, एवं औषधि प्रशासन के कार्यालय में प्रस्तुत करेगा । प्रत्येक व्यापारी द्वारा विहित माह की 15 तारीख को समाप्त होने वाले पक्ष की जानकारी उसी माह की 20 तारीख तक तथा मास के अंत में , समाप्त होने वाले पक्ष की आगामी माह की 5 तारीख तक भेजना सुनिश्चित करेगा । 246(1)

7. तलाशी तथा अभिग्रहण :-
( 1 ) राज्य सरकार के स्वास्थ्य एवं परिवार कल्याण विभाग का औषधि निरीक्षक से अनिम्न स्तर का कोई अधिकारी , तथा खाद्य, नागरिक आपूर्ति एवं उपभोक्ता संरक्षण विभाग का नापतौल निरीक्षक से अनिम्न स्तर का अधिकारी अपने पदस्थापना जिले/विहित क्षेत्राधिकार के अंतर्गत ऐसी सहायता, यदि कोई हो , जैसी कि वह उचित समझे के साथ-
(क) किसी स्थान , परिसर , वाहन जिसके संबंध में उसे यह विश्वास करने का कारण हो कि इस आदेश अथवा उसके उपबंधों का उल्लंघन हुआ है, किया जा रहा है या किया जाने वाला है , स्वामी , अधिभोगी अथवा अन्य किसी भारसाधक व्यक्ति से, ऐसे उल्लंघन से संबंधित संव्यवहारों को दर्शाने वाली पुस्तकें, लेखे या अन्य अभिलेखों को प्रस्तुत करने की अपेक्षा कर सकेगा। (ख) ऐसे स्थान , परिसर , वाहन में जिसके संबंध में उसे यह विश्वास करने का कारण हो कि इस आदेश के किन्हीं उपबन्धों का उल्लंघन हुआ है , किया जा रहा है या किया जाने वाला है , प्रवेश कर सकेगा, उसका निरीक्षण कर सकेगा या उसे खोल सकेगा तथा उसकी तलाशी ले सकेगा ।
( ग) ऐसे उल्लंघनों से संबंधित संव्यवहारों को दर्शाने वाले रजिस्टर , बिल बुक या किसी दस्तावेजों का अभिग्रहण कर सकेगा या अभिग्रहित करवा सकेगा। (घ ) कंडिका (3 ) में उल्लेखित वस्तुओं के स्टॉक को तथा इस आदेश के उपबन्धों के उल्लंघन में उक्त वस्तुओं को ले जाने के लिए उपयोग में लाए जा रहे वाहनों की तलाशी ले सकेगा , उनका अभिग्रहण कर सकेगा और उन्हें हटा सकेगा और तत्पश्चात् ऐसे समस्त उपाय करेगा या करने के लिए प्राधिकृत कर सकेगा जो इस प्रकार अभिग्रहण किए गए आवश्यक वस्तु के स्टॉक तथा वाहनों का सक्षम न्यायालय के समक्ष पेश किया जाना सुनिश्चित करने के लिए तथा इस प्रकार पेश किए जाने तक उसकी सुरक्षित अभिरक्षा के लिए आवश्यक हों ।
(2) दण्ड प्रक्रिया संहिता, 1973 ( 1974 का सं 2) के उपबन्ध जो तलाशी तथा अभिग्रहण से संबंधित हैं यथासंभव इस खण्ड के अधीन तलाशियों तथा अभिग्रहण को लागू होंगे । मध्यप्रदेश राजपत्र, दिनांक 20 मार्च 2020

8. छूट: -
राज्य सरकार , साधारण या विशेष आदेश द्वारा व्यक्तियों के किसी वर्ग को इस आदेश के समस्त या किन्हीं भी उपबन्धों से छूट दे सकेगी और किसी भी समय ऐसी छूट को निलंबित या निरस्त कर सकेगी।

Bhopal , the 20th March 2020 In exercise' of the powers conferred under Section 3 and 5 of Essential Commodities Act , 1955 (No. 10 of 1955) read with S.O. 681 ( E) dated 30-11-1974 (No. 10 of 1955) and in pursuance to notification of Central Government published under Ministry of Consumer Affairs ( Department of Consumer Affairs ) S.O. 1087 (A) dated 13-03-2020 the State Government , hereby , makes the following order , namely: -
1. Title , extent and commencement.-
(1) This order may be called the Madhya Pradesh mask (2 ply and 3 ply surgical mask, N 95 mask) and hand sanitizer, control Order, 2020 .
(2) It extends to the whole of Madhya Pradesh .
(3) It shall come into force from the date of its publication in the Madhya Pradesh Gazette and shall remain in force upto 30th June , 2020 or upto the date as notified by the Government of India in this regard .
2. Definitions.- In this order, unless the context otherwise requires , -
(a) " Appendix " means Appendix appended to this order .
( a) " Trader" means such a person , society , firm or company that is engaged in the business of sale and purchase of mask (2ply and 3ply surgical mask , N - 95 mask) and hand sanitizer as a wholesaler or retailer .
3. Display of stock and price.-
The trader shall display information of available stock and the sale price of mask (2ply and 3ply surgical mask , N95 mask) and hand sanitizer on a board fix at a conspicuous place in its transaction premise daily .
4. The trader shall not refuse to sale the essential commodities mentioned in clause 3 to any consumer .

5. The trader shall not commit any act for the purpose of profiteering which creates an artificial shortage of the said essential commodity mentioned in clause 3 in the market .
6. The trader shall submit the details of sale and purchase of the said commodity in annexure - 1 mentioned in clause 3 before the office of Food and Drug Administration fortnightly . Every trader shall submit the information on 20th of every month for the fortnight ending on 15th of the said month and on 5th of every month for the fortnight ending on last of the previous month .
7. Search and Seizure.-
(1)Any officer not below the rank of drug inspector of the department of Health and Family Welfare and Inspector of Weights and Measure , Department of the Food , Civil Supplies and Consumer Protection within the district /jurisdiction with such assistance , if any, as he thinks fit, -
(a) may expect to produce the books , accounts and other documents from the owner or any other person in charge thereof, about the violation of the related transactions , if he has reason to believe that this order or the provisions of this order have been violated , are being violated are about to be violated in respect of place , premise or conveyance .
(b) may enter , inspect , open or search such place , premise or conveyance in respect of which he has reason to believe that this order or the provisions of this order have been violated , is being violated or to be violated in respect of a place , premise or conveyance by the owner thereof.
(c) may seize the register , bill book or any other documents are cause to be seized .
(d) may search the stock as well as the vehicle used for carrying the commodity mentioned in clause 3 and seize it or remove it and shall do such other proceedings or authorize someone for this which is necessary to ensure the production of the seized stock मध्यप्रदेश राजपत्र, दिनांक 20 मार्च 2020
246(5) and vehicles of essential commodities before the competent court and for secured custody of the same until its production before the court .
(2) The provisions of the Civil Procedure Court , 1973 (No. 2 of 1974) related to search and seizure shall be applicable , as far as possible , in this order.
8. Exemption.-
The State Government may exempt any person or a section of persons , by a general or special order , from all or any of this provision of this order and at, any point of time , may suspend or revoke the such exemption .
