अधिसूचना
से. 318/ रा.स. - मल्टी/2020: यतः आयोग ने दिनांक 06 मार्च, 2020 की अपनी अधिसूचना से. 318 /रा.स. -मल्टी/2020( 1 ) के जरिए 17 राज्यों से 55 स्थानों के लिए राज्य सभा के विवार्षिक निर्वाचन के लिए कार्यक्रम अधिसूचित किया है;
यतः , उक्त अधिसूचना के जरिए मतदान की सारीया 26.03.2020 (गुरुवार) नियत की गई है और वह तारीख जिसके पहले निर्वाचन सम्पन्न हो जाएगा, 30.03.2020 (सोगवार) रखी गई है;
यतः , संबंधित्त रिटर्निंग अधिकारियों से प्राप्त रिपोटी के अनुसार आंध्र प्रदेश, गुजरात, झारखंड , मध्य प्रदेश, मणिपुर, मेघालय और राजस्थान राज्यों में उक्त द्विवार्षिक निर्वाचनों के लिए मतदान 26.03.2020 को आयोजित किया जाना अपेक्षित है;
यतः , गीजूदा सार्वजनिक स्वास्थ्य की अप्रत्याशित आपात स्थिति की समीक्षा करनेपर तथा भारत सरकार के विभिन्न राज्यों में COVID - 19 के प्रबंधन और नियंत्रण के बारे में जारी निर्देशों के दुष्टिगत , आयोग ने दिनांक 24.03.2020 के अपने आदेश सं. 318/रा.स.-मल्टी/2020- द्विवार्षिक के रिए लांक प्रतिनिधित्व अधिनियम , 1951 की धारा 153 के उपबंधों के अंतर्गत पूर्वोक्त 7 राज्यों के संबंध में उक्त द्विवार्षिक निर्वाचन को पूरा करने की अवधि, उसमें उल्लिखित कारणों के लिए, चढ़ाने का निर्णय लियाहै;
अतः , अब उपर्युक्त को ध्यान में रखते हुए और लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 153 के अंतर्गत निहित शक्तियों का प्रयोग करते हुए निर्वाचन आयोग दिनांक 06 मार्च, 2020 की अपनी अधिसूचना सं. 318 /रा.स. -मल्टी/2020 ( 1 ) में एतद्वारा इस सीमा तक संशोधन करता है कि मतदान, मतगणना की तिथि और वह तिथि, जिसके पहले निर्वाचन संपन्न हो जाएंगे, उसकी चांषणा परिस्थिति की आगे समीक्षा किए जाने के उपरांत यथासमय की जाएगा। संबंधित रिटर्निंग अधिकारियों द्वारा उक्त निर्वाचनों केलिए पहले से प्रकाशित निर्वाचन लड़ने वाले अभ्यर्थियों की सूची, उक्त अधिसूचनाओं केअंतर्गतयथा- विहित शेष कार्यकलापों के प्रयोजनार्थ , वैध रहेगी।

NOTIFICATION
NOTIFICATION
No. 318 /CS - MULTI / 2020 ; - WHEREAS, the Commission , vide its Notification No. 318 /CS - MULTI /2020 ( 1 ) , dated 06th March , 2020, has notified the schedule for the biennial election to the Council of States for 55 seats from 17 states ;
Whereas , vide said notification , the date of poll is fixed as 26.03.2020 (Thursday) and the date before which election shall be completed is kept as 30.03.2020 (Monday);
Whereas, as per the reports received from the concerned Returning Officers , in the States of Andhra Pradesh , Gujarat , Jharkhand , Madhya Pradesh, Manipur , Meghalaya and Rajasthan , poli is required to be held on 26.03.2020 for the said biennial elections;
Whereas , on review of the prevailing unforeseen situation of public health emergency and the Government of India instructions for management and containment of COVID - 19 in various States of the Country , the Commission has , vide its Order No. 318/CS - MULTI / 2020 - BIEN dated 21.03.2020 , decided to extend the period for completion of said biennial election w.r.t. aforesaid 7 states under the provisions of section 153 of the Representation of the People Act , 1951 for the reasons mentioned therein;
Now, therefore , in view of the above and in exercise of the powers vested under section 153 of the Representation of the People Act, 1951, the Election Commission hereby makes amendment in its notification No. 318/CS- MULTI /2020 ( 1 ) , dated 06thMarch , 2020 to the extent that the date (s ) for taking poll , counting of votes and date before which election shall be completed shall be announced in due course after reviewing the situation further. The list of contesting candidates, already published for the said elections by the respective Returning Officers shall remain valid for the purposes of remaining activities , as prescribed under the said notifications .
