संविदा श्रमिक (विनियमन तथा समाप्ति) मध्यप्रदेश नियम, 1973 में संशोधन का प्रारूप संविदा श्रमिक (विनियमन एवं समाप्ति) अधिनियम, 1970 (क्रमांक 37 सन् 1970) की धारा 35 की उप-धारा (1 ) द्वारा अपेक्षित किए गए अनुसार उन समस्त व्यक्तियों की, जिनके कि उससे प्रभावित होने की संभावना है, जानकारी के लिए मध्यप्रदेश राजपत्र, भाग 4' (दो) में दिनांक 23 अगस्त 2019 में प्रकाशित किया गया था ।
और चूंकि उक्त प्रस्ताव के संबंध में कोई आपत्तियां/ सुझाव प्राप्त नहीं हुए हैं । अतएव, राज्य शासन संविदा श्रमिक (विनियमन एवं समाप्ति) अधिनियम, 1970 (क्रमांक 37 सन् 1970) की धारा की उप धारा (1 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , संविदा श्रमिक (विनियमन तथा समाप्ति) मध्यप्रदेश नियम, 1973 के नियम 21 के उप नियम (1 ) एवं उप नियम (3 ), नियम 26 के उप नियम (2) एवं नियम 27 में निम्नानुसार संशोधित करता है जो इस अधिसूचना के मध्यप्रदेश राजपत्र में प्रकाशित होने के दिनांक से प्रभावशील होगा ।

संशोधन
उक्त नियमों में,-
1. नियम 21 में,-
(1) उप-नियम (1 ) में, शब्द "प्रारूप क्रमांक चार में तीन प्रतियों में " , के स्थान पर, शब्द " मध्यप्रदेश शासन श्रम विभाग , के अधिकारिक वेब पोर्टल पर उपलब्ध ऑनलाईन प्रारूप में" स्थापित किया जाता है ।
(2) उप-नियम (3) का लोप किया जाता है ।
2. नियम 26 में, उप - नियम (2) में, शब्द "फीस " के स्थान पर , शब्द "एक कलैंडर वर्ष के लिए फीस " स्थापित किये जाते है ।
3. नियम 27 के स्थान पर, निम्नलिखित नियम स्थापित किये जाते है, अर्थात्ः-
"27. अनुज्ञप्ति की विधिमान्यता, नियम 25 के अधीन प्रदत्त या नियम 29 के अधीन नवीनीकृत अनुज्ञप्ति, ठेके की उस अवधि के लिए विधि मान्य होगी , जिसके लिए आवेदन किया गया है ।" ।

Bhopal , the 5th May 2020 In exercise of the powers conferred by sub - section ( 1) of section 35 of the Contract Labour ( Regulation and Abolition) Act, 1970 (37 of 1970) , the State Government , as proposed to make amendment in the Contract Labour (Regulation and Abolition) Madhya Pradesh Rules , 1973 published in the Madhya Pradesh Gazette , Part 4 (II) dated 23rd August, 2019 as required by sub - section of section _ of the said Act for the information of all persons likely to be affected there .
And that no comments have been received .
Now, therefore , the State Government, in exercise of the powers conferred by sub- section ( 1 ) of section 35 of the said Act , amend the rules 21 (1 ) (2 ) , 26 (2) and 27 of the Contract Labour ( Regulation and Abolition ) Madhya Pradesh Rules , 1973 as follows , which shall come into for ce from the date of their publication in the Madhya Pradesh Gazette .
AMENDMENT
In the said rules , -
1. In rule 21 , -
(1) In sub - rule ( 1 ) , for the words " in triplicate in Form No. IV" , the words "in the online from available on official portal of the Labour Department , Government of Madhya Pradesh " shall be substituted .
(2) sub - rule (3) shall be omitted .
2. In rule 26 , in sub - rule (2) , for the words " the fees " , the words " the fees for one calendar year" shall be substituted .
3. For rule 27 , the following rule shall be substituted , namely : -
" 27. Validity of the Licence.- Licence granted under rule 25 of renewed under rule 29 shall be valid for the period of the contract for which the application is made ." .

इस विभाग की अधिसूचना क्र एफ -4 (ई) 1-2016-ए-सोलह, दिनांक 28 मार्च , 2017 (मध्यप्रदेश राजपत्र , में प्रकाशित दिनांक 21 अप्रैल , 2017) को अधिक्रमित करते हुए राज्य शासन, एतदद्वारा कारखाना अधिनियम, 1948 ( 1948 का 63) की धारा 8 की उपधारा ( 1 ) एवं धारा 112 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, औद्योगिक नीति एवं संवर्धन, वाणिज्य एवं उद्योग मंत्रालय , भारत सरकार के द्वारा निरूपित व्यवसाय सुधार कार्य योजना , 2016 के अधीन गैर खतरनाक श्रेणी के 50 श्रमिकों तक नियोजित करने वाले कारखानों के लिये अन्य पक्ष प्रमाणन को मान्यता प्रदान करने हेतु अधिसूचित करता है.
ऐसे कारखाने यदि श्रम आयुक्त, मध्यप्रदेश के द्वारा इस हेतु अधिकृत अन्य पक्ष (Third Party) के कारखाना अधिनियम, 1948 के अनुपालन का प्रमाणीकरण कराकर प्रत्येक वर्ष 31 जनवरी तक अपने क्षेत्राधिकार के निरीक्षक के समक्ष प्रस्तुत करते हैं तो उन्हें दैनन्दिन निरीक्षण की प्रक्रिया से छूट मिल जायेगी परन्तु ऐसे कारखानों का निरीक्षण केवल गंभीर/ प्राणान्तक दुर्घटना या शिकायत की सूचना के आधार पर श्रमायुक्त की अनुमति प्राप्त कर किया जा सकेगा । जो कारखाने प्रत्येक वर्ष निर्धारित समय -सीमा 31 जनवरी तक अपनी विहित प्रमाणीकरण प्रतिवेदन प्रस्तुत नहीं करेंगे वे ऐसी छूट का लाभ लेने से वंचित रह जायेंगे.

レ In supersession of this department's Notification No. F -4 ( E ) -1-2016 - A- XV dated 28th March, 2017 ( published in the Madhya Pradesh Gazette dated 21st April 2017) ; and in exercise of the powers conferred by sub- section ( 1 ) of Section 8 and Section 112 of the Factories Act, 1948 ( No. 63 of 1948) , the State Government, hereby, notify to recognize the Third Party Certification for nonhazardous category factories employing upto 50 Workers as per the Business Reform Action Plan , 2016 under the Industrial Policy and Promotion , Ministry of Commerce and Industries, Government of India .
Such factories which submits the certification report carried out by a Third Party authorised by the Labour Commissioner, Madhya Pradesh regarding compliances of Factories Act, 1948 ( No. 63 of 1948) to the Inspector having jurisdiction , before 31st January of every year, shall be exempted from routine inspection process , Provided , inspection of such factories shall only be carried out with the prior permission of Labour Commissioner , Madhya Pradesh in case of Serious/ Fatal Accident or complaint information received thereto. The factories those fail to submit their compliance certification report before the prescribed deadline of 31st January of every year shall not be entitled for such exemption .

भोपाल, दिनांक 5 मई 2020 इस विभाग की अधिसूचना क्र एफ-4 (ई) 1-2016-ए-सोलह, दिनांक 14 जून, 2016 (मध्यप्रदेश राजपत्र में प्रकाशित दिनांक 9 सितंबर, 2016) को अधिक्रमित करते हुए तथा कारखाना अधिनियम, 1948 (1948 का 63) की धारा 8 की उपधारा (1 ) एवं धारा 112 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार एतदद्वारा मध्यप्रदेश कारखाना नियमावली, 1962 के निम्नलिखित संशोधित नियम 18 (ख) को प्रतिस्थापित करती है, जो कि इस अधिसूचना के मध्यप्रदेश राजपत्र में प्रकाशित होने की दिनांक से प्रभावशील होगा।

Bhopal , the 5th May 2020 In supersession of this department's Notification No. -4 (E)-1-2016- A- XVI dated 14th June , 2016 ( published in Madhya Pradesh Gazette dated 9th September , 2016) and in exercise of powers conferred by sub- section (1 ) of Section 8 and Section 112 of the Factories Act , 1948 (63 of 1948) , the State Government, hereby, establishes the following amended Rule 18 ( B) of the Madhya Pradesh Factories Rules , 1962, which will be effective from the date of publication of this notification in the Madhya Pradesh Gazette.

"18-B . Notwithstanding anything contrary contained in these rules, any person or agency , which is so authorized by the Labour Commissioner, Madhya Pradesh shall be authorised to conduct inspection subject to such restrictions as may be specified . "

भोपाल , दिनांक 5 मई 2020 औद्योगिक विवाद अधिनियम , 1947 (1947 का 14 ) की धारा 36- ख द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , राज्य सरकार, एतदद्वारा राज्य के उन उद्योगों को इस अधिनियम के अध्याय- पाँच-ए तथा अध्याय पाँच- बी के अंतर्गत धारा 25- एन, 25-ओ, 25-पी, 25-क्यु एवम 25-आर के प्रावधानों को छोडकर शेष सभी प्रावधानों से, इस अधिसूचना के मध्यप्रदेश राजपत्र में प्रकाशित होने के दिनांक से आगामी 1000 दिवस तक, इस शर्त के साथ छूट प्रदान करती है कि इन उद्योगों द्वारा नियोजित कामगारों के औद्योगिक विवादों की छानबीन तथा निराकरण हेतु समुचित व्यवस्था की जायेगी । यह अधिसूचना उन नये उद्योगों पर लागू होगी जो इस अधिसूचना के प्रकाशित होने के पश्चात् आगामी 1000 दिनों में प्रथम बार कारखाना अधिनियम, 1948 में पंजीकृत होंगे तथा उत्पादन चालू करेगें ।

Bhopal , the 5th May 2020 In exercise of the powers conferred by Section 36 - B of the Industrial Disputes Act , 1947 ( 14 of 1947 ) , the State Government , hereby, exempts such industries of the state from the provisions of this Act , except the provisions of Chapter V-A and Section 25- N , 25-0 , 25- P, 25 - Q and 25 - R of chapter V- B for next 1000 days from the date of publication of this notification in the Madhya Pradesh Gazette subject to condition that adequate provisions are made by such industries for the investigation and settlement of industrial disputes of the workmen employed by them . This notification shall be applicable to those new industries which will be registered in the factories act , 1948 and start production for the first time in the next 1000 days after the publication of this notification
