क्रमांक एफ- 35-69-2013 - दो- सी-2ः भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए तथा इस विभाग की अधिसूचना क्रं. एफ- 35-69-2013 - दो- सी-2 दिनांक 24 नवम्बर 2014 , को अतिष्ठित करते हुए , मध्यप्रदेश के राज्यपाल एतद्वारा , मध्यप्रदेश राज्य आपदा प्रबंधन प्राधिकरण के अधिकारियों और कर्मचारियों की भरती तथा सेवा की शर्तों को विनियमित करने हेतु निम्नलिखित नियम बनाते हैं, अर्थात्:-

भाग-एक

प्रारंभिक

1. संक्षिप्त नाम तथा प्रारंभ.-

(1 ) इन नियमों का संक्षिप्त नाम मध्यप्रदेश राज्य आपदा प्रबंधन प्राधिकरण (भरती तथा सेवा की शर्ते) नियम, 2020 है ।

(2) ये मध्यप्रदेश राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. परिभाषाएं. इन नियमों में, जब तक कि संदर्भ में अन्यथा अपेक्षित न हो,-

(क) " नियुक्ति प्राधिकारी " से अभिप्रेत है, प्राधिकरण का समन्वयक / संचालक ;

(ख ) " प्राधिकरण " से अभिप्रेत है आपदा प्रबंधन अधिनियम, 2005 की धारा 14 की उप - धारा (1 ) के अधीन स्थापित मध्यप्रदेश राज्य आपदा प्रबंधन प्राधिकरण (एम पी एस डी एम ए) ;

(ग) राज्य का मुख्यमंत्री, आपदा प्रबंधन अधिनियम, 2005 की धारा 14 की उप- धारा (2) के अनुसार प्राधिकरण का पदेन 'अध्यक्ष ' होगा ;

(घ) " सक्षम प्राधिकारी " से अभिप्रेत है, प्राधिकरण का अध्यक्ष ;

(ड. ) " समन्वयक / संचालक " से अभिप्रेत है, प्राधिकरण का समन्वयक / संचालक ;

(च) " सरकार " से अभिप्रेत है, मध्यप्रदेश सरकार ;

(छ) "राज्यपाल " से अभिप्रेत है, मध्यप्रदेश के राज्यपाल;

(ज) "सदस्य सलाहकार " से अभिप्रेत है, प्राधिकरण का पूर्णकालिक सलाहकार जो मध्यप्रदेश राजपत्र क्र. 35-82-2016 - दो- सी-2 दिनांक 28 जुलाई 2018 की धारा 2 (ख ) के अनुसार प्राधिकरण के सदस्यों में से एक सदस्य होगा । मध्यप्रदेश राजपत्र , दिनांक 14 मई 2020

338 ( 1) (झ) "अन्य पिछड़े वर्ग" से अभिप्रेत है, केन्द्र सरकार द्वारा समय- समय पर यथा संशोधित अधिसूचना क्र. एफ-8-5- पच्चीस-4-84, दिनांक 26-12-1984 द्वारा यथाविनिर्दिष्ट नागरिकों के अन्य पिछड़े वर्ग;

(ज) "अनुसूचित जातियों" से अभिप्रेत है, कोई जाति, मूलवंश या जनजाति या किसी जाति, मूलवंश या जनजाति का भाग या उसमें का यूथ जो भारत के संविधान के अनुच्छेद 341 के अधीन मध्यप्रदेश राज्य के संबंध में अनुसूचित जातियों के रूप में विनिर्दिष्ट किया गया हो;

(झ) "अनुसूचित जनजातियों" से अभिप्रेत है, कोई जनजाति या जनजाति समुदाय अथवा ऐसी जनजाति या जनजाति समुदाय का भाग या उसमें का यूथ जो भारत के संविधान के अनुच्छेद 342 के अधीन मध्यप्रदेश राज्य के संबंध में अनुसूचित जनजातियों के रूप में विनिर्दिष्ट किया गया हो;

(ञ) "सेवा" से अभिप्रेत है , मध्यप्रदेश राज्य आपदा प्रबंधन प्राधिकरण सेवा;

(ट) "राज्य" से अभिप्रेत है , मध्यप्रदेश राज्य;

(ठ) "राज्य कार्यपालिक समिति" से अभिप्रेत है, आपदा प्रबंधन अधिनियम, 2005 की धारा 20 की उप-धारा (1 ) के अधीन गठित प्राधिकरण की कार्यपालिक समिति ।

3. लागू होना.- मध्यप्रदेश सिविल सेवा (सेवा की सामान्य शर्तें) नियम, 1961 में अन्तर्विष्ट उपबंधों की व्यापकता पर प्रतिकूल प्रभाव डाले बिना, ये नियम प्राधिकरण के प्रत्येक सदस्य को लागू होंगे ।

4. प्राधिकरण की सेवा का गठन.- प्राधिकरण की सेवा निम्नलिखित व्यक्तियों से मिलकर बनेगी, अर्थात्:-

(क) ऐसे व्यक्ति, जो इन नियमों के प्रारंभ होने के समय अनुसूची- एक में विनिर्दिष्ट पद मूल रूप से या स्थानापन्न रूप में धारण कर रहे हों;

(ख) ऐसे व्यक्ति , जो इन नियमों के प्रारंभ होने के पूर्व, प्राधिकरण में भरती किए गए हों; और (ग ) ऐसे व्यक्ति, जो इन नियमों के उपबंधों के अनुसार प्राधिकरण में भरती किए गए हों । 5. पदों की संख्या, वर्गीकरण एवं वेतनमान आदि. वर्गीकरण, वेतनमान तथा प्राधिकरण में सम्मिलित पदों की संख्या अनुसूची- एक के अनुसार होगी ।

भाग-दो भर्ती

6. भर्ती का तरीका.-

(1) सामान्य शर्तें इन नियमों के प्रारंभ होने के पश्चात्, प्राधिकरण में नियुक्ति के लिए अभ्यर्थियों को निम्नलिखित तरीकों में से किसी एक से चयनित किया जाएगा:-

(क) प्रतिनियुक्ति पर ( मध्यप्रदेश पुलिस , सीमा सुरक्षा बल, संचालनालय नगर सेना एवं नागरिक सुरक्षा, मध्यप्रदेश , केन्द्रीय औद्योगिक सुरक्षा प्राधिकरण , राष्ट्रीय आपदा मोचन प्राधिकरण , राष्ट्रीय आपदा प्रबंधन प्राधिकरण , सेना या राज्य अथवा केन्द्र सरकार के किसी अन्य विभाग में नियुक्त अधिकारियों / कर्मचारियों के स्थानांतरण द्वारा, जो आपदा प्रबंधन मे कुशल हो) मध्यप्रदेश राजपत्र , दिनांक 14 मई 2020

मध्यप्रदेश शासन , सामान्य प्रशासन विभाग क्रमांक सी/ 3-14 / 06 / 3 / 1 दिनांक 29 फरवरी, 2008 के अधीन जारी प्रतिनियुक्ति दिशानिर्देश; और

(ख) मध्यप्रदेश राजपत्र दिनांक 28 सितंबर, 2017 में सामान्य प्रशासन विभाग द्वारा मध्यप्रदेश सिविल पदों पर संविदा नियुक्ति नियम , 2017 के अधीन संविदा नियुक्ति जैसा कि प्रकाशित की गई है ।

(2) भरती किए गए व्यक्तियों की संख्या, कभी भी अनुसूची- एक में उल्लिखित पदों की संख्या से अधिक नहीं होगी ।

(3) भरती, अनुसूची-दो में यथा विनिर्दिष्ट तरीके के अनुसार की जाएगी ।

(4) (एक) अनुसूची दो के अनुक्रमांक 2, 3 एवं 4 के सामने उल्लिखित पदों के लिए भरती , निम्नलिखित से मिलकर बनने वाली चयन समिति की सिफारिशों पर सक्षम प्राधिकारी के अनुमोदन से की जाएगी:

: अध्यक्ष (क) सदस्य सलाहकार, मध्यप्रदेश राज्य आपदा प्रबंधन प्राधिकरण

(या अपर मुख्य सचिव/ प्रमुख सचिव, गृह उनकी अनुपलब्धता की दशा में )

: सदस्य (ख) समन्वयक/ संचालक, मध्यप्रदेश राज्य आपदा प्रबंधन प्राधिकरण

: सदस्य (ग) उप सचिव (गृह) या समकक्ष श्रेणी का कोई अधिकारी

(दो) अनुसूची- दो के अनुक्रमांक 5,6,7,8,9 , एवं 10 के सामने उल्लिखित पदों के लिए भरती निम्नलिखित से मिलकर बनने वाली चयन समिति की सिफारिशों पर सक्षम प्राधिकारी के अनुमोदन से की जाएगी :

(क) उप सचिव (गृह) या समकक्ष श्रेणी का कोई अधिकारी : अध्यक्ष (ख) उप संचालक, मध्यप्रदेश राज्य आपदा प्रबंधन प्राधिकरण : सदस्य (ग) संहायक संचालक, मध्यप्रदेश राज्य आपदा प्रबंधन प्राधिकरण : सदस्य टीप 1: चयन समिति , अभ्यर्थियों के साथ व्यक्तिगत साक्षात्कार (या कौशल परीक्षण ) के आधार पर अभ्यर्थियों की शैक्षणिक अर्हताओं तथा अनुभव, उनके सेवा अभिलेख के साथ- साथ साक्षात्कार (या कौशल परीक्षण ) में उनके प्रदर्शन को समिति द्वारा यथा निर्धारित समुचित महत्व देते हुए , उनकी सिफारिशें करेगी ।

टीप 2: जब प्राप्त आवेदनों की संख्या अधिक हो, तो चयन समिति, समिति द्वारा विनिश्चित किए जाने वाले मापदंड के आधार पर साक्षात्कार के लिए बुलाए जाने वाले अभ्यर्थियों को शार्टलिस्ट करने का अधिकार आरक्षित रखती है ।

(5) प्रतिनियुक्ति/ संविदा आधार पर भरती किए जाने वाले कर्मचारियों की अर्हताएं ऐसी होंगी जैसी कि संबंधित पदों के लिए अनुसूची - तीन में उल्लिखित है ।

(6) दो बार विज्ञापन निकाले जाने के पश्चात् भी प्रतिनियुक्ति पदों के विरूद्ध उपयुक्त अभ्यर्थियों की अनुपलब्धता की दशा में, उक्त पद संविदा आधार पर भरे जा सकेंगे , यदि ये पद दो वर्ष या अधिक अवधि के लिए रिक्त बने रहे हैं ।

7. आरक्षण.-

(1) दिव्यांग व्यक्तियों का आरक्षण , मध्यप्रदेश राज्य शासन द्वारा समय- समय पर जारी नियमों के अनुसार होगा । 338 (3)

(2) अनुसूचित जातियों, अनुसूचित जनजातियों तथा अन्य पिछड़े वर्गों के लिए आरक्षण, मध्यप्रदेश लोक सेवा (अनुसूचित जातियों, अनुसूचित जनजातियों तथा अन्य पिछड़े वर्गों के लिए आरक्षण) अधिनियम, 1994 (क्रमांक 21 सन् 1994) के उपबंधो के अनुसार होगा ।

8. नियुक्ति तथा हटाया जाना. प्राधिकरण में अधिकारियों / कर्मचारियों को सक्षम प्राधिकारी के अनुमोदन से मध्यप्रदेश राज्य आपदा प्रबंधन प्राधिकरण के समन्वयक / संचालक द्वारा नियुक्त किया जाएगा और सेवाएं समाप्त और प्रत्यावर्तित की जा सकेंगी ।

9. संविदा नियुक्ति हेतु पात्रता की शर्ते. इन नियमों के प्रारंभ होने के पश्चात् सेवा में समस्त संविदा नियुक्तियां, मध्यप्रदेश सिविल पदों पर संविदा नियुक्ति नियम , 2017 के अनुसार की जाएंगी ।

संविदा नियुक्ति पर चयन हेतु पात्र होने के लिए अभ्यर्थियों द्वारा निम्नलिखित शर्तें पूरी की जाएंगी-

(1) प्राधिकरण में संविदा आधार पर कर्मचारी, अनुसूची-दो के कॉलम (7) में विनिर्दिष्ट किए गए अनुसार नियुक्त किए जाएंगे ।

(2) संविदा पर इस प्रकार नियुक्त किए गए व्यक्ति के पास अनुसूची- तीन में विनिर्दिष्ट पदों के लिए न्यूनतम अर्हता होनी चाहिए ।

10. नियुक्ति/ प्रतिनियुक्ति पर भर्ती.-

(1 ) अधिकारी / कर्मचारी के मूल विभाग की सहमति प्राप्त करने के पश्चात्, विभिन्न पदों पर प्रतिनियुक्ति के माध्यम से भर्ती की जाएगी ।

अभ्यर्थी को अनुसूची- तीन में यथा विनिर्दिष्टि अपेक्षित अर्हताएं धारण करनी चाहिए । (2)

(3) संबंधित अधिकारी / कर्मचारी प्रतिनियुक्ति पर वही वेतन तथा भत्ते प्राप्त करेगा, जो कि वह अपने मूल विभाग में प्राप्त कर रहा था ।

(4) मध्यप्रदेश शासन के नियमानुसार, प्रतिनियुक्ति अवधि 4 वर्ष की होगी । यदि इससे अधिक अवधि के लिए अधिकारी को रखा जाना आवश्यक है, तो वह विभाग जिसमें अधिकारी प्रतिनियुक्ति पर है तथा वह विभाग जिससे उसकी सेवाएं प्राप्त की गई हैं, दोनों विभागों के अनुमोदन से उसकी प्रतिनियुक्ति अवधि बढ़ाई जा सकेगी ।

11. निरर्हता.-

(1) अभ्यर्थी की ओर से अपनी अभ्यर्थिता के लिए किसी भी साधन से समर्थन अभिप्राप्त करने के लिए किया गया कोई भी प्रयास नियुक्ति प्राधिकारी द्वारा परीक्षा में बैठने/ चयन के लिए निरर्हता माना जा सकेगा ।

(2) ऐसा कोई अभ्यर्थी, जो कि मध्यप्रदेश शासन द्वारा समय- समय पर निर्धारित मानदंडो को पूरा नहीं करता हो , किसी सेवा या पद पर नियुक्ति के लिए पात्र नहीं होगा । मध्यप्रदेश राजपत्र , दिनांक 14 मई 2020

भाग-तीन

सेवा की शर्ते

12. सेवा में आचरण एवं अनुशासन. - मध्यप्रदेश सिविल सेवा (आचरण) नियाम, 1965, मध्यप्रदेश सिविल (वर्गीकरण , नियंत्रण एवं अपील) नियम , 1966 तथा मध्यप्रदेश सिविल , सेवा ( सेवा की सामान्य शर्ते) नियम, 1961 , प्राधिकरण मे कार्य करने वाले अधिकारियों / कर्मचारियों पर लागू होंगे ।

13. अनुशासनिक एवं अपील प्राधिकारी.- मध्यप्रदेश राज्य आपदा प्रबंधन प्राधिकरण के समन्वयक / संचालक , मध्यप्रदेश सिविल सेवा (वर्गीकरण , नियंत्रण एवं अपील) नियम , 1966 के नियम 10 के उपबंधों के अनुसार प्राधिकरण में कार्य करने वाले अधिकारियों / कर्मचारियों के विरूद्ध अनुशासनिक कर्रवाई करने के लिए सक्षम होंगे । 14. शिथिलीकरण.- इन नियमों में की किसी भी बात का यह अर्थ नहीं लगाया जाएगा कि वह ऐसे किसी व्यक्ति के मामले का, जिसे ये नियम लागू होगे हैं, ऐसी रीति में, जो कि उसे न्यायसंगत और साम्यपूर्ण प्रतीत होती हो, निपटारा करने की राज्यपाल की शक्ति को सीमित या कम करती है:

परंतु कोई मामला किसी ऐसी रीति में नहीं निपटाया जाएगा जो इन नियमों में उपबंधित रीति की अपेक्षा उसके लिए कम अनुकूल हो ।

15. निर्वचन.- यदि इन नियमों के निर्वचन से संबंधित कोई प्रश्न उद्भूत होता हैं, तो वह कार्यपालिक समिति को निर्दिष्ट किया जाएगा और उस पर उसका विनिश्चय अंतिम होगा ।

16. व्यावृत्ति.- इन नियमों में अंतर्विष्ट कोई भी बात अनुसूचित जातियों अनुसूचित जनजातियों तथा अन्य पिछड़े वर्गों के लिए राज्य सरकार द्वारा इस संबंध में, समय - समय पर जारी किए गए आदेशों में उपबंधित किए जाने हेतु अपेक्षित आरक्षण तथा अन्य शर्तों को प्रभावित नहीं करेगी ।

(एक) सदृश पद धारण करता हो तथा संबंधित क्षेत्र में अनुभव हो अथवा

केन्द्र / राज्य शासन/ अर्धशासकीय संगठनों/ अंतर्राष्ट्रीय अभिकरणों में आपदा प्रबंधन में न्यूनतम 10 वर्ष का अनुभव

ऐसे अधिकारियों को अधिमानता दी जाएगी जिन्होंने शासकीय/ अर्धशासकीय/ अंतर्राष्ट्रीय अभिकरणों के साथ आपदा प्रबंधन के क्षेत्र में कार्य किया हो,

(दो) पुनरीक्षण-पूर्व वेतनमान रू. 15600-39100ग्रेड वेतन 5400 में संबंधित क्षेत्र में 5 वर्ष का अनुभव हो अथवा

(तीन) पुनरीक्षण-पूर्व वेतनमान रू. 9300-34800 ग्रेड वेतन 4600 में संबंधित क्षेत्र में 8 वर्ष का अनुभव हो।

केन्द्र / राज्य शासन / अर्धशासकीय संगठनों/ अंतर्राष्ट्रीय अभिकरणों में आपदा प्रबंधन के

क्षेत्र में न्यूनतम 10 वर्ष पढ़ाने का अनुभव

ऐसे अधिकारियों को अधिमानता दी जाएगी जिन्होंने शासकीय / अर्धशासकीय / अंतर्राष्ट्रीय अभिकरणों के साथ आपदा प्रबंधन के क्षेत्र में कार्य किया हो,

केन्द्र/ राज्य शासन या अर्धशासकीय संगठनों के अधीन प्रथम/ द्वितीय श्रेणी अधिकारी (एक) सदृश पद धारण करता हो तथा संबंधित क्षेत्र में अनुभव हो अथवा (दो) पुनरीक्षण-पूर्व वेतनमान रू. 15600-39100 ग्रेड वेतन 5400 में संबंधित क्षेत्र में 5 वर्ष काअनुभव हो अथवा

सामाजिक विज्ञान/ भू-विज्ञान/ विज्ञान/ ग्रामीण विकास/ आपदा प्रबंधन/ इंजीनियरिंग / कृषि / विधि/ चिकित्सा / अर्थशास्त्र/ सांख्यिकी/ रक्षा अध्ययन में पी.एच.डी उपाधि होनी चाहिए ।

(दो) पुनरीक्षण-पूर्व वेतनमान रू. 9300-34800 ग्रेड वेतन 4600 में संबंधित क्षेत्र में 5 वर्ष काअनुभव हो अथवा (तीन) पुनरीक्षण-पूर्व वेतनमान रू. 9300-34000 ग्रेड वेतन 4200 में संबंधित क्षेत्र में 8 वर्ष का अनुभव हो।

साथ आपदा प्रबंधन के क्षेत्र में कार्य किया हो, सहायक संचालक (वित्त) के लिए ऐसे अधिकारियों को अधिमानता दी जाएगी जिन्होंने केन्द्र/राज्य शासन में लेखा अधिकारी /कोषालय अधिकारी/ सहायक लेखा अधिकारी के रूप में कार्य किया हो ।

कृषि/विधि/ चिकित्सा/ अर्थशास्त्र/ सांख्यिकी/ रक्षा अध्ययन में स्नातकोत्तर उपाधि होनी चाहिए । सहायक संचालक (वित्त) के लिए अधिकारी के पास वाणिज्य में स्नातक उपाधि होनी चाहिए तथा विभागीय वित्तीय सेवा परीक्षा या केन्द्र/राज्य शासन द्वारा संचालित अधीनस्थ लेखा सेवा परीक्षा उत्तीर्ण होना चाहिए ।

सहायक लेखा अधिकारी

केन्द्र/ राज्य शासन/ अर्धशासकीय संगठनों में लेखा / कोषालय में कम से कम 3 वर्ष का कार्य करने का अनुभव

उपाधि/ एम.बी.ए. (फायनेंस) वाणिज्य में स्नातकोत्तर / चार्टर्ड अकाउन्टेंट या समकक्ष वःछनीय

है।

No. F - 35-69-20 13 - II -C- 2 In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and in supersession of this department's Notification No. F - 35-69-20 13 - II - C- 2 dated 24th November , 2014 the Governor of Madhya Pradesh , hereby , make the following rules for regulating the recruitment and conditions of service of officers and employees of the Madhya Pradesh State Disaster Management Authority , namely : -

RULES

PART - I

PRELIMINARY

1. Short title and commencement.-

(1) These rules may be called the Madhya Pradesh State Disaster Management Authority (Recruitment Conditions of Service ) Rules , 2020 . and (2) They shall come into force from the date of their publication in the Madhya Pradesh Gazette .

2. Definitions . In these rules , unless the context otherwise requires , -

(a) "Appointing Authority " means the Coordinator / Director of the Authority ;

( b) " Authority " means the Madhya Pradesh State Disaster Management Authority ( MPSDMA ) established under- sub - section ( 1 ) of Section 14 of the Disaster Management Act , 2005 ;

(c) Chief Minister of the State , shall be the ex officio 'Chairperson ' of the Authority in accordance with Section 14 (2) the of the Disaster Management Act , 2005

(d) " Competent authority" means the Chairperson of the Authority;

(e) " Co - ordinator / Director " Director of the Authority; means the Coordinator/ (f) "Government " means the Government of Madhya Pradesh;

(g) "Governor " means the Governor of Madhya Pradesh ;

(h) "Member Advisor " means the full time Advisor of the Authority who will be one of the members of the Authority in accordance with Section 2 (b) of Madhya Pradesh Gazette No. 35-82-2016 - II - C - 2 dated 28th July, 2018 .

(i) " Other Backward Classes " means the Backward Classes of citizens as specified by the Central Government vide Notification No. F -8-5- twenty five - 4- 84, dated 26-12-1984 as amended from time to time ;

(j ) " Scheduled Castes " means any caste , race or tribe or part of or group within a caste , race or tribe specified as such in relation to the State of Madhya Pradesh under article 341 of the Constitution of India ;

(k) " Scheduled Tribes " means any tribe or tribal community or part of or group within a tribe or tribal community specified as such in relation to the State of मध्यप्रदेश राजपत्र, दिनांक 14 मई 2020

Madhya Pradesh under article 342 of the Constitution ofIndia;

(1) " Service " means the service of Madhya Pradesh State Disaster Management Authority;

(m) " State" means the State of Madhya Pradesh ;

(n) " State Executive Committee" means the Executive Committee of the Authority constituted under sub- section ( 1 ) of Section 20 of the Disaster Management Act, 2005 .

3. Application.- Without prejudice to the generality of the provisions contained in the Madhya Pradesh Civil Services (General Conditions of Service) Rules , 1961 , these rules shall apply to every members of the Authority.

4. Constitution of the Service of Authority . The service of Authority shall consist of the following persons , namely: - (a) persons , who at the time of commencement of these rules are holding substantively or in officiating capacity , the posts specified in Schedule - I ;

( b) persons recruited to the Authority before the commencement of these rules ; and

5. Number of posts , classification and pay scale etc.-

The classification , pay scale and number of posts included in the Authority shall be in accordance with Schedule - I .

PART - II RECRUITMENT

6. Method of recruitment.-

(1) General conditions : After the commencement of these rules , candidates shall be selected for appointment in the Authority by one of the following methods as may be prescribed : -

(a) On deputation ( by transfer of officers / employees appointed in the Madhya Pradesh Police , Border Security Force , Directorate of Home Guards and Civil Defence , Madhya Pradesh , Central Industrial Security Authority, National Disaster Response Authority, National Disaster Management Authority , Army or any other department of the State or Central Government who possess the skills of Disaster Management) under Madhya Pradesh Government , General Department Deputation Administration Guidelines issued vide No. C/ 3-14/ 06/ 3 / 1 dated 29th February , 2008 ; and

(b) By Contractual appointment under 'Madhya Pradesh Contractual Appointment to Civil Posts Rules , 2017 as published by General Administration Department in Madhya Pradesh Gazette dated 28th September 2017 .

(2) Number of persons recruited shall never exceed the number of posts mentioned in the Schedule- I .

(3) Recruitment shall be done in accordance with the method as specified in Schedule - II .

(4) ( I) For the posts mentioned against Serial Number 2,3 and 4 of Schedule - II , recruitment shall be made with the approval of competent authority on the recommendations of a Selection Committee consisting of:

(a) Member Advisor , MPSDMA ( or : Chairman in case of his non - availability ACS/ PS , Home)

Director, : Member (b) Coordinator MPSDMA /

( II) For the posts mentioned against Serial Number 5,6,7,8,9 and 10 of Schedule - II , recruitment shall be made with the approval of competent authority on the recommendations of a Selection Committee consisting of:-

(a) Deputy Secretary ( Home) or an : Chairman officer of equivalent rank

: Member (b) Deputy Director , MPSDMA

: Member (c) Assistant Director , MPSDMA

Note 1: The make Selection Committee shall their recommendations on the basis of personal interviews (or skill test) with the candidates , giving appropriate weightage , as may be determined by the Committee , to the educational qualifications and experience of the candidates , their service record as well as their performance in the interview (or skill test) .

338 ( 17) Selection Committee reserves the right to shortlist the candidates to be called for interview , based on the criteria to be decided by the Committee .

on (5) The employees to be recruited deputation/ contractual basis shall have such qualifications as mentioned in Schedule III for the concerned posts .

(6) In case of non availability of suitable candidates against deputation posts , even after having advertised twice , such posts may be filled on contractual basis , if these posts have remained vacant for a period of two years or more .

7. Reservation.-

(1) Reservation of physically challenged persons shall be as per the rules issued by the Madhya Pradesh State Government , from time to time .

(2) Reservation for Scheduled Castes , Scheduled Tribes and Other Backward Classes shall be in accordance with the provisions of the Madhya Pradesh Lok Sewa (Anusuchit Jatiyon , Anusuchit Janjatiyon Aur Anya Pichhade Vargon Ke Liye Arakshan) Adhiniyam , 1994 (No.21of 1994) .

8. Appointment and Removal . The officers / employees in the Authority shall be appointed and may be terminated / repatriated by the Coordinator / Director of MPSDMA with the approval of competent authority.

9. Conditions of eligibility for contractual appointment.- After the commencement of these rules , all the contractual appointments in the service shall be made in accordance मध्यप्रदेश राजपत्र, दिनांक 14 मई 2020

with Madhya Pradesh Contractual Appointment to Civil Posts Rules , 2017 .

The following conditions shall be fulfilled by the candidates to be eligible for Selection on contract appointment-

(1 ) The employee shall be appointed on contractual basis in the Authority as specified in column (7) of Schedule- II .

) The person so appointed on contract must have the minimum qualification for the posts specified in Schedule - III .

10. Appointment / Recruitment on deputation.-

(1) After receiving the consent of the parent department of the Officer / Employee , the recruitment through deputation shall be made on different posts .

( 2) The candidate must possess the requisite qualifications as specified in Schedule - III .

(3) The concerned officer / employee shall receive the same pay and allowances on deputation as he was getting in his parent department .

( 4) As per the rules of Madhya Pradesh Government , the deputation period shall be of 4 years . If it is required to retain the officer for more period , then his deputation period may be increased with the approval of both the department in which the officer is on deputation and the department from which his services have been obtained .

11. Disqualification.-

( 1) Any attempt on the part of a candidate to obtain support for his candidature by any means may be held as disqualification for appearing in the examination / Selection by the Appointing Authority .

(2) No candidate shall be eligible for appointment to a service or post , who does not fulfill the norms laid down by the State Government from time to time .

PART - III

CONDITIONS OF SERVICE

12. Conduct and discipline in the service . The Madhya Pradesh Civil Services ( Conduct ) Rules , 1965 , the Madhya Pradesh Civil Services ( Classification , Control and Appeal) Rules , 1966 and the Madhya Pradesh Civil Services (General Conditions of Service) Rules , 1961 shall be applicable on the officer/ employee who is working in the Authority .

13. Disciplinary and Appellate Authority . - The Coordinator / Director of MPSDMA shall be competent to take disciplinary action against the officers /employees working in the Authority as per the provisions of rule 10 of the Madhya Pradesh Civil Services ( Classification , Control and Appeal ) Rules , 1966 .

14. Relaxation . - Nothing in these rules shall construed to limit orabridge the powers of the Governor to deal with the case of any person to whom these rules apply in such a manner , as may appear to him to be just and equitable:

Provided taht the case shall not be dealt within any such manner less favouable to him than that which provided in these rules.

15. Interpretation.- If any question arises relationg to the interpretaion of these rules , it shall be referred to the Executive Committee and its decision shall be final thereon .

16. Saving.- Nothing contained in these rules shall affect reservation and other conditions required to be provided for the Scheduled Castes , Scheduled Tribes and other Backward Classes in the orders issued by the State Government in this behalf, from time to time .
