अधिसूचना
सं. 318- रा.स. - मल्टी -2020 ( 1 ) .- यतः, भारत निर्वाचन आयोग ने 17 राज्यों से अप्रैल, 2020 माह में सेवानिवृत्त होने वाले सदस्यों की 55 सीटें भरने के लिए दिनांक 25 फरवरी 2020 को राज्य सभा के निर्वाचनों की घोषणा की थी, जिन्हें दिनांक 6 मार्च 2020 की अधिसूचना संख्या 318 - रा.स. - मल्टी -2020 ( 1 ) के तहत अधिसूचित किया गया था. दिनांक 18 मार्च 2020 को नाम वापिस लेने की अंतिम तारीख के उपरान्त, संबद्ध रिटर्निंग अधिकारियों ने 10 राज्यों की 37 सीटें निर्विरोध भरे जाने की घोषणा की. इसके अतिरिक्त, संबद्ध रिटर्निंग अधिकारियों से प्राप्त हुई रिपोर्ट के अनुसार. ये द्विवार्षिक निर्वाचन आंध्र प्रदेश , गुजरात, झारखंड, मध्यप्रदेश , मणिपुर, मेघालय और राजस्थान राज्यों से 18 सीटों के लिए दिनांक 26 मार्च 2020 ( गुरुवार ) को आयोजित किए जाने थे और जैसा कि आयोग द्वारा दिनांक 6 मार्च 2020 की अधिसूचना के अनुसार पहले घोषणा की गई थी, जिस तारीख से पहले निर्वाचन संपन्न करवाये जाने थे, वह तारीख 30 मार्च 2020 ( सोमवार ) थी; और
यतः , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 153 में यह विनिर्दिष्ट है कि निर्वाचन आयोग किन्हीं भी कारणों, जो इसे उचित लगें, से उक्त अधिनियम की धारा 30 अथवा धारा 39 की उप - धारा ( 1 ) के अन्तर्गत आयोग द्वारा जारी की गई अधिसूचना में आवश्यक संशोधन करते हुए किसी भी निर्वाचन को पूरा/संपन्न किये जाने के लिए समय - सीमा में विस्तार कर सकता है. तद्नुसार, कोविड-19 की वजह से जन स्वास्थ्य संबंधी आपातकाल की मौजूदा अप्रत्याशित स्थिति और देश में जारी संबद्ध हिदायतों (एडवाइजरी ) को ध्यान में रखते हुए, निर्वाचन आयोग ने दिनांक 24 मार्च 2020 के अपने आदेश के तहत मतदान आस्थगित कर दिए थे और उक्त अधिनियम की धारा 153 के प्रावधानों के अन्तर्गत उक्त निर्वाचन की अवधि बढ़ा दी थी तथा यह निर्णय लिया था कि उक्त द्विवार्षिक निर्वाचनों के लिए मतदान तथा मतगणना की नई तारीख की घोषणा, भारत निर्वाचन आयोग द्वारा विद्यमान स्थिति की समीक्षा करने के उपरान्त की जाएगी. इस आदेश में यह भी विनिर्दिष्ट था कि संबद्ध रिटर्निंग अधिकारियों द्वारा उक्त निर्वाचन के लिए निर्वाचन लड़ने वाले अभ्यर्थियों की पहले से ही प्रकाशित की गई सूची , उन शेष सभी कार्यकलापों के प्रयोजनार्थ वैध रहेगी जो उक्त अधिसूचना (दिनांक 6 मार्च 2020 ) के अन्तर्गत निर्धारित किए गए थे; और
यतः , जन स्वास्थ्य संबंधी आपातकाल की तत्कालीन विद्यमान स्थितियों की समीक्षा करने के बाद आयोग ने लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 153 के साथ पठित भारत के संविधान के अनुच्छेद 324 के अधीन अपनी शक्तियों का प्रयोग करते हुए अपने दिनांक 3 अप्रैल 2020 के आदेश के तहत निर्वाचन की अवधि को उपुर्यक्त सीटों के विहित कार्यकाल से आगे बढ़ा दिया था और यह निर्णय लिया था तत्कालीन विद्यमान परिस्थितियों की समीक्षा करने के बाद उचित समय पर मतदान और मतगणना की नई तारीख सूचित कर दी जाएगी. यह भी स्पष्ट किया गया था कि संबंधित रिटर्निंग अधिकारियों द्वारा उक्त निर्वाचनों के लिए निर्वाचन लड़ने वाले अभ्यर्थियों की पहले से प्रकाशित की गई सूची , उन शेष कार्यकलापों के प्रयोजनार्थ वैध रहेगी , जो दिनांक 6 मार्च 2020 की अधिसूचना के अंतर्गत विहित किए गए थे .

380 (1) यतः, आयोग ने इस मामले की व्यापक समीक्षा की है. राष्ट्रीय आपदा प्रबंधन अधिनियम, 2005 के अधीन केन्द्रीय गृह सचिव और राष्ट्रीय कार्यकारी समिति ( एनईसी ) के अध्यक्ष द्वारा जारी किए गए दिनांक 30 मई 2020 के दिशा- निर्देशों सहित सभी कारकों पर विचार करते हुए तथा राज्यों के संबधित मुख्य निर्वाचन अधिकारियों से प्राप्त जानकारी ( इनपुट ) को ध्यान में रखते हुए, आयोग द्वारा निर्णय लिया गया है कि आंध्रप्रदेश ( 04 सीट) , गुजरात ( 04 सीट ) , झारखंड ( 02 सीट) , मध्यप्रदेश ( 03 सीट ) , मणिपुर ( 01 सीट ) , मेघालय ( 01 सीट ) और राजस्थान ( 03 सीट ) राज्यों से 18 सीटों के लिए द्विवार्षिक निर्वाचनों के संबंध में मतदान और मतगणना की तारीख निम्नलिखित अनुसूची के अनुसार होगी:-

अतः, अब, उपरोक्त को ध्यान में रखते हुए और लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 153 के साथ पठित संविधान के अनुच्छेद 324 के अधीन निहित शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग दिनांक 06 मार्च 2020 की अपनी अधिसूचना सं. 318 - रा.स.- मल्टी-2020 ( 1 ) में एतद्वारा निम्नलिखित और संशोधन करता है:-
उक्त अधिसूचना के पैरा ( अ ) के उप- पैरा ( घ ) और ( ङ) को निम्नलिखित से प्रतिस्थापित किया जाएगा:-
" (घ ) 19 जून , 2020 ( शुक्रवार ) , वह तारीख , जिसको यदि आवश्यक हुआ, तो मतदान कराया जाएगा; और (ङ) 22 जून, 2020 ( सोमवार ) , वह तारीख , जिससे पूर्व निर्वाचन सम्पन्न करा लिया जाएगा ; और ".

NOTIFICATION
No. 318 -CS - MULTI - 2020 ( 1 ) .-WHEREAS , on 25th Febuary 2020 Election Commission of India announced elections to the Council of States to fill 55 seats of Memrbers from 17 States , retiring in the month of April ,2020 , which werenotified vide Notification No. 318- CS- Multi- 2020 ( 1 ) , dated 06th March 2020. After the last date of withdrawal on 18th March 2020 , respective Returning Officers declared 37 seats from 10 States filled in uncontested. Further, as per the reports received from the concerned Returning Officers the biennial elections for 18 seats from the States of Andhra Pradesh , Gujarat , Jharkhand , Madhya Pradesh , Manipur, Meghalaya and Rajasthan were to be conduted on 26th March 2020 (Thursday) and the date before which election was to be completed as earlier announced by the Commission was 30th March 2020 (Monday ) as per the notification dated 6th March 2020 ; and
WHEREAS , Section 153 of the Representation of the People Act , 1951 specifies that the Election Commission for reasons which it considers sufficient , may extend the time for the completion of any election by making necessary amendents in the notification issued by it under section 30 or sub- section ( 1 ) of section 39 of the said Act. Accordingly, considering the prevailing unforeseen situation of public health emergeny due to COVID - 19 and related advisories in the country , the Election Commission , vide its Order , dated 24th March 2020 , deferred the poll and extended the period of said election under the provisions of Section 153 of the said Act and decided that the announcement of fresh date of poll and counting for the said biennial elections will be made by the ECI after reviewing the prevailing situation. The Order also specified that the list of contesting candidates , already published for the said election by the respective Returning Officers , is to remain valid for the purpose of remaining activities as was prescribed under the said notification (dated 6th March 2020 ) ; and
WHEREAS , vide its Order dated 3rd April 2020 , after reviewing the then prevailing situation of Public health emergency, the Commission further extended the period of election beyond the prescribed term (s ) of above- mentioned seats invoking its powers under Article 324 of the Constitution of India read with Section 153 of the Representation of the People Act, 1951 and decided that the fresh date of poll date and counting shall be intimated in due course after reviewing the then prevailing situation. It vas further clarified that the list of contesting candidates , already published for the said elections by the respective Returning Officer , shall remain valid for the purpose of remaining activities , as prescribed under the notification dated 06th March 2020 .
WHEREAS , the Commission has reviewed the matter in detail . Considering all factors , including the guide- lines dated 30th May 2020 issued by Union Home Secretary and Chairman , National Executive Committee ( NEC ) under the National Disaster Management Act , 2005 and taking into account the inputs obtained from the Chief Electoral Officers concerned the Commission has decided that the date of poll and counting of votes in respect of the biennial elections for 18 seats from the States of Andhra Pradesh (4 seats ) , Gujarat ( 4 seats ) , Jharkhand (2 seats) , Madhya Praclcsh (3 seats ) , Manipur ( 1 seats) Meghalaya ( 1 seats ) and Rajasthan (3 seats ) shall be as per the following schedule :-

380 (3 ) NOW, THEREFORE , in view of the above and the exercise of the powers vested under Article 324 of the Constitution read with Section 153 of the Representation of the People Act , 1951 , the Election Commission here by makes further amendment in its notification No. 318 - CS - MULTI - 2020 ( 1 ) , dated 06th March 2020 as under :-- sub - para ( d) & (e) of para (A) of the said notification shall be substituted with:-
"(d) the19th June , 2020 ( Friday ) , as the date on which a poll shall , if necessary , be taken; and (e) the 22nd June, 2020 ( Manday ) , as the date before which the election shall be completed ; and " .
