क्र. एफ 3-2-2013- पैंतीस .- भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, मध्यप्रदेश के राज्यपाल, एतद्वारा, मध्यप्रदेश पशुपालन चतुर्थ श्रेणी संविदा सेवा ( नियुक्ति तथा सेवा की शर्त ) नियम , 2018 में निम्नलिखित संशोधन करते हैं , अर्थात्ः-

उक्त नियमों में , नियम 3 के पश्चात , निम्नलिखित नियम अन्तः स्थापित किए जाएं , अर्थातः-
" उक.पारिश्रमिकः-
(1 ) संविदा आधार पर प्रथम बार इस प्रकार नियुक्त कर्मचारी के संबंध में , उसका संविदा पारिश्रमिक समकक्ष पद पर नियुक्ति होने पर किसी नियमित सेवा के कर्मचारी को यथा देय अर्थात मूल वेतन (ग्रेड- पे सहित) एवं इस पर राज्य सरकार द्वारा समय- समय पर पुनरीक्षित किए गए अनुसार अतिरिक्त रकम की एक निश्चित प्रतिशतता जोड़ते हुए एकमुश्त नियत की जाएगी ।
(2) संविदा अवधि के दौरान संविदा पारिश्रमिक में वृद्धि नही की जाएगी ।
(3) पूर्व में नियुक्त किसी संविदा कर्मचारी की दशा में , उसके संविदा पारिश्रमिक का पुनरीक्षण , अखिल भारतीय उपभोक्ता सूचकांक (औद्योगिक श्रमिकों के लिए )में हुई

वृद्धि के संबंध में वित्त विभाग द्वारा समय - समय पर जारी आदेशों के आधार पर विभागों द्वारा किया जाएगा । इस प्रकार पुनरीक्षित संविदा पारिश्रमिक नवीन संविदा के लिए संविदा पारिश्रमिक होगा ।
! (4 ) संविदा कर्मचारियों के पारिश्रमिक के बारे में जानकारी (पुनरीक्षण को सम्मिलित करते हुए) वित्त विभाग द्वारा जारी आदेश क्रमांक एफ- 2-2/ 2013 /नियम -4 दिनांक 19.3.2013 के अनुसार महालेखाकार कार्यालय को अग्रेषित की जाएगी ।
(5) यदि संविदा कर्मचारी पैरा 3 क में वर्णित पारिश्रमिक से कम पारिश्रमिक प्राप्त कर रहे हैं , तो उनकी वर्तमान संविदा के पूर्ण होने के पश्चात , उनका पारिश्रमिक पैरा 3 क ( 1 ) या 3 क ( 3 ) , जो भी अधिक हो , के अनुसार नियत किया जायेगा ।
(6) संविदा पारिश्रमिक के सिवाय कोई भत्ते/सुविधायें नहीं दी जाएंगी ।
३ख . यात्रा भत्ताः-
किसी विशिष्ट स्वीकृत पद पर संविदा आधार पर नियुक्त कर्मचारी को यात्रा भत्ते , किसी नियमित समकक्ष संवर्ग के लिए लागू यात्रा भत्तों, के समान होंगे । दौरा/यात्रा भत्ता , पद से संबंधित क्षेत्र के भीतर लागू नहीं होंगे । उपरोक्त सुविधा केवल तभी उपबंधित होगी , यदि वह उपबंध हस्ताक्षरित संविदा में स्पष्ट रूप से उल्लेखित है । उग . चयन एवं पदों पर नियुक्ति की प्रक्रिया-
(1 ) पदों की संख्या की उपलब्धता पशु चिकित्सालयों/ पशु औषधालयों में वास्तविक रिक्तियों से विनिश्चित की जाएगी ।
(2) अनुसूची में वर्णित पदों पर चयन तथा नियुक्तियाँ, अनूसूची में वर्णित चयन समिति की अनुशंसा पर की जाएंगीः
परन्तु चयन समिति के गठन के लिये मध्यप्रदेश लोक सेवा (अनुसूचित जातियों , अनुसूचित जनजातियों और अन्य पिछड़े वर्गो के लिए आरक्षण ) अधिनियम , 1994 की धारा 8 लागू होगी । "

No. F - 3-2-2013 - XXXV. In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India , the Governor of Madhya Pradesh , hereby, makes the following amendments in the Madhya Pradesh Animal Husbandry Class - IV Contract Service (Appointment and Service Condition ) Rules , 2018 , namely :-
AMENDMENTS
In the said rules , after rule 3 , the following rules shall be inserted , namely: - "3A.Wages: -
(1) In respect of an employee so appointed first time on contract basis , his contract wages shall be fixed in lump - sum just as given to a regular service employee on appointment on equal post i.e. basic pay ( with grade pay ) adding a definite percentage of extra amount as revised by the State Government from time to time.
(2) There shall not be any increase in contract wages during a contract period .
(3) In case of an earlier appointed contract employee , the revision of his contract wages shall be done by the Department on the basis of orders issued by the Finance Department from time to time in respect of increase in the All India Consumer's index ( for Industrial Labourers ) . Thus revised contract wages shall be contract wages for new contract
(4) The information about the wages of the contract employees ( including revision ) shall be forwarded to the A.G.M.P. as per orders issued by the Finance Department vide order no. F - 2-2 /2013 rule -4 dated 19.3.2013 .
(5) If the contract employees are getting wages less than the wages mentioned in rule 3A,, then after the completion of their present contract , their wages shall be fixed as per rule 3A ( 1 ) or 3A ( 3 ) whichever is higher.
(6) No other allowance / facility Shall be given except contract wages .
3B.Travel Allowance: -
Anemployee , appointed on contract basis on a particular sanctioned post the travel allowances shall be just as applicable to a regular equal cadre . The tour / travel allowance shall not be applicable within the area related to the post . Above facility shall be provided only if this provision is clearly mentioned in the signed contract .

3C.Selection and Process of appointment on the posts : -
(1) The availability of number of posts shall be decided from the actual vacancies in veterinary Hospitals / veterinary dispensaries .
(2) Selection and Appointments On the posts mentioned in the schedule , shall be made on the the recommendation of the selection committee , mentioned in the schedule:
Provided that for the constitution of the Selection Committee , section 8 of the Madhya Pradesh Lok Seva ( Anusuchit Jatiyon , Anusuchit Jan Jatiyon aur Anya Pichhade Vargon ke liye Arakshan ) Adhiniyam , 1994 shall be applicable . "
