अधि. क्र.११ एफ 1-04/2017/ 18-3:- पथ विक्रेता ( जीविका संरक्षण और पथ विक्रय विनियमन ) अधिनियम , 2014 (अधिनियम 2014 का 7) की धारा 38 द्वारा प्रदत्त शक्तियों और इस निमित्त सशक्त करने वाली सभी अन्य शक्तियों को प्रयोग में लाते हुए , मध्यप्रदेश सरकार, पथ विक्रेताओं के कल्याण एवं उनको आजीविका अर्जित करने का अवसर प्रदान करने के लिये निम्नलिखित योजना बनाती है, अर्थात्: -

योजना

1. संक्षिप्त नाम , प्रारंभ और विस्तार : -

(1 ) इस योजना का नाम मध्यप्रदेश पथ विक्रेता (जीविका संरक्षण और पथ विक्रय विनियमन ) योजना, 2020 है ।

(2) यह मध्यप्रदेश राजपत्र में इसके प्रकाशन की तारीख से प्रवृत्त होगी।

(3 ) इसका विस्तार सम्पूर्ण मध्यप्रदेश राज्य में होगा ।

2. परिभाषाएं : -

(1 ) इस योजना में , जब तक संदर्भ से अन्यथा अपेक्षित ना हो :

(क ) "अधिनियम" से अभिप्रेत है पथ विक्रेता ( जीविका संरक्षण और पथ विक्रय विनियमन ) अधिनियम , 2014 (केन्द्रीय अधिनियम 2014 का 7) ;

(ख ) " उत्सव बाजार' से अभिप्रेत है नगरीय स्थानीय प्राधिकरण द्वारा नगर विक्रय समिति की अनुशंसा पर निर्धारित किया गया एक ऐसा बाजार जहां विक्रेता और क्रेता परंपरागत रूप से त्यौहार सत्र के दौरान उत्पादों या सेवाओं के विक्रय और क्रय के लिए एकत्रित होते हैं ।

(ग ) "प्ररूप" से अभिप्रेत है इस योजना से संलग्न प्ररूप ;

(घ ) "विरासत बाजार " से अभिप्रेत है नगर विक्रय समिति की सिफारिशों पर नगरीय स्थानीय प्राधिकरण द्वारा निर्धारित किया गया एक ऐसा बाजार जो पचास वर्ष से भी अधिक समय एक ही स्थान पर पूर्ण कर चुका है तथा जहां विक्रेता और क्रेता पारंपरिक रूप से उत्पादों या सेवाओं के विक्रय और क्रय के लिए एकत्रित होते हैं ;

(ड ) " प्राकृतिक बाजार " से अभिप्रेत है नगरीय स्थानीय प्राधिकरण द्वारा नगर विक्रय समिति की अनुशंसाओं पर इस रूप में अवधारित किया गया एक बाजार जहां विक्रेता और क्रेता परंपरागत रूप से उत्पादों या सेवाओं के विक्रय और क्रय के लिए एकत्रित होते हैं ;

(च) " रात्रि बाजार" से अभिप्रेत है नगर विक्रय समिति की अनुशंसाओं पर नगरीय स्थानीय प्राधिकरण द्वारा इस रूप में अवधारित किया गया एक बाजार जहां विक्रेता और क्रेता पारंपरिक रूप से शाम के बाद अर्थात रात के दौरान उत्पाद या सेवाओं के विक्रय और क्रय के लिए एकत्रित होते हैं ;

(छ) "योजना" से अभिप्रेत है अधिनियम में संलग्न पहली अनुसूची में अंतर्विष्ट मामले को आच्छादित करने वाली पथ विक्रेताओं के व्यवसाय को बढ़ावा. देने के लिए तैयार की गई योजना ;

(ज) अधिनियम के संदर्भ में " सार्वजनिक प्रयोजन " में सम्मिलित है,

पथों, सड़कों, गलियों को चौड़ा करना ;

( एक)

पथों, सड़कों, गलियों के संरेखण को बदलना ;

(दो)

बिना फ्लाइओवर और स्लिप डाउन रोड का निर्माण ;

(तीन)

अंडरपास का निर्माण :

(चार)

(पांच) कुछ सार्वजनिक परियोजनाओं के लिए सार्वजनिक प्राधिकरणों के स्वामित्व वाली भूमि का विकास ;

जल, वर्षा जल या सीवर लाइनों को बिछाना ;

(छह)

सेवाओं के लिए मध्यवर्ती पम्पिंग स्टेशन बनाना ;

(सात)

(आठ) सार्वजनिक परिवहन जैसे बस, रैपिड ट्रांजिट सिस्टम, मेट्रो इत्यादि से संबंधित कोई भी परियोजना ;

(नौ) आर्थिक रूप से कमजोर वर्ग (ईडब्ल्यूएस) के आवास निर्माण ;

पार्क, उद्यान और मनोरंजन क्षेत्र का विकास और रखरखाव ;

(दस)

(ग्यारह) विक्रय क्षेत्र में किसी भी पर्यावरणीय संसाधन का संरक्षण; तथा मध्यप्रदेश राजपत्र, दिनांक 29 जून 2020

404(1) (बारह) नगरीय स्थानीय प्राधिकरण और / या राज्य सरकार द्वारा लिया गया कोई अन्य विकास कार्य , जिसका हितग्राही बड़े पैमाने पर समुदाय होगा ;

(झ) "नियम" से अभिप्रेत है मध्यप्रदेश पथ विक्रेता (जीविका संरक्षण और पथ विक्रय विनियमन) नियम, 2017 ;

(ञ) " मौसमी विक्रेता" से अभिप्रेत है नगरीय स्थानीय प्राधिकरण द्वारा नगर विक्रय समिति की अनुशंसा पर निर्धारित किया गया ऐसा पथ विक्रेता जो विशिष्ट मौसमों पर विक्रय गतिविधियों को सम्पादित करते हैं ;

(ट) "धारा" से अभिप्रेत है अधिनियम की धारा ;

(ठ) " स्थाई विक्रेता" से अभिप्रेत है पथ विक्रेता, जो एक विशेष स्थान पर नियमित आधार पर विक्रय गतिविधियों को सम्पादित करते हैं अर्थात् फुटपाथ या अन्य सार्वजनिक स्थानों और / या निजी खुले / आच्छादित क्षेत्रों पर प्राधिकरणों की व्यक्त सहमति के साथ स्थल पर कब्जा रखते हैं ।

(ड) " साप्ताहिक बाजार" से अभिप्रेत है नगरीय स्थानीय प्राधिकरण द्वारा नगर विक्रय समिति की अनुशंसाओं पर निर्धारित किया गया एक बाजार जहां विक्रेता और क्रेता उत्पादों या सेवाओं का विक्रय और क्रय के लिए साप्ताहिक एकत्र होते हैं ;

(2) शब्द और अभिव्यक्तियों जिन्हें योजना में परिभाषित नहीं किया गया है, परंतु अधिनियम और नियमों में परिभाषित किया गया है , उनके वही अर्थ होंगे जो यथास्थिति उनके लिये अधिनियम या नियमों में, समुदेशित किए गए होंः 3. पथ विक्रेताओं का सर्वेक्षण करने की रीति:-

(1) नगर विक्रय समिति (टीवीसी), इस योजना के लागू होने के पश्चात अपने क्षेत्र अधिकार के भीतर विद्यमान पथ विक्रेताओं की पहचान के लिए सर्वेक्षण आयोजित करेगी । और पश्चात् भी सर्वेक्षण प्रत्येक 3 वर्ष में कम से कम एक बार किया जाएगा;

(2) नगर विक्रय समिति (टीवीसी) सर्वेक्षण में, पथ विक्रेताओं का वार्डवार डाटा / आंकड़े रखेगी ;

(3) सर्वेक्षण की प्रक्रिया निम्नानुसार होगी :-

(क) संचालनालय , नगरीय प्रशासन एवं विकास द्वारा इस हेतु निर्मित पोर्टल पर पथ विक्रेता अपने आधार एवं समग्र आईडी आधारित आनलाईन स्वयं पंजीयन करेंगे । मध्यप्रदेश राजपत्र, दिनांक 29 जून 2020

(ख ) नगरीय स्थानीय प्राधिकरण , पथ विक्रेयताओं के स्व रजिस्ट्रीकरण को प्रोत्साहित करने के लिए आवश्यक और समुचित कार्रवाई करने के लिए उत्तरदायी होगा ।

(ग) नगरीय स्थानीय प्राधिकरण के एक अधिकारी या सिटी मिशन मैनेजर दीनदयाल अन्त्योदय योजना - राष्ट्रीय शहरी आजीविका मिशन ऐसे आवेदनों का उचित रीति से सत्यापन के लिए जबाबदेह होगा ।

(घ) पथ विक्रेता, पोर्टल के माध्यम से नगरीय स्थानीय प्राधिकरण से पहचान पत्र और विक्रय प्रमाण पत्र प्राप्त करेंगी ।

विक्रय प्रमाणपत्र, पहचान पत्र, वैधता, नवीकरण, रद्दीकरण या विक्रय प्रमाण पत्र का निलंबन:-

(

1 ) विक्रय प्रमाणपत्र जारी करना :- विक्रय प्रमाणपत्र जारी करने के लिए मानदंड निम्नानुसार होंगे : -

(क) सर्वेक्षण में चिन्हत किए गए पथ विक्रेता को नगर विक्रय समिति द्वारा ऑनलाइन पंजीयन पूर्ण होने की तिथि से अधिकतम 30 दिन की कालावधि के भीतर प्ररूप-2 में प्रमाण पत्र जारी किया जाएगा ;

(ख) किसी भी ऐसे पथ विक्रेता को प्रमाणपत्र जारी नहीं किया जाएगा ;

(एक) जो भारत का नागरिक नहीं है और जो मानसिक रूप से स्वस्थ न हो,

(दो) जिसका आजीविका का कोई अन्य साधन हैं ;

(तीन ) जिराका किसी भी अन्य जगह पर कोई अन्य विक्रय स्थल है ;

(चार) जो स्वयं विक्रय न करता हो या अपने परिवार के अठारह साल से कम आयु के सदस्यों के माध्यम से विक्रय करता है ;

(पांच) जिसने अठारह वर्ष की आयु पूरी नहीं की है ;

(ग) नगरीय क्षेत्र के भीतर आवेदक को केवल एक विक्रय स्थल की अनुमति दी जा सकेगी ।

(घ) पथ विक्रेता ऑनलाइन आवेदन के समय निम्नानुसार बचनबंध देगा:-

(एक) विक्रय प्रमाण पत्र, विक्रेता द्वारा स्वयं या परिवार के आश्रित सदस्यों द्वारा उपयोग में लाया जाएगा ;

(दो) विक्रय का प्रमाण पत्र, किसी अन्य व्यक्ति को पट्टे पर, किराए पर नहीं दिया जा सकता है, न ही यह किसी अन्य व्यक्ति को बेचा जा सकता है । इस संबंध में एक वचनपत्र पथ विक्रेताओं द्वारा टीवीसी को प्रस्तुत किया जाएगा ;

(तीन) विक्रेताओं द्वारा इस बात की पुष्टि की जाएगी कि उन्हें नगरीय स्थानीय प्राधिकरण की सीमाओं के अंदर कोई अन्य सार्वजनिक स्थान , स्टोर आवंटित नहीं किया गया है ;

(चार) विक्रेताओं द्वारा इस बात की पुष्टि की जाएगी कि उनके आश्रितों या परिवार के किसी सदस्य (पत्नी / पुत्र) को विक्रय प्रमाणपत्र जारी नहीं किया गया है ;

(पांच)विक्रेता, किसी विक्रय प्रमाण पत्र का उपयोग अनैतिक, अवैध व्यापार, या दवा / मादक पदार्थो के लिए नहीं करेगा ;

(छह) विक्रेया, विक्रय प्रमाण पत्र का उपयोग किसी प्रकार की विस्फोटक सामग्रियों के लिए नही करेगा ;

(सात)विक्रेता विक्रय क्षेत्र में स्वच्छता नियमों का पालन करेगा ;

(आठ) विक्रेता किसी भी प्रकार के पॉलिथीन बैग का उपयोग नहीं करेगा ;

(नौ) विक्रेता नगरीय स्थानीय प्राधिकरण और राज्य सरकार द्वारा समय - समय पर जारी किए गए आदेशों का पालन करेगा ;

(दस) विक्रेता, विक्रय प्रमाण पत्र में उल्लेखित सभी शर्तों का अनुसरण व पालन करेगा;

(ग्यारह)आवेदन में दी गई समस्त सूचनाएं और उसके साथ प्रस्तुत दस्तावेजों सही हों और यदि अन्यथा पाई जाती है तो पर प्राधिकरण द्वारा विक्रय प्रमाणपत्र रद्द कर दिया जाएगा ;

(ङ) नए पथ विक्रेता, जो दो सर्वेक्षणों के अंतराल में पथ पर विक्रय करना चाहते हैं, वे किसी भी समय ऑनलाइन स्वपंजीयन कर आवेदन कर सकेंगे । ऑनलाइन आवेदन करने की प्रक्रिया सतत् रहेगी ।

(च) विक्रय प्रमाण पत्र पर, विक्रय गतिविधि करने वाले व्यक्ति का छायाचित्र होगा और परिवार के अन्य सदस्य के विक्रय गतिविधि में संलग्न होने की दशा में उस सदस्य का छायाचित्र भी विक्रय प्रमाण पत्र पर चस्पा किया जाएगा ;

(छ) व्यक्ति, जो अधिनियम के प्रारंभ होने से पहले से पथ पर विक्रय कर रहे हैं, को उस व्यक्ति पर प्राथमिकता दी जाएगी, जो पथ विक्रय प्रारम्भ करने के इच्छुक हैं ;

(ज) नगर विक्रय समिति, विक्रय प्रमाण पत्र जारी करने के दौरान वरिष्ठ नागरिक , शारीरिक रूप से विकलांग , एकल माता, विधवा और अनुसूचित जाति, अनुसूचित जनजाति, अन्य पिछड़े वर्ग और अल्पसंख्यकों को प्राथमिकता देगी ;

(झ) किसी भी ऐसे विक्रेता को प्रमाण पत्र जारी नहीं किया जाएगा , जो किसी भी अवैध या अनैतिक व्यवसाय में अन्तर्वलित है और/ या किसी भी ऐसे व्यवसाय में लगा है जो राज्य सरकार या नगरीय स्थानीय प्राधिकरण द्वारा निषिद्ध किया गया है या जो प्ररूप-2 में उल्लिखित किसी शर्त की पूर्ति नहीं करता है । मध्यप्रदेश राजपत्र , दिनांक 29 जून 2020

(2) विक्रय प्रमाणपत्र की वैधता:-

(क) विक्रय प्रमाणपत्र जारी होने की तारीख से 5 वर्ष की कालावधि के लिए वैध होगा;

(ख) विक्रय प्रमाण पत्र आगे 3 वर्ष की कालावधि के लिए नवीकृत किया जा सकेगा ।

(3) विक्रेताओं को पहचान पत्र जारी करने के लिए प्रक्रिया और प्ररूप प्रत्येक व्यक्ति को जो विक्रय प्रमाण पत्र धारण करता है, पहचान पत्र जारी किया जाएगा । पहचान पत्र प्ररूप-4 में जारी किया जाएगा;

(क) पहचान पत्र, नगरीय स्थानीय प्राधिकरण के प्राधिकृत अधिकारी के हस्ताक्षर के अधीन जारी किया जाएगा;

(ख ) पहचान पत्र, में एक फोटो होगी जिस पर जारी करने वाले अधिकारी के हस्ताक्षर होंगे एवं सम्यक रूप से मोहर लगी होगी ;

(ग) पहचान पत्र , के नुकसान या क्षति की दशा में, पथ विक्रेता, नगर विक्रय समिति को डुप्लिकेट पहचान पत्र जारी करने के लिए शपथपत्र, प्रथम सूचना रिपोर्ट की प्रति और पचास रुपए की फीस के साथ आवेदन कर सकता है ।

(4) विक्रय प्रमाणपत्र मंजूर किए जाने और नवीनीकरण के लिए आवेदन :-

(क) कोई व्यक्ति जो पथ विक्रेता के रूप में कारोबर करना चाहता है ऑनलाइन पोर्टल पर नवीनीकरण शुल्क के साथ आवेदन प्रस्तुत कर सकता है ;

(ख) नवीनीकरण शुल्क, नगरीय स्थनीय प्राधिकरण या नगर विक्रय समिति द्वारा समय- समय पर तय किया जाएगा ;

(ग) नगर विक्रय समिति, उन त्रुटिकर्ता (डिफाल्टर) पथ विक्रेताओं की एक सूची प्रकाशित करेगी, जो विनिर्दिष्ट समय के भीतर विक्रय प्रमाणपत्र के नवीकरण के लिए शुल्क जमा करने में विफल रहे हैं । नियत तारीख के पश्चात्, उन पथ विक्रेताओं को नवीनीकरण के लिए एक महीने की सूचना जारी की जाएगी । सूचना कालावधि के दौरान पथ विक्रेता शुल्क के अतिरिक्त प्रतिदिन रूपए 20 / - (बीस रूपय केवल ) भुगतान करने का दायी होगी ।

(घ) पथ विक्रेता, जिसने उपर्युक्त खंड - ग में यथा विनिर्दिष्ट प्रदत्त सूचना के बाद भी, अपने प्रमाणपत्र का नवीनीकरण नहीं कराया है, पर नगर विक्रय समिति उचित कार्रवाई करेगी ।

(ड. ) पथ विक्रेता प्रमाण पत्र के नवीनीकरण के लिए , विक्रय स्थल से ऐसे स्थाई तथा अस्थाई संरचना हटा दे / नष्ट कर दे । 404(5)

(5) विक्रय प्रमाणपत्रों को रद्द करना या निलंबित करना :-

(क) नगर विक्रय समिति, निम्नलिखित किसी एक या अधिक आधारों पर किसी भी पथ विक्रेता के विक्रय प्रमाण पत्र को रद्द कर सकती है, अर्थात्ः-

(एक) अधिनियम या इस योजना में उल्लिखित विक्रय प्रमाणपत्र की किसी भी शर्त का उल्लंघन ;

(

दो) विक्रय प्रमाण पत्र महत्वर्ण तथ्यों का गलत प्रस्तुतिकरण या छिपाकर प्राप्त किया गया है ;

(तीन) झूठे दस्तावेज या फोटो का उपयोग किया गया है ;

(चार) नगरीय स्थानीय प्राधिकरण का मासिक किराया और बकाया का भुगतान करने में विफल रहता है ;

(ख) जहा नगर विक्रय समिति का कारण अभिलेखित करते हुए यह समाधान हो जाता है कि किसी भी आधार पर विक्रय प्रमाण पत्र के रद्ध होने के प्रश्न के लंबित रहते, यह आवश्यक है कि पथ विक्रेता की विक्रय गतिविधियों को ऐसी कालावधि के लिए, जो 30 दिन से अधिक की नही होगी जैसा आदेश में विनिर्दिष्ट किया जाए , लंबित रखना आवश्यक है प्रमाण पत्र को निलंबित कर सकेगा और ऐसे पथ विक्रेता से ऐसा आदेश जारी होने के दिनांक से 15 दिन के भीतर कारण बताने की अपेक्षा की जाएगी कि उसकी विक्रय गतिविधियों का निलम्बन ऐसे विक्रय प्रमाण पत्र के रद्ध रहने के प्रश्न के अवधारण तक क्यों ना बढाया जाए;

(ग ) विक्रय प्रमाण पत्र रद्द करने का कोई आदेश तब तक नहीं दिया जाएगा, जब तक कि व्यक्ति को सुनवाई का उचित अवसर नहीं दे दिया गया हो ;

(घ) जहां नगर विक्रय समिति ने किसी पथ विक्रेता के विक्रय प्रमाणपत्र को रद्द करने का आदेश दिया है, ऐसा विक्रेता, रद्दकरण आदेश में विनिर्दिष्ट अवधि के भीतर नगर विक्रय समिति को अपने विक्रय प्रमाण पत्र और पहचान पत्र को सुपुर्द करेगा और उसका नाम इस प्रयोजन के लिये संधारित पंजी से हटा दिया जाएगा ।

(ड.) पथ विक्रेता शिकायतों की अपील, शिकायत निवारण समिति में करेगा ।

(च) पथ विक्रेता यह सुनिश्चित करेगा कि उसके विक्रय क्षेत्र के निकट अवैध पार्किंग नहीं की जाए ।

(छ) पथ विक्रेता ग्राहकों को आकर्षित करने के लिए किसी प्रकार का शोर-शराबा या ध्वनि नहीं करेगा ।

(ज) सुरक्षा कारणों के आधार पर या आपातिक स्थिति में बिना कारण जाने स्थल को तत्काल खाली कर देगा ।

(झ) पथ विक्रेता, सार्वजनिक सम्पत्ति को किसी भी प्रकार की क्षति नहीं पहुचायेगा यदि पथ ऐसा किया जाता है तो क्षति का खर्च विक्रेता द्वारा वहन किया जाएगा । 1 404(6)

(ञ ) किसी भी प्रकार का बिजली / पानी कनेक्शन विक्रय परिसर में अनुरोध नहीं है । पथ विक्रेता बिना ध्वनिया वायु प्रदूषण के रिन्यूवल बैटरी चलित तरीके का उपयोग करेगा ।

5. विक्रय शुल्क ,-

(1 ) भूमि और नागरिक सुविधाओं की व्यवस्था करने के लिए व्ययों को पूरा करने के लिए, नगरीय स्थानीय प्राधिकरण , विनिश्चित किए अनुसार विक्रय शुल्क प्रभारित करेगा जो नीचे विनिर्दिष्ट राशि से कम का नहीं होगा,

(क) मध्यप्रदेश नगर पालिक निगम अधिनियम , 1956 की धारा 132 (छ) के अनुसार नगरीय स्थानीय प्राधिकरण द्वारा यथा विनिश्चित ;

(ख) मध्यप्रदेश नगर पालिका अधिनियम, 1961 की धारा 127(छ) के अनुसार नगरीय स्थानीय प्राधिकरण के द्वारा यथा विनिश्चित ।

(2) विक्रय शुल्क में प्रतिवर्ष न्यूनतम 5 प्रतिशत की वृद्धि अधिरोपित की जाएगी । (3 ) विक्रय शुल्क संग्रहित करने की रीति: -

(क) धन जमा करने के प्रयोजन के लिए अधिनियम , नियम और योजना के अधीन पथ विक्रेताओं द्वारा देय शुल्क, भाड़ा या जुर्माना या शास्ति के रूप में हो , प्रत्येक नगर विक्रय समिति, किसी भी अधिसूचित बैंक में बैंक खाता खोलेगी जो नगर विक्रय समिति के ऐसे अधिकारी द्वारा संचालित किया जाएगा जैसा कि नगरीय स्थानीय प्राधिकरण द्वारा निर्देशित किया जाए ;

(ख) पथ विक्रेता, शुल्क जिसमें मासिक भाड़ा और अन्य शुल्क सम्मिलित है अपने नाम और उसको आवंटित पंजीकरण संख्या सहित खाते में जमा कर सकेगा तथा नगरीय स्थानीय प्राधिकरण द्वारा तय किसी ऐसी प्रक्रिया द्वारा संदाय किया जा सकेगा ;

(ग) शुल्क के संग्रहण के लिए संबंधित नगरीय स्थानीय प्राधिकरण, नगर विक्रय समिति के परामर्श से, अपनी वैकल्पिक व्यवस्था करने के लिए स्वतंत्र है ;

(4) विद्यमान विधि के अनुसार नगर विक्रय समिति द्वारा खाते का वार्षिक अंकेक्षण किया जाएगा ।

6. विक्रय परिक्षेत्र का समय साझा करना :-विक्रय के समय के विभाजन की प्रक्रियाः- (1 ) नगर विक्रय समिति, स्थान की उपलब्धता महिला विक्रेताओं के सुरक्षा मानकों को को ध्यान में रखते हुए विक्रय समय निर्धारित करेगी ; .

(2) विक्रय के लिए समय आवंटित करते समय पुरुष और महिला विक्रेताओं को ऐसे आवंटन से संबंधित नियम और मानदंड बिना किसी भेदभाव के समान रूप से लागू होंगे ;

(3) विक्रय परिक्षेत्रों में उपलब्ध स्थान से विक्रेताओं की संख्या अधिक होने की दशा में, विक्रेताओं को अलग-अलग पाली में विक्रय के लिए समय अवधि आवंटित की जाएगी । यह सभी विक्रेताओं को आजीविका को बढ़ावा देने के लिए और विक्रय क्षेत्र में स्वच्छता के मानकों को बनाए रखने समान अवसर प्रदान करेगा;

(4) जहां विक्रय गतिविधियां ऐसे बाजारों के खुलने से पहले सम्पन्न होती हैं, जिसका कार्य विक्रय परिक्षेत्रों के स्थान पर होता है, ऐसे विक्रेताओं को इस तरह के बाजार खुलने से पहले स्थान रिक्त करने के लिए सख्त निर्देश देना होगा । इसके अलावा, उन्हें ऐसे विक्रय क्षेत्रों की साफ सफाई एवं व्यवस्था को बनाए रखना होगा ;

(5) नगर विक्रय समिति , बाजार की जरूरतों और पथ विक्रेताओं के लिए जगह पर निर्भर रहते हुए समय- साझाकरण के आधार पर विक्रय संबंधी गतिविधियों का निर्धारण करेगी ;

7. प्रतिबंध- मुक्त- विक्रय क्षेत्र, प्रतिबंधित विक्रय क्षेत्र और विक्रय निषेध क्षेत्र के रूप में विक्रय परिक्षेत्रों के निर्धारण करने का सिद्धांत :-

(1 ) गली, स्थिति, सड़क और वाहनों और पैदल यात्री आवागमन का घनत्व विक्रय और विक्रय निषेध क्षेत्र निर्धारित करने के लिए निश्चायक कारक होंगे ;

(2) नगर विक्रय समिति, प्रतिबंध मुक्त विक्रय क्षेत्र, विक्रय निषेध क्षेत्र, प्रतिबंधित विक्रय क्षेत्र, विशेष सड़क या बाजार का निर्धारण, नगरीय स्थानीय प्राधिकरण के साथ मिलकर उचित रीति के साथ करेगी ।

(3) चलित विक्रय को यातायात और पैदल आवागमन को देखते हुए अनुमति दी. जाएगी ।

8. विक्रय निषेध क्षेत्र

(1 ) सचिवालय, जिला कलेक्टरेट, जिला पंचायत, नगर निगम, नगर पालिका, नगर पंचायत, कैन्टोनमेंट बोर्ड के कार्यालय तथा भारतीय पुरातत्व सर्वेक्षण और राज्य पुरातात्विक स्थलों के दो सौ मीटर का क्षेत्र ; और

(2) क्रॉसिंग के दो या अधिक ओर पचास मीटर का क्षेत्र तथा नगरीय स्थानीय प्राधिकरण द्वारा घोषित विरासत संरचना;

(3) नगरीय स्थानीय प्राधिकरण द्वारा यथा निर्धारित अन्य क्षेत्र ।

9. विक्रय परिक्षेत्र की धारण क्षमता निर्धारित करने के लिए सिद्धांत :-

(1 ) विक्रय क्षेत्र की धारण क्षमता निर्धारित करने के निम्नलिखित सिद्धांत होंगे ;

(क) वार्ड या क्षेत्र की आबादी का 2.5 प्रतिशत समायोजित किया जाएगा ;

(ख) विक्रय क्षेत्र की धारण क्षमता विक्रय क्षेत्र के कुल क्षेत्र द्वारा विभाजित विक्रय स्थल के अनुसार होगी ;

(2 ) नगर विक्रय समिति द्वारा निम्न मानदंडों को विक्रय क्षेत्र निर्धारित करने में ध्यान में रखा जा सकेगा, अर्थात्ः-

(क) प्रत्येक विक्रेता / हॉकर को अधिकतम 2 वर्ग मीटर क्षेत्र का विक्रय क्षेत्र प्रदान किया जाएगा ;

(ख ) स्टालों / हाथ ठेला (गाड़ी) के सामने 1.0 मीटर / 2.0 मीटर की चौड़ाई का मार्ग उपभोक्ताओं / उपयोगकर्ताओं को खड़े होने / सामान खरीदने के लिए विस्तार के रूप में आरक्षित किया जाएगा ;

(ग) किसी भी दशा में, फुटपाथ का उपयोग पथ विक्रय के लिए किए जाने की अनुमति नहीं दी जाएगी ;

(घ) यदि पथ की चौड़ाई अनुमति देती है तो पथ के दोनों किनारों पर पथ विक्रय की अनुमति दी जा सकेगी ; और

(ड.) पथ के किसी भी जोड़ / निकास / प्रवेश से 50 मीटर की दूरी पर किसी प्रकार की विक्रय गतिविधि की अनुमति नहीं दी जाएगी ।

10. पथ विक्रेताओं का पुनर्वास और निष्कासन :-

(1 ) विक्रेता का पुनर्वास जब भी नगर विक्रय समिति यह महसूस करती है कि निम्नलिखित सार्वजनिक उद्देश्यों में किसी के लिए किसी क्षेत्र या उसके किसी भाग को विक्रय निषेध क्षेत्र घोषित किए जाने की आवश्यकता है,

(क) यदि यातायात सुविधाजनक और व्यवस्थित नहीं है ;

(ख) यदि विक्रय क्षेत्र में अधिक भीड़ है ;

(ग) यदि विक्रय क्षेत्र संकीर्ण मार्ग में है ;

(घ) सड़क चौड़ी करते समय ;

(ড) मास्टर प्लान के उल्लंघन की स्थिति में ;

(च) सुरक्षा के दृष्टिकोण से, अति विशिष्ट या महत्वपूर्ण व्यक्ति के घर के अंदर और आसपास ;

(छ) विक्रय क्षेत्र के किनारों के मार्गों पर, यदि टेलीफोन लाइन, विद्युत लाइन , जल निकास निर्माण , पथ के किनारों का सौंदर्गीकरण प्रस्तावित है या अन्य उद्देश्य के लिए शासकीय भूमि पर स्थित है ;

(ज) किसी भी अन्य सार्वजनिक उद्देश्य के लिए जिसका उल्लेख ऊपर नही किया हो ;

तो नगर विक्रय समिति, विक्रय हेतु उपयुक्त जगह पर स्थानांतरित करने के लिए नगरीय स्थानीय प्राधिकरण को अनुशंसा करेगी । (2) नगरीय स्थानीय प्राधिकरण , उस क्षेत्र के पथ विक्रेताओं को किसी विक्रय निषेध क्षेत्र की घोषणा की तारीख से 30 दिन पहले सूचित करेगा और उन्हें उन क्षेत्रों के बारे में भी सूचित करना चाहिए जिसमें प्रभावित पथ विक्रेताओं को स्थानांतरित किया जाएगा ;

(3) सूचना में समय सीमा का भी उल्लेख होना चाहिए , जिसमें विक्रेताओं को विद्यमान विक्रय क्षेत्र खाली करना होगा ;

(4) यदि पथ विक्रेता सूचना में निर्दिष्ट अवधि के भीतर कोई विक्रय निषेध क्षेत्र को खाली करने में विफल रहता है तो वह विधि अनुसार निष्कासन का दायी होगा;

(5) कोई पथ विक्रेता, जो विक्रय प्रमाणपत्र के बिना या जिसका विक्रय प्रमाणपत्र धारा 7 के तहत रद्द कर दिया गया है, विक्रय गतिविधि पर व्यवसाय जारी रखता है तो नगरीय स्थानीय प्राधिकरण द्वारा उचित रीति के साथ बेदखल किया जाएगा ।

11. सामाजिक अंकेक्षण :-

(1 ) नगर विक्रय समिति की गतिविधियों के सामाजिक अंकेक्षण के लिए प्ररूप और प्रक्रिया:-

(क) नगर विक्रय समिति, अधिनियम, नियम या योजना के अधीन निष्पादित की गई अपनी गतिविधियों के सामाजिक अंकेक्षण के उद्देश्य से तीन सदस्यीय इकाई का गठन करेगी ;

(ख) सामाजिक अंकेक्षण इकाई एक स्वतंत्र निकाय होगा और इसमें निम्नलिखित सम्मिलित होंगे :-

(एक) समाजशास्त्र के क्षेत्र में एक प्रख्यात विद्वान ;

(दो) एक प्रख्यात सामाजिक कार्यकर्ता ;

(तीन) एक सेवानिवृत्त प्रशासक ;

(ग) सामाजिक अंकेक्षण प्रत्येक तीन वर्षों में कम से कम एक बार किया जाएगा । सामाजिक अंकेक्षण आयोजित करने की योजना कम से कम तीन माह पूर्व विनिश्चित की जाएगी ;

(घ) नगर विक्रय समिति, सामाजिक अंकेक्षण प्रक्रिया शुरू होने से कम से कम एक पखवाड़े पूर्व अंकेक्षण इकाई की सभी सुसंगत जानकारी का विवरण प्रदान करेगी । ऐसे विवरण में निम्नलिखित सम्मिलित होगी,

(एक) पथ विक्रेताओं के लिए अधिनियम , नियम और योजना के क्रियान्वयन कीस्थिति :

(दो) उन वर्षों में आयोजित नगर विक्रय समिति की बैठकों के कार्यवाही विवरणों के अभिलेख ;

(तीन) सभी पंजीकृत पथ विक्रेताओं का अभिलेख ;

(चार) अधिनियम की धारा 11 के अधीन स्थानीय प्राधिकारी के समक्ष प्रस्तुत की गई अपीलों का अभिलेख ;

(पांच) अधिनियम की धारा 20 के अधीन गठित शिकायत निवारण समिति के समक्ष लायी गई सभी शिकायतों या विवादों का अभिलेख ;

(छह) किये गए निष्कासनों की कुल संख्या, सामानों की जब्ती और उन वर्षों में किये गये पथ विक्रेताओं के पुनर्वास का अभिलेख ; और (सात) सामाजिक अंकेक्षण प्रतिवेदन यदि कोई हो, का अभिलेख ।

(2) सामाजिक अंकेक्षण इकाई की बैठक और कार्यप्रणाली :-

(क) सामाजिक अंकेक्षण इकाई, बैठक आयोजित करेगी तथा अधिनियम , नियमों और योजना के क्रियान्वयन के विभिन्न पहलुओं पर पथ विक्रेताओं के साथ समूह चर्चाओं पर ध्यान देगी ;

(ख) अंकेक्षण इकाई, पथ विक्रेताओं की किसी भी विषय अथवा समस्या पर शिकायतों को लिखित रूप में दर्ज करेगी तथा निष्कर्ष अभिलिखित करेगी;

(ग) अंकेक्षण इकाई, सामाजिक अंकेक्षण सार्वजनिक बैठक की सार्वजनिक सूचना पर्याप्त अग्रिम में देगी ;

(घ) अंकेक्षण इकाई, नगर विक्रय समिति कार्यालय में एक सामाजिक अंकेक्षण सार्वजनिक बैठक आयोजित करेगी । समिति के सदस्य और स्थानीय प्राधिकरण के प्रतिनिधि इस बैठक में भाग लेंगे । अंकेक्षण इकाई, वैठक में अपने निष्कर्षों को पढ़ेगी । पथ विक्रेताओं को गवाही देने के लिए प्रोत्साहित किया जाएगा और नगर विक्रय समिति, सामाजिक लेखा परीक्षा में चिन्हित किए गए प्रत्येक मुद्दे पर प्रभावित पक्षकार और जनता को स्पष्टीकरण देकर प्रतिक्रिया देगी कि क्यों कुछ निश्चित कार्यवाही की गई. या क्यों नहीं की गई ;

(ङ) स्थानीय प्राधिकरण , अंतराल, चूक या विचलन के मामलों में सामाजिक अंकेक्षण इकाई के प्रत्येक निष्कर्ष पर जबावदेही तय करेगा और तत्काल सुधारक उपाय या उचित आवश्यक कार्रवाई करेगा ;

(च) सामाजिक अंकेक्षण सम्पादित करने की लागत, नगर विक्रय समिति के बजट के प्रावधानों से पूरी की जाएगी ;

(छ) सामाजिक अंकेक्षण संपादित करने की सांविधिक आवश्यकता खातों के सामान्य अंकेक्षण को पूरा करने के लिए किसी भी अन्य स्वतंत्र पहल को नहीं रोकेगी ।

12. पथ विक्रेताओं के संबंध में नगर विक्रय समिति, नगरीय स्थानीय प्राधिकरण , योजना प्राधिकरण और राज्य नोडल अधिकारी द्वारा उचित अभिलेखों और अन्य दस्तावेजों के रखरखाव की प्रक्रिया, -

(1 ) संचालनालय , नगरीय प्रशासन और विकास द्वारा पथ विक्रेताओं के अभिलेख रखने के लिए ऑन-लाइन सॉफ्टवेयर विकसित किया जा सकेगा ;

(2) नगरीय स्थानीय प्राधिकरण , ऑनलाइन प्रक्रिया के माध्यम से सर्वेक्षण किए गए पथ विक्रेताओं का डाटा दर्ज करेगा ;

(3) विक्रय प्रमाणपत्र और पहचान पत्र ऑन - लाइन तैयार किया जा सकता है ;

(4) नगरीय स्थानीय प्राधिकरण की वेबसाइट विक्रय परिक्षेत्रों और पथ विक्रेताओं का विवरण प्रदर्शित करेगी ।

13. सार्वजनिक स्वास्थ्य और स्वच्छता :- सार्वजनिक स्वास्थ्य और स्वच्छता रखने के लिए निम्नलिखित मानदंडों का पालन किया जाना चाहिए,

(1 ) नगरीय स्थानीय प्राधिकरण एक स्वच्छ वातावरण को बनाए रखने के लिए अपनी अपशिष्ट सामग्री का निपटान करने के लिए पथ विक्रेताओं को उचित स्थान उपलब्ध करेगा ;

(2) पथ विक्रेता, नगरीय स्थानीय प्राधिकरण या नगरीय स्थानीय प्राधिकरण की ठोस अपशिष्ट प्रबंधन प्रणाली द्वारा निर्धारित अपशिष्ट निपटान मानदंडों के अनुसार अपशिष्ट सामग्री का निपटान करने के लिए उचित ढक्कन युक्त कूड़ेदान (डस्टविन) का उपयोग करेगा । पथ विक्रेता, नगरीय स्थानीय प्राधिकरण द्वारा ठोस अपशिष्ट प्रबंधन (एसडब्ल्यूएम ) के लिये निर्धारित मानदंडों के अनुसार स्वच्छता शुल्क का भुगतान भी करेगा ;

(3) नगरीय स्थानीय प्राधिकरण जहां तक संभव हो वहां विद्युत / सड़क प्रकाश (स्ट्रीट लाईट) की सुविधा के साथ पथ विक्रेताओं को स्वच्छ और ताजा जल उपलब्ध करना सुनिश्चित करेगा ;

(4) नगरीय स्थानीय प्राधिकरण सार्वजनिक स्वास्थ्य और स्वच्छता बनाए रखने के लिए पर्याप्त पानी और विद्युत के साथ शौचालय सुविधा उपलब्ध करेगा ;

(5) अपशिष्ट सामग्री के निपटान के लिए नगरीय स्थानीय प्राधिकरण द्वारा उपयुक्त संख्या में कूड़ेदान उपलब्ध जाएंगे ;

(6) नगर विक्रय समिति, पथ विक्रेताओं के लिए समूह बीमा योजना शुरू कर सकेगी ।

14. राज्य नोडल अधिकारी :

(1 ) राज्य स्तर पर पथ विक्रय से संबंधित सभी मामलों को समन्वित करने के प्रयोजन से , आयुक्त, नगरीय प्रशासन और विकास विभाग , एक राज्य नोडल अधिकारी नियुक्त करेगा, जो संयुक्त संचालक, नगरीय प्रशासन और विकास संचालनालय के पद से अनिम्न श्रेणी का नहीं होगा ;

(2) नोडल अधिकारी, जैसा और जब वह उचित समझे, नगर विक्रय समिति के अभिलेख का निरीक्षण करेगा या निरीक्षण करवाएगा

(3) पथ विक्रेताओं की स्थिति को अद्यतन करने के लिए नोडल अधिकारी , नगरीय स्थानीय प्रधिकरण के साथ कम से कम एक अर्ध- वार्षिक बैठक करेगा और उनकी सामाजिक सुरक्षा सुनिश्चित् करने के लिए पथ विक्रेताओं से प्रतिक्रिया ले सकेगा और नगर विक्रय समिति सहित नगरीय स्थानीय लोक प्राधिकरण के साथ समन्वय कर सकेगा ;

(4) राज्य सरकार, यदि आवश्यक हो, पथ विक्रेताओं के अधिकतम हित और योजना के प्रभावी क्रियान्वयन के लिए समय- समय पर कार्यपालिक निर्देश जारी कर सकती है । 404(12)

सर्वेक्षण दल / संस्था के लिए निर्देशः-

(क) सर्वेक्षण दल / संस्था नगर विक्रय समिति के निर्देशन और मार्गदर्शन के अधीन सर्वेक्षण कार्य पूर्ण करेगा ।

(घ) सर्वेक्षण प्रारूप में एकत्रित की गई जानकारी का डाटाबेस सर्वेक्षण दल / संस्था द्वारा यथाशीघ्र तैयार किया जाएगा ।

(ङ) सर्वेक्षण दल / संस्था द्वारा विक्रेताओं का वार्डवार सर्वेक्षण किया जाएगा । (च) सर्वेक्षण के दौरान सर्वेक्षण दल / संस्था पथ विक्रेताओं या उनके परिवार के सदस्यों में भय या लालच उत्पन्न नहीं करेगा ।

अंतिम पृष्ठ

'निम्नलिखित शर्तों के अधीन पथ विक्रय प्रमाण पत्र दिया जाता है

(1) विक्रय प्रमाणपत्र भूमि का स्वामित्व प्रदान नहीं करता है, बल्कि केवल कुछ शर्तों के आधार पर भूमि का उपयोग करना प्रदान करता है ।

(2) विक्रेता आवंटित स्थान पर किसी भी स्थायी संरचना का निर्माण नहीं करेगा ।

(3) नगरीय स्थानीय प्राधिकरण , धारा 10 के अधीन यथा विहित आधारों पर पथ विक्रेताओं को अन्य स्थान पर स्थानांतरित करने का अधिकार रखता है ।

(4) विक्रय प्रमाणपत्र को दूसरों को हस्तांतरित/ पट्टे / भाड़े पर या बेचा नहीं जा सकता है । पथ विक्रेता द्वारा नगर विक्रय समिति को एक वचनपत्र प्रस्तुत किया जाए ।

(5) पथ विक्रेता केवल उस व्यवसाय की उन वस्तुओं को बेच सकता है जिसके लिए पथ विक्रय प्रमाणपत्र जारी किया गया है ।

(6) पथ विक्रेता पथ विक्रय प्रमाणपत्र पर उल्लिखित विशिष्ट स्थान और समय पर अपना व्यवसाय कर सकता है । (7) प्रमाणपत्र में उल्लिखित अवधि समाप्त होने के बाद पथ विक्रय प्रमाणपत्र समाप्त हो जाएगा । पथ विक्रेता की समाप्ति के पहले प्रमाणपत्र को नवीनीकृत करने के लिए पूरी जिम्मेदारी होगी ।

(8) यदि एक पथ विक्रेता जिसे पथ विक्रय प्रमाणपत्र जारी किया गया है, की मृत्यु हो जाती है तो या किसी स्थायी विकलांगता से पीड़ित है या बीमार है पर अपने परिवार के किसी सदस्य या तो पति (पत्नी) या आश्रित संतान जो प्रमाण पत्र में सूचीबद्ध है, वह उसकी ओर से व्यवसाय कर सकता है ।

विक्रेता पथ विक्रय प्रमाणपत्र में उल्लिखित अपनी श्रेणी के अनुसार व्यवसाय कर सकता है ।

यदि कोई पथ विक्रेता, समय साझा करने के आधार पर स्थान पर रहता है, तो वह उसे आवंटित समय- साझाकरण की अवधि के अंत में प्रतिदिन अपने सामान और माल को निकाल लेगा । (10)

(11) प्रत्येक पथ विक्रेता, विक्रय क्षेत्र और आसपास के क्षेत्रों में स्वच्छता और सार्वजनिक स्वच्छता बनाए रखेगा । प्रत्येक पथ विक्रेता विक्रय क्षेत्र में नागरिक सुविधाओं और सार्वजनिक संपत्ति को अच्छी स्थिति में बनाए रखेगा और न ही उसे नुकसान पहुंचाएगा और न ही किसी को पहुंचाने देगा ।

(12) प्रत्येक पथ विक्रेता विक्रय क्षेत्र में उपलब्ध नागरिक सुविधाओं के लिए नगरीय स्थानीय प्राधिकरण द्वारा समय- समय पर निर्धारित आवधिक रखरखाव शुल्क का भुगतान करेगा ।

(13) यह विकय प्रमाणपत्र आवंटित विक्रय क्षेत्रों में विक्रय गतिविधियों को चलाने का कोई अस्थायी, स्थायी या शास्वत अधिकार प्रदान नहीं करता है ।

(14) यदि एक पथ विक्रेता का शिकायत या विवाद है तो वह उस शिकायत या विवादों को हल करने के लिए नगरीय स्थानीय प्राधिकरण द्वारा गठित समिति को लिखित आवेदन सकेगा।

(15) प्रत्येक पथ विक्रेता को यातायात नियमों का पालन करना पड़ता है और यातायात को बाधा उत्पन्न नहीं करनी चाहिए । विक्रेता किसी भी तरह से यातायात और पैदल चलने वालों के स्वतंत्र आवागमन में बाधा नहीं डालेगा ।

(16) नगरीय स्थानीय प्राधिकरण के अधिकारियों की मांग पर विक्रेता को पथ विक्रय प्रमाणपत्र दिखाना होगा । (17) प्रत्येक पथ विक्रेता उचित तरीके से सुसज्जित होगा और किसी भी अवैध या अनैतिक गतिविधि में सम्मिलित नहीं होगा ।

किसी पथ विक्रेता को ड्रग्स या अल्कोहल या विस्फोटक जैसे पदार्थ विकय नहीं करना चाहिए । (18)

(19) प्रत्येक पथ विक्रेता को नगरीय स्थानीय प्राधिकरण या राज्य सरकार द्वारा समय- समय पर जारी किसी निर्देश या अनुदेश का पालन करना होगा । 404(17)

Noti . 99 F - 1-04-2017-18-3.- In exercise of the powers conferred by section 38 ( 1 ) of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act , 2014 (No. 7 of 2014) and all other powers enabling him in this behalf, the government of Madhya Pradesh , is pleased to make the following scheme for welfare & providing opportunity to street vendors to earn livelihood , namely : -

Scheme

1. Short title , Extent and Commencement: -

(1 ) This scheme may be called the Madhya Pradesh Street Vendors ( Protection of Livelihood and Regulation of Street Vending ) Scheme , 2020. (2 ) It shall extend to the whole State of Madhya Pradesh; (3 ) It shall come into force from the date of its publication in the Official Gazette of Madhya Pradesh

2. Definitions.-

(1) In this scheme, unless the context otherwise requires , -

(a) " Act " means the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act , 2014 (no . 7 of 2014 ) ;

(B) " Festive Market " means a market where sellers and buyers have traditionally congregated for the sale and purchase of products or services during festival season and has been determined as such by the Urban Local Authority on the recommendations of the Town Vending Committee;

(e) " Form " means Forms appended to this scheme ;

(d) "Heritage Market " means a market which has completed more than fifty years in one place where sellers and buyers have traditionally congregated for the sale and purchase of products or services and has been determined as such by the 404(23)

Urban Local Authority on the recommendation of the Town Vending Committee;

(c) "Natural Market " means a market where sellers and buyers have traditionally congregated for the sale and purchase of niche products or services and has been determined as such by the Urban Local Authority on the recommendation of the Town Vending Committee ;

(f) " Night Market " means a market where sellers and buyers have traditionally congregated for the sale and purchase of products or services after evening i.e. during night and has been determined as such by the Urban Local Authority on the recommendation of the Town Vending Committee ;

(g) " Plan" means the plan prepared to promote the vocation of street vendors covering the matter contained in the First Schedule appended to the Act ;

(h) " Public Purpose " in the context of the Act includes , -

(i ) Widening of roads , streets , lanes ;

(ii ) Shifting the alignment of roads , streets , lanes ;

(iii) Construction of flyovers without slip down roads ;

(iv) Construction of underpasses ;

(v) Development of land owned by public authorities for some public projects ;

(vi) Laying of water , storm water or sewer lines ;

(vii) Erecting intermediate pumping stations for the services ;

(viii ) Any project related with public transport like Bus Rapid Transit System , Metro etc ;

(ix) Construction of Economically Weaker Section ( EWS ) housing ;

(x) Development and maintenance of parks , gardens and recreational area;

(xii )Any other development work taken up by the Urban Local Authority and/or the State government , the beneficiary of which will be the community at large;

(i) "Rules " means the Madhya Pradesh Street Vendors ( Protection of livelihood and Regulation of Street Vending ) Rules , 2017;

(j ) " Seasonal Vendors " means street vendors who carry out vending activities on specific seasons and has been determined as such by the Urban Local Authority on the recommendation of the Town Vending Committee ;

(k ) " Section " means section of the Act;

(1 ) "Stationary Vendors " means street vendors who carry vending activities on regular basis at a specific location e.g. those occupying space on the pavements or other public places and/or private areas either open/covered (with implicit or explicit consent) of the authorities;

(m) "Weekly Market " means a market where sellers and buyers have weekly congregated for the sale and purchase of products or services and has been determined as such by the Urban Local Authority on the recommendations of the Town Vending Committee .

(2) The words and expressions used but not defined in this scheme shall have the same meanings as assigned to them in the Act or the Rules .

3. Manner of conducting survey of street vendors.-

(1) The Town Vending Committee (TVC) , after the date of commencement of this scheme shall conduct survey to identify all existing street vendors within the area of its jurisdiction and subsequent survey shall be carried out at least once in every 03 years .

(2) The Town Vending Committee (TVC) shall keep ward wise data of street vendors , in the survey.

404(25) (3) Manner of survey shall be as follows , -

( a) Street vendors will register themselves by putting their Aadhar and SAMAGRA through the portal prepared by Directorate , Urban Administration and Development ;

(b) Urban local authorities shall be responsible for taking necessary and appropriate actions for motivation for self- registration of street vendors ;

(c) An officer from the urban local authority or City Mission Manager , Deendayal Antyoday Yojna will be accountable for verification of such applications ;

(d) Street vender will get identity card or certificate of vending through the portal or through Urban Local Authority .

4. Vending Certificate , Identity Card , Validity , Renewal , Cancellation or Suspension of Vending Certificates :

(1) Issuance of vending certificate : - The criteria for issuing vending certificate would be as under : -

(a) The street vendor identified in the survey shall be issued certificate in form - 2 by the Town Vending Committee within a maximum period of 30 days from the date of completion of survey .

(b) Vending Certificate shall not be issued to a street vendor ; if he/she

(i) is not citizen of India and is not of sound mind;

(ii ) has any other means of livelihood;

(iii ) has any other vending site in any other place ;

(iv) does not carry on the vending himself or through his family members who are above eighteen years of age;

(v) does not complete the age of eighteen years .

(d) Street vendors shall provide undertaking on following points at the time of online application , - मध्यप्रदेश राजपत्र, दिनांक 29 जून 2020

(i) the vending certificate shall be used by the vendor only for self or dependents of family member;

(ii) the vending certificate can't be leased , rented or sold to any other person. Anundertaking in this respect shall be submitted by the street vendors to the TVC;

(iii) the vendors shall confirm that they are not allocated any other public space, store within the limits of Urban Local Authority;

(iv) the vendors shall confirm that either of their dependent or family members (wife/son) has not been issued a vending certificate;

(v) the vendor shall not use vending certificate for the vending of any unethical and illegal business or any kind of drug/ intoxicating substance;

(vi) the vendor will not use the certificate for vending any kind of explosive materials;

(vii) the vendor shall follow the sanitation and hygiene rules in vending zone ;

(viii) the vendor shall not use any type of polythene bags ;

(ix) the vendor shall follow the orders issued by the Urban Local Authority and State Government from time to time;

(x) the vendor shall abide and follow all the conditions mentioned in vending certificate;

(xi) all the information given in the application and documents submitted along with it are correct and bona - fide and if found otherwise , vending certificate shall be cancelled by the authority .

(c) New street vendors who wish to carry on street vending during the intervening period of two surveys , shall apply online through self- registration process . Online application will be a continue process .

(f) The vending certificate will have a photograph of the person carrying on vending activity and in case of family members involved in vending at vending site, in such situation the said persons shall be covered in that photograph.

(g) Person who are carrying on street vending prior to commencement of the Act shall be given preference over the person who are intending to start street vending.

(h) The town vending committee (TVC) while considering for issue of vending certificate shall also give preference to senior citizen, physically challenged, 404(27)

single mother , widow as well as scheduled castes , scheduled tribes , other backward classes and minorities .

(i ) Certificate shall not be issued to any vendor, if involved in any illegal or immoral occupation and /or in any occupation which is prohibited by the State Government or by the Urban Local Authority or who does not fulfill any condition mentioned in Form -2 .

(2) Validity of vending certificate.-

(a) vending certificate will be valid for a period of 5 years from the date of issuance ;

(b) the vending certificate can be renewed for a further period of 3 years .

(3) Method and format to issue identity card to vendors . - Every person who is holding a vending certificate shall be issued with an identity card . The identity card shall be issued inForm-4;

(a) identity card will be issued under the signature of authorized officer of Urban Local Authority;

(b) identity card must contain a photograph which should be signed by issuing officer , with duly stamped;

(c) in case of loss or damage of identity card , the street vendor may apply for issuance of duplicate identity card to the town vending committee accompanied with an affidavit , copy of FIR and fee of fifty rupees .

(4) Application for Grant and Renewal of vending certificate.-

(a) Any person who intends to carry on business as street vendor , may apply through online portal with renewal fee .

(b) Renewal fee will be decided by the Urban Local Authorities or Town Vending Committee time to time .

(c) The Town Vending Committee shall publish a list of defaulter street vendors who have failed to deposit the fees for renewal of vending certificate within specified time. During the period of notice , the street vendor shall be liable to pay Rs . 20/- (Rupees Twenty only) per day as penalty in addition to fee ;

(d) Street vendors who have not got their certificate renewed even after first notice served as specified in clause - ' c ' as above the town vending committee will take appropriate action.

(e ) For the renewal of vending certificate the street vendor should dismantle/destroy all such permanent or temporary structure made by him , from the vending place.

(5) Cancellation or Suspension of Vending Certificates . -

(a) The Town vending committee may cancel the vending certificate of any street vendor on any one or more of the following grounds , namely: -

I. breach of any of the conditions of vending certificate mentioned in the Act or in this Scheme ;

II . the Vending Certificate has been obtained on misrepresentation or suppression of material facts;

false document or photograph has been used;

IV. fails to pay the monthly rent and dues of the Urban Local Authority and .

(b) Where the Town Vending Committee , for reason to be recorded in writing, is satisfied that pending the question of cancellation of the vending certificate on any of the ground, it is necessary to suspend the street vendor from the vending activities for such period not exceeding thirty days as specified in the order may suspend the certificate and require such street vendor to show cause within 15 days from the date of issue of the order , as to why the suspension of vending activities should not be extended till the determination of the question of cancellation of such Vending Certificate .

(c) No order of cancellation of vending certificate shall be made , unless the person concerned has been given a reasonable opportunity of being heard.

(d) Where the Town Vending Committee has made an order cancelling the vending certificate of a street vendor , such vendor shall surrender his certificate of vending and identity card to the town vending committee within the period as 404 (29)

specified in the order of cancellation and his name shall be struck off from the register maintained for the purpose .

(e) Street vendor may appeal its concern in grievance redressal committee.

(f) Street vendor should ensure that any illegal parking shall not be made around its vending place.

(g) Street vendor shall not use or create any sound or noise to attract the consumers .

(h) Due to security reasons or any emergency the vendor shall vacant the place immediately without asking any reason .

(i) Street vendor shall not damage any public property, if it is happened so the cost ofrepairing will be borne by the vendor .

(j ) Electricity or water connection is not permissible at the vending place . The street vendor shall use renewable battery operated devices without sound or air pollution.

5. Vending Fees.-

(1 ) In order to meet the expenses for making arrangement of land and civic amenities , the Urban Local Authority shall charge the vending fee, as decided by it but not less than the amount as specified below, -

(a) as decided by urban local authority according to section 132 (g ) of the Madhya Pradesh Municipal Corporation Act , 1956 ;

(b) as decided by urban local authority according to section 127 (g ) of the Madhya Pradesh Municipalities Act, 1961 .

(2) every year a minimum 5 % increase in vending fees shall be imposed.

(3 ) manner of collecting vending fees , -

(a) for the purpose of deposit of money , whether as a fee , rent or fine or penalty, payable by the street vendors under the Act, Rules and the Scheme, every Town Vending Committee shall open a bank account in any scheduled bank, which shall be operated by such officer of the Town Vending Committee as the Urban Local Authority may direct ;

(b) the street vendor may deposit the fees including monthly rent and such other fee in the account with his name and Registration Number allotted to him and may also be paid by any such process established by the Urban Local Authority;

(c) the Urban Local Authority concerned is free to make its own alternative arrangement for collection of fees , in consultation with Town Vending Committee .

(4) An annual audit of the account will be carried out by the Town Vending Committee as per prevailing laws .

6. Time sharing of vending zones.- The manner of distribution of the time of Vending: - ( 1 ) the Town Vending Committee shall determine the vending time taking into account the availability of space and securing standards of female vendors ;

(2) in allotting time span for vending the male and female vendors shall be treated cqually without any discrimination in the rules and parameters concerned with such allotment;

(3) in case the number of vendors in vending zones exceeds the space available , vendors shall be allotted time- spans for vending in different shifts . This will provide equal opportunity to all vendors in the promotion of their livelihood and in maintaining standards of hygiene at the vending zone;

(4) where vending activities take place before the opening of markets that function in the location of such vending zone , vendors have to be given strict instructions to vacate the place before such opening . Further , they will also have to maintain cleanliness and order of such vending zones ; :

(5) the Town Vending Committee shall determine the vending activities on time-sharing basis depending on the market needs and space to the street vendors .

7. The Principles for Determining of Vending Zones as Restriction- Free -Vending Zones , Restricted- Vending Zones and No -Vending Zones.-

(1) Foot fall , status , road with and density of the vehicular and pedestrian movement shall be the deciding factor for determining vending and no vending zone .

(2) Town Vending Committee will decide free vending zones , restricted vending zones , no vending zones , special road or market in consultation with Urban Local Authority.

(3 ) The mobile vending shall be allowed on the road keeping the traffic and pedestrian movement in the view .

8. No Vending Zone.-

(1) Area of two hundred meters of the Secretariat , District Collectorate , offices of District Panchayat , Municipal Corporation, Municipality, Nagar Panchayat , Cantonment Board, Archaeological survey of India and State Archaeological Monuments ; and

arca of fifty meters from crossing of two or more on all sides and any declared heritage structure by Urban Local Authority; (2)

(3) other areas as decided by Urban Local Authority .

9. Principles to determine the holding capacity of vending zone.-

(1) The following shall be the principles for determining the holding capacity of vending zone;

(a) 2.5% of the population of the ward or zone shall be accommodated;

(b) the holding capacity of a vending zone will be according to the vending site divided by the total area of the vending area.

(2) The following criteria may be kept in the mind by the Town Vending Committee in determining the vending zones , namely: -

(a) a maximum of 2 square meters area as ' vending area ' shall be provided to cach vendor/hawker;

(b) passage of 1.0/2.0 meter width in front of stalls/push carts shall be reserved as 'extension' , for consumers /users to stand or buy goods ;

(e) no vending activity shall be allowed at a distance of 50 meters from any junction/exit/ entry of road .

10. Relocation and eviction of street vendors.-

(1 ) Whenever Town Vending Committee feels that there is a need to declare a zone or part of it to be no vending zone for any of the following public purpose-

(a) if the traffic is not convenient and systematically organized;

(b) if the vending zone is overcrowded;

(d) at the time of widening of the road;

(e) in the event of violation of the master plan;

(f) in and around of the very special or important personality house , from safety point ofview;

(g) on the side ways of vending zone , if there is proposal for telephone line , electric line, drainage construction , beautification of road side or if it is located on government land for other purpose ;

(h) for any other public purpose not mentioned above ;

then the Town Vending Committee shall recommend the same to the Urban Local Authorityto relocate it at suitable place for vending .

(2) The Urban Local Authority shall intimate the street vendors of that zone 30 days prior to date of declaration of no vending zone and should also intimate about the area in which the affected street vendors will be relocated .

(3) The notice should also mention the time line in which the vendors have to vacate the existing vending zone .

(4) If the street vendors fails to vacate the intended no vending zone within the period specified in the notice shall be liable for eviction as per law.

(5) Any Street Vendor who carry on business on vending activities without having a vending certificate or whose vending certificate has been cancelled under section- 7 shall be evicted by the Urban Local Authority by taking appropriate and legal action.

11. Social Auditing.-

(1) The form and the manner for carrying out social audit of the activities of Town Vending Committee:-

(a) The Town Vending Committee shall constitute a unit of three members for the purpose of carrying out social audit of its activities required to be performed under the provisions of the Act, Rules or the Scheme .

(b) The social audit unit shall be an independent body and shall consist of-

(i ) an eminent academician in the field of sociology;

(ii) an eminent social activist ; and

(iii ) a retired administrator .

(c ) The social audit shall be carried out at least once in every three years . The schedule for conducting social audit shall be decided at least three months advance.

(d) The Town Vending Committee shall provide details of all relevant information to the audit unit, at least a fortnight before the social audit process commences . Such details include ;

(i ) status of implementation of the Act , Rules and the Scheme for the street vendors;

(ii ) rhe record of the minutes of the meetings of the Town Vending Committee conducted in those years ;

(iii ) the record of all registered street vendors ;

(iv) the record of appeals made before the local authority under section 11 of the Act;

(v) the record of all grievances or disputes brought before the grievance redressal committee constituted under section 20 of the Act ;

(vi) the record of the total number of evictions taken place, confiscation of goods and the relocation of street vendors taken place in those years ; and मध्यप्रदेश राजपत्र, दिनांक 29 जून 2020

(vii) the records of social audit reports , if any , taken place previously .

(2) Mecting and working of social audit unit.-

(a) The social audit unit shall conduct meetings and focus group discussions with street vendors on various aspects of the implementation of the Act , Rules and the Scheme.

(b) The audit unit shall record in writing the grievances of the street vendors on any issue or problem faced by them and record findings .

(d) The audit unit shall hold a social audit public meeting at the town vending committee office . The members of the committee and representatives of the local authority shall attend the meeting . The audit unit shall read out its findings at the meeting. The street vendors shall be encouraged to testify and the Town Vending Committee shall respond to each of the issues identified in the social audit by giving clarification and explanation to the affected party and the public as to why a certain action was taken or not taken.

(e) The local authority shall, on each findings of the social audit unit in the cases of gaps , lapses or deviations , fix responsibility and shall take immediate corrective measures or disciplinary action .

(1) The cost of conducting social audit shall be met from the budgetary provisions of the Town Vending Committee .

(g) The statutory requirement of conducting social audit shall not preclude any independent initiative to carry out normal audit of accounts .

12. The manner of maintenance of proper records and other documents by the Town Vending Committee , Urban Local Authority, Planning Authority and State Nodal Officer in respect of street vendors.-

( 1 ) Online software may be developed by the Urban Administration & Development Department for keeping the records of the street vendors .

(2) The Urban Local Authority shall enter the data of the surveyed street vendors through online process.

4.(3 ) The certificate of vending and identity card may be generated online .

(4) The website of Urban Local Authority shall display the vending zones and details of street vendors .

13. Public health and hygiene.-

Following norms should be abided for keeping public health and hygiene ;

(1) The Urban Local Authority shall provide street vendors a proper place for disposing of their waste materials in order to maintain a hygienic environment .

(2) The street vendor (s) shall use proper covered dustbin(s) for disposing of the waste materials , in accordance with the waste disposal norms set by Urban Local Authority or Solid Waste Management system of Urban Local Authority . The street vendors shall also pay the sanitation charges as per the norms set by the Urban Local Authority for Solid Waste Management (SWM).

(3) The Urban Local Authority shall ensure and provide the street vendors clean and fresh water along with the electricity/ street light facility wherever possible .

(4) The Urban Local Authority in order to maintain public health and hygiene shall provide toilets facility with adequate water and electricity.

(5) Appropriate number of dustbins shall be provided by the Urban Local Authority to dispose of the waste materials .

(6) Town Vending Committee may initiate group insurance scheme for the street vendors .

State Nodal Officers.-

14.

(1 ) For the purpose of co - ordinating all matters relating to street vending at the state level , Commissioner, Urban Administration & Development Department shall appoint a State NodalOfficer who shall not be below the rank of Joint Director , Directorate of Urban Administration and Development .

(2) The Nodal officer shall have power to inspect or cause to be inspected , the record of Town Vending Committee as and when deems fit .

(3) The Nodal officer shall have, at least, a half- yearly meeting with the Urban Local Authority in order to update the status of street vendors and may take feedback from the street vendors for ensuring their social security and co- ordinate with the Urban Local Authority including the Town Vending Committee.

(4) The State Government , if requires , may issue executive instruction, from time to time , for greater interest of the street vendors and effective implementation of the Scheme .

The Street Vending Certificate is granted under following conditions: -

(i ) Vending certificate does not confer ownership of land, but only confers the use of land based on certain conditions;

(ii ) The vendor shall not construct any permanent structure on allotted space;

( iii) The Urban Local Authority reserves the right to shift the street vendor to other location on the ground as provided under section 10;

( iv) The Vending Certificate cannot be transferred /leased/rented or sold to others . An undertaking is to be submitted by the Strect Vendor to the Town Vending Committee;

(v) Street Vendor can sell only those articles of business for which Street Vending Certificate is issued ;

(vi) Street Vendor can do his business on the specified location and time as mentioned on the Street Vending Certificate;

(vii ) Street Vending Certificate will lapse after the expiry mentioned in the Certificate . It will be the sole responsibility of the Street Vendor to renew certificate before the expiry ;

(viii ) If a Street Vendor to whom this Street Vending Certificate is issued dies or suffers from any permanent disability or is ill , one of his family member cither spouse or depended child who is enlisted in the Certificate can do business on his/her behalf;

(ix) Vendor can do the business according to its category mentioned in the Street Vending Certificate;

(x) If a Street Vendor occupies the space on a time sharing basis , he shall remove his goods and wares every day at the end oftime-sharing period allowed to him/her;

(xi ) Every Street Vendor shall maintain cleanliness and public hygiene in the vending zone and the adjoining areas . Every Street Vendor shall maintain civic amenities and public property in the vending zone in good condition and not damage or destroy or cause any damage or destruction to the same ;

(xii ) Every Street Vendor shall pay such periodic maintenance charges for the civic amenities and facilities provided in the vending zones as prescribed by the Urban Local Authority from time to time;

(xiii ) This Street Vending Certificate do not confer any temporary, permanent or perpetual right of carrying out vending activities in the vending zones allotted;

(xiv) If a Street Vendor has a grievance or dispute may make an application in writing to the committee constituted by the Urban Local Authority to solve grievance or disputes;

(xv) Every Strect Vendor has to follow traffic rules and should not cause disruption to traffic . The vendor in any way shall not obstruct the free movement of pedestrians and traffic;

(xvi) On demand by the Urban Local Authority officials the vendor will have to show the Street Vending Certificate;

(xvii ) Every Street Vendor shall properly dressed and not be involved in any illegal or immoral activity;

(xviii) Every Street Vendor should not vend like drugs or alcohol or explosives ;

(xix) Every Street Vendor has to follow any direction, instructions issued by the Urban Local Authority or State Government from time to time.
