क्र.-एफ-ए- 3-15-2020-1-पांच (34). मध्यप्रदेश माल और सेवा कर अधिनियम, 2017 (क्रमांक 19 सन् 2017) की धारा 164 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार, एतद्वारा, मध्यप्रदेश माल और सेवा कर नियम, 2017 में निम्नलिखित संशोधन करती है, अर्थात:-
संशोधन
उक्त नियमों में,-
(1) नियम 3 में, उप-नियम (3) में, पूर्ण विराम के स्थान पर, कॉलन स्थापित किया जाए तथा उसके पश्चात् निम्नलिखित परंतुक अन्तःस्थापित किया जाए, अर्थात्ः-
"परंतु कोई पंजीकृत व्यक्ति, जो वित्तीय वर्ष 2020-2021 के लिए धारा 10 के अधीन कर का संदाय करने का विकल्प लेता है, तो वह या तो प्रत्यक्ष रूप से या आयुक्त द्वारा अधिसूचित सुविधा केन्द्र के माध्यम से, सामान्य पोर्टल पर, सम्यक् रूप से हस्ताक्षरित या इलेक्ट्रानिक सत्यापन कोड के माध्यम से सत्यापित प्ररूप जीएसटी सीएमपी-02 में इलेक्ट्रनिक रूप से सूचना जून, 2020 के 30 वें दिन को या उससे पूर्व फाईल करेगा और नियम 44 के उप - नियम (4) के उपबंधो के अनुसार प्ररूप जीएसटी आईटीसी-03 में विवरण जुलाई , 2020 के 31 वें दिन तक प्रस्तुत करेगा. ".
(2) नियम 36 में, उपनियम (4) में, पूर्ण विराम के स्थान पर, कॉलन स्थापित किया जाए तथा उसके पश्चात् निम्नलिखित नवीन परंतुक अन्तःस्थापित किया जाए , अर्थात्:-
"परंतु उक्त शर्त फरवरी , मार्च, अप्रैल , मई, जून, जुलाई और अगस्त, 2020 की कालावधि के लिए संचयी रूप से लागू होगी और सितंबर, 2020 की कर अवधि के लिए प्ररूप जीएसटी-3 ख में विवरणी , उक्त महीनों के लिए आगत कर प्रत्यय के ऊपर उल्लेखित शर्तों के अनुसार संचयी समायोजन के साथ प्रस्तुत की जाएगी.".

2. अन्यथा उपबंधित के सिवाय , यह अधिसूचना 3 अप्रैल, 2020 से प्रवृत्त हुई समझी जाएगी.

क्र.- एफ- ए- 3-15-2020-1- पांच. भारत के संविधान के अनुच्छेद 348 के खण्ड (3) के अनुसरण में, इस आशय की अधिसूचना क्रमांक एफ- ए- 3-15-2020-1- पांच (34) , दिनांक 10 जुलाई 2020 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्वारा प्रसारित किया जाता है

No. FA -3-15-2020-1 -V (34) .- In exercise of the powers conferred by Section 164 of the Madhya Pradesh Goods and Services Tax Act, 2017 ( 19 of 2017), the State Government , hereby, makes the following amendments in the Madhya Pradesh Goods and Services Tax Rules , 2017, namely : -
AMENDMENTS
Inthe said rules , -
1. In rule3 , in sub-rule (3 ), for the full stop , the colon shall be substituted and thereafter the following proviso shall be inserted, namely:-
"Provided that any ragistered person who opts to pay tax under section 10 for the financial year 2020-2021 shall electronically file an intimation in FORM GST CMP- 02, duly signed or verified through electronic verification code, on the common portal , either directly or through a Facilitation Centre notified by the Commissioner, on or before 30th day of June , 2020 and shall furnish the statement in FORMGST ITC-03 in accordance with the provisions of sub- rule (4) ofrule 44 upto the 31st day of July, 2020. " .
2.In rule36, in sub -rule (4) , for the full stop , the colon shall be substituted and thereafter the following new proviso shall be inserted, namely:-
"Provided the said condition shall apply cumulatively for the period February, March, April, May, June , July and August, 2020 and the return in FORM GST- 3B for the tax period September, 2020 shall be furnished with the cumulative adjustment of input tax credit for the said months in accordance with the conditions mentioned above . " .
3. Save as otherwise provided , this notification shall be deemed to have come into force from 3rdApril , 2020 .
