क्र. एफ - 5-3-2020 - पन्द्रह - एक.- मध्यप्रदेश सहकारी सोसाइटी अधिनियम, 1960 ( क्रमांक 17 सन् 1961 ) की धारा 95 की उप- धारा ( 1 ) तथा ( 2 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा , मध्यप्रदेश सहकारी सोसाइटी नियम, 1962 में निम्नलिखित और संशोधन करती है, अर्थात्ः-

उक्त नियमों में,-
1. नियम 4 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए, अर्थात्ः-
"4. रजिस्ट्रीकरण के लिए आवेदन पत्र.-
(1) धारा 7 की उप-धारा ( 1 ) के अधीन किसी सोसाइटी के पंजीयन के लिये प्रत्येक आवेदन प्ररूप क में या पोर्टल पर विहित प्ररूप में ऑनलाइन आवेदन दिया जाएगा। (2) जहां रजिस्ट्रीकृत की जाने वाली सोसाइटी के किन्हीं सदस्यों में से कोई सदस्य रजिस्ट्रीकृत सोसाइटी हो, तो ऐसी सोसाइटी के संचालक मण्डल का कोई सदस्य, अपनी सोसाइटी के ठहराव द्वारा रजिस्ट्रीकरण के लिए आवेदन पर उसकी ओर से हस्ताक्षर करने के लिये संचालक मंडल द्वारा प्राधिकृत किया जाएगा और ऐसे ठहराव की एक प्रतिलिपि आवेदन पत्र के साथ संलग्न की जाएगी । रजिस्ट्रीकरण के लिए ऑनलाइन आवेदन की दशा में समस्त दस्तावेजों का सत्यापन रजिस्ट्रीकरण होने वाली सोसाइटी के प्रथम हस्ताक्षरकर्ता द्वारा डिजिटल सत्यापन किया जाएगा।

(3) आवेदन-पत्र रजिस्ट्रार को पंजीकृत डाक से भेजा जाएगा या हाथ से परिदत्त किया जाएगा या पोर्टल के माध्यम से ऑनलाइन प्रस्तुत किया जाएगा। तथापि, ऑनलाइन रजिस्ट्रीकरण के लिए समस्त व्यवस्थाए सुनिश्चित करने के पश्चात् रजिस्ट्रार द्वारा आदेशित तारीख से आवेदन हाथ से या रजिस्ट्रीकृत डाक से ग्रहण नहीं किए जाएंगे और केवल ऑनलाइन मोड के माध्यम से आवेदन स्वीकार किए जाएंगे ।
(4) ऑनलाइन आवेदन प्रस्तुत करने के लिए आवेदक को अपने आवेदन के साथ पोर्टल पर उल्लिखित चेक- लिस्ट के अनुसार सभी आवश्यक दस्तावेज अपलोड करना तथा रजिस्ट्रीकरण हेतु यदि कोई रजिस्ट्रीकरण फीस निर्धारित हो तो उसका भुगतान ऑनलाइन करना अनिवार्य होगा। रजिस्ट्रार द्वारा आवेदक से ऐसे आवश्यक दस्तावेजों की भौतिक प्रतियां पृथक् से नहीं मांगी जाएंगी । पोर्टल पर आवेदन एवं आवश्यक दस्तावेज अपलोड होने पर संदर्भ क्रमांक आवेदक को प्राप्त होगा। " । 2. नियम 5 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए , अर्थात्: -
"5. आवेदन प्राप्त होने की प्रक्रिया.-
(1) नियम 4 के उप-नियम 3 के अधीन आवेदन प्राप्त होने के पश्चात्, रजिस्ट्रार दस्तावेजों एवं उपविधियों के साथ आवेदन में उल्लिखित तथ्यों का परीक्षण करेगा और यदि आवश्यक हो तो आगे जांच के लिए आदेश देगा।
(2) यदि परीक्षण में कोई त्रुटि पाई जाती है, तो रजिस्ट्रार, आवेदक को अधिकतम 15 दिवस के भीतर सुधार करने हेतु उचित माध्यम से सूचित करेगा ।
(3) यदि आवेदक द्वारा विहित समय-सीमा में आवश्यक त्रुटियों का सुधार किया जाता है और उन सुधारों से यदि रजिस्ट्रार संतुष्ट है तथा यदि प्रस्तावित सोसाइटी, अधिनियम एवं नियमों के उपबंधों का अनुपालन करता है तो वह इस प्रयोजन के लिए रखे गए सोसाइटियों के रजिस्टर में सोसाइटी को पंजीबद्ध ( दर्ज) करेगा । प्रत्येक प्रविष्टि रजिस्ट्रार की मोहर एवं हस्ताक्षर द्वारा सत्यापित की जाएंगी। वह सोसाइटी को रजिस्ट्रेशन आदेश, रजिस्ट्रेशन प्रमाण पत्र एवं उसके द्वारा अंतिम रूप से स्वीकृत एवं रजिस्ट्रीकृत उपविधियों की प्रमाणित प्रति भी प्रेषित करेगा । (4) यदि आवेदक द्वारा अपेक्षित त्रुटि सुधार निर्धारित समय - सीमा में नही किया जाता है अथवा उसके द्वारा किए गए सुधार से रजिस्ट्रार संतुष्ट नही है अथवा रजिस्ट्रार की राय में प्रस्ताव अधिनियम एवं नियमों के उपबंधों के प्रतिकूल है, तो वह अस्वीकृत करने का आदेश कारण सहित पारित करेगा और आवेदक को उचित माध्यम से सूचित करेगा ।
(5) ऑनलाइन आवेदन की दशा में , रजिस्ट्रार रजिस्ट्रेशन आदेश, रजिस्ट्रेशन प्रमाण पत्र एवं पंजीकृत उपविधियां पोर्टल पर अपलोड करेगा , जिसे आवेदक के द्वारा स्वयं डाउनलोड किया जा सकेगा। 534(1)

(6) ऑनलाइन आवेदन की दशा में, प्रत्येक पत्राचार/ संचार केवल ऑनलाइन माध्यम से ही किया जाएगा ।
(7) रजिस्ट्रार के लिये यह अनिवार्य होगा कि वह आवेदन के निराकरण के लिए मध्यप्रदेश लोक सेवाओं के प्रदान की गारंटी अधिनियम , 2010 के उपबंधों के अनुसार 45 दिवस के भीतर करें । " ।
3. नियम 66 में, उपनियम (2) में, खण्ड (च) में, उप-खण्ड (दो) में , कॉलन का लोप करने के पश्चात् प्रथम पैराग्राफ के अंत में , निम्नलिखित शब्द अंतःस्थापित किए जाएं, अर्थात्:
"या सम्पत्ति का विक्रय ई-नीलामी (इलेक्ट्रानिक आक्शन) के माध्यम से किया जाएगा। " । No. F-5-3-2020- XV- One . In exercise of the powers conferred by sub - section ( 1 ) and (2) of Section 95 of the Madhya Pradesh Co- operative Societies Act , 1960 (No. 17 of 1961 ) , the State Government , hereby, makes the following further amendments in the Madhya Pradesh Co- operative Societies Rules , 1962, namely:-

In the said rules , -
1. For rule 4, the following rule shall be substituted, namely: -
"4. Application for Registration.-
( 1) Every application for the registration of a society under sub- section ( 1 ) of Section 7 , shall be made in Form A or an online application in the prescribed format on the portal .
(2) Where any member of a society to be registered is a registered society , a member of the Board of Directors of such society shall be authorised by such board of directors by a resolution to sign the application for registration on its behalf and a copy of such resolution shall be appended to the application. In the case of an online application for registration , all the documents shall be digitally verified by the first signatory of the society seeking registration .
(3) The application shall be sent to the Registrar by registered post or delivered by hand or submitted online through the portal . However , once all the arrangements for online registration have been made , the hand-delivered or registered post applications shall not be entertained from such date as directed by the Registrar and after which applications shall be accepted only through online mode .
(4) For the submission of online application , it shall be mandatory for the applicant to upload all the required documents as per the checklist mentioned on the portal and to pay online the requisite registration fee, if any . The Registrar shall not ask the applicant to furnish the physical copies of those required documents separately . On uploading the application and required documents on the portal , the applicant shall be issued a reference number . " .

2. For rule 5, the following rule shall be substituted, namely: -
" 5. Procedure on receipt of application . -
(1) Upon receipt of an application under sub - section (3 ) of rule 4, the Registrar shall examine the facts mentioned in the application along with the documents and the bye- laws and if necessary, may order for further enquiry .
(
2) If on examination , any defects are found , the Registrar shall inform the applicant by appropriate mode to rectify those defects within a maximum period of 15 days .
(
3) The required rectifications, if done by the applicant within the prescribed time limit and the Registrar is satisfied with the rectifications done and also that the proposed society has complied with the provisions of the Act and Rules , he shall register the society in a register to be called register of societies to be kept for this purpose. Every such entry shall be attested by the seal and signature of the Registrar . He shall also forward to the society a copy of the order of registration , a certificate of registration and a certified copy of the bye- laws as finally approved and registered by him .

4) If the applicant does not make the required rectifications within prescribed time- limit or the Registrar is not satisfied with the rectifications done or the Registrar is of the opinion that the proposal is contrary to the provisions of the Act and Rules , he shall pass an order of refusal together with the reasons therefor and communicate it to the applicant by appropriate mode .
(5) In case of online application , the Registrar shall upload the copies of the registration order, certificate of registration and registered bye - laws on the portal , which can be downloaded by the applicant.

6) In case of online application, every correspondence / communication shall be made through online mode only.
(7) It shall be mandatory for the Registrar to dispose of the application as per the provision of MADHYA PRADESH LOK SEWAON KE PRADAN KI GUARANTEE ADHINIYAM, 2010 within a period of 45 days from the date of its receipt . " .
3. In rule 66, in sub - rule (2) , in clause (f) , in sub - clause ( ii ) , at the end of the first paragraph after omitting the colon , the following words shall be inserted , namely: -
" or the property shall be sold out throughe-Auction (Electronic Auction) . " .
