सूचना

क्र. एफ - 3-49-2020-अठारह 5.- मध्यप्रदेश भूमि विकास नियम, 2012 में संशोधन का निम्नलिखित प्रारूप जिन्हें राज्य सरकार, मध्यप्रदेश नगर तथा ग्राम निवेश अधिनियम, 1973 ( क्रमांक 23 सन् 1973 ) की धारा 24 की उपधारा ( 3 ) के साथ पठित धारा 85 की उपधारा ( 1 ) द्वारा अपेक्षित किए गए अनुसार, ऐसे समस्त व्यक्तियों की, जिनके कि उससे प्रभावित होने की संभावना है, जानकारी के लिए एतद्वारा प्रकाशित किया जाता है और एतद्वारा यह सूचना दी जाती है कि इस सूचना के मध्यप्रदेश राजपत्र में प्रकाशन की तारीख से पन्द्रह दिन का अवसान होने के पश्चात् उक्त संशोधन प्रारूप पर विचार किया जाएगा.

किसी भी ऐसी आपत्ति या सुझाव पर, जो उक्त प्रारूप के संबंध में किसी व्यक्ति, संस्था अथवा निकाय के उक्त कालावधि का अवसान होने के पूर्व प्राप्त हो, राज्य सरकार द्वारा विचार किया जावेगाः-

संशोधन

उक्त नियमों में:-

1. नियम 2 के उप- खण्ड (40 ) के स्थान पर, निम्नलिखित उप- खण्ड स्थापित किया जाए, अर्थात्ः-

" (40 ) " अनुज्ञप्त वास्तुविद् / संरचना इंजीनियर / इंजीनियर / पर्यवेक्षक / नगर योजनाकार / अग्निशमन इंजीनियर / लिफ्ट इंजीनियर / समूह" से अभिप्रेत है, क्रमशः कोई अर्ह वास्तुविद् / संरचना इंजीनियर / इंजीनियर / पर्यवेक्षक / नगर योजनाकार / अग्निशमन इंजीनियर / लिफ्ट इंजीनियर / समूह जो, जहां आवश्यक हो, प्राधिकारी द्वारा इस रूप में अनुज्ञप्तं किया गया हो । "

2. नियम 16 में,

(1) उप-नियम (8) में, खण्ड (एक) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए, अर्थात्ः-

"(एक) आवेदन पत्र के साथ सामान्य तथा विस्तृत दोनों प्रकार की विशिष्टियां, जिसमें उपयोग में लाई जाने वाली सामग्री का प्रकार तथा श्रेणी दी जाएगी तथा जो यथास्थिति, अनुज्ञप्त वास्तुविद्, संरचना इंजीनियर, इंजीनियर, पर्यवेक्षक, नगर योजनाकार, अग्निशमन इंजीनियर या लिफ्ट इंजीनियर द्वारा यथास्थिति अनुसार सम्यक रूप से हस्ताक्षरित की जाएगी । "

(2) उप- नियम (9) के स्थान पर, निम्नलिखित उप- नियम स्थापित किया जाए , अर्थात्ः- " (9) पर्यवेक्षण- आवेदन पत्र के साथ पर्यवेक्षण करने वाले, यथास्थिति, अनुज्ञप्त वास्तुविद्, संरचना इंजीनियर, इंजीनियर, पर्यवेक्षक, नगर योजनाकार, अग्निशमन इंजीनियर या लिफ्ट इंजीनियर का प्रमाण पत्र परिशिष्ट (ख) में दिए गए प्ररूप में संलग्न होगा । "

3. नियम 26 में,

(1) उप- नियम (1 ) के स्थान पर, निम्नलिखित उप- नियम स्थापित किया जाए, अर्थात्ः- "(1 ) प्राधिकारी , संरचना इंजीनियरों, इंजीनियरों, पर्यवेक्षकों, नगर योजनाकारों, अग्निशमन इंजीनियरों तथा लिफ्ट इंजीनियरों को, जिसके पास उप- नियम (2 ) में अधिकथित न्यूनतम अर्हताएं हो, " परिशिष्ट-ग" में दिये गये प्ररूप में अनुज्ञप्ति दे सकेगा ।"

(2) उप- नियग (2) में अनुक्रमांक 6 के पश्चात्, निम्नलिखित अनुक्रमांक अंतःस्थापित किया जाए, अर्थात्ः-

"7. लिफ्ट इंजीनियर मान्यता प्राप्त भारतीय या विदेशी विश्वविद्यालय से इलेक्ट्रिकल / मैकेनिकल इंजीनियरिंग में स्नातक एवं लिफ्ट, एस्केलेटर और मूविंग वॉक की स्थापना, निर्माण, परीक्षण अथवा ऑडिट से संबंधित पांच वर्ष का अनुभव धारण करता हो। "

(3) उप- नियम (9) में खण्ड (च) के पश्चात् निम्नलिखित खण्ड स्थापित किए जाएं, अर्थात्ः-

"(छ) लिफ्ट इंजीनियर की सक्षमता लिफ्ट इंजीनियर, सभी प्रकार के भवनों के लिफ्ट, एस्केलेटर और मूविंग वॉक से संबंधित सभी कार्यों को पूरा करने के लिए सक्षम होगा, जो नेशनल बिल्डिंग कोड के भाग - 8 के सेक्शन-5 के अंतर्गत आते हैं । 576( 1)

(ज) समूह या अभिकरण जब अर्हता प्राप्त वास्तुविदों, संरचना इंजीनियरों, इंजीनियरों, नगर योजनाकारों, अग्निशमन इंजीनियर, लिफ्ट इंजीनियरों का कोई अभिकरण या समूह कार्य कर रहा हो तो अर्हता और कार्य की सक्षमता, समूह या अभिकरण में व्यक्ति की उच्चतम सक्षमता के बराबर होगी। लिफ्ट, एस्केलेटर अथवा मूविंग वॉक के निर्माणकर्ता को भी इस श्रेणी में अनुज्ञप्ति जारी की जा सकती है ।"

4. नियम 83 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए , अर्थात्ः- "83 लिफ्ट, एस्केलेटर या मूविंग वॉक का प्रावधानः 12.5 मी. से अधिक उँचे भवनों के लिए लिफ्ट की व्यवस्था की जाएगी । किसी भवन में स्थापित किये जाने वाले लिफ्ट, एस्केलेटर या मूविंग वॉक की योजना, डिजाइन, स्थापना, संचालन, रखरखाव और निरीक्षण नेशनल बिल्डिंग कोड के भवन सेवाओं भाग - 8 के सेक्शन 5 में दिए गए प्रावधानों के अनुसार होगा । भवन के प्रत्येक भवन स्वामी पर निम्नलिखित प्रावधान लागू होंगेः-

(1) प्रत्येक भवन स्वामी को लिफ्ट, एस्केलेटर या मूविंग वॉक की स्थापना से संबंधित विवरण "परिशिष्ट- क-2(क) में भवन अनुज्ञा आवेदन के साथ संबंधित प्राधिकारी को प्रस्तुत करना होगा ।

(2) लिफ्ट्स, एस्केलेटर या मूविंग वॉक स्थापना का कार्य पूर्णता प्रतिवेदन परिशिष्ट- ड-3 (क) में भवन स्वामी द्वारा नियम 102 के तहत पूर्णता प्रमाण पत्र प्राप्त करते समय प्रस्तुत किया जाएगा। समुचित प्राधिकारी द्वारा प्रत्येक इकाई का विशिष्ट पंजीकरण क्रमांक प्रदाय किया जाएगा ।

(3) नियम में इस प्रावधान के लागू होने से पूर्व ऐसे स्थल जिनमें लिफ्ट, एस्केलेटर या मूविंग वॉक स्थापित किया गया हो , प्रत्येक भवन स्वामी को इसके लागू होने की दिनांक से छह महीने के अंदर संबंधित प्राधिकारी को परिशिष्ट-क-2 (ख) में लिफ्ट, एस्केलेटर या मूविंग वॉक के लिए रू. 500/- प्रति यूनिट की दर से शुल्क के साथ सूचित करना होगा । उपरोक्त छह माह की पूर्वोक्त अवधि, आवेदन प्रस्तुत करने पर समुचित कारण सहित पारित आदेश द्वारा छह माह तक आगे बढाई जा सकती है । समुचित प्राधिकारी द्वारा प्रत्येक इकाई का विशिष्ट पंजीकरण क्रमांक प्रदाय किया जाएगा । तथापि व्यक्तिगत भवन स्वामी, जो अपने आवासीय परिसर में लिफ्ट, एस्केलेटर या मूविंग वॉक का उपयोग कर रहे हैं, को इससे छूट होगी ।

(4) प्रत्येक भवन स्वामी लिफ्ट को उपयोग करने वाले व्यक्तियों के साथ लिफ्ट, एस्केलेटर अथवा मूविंग वॉक का बीमा मान्यता प्राप्त संस्था से करायेगा ।

(5) प्रत्येक भवन स्वामी लिफ्ट इंजीनियर द्वारा स्थापना के पश्चात दिए गए रखरखाव के निर्देश का पालन करेगा ।

(6) प्रत्येक भवन स्वामी लिफ्ट, एस्केलेटर या मूविंग वॉक के संचालन के लिए निम्नलिखित निबंधनों और शर्तों के अधीन उत्तरदायी होगाः 576 ( 2)

(क) भवन स्वामी द्वारा ऐसे लिफ्ट, एस्केलेटर या मूविंग वॉक का उपयोग नहीं किया जाएगा, जो सुरक्षित स्थिति में नहीं है और इसके लिए भवन स्वामी पूर्ण रूप से उत्तरदायी होगा ।

(ख) जब किसी बिल्डिंग में लिफ्ट का उपयोग नहीं किया जा रहा हो तो भवन स्वामी इसे पूरी तरह से बिजली की आपूर्ति से डिस्कनेक्ट करने के बाद इसे सुरक्षित यांत्रिक स्थिति में हटा देगा या बनाए रखेगा; सभी दरवाजों को सुरक्षित रूप से बंद कर दिया जाएगा, ताकि आकस्मिक प्रवेश को रोका जा सके और अनजाने उपयोग को भी रोका जा सके ।

(ग) भवन स्वामी द्वारा नेशनल बिल्डिंग कोड में किए गए प्रावधानों के अनुसार संचालन और रखरखाव किया जाएगा ।

(7) प्रत्येक भवन स्वामी लिफ्ट इंजीनियर से विधिवत हस्ताक्षरित एक छह मासिक आवधिक सुरक्षा और लेखा परीक्षा रिपोर्ट संबंधित प्राधिकारी को प्रस्तुत करेगा, जो नेशनल बिल्डिंग कोड के भाग-8 के अनुलग्नक- सी (क्लॉज-16.4) या अनुलग्नक-डी, (क्लॉज- 15.5.1 ) के निर्धारित अनुसार प्रकरण से संबंधित है और प्राधिकारी द्वारा परिशिष्ट-ज-3 (क) में भवन स्वामी को प्रमाण पत्र जारी किया जाएगा, जो लिफ्ट में दृष्टिगोचर स्थल पर प्रदर्शित किया जाएगा । तथापि व्यक्तिगत भवन स्वामी जो अपने आवासीय परिसर में लिफ्ट, एस्केलेटर या मूविंग वॉक का उपयोग कर रहे हैं, उन्हें इससे छूट होगी ।

(8) यदि भवन स्वामी उपरोक्त के अनुसार खण्ड (3 ) अथवा खण्ड (7) के प्रावधानों का पालन करने में विफल रहता है, पहली बार अनुपालन न करने की स्थिति में, उसे अगले दो महीनों में प्रतिवेदन जमा करने की दिशा- निर्देश के साथ एक चेतावनी जारी की जाएगी । दूसरी बार अनुपालन न करने की स्थिति में, उसे एक कारण बताओ नोटिस , यह दर्शाते हुए कि क्यों न लिफ्ट्, एस्केलेटर या मूविंग वॉक के संचालन को रोक दिया जाए, जारी किया जाएगा । सुनवाई का उचित अवसर देने के बाद, लिफ्ट, एस्केलेटर या मूविंग वॉक को सील करने के बारे में निर्णय प्राधिकारी द्वारा लिया जा सकेगा।

(9) यदि कोई दुर्घटना होती है, तो 24 घंटे के अंदर दुर्घटना का पूर्ण विवरण भवन स्वामी संबंधित प्राधिकारी को देगा ।

(10) प्रत्येक प्राधिकारी लिफ्ट्स, एस्केलेटर्स अथवा मूविंग वॉक्स की भौतिक और इलेक्ट्रॉनिक सूची परिशिष्ट- ज-3 (ख) में दिए गए प्ररूप में संधारित करेगा । " 576(3)

5. परिशिष्ट क-2 के बाद नया परिशिष्ट स्थापित किया जाए , अर्थात्ः-

576( 7) 4. अनुज्ञप्तिधारी मध्यप्रदेश भूमि विकास नियम, 2012 के उपबंधों का पालन करेगा और इस अनुज्ञप्ति के निबंधन के अंतर्गत कार्य करेगा ।

5. अनुज्ञप्तिधारी की सक्षमता नीचे मध्यप्रदेश भूमि विकास नियम, 2012 के उपबंधों द्वारा निर्धारित की जाएगी ।

6. समूह या अभिकरण : जब कोई अभिकरण या कोई अर्हता प्राप्त वास्तुविद् या संरचना इंजीनियर या इंजीनियर या नगर योजनाकार या लिफ्ट इंजीनियर का समूह कार्य कर रहा हो, तब कार्य की अर्हता और सक्षमता उस समूह या अभिकरण में व्यक्ति विशेष की उच्चतम सक्षमता के समतुल्य होगी ।

7. अनुज्ञप्तिधारी रेखांक तैयार करने तथा उनके द्वारा किए गए पर्यवेक्षण कार्य संबंधी सभी सुसंगत अभिलेख रखेगा । इस अभिलेख का निरीक्षण अधिकारिता रखने वाले प्राधिकारी के प्राधिकृत अधिकारियों द्वारा किया जा सकेगा ।

8. अनुज्ञप्तिधारी तैयार किये गये प्रत्येक दस्तावेज पर अपने हस्ताक्षर करेगा, नाम और अनुज्ञाप्ति क्रमांक लिखेगा और अधिकारिता रखने वाले प्राधिकारी को प्रस्तुत करेगा ।

9. यह अनुज्ञप्ति मध्यप्रदेश भूमि विकास नियम, 2012 में उल्लिखित शर्तों के अध्यधीन होगी और इन शर्तों में से किसी शर्त के भंग होने पर तत्समय प्रवृत्त किसी विधि के अधीन अनुज्ञप्तिधारी के विरूद्ध की जाने वाली अन्य कोई विधिक कार्यवाही पर प्रतिकूल प्रभाव डाले बिना यह अनुज्ञप्ति रद्द हो जाएगी ।

NOTICE

F. No. 3-49-2020 - XVIII - 5 . The following draft of amendments in the Madhya Pradesh Bhumi Vikas Niyam, 2012 , which the State Government proposes to make in exercise of the powers conferred by Section 87 read with sub - section ( 3) of Section 24 of the Madhya Pradesh Nagar Tatha Gram Nivesh Adhiniyam , 1973 (No. 23 of 1973) is hereby published , as required by sub - section ( 1 ) of Section 85 of the said Adhiniyam for the information of all persons , likely to be affected thereby and notice is hereby given that the said draft of amendment will be taken into consideration on the expiry of fifteen days from the date of publication of this notice in the Madhya Pradesh Gazette .

Any objection or suggestion , which may be received from any persons , with respect to the said draft before the expiry of the period specified above will be considered by the State Government :-

AMENDMENT

In the said rules , -

1. In rule 2 , for sub- clause (40) , the following sub - clause shall be substituted , namely: -

" (40 ) " Licensed Architect / Structural Engineer / Engineer / Supervisor /Town Planner/ Fire Engineer/Lift Engineer/Group " means , respectively, any qualified Architect / Structural Engineer / Engineer / Supervisor /Town Planner / Fire Engineer/ Lift Engineer/Group, who , where necessary, has been licensed as such by the Authority . "

2. In rule 16,

(1) In sub - rule (8 ) , for clause ( i) , the following clause shall be substituted, namely:-

"( i) Specifications both general and detailed , giving type and grade of materials being used, duly signed by the licensed Architect, Structural Engineer , Engineer, Supervisor, Town Planner , Fire Engineer or Lift Engineer , as the case may be , shall accompany the application . " .

(2) For sub - rule (9) , the following sub - rule shall be substituted , namely: - "(9) Supervision- The application shall be further accompanied by a certificate in form given in Appendix - B by the licensed Architect, Structural Engineer , Engineer , Supervisor, Town Planner , Fire Engineer or Lift Engineer , as the case may be, undertaking the supervision. "

3. InRule 26,

(1) For sub -rule ( 1 ) , the following sub -rule shall be inserted, namely: - "(1) The Authority may issue licenses in form given in Appendix - C to Structural Engineers , Engineers , Supervisors , Town Planners , Fire Engineers and Lift Engineers , who possess the minimum qualifications as laid down in the sub - rule (2) . "

(2) In sub -rule (2) , clause No. 6, the following clause shall be inserted, namely: -

"7. Lift Engineer

Graduate in Electrical/Mechanical Engineering from a recognized Indian or Foreign university with five years of experience , related to installation, erection, testing or audit of lift, escalator and movingwalk .

(3) In sub -rule (9) , after clause (F ) , the following clause shall be inserted, namely:-

"(G) Lift Engineer- Competence. -The Lift Engineer shall be competent to carry out all works related to installation , erection, testing, safety and audit of lift , escalator and moving walk of all types of buildings , which are covered under Section 5 of National Building Code Part- VIII .

(H) Group or Agency- When an agency or group of qualified Architects , Structural Engineers , Engineers , Town Planners , Fire Engineers , Lift Engineers is practicing, then the qualification and competence of work shall be equivalent to the highest competency of individual in the group or agency . manufacturers of lifts , escalators or moving walks may also be issued license in this category . " .

4. For Rule 83 , the following rule shall be substituted , namely: - "83 ""Provision of Lifts , Escalators or Moving Walks : -Provision for lifts shall be made for building more than 12.5 meters in height . Planning, design , installation, operation, maintenance and inspection of Lift, Escalator or Moving Walk to be installed in a building shall be in accordance with the provisions given in Section 5 of Part- VIII : of National Building Code (NBC ). Following provisions shall apply to every owner of building : -

(1) Every owner shall furnish details related to installation of lift , escalator or moving walk along with building permission application in Appendix A- 2 (A) to the concerned authority.

(2) Work completion report of erection of lift , escalator or moving walk shall be submitted by the owner in Appendix E - 3 (A) at the time of obtaining completion certificate in rule 102. The Authority shall issue a unique registration number to each unit.

(3) Every owner of a place in which a lift , escalator or moving walk has been installed before the commencement of this provision in the rule, shall , within six months from such commencement date inform the concerned Authority in Appendix A- 2 ( B ) along with a fee of Rupees 500 per unit of lift , escalator or moving walk. The aforesaid period of six months may by order and for reasons to be recorded be further extended by six months on an application being made . The Authority shall issue a unique registration number to each unit . However , the individual owner who is using lift, escalator or moving walk in his own residential premise shall be exempted from it .

(4) Every owner shall get the lift , escalator or moving walk insured from recognized agency , along with the insurance of persons using them.

(5) Every owner shall follow the instruction of maintenance provided by the Lift Engineer after installation.

(6) Every owner shall be responsible for operation of lift , escalator or moving walk subject to the following terms and conditions: - मध्यप्रदेश राजपत्र , दिनांक 8 सितम्बर 2020

576 ( 13) (a) The owner shall not use the lift, escalator or moving walk, which is not in a safe condition and he shall be solely responsible for it .

(b) When a lift erected at any place ceased to be used as such , the owner shall either remove it or maintain it in safe mechanical condition after disconnecting it entirely from the electric supply; all gates and doors shall be securely locked, so as to prevent the accidental entry to lift well and to prevent inadvertent use .

(7) Every owner shall submit a six monthly periodical safety and audit report duly signed by the Lift Engineer as prescribed in Annex C (Clause 16.4) , Annex D (Clause 15.5.1 ) as the case may be , of NBC Volume VIII to the concerned Authority and the authority shall issue a certificate in appendix- H 3 (A) to the owner which shall be displayed in the lift , escalator or moving walk at a visible location . However , the individual owner who is using lift, escalator or moving walk in his own residential premise shall be exempted from it .

(8) If the owner fails to comply with the provisions of clause (3 ) or clause (7) as mentioned above: in case of non - compliance for the first time , a warning will be issued to him with the direction to submit the same in the next two months . In case of non- compliance for the second time , a show cause notice stating as to why the operation of lift , escalator or moving walk should not be stopped, shall be issued to him . After giving a reasonable opportunity of being heard , a decision regarding sealing operation of lift , escalator or moving walk may be taken by the Authority .

(9) If any accident occurs , the owner shall give full details of accident within 24 hours to the concerned Authority .

(10) Every Authority shall maintain the inventory of the lifts , escalators or moving walks in physical and electronic format as given in Appendix - H 3 (B) . " .
