भोपाल, दिनांक 15 सितम्बर 2020 फार्मेसी एक्ट, 1948 (क्रमांक 8 सन् 1948) की धारा 46 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार, एतदद्वारा, मध्यप्रदेश फार्मेसी नियम , 1978 में निम्नलिखित संशोधन करती है, अर्थात्:-
संशोधन
उक्त नियमों में,-
1. नियम 5 के पश्चात्, निम्नलिखित नियम अन्तःस्थापित किया जाए , अर्थात्
"5क. परिषद् निधि -
एक परिषद् निधि होगी जो राज्य सरकार से प्राप्त प्रत्याशित अनुदान तथा रजिस्ट्रीकरण से प्राप्त राशि से मिलकर बनेगी । निधि की राशि को निम्नलिखित प्रयोजनों के लिए उपयोग किया जाएगाः-
(क) परिषद् के अधिकारियों तथा कर्मचारियों के वेतन तथा भत्तों के भुगतान के लिए;

(ख) परिषद् के भवन के निर्माण एवं उसके रखरखाव के लिए ;
(ग) रजिस्ट्रीकृत फार्मासिस्ट तथा उनके परिवारों के कल्याण हेतु तैयार योजनाओं के क्रियान्वयन के लिए;
(घ) फार्मेसी के क्षेत्र में नवीन अनुसंधान कार्य को बढ़ावा देने के लिए ;
(ड.) फार्मेसी विषय में अध्ययन कर रहे छात्रों के प्रोत्साहन के लिए ;
(च) रजिस्ट्रीकृत फार्मासिस्टों के जीवन बीमा तथा स्वास्थ्य बीमा से संबंधित कार्यक्रमों को क्रियान्वित करने के लिए ;
(छ) रजिस्ट्रीकृत फार्मासिस्टों के लिए पुनश्चर्या पाठ्यक्रम , प्रशिक्षण कार्यक्रम , सेमीनार, कार्यशालाएं , रोजगार मेले तथा व्यावसायिक प्रशिक्षण धारक के लिए;
(ज) "औषधि सूचना केन्द्र" की स्थापना तथा केन्द्र के संचालन के लिए;
(झ) परिषद् की वेबसाइट के रखरखाव तथा उचित संचालन के लिए;
(ञ) फार्मेसी शिक्षकों हेतु नियमित प्रशिक्षण कार्यक्रम संचालित करने के लिए ,
(ट) मध्यप्रदेश के विभिन्न विश्वविद्यालयों के फार्मेसी संकाय के शीर्षस्थ स्नातक तथा स्नातकोत्तर छात्रों को सम्मानित तथा प्रोत्साहित करने के लिए;
(ठ) फार्मास्युटिकल पत्रिका, या विवरणिका या संवाद-पत्र के प्रकाशन के लिए;
(ड) यदि परिषद् की आवश्यकता हो, तो कुछ अवधि के लिए विशेषज्ञों या संविदा आधार पर अन्य कर्मचारिवृंद या आउटसोर्स अभिकरण की सेवाएं प्राप्त करने के लिए ।
2. नियम 6 में , शब्द तथा अंक "200 रूपए " के स्थान पर , शब्द तथा अंक " 5000 रूपए " स्थापित किया जाए ।
3. नियम 8 का लोप किया जाए ।
4. नियम 13 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए , अर्थात्ः-
"13. रजिस्ट्रार .-
(क) 50,000 /- रूपए से अधिक नही ;
(ख) अध्यक्ष के पूर्व अनुमोदन से स्वप्रेरणा से 1 लाख रूपए से अधिक नहीं;

(ग) राज्य सरकार के पूर्व अनुमोदन से 1 लाख रूपए से अधिक का व्यय उपगत कर सकेगा । " ;
5. नियम 14 में, निम्नलिखित शब्द " किन्तु यदि दावा 50 रूपये से अधिक का हो तो उसका भुगतान तब तक नहीं किया जाएगा जब तक कि अध्यक्ष द्वारा उनका परीक्षण न कर लिया गया हो और उसे पारित न किया गया हो । " का लोप किया जाए । 6. नियम 27 में , शब्द तथा अंक "50 रूपए " के स्थान पर, शब्द तथा अंक " 10,000 रूपए " स्थापित किए जाएं तथा शब्द " मनीआर्डर या बीमा रजिस्ट्रीकृत डाक" के स्थान पर , शब्द "ऑनलाईन संव्यवहार " स्थापित किए जाएं ।
7. नियम 45 के पश्चात्, निम्नलिखित नियम अन्तःस्थापित किया जाए , अर्थात्ः -
"
45-क. (1 ) परिषद् का अध्यक्ष उनके पारिश्रमिक के अतिरिक्त ऐसे लाभ तथा अनुलाभों का हकदार होगा, जो समय- समय पर राज्य सरकार द्वारा नियत किए जाएं । परन्तु ये लाभ राज्य सरकार के उपक्रमों, निगमों तथा मण्डलों के अध्यक्ष को उपबंधित किए गए लाभ से अधिक नहीं होंगे । (2) इस संबंध में व्यय , परिषद् की निधि में से किया जाएगा । ";
8. नियम 96 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए , अर्थात्ः-
"96 (1 ) रजिस्ट्रार, राज्य प्रशासनिक सेवा का कोई अधिकारी होगा, जो परिषद् में प्रतिनियुक्ति पर या अंशकालिक आधार पर राज्य सरकार द्वारा नियुक्त किया जाएगा
परन्तु ऐसे रजिस्ट्रार का पारिश्रमिक जो अंशकालिक आधार पर नियुक्त हैं, उनके वेतन की ऐसी प्रतिशतता, जैसी कि राज्य सरकार द्वारा नियत की जाए या 3000 /- रूपए माह, जो भी उच्चतर हो, पर भुगतान किया जाएगा । " (2) रजिस्ट्रार की सेवाएं राज्य सरकार द्वारा जारी आदेशों/ निदेशों के अनुसार जारी रखी जाएंगी । मध्यप्रदेश राजपत्र, दिनांक 15 सितम्बर 2020

(3) कार्यालय प्रमुख के रूप में, रजिस्ट्रार ऐसे कर्तव्यों का निर्वहन तथा ऐसी शक्तियों का प्रयोग करेंगे , जैसी कि उन्हें अधिनियम या नियमों के अधीन सौंपी जाएं तथा वह वित्त विभाग द्वारा कार्यालय प्रमुख को सौंपे गए अधिकारों का प्रयोग कर सकेंगे । वह परिषद् की सम्पत्ति की पूर्ण सुरक्षा तथा कार्यालय के नियंत्रण और प्रबंध , लेखाओं और पत्राचार के लिए उत्तरदायी रहेंगे तथा सामान्यतः ऐसे सभी कर्तव्यों का पालन करेंगे , जैसी कि अधिनियम के प्रयोजन के लिए परिषद् द्वारा अपेक्षित किया जा सके ।
(4) रजिस्ट्रार , परिषद् के सम्मेलन में तथा कार्यकारी समिति में सदस्य सचिव के रूप में में उपस्थित रहेंगें एंव कार्यवाहियों की टिप्पणियां प्राप्त करेंगे ।" ;
9. नियम 97 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए , अर्थात्ः-
आवश्यक आदेश जारी
* "97 (1 ) नियुक्ति/ स्थानांतरण / पदोन्नति / कमौन्नति तथा कर्मचारियों की स्थापना से संबंधित अन्य कार्य शासकीय सेवकों को यथा प्रयोज्य समय - समय पर यथा संशोधित मूलभूत नियमों तथा अनुपूरक नियमों द्वारा शासित होंगे । रजिस्ट्रार , परिषद् के पूर्व अनुमोदन के पश्चात् उपरोक्त उपबंधों के संबंध में करेगा ।
(2) कर्मचारियों को वेतन तथा भत्ते राज्य सरकार के आदेश के अनुसार देय होंगे । (3) (एक) कर्मचारी तथा विशेषज्ञ , जो संविदा आधार पर या आउटसोर्स अभिकरण द्वारा नियुक्ति किए जाएं , को शासन द्वारा नियत दर पर शासन तथा परिषद् के पूर्वअनुमोदन के अनुसार भुगतान किया जाएगा ।
(दो) ऐसी नियुक्ति के लिए राज्य शासन के पूर्व अनुमोदन की आवश्यकता होगी । 10. नियम 98 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए , अर्थात्ः-
"98 रजिस्ट्रार की शक्तियां.- मध्यप्रदेश राजपत्र , दिनांक 15 सितम्बर 2020
606(3) प्रभारी अधिकारी के रूप में , रजिस्ट्रार को आदेश देने की शक्ति होगी तथा वह कर्मचारिवृंद पर नियंत्रण करेगा । कर्मचारिवृंद के विभिन्न प्रवर्गों के कर्तव्य ऐसे होंगे , जैसे कि समय - समय पर रजिस्ट्रार द्वारा उन्हें समनुदेशित किए जाएं । रजिस्ट्रार मध्यप्रदेश सिविल सेवा ( वर्गीकरण, नियंत्रण तथा अपील) नियम, 1966 के अधीन अनुशासनिक प्राधिकारी होगा ।
11. नियम 106 के स्थान पर , निम्नलिखित नियम स्थापित किया जाए , अर्थात्ः-
" 106 रजिस्ट्रीकरण प्रमाण- पत्र के गुम जाने या नष्ट हो जाने की दशा में, धारक , ऐसे प्रमाण - पत्र के प्रवृत्त रहने के दौरान किसी भी समय , फार्मेसी एक्ट की धारा 39 के अधीन नवीन प्रमाण - पत्र के लिए रजिस्ट्रार को आवेदन कर सकेगा तथा रजिस्ट्रार, आवेदक की पहचान तथा मूल प्रमाण- पत्र जारी किए जाने के प्रमाण के संबंध में संतोषप्रद सबूत प्रस्तुत किए जाने पर , ऐरो शुल्क के भुगतान पर, जैसी कि परिषद् द्वारा विहित की जाए , ऐसा प्रमाण- पत्र प्रदान कर सकेगा । इस उप - नियम के अधीन जारी प्रमाण- पत्र पर रजिस्ट्रीकरण की दूसरी प्रति चिन्हित होगी । परिषद् , आदेश द्वारा , समय-समय पर रजिस्ट्रीकरण प्रमाण-पत्र की दूसरी प्रति के लिए शुल्क विहित करेगी । " I
12. नियम 107 में, उप- नियम (1 ) के स्थान पर, निम्नलिखित उप- नियम स्थापित किया जाए ।
" (1 ) अधिनियम के अधीन रजिस्ट्रीकृत प्रत्येक व्यक्ति का नाम, उसमें अंतर्विष्ट उपबंधों के अध्यधीन उसमें दर्ज रहेगा तथा ऐसे व्यक्ति का रजिस्ट्रीकरण पांच वर्ष के लिए मान्य रहेगा ।" ।
13. नियम 113 में, उप- नियम (2) के पश्चात्, निम्नलिखित उप - नियम अन्तःस्थापित किया जाए, अर्थात्:-

"(3) जिले में पदस्थ औषधि निरीक्षक का यह उत्तरदायित्व होगा, कि वह प रजिस्ट्रीकृत फार्मासिस्ट की मृत्यु के बारे में, समय- समय पर मध्यप्रदेश फार्मेसी परिषद् के रजिस्ट्रार को सूचित करे, ताकि ऐसे फार्मासिस्ट का रजिस्ट्रीकरण निरस्त किया जा सके । " I
14. नियम 124 में, उप - नियम (1 ) के स्थान पर, निम्नलिखित उप-नियम स्थापित किया जाए , अर्थात्ः-
"(1 ) अधिनियम के अध्याय चार के अधीन देय शुल्क तथा रजिस्टर की प्रतिलिपि के लिए आवेदन करने के प्रभार तथा संबंधित निम्नलिखित अन्य प्रयोजनों के लिए शुल्क तथा प्रभार ऐसे होंगे , जो कि प्रत्येक तीन वर्ष के लिए परिषद् के आदेश द्वारा नियत किए जाएं ।
(एक) रजिस्टर में प्रथम रजिस्ट्रीकरण के लिए ।
(दो) पश्चात्वर्ती रूप से रजिस्ट्रीकृत प्रत्येक अर्हता या प्रास्थिति के लिए ।
(तीन) उस वर्ष या वर्षों , जिसके दौरान शेष नाम हटा दिए गए थे के प्रतिधारण शुल्क के अतिरिक्त वार्षिक प्रतिधारण शुल्क के गैर भुगतान के लिए हटाए जाने के पश्चात् रजिस्टर बहाली के लिए ।
(चार) वार्षिक प्रतिधारण के लिए । ..
(पांच) अधिनियम की धारा 37 के अधीन रजिस्टर के प्रतिधारण के लिए ।
(छह) नाम परिवर्तन के रजिस्ट्रीकरण के लिए ।
(सात) रजिस्टर में किसी प्रविष्टि की प्रत्येक प्रमाणित प्रतिलिपि के लिए ।
(आठ) नियम 4(2) के अधीन किसी दूसरी प्रमाणित प्रतिलिपि के लिए ।
(नौ) आवेदन प्ररूप (नौ) के लिए फीस ।
(दस) डाक टिकट ।
(ग्यारह) इस राज्य से किसी अन्य राज्य में रजिस्ट्रीकृत फार्मासिस्ट के स्थानांतरण की दशा में "अनापत्ति प्रमाण- पत्र" के लिए फीस ।
(बारह) पुनश्चर्या पाठ्यक्रम हेतु फीस ।
(तेरह) परिषद् द्वारा संचालित अन्य कार्यक्रमों के लिए फीस तथा अंशदान " ।
15. नियम 129 में, खण्ड (ग) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए , अर्थात्ः-
" (ग) अशासकीय सदस्य को उसके निवास के स्थान पर आयोजित सम्मेलनों के लिए वाहन भत्ते का भुगतान ऐसी दर से किया जाएगा जैसा कि राज्य सरकार द्वारा नियत किया गया है । " । मध्यप्रदेश राजपत्र, दिनांक 15 सितम्बर 2020
606(5) No.F 3-1 / 2020/ 17/ M - 1 : -In exercise of the powers conferred by section 46 of the Pharmacy Act , 1948 (No. 8 of 1948 ) , the State Government , hereby , makes the following amendments in the Madhya Pradesh Pharmacy Rules , 1978 , namely : -
AMENDMENTS
In the said rules , -
1. After rule 5 , the following rule shall be inserted , namely : - " 5 A. Council Fund-
There shall be a Council Fund which shall consist of the anticipated grant received from the State Government and the amount received from Registration . The amount of the fund shall be utilised for the following purposes : -
(a) for payment of pay and allowances to the officers and employees of the Council;
(b) for construction of Council's building and for maintenance thereof;
(c) for implementation of scheme prepared for the welfare of the registered Pharmacists and their families ;
(d) for promotion of new research work in the field of Pharmacy;
(e) for encouragement of students studying in the Pharmacy subjects;
(f) for implementation of programmes relating to life insurance and health insurance of Registered Pharmacists ;
(g) for holding refresher courses , training programmes , seminar , workshops , employment fair and professional training for registered pharmacist ;

(h) for establishment of " drugs information centre " and conducting the centre ;
(i) for maintenance of website of the Council and its proper operation;
(j ) for conducting regular training programmes for Pharmacy teachers ;
(k) for honouring and encouraging the topper graduate and post graduate students of Pharmacy faculty of various universities of Madhya Pradesh ;
(1) for publication of pharmaceutical journal or bulletin or news letter;
(m) for obtaining the services of experts or other staff on contractual basis or by outsource agency for some period , if needed , by the Council .
2. In rules 6 , for the word and figures "Rupees 200 " the word and figures " Rupees 5000 " shall be substituted .
3. Rule 8 , shall be omitted .
4. For rule 13 , the following rule shall be substituted , namely: - " 13. The Registrar may incur an expenditure , -
(a) not exceeding Rupees 50,000 / - ;
(b) not exceeding Rupees 1 lakh sou motu with the prior approval of the President ;
(c) exceeding Rupees 1 lakh , with the prior approval of the State Government . " .
5 . In rule 14 , the following words . "But if the claim exceeds Rs 50 the payment shall not be made until it has been examined and passed by the President shall be omitted . " .
6. In rule 27 , for the word and figures " Rupees 50 " , the word and figures " Rupees 10,000 " shall be substituted and for the word "Money order or insured Registered Post " the word " online transaction " shall be substituted ;
7 . After rule 45 , the following rule shall be inserted , namely: - मध्यप्रदेश राजपत्र , दिनांक 15 सितम्बर 2020
606(7) "45.A ( 1 ) The President of the Council shall be entitled to such benefit and perquisites , as fixed by the State Government form time to time but these benefits and perquisites shall not be more than as are provided to the President undertakings , Corporations and Government . of Boards fixed by the State (2) The expenditure in this respect shall be made from the fund of the Council . " ;
8. For rule 96 , the following rule shall be substituted , namely: - "96. ( 1) The Registrar shall be an officer of State Administrative Service who shall be appointed by the State Government on deputation or on part time basis in the Council :
Provided that the remuneration of the Registrar who is appointed on part - time basis shall be paid on such percentage of his salary as may be fixed by the State Government or Rupees 3000/ - per month which ever is higher . "
(2) The services of the Registrar shall be continued according to the orders / directions of the State Government .
(3) As officer incharge , the Registrar shall perform such duties and exercise such power as may be assigned to him under the Act or the rules and he shall exercise the power of a office incharge as assigned by the Finance Department of the State Government . He shall also be responsible for the safety of the property of the Council and the control and management of the office accounts and correspondence and shall generally perform all such duties as may be required by the Council for the purpose of the Act .
(4) The Registrar shall attend and take notes of proceedings of the meeting of the council and the Executive Committee as member secretary. " ;

9. and For rule 97 , the following rule shall be substituted , namely : - "97. (1) The appointment / transfer / promotion and other concerning work of establishment of the employees , shall be governed by the fundamental Rules supplementary Rules made thereunder as amended from time to time as they are applicable to the Government servants . The Registrar shall issue necessary orders in respect of above provisions after prior approval of the Council .
(2) The pay and allowances shall be payable to the employees according to the orders of the State Government .
(3) ( i) The employees and expert who will be appointed on contractual basis or by outsource agency , shall be paid according to the rate fixed by Government and the previous approval of Council .
( ii) Previous approval of the State Government shall be required for such appointment.
10. For rule 98, the following rule shall be substituted , namely : - " 98. Powers of Registrar , - As the officer incharge the Registrar shall have power to give orders and shall exercise control over the staff . The duties of various categories of the staff shall be such as may be assigned to them by the Registrar from time to time . Registrar shall be the disciplinary authority under the Pradesh Civil Services ( Classification , Control and ". Madhya Appeal) Rules , 1966 .
11. For rule 106 , the following rule shall be substituted , namely: - " 106. In case the Registration Certificate is lost or destroyed , the holder may , at any time during which such certificate is in force , apply to the Registrar under section 39 of the मध्यप्रदेश राजपत्र, दिनांक 15 सितम्बर 2020
606(9) Pharmacy Act , for a fresh certificate and the Registrar may , if he thinks fit on furnishing satisfactory proof as to the identity of the applicant and proof of issuing original certificate , grant such certificate on payment of such fee as may be prescribed by the council . The certificate issued under this sub - rule shall be marked Duplicate Registration . The council shall , by order , prescribe the fee for Duplicate Registration Certificate from time to time . " .
12. In rule 107 , for sub- rule ( 1 ) , following sub - rule shall be substituted :- " ( 1 ) The name of every person registered under the Act , shall subject to the provisions contained therein , remain entered therein and the registration of such person shall hold good for five years from the date of the registration . " .
13. In rule 113, after sub- rule ( 2) , the following sub-rule shall be inserted , namely: -
" (3) It shall be the responsibility of the Drug Inspector posted in the District to inform the Registrar , Madhya Pradesh Pharmacy Council from time to time about the death of Registered Pharmacist so that the Registration of such Pharmacist may be cancelled . " .
14. In rule 124 , for sub- rule ( 1 ) , the following sub- rule shall be substituted , namely: -
" ( 1) The fees payable under chapter IV of the Act and charges for applying copies of the register and the fee and charges for related following other purposes , shall be such as may be fixed , by order , of the every three years . council for (i) For the first registration in the register .
(ii) Forevery qualification or status subsequently registered .
( iii) For restoration to the register after removal for non payments of annual retention fees in to the retention fee for the year or years which the name remained removed . addition during (iv) For annual retentions .

(v) For retention to the register under section 37 of the Act .
(vi) For registration of a change name .
(vii ) For every certified copy of an entry in the register .
(viii ) For a duplicate certificate under rule 4 (2) .
(ix) Fee for application form (ix).
(x) Postage stamp .
(xi) Fee for No Objection Certificate " in the case of transfer of Registered Pharmacist from this State to another State .
(xii) Fee for the Refresher Courses .
(xiii) Fee and contribution for the other programme conducted by the Council . " .
15. In rule 129 , for clause (c) , the following clause shall be substituted , namely: -
"(c) a non - official member shall be paid for meetings held at the place of his residence , conveyance allowance at such rate as has been fixed by the State Government to such member . " .
