मध्यप्रदेश नगरपालिक विधि ( तृतीय संशोधन ) अध्यादेश , २०२०
[" मध्यप्रदेश राजपत्र ( असाधारण ) " में दिनांक २६ सितम्बर , २०२० को प्रथमबार प्रकाशित किया गया. ]
भारत गणराज्य के इकहत्तरवें वर्ष में राज्यपाल द्वारा प्रख्यापित किया गया.
मध्यप्रदेश नगरपालिक निगम अधिनियम, १ ९ ५६ तथा मध्यप्रदेश नगरपालिका अधिनियम, १ ९ ६१ को और संशोधित करने हेतु अध्यादेश.
यतः , राज्य के विधान- मंडल का सत्र चालू नहीं है और मध्यप्रदेश के राज्यपाल का यह समाधान हो गया है कि ऐसी परिस्थितियां विद्यमान हैं, जिनके कारण यह आवश्यक हो गया है कि तुरन्त कार्रवाई करें;
अतएव , भारत के संविधान के अनुच्छेद २१३ के खण्ड ( १ ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, मध्यप्रदेश के राज्यपाल निम्नलिखित अध्यादेश प्रख्यापित करते हैं :-
संक्षिप्त नाम.
१. इस अध्यादेश का संक्षिप्त नाम मध्यप्रदेश नगरपालिक विधि ( तृतीय संशोधन ) अध्यादेश, २०२० है.
२. इस अध्यादेश के प्रवर्तन की कालावधि के दौरान मध्यप्रदेश नगरपालिक निगम अधिनियम, १ ९ ५६ (क्रमांक २३ सन् १ ९ ५६ ) तथा मध्यप्रदेश नगरपालिका अधिनियम, १ ९ ६१ ( क्रमांक ३७ सन् १ ९६१ ) धारा ३ से ४ में विनिर्दिष्ट संशोधनों के अध्यधीन रहते हुए प्रभावी होंगे .
मध्यप दा अधिनियम क्रमांक २३ सन् १ ९ ५६ तथा अधिनियम क्रमांक ३७ सन् १९ ६१ का अस्थाई रूप से संशोधित किया जाना.
भाग-एक
मध्यप्रदेश नगरपालिक निगम अधिनियम , १ ९ ५६ ( क्रमांक २३ सन् १ ९ ५६ ) का संशोधन ३. मध्यप्रदेश नगरपालिक निगम अधिनियम, १ ९ ५६ ( क्रमांक २३ सन् १ ९५६ ) में, -
( १ ) धारा ९ में, -
मध्यप दा अधिनियम क्रमांक २३ सन् १ ९ ५६ का संशोधन.
(क) उपधारा ( १ ) में, खण्ड ( क ) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए, अर्थात्ः- " ( क) नगरपालिक क्षेत्र से प्रत्यक्ष निर्वाचन द्वारा निर्वाचित महापौर अर्थात् सभापति; ".
(ख) उपधारा ( ४ ) के स्थान पर, निम्नलिखित उपधारा स्थापित की जाए, अर्थात् : - " (४ ) यदि कोई नगरपालिक क्षेत्र महापौर का निर्वाचन करने में असफल रहे या कोई वार्ड पार्षद् का निर्वाचन करने में असफल रहे , तो यथास्थिति, ऐसे नगरपालिक क्षेत्र या वार्ड के स्थान को भरने के लिये छह माह के भीतर नई निर्वाचन कार्यवाही प्रारंभ की जाएगी और जब तक उस स्थान को भरा नहीं जाता उसे आकस्मिक रिक्ति समझा जाएगा:

684(1) परंतु अधिनियम के अधीन अध्यक्ष या समिति में से किसी के निर्वाचन की कार्यवाहियां, ऐसे स्थान का निर्वाचन लंबित रहते स्थगित नहीं की जाएंगी. " .
(२ ) धारा १० में, उपधारा ( ४ ) में, प्रथम परन्तुक में, शब्द " दो माह " के स्थान पर, शब्द " छह माह " स्थापित किए जाएं.
(३ ) धारा १४ में, -
(क) उपधारा ( १ ) में शब्द " पार्षदों " के पश्चात्, शब्द " तथा महापौर " अन्तःस्थापित किए जाएं.
(ख) उपधारा ( २ ) में, शब्द " पार्षदों " के पश्चात्, शब्द " तथा महापौर " अन्तःस्थापित किए जाएं.
(४) धारा १४- क में, उपधारा ( १ ) में , शब्द " पार्षद् " के स्थान पर, शब्द " महापौर अथवा पार्षद्" स्थापित किए जाएं.
(५ ) धारा १४ - ख में , शब्द " पार्षद् " के स्थान पर , शब्द " महापौर अथवा पार्षद्" स्थापित किए जाएं.
(६ ) धारा १४ - ग में, शब्द " पार्षद्" के पश्चात्, शब्द " या महापौर " अन्तःस्थापित किए जाएं.
(७ ) धारा १५ में,-
शब्द " पार्षदों " के पश्चात्, शब्द " या महापौर " जोड़े जाएं.
(क)
(ख) परंतुक के स्थान पर , निम्नलिखित परंतुक स्थापित किया जाए, अर्थात् : -
" परंतु कोई भी व्यक्ति यथास्थिति, पार्षदों के किसी निर्वाचन में या महापौर के निर्वाचन में, एक से अधिक बार मतदान नहीं करेगा. ".
(८ ) धारा १६ में, उपधारा ( ३ ) के पश्चात्, निम्नलिखित उपधारा जोड़ी जाए, अर्थात् :-
" ( ४ ) यदि कोई व्यक्ति महापौर और पार्षद् दोनों पदों के लिये निर्वाचित हो जाता है , तो उसे निर्वाचित घोषित किए जाने की तारीख से सात दिन के भीतर किसी एक पद से अपना त्यागपत्र देना होगा.".
(९ ) धारा १७ में, -
" ( क ) पार्श्व शीर्ष में, शब्द " पार्षद्" के पश्चात् शब्द " या महापौर " जोड़े जाएं.
उपधारा ( १ ) में, -
(ख)
(एक) प्रारंभिक पैरा में, शब्द " पार्षद् " के पश्चात्, शब्द " या महापौर " अन्तःस्थापित किए जाएं;
खण्ड ( ख ख ) में, शब्द " पार्षद्" के पश्चात्, शब्द " या महापौर " अन्तःस्थापित किए जाएं.

(ग) उपधारा ( २ ) में, -
(एक) पार्श्व शीर्ष में, शब्द " पार्षद्" के पश्चात्, शब्द " या महापौर " जोड़े जाएं;
(दो) प्रारंभिक पैरा में , शब्द " पार्षद्" के पश्चात्, शब्द " या महापौर " अन्तःस्थापित किए जाएं;
(तीन) खण्ड (ङ) में , शब्द " पार्षद् " के पश्चात्, शब्द " या महापौर " अन्तःस्थापित किए जाएं.
( घ) उपधारा ( ३ ) में, शब्द " पार्षद" जहां कहीं भी वह आया हो, के स्थान पर, शब्द " पार्षद् या महापौर " स्थापित किए जाएं.
(१० ) धारा १७ - ख में, -
(क) पार्श्व शीर्ष में , शब्द " पार्षद् " के स्थान पर, शब्द " महापौर तथा पार्षद्" स्थापित किए जाएं;
( ख) उपधारा ( १ ) में, प्रारंभिक पैराग्राफ में, शब्द " प्रत्येक पार्षद्" के स्थान पर, शब्द " महापौर तथा प्रत्येक पार्षद्" स्थापित किए जाएं.
उपधारा ( २ ) में,
(ग)
( एक) प्रारंभिक पैराग्राफ में, शब्द " पार्षद् " जहां कहीं भी वह आया हो, के स्थान पर, शब्द " महापौर या पार्षद्" स्थापित किए जाएं;
(दो) परन्तुक में , शब्द " पार्षद् " के स्थान पर, शब्द " महापौर या पार्षद्" स्थापित किए जाएं.
(११ ) धारा १८ में, -
पार्श्व शीर्ष के स्थान पर, निम्नलिखित पार्श्व शीर्ष स्थापित किया जाए, अर्थात्:-
(क)
" अध्यक्ष ( स्पीकर ) का निर्वाचन " ;
(ख) उपधारा ( १ ) में, शब्द " तथा महापौर " का लोप किया जाए.
(१२ ) धारा २० में , स्पष्टीकरण में , शब्द " तथा महापौर " का लोप किया जाए.
(१३ ) धारा २३ - क में, -
(क) पार्श्व शीर्ष में तथा उपधारा ( १ ) में, शब्द " या महापौर " जहां कहीं भी वे आए हों, का लोप किया जाए;
(ख) उपधारा ( २ ) के खण्ड ( दो ) में, शब्द " अध्यक्ष , महापौर " के स्थान पर, शब्द " महापौर " स्थापित किया जाए.

684(3) (१४ ) धारा २३ - क के पश्चात्, निम्नलिखित धारा अंतःस्थापित की जाए, अर्थात्: -
महापौर का वापस बुलाया जाना .
" २४. ( १ ) किसी निगम के प्रत्येक महापौर द्वारा अपना पद तत्काल रिक्त कर दिया गया समझा जाएगा , यदि उसे ऐसी प्रक्रिया के अनुसार, जैसी कि विहित की जाए, निगम क्षेत्र के मतदान करने वाले मतदाताओं की कुल संख्या के आधे से अधिक मतदाताओं के बहुमत द्वारा गुप्त मतदान से वापस बुलाया जाएः
परन्तु वापस बुलाने की ऐसी कोई प्रक्रिया तक तक आरम्भ नहीं की जाएगी जब तक कि निर्वाचित पार्षदों की कुल संख्या से कम से कम तीन चौथाई पार्षदों द्वारा प्रस्ताव पर हस्ताक्षर न कर दिए जाएं और उसे संभागीय आयुक्त को प्रस्तुत न कर दिया जाएः
परन्तु यह और कि ऐसी कोई प्रक्रिया, -
(एक) उस तारीख से, जिसको कि ऐसा महापौर निर्वाचित होता है और अपना पद धारण करता है , दो वर्ष की कालावधि के भीतर ; और
(दो) महापौर के उप चुनाव में निर्वाचित होने की दशा में उसकी पदावधि की आधी कालावधि का अवसान हो गया हो,
आरम्भ नहीं की जाएगी:
परन्तु यह और भी कि महापौर को वापस बुलाए जाने की प्रक्रिया उसकी संपूर्ण पदावधि में एक बार ही आरम्भ की जाएगी.
(२) संभागीय आयुक्त, अपना समाधान कर लेने और यह सत्यापित कर लेने के पश्चात् कि उप - धारा ( १ ) में विनिर्दिष्ट तीन - चौथाई पार्षदों ने वापस बुलाए जाने के प्रस्ताव पर हस्ताक्षर कर दिए हैं, प्रस्ताव राज्य सरकार को भेजेगा और राज्य सरकार उसे राज्य निर्वाचन आयोग को निर्देशित करेगी .
(३) निर्देश प्राप्त होने पर, राज्य निर्वाचन आयोग , वापस बुलाए जाने के प्रस्ताव पर, ऐसी रीति में, जैसी कि विहित की जाए, मतदान कराने की व्यवस्था करेगा." .
(१५) धारा ४४१ में, उपधारा ( २ ) में, खण्ड ( ख ) में, उप- खण्ड ( तीन ) के स्थान पर, निम्नलिखित उप- खण्ड स्थापित किया जाए, अर्थात् :-
" (तीन ) महापौर के निर्वाचन की दशा में, नगरपालिक क्षेत्र के किसी मतदाता द्वारा. ".
भाग-दो
मध्यप्रदेश नगरपालिका अधिनियम, १ ९ ६१ ( क्रमांक ३७ सन् १ ९ ६१ ) का संशोधन
मध्यप दा ४. मध्यप्रदेश नगरपालिका अधिनियम, १ ९ ६१ ( क्रमांक ३७ सन् १ ९ ६१ ) में, -
(१ ) धारा १ ९ में, -
अधिनियम क्रमांक ३७ सन् १ ९ ६१ का संशोधन.
(क) उपधारा ( १ ) में, खण्ड ( क ) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए, अर्थात्: -
" (क ) नगरपालिक क्षेत्र से प्रत्यक्ष निर्वाचन द्वारा निर्वाचित अध्यक्ष अर्थात् सभापति ( चेयरपर्सन ) ; " मध्यप्रदेश राजपत्र, दिनांक 26 सितम्बर 2020

उपधारा (४ ) के स्थान पर, निम्नलिखित उपधारा स्थापित की जाए, अर्थात्:-
(ख)
" (४ ) यदि कोई नगरपालिक क्षेत्र, अध्यक्ष का निर्वाचन करने में असफल रहे या कोई वार्ड, पार्षद् का निर्वाचन करने में असफल रहे, तो यथास्थिति, ऐसे नगरपालिक क्षेत्र या वार्ड के स्थान को भरने के लिये छह माह के भीतर नवीन निर्वाचन कार्यावाहियां प्रारंभ की जाएंगी और जब तक उस स्थान को भरा नहीं जाता उसे आकस्मिक रिक्ति के रूप में समझा जाएगाः
परन्तु अधिनियम के अधीन उपाध्यक्ष या समितियों में ले किसी के निर्वाचन की कार्यवाहियां, ऐसे स्थान का निर्वाचन लंबित रहते स्थगित नहीं की जाएगी . ".
(२ ) धारा २० में, उपधारा ( २ ) में, खण्ड ( ख ) में, उप- खण्ड ( तीन ) के स्थान पर, निम्नलिखित उप- खण्ड स्थापित किया जाए, अर्थात्:-
" ( तीन ) अध्यक्ष के निर्वाचन की दशा में नगरपालिक क्षेत्र के किसी मतदाता द्वारा ; ".
(३ ) धारा २ ९ में, उपधारा ( ४ ) में, प्रथम परन्तुक में, शब्द " दो माह " के स्थान पर, शब्द " छह माह " स्थापित किए जाएं.
(४) धारा ३२ में, -
(क) उपधारा ( १ ) में , शब्द " पार्षदों " के स्थान पर, शब्द " अध्यक्षों तथा पार्षदों " स्थापित किए जाएं;

(५ ) धारा ३२ - क में, उपधारा ( १ ) में शब्द " पार्षद " जहां कहीं भी वह आया हो , के स्थान पर, शब्द " अध्यक्ष तथा पार्षद्" स्थापित किए जाएं.
(६ ) धारा ३२ - ख में, शब्द " पार्षद्" के स्थान पर, शब्द " अध्यक्ष तथा पार्षद्" स्थापित किए जाएं.
(७ ) धारा ३२ - ग में, शब्द " पार्षद्" के स्थान पर, शब्द " पार्षद् या अध्यक्ष " स्थापित किए जाएं.
(८) धारा ३३ में, -
प्रारंभिक पैरा में, शब्द " पार्षदों " के पश्चात्, शब्द " या अध्यक्ष " जोड़े जाएं;
( क)
(ख) विद्यमान परंतुक के स्थान पर, निम्नलिखित परंतुक स्थापित किया जाए, अर्थात्:-
" परन्तु कोई भी व्यक्ति यथास्थिति, पार्षदों के किसी निर्वाचन में या अध्यक्ष के किसी निर्वाचन में एक से अधिक बार मतदान नहीं करेगा. " .
( ९ ) धारा ३५ में, शब्द " पार्षद् के रूप में निर्वाचन या नामनिर्देशन " के पूर्व, शब्द " अध्यक्ष के रूप में निर्वाचन या " अन्तःस्थापित किए जाएं.
(१० ) धारा ४३ में, -
पार्श्व शीर्ष में , शब्द " अध्यक्ष तथा " का लोप किया जाए;

(ख) उपधारा ( १ ) के स्थान पर, निम्नलिखित उपधारा स्थापित की जाए, अर्थात्:-
" ( १ ) परिषद् का अध्यक्ष तथा निर्वाचित पार्षद्, धारा ५५ की उपधारा ( १ ) में यथानिर्दिष्ट प्रथम सम्मिलन में, विहित रीति में निर्वाचित पार्षदों में से उपाध्यक्ष का चुनाव करेंगे. ";
उपधारा ( ३ ) में, शब्द " अध्यक्ष तथा " का लोप किया जाए.
(ग)
( ११ ) धारा ४३ - क में , -
(क) पार्श्व शीर्ष में और उपधारा ( १ ) में , शब्द " अध्यक्ष या " जहां कहीं भी वे आए हों, का लोप किया जाए;
(ख) उपधारा ( २ ) में, खण्ड ( दो ) में, शब्द " अध्यक्ष, उपाध्यक्ष " के स्थान पर, शब्द " उपाध्यक्ष " स्थापित किया जाए.
(१२ ) धारा ४६ के पश्चात्, निम्नलिखित धारा अन्तःस्थापित की जाए, अर्थात् :-
अध्यक्ष का वापस बुलाया जाना.
"४७. ( १ ) किसी परिषद् के प्रत्येक अध्यक्ष द्वारा अपना पद तत्काल रिक्त कर दिया गया समझा जाएगा यदि उसे ऐसी प्रक्रिया के अनुसार, जो कि विहित की जाए, नगरपालिका क्षेत्र के मतदान करने वाले मतदाताओं की कुल संख्या के आधे से अधिक मतदाताओं के बहुमत द्वारा गुप्त मतदान से वापस बुलाया जाएः

(२) कलक्टर अपना समाधान कर लेने और यह सत्यापन कर लेने के पश्चात् कि उपधारा ( १ ) में विनिर्दिष्ट तीन - चौथाई पार्षदों ने वापस बुलाए जाने का प्रस्ताव कर दिया है , प्रस्ताव राज्य सरकार को भेजेगा और राज्य सरकार उसे राज्य निर्वाचन आयोग को निर्दिष्ट करेगी.
(३) निर्देश प्राप्त होने पर, राज्य निर्वाचन आयोग वापस बुलाए जाने के प्रस्ताव पर ऐसी रीति में , जैसी कि विहित की जाए, मतदान कराने के लिये व्यवस्था करेगा. ".

( १३ ) धारा ५५ के स्थान पर , निम्नलिखित धारा स्थापित की जाए, अर्थात्:-
साधारण निर्वाचन के पश्चात् प्रथम सम्मिलन.
" ५५. ( १ ) मुख्य नगरपालिका अधिकारी , विहित प्राधिकारी के अनुमोदन से, प्रत्येक साधारण निर्वाचन के पन्द्रह दिन के भीतर उपाध्यक्ष का निर्वाचन करने के प्रयोजन के लिए निर्वाचित पार्षदों का सम्मिलन बुलाएगा.
(२ ) उपधारा ( १ ) के अधीन बुलाए गए परिषद् के प्रथम सम्मिलन की अध्यक्षता कलक्टर द्वारा नियुक्त किए गए ऐसे अधिकारी द्वारा , जो नगपपालिका परिषद् के मामले में डिप्टी कलक्टर की पद श्रेणी से निम्न पद श्रेणी का न हो तथा नगर परिषद् के मामले में तहसीलदार की पद श्रेणी से निम्न पद श्रेणी का न हो, की जाएगी और इस अध्याय में अंतर्विष्ट वे समस्त उपबंध जो परिषद् के सम्मिलनों के बारे में है , यथाशक्य ऐसे सम्मिलन के संबंध में लागू होंगे:
परन्तु अध्यक्षता करने वाले अधिकारी को ऐसे सम्मिलन में मत देने का अधिकार नहीं होगा और मतों के बराबर होने की दशा में परिणाम का विनिश्चय लॉट द्वारा किया जाएगा. ".
( १४ ) धारा ५६ में, अंक , चिन्ह, अक्षर तथा अर्धविराम " ४३ - क, " के पश्चात्, अंक तथा अर्धविराम " ४७, " अन्तःस्थापित किए जाएं.
( १५ ) धारा ६२ में, उपधारा ( ३ ) में, खण्ड ( तीन ) के परंतुक में, अंक, चिन्ह तथा अक्षर " ४३ - क " के पश्चात्, शब्द, अंक तथा अर्धविराम " या ४७ , " अन्तःस्थापित किए जाएं.
( १६ ) धारा ६३ में, परन्तुक में, शब्द " अध्यक्ष " के पूर्व, शब्द " उपाध्यक्ष या ", अन्तःस्थापित किए जाएं.
(१७ ) धारा ३२८ में, उपधारा ( १ ) में, खण्ड ( ख ) में, शब्द " अध्यक्ष तथा " जहां कहीं भी वे आए हों, का लोप किया जाए.

An Ordinance further to amend the Madhya Pradesh Municipal Corporation Act, 1956 and the Madhya Pradesh Municipalities Act, 1961 .
WHEREAS, the State Legislature is not in session and the Governor of Madhya Pradesh is satisfied that cirecumstances exist which render it necessary for him to take immedaite action;
NOW , THEREFORE , in exercise of the powers conferred by clause ( 1 ) of Article 213 of the Constitution of India, the Governor of Madhya Pradesh is pleased to promulgate the following Ordinance :-
1. This Ordinance may be called the Madhya Pradesh Nagarpalik Vidhi ( Tritiya Sanshodhan) Adhyadesh , 2020 . Short title.
2. During the period of operation of this Ordinance , the Madhya Pradesh Municipal Corporation Act , 1956 ( No. 23 of 1956) and the Madhya Pradesh Municipalities Act , 1961 (No. 37 of 1961 ) shall have effect subject to the amendments specified in Sections 3 and 4.
PART-I
Madhya Pradsh Act No. 23 of 1956 and Act No. 37 of 1961 to be temporarily amended.
AMENDMENT TO THE MAHDYA PRADESH MUNICIPAL CORPORATION ACT, 1956 (NO . 23 OF 1956 )
3. In the Madhya Pradesh Municipal Corporation Act, 1956 (No. 23 of 1956) , ( 1 ) In Section 9 ,-
Amendment to the Madhya Pradesh Act No. 23 of 1956 .
(a) in sub - section ( 1 ) , for clause ( a) , the following clause shall be substituted , namely:--
"( a) a Mayor , that is Chairperson elected by direct election from the Municipal area , " .
(b) for sub - section ( 4) , the following sub- section shall be substituted , namely:-
"(4) If any municipal area fails to elect a Mayor on any ward fails to elect a Councillor, fresh election proceedings shall be commenced for such Municipal area or ward , as the case may be , within six months to fill up the seat and until the seat is filled up it shall be treated as casual vacancy :
Provided that proceedings of elecion of Speaker or any of the Committee under the Act shall not be stayed , pending the election of such seat . " .
(2) In Section 10 , in sub- section (4) , in the first proviso , for the words " two months " , the words " six months " shall be substituted .

(3) In Section 14 ,-
(a) in sub-section ( 1 ) , after the word "Councillors " , the words " and mayors " shall be inserted;
(b) in sub-section ( 2) , after the word " conuncillors " , the words " and Mayprs " shall be inserted.
(4) In Section 14 - A, in sub- section ( 1 ) , for the word "Councillor " , the words "Mayor or Councillor " shall be substituted .
(5) In Section 14 - B , for the word " Councillor " , the word " Mayor or Councillor " shall be substituted .
(6) In Section 14 - C,, after the word "Councillor " , the words "or a Mayor " shall be inserted.
(7) In Section 15 ,-
(a) after the word " Councillors " , the words " or Mayor " shall be added;
(b) for the proviso , the following proviso shall be substituted , namely:-
"Provided that no person shall vote more than once in any election of the Councillors or an election of the Mayor , as the case may be . " .
(8) in Section 16 , after sub- section (3 ) , the following sub - section shall be added , namely:-
"(4) If a person is elected for the Office of Mayor and Councillor both , he shall have to resign from one of the offices within seven days from the date on which he is declared elected . " .
(9) In Section 17 ,-
(a) in the marginal heading , after the word " Councillor " , the words " or Mayor " shall be added.
(b) in sub - section ( 1 ) .-
(i) in the opening paragraph , after the words , " Councillor " , the words " or Mayor " shall be inserted ;
(ii) in clause (bb ) , after the word " Councillor " , the words " or Mayor " shall be inserted .
(c) in sub - secction ( 2) ,-
( i) in the marginal heading , after the word "Councillor " , the words " or Mayor " shall be added;
( ii ) in the opening paragraph , after the word " Councillor " , the words " or mayor " shall be inserted;
(iii) in clause ( e) , after the word "Councillor " , the words " or Mayor " shall be inserted.
(d) in sub - section (3) , for the word "Councillor " wherever it occurs , the words "Councillor or Mayor " shall be substituted .

( 10) In Section 17 - B ,-
(a) in the marginal heading , for the words " the Councillor " , the words " the Mayor and the Councillor " shall be substituted;
(b) in sub - section ( 1 ) , in the opening paraggraph for the words "Every Councillor " , the words "Mayor and every Councillor " shall be substituted .
(c) in sub - section ( 2) ,-
(i) in the opening paragraph , for the word " Councillor " wherever it occurs , the words "Mayor or Conucillor " shall be substituted;
( ii ) in the proviso , for the words " Councillor " , the words " Mayor or Councillor " shall be substotuted .
( 11) In Section 18 ,-
of
" Election Speaker" ;
(a) for the marginal heading , the following marginal heading shall be substituted , namely:-
"Election of Speakar" ;
(b) in sub - section ( 1 ) , the words " and Mayor " shall be omitted.
(12) In Section 20, in the Explanation , the words " and the Mayor " shall be omitted.
( 13) In Section 23 - A ,-
(a) in the marginal heading and in sub - section ( 1 ) , the words " or Mayor " wherever they occur shall be omitted;
(b ) in clause ( ii ) of sub - section (2 ) . for the words "Speaker , Mayor " , the word "Mayor " shall be substituted .
(14) After Section 23 -A, the following section be , inserted, namely:-
Recalling of Mayor.
"24. ( 1 ) Every Mayor of a Corpoation shall forthwith be deemed to have vacated his office if he is recalled through a secret ballot by a majority of more than half of the total number of voters of the corporation area casting the vote in accordance with the procedure as may be prescribed:
Provided that no such process of recall shall be initiated unless a proposal is signed by not less than three-fourth of the total number of the elected Councillors and presented to the Divisional Commissioner :
Provided further that no such process shall be initiated ,-
(i) within a period of two years from the date on which such Mayor is elected and enters his offcie ; and
( ii) in case Mayor is elected in a by - election , half of the period of tenure has beenexpired:
Provided also that process for recall of the Mayor shall be initiated once in his whole term .

(2) the Divisional Commissioner, after satisfying himself and verifying that the three- forth of the Councillors specified in sub - section ( 1 ) have signed the proposal of recall , shall send the proposal to the State Government and the State Government shall make a reference to the State Election Coommissios .
(3) On receipt of the reference , the State Election Commission shall arrange for voting on the propoal of recall in such manner as may be prescribed. " .
(15) In Section 441 , in sub- section (2) , in clause ( b ) , for sub- clause ( iii ) , the followng sub- clause shall be subtituted , namely :-
"(iii) in the case of election of Mayor, by any voter of the Municipal area . " .
PART-II
AMENDMENT TO THE MAHDYA PRADESH MUNICIPALITIES ACT, 1961
(NO. 37 OF 1961 )
4. In the Madhya Pradesh Municipalities Act, 1961 ( No. 37 of 1961 ) ,-
(1) In Section 19 ,-
Amendment to the Madhya Pradesh Act No. 37 of 1961 .
(a) in sub- section ( 1 ) , for clause (a) , the following clause shall be subtituted , namely :-
"( a) president , that is Chairperson , elected by the direct election from the Municipal area; " .
(b) for sub - section (4) , the following sub -section shall be substituted, namely :-
"(4) If any Municipal area fails to elect a President or any Ward fails to elect a Councillor, fresh election proceedings shall be commenced for such Municipal area or Ward , as the case maybe , within six months to fill up the seat, and until the seat is filled up , it shall be treated as casual vacancy:
Provided that proceedings of election of Vice-President , or any of the Committes under the Act shall not be stayed , pending the election of such seat . " .
(2) In Section 20 , in sub- section (2) , in clause ( b ) , for sub- clause ( iii ) , the following sub- clause shall be substituted , namely:-
"( iii) in the case of election of President by any voter of the Municipal area ; " .
(3) In Section 29 , in sub- section ( 4) , in the first proviso , for the words " two months " , the words " six months " shall be substituted .
(4) In Section 32 ,-
(a) in sub - section ( 1 ) , for the word " Councillor " , the words " Presidents and Councillor " shall be substituted ;
(b) in sub - section ( 2) , for the word " Councillors " , the words " presdidents and Councillor " shall be substituted .
(5) In Section 32 - A, in sub- section ( 1 ) , for the word " Councillor " wherever it occurs , the words " President and Councillor " shall be substituted .
(6) In Section , 32 -B , for the word " Councillor " , the words "President and Councillor " shall be substituted .

684(11) (7) In Section 32 - C , for the word "Councillor " , the words " Councillor " or President " shall be substituted.
(8) In Section 33 ,-
(a) in the opening paragraph , after the word "Councillors " , the words " or President " shall be added ;
(b) for the existing proviso , the following proviso shall be substituted , namely :-
"Provided that no person shall vote more than once in any election of the Councillor or the President , as the case may be . " .
(9) In Section 35 , before the words " election or nomination as a Councillor " , the words "election as a President or " shall be inserted.
(10) In Section 43 ,-
(a) in the marginal heading , the words " the President and " shall be omitted ;
(b) for sub - section ( 1 ) , the following sub- section shall be substituted, namely :-
"( 1 ) the President and the elected Councillors of the Council shall , at its first meeting as referred to in sub- section ( 1 ) of Section 55 elect a Vice- President from amongst the elected Councillors in the prescribed manner . " ;
(c) in sub - section ( 3 ) , the words " the President and " shall be omitted .
(11) In Section 43 - A,-
( a) in the marginal heading and in sub- section ( 1 ) , for the words "the President or " wherever they occur, shall be omitted;
(b) in clause ( ii ) of sub- section ( 2) , for the word " President , Vice- President " , the words "Vice - President " shall be substituted.
( 12) After Section 46 , the following section shall be , inserted , namely :-
Recalling of President.
"47. ( 1 ) Every President of a Council shall forthwith be deemed to have vacated his office if he is recalled through a secret ballot by a majority of more than half of the total number of voters of the Municipality area casting the vote in accordance with the procedure as may be prescribed:

(i ) within a period of two years from the date on which such persident is elected and enters his office ; and
(ii) in case President is elected in a by-election , half of the period of tenure has beenexpired:

Provided also that precess for recall of the President shall be initiated once in his whole term.
(2) the Collector , after satisfying himself and verifying that the three-fourth of the Councillors specified in sub- section ( 1) have the proposal of recall , shall send the proposal to the State Government and the State Government shall make a reference to the State Election Commission.
(3) On receipt of the reference , the State Election Commission shall arrange for voting on the proposal of recall in such manner as may be prescribed . " .
( 13) For Section 55 , the following section shall be substituted , namely:-
First meeting after election. general
"55. ( 1 ) The Chief Municipal Officer shall , with the approval of the prescribed authority, within fifteen days of every general election, call a meeting of the elected Councillors for the purpose of electing Vice-President .
(2) The first meeting of the Council called under sub - section ( 1 ) shall be presided over by such officer not below the rank of Deputy Collector in the case of Municipal Council and not below the rank of Tehsildar in the case of Nagar Parishad , appointed by the Collector and all provisions contained in this Chapter regarding meetings of the Council shall , as far as may be , apply in respect of such meeting:
Provided that the presiding officer shall not have right to vote at such meeting and in case of equality of votes , the result shall be decided by lot . " .
(14) In Section 56 , after the figure , sign , letter and comma " 43 - A , " , the figure and comma" 47 , " shall be inserted .
( 15) In Section 62, in sub- section ( 3) , in the proviso to clause ( iii ) , after the figure , sign and letter " 43 - A " the word , figure and comma " or 47. " shall be inserted .
(16) In Section 63 , in the proviso , before the words " the Chairman " , the words " Vice- President or " , shall be inserted .
(17) In Section 328 , in sub- section ( 1 ) , in clause ( b ) , the words " President and " wherever they occur shall be omitted.
