क्र. एफ 01-02-2020- ए-16.- मध्यप्रदेश कारखाना नियम , 1962 में संशोधन का निम्नलिखित प्रारूप, जिसे राज्य सरकार कारखाना अधिनियम, 1948 ( 1948 का 63 ) की धारा 6 और धारा 112 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , बनाना प्रस्तावित करती है, उक्त अधिनियम की धारा 115 द्वारा अपेक्षित किए गए अनुसार उन समस्त व्यक्तियों की जानकारी के लिए जिनके कि उससे प्रभावित होने की संभावना है , एतद्वारा प्रकाशित किया जाता है तथा एतद्वारा यह सूचना दी जाती है, कि इस सूचना के " मध्यप्रदेश राजपत्र " में प्रकाशन की तारीख से 45 दिवस का अवसान होने पर या उसके पश्चात् उक्त प्रारूप पर विचार किया जावेगा.
ऐसी किसी भी आपत्ति या सुझाव हो पर जो संशोधन के उक्त प्रारूप के संबंध में किसी भी व्यक्ति से ऊपर विनिर्दिष्ट कालावधि का अवसान होने के पूर्व प्राप्त हो , राज्य सरकार द्वारा विचार किया जाएगा.
संशोधन
उक्त नियमों में-
1. नियम 6 में,-
(1) उप-नियम ( 1 ) में, शब्द तथा अंक " प्ररूप 4 में दो प्रति " के स्थान पर, शब्द तथा अंक " मध्यप्रदेश शासन , श्रम विभाग, के अधिकारिक वेब पोर्टल ( www.labour.mp.gov.in ) पर उपलब्ध ऑनलाइन प्रारूप 4 " स्थापित किए जाएं.
(2) उप -नियम ( 1 ) में, शब्द " नीचे दी गई अनुसूची में उल्लेखित फीस की रकम " के स्थान पर, शब्द " आवेदन अनुसार ऐसे केलेंडर वर्षों के रजिस्ट्रीकरण के लिए लागू नीचे दी गई अनुसूची में उल्लेखित कुल फीस की रकम " स्थापित किए जाएं.

(3) उप-नियम ( 2 ) में , शब्द " कारखाने का रजिस्ट्रीकरण करके प्ररूप 3 में " के स्थान पर, शब्द " कारखाने का रजिस्ट्रीकरण करके दस या अधिक वर्षों या आवेदन अनुसार अवधि हेतु ऑन लाइन प्ररूप 3 में " स्थापित किए जाएं.
No. F- 1-02-2020- A- 16 . The following draft of amendment in the Madhya Pradesh Factories Rules , 1962 , which the State Government proposes to make in exercise of the powers conferred by Section 6 and Section 112 of the Factories Act , 1948 ( No. LXIII of 1948 ) is hereby published as required by Section 115 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft shall be taken into consideration on or after the expiry of 45 days from the date of publication of this notice in the " Madhya Pradesh Gazette" .
Any objection or suggestion , which may be received from any person with respect to the said draft of amendment on or before the expiry of the period specified above will be considered by the State Government.
AMENDMENT
In the said rules-
1 . In rule 6 ,-
(1) In sub - rule ( 1 ) , for the words and figure " Form no. 4, in duplicate " , the words and figure " online form no . 4 available on official portal of the Labour Department , Government of Madhya Pradesh ( www.labour.mp.gov.in ) " shall be substituted.
(2) In sub - rule ( 1 ) , for the words " amount of fee as specified in the Schedule below" , the words "total amount of fees as for such calendar years as applicable for such registration" shall be substituted.
(3) In sub - rule ( 2 ) , for the words and figure " register the factory and grant a licence in Form 3 " the words and figure " register the factory and grant a licence online in form No. 3 for ten years or more or for such period as applied shall be substituted.
