क्र. एफ - 23-03-2020- G - 19.- मध्यप्रदेश राज्य को लागू हुए रूप में भारतीय पथकर अधिनियम, 1851 ( 1851 का सं. - 8 ) की धारा 4 के साथ पठित धारा- 2 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए राज्य सरकार, भोपाल बायपास पर दिनांक 18.07.2020 प्रातः 06:01 बजे से उक्त मार्ग अथवा उसके भाग (अनुरूप भाग ) पर प्रति फेरा प्रति यान आधार (पर ट्रिप पर वेहिकल बेसिस ) पर निम्नलिखित मूलदरों पर पथकर उद्‌ग्रहीत करने के लिए मंजूरी प्रदान करती है: -

2. पथकर , महाप्रबंधक/ संभागीय प्रबंधक , मध्यप्रदेश सड़क विकास निगम लिमिटेड, भोपाल संभाग द्वारा संग्रहित किया जाएगा । प्रत्येक पथकर प्लाजा पर पथकर की दरें, उपरोक्त दरों के आधार पर , मध्यप्रदेश सड़क विकास निगम लिमिटेड द्वारा विनिर्दिष्ट की जाएंगी।

3. उपरोक्त पथकर दरें प्रत्येक वर्ष थोक मूल्य सूचकांक के आधार पर बढ़ायी जाएगी तथा निकटतम 5 रूपये तक पूर्णांकित की जाएगी । प्रतिवर्ष 31 मार्च को समाप्त होने वाले वर्ष की दरों को थोक मूल्य सूचकांक के आधार पर प्रत्येक वर्ष 1 सितंबर से प्रभावी किया जायेगा । पथकर की मूल दर दिनांक 01.09.2007 को अधिसूचित मूल दर के अनुसार होगी । प्रतिवर्ष पथकर वृद्धि गणना निम्नानुसार सूत्र (उदाहरण ) अनुसार की जायेगीः-

आगामी वर्षोंवर्षों, हेतु भी गणना उपरोक्तानुसार नये वर्ष हेतु नये थोक मूल्य सूचकांक के आधार पर ही की जायेगी । मूल थोक मूल्य सूचकांक 31 मार्च 2007 को समाप्ति वर्ष का ही लिया जायेगा।

4.. महाप्रबंधक/संभागीय प्रबंधक, मध्यप्रदेश सड़क विकास निगम लिमिटेड, किसी व्यक्ति के अनुरोध पर नियत वाहन के लिए देय शुल्क के 150 प्रतिशत ( एक सौ पचास प्रतिशत ) के बराबर राशि के भुगतान पर लिखित पास जारी करेगा यदि वह परियोजना राजमार्ग पर एक तरफ की यात्रा का अभिवचन देता है । ऐसा लिखित पास शुल्क के संदाय के समय से 24 घंटे (चौबीस घंटे ) के भीतर वापसी यात्रा के अभिवचन पर विनिर्दिष्ट वाहन के लिए वैध किया जाएगा ।

5. महाप्रबंधक/ संभागीय प्रबंधक, मध्यप्रदेश सड़क विकास निगम लिमिटेड , भोपाल संभाग, किसी व्यक्ति के अनुरोध पर 50 ( पचास ) या उससे अधिक मध्यप्रदेश राजपत्र, दिनांक 8 दिसम्बर 2020

960(1) एक तरफ की यात्रा का पथकर टिकिट जारी करने के लिए नियत वाहन के लिए देय शुल्क के दो तिहाई बराबर रियायती दर पर ऐसे टिकिट जारी करेगा । ऐसे रियायती टिकिट शुल्क के संदाय के दिनांक से एक मास की कालावधि के दौरान किसी भी समय एक तरफ की यात्रा के लिए एक टिकिट के उपयोग द्वारा परियोजना राजमार्ग पर आवागमन के लिए विनिर्दिष्ट वाहन के लिए वैध किये जाएंगे ।

6. स्थानीय ट्रेफिक पथकर के भुगतान से मुक्त रहेंगे । ऐसे वाहनों को मासिक पास महाप्रबंधक/ संभागीय प्रबंधक, मध्यप्रदेश सड़क विकास निगम , भोपाल संभाग द्वारा जारी किये जायेंगे । ऐसे पास पात्र वाहन मालिकों को, आवश्यक दस्तावेज प्रस्तुत करने पर, महाप्रबंधक / संभागीय प्रबंधक द्वारा रू. 85/- ( रूपये पिच्यासी मात्र ) के मासिक भुगतान करने के पश्चात् जारी किये जायेंगे , जो कि यह दरें प्रतिवर्ष 31 मार्च 2007 की समाप्ति वर्ष के थोक मूल्य सूचकांक में परिवर्तन होने पर प्रत्येक वर्ष की 1 सितंबर से वार्षिक रूप से पुनरीक्षित की जाकर तथा निकटतम् 5/- रु. तक पूर्णांकित की जाएगी। इस छूट के प्रयोजन के लिए स्थानीय ट्रेफिक से वह ट्रेफिक अभिप्रेत होगा जो प्राइवेट कार /जीप अथवा समतुल्य वाहन से परियोजना राजमार्ग पर आवागमन करे; परन्तु ऐसी प्राईवेट कार ऐसे व्यक्ति के स्वामित्व की हो जो पथकर प्लाजा से 20 किमी. की दूरी के भीतर निवास करता होः

परन्तु ऐसे वाहन को जो परियोजना राजमार्गों के एक भाग का तो उपयोग करता है , किन्तु एक से अधिक पथकर प्लाजा पार करता हो , स्थानीय ट्रेफिक नहीं समझा जाएगा । इसी प्रकार ऐसे समस्त स्थानीय ट्रैफिक से किसी पास की अपेक्षा नहीं होगी या उससे कोई फीस संग्रहीत नहीं की जायेगी जो परियोजना राजमार्ग के एक भाग का तो उपयोग करते हैं किन्तु किसी पथकर प्लाजा को पार नहीं करते ।

7. सर्विस लेन निर्मित होने पर स्थानीय ट्रैफिक और अन्य यान , सर्विस लेन का निशुल्क उपयोग करने के हकदार होंगे तथा महाप्रबंधक /संभागीय प्रबंधक, मध्यप्रदेश सड़क विकास निगम, भोपाल संभाग फीस के भुगतान करने के सिवाय जो कि इस अधिसूचना के निबंधनों के अनुसार प्रयोज्य मध्यप्रदेश राजपत्र , दिनांक 8 दिसम्बर 2020

हो, परियोजना राजमार्गों पर ऐसे यान को प्रवेश देने से इंकार करने का हकदार होगा ।

8. किसी मार्ग या उसके भाग (अनुरूप भाग ) पर पथकर का उद्‌ग्रहण और संग्रहण दिनांक 18.07.2020 प्रातः 06:01 बजे से प्रारंभ होगा ।

9. महाप्रबंधक/ संभागीय प्रबंधक, मध्यप्रदेश सड़क विकास निगम , भोपाल संभाग द्वारा परियोजना राजमार्ग के प्रवेश स्थल पर और प्रत्येक पथकर प्लाजा के दोनों ओर परियोजना राजमार्ग के दोनों तरफ से आने वाले उपयोगकर्ता की जानकारी के लिए लागू पथकर हिन्दी और अंग्रेजी में संप्रदर्शित करेंगें । 10. अप्राधिकृत संग्रहण: -

1 ) यदि महाप्रबंधक/संभागीय प्रबंधक, मध्यप्रदेश सड़क विकास निगग किसी व्यक्ति से धन की ऐसी राशि संग्रहीत करता है जो इसके अधीन शोध्य और देय नहीं है तो महाप्रबंधक/संभागीय प्रबंधक संग्रहण की तारीख से वापसी की तारीख तक प्रत्येक दिन के लिए , इस प्रकार संग्रहीत रकम के 3 प्रतिशत की दर से संग्रहीत राशि के साथ इस प्रकार संग्रहीत रकम तुरंत ही नुकसानी के रूप में ऐसे व्यक्ति को वापस करने का दायी होगा । यथा पूर्वोक्त रीति से संगणित नुकसान के साथ ऐसी रकम के किसी भी कारण से ऐसे व्यक्ति को संदत्त न होने की दशा में उसे ऐसे संग्रहण की तारीख से 15 ( पन्द्रह ) दिनों की कालावधि के भीतर , मध्यप्रदेश सड़क विकास निगम में निक्षिप्त किया जायेगा ।

2) उप खण्ड ( 10.1) के अधीन महाप्रबंधक/संभागीय प्रबंधक द्वारा देय रकम से संबंधित कोई विवाद उत्पन्न होता है तो उसके निपटारे के लिये मुख्य अभियंता, मध्यप्रदेश सड़क विकास निगम, भोपाल द्वारा लिखित में आदेश द्वारा निपटाया जाएगा और ऐसे आदेश के विरुद्ध अपील , यदि कोई हो, प्रमुख अभियंता, मध्यप्रदेश सड़क विकास निगम , भोपाल को होगी। मध्यप्रदेश राजपत्र, दिनांक 8 दिसम्बर 2020

960(3) 3 ) पथकर के संग्रहण के संबंध में व्यथित कोई भी व्यक्ति, महाप्रबंधक/ संभागीय प्रबंधक, मध्यप्रदेश सड़क विकास निगम को अपनी शिकायत दर्ज करा सकेगा और महाप्रबंधक / संभागीय प्रबंधक, 15 ( पन्द्रह ) दिनों की कालावधि के भीतर ऐसी शिकायत पर आदेश पारित करेगा और ऐसे आदेश के विरुद्ध अपील, मुख्य अभियंता, मध्यप्रदेश सड़क विकास निगम, भोपाल को होगी ।

11. यह अधिसूचना दिनांक 18.07.2020 से 19.07.2026 दोपहर 12:00 बजे तक प्रभावी मानी जायेगी ।

12. राज्य सरकार यह भी घोषित करती है कि वाहनों की निम्नलिखित श्रेणियों इन सड़कों को पार करते समय पथकर के भुगतान से छूट प्राप्त रहेगी: - ( 1 ) भारत सरकार तथा मध्यप्रदेश सरकार के समस्त यान सरकारी कर्तव्य (ड्यूटी ) पर हों ।

(2) संसद तथा विधानसभा के माननीय सदस्यों के यान ।

(3 ) समस्त यान जो भारतीय सेना से संबंधित हों ।

(4) एम्बुलेंस ।

(5 ) फायर बिग्रेड

(6) भारतीय डाक तथा तार विभाग के यान ।

(7 ) भूतपूर्व विधायको एवं सांसदों के यान।

(8 ) कृषि प्रयोजन के लिए उपयोग की जाने वाली ट्रैक्टर-ट्राली ।

( 9 ) आटो रिक्शा, दुपहिया तथा बैलगाड़ियों ।

( 10 ) स्वतंत्रता संग्राम सेनानियों एवं अधिमान्यता प्राप्त पत्रकार ।

टिप्पणीः- पथकर के भुगतान से इस प्रकार छूट प्राप्त यान/ वैन का चालक (ड्रायवर ) अपना नाम, रैंक तथा कर्तव्य (ड्यूटी ) , जिसमें वह लगा हुआ है, कथित करेगा।

No. F - 23-03-2020 - G - XIX .- In exercise of the powers , conferred by Section - 2 read with Section -4 of the Indian Tolls Act , 1851 (No. VIII of 1851) in its application to the State of Madhya Pradesh , is pleased to grant sanction for levying toll on the following Basic Rates on Bhopal Bypass shown as below in the table on a per trip per vehicle basis for road or part thereof (Homogeneous Section ) with effect from 18.07.2020 at 06:01 AM , namely: -

2. The toll will be collected by MP Road Development Corporation, through the General Manager/Divisional Manager , MP Road Development Corporation , Bhopal Division . The rates of toll on each toll plaza will be specified by Madhya Pradesh Road Development Corporation Ltd. on the basis of above Rates .

3. The above rates will increase every year on the basis of Wholesale Price Index and will be rounded off to the nearest five rupees . The increase will be made effective from 1st September every year, based on the Wholesale Price Index for the year ending 31st March . The Basic Toll Rates will be as per the rates notified to be effective as on 01.09.2007 . The calculation of toll increase every year will be done as per the formula (example) given below : -

960(5) For the coming years , the calculations will be done as per the above based on new Wholesale Price Index for new years . Basic Wholesale Price Index will be ofthe year ending 31st March , 2007 .

4. The General Manager/Divisional Manager, MP Road Development Corporation , Bhopal shall , upon request from any person, issue a written pass on payment of a sum equal to 150% (one hundred and fifty percent) of the Fee payable for the respective vehicle if it where to under take a single one way trip on the Project Highway . Such written pass shall be entitled the specified vehicle to undertake a return journey within 24 hrs (twenty four hours) from the time of payment of Fee .

5. The General Manager /Divisional Manager , MP Road Development Corporation , Bhopal Division shall , upon request from any person for issue of 50 (fifty) or more one way toll tickets , issue such tickets at a discounted rate equivalent to two - thirds of the Fee payable for the respective vehicle . Such discounted tickets shall entitled the specified vehicle to commute on the Project Highway by using one ticket for a single one -way trip at any time during a period of one month from the date of payment of Fee .

6. Local Traffic will remain exempted from payment of toll . Such vehicles will be issued monthly passes by the General Manager/Divisional Manager , MP Road Development Corporation, Bhopal . Such passes will be issued to eligible vehicle owners , by the General Manager/Divisional Manager on production of necessary documents and after payment of monthly fee of Rs . 85.00 (Rupees Eighty five only) to be revised annually applicable from 1st September of every year to reflect the variation in WPI as compared to WPI of year ended March , 31 , 2007 and then rounded off to nearest five rupees . For the purpose of such exemption, Local Traffic will mean the traffic on account of commuting by a private Car/ Jeep or equivalent vehicle by means of the Project Highway; provided that such private Car is owned by a person who resides within a distance of 20 (twenty) Km from the Toll Plaza;

Provided that any vehicle that uses the part of Project Highway but crosses more than one Toll Plaza will not be reckoned as Local Traffic . Similarly no passes will be required or fee will be collected from such Local Traffic that uses part of the Project Highway and does not cross a Toll Plaza.

7. Upon construction of service lanes , the local Traffic and other vehicles , shall be entitled to free use of service lanes and The General Manager/Divisional Manager , MP Road Development Corporation, Bhopal Division shall be entitled to refuse entry of such vehicles on Project Highway except upon payment of fee, as is applicable as per the terms of the notification .

8. Levy and collection of toll of the road shall commence on 18.07.2020 at 06:01 AM.

9. The General Manager/Divisional Manager , MP Road Development Corporation , Bhopal Division shall display the applicable toll charges at entry point of the Project Highway and each Toll Plaza on both sides for information of users approaching from either side of the Project Highway in both Hindi & English .

10. Unauthorized Collection : -

1. In the event that the General Manager /Divisional Manager , collects from any person a sum of money not due and payable hereunder , the Divisional Manager shall be liable to refund to such person forthwith the amount so collected along with a sum computed @ 3 % (three percent) of the amount so collected , for each day from the date of collection till the date of refund , by way of damages . In the event that such amount together with damages computed in the manner as aforesaid is not paid to such person for any reason whatsoever , the same shall be deposited with MPRDC within a period of 15 (fifteen) days from the date of such collection.

2. Any dispute relating to amounts payable by the General Manager/Divisional Manager under Sub - clause 10.1 shall be settled by the Chief Engineer , MPRDC, Bhopal , by an order in writing and appeal , if any, against such order shall lie with the Engineer- in - Chief MPRDC Bhopal .

3. Any person aggrieved in connection with collection of the toll may lodge a complaint to the General Manager/Divisional Manager , MPRDC and the General Manager/Divisional Manager shall pass order on such complaint within a period of 15 (fifteen) days and appeal , against such order shall lie with the Chief Engineer , MPRDC, Bhopal .

11. This notification shall be deemed to be effective from 18.07.2020 to 19.07.2026 at 12:00 PM.

12. The State Government further declares that following categories of vehicle will be exempted from payment of toll while crossing these roads .

1) All vehicles belonging to the Government of India, Government of Madhya Pradesh and those on Government duty.

) Vehicle belonging to the Hon'ble Member of Parliament and Member of Legislative Assembly.

3) All vehicles belonging to the Indian Army .
