क्र. एफ- 19-2-2019- बारह- 1- पार्ट. खान एवं खनिज ( विकास तथा विनियमन ) अधिनियम, 1957 ( 1957 का 67 ) की धारा 15 एवं धारा 23 ( ग ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा , मध्यप्रदेश रेत ( खनन , परिवहन, भंडारण तथा व्यापार ) नियम, 2019 में निम्नलिखित और संशोधन करती है , अर्थात्ः-
संशोधन
उक्त नियमों में, -
1. नियम 9 के स्थान पर, निम्नलिखित नियम स्थापित किया जाए, अर्थात्:-
" 9. निविदा में सम्मिलित रेत समूह की अवधि.- समूह की खदानों की ठेका अवधि 3 वर्ष होगी तथा प्रथम वर्ष की गणना आशय पत्र जारी किए जाने की तारीख से वर्ष के 30 जून तक होगी तथा अंतिम अवधि तीसरे वर्ष के 30 जून तक होगी.
उदाहरणार्थ:- यदि आशय पत्र दिनांक 5 अक्टूबर, 2019 को जारी किया गया है , तो समूह की अवधि निम्नलिखित प्रगणित की जाएगी:

2. नियम 13 में, उप- नियम ( 4 ) के पश्चात्, निम्नलिखित उप- नियम अंतःस्थापित किया जाये , अर्थात्ः-
" ( 5 ) यदि आशय पत्र के धारक ने समूह की किसी एक खदान के लिए संचालन की सहमति ( सी.टी.ओ. ) प्राप्त होने के बावजूद, 7 दिवस के भीतर जिला समूह के अनुबंध के लिए आवेदन नहीं किया है या अनुबंध के निष्पादन की स्वीकृति के लिए सूचना प्राप्त होने के 5 कार्य दिवस के भीतर अनुबंध निष्पादित नहीं किया है, तो इस प्रकार निक्षिप्त सुरक्षा राशि को समपहृत करके आशय पत्र निरस्तीकरण किया जाएगा. ".
3. नियम 18 में, उप- नियम ( 6 ) में, प्रथम पैरा के स्थान पर, निम्नलिखित पैरा स्थापित किया जाए, अर्थात्ः- " व्यवसायिक प्रयोजन हेतु रेत खनिज के भंडारण के लिए अनुज्ञा समूह ठेकेदार या रेत खनन हेतु प्राधिकृत ठेकेदार को, उसके पक्ष में स्वीकृत किसी विधिमान्य रेत खदान के 5 किलोमीटर के परे, परंतु 8 किलोमीटर की सीमा के भीतर प्रदान की जाएगी." .
4. नियम 26 में, उप - नियम ( 6 ) के पश्चात्, निम्नलिखित उप - नियम अंतःस्थापित किया जाए, अर्थात्ः-
" (7 ) अस्थाई रूप से रिक्त समूह की रेत खदान से रेत खनिज, जो केन्द्रीय सरकार या राज्य सरकार या केन्द्र सरकार के किसी विभाग, उपक्रम या स्थानीय निकाय या केन्द्र या राज्य सरकार के किसी विभाग , उपक्रम या स्थानीय निकाय के निर्माण कार्यों के लिए आवश्यक है , का उत्खनन करने , हटाने तथा परिवहन करने के लिए उत्खनन अनुज्ञा, 30 दिवस की अवधि के लिए, राज्य सरकार द्वारा विहित शर्त पर , संबंधित जिले के कलक्टर द्वारा स्वीकृत की जाएगी. ऐसी अनुज्ञा या तो संबंधित विभागीय प्राधिकारी को या उसके द्वारा प्राधिकृत ठेकेदार को, ठेका दिए जाने के संबंध में सबूत प्रस्तुत किए जाने पर दी जाएगी . ".
5. प्ररूप - आठ में, प्रथम पैरा के स्थान पर, निम्नलिखित पैरा स्थापित किया जाए, अर्थात्ः-

.स्वीकृत रेत खदान समूह क्रमांक . .का ठेकेदार हूँ अथवा जिला .ग्राम .( जो भी लागू हो ) में स्वीकृत रेत खदान का प्राधिकृत ठेकेदार हूँ. मैं भण्डारण अनुज्ञप्ति प्रदान किए जाने के लिए आवेदन प्रस्तुत करने हेतु फर्म/ कंपनी की ओर से प्राधिकृत हूँ ( प्राधिकार पत्र की प्रति संलग्न करें ) . आवेदन पत्र के साथ निम्नलिखित दस्तावेज संलग्न हैं:-. " .
No. F 19-2-2019 - XII - 1 - part. In exercise of the powers conferred by Section 15 and Section 23 ( C ) of the mines and Minerals ( Development and Regulation ) Act , 1957 ( 67 of 1957 ) , the State Government , hereby , makes the following further amendments in the Madhya Pradesh Sand ( Mining, Transportation . Storage and Trading ) Rules . 2019 , namely:-
AMENDMENT
In the said rules ,-
1. For rule 9 , the following rule shall be substituted, namely:-
"9. Period of sand group included in tender . The contract period of the quarries of the group shall be 3 years and first year shall be calculated from the date of issuing of letter of intent upto 30th June of the year and last period shall be 30th June of the third year .
For example: If the Letter of Intent is issued on 5th October , 2019 the period of the group shall be calculated as under:

10(1) 2. In rule 13 , after sub- rule ( 4) , the following sub - rule shall be inserted , namely :-
"( 5) If the holder of Letter of Intent , in spite of receiving consent to operate ( C. T. O. ) for any one quarry of the group within 7 days , has not made application for agreement of group of district or has not executed the agreement within 5 working days of receiving information for sanction of execution of agreement , then cancellation of letter of intent shall be made by forfeiting the security amount so deposited.".
3. In rule 18 , in sub - rule ( 6 ) , for the first para, the following para shall be substituted , namely :-
"Permit for stoage of sand mineral for commercial purpose shall be sanctioned to the group contractor or contractor authorized for sand mining , beyond 5 k . m. but within the radius of 8 k. m . from any valid sand quarry sanctioned in his favor . " .
4. In rule 26, after sub - rule ( 6) , the following sub - rule shall be inserted , namely :-
"( 7) Quarry Permit for excavation , removal and tranportation of sand minerals from the sand quarry of the group remained vacant temporarily , shall be sanctioned by the Collector of the concerned district , which is required for the works of the Central Government or the State Government or any department , undertaking or local body of the Central Government or any department , undertaking or local body of the Central Government or State Government , for a period of 30 days on the condition prescribed by the State Government . Such permit shall be given either to the concerned departmental authority or the contractor authorized by him on submission of proof regarding the award of the contract . " .
5. In Form - VIII , for the first para, the following para shall be substituted , namely:-

(Whichever is applicable ) in tender . I am authorized on behalf of firm/ company to submit the application for grant of storage license ( attached copy of the letter of authorization ) . The followingdocument are attached along with the application form:-. " .
