अधि.क्र. 01 एफ 1-358 / 2020 / 18-3 , मध्यप्रदेश नगर पालिक अधिनियम 1956 (अधिनियम संख्या 23 सन् 1956) की धारा 432- ए एवं मध्यप्रदेश नगर पालिका अधिनियम, 1961 (क्रमांक 37 सन् 1961 ) की धारा 359 के द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार , एतद्वारा , विवाह स्थल के पंजीयन एवं उपभोग के नियंत्रण के संबंध में, निम्नलिखित आदर्श उपविधियाँ बनाती है, अर्थात्: -

1. संक्षिप्त नाम , विस्तार तथा प्रारंभः.-
(1 ) ये उपविधियाँ, मध्यप्रदेश नगरपालिका (विवाह स्थल का पंजीयन एवं उपभोग ) आदर्श उपविधि 2020 कहलाएगी ;
(2) ये उपविधियाँ, नगर पालिकनिगम / नगरपालिका परिषद् / नगर परिषद की अधिकारिता के अधीन सम्पूर्ण क्षेत्र में प्रभावशील होंगी;
(3 ) ये उपविधियाँ, मध्यप्रदेश राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगी ।
2. परिभाषा.-
(1 ) इन आदर्श उपविधियों में , जब तक संदर्भ से अन्यथा अपेक्षित न हो,-
(क) "अधिनियम" से अभिप्रेत है यथास्थिति, मध्यप्रदेश नगरपालिक निगम अधिनियम, 1956 (संख्या 23 संन् 1956) या मध्यप्रदेश नगरपालिका अधिनियम, 1961 (अधिनियम संख्या 37 सन् 1961 ) ;
(ख) "उपाबंध" से अभिप्रेत है, इन उपविधियों के साथ संलग्न उपाबंध ;
(ग ) " आवेदक" से अभिप्रेत है, कोई भी व्यक्ति संस्था अथवा कंपनी या उनके द्वारा अधिकृत प्रतिनिधि, जो विवाह स्थल के पंजीयन एवं उपभोग की अनुज्ञप्ति के लिए आवेदन करता है;

(घ) "मुख्य नगरपालिका अधिकारी से अभिप्रेत है, मध्यप्रदेश नगरपालिका अधिनियम, 1961 की धारा 3 (5) में यथा परिभाषित नगरपालिका परिषद्/ नगर परिषद का मुख्य नगरपालिका अधिकारी;
(ङ) "आयुक्त" से अभिप्रेत है, मध्यप्रदेश नगरपालिक निगम अधिनियम, 1956 की धारा 5 ( 11 ) में यथा परिभाषित नगरपालिक निगम का आयुक्त;
(च) "सक्षम प्राधिकारी" से अभिप्रेत है, नगरपालिक निगम के अंतर्गत आने वाले क्षेत्र की दशा में, नगरपालिक निगम आयुक्त तथा नगरपालिका परिषद्/ नगर परिषद् के अंतर्गत आने वाले क्षेत्र की दशा में, मुख्य नगर पालिका अधिकारी या उनके द्वारा अधिकृत पदाधिकारी;
(छ) "पंजीयन एवं उपभोग की अनुज्ञप्ति से अभिप्रेत है इन आदर्श उपविधियों 'के अधीन विवाह स्थल पंजीयन एवं उपभोग की अनुज्ञप्ति;
(ज) "विवाह स्थल" से अभिप्रेत है, नगरपालिका की सीमा में 50 से अधिक व्यक्ति एकत्रित होने की क्षमता रखने वाले समस्त स्थान, जैसे होटल / भूखण्ड/ फार्म / सामुदायिक केन्द्र / भवन / क्लब / बैंक्वेट हॉल / धर्मशाला इत्यादि, जो कि विवाह, सगाई , बारातघर, जन्मदिवस एवं अन्य प्रकार के सामाजिक समारोहों जैसे उत्सव / प्रदर्शनी / कन्वेंशन / गरबा उत्सव / नववर्ष आयोजन इत्यादि के लिये उपयोग किए जाते हों;
(झ) "नगरपालिका" से अभिप्रेत है यथास्थिति, नगरपालिक निगम / नगरपालिका परिषद अथवा नगर परिषद;
(ञ) "जनसंख्या" से अभिप्रेत है पूर्ववर्ती जनगणना में अभिनिश्चित की गई जनसंख्या और जिसके आंकड़े प्रकाशित हो गए हैं ।
इन उपविधियों में, उन शब्दों तथा अभिव्यक्तियों का जो प्रयुक्त हुए हैं किन्तु परिभाषित नहीं किए गए हैं, का वही अर्थ होगा जो उन्हें अधिनियम में सामान्य या विशिष्ट रूप से समनुदेशित किए गए हैं । मध्यप्रदेश राजपत्र, दिनांक 6 जनवरी 2021

पंजीयन एवं उपभोग की अनुज्ञा की शर्तें एवं आवेदन.- कोई भी व्यक्ति, संस्था अथवा कंपनी या उनके अधिकृत प्रतिनिधि, जो नगरपालिका की सीमा में स्थित विवाह स्थल का पंजीयन एवं उपभोग करना चाहता है अथवा इन उपविधियों के प्रभावी होने से पहले से ही उस स्थल का उपयोग विवाह स्थल के लिए कर रहा है उसे निर्धारित प्ररूप - क में विहित किए गए प्ररूप में आवेदन के साथ निम्न लिखित जानकारी एवं दस्तावेज प्रस्तुत करेगाः
भवन/ भूमि के स्वामित्व के दस्तावेज ।
(1 )
(2) भवन अनुज्ञा एवं अनुमोदित ले-आउट प्लान की प्रति या अस्थाई संरचना की स्थिति में वास्तुविद से अनुमोदित ले -आउट ।
(3) नेशनल बिल्डिंग कोड के भाग -4 और लागू अधिनियम / नियमों के उपबंधों के अनुसार अग्निशमन यंत्रों की युक्ति युक्त व्यवस्था की अग्निशमन विभाग की एन. ओ.सी. की प्रति तथा अग्नि शमन हेतु प्रशिक्षित कर्मचारियों की संख्या एवं ब्यौरे;
(4) कुल व्यक्तियों को समाहित करने के लिए आवेदित स्थल की क्षमता;
(5) प्रवेश व निर्गम के लिए दो पृथक रास्ते (सुरक्षा के प्रयोजन से अनिवार्य) की जानकारी । विद्यमान स्थल में यदि प्रवेश और निर्गम का एक ही रास्ता उपलब्ध हो तो आवेदन करने से पूर्व, दूसरे सस्ते की व्यवस्था की जाएगी ।
(6) विवाह स्थल के पहुंच मार्ग की न्यूनतम चौड़ाई 12 मीटर के बारे में दस्तावेजों/ जानकारी की प्रति सार्वजनिक सामुदायिक केन्द्रों के लिए मार्ग की न्यूनतम चौड़ाई 9 मीटर होगी ।
कचरा एवं ठोस अपशिष्ट नियमित संग्रहण की व्यवस्था के संबंध में जानकारी । (7)
वाटर हारवेस्टिंग प्रणाली के संबंध में जानकारी ।
(8)
(9) हलवाई / कैटरिंग / अग्नि शमन व्यवस्था के स्थान के संबंध में की जानकारी जहां भोजन तैयार किया जाएगा ।
(10) विकसित वृक्ष , पार्क, लैण्डस्केपिंग इत्यादि का विवरण ।
(11 ) विद्युत कनेक्शन के मंजूर भार सहित जनरेटर रूम व्यवस्था का विवरण ।
12) आतिशबाजी आदि के लिए निर्वारित क्षेत्र का विवरण देना होगा ।

(13) पार्किंग व्यवस्था की जानकारी जो कुल क्षेत्रफल का कम से कम 25 प्रतिशत होगा ।
(14) विवाह स्थल के आवेदित स्थल का संपत्ति कर, जलकर एवं नगरपालिका के अन्य बकाया नहीं होने का प्रमाण - पत्र / रसीद की प्रतियां प्रस्तुत की जाएंगी । 12(3)

(15) यदि आवेदनकर्ता भू- स्वामी न होकर किरायेदार है तो, वह भू- स्वामी के साथलिखित में हुए इकरारनामा एवं एम.ओ.यू/ अन्य कानूनी दस्तावेजों की नोटराईज्ड प्रतिलिपि संलग्न करेगा ।
(16) आवेदक को आवेदन पत्र के साथ निम्नांकित आशयों का विहित मूल्य के गैर न्यायिक स्टॉम्प पेपर पर शपथ पत्र भी प्रस्तुत करना होगा कि-
(क) विवाह स्थल की सफाई , उत्पन्न कचरे एवं अपशिष्ट पदार्थो का संग्रहण एवं निस्तारण के खर्चे स्वयं वहन करेगा ।
(ख) यदि शासन/ नगरपालिका द्वारा अनुज्ञप्ति प्रदाय करने की ऑनलाईन प्रक्रिया लागू की जाती हैं, तो वह आवेदक को लागू होगी ।
(ग) यदि विवाहस्थल ऐसे स्थान पर है जहां पर अस्पताल, रात्रिकालीन शिक्षण या अन्य इस प्रकार की गतिविधियाँ संचालित हों, वहाँ विवाह स्थल के पंजीयन से ऐसे स्वास्थ्य, शिक्षण गतिविधियों में बाधा नहीं पहुँचाई जाएगी;
(घ) रात्रि 10 बजे से अगली सुबह 8 बजे तक विवाह स्थलों में ध्वनि विस्तारक यंत्रों का उपयोग नहीं किया जाएगा । इस संबंध में, विवाह स्थल पर एक पटल लगाया जाएगा जिला प्रशासन द्वारा ध्वनि विस्तारक यंत्रों के संबंध में जारी निर्देशों / निषेधाज्ञा का दृढ़तापूर्वक पालन किया जाएगा ।
4. विवाह स्थल (पंजीयन एवं उपभोक्ता) अनुज्ञप्ति शुल्क.-
(1 ) विवाह स्थल के क्षेत्रफल अनुसार नगरपालिकाओं की विभिन्न श्रेणियों के लिये न्यूनतम पंजीयन एवं उपभोक्ता शुल्क निम्न प्रकार से देय होगा-

6000/- 4000/- (2) पंजीयन शुल्क, विवाह स्थल के पंजीयन के समय एक बार लिया जायेगा, जो :
वर्ष के लिये मान्य होगा । उपभोक्ता शुल्क प्रत्येक वित्तीय वर्ष के लिए देय होगा यदि विवाह स्थल , वित्तीय वर्ष के मध्य में स्थापित किया जाता है तो भी उपभोक्त शुल्क पूरे वर्ष का देय होगा । उपरोक्त विवाह स्थल पंजीयन शुल्क एवं उपभोक्त शुल्क नगरपालिका द्वारा अधिरोपित किए जाने वाले किसी शुल्क / कर में वृद्धि वं अतिरिक्त होगा ।
(3) उप विधि 4 (1 ) में यथा विनिर्दिष्ट किये गये न्यूनतम दरों से उच्च पंजीयन एव उपभोक्ता शुल्क लगाये जाने के लिये नगरपालिकाएं सक्षम होगी । नगपालिक उपरोक्त दरों में प्रत्येक 3 वर्ष पश्चात् कम से कम 10 प्रतिशत की वृद्धि करेगी । पंजीयन एवं उपयोग की अनुज्ञा. समस्त औपचारिकताएं पूरी करने के पश्चात् सक्षम् प्राधिकारी द्वारा प्ररूप- ख में पावती जारी की जायेगी । सक्षम प्राधिकारी / आवेदित स्थल् की जांच उपरांत , उक्त विवाह स्थल को उपविधियों के प्रावधानों के अनुरूप पाता है तं मध्यप्रदेश राजपत्र, दिनांक 6 जनवरी 2021
12(5) 30 दिवस के अंदर पंजीयन / अनुज्ञप्ति शुल्क जमा कराकर विवाह स्थल के पंजीयन एवं उपयोग की अनुज्ञप्ति प्ररूप - ग में प्रदाय करेगा । यद्यपि आवेदन रद्द किए जाने की स्थिति में, सुनवाई का एक अवसर प्रदाय किया जाएगा और 30 दिवस के अंदर समुचित आदेश जारी किया जायेगा ।
6. पंजीयन एवं उपयोग की अनुज्ञप्ति निम्नलिखित शर्तों के अध्यधीन होगी. -
(1 ) विवाह स्थल के चारों ओर सुरक्षा संबंधी आवश्यक प्रबंध किए जाएंगे ।
(2) स्थल के संबंध में आवश्यक हिदायतें व सूचनाएं, नगरपालिका द्वारा जारी पंजीयन संख्या, जमा राशि की रसीद संख्या शर्ते एवं निबंधन परिसर के बाहर नगरपालिका द्वारा यथा विहित ऐसे स्थल पर जो सहज रूप से दृष्टिगोचर हो, 1.80 मीटर ×1 . 20मीटर का पटल लगाकर अंकित की जावेगी ।
(3) राज्य सरकार/ज़िला प्रशासन/ नगरपालिका द्वारा जारी आदेशों / निर्देशों का पालन करना आवश्यक होगा ।
(4) नगरपालिका विवाह स्थल से कचरा उठाने के लिए दायी नहीं होगी तथा आवेदक का यह कार्य स्वयं के व्यय पर करना होगा । कचरा एवं ठोस अपशिष्ट पदार्थों को विवाह स्थल के आसपास या सड़क के किनारे नहीं डाला जाएगा । इसको उल्लंघन की दशा में अनुज्ञप्ति धारी के विरूद्ध सुसंगत नियमों के अधीन कार्रवाई की जाएगी और इसके अतिरिक्त शास्ति अधिरोपित की जाएगी,। कचरा एवं ठोस अपशिष्ट का संग्रहण व निस्तारण अनुज्ञप्तिधारी द्वारा किया जाएगा।
(5) विवाह स्थल पर विहित अग्निशमन प्रणाली लगवाया जाना आवश्यक होगा । अनुज्ञप्ति जारी होने के पश्चात् अग्निशमन प्रणाली विहित मापदण्ड अनुसार नहीं पायी जाती है तो नगरपालिका के प्राधिकृत अधिकारी को अनुज्ञप्ति निरस्त करने का अधिकार होगा ।
(6) अनुज्ञप्तिधारी द्वारा विवाह स्थल के क्षेत्र का न्यूनतम 25 प्रतिशत क्षेत्र सुविधाजनक एवं सुरक्षित पार्किंग हेतु स्थल स्वयं के खर्च पर चिन्हित करेगा एवं उस क्षेत्र को बेरिकेट्स आदि लगाकर पृथक से पार्किंग प्रदर्शित करेगा । अनुज्ञप्तिधारी द्वारा विवाह स्थल को अनुमोदित ले-आउट प्लान में इंगित शर्तों के अनुसार विकसित किया जाना अनिवार्य होगा । मध्यप्रदेश राजपत्र , दिनांक 6 जनवरी 2021

(7) महिला व पुरूष के लिए शौचालय व मूत्रालय की जानकारी पृथक् पृथक् निम्नानुसार देनी होगी:-
(अ.) 3000 वर्गमीटर तक क्षेत्रफल के विवाह स्थल हेतु

(ब.) प्रत्येक अतिरिक्त 2000 वर्गमीटर हेतु पुरूषों के लिए 1 शौचालय व 1 मूत्रालय अतिरिक्त एवं महिलाओं के लिये 1 शौचालय अतिरिक्त उपलब्ध कराना आवश्यक होगा ।
(8) अनुज्ञप्तिधारी द्वारा विवाह या अन्य आयोजन के दिन स्वयं के खर्चे पर विवाह स्थल के बाहर निम्नानुसार पर्याप्त संख्या में गार्डों की व्यवस्था की जायेगी । उपविधि 4 के अनुसार विवाह स्थलों की श्रेणी में श्रेणी कमांक 1 तथा 2 के लिये न्यूनतम 2 गार्डस्, श्रेणी कमांक-3 के लिये न्यूनतम 4 गार्ड, श्रेणी कमांक-4 के लिये न्यूनतम 6 गार्ड तथा श्रेणी क्रमांक-5 के लिये न्यूनतम 8 गार्ड,। इसके अतिरिक्त, नगरपालिका स्थानीय परिस्थितियों को देखते हुये गार्डो की संख्या में वृद्धि किये जाने के लिए निर्देश देने के लिए सक्षम होगी । ये गार्ड विवाह स्थल की निर्धारित पार्किंग स्थल पर तैनात किए जाएंगे तथा विवाह स्थल के सामने यातायात को बाधित होने से रोकेंगे, साथ ही विवाह स्थल पर सुरक्षा के लिए उत्तरदायी होंगे ।
(9) नगरपालिका क्षेत्र में जनरेटर सेट इस प्रकार स्थापित करने होंगे जिससे आम जनता को किसी भी प्रकार की असुविधा ना हो एवं उससे किसी भी प्रकार का प्रदूषण ना हो ।
(10) सीढ़ी के अतिरिक्त, नेशनल बिल्डिंग कोड के प्रावधानों अनुसार, लिफ्ट व रेम्प्स की व्यवस्था करना आवश्यक होगा । 12( 7)

(11 ) भूखण्ड/ स्थल की किसी विद्यालय , महाविद्यालय और चिकित्सा की बाउण्ड्री से दूरी 100 मी. से अधिक दूरी होना आवश्यक है ।
7. नवीनीकरण. आवेदक को प्रत्येक 3 वर्ष के पश्चात विवाह स्थल पंजीयन और उपयोग हेतु अनुज्ञप्ति का नवीनीकरण करवाएगा , जिसके लिये आवेदक को विद्यमान अनुज्ञप्ति की समयावधि समाप्त होने के 30 दिवस पूर्व आवेदन करना होगा, परन्तु –
(क) यदि आवेदक ने 3 वर्ष की कालावधि के दौरान प्रत्येक वर्ष निर्धारित समयावधि में उपभोक्ता शुल्क का भुगतान किया है और नियमित रूप से संपत्ति कर का भुगतान करता है तो उसे पर्याप्त माना जाएगा और नवीनीकरण की आवश्यकता नहीं होगीः
परन्तु यह कि आवेदक को नवीन अनुज्ञप्ति हेतु निर्धारित पंजीयन तथा उपभोक्ता शुल्क नियमित रूप से भुगतान करेगा ।
(ख) पंजीयन तथा उपभोक्ता शुल्क पूर्ण वित्तीय वर्ष के लिये देय होगा भले ही विवाह स्थल वित्तीय वर्ष के मध्य में स्थापित किया जाता है ,
(ग ) अनुज्ञप्तिधारियों को नवीन पंजीयन अथवा नवीनीकरण के समय नगरपालिका द्वारा विहित. पंजीयन शुल्क/ उपभोक्ता शुल्क जमा कराना अनिवार्य होगा ।
(घ ) आवेदक यदि निर्धारित अवधि ( 1 मार्च से 31 जुलाई तक) में शुल्क जमा करने में असफल रहता है तो शुल्क की देय राशि पर 10 प्रतिशत शास्ति एवं उसके पश्चात् प्रथम 3 माह तक के विलंब के लिए 2 प्रतिशत प्रतिमाह विलम्ब शुल्क अधिरोपित किया जाएगा । नगरपालिका इससे अधिक शास्ति अधिरोपित करने हेतु सक्षम होंगी ।
8. उपविधियों का उल्लंघन. इन उपविधियों में से किसी भी उपविधि के उल्लंघन की दशा में सक्षम प्राधिकारी द्वारा रूपए 10,000 /- (दस हजार रूपए ) तक अधिरोपित किया जाकर अनुज्ञप्ति धारी के विरूद्ध कार्रवाई की जाएगी ।
9. शास्ति की राशि को स्थानीय कोष में जमा करवाना.- अनुज्ञप्तिधारी नगरपालिका के कोषालय में शास्ति की राशि जमा करेगा और सक्षम प्राधिकारी को सूचित करेगा । मध्यप्रदेश राजपत्र , दिनांक 6 जनवरी 2021

10. अनाधिकृत विवाह स्थलों के विरूद्ध कार्रवाई.- यदि किसी व्यक्ति अथवा संस्था द्वारा नगरपालिका द्वारा जारी अनुज्ञप्ति के बिना कोई वैवाहिक स्थल संचालित किया जाता है अथवा उपविधियों की अधिसूचना के पूर्व से विद्यमान विवाह स्थल का इन उपविधियों की अधिसूचना के 3 माह के अंदर यथाविहित अनुसार पंजीयन नहीं कराया जाता है तो नगरपालिका उसे अनधिकृत घोषित करेगा और उसे हटा देगा और उसके विरूद्ध अभियोजन कार्यवाही प्रारंभ की जाएगी ।
11. सार्वजनिक स्थानों पर सामाजिक समारोह आयोजित करने का प्रतिषेध. नगरपालिक सीमाओं में विकास समिति एवं गृह निर्माण एवं मोहल्ला विकास समिति द्वारा सार्वजनिक पार्क हेतु चिन्हित किए गए हैं सार्वजनिक स्थल विवाह स्थलों हेतु उपयोग नहीं किया जाएगा, न ही कोई अनुज्ञप्ति जारी की जाएगी । उनका उपयोग उसी उद्देश्य हेतु किया जाएगा जिसके लिए उन्हे चिन्हित किया गया है ।
12. सुचारू पार्किंग और यातायात व्यवस्था सुनिश्चित करना.- अनुज्ञप्ति धारी, कड़े एवं समतल सतह पार्किंग की व्यवस्था स्वयं के खर्चे पर सुनिश्चित करेगा । यातायात की दशा में विवाह जुलूस को जिला प्रशासन एवं स्थानीय पुलिस द्वारा नियंत्रित किया जाएगा । सक्षम अधिकारी द्वारा किसी सड़क विशेष पर विवाह जुलूस प्रतिबंधित भी किया जा सकेगा ।
13. विवाह स्थलों के उपयोग पर प्रतिषेध. नगरपालिका द्वारा किसी सामाजिक दायित्वों की पूर्ति करने को दृष्टिगत रखते हुए, विवाह स्थल पंजीयन व उपभोग हेतु जारी अनुज्ञप्ति किसी भी प्रकार की भू- उपयोग परिवर्तन की अनुमति नहीं माना जाएगा । अनुज्ञप्ति प्राप्त करने के पश्चात् अनुज्ञप्तिधारी, अनुज्ञप्ति की एक प्रति संबंधित पुलिस थाना व जिला कलक्टर को प्रेषित करेगा ।
14. सक्षम प्राधिकारी के आदेश के विरूद्ध अपील. यदि आवेदक सक्षम प्राधिकारी के किसी आदेश से व्यथित है तो अपील , यथास्थिति मध्यप्रदेश नगरपालिक निगम अधिनियम, 1956 की धारा 403 (4) के अधीन अपीलीय समिति के समक्ष और मध्यप्रदेश नगर पालिका अधिनियम , 1961 की धारा 308 (घ) के अधीन कलक्टर के समक्ष संस्थित की जा सकेगी । 15. अभियोजन.- सक्षम प्राधिकारी किसी भी समय विवाह स्थल का निरीक्षण कर सकेगा । यदि उपविधियों के किसी प्रावधानों का उल्लंघन पाया जाता है तो सक्षम प्राधिकारी 3 दिवस में पूर्ति करने हेतु अनुज्ञप्तिधारी को सूचित करेगा । यदि अनुज्ञप्तिधारी निर्देशों को पालन नहीं करता है तो सक्षम प्राधिकारी तत्काल अनुज्ञप्ति निरस्त कर सकेगा एवं दोषी व्यक्ति, संस्था अथवा कंपनी के विरूद्ध सक्षम न्यायालय के समक्ष अभियोजन हेतु कार्यवाही प्रारंभ कर सकेगा । 12(9)

16. समझौता.- न्यायालय में विचाराधीन अभियोग को वापस लेने अथवा समझौता करने की शक्तियां नगरपालिका के सक्षम प्राधिकारी में निहित होंगी ।
17. नगरपालिका का सर्वाधिकार सुरक्षित. नगरीयनिकाय को विवाह स्थल के रूप में पंजीकृत भूमि / भवन के स्वामित्व का कोई अधिकार प्राप्त नहीं होगा । नगरपालिका के पास जन हित में बिना कारण बताए अनुज्ञप्ति निरस्त करने का अधिकार सुरक्षित होगा । विवाह स्थल की अनुज्ञप्ति निरस्तीकरण के लिए नगरपालिका किसी भी प्रकार की क्षतिपूर्ति भुगतान करने के लिए उत्तरदायी नहीं होगी ।
18. निषेद्ध .- नगरपालिका की सीमा के भीतर, कोई भी व्यक्ति , संस्थान, कंपनी नगरपालिका से अनुज्ञप्ति प्राप्त किए बिना, किसी स्थान का विवाह हेतु उपयोग नहीं करेगा । नगरपालिका सीमा में , इन उपविधियों की लागू होने के पूर्व विद्यमान विवाह स्थलों की अनुज्ञप्ति उस वित्त वर्ष की 31 मार्च से पूर्व उन आदर्श नियमों में विहित प्रक्रिया के अनुसार की जाएगी , अन्यथा उनको अनाधिकृत मानकर उनके विरूद्ध कार्रवाई की जाएगी ।
19. निरसन तथा व्यावृत्ति. - इन उपविधियों के प्रारम्भ होने की तारीख से , इन उपविधियों के तत्स्थानी सभी नियम, उपविधियाँ, नगरपालिकाओं में लागू थीं, निरसित हो जाएँगी ;
परन्तु इस प्रकार निरसित नियमों, या उपविधियों के अधीन की गई कोई बात या की गई कोई कार्रवाई , जब तक कि वह इन आदर्श उपविधियों के उपबन्धों से असंगत न हो, इन आदर्श उपविधियों के तत्स्थानी उपबन्धों के अधीन की गई कोई बात या की गई कोई कार्रवाई समझी जाएगी । मध्यप्रदेश राजपत्र , दिनांक 6 जनवरी 2021

Not -No 01 F1-358 /2020/ 18-3 - In exercise of the powers conferred by Section 432-A of the Madhya Pradesh Municipal Corporation Act, 1956 (Act 23 of 1956) and Section 359 of the Madhya Pradesh Municipalities Act, 1961 (Act 37 of 1961 ) , the State Government, hereby, makes the following model bye - laws for registration and use of Marriage Gardens , namely:
MODEL BYE - LAWS
1. Short title , extent and commencement .
(1) These model bye -laws may be called the Madhya Pradesh Municipality (Registration and Use of Marriage Garden) Model bye-laws , 2020 .
(2) They shall extend to the entire area under the jurisdiction of the Municipal Corporations/Municipalities /Nagar Parishads .
(3) These bye- laws shall come into force from the date of their publication in the Madhya Pradesh Gazette .
2. Definitions .
(1) Inthese bye - laws , unless the contest otherwise requires , -
(a) "Act " means the Madhya Pradesh Municipal Corporation Act, 1956 (No. 23 of 1956) and Madhya Pradesh Municipalities Act, 1961 (No. 37 of 1961 ) , as the case may be;
" Appendix " means , forms appended to these bye - laws ;
(b)
(c) " Applicant " means , any person, organisation or company or any representative authorised by them , who applies for license for registration and use of marriage garden;
(d) " Chief Municipal Officer " means , Chief Municipal Officer of Municipality /Nagar Parishad as defined in section 3 (5 ) of Madhya Pradesh Municipalities Act, 1961 ;

(e) " Commissioner " means , Commissioner of Municipal Corporation as defined in section 5(11 ) of Madhya Pradesh Municipal Corporation Act, 1956;
(f) " Competent Authority" means , Municipal Commissioner in case of any area falling under jurisdiction of the Municipal Corporation and Chief Municipal Officer , in case of any area falling within the jurisdiction of Municipality/Nagar Parishad or any officer authorised by them;
(g) " License for Registration and Use " means , license for registration and use of marriage garden under these model bye- laws;
(h) "Marriage Garden" means, all the places in the municipal limits , like hotels / plots / farms / community centres /buildings/clubs /banquet halls/ dharmshalas etc which are used for marriage, engagement, baratghar, birthdays and. other types of social functions like festivals/ exhibition/ convention/garba festival/new year celebration etc. having capacity for gathering more than 50 person;
(i) "Municipality" means, Municipal Corporation/ Municipality /Nagar Parishad, as the case may be;
(j ) " Population" means , population enumerated in latest census and whose data has been published;
(2) The words and expressions used but not defined in these bye- laws shall have the same meaning as assigned to them generally or specifically under Act.
3. Conditions for license for registration and use and application.- Any person, organisation or company or their authorised representative who desires to register and use any place as marriage garden within the municipal limits or is using any place as marriage garden before commencement of these bye - laws , shall submit following information and documents along with application in the prescribed form given in Form-A:
(1) Ownership documents of building/land.

(2) Copy of building permission and approved lay- out or in case of temporary structure lay - out approved by the architect.
(3) Copy of "NOC" from Fire Department for proper arrangement of fire fighting system in compliance of provisions of National Building Code Part -4 and applicable Act/Rules and number and details of trained fire fighting workers .
(4) The capacity of place applied for to accommodate total number of persons.
(5) Information about two separate ways for entry and exit (compulsory for security purpose) . In the existing place if there is only one way for entry and exit, then before submission of application, arrangement shall be made for the second way.
(6) Copy of document/information about minimum width of 12 meters ofapproach road to the marriage garden . The minimum road width of9 meters shall be required for public community centres .
(7) Information regarding arrangement for regular collection of garbage and solid waste .
(8) Information regarding water harvesting system .
(9) Information regarding place for confectioner/catering/ fire arrangement where food will be prepared.
(10) Details of grown trees , park, landscaping etc ..
(11) Details of sanctioned load of electric connection along with generator room arrangement .
(12) Area earmarked for fireworks etc. shall be submitted.
(13) Details of parking arrangement which shall be at least 25 percent ofthe total area.
(14) Copy of no - dues certificate/receipts of payment of property tax, water charges and other municipal dues for the applied place shall be submitted.
(15) If the applicant is not the owner of the place but tenant, then he shall submit notarised copy of the agreement and MOU/ other legal documents entered into the arrangement with the owner .
(16) The applicant will be required to submit an affidavit on non- judicial stamp paper of the prescribed value along with the application to the following:

(a) The expenditure on cleaning of the marriage garden , collection and disposal of generated garbage and solid waste shall be borne be us .
(b) If the on- line system is implemented by the government/municipality for grant of license the same will be applicable to the applicant.
(c) Ifthe marriage garden is at such place where hospital, night education or such type of activities are conducted in near vicinity, no disturbance shall be caused to health and education activities by the registration of marriage garden.
(d) The sound amplifying system will not be used between 10 P.M. and 8 A.M of the following morning at the marriage garden. A board shall be displayed at the marriage garden in this regard . The directions/ prohibitory orders issued by the district administration for sound systems shall be strictly compliedwith.
4. Marriage garden (registration and user) license Fee.-
(1) The minimum registration and user fee for marriage garden according to its size for different categories of municipalities shall be as under: -

(2) Registration fee shall be taken once at the time of registration of the marriage garden which shall be valid for 3 years ..User fee shall be payable for each financial year. In case marriage garden is established in the middle of a financial year, the user fee shall be payable for the whole financial year . The above registration and user fee for marriage garden shall be in addition to any fee/tax being imposed by the municipality .
(3) The municipality shall be competent to levy registration fee and user fee at higher rates than the minimum rates as specified in bye- law4(1). The municipality shall increase the above rates atleast 10 percent every 3 years .
5. License for registration and use.- The competent authority shall issue acknowledgement letter in Form-B after completion of all the formalities . The competent authority after inspection of the place applied for use as marriage garden, finds that the place complies to all the provisions of the bye- laws, shall issue license in Form- C after deposit of registration/ license fee within 30 days . However, in case the application is rejected, an opportunity shall be given for hearing and appropriate orders shall be passed within30 days .

6. The license for registration and use shall be subject to following conditions.-
(1) Necessary security arrangements shall be made around the marriage garden.
(2) All the information regarding necessary instructions and notices , registration number , receipt number of deposited amount issued by the municipality, terms and conditions shall be displayed outside the venue on a board of size 1.80 x 1.20 meter , at such a place where it is easily visible, as determined by the municipality.
(3) All orders/instructions issued by the State Government/District Administration/Municipality from time to time shall be complied withstrictly.
(4) Municipality shall not be liable to lift garbage and solid waste from the marriage garden and this shall be done by the licensee at his own cost . The garbage and solid waste shall not be thrown near the venue or on road outside . In case of any violation, action shall be taken against the licensee under the relevant rules and penalty will be charged besides , the garbage and solid waste shall be collected and disposed off by licensee .
(5) It shall be necessary to install prescribed fire fighting system at the marriage garden, and if it is found that after issue of license the fire fighting system is not in accordance with the prescribed criteria, the authorised officer of the municipality shall have the powers to cancel the license .
(6) The licensee shall earmark 25 percent area of the marriage garden exclusively for secure and convenient parking at his own expense and that area shall be barricaded and displayed separately as parking space . It shall be necessary for the licensee to develop the marriage garden in accordance with the conditions indicated in the approved layout .
(7) Information regarding toilets and urinals for Males and Females shall be provided separately as per the following norms :

(a) For the marriage garden up to 3000 sq. meter :
1. Water Closets (WC) - 3 numbers (Male)

- 6 numbers (Male)
(b) It shall be necessary to provide additional 1 toilet and 1 urinal for males and additional one toilet for females for each additional 2000 sq. meters area .
(8) On the day of marriage or any function , licensee at his own expense shall make necessary arrangement to provide adequate number of guards outside the marriage gardens as per the following criteria. In categories of marriage gardens as per bye- law 4 , Minimum 2 guards for categories- 1 &2 , Minimum 4 guards for category -3 , Minimum 6 guards for category -4 , and 8 guards for category-5.In addition, the municipality shall be competent to direct the licensee to increase the number of guards in view of the local conditions . These guards shall be posted at the earmarked parking space of the marriage garden and shall prevent traffic jam in front of the marriage garden besides will be responsible for security of the marriage garden.
(9) The generator sets in the municipal area shall be set up in such a way that there is no inconvenience caused to public and there is no pollution of any kind. :
(10) In addition to stairs , arrangements shall be made to provide lifts and ramps as per provisions of National Building Code.
(11) The distance of plot/building licensed for use as marriage garden shall be more than 100 meters from boundary of any- school, college, and hospital .
7. Renewal.- The applicant shall after every 3 years get the licence for registration and use of marriage garden renewed for which the applicant shall apply with full formalities before 30 days of expiry of the existing license, however, -
(a) If the applicant, has every year during the period of 3 years deposited user fee within the prescribed time and pays property मध्यप्रदेश राजपत्र, दिनांक 6 जनवरी 2021

tax regularly then it shall be treated as adequate and renewal shall not be necessary:
Provided, the applicant shall pay prescribed registration fee for the new license and user fee regularly for the new license period.
(
b) The fee for registration and use shall be payable for the whole year , and even if the marriage garden is established in the middle ofthe financial year.
(c) It will be necessary for the Licensee to deposit registration fee/user fee as prescribed by the municipality at the time of new registration or renewal .
(d) If the applicant fails to deposit fee during the prescribed period (1st March to 31st July) , a penalty of 10 percent on the due amount of fee and 2 percent late fee surcharge per month for the delay for the first 3 months shall be imposed. Municipality shall be competent to impose higher penalties than these.
8. Violation of bye -laws.- In case of violation of any bye- law of these bye- laws , action shall be taken against the licensee by the competent authority by imposing a penalty of up to an amount of Rs . 10000/-(Ten Thousand Rupees) . 2
9. Amount of penalty to be deposited in the local treasury.- The licensee shall deposit the amount of penalty in the treasury of the municipality and inform the competent authority.
10. Action against unauthorised marriage gardens.- If any marriage garden is run by any person or organisation without license issued by the municipality or if any existing marriage garden running before notification of these bye- laws is not registered within 3 months of notification of the bye- laws as per prescribed procedure, the municipality shall declare it unauthorised and shall remove it and prosecution proceeding shall be initiated against it.
11. Prohibition on holding social functions at public places.- The public places in the municipal limits , earmarked for public parks by the development committee and house construction and Mohalla development Committee shall not be used for marriage gardens and shall मध्यप्रदेश राजपत्र, दिनांक 6 जनवरी 2021
12(21) not be issued any license . They shall be used only for the purpose for which they have been earmarked.
12. Ensure smooth Parking and Traffic system.- The licensee shall ensure hard and plain surface parking at his own expense. In case of traffic, the marriage procession shall be controlled by district administration and local police . The marriage procession may be prohibited by the competent authority on any particular road.
13. Prohibition on use of marriage garden.- In consideration of the fulfilment of any social obligations by the municipality, the license issued for the registration and use of marriage garden shall not be considered for permission to change in land use . The licensee after receipt of license shall send one copy of license to concerned police station and collector .
14. Appeal against order of the competent authority.- If the licensee is aggrieved by any orders of the competent authority, the appeal can be filed before the appeal committee under section 403 (4) of Madhya Pradesh Municipal Corporation Act, 1956 or to the Collector under section 308 (d) of the Madhya Pradesh Municipalities Act, 1961 , as the case maybe.
15. Prosecution.- The competent authority can inspect the marriage garden at any time . If any violation of any provision of bye - laws is detected, the competent authority shall inform the licensee to take necessary action within 3 days . If the licensee does not comply with the instructions then license can be cancelled immediately, and the competent authority can initiate proceedings for prosecution before the competent court against the guilty person, organisation, or company .
16. Settlement . The powers to withdraw charges under consideration before the court or settlement of dispute shall vest with the competent authority of the municipality.
17. All right of the municipality reserved.- The municipality shall not get any ownership rights of the land/building registered as marriage garden . The municipality shall reserve the right to cancel license in public मध्यप्रदेश राजपत्र, दिनांक 6 जनवरी 2021

interest without assigning any reason . Municipality shall not be liable to pay any amount as damages for cancellation of the license of marriage .
18. Prohibition. - Within the municipal limits , no person, organisation, company without the valid licence from the municipality shall use any place for marriage. License for the marriage gardens in the municipal limits existing before the commencement of these bye-laws, shall be taken before 31st March of that financial year in accordance with the procedure prescribed in these model bye - laws , otherwise action shall be taken by treating them unauthorised. :
19. Repeal and saving.- As from the date of commencement of these bye- laws, all rules, bye - laws corresponding to these bye- laws applicable in municipalities shall stand repealed:
Provided, anything done or any action taken under the rules or bye- laws so repealed, shall, unless such thing or action is inconsistent with the provisions of these bye- laws , be deemed to have been done or taken under the corresponding provisions of these bye- laws .
