मध्यप्रदेश सहकारी सोसाइटी (संशोधन) अध्यादेश , २०२१ [मध्यप्रदेश राजपत्र (असाधारण) " में दिनांक २३ जनवरी , २०२१ को प्रथम बार प्रकाशित किया गया. ] भारत गणराज्य के इकहत्तरवें वर्ष में राज्यपाल द्वारा प्रख्यापित किया गया.
मध्यप्रदेश सहकारी सोसाइटी अधिनियम , १६६० को और संशोधित करने हेतु अध्यादेश.
यतः , राज्य के विधान मण्डल का सत्र चालू नहीं है और मध्यप्रदेश के राज्यपाल का यह समाधान हो गया है कि ऐसी परिस्थितियां विद्यमान हैं जिनके कारण यह आवश्यक हो गया है कि तुरन्त कार्रवाई करें ;
अतएव , भारत के संविधान के अनुच्छेद २१३ के खण्ड (१ ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए मध्यप्रदेश के राज्यपाल निम्नलिखित अध्यादेश प्रख्यापित करते हैं :-
१. (१) इस अध्यादेश का संक्षिप्त नाम मध्यप्रदेश सहकारी सोसाइटी (संशोधन) अध्यादेश , २०२१ है.
संक्षिप्त नाम तथा प्रारंभ .
(२) यह मध्यप्रदेश राजपत्र में इसके प्रकाशन की तारीख से प्रवृत्त होगा,
२. इस अध्यादेश के प्रवर्तन की कालावधि के दौरान मध्यप्रदेश सहकारी सोसाइटी अधिनियम , १६६० (क्रमांक १७ सन् १६६१ ) (जो इसमें इसके पश्चात् मूल अधिनियम के नाम से निर्दिष्ट है ) धारा ३ से ६ में विनिर्दिष्ट संशोधनों के अध्यधीन रहते हुए प्रभावी होगा.
मध्यप्रदेश अधिनियम क्रमांक १७ सन् १६६१ का अस्थाई रूप से संशोधित किया जाना.
३. मूल अधिनियम की धारा ४८- क में, उप धारा (४) में, -
धारा ४८- क का संशोधन.
(एक) खण्ड (क) में, शब्द " संसद या विधान सभा के सदस्य के रूप में निर्वाचित हो जाता है या" का लोप किया जाए.
(दो) खण्ड (ख) का लोप किया जाए .
धारा ४६ का संशोधन
४. मूल अधिनियम की धारा ४६ में, उपधारा (७- क) में , खण्ड ( ख) में , प्रथम परंतुक में , पूर्ण विराम के स्थान पर , कोलन स्थापित किया जाए , और इसके पश्चात् निम्नलिखित परन्तुक अंतः स्थापित किया जाए , अर्थात्:-
" परन्तु यह और कि किसी शीर्ष अथवा केन्द्रीय सोसाइटी की दशा में, यदि रजिस्ट्रार की राय में प्रशासक को उसके पदीय कर्तव्यों के निर्वहन में सहायता करने के लिए समिति गठित की जाना आवश्यक है , तो रजिस्ट्रार, निम्नलिखित सदस्यों की एक समिति नियुक्त कर सकेगा, अर्थात्: -
(क) उस सोसाइटी के अधिकतम तीन सदस्य जो सोसाइटी के संचालक मण्डल के सदस्य के रूप में निर्वाचित होने की अर्हता रखते हों ;
(ख) रजिस्ट्रार का एक प्रतिनिधि;
(ग) वित्तपोषक संस्थाओं का एक प्रतिनिधि. " .

74(1) ५. मूल अधिनियम की धारा ५२ में , उपधारा (५ ) में, खण्ड (क) के स्थान पर, निम्नलिखित खण्ड स्थापित धारा ५२ का संशोधन. किया जाए , अर्थात्: -
" (क) सहकारी साख संरचना में , राज्य सरकार की अंश पूंजी के लिए अधिकतम सीमा राज्य सरकार द्वारा समय- समय पर अधिसूचित किए गए अनुसार होगी; ".
धारा ५३ का संशोधन ६. मूल अधिनियम की धारा ५३ में,
(एक) उपधारा ( १) में, प्रथम परन्तुक के पश्चात्, निम्नलिखित परन्तुक अन्तःस्थापित किया
जाए , अर्थात्:-
"परन्तु यह और कि किसी शीर्ष अथवा केन्द्रीय सोसाइटी की दशा में , यदि रजिस्ट्रार की राय में प्रशासक को उसके पदीय कर्तव्यों के निर्वहन में सहायता करने के लिए समिति गठित की जाना आवश्यक है , तो रजिस्ट्रार, निम्नलिखित सदस्यों की एक समिति नियुक्त कर सकेगा, अर्थात्:-
(क) उस सोसाइटी के अधिकतम तीन सदस्य जो सोसाइटी के संचालक मण्डल के सदस्य के रूप में निर्वाचित होने की अर्हता रखते हों;
(ख) रजिस्ट्रार का एक प्रतिनिधि;

(दो) उपधारा (१२ ) में, परन्तुक में, पूर्ण विराम के स्थान पर, कोलन स्थापित किया जाए तथा इसके पश्चात् निम्नलिखित परन्तुक अन्तःस्थापित किया जाए , अर्थात्:-
"परन्तु यह और कि किसी शीर्ष अथवा केन्द्रीय सोसाइटी की दशा में , यदि रजिस्ट्रार की राय में प्रशासक को उसके पदीय कर्तव्यों के निर्वहन में सहायता करने के लिए समिति गठित की जाना आवश्यक है, तो रजिस्ट्रार , निम्नलिखित सदस्यों की एक समिति नियुक्त कर
सकेगा, अर्थात्:-

( AMENDMENT)
ORDINANCE , 2021
First published in the " Madhya Pradesh Gazette ( Extra - ordinary) " , dated the 23rd January , 2021 .
Promulgated by the Governor in the seventy first year of the Republic of India.
An Ordinance further to amend the Madhya Pradesh Co - operative Societies Act , 1960 .
Whereas , the State Legislature is not in session and the Governor of Madhya Pradesh is satisfied that circumstances exist which render it necessary to take immediate action;
Now, therefore, in exercise of the powers conferred by clause ( 1 ) of article 213 of the Constitution of India , the Governor of Madhya Pradesh is pleased to promulgate the following Ordinance : -
Short title and commencement .
1. ( 1 ) This Ordinance may be called the Madhya Pradesh Co - operative Societies (Amendment) Ordinance , 2021 .
(2) It shall come into force from the date of its publication in the Madhya Pradesh Gazette.
Madhya Pradesh Act No. 17 of 1961 to be temporarily amended .
2.During the period of operation of this Ordinance , the Madhya Pradesh Co - operative Societies Act, 1960 (No. 17 of 1961 ) ( hereinafter referred to as the principal Act) , shall have effect subject to the amendments specified in Sections 3 to 6 .
3. In Section 48 -A of the principal Act , in sub - section (4 ) , -

elected as a Member of in clause ( a) , the words Parliament or Member of Legislative Assembly or " shall be omitted. (i)
(ii) clause (b ) shall be omitted .
Amendment of Section 49 .
4. In Section 49 of the principal Act , in sub - section (7 - a) , in clause (b ) , in the first proviso , for full stop , colon shall be substituted and thereafter, the following proviso shall be inserted , namely : -
"Provided further that , in case of any Apex or Central Society, if in the opinion of the Registrar , a committee is required to be constituted to assist the Administrator in the discharge of his duties , the Registrar may appoint a committee consisting of following members , namely
a maximum of three members of the said society who are eligible to be elected as a member of the Board of Directors of the society; (a)
(b ) one representative of the Registrar ;
(c) one representative of the financing institutions . " .
Amendment of Section 52 .
5. In Section 52 of the principal Act , in sub - section (5 ) , for clause ( a) , the following clause shall be substituted , namely : -
"(a) in the Co - operative Credit Structure , the maximum limit for the share capital of the State Government shall be such as may be notified by the State Government , from time to time . " .
6. In Section 53 of the principal Act , -
Amendment of Section 53 .
(i) in sub - section ( 1 ) , after the first proviso , the following proviso shall be inserted , namely : -
"Provided further that , in case of any Apex or Central Society, if in the opinion of the Registrar, a committee is required to be constituted to assist the Administrator in the discharge of his duties , the Registrar may appoint a committee consisting of following members , namely : -
(a) a maximum of three members of the said society who are eligible to be elected as a member of the Board of Directors of the society;
(b) one representative of the Registrar ;
(c) one representative of the financing insititutions . " .
