क्र.- एफ 2-10 (7-1 ) / 2019/ 29-2, उपभोक्ता सरंक्षण अधिनियम, 2019 (क्र. 35 सन 2019) की धारा- 102 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए राज्य शासन, एतद् द्वारा निम्नलिखित नियम बनाती हैं, अर्थात-

//नियम//

1. संक्षिप्त नाम तथा प्रारंभ-

(1 ) इन नियमों का संक्षिप्त नाम मध्यप्रदेश उपभोक्ता विवाद प्रतितोषण आयोग (अधिकारी/कर्मचारी) सेवा भरती नियम, 2021 है।

(2) ये नियम मध्यप्रदेश राजपत्र में इनके प्रकाशन की दिनांक से प्रवृत्त होंगे।

2. परिभाषाएं- इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो, -

(क) "अधिनियम "से अभिप्रेत है, उपभोक्ता संरक्षण अधिनियम , 2019 (2019 का 35);

(ख) "नियुक्ति प्राधिकारी "से अभिप्रेत है, मध्यप्रदेश राज्य उपभोक्ता विवाद प्रतितोषण आयोग का अध्यक्ष (चेयरपर्सन) या उनके द्वारा नियुक्त कोई अन्य प्राधिकारी;

(ग) " अध्यक्ष (चेयरपर्सन) "से अभिप्रेत है, आयोग का अध्यक्ष या मध्यप्रदेश के राज्यपाल द्वारा ( अधिनियम की धारा 42 के अधीन) प्राधिकृत किया गया स्थानापन्न अध्यक्ष;

(घ) "आयोग 'से अभिप्रेत है, मध्यप्रदेश राज्य उपभोक्ता विवाद प्रतितोषण आयोग अथवा जिला उपभोक्ता विवाद प्रतितोषण आयोग, जैसी भी स्थिति हो;

(ङ) "विभागीय पदोन्नति /सीधी भर्ती समिति "से अभिप्रेत है, इन नियमों के अधीन गठित ऐसी समिति;

(च) "कर्मचारी "से अभिप्रेत है, आयोग का कर्मचारी या आयोग द्वारा नियुक्त कोई कर्मचारी या अन्य शासकीय विभागों से संविलियन द्वारा , आयोग में कोई पद धारण करने वाला कर्मचारी;

(छ) "परीक्षा"से अभिप्रेत है, इन नियमों के अधीन संचालित प्रतियोगिता परीक्षा या विभागीय परीक्षा;

(ज) "शासन "से अभिप्रेत है, मध्यप्रदेश शासन;

(झ) "सदस्य"से अभिप्रेत है, अधिनियम के अनुसार नियुक्त किया गया आयोग का सदस्य;

(ञ) "अन्य पिछड़ा वर्ग"से अभिप्रेत है, राज्य शासन द्वारा समय-समय पर यथा संशोधित अधिसूचना क्रमांक एफ 8-5- पच्चीस-4-84, दिनांक 26 दिसम्बर , 1984 द्वारा यथा संशोधित नागरिकों के अन्य पिछड़े वर्ग;

(ट) "अनुसूची"से अभिप्रेत है, इन नियमों से संलग्न अनुसूची;

(ठ) " अनुसूचित जाति 'से अभिप्रेत है, कोई जाति, मूलवंश या जनजाति अथवा जाति मूलवंश या जनजाति का भाग या उसमें का यूथ , जिसे भारत के संविधान के अनुच्छेद 341 के अधीन मध्यप्रदेश राज्य के संबंध में अनुसूचित जातियों के रूप में विनिर्दिष्ट किया गया है;

(ड) " अनुसूचित जनजाति"से अभिप्रेत है, कोई जनजाति, या जनजाति समुदाय अथवा ऐसी जनजाति या जनजाति समुदाय का भाग या उसमें का यूथ , जिसे भारत के संविधान के अनुच्छेद 342 के अधीन मध्यप्रदेश राज्य के संबंध में अनुसूचित जातियों के रूप में विनिर्दिष्ट किया गया है;

(ढ) " आर्थिक रूप से कमजोर वर्ग (ई.डब्ल्यू.एस. ) " से अभिप्रेत है, जो संविधान के अनुच्छेद-341 एवं 342 के अंतर्गत मध्यप्रदेश राज्य के लिए अधिसूचित अनुसूचित जाति एवं अनुसूचित जनजाति तथा राज्य सरकार द्वारा समय - समय पर संशोधित अधिसूचना दिनांक 26.12.1984 द्वारा विर्निदिष्ट अन्य पिछड़े वर्ग को प्रदत्त आरक्षण की परिधि में नहीं आते हैं;

(ण) "सेवा "से अभिप्रेत है, अनुसूची दो के कॉलम (2) में यथावर्णित सेवा;

(त) "राज्य "से अभिप्रेत है, मध्यप्रदेश राज्य;

(थ) "बोर्ड"से अभिप्रेत है, प्रोफेशनल इग्जामिनेशन बोर्ड अथवा ऐसा कोई संस्थान जिसे राज्य शासन द्वारा प्रतियोगिता परीक्षा आयोजित कर चयन करने हेतु अधिकृत किया गया हो। 110(1)

3. विस्तार और लागू होना- मध्यप्रदेश सिविल सेवा (सेवा की सामान्य शर्तें) नियम, 1961 में अन्तर्विष्ट उपबंधों की વ્યાપઃ૫૬પ્રતિયુદ્ધ પ્રમાવ ડાળે વિશ્વા, અનુસૂચી- ણ્ય મેંવિર્શિત બાયોગ છે સ્વીયુદ્ધ પછવે પ્રત્યેય સર્વિસ્થ ૫૨ બા होंगे।

4. सेवा का गठन- सेवा में निम्नलिखित व्यक्ति होंगे , अर्थात्-

(क) वे व्यक्ति , जो इन नियमों के प्रारंभ होने के समय अनुसूची-एक में विनिर्दिष्ट किसी पद को मूलरूप से या स्थानापन्न रूप से धारण कर रहे हों;

(ख) वे व्यक्ति, जो इन नियमों के प्रारंभ होने से पूर्व , सेवा में भर्ती किए गए हों; और

(ग) वे व्यक्ति जो इन नियमों के उपबंधों के अनुसार सेवाओं में भर्ती किए गए हों।

5. वर्गीकरण , वेतन मेट्रिक्स आदि-

(1) सेवा का वर्गीकरण , उससे संलग्न वेतन मेट्रिक्स तथा सेवा में सम्मिलित पदों की संख्या, अनुसूची-एक के उपबंधों के अनुसार होंगी;

परन्तुसरकार आयोग के अध्यक्ष के परामर्श से, सेवा में सम्मिलित किए गए पदों की संख्या में समय-समय पर या तो स्थायी आधार पर या अस्थायी आधार पर , वृद्धि या कमीं कर सकेगी।

(2) सेवा के सदस्य, वित्त विभाग के परिपत्र एफ 11-1/2008/ नियम/चार, दिनांक 24.01.2008 के उपबंधों के अधीन समयमान वेतनमान के हकदार होंगे।

(क) प्रतियोगिता परीक्षा के माध्यम से सीधी भर्ती द्वारा;

(ख) अनुसूची चार के कॉलम (2) में यथा विनिर्दिष्ट सेवा के सदस्यों में से पदोन्नति द्वारा ;

(ग) ऐसी सेवाओं के मूल पदों पर नियुक्त किए गए व्यक्तियों के स्थानांतरण/प्रतिनियुक्ति द्वारा , जैसा कि विनिर्दिष्टकिया जाए।

(2) उप नियम (1 ) के खण्ड (क) या (ख) के अधीन भर्ती किए गए व्यक्तियों की संख्या किसी भी समय अनुसूची एक में विनिर्दिष्ट पदों की संख्या , अनुसूची दो में दर्शाए गए प्रतिशत से अधिक नहीं होगी।

7. सेवा में नियुक्ति -

इन नियमों के प्रारम्भ होने पर सेवा में समस्त नियुक्तियां आयोग के अध्यक्ष या आयोग के अध्यक्ष द्वारा प्राधिकृत प्राधिकारी द्वारा की जाएंगी और ऐसी कोई भी नियुक्ति नियम-6 में विनिर्दिष्ट भर्ती के तरीकों में किसी एक तरीके द्वारा चयन के पश्चात्की जाएगी अन्यथा नहीं।

8. सीधी भर्ती की पात्रता की शर्तें -

सीधी भर्ती द्वारा चयन स्पर्धा के लिए पात्र होने हेतु अभ्यर्थी को निम्नलिखित शर्तें पूरी करनी चाहिए, अर्थात्ः- (क) वह भारत का नागरिक हो ;

(ख) आयु - मध्यप्रदेश राजपत्र, दिनांक 1 फरवरी 2021

(एक) उसने चयन के प्रारम्भ होने की तारीख के ठीक आगामी वर्ष की जनवरी के प्रथम दिन को अनुसूची- तीन के कॉलम (3) में यथा विनिर्दिष्ट आयु प्राप्त कर ली हो और उक्त अनुसूची के कॉलम (4 ) में यथा विनिर्दिष्ट आयु प्राप्त न की हो ;

(दो) यदि अभ्यर्थी अनुसूचित जाति या अनुसूचित जनजाति वर्ग का हो तो उच्चतर आयु सीमा अधिकतम 05 वर्ष तक शिथिलनीय होगी;

(तीन) उन अभ्यर्थियों के संबंध में, जो मध्यप्रदेश सरकार के कर्मचारी हों अथवा कर्मचारी रह चुके हों उच्चतर आयु सीमा नीचे दी गई सीमा तक तथा शर्तों के अध्यधीन रहते हुए शिथिलनीय होगीः- (1 ) एक अभ्यर्थी जो स्थायी या अस्थायी कर्मचारी हो , 45 (40+05) वर्ष से अधिक आयु का नहीं होना चाहिए । यह रियायत आकस्मिक निधि से वेतन पाने वाले समस्त वर्गों के कर्मचारियों, कार्यभारित कर्मचारियों तथा परियोजना कार्यान्वयन समिति में कार्यरत कर्मचारियों को भी अनुज्ञेय होगी;

(2) ऐसे अभ्यर्थी को, जो छंटनी किया गया शासकीय सेवक हो, अपनी आयु में से उसके द्वारा पहले की गई सम्पूर्ण सेवा की अधिकतम सात वर्ष की सीमा तक की कालावधि भले ही वह कालावधि एक से अधिक बार की गई सेवाओं का योग हो, कम करने के लिए अनुज्ञात किया जाएगा बशर्ते कि इसके परिणाम स्वरूप जो आयु निकले वह उच्चतर आयु सीमा 45 वर्ष से अधिक न हो;

स्पष्टीकरण-छंटनी किये गये "सरकारी सेवक 'से अभिप्राय है, ऐसा व्यक्ति जो इस राज्य या किसी भी घटक इकाई की सरकारी सेवा में लगातार कम से कम छह माह की कालावधि तक रहा हो तथा जिसे रोजगार कार्यालय में अपना नाम पंजीकरण कराने या सरकारी सेवा में नियोजन हेतु अन्यथा आवेदन पत्र देने की तिथि से अधिक से अधिक तीन वर्ष पूर्व स्थापना में कमी किए जाने के कारण सेवोन्मुक्त किया गया हो।

(चार) ऐसे अभ्यर्थी को, जो भूतपूर्व सैनिक हों अपनी आयु में से उसके द्वारा पहले की गई संपूर्ण प्रतिरक्षा सेवा की अवधि कम करने के लिए अनुज्ञात किया जाएगा बशर्ते कि इसके परिणामस्वरूप जो आयु निकले , वह उच्चतर आयु सीमा से 45 वर्ष से अधिक न हो।

स्पष्टीकरण-पद " भूतपूर्व सैनिक "से अभिप्राय है ऐसा व्यक्ति, जो निम्नलिखित प्रवर्गों में से किसी एक प्रवर्ग में रहा हो तथा जो भारत सरकार के अधीन कम से कम छह माह की निरन्तर कालावधि तक हो तथा किसी भी रोजगार कार्यालय में अपना नाम रजिस्ट्रीकृत कराने की या सरकारी सेवा में नियोजन हेतु अन्यथा आवेदन- पत्र देने की तारीख से अधिक से अधिक तीन वर्ष पूर्व मितव्ययिता इकाई की सिफारिशों या स्थापना में सामान्य रूप से कमी किए जाने के कारण जिसकी छंटनी की गई हो अथवा अधिशेष (सरप्लस) घोषित किया गया थाः-

(1 ) ऐसे भूतपूर्व सैनिक, जिन्हें समय पूर्व सेवानिवृत्त रियायतों (मस्टरिंग आऊट कन्शेसन) के अधीन मुक्त कर दिया गया हो;

(2) ऐसे भूतपूर्व सैनिक जो दूसरी बार भर्ती किए गए हों और अल्पकालीन वचनबंध अवधि तथा नामांकन संबंधी शर्तें पूर्ण कर लेने पर सेवोन्मुक्त कर दिए गए हों ;

(3) मद्रास सिविल यूनिट के भूतपूर्व कर्मचारी;

(4) ऐसे अधिकारी (सैनिक तथा असैनिक) जिनकी अल्पावधि सेवा में नियमित कमीशन प्राप्त अधिकारी सम्मिलित हैं उनकी संविदा के पूरे होने पर सेवोन्मुक्त किए गए हों;

(5) ऐसे अधिकारी, जिन्हें अवकाश रिक्तियों पर छह माह से अधिक समय तक निरंतर कार्य करने के बाद सेवोन्मुक्त किया गया हो;

(6) ऐसे भूतपूर्व सैनिक, जिन्हें अशक्त होने के कारण सेवा से अलग किया गया हो;

(7) ऐसे भूतपूर्व सैनिक, जिन्हें इस आधार पर सेवोन्मुक्त किया गया हो कि वे दक्ष सैनिक बनने योग्य नहींहै;

(8) ऐसे भूतपूर्व सैनिक, जिसको गोली लगने , घाव हो जाने आदि के कारण चिकित्सीय आधार पर सेवा से अलग कर दिया गया हो।

(पांच) सीधी भर्ती हेतु महिला अभ्यर्थियों को उच्चतर आयु सीमा 05 वर्ष तक शिथिलनीय होगी;

(छः) तलाकशुदा महिला अभ्यर्थियों के संबंध में उच्चतर आयु सीमा 45 वर्ष तक होगी।

(सात) अनुसूचित जाति, अनुसूचित जनजाति तथा पिछड़े वर्ग कल्याण विभाग के अन्तर्जातीय विवाह प्रोत्साहन कार्यक्रम के अधीन किसी पुरस्कृत दंपत्ति के सवर्ण पति-पत्नी के संबंध में उच्चतर आयु सीमा पांच वर्ष तक शिथिलनीय होगी;

(आठ) विक्रम पुरस्कार धारक अभ्यर्थियों के लिए भी उच्चतर आयु सीमा पांच वर्ष तक शिथिलनीय होगी;

(नौ) ऐसे अभ्यर्थियों के संबंध में, जो मध्यप्रदेश राज्य, निगम/बोर्ड के कर्मचारी हैं, उच्चतर आयु सीमा अधिकतम 05 वर्ष तक शिथिलनीय होगी।

(दस) नगर सेना (होमगार्डस) के स्वयं सेवी नगर सैनिकों तथा नान कमीशंड् अधिकारियों को उनके द्वारा पूर्व में की गई नगर सेना सेवा की संपूर्ण कालावधि के लिए उच्चतर आयु सीमा शिथिलनीय होगी किन्तु किसी भी दशा में उनकी आयु 45 वर्ष से अधिक नहीं होगी;

(ग्यारह) आयु सीमा के संबंध में समस्त शिथलीकरण पश्चात अधिकतम आयु सीमा किसी भी दशा में 45 वर्ष से अधिक नहीं होगी;

(बारह) इसके अतिरिक्त उपरोक्त उल्लिलिखत उपबंधों के होते हुए भी सामान्य प्रशासन विभाग द्वारा आयु सीमा निर्धारण के संबंध में समय- समय पर जारी किये जाने वाले दिशा-निर्देश प्रभावी होंगे ;

टिप्पणीः-उपर्युक्त उपखण्ड (तीन) (1 ) में उल्लेखित आयु संबंधी रियायतों के अधीन ऐसे अभ्यर्थी जिन्हें परीक्षा/चयन के योग्य माना गया हो, व यदि आवेदन पत्र भेजने के पश्चात् परीक्षा/चयन के पहले मध्यप्रदेश राजपत्र, दिनांक 1 फरवरी 2021

अथवा बाद में सेवा से त्याग पत्र दे दें तो नियुक्ति के पात्र नहीं होंगे। तथापि यदि आवेदन पत्र भेजने के पश्चात् उनकी सेवा अथवा पद से छंटनी की जाए तो वे नियुक्ति के पात्र बने रहेंगे। किसी भी अन्य मामले में आयु सीमाएं शिथिल नहीं की जावें। विभागीय उम्मीदवार को चयन हेतु उपस्थित होने के लिए नियुक्ति प्राधिकारी से पूर्व अनुमति प्राप्त करनी होगी।

(ग)शैक्षणिक अर्हताएं -

अभ्यर्थी के पास अनुसूची-तीन में दर्शाई गई सेवा के लिए विहित शैक्षणिक अर्हता होनी चाहिए ।

(घ) फीस-

सीधी भर्ती के लिए प्रतियोगी परीक्षा में सम्मिलित होने हेतु अभ्यर्थियों को आयोग/ बोर्ड द्वारा विहित फीस का भुगतान करना होगा।

9. निरर्हता-

(1 ) अभ्यर्थी की ओर से अपनी अभ्यर्थिता के लिए किसी भी साधन से समर्थन अभिप्राप्त करने के किसी भी प्रयास को आयोग द्वारा उनके परीक्षा/चयन में बैठने के संबंध में निरर्हता माना जाएगा;

(2) कोई भी अभ्यर्थी, जिसने विवाह के लिये नियत की गई न्यूनतम आयु से पूर्व विवाह कर लिया हो , किसी भी सेवा में नियुक्ति का पात्र नहींहोगा;

(3) कोई भी अभ्यर्थी, जिसकी दो से अधिक जीवित संतान हों, जिसमें से एक का जन्म 26 जनवरी, 2001 को या उसके पश्चात् हुआ हो, किसी सेवा या पद के लिये पात्र नहीं होगा;

परन्तुकोई भी अभ्यर्थी, जिसकी पहले से एक जीवित संतान है तथा आगामी प्रसव 26 जनवरी, 2001 को या उसके पश्चात् हुआ हो, जिसमें दो या दो से अधिक संतान का जन्म होता है, किसी सेवा या पद पर नियुक्ति के लिये निरर्हित होगा;

(4) कोई भी अभ्यर्थी जिसे महिलाओं के विरूद्ध किसी अपराध का सिद्ध- दोष ठहराया गया हो, किसी सेवा या पद पर नियुक्तिके लिये पात्र नहीं होगा।

(5) कोई भी अभ्यर्थी, जिसकी एक से अधिक जीवित पनियों हों और कोई भी महिला अभ्यर्थी जिसने ऐसे व्यक्ति सेविवाहकिया है, जिसकी पहले से ही एक पत्नी जीवित हो, सेवा के लिये अपात्र होगा

10. पात्रता के संबंध में विनिश्चय परीक्षा/चयन में प्रवेश के लिए किसी अभ्यर्थी की पात्रता या अन्यथा के संबंध में नियुक्ति प्राधिकारी का विनिश्चय अंतिम होगा और ऐसे अभ्यर्थी को जिसे प्रवेश प्रमाण-पत्र जारी नहीं किया गया है, परीक्षा के उपसंजात होने के लिए अनुज्ञात नहीं किया जाएगा

11. प्रतियोगी परीक्षा द्वारा सीधी भर्ती: -

(1 ) सेवा में भर्ती के लिए प्रतियोगिता परीक्षा ऐसे अन्तरालों से ली जायेगी, जैसा कि आयोग समय-समय पर निश्चित करें।

(2) सीधी भर्ती के लिये उपलब्ध रिक्तियों में से 16 प्रतिशत तथा 20 प्रतिशत स्थान क्रमशः अनुसूचित जातियों, अनुसूचित जनजातियों के लिए आरक्षित रखे जाएंगे तथा अन्य पिछड़ा वर्ग के लिये ऐसा प्रतिशत जो सामान्य प्रशासन विभाग के द्वारा समय -समय पर अधिसूचित किया जाए, आरक्षित रखे जाएंगे।

(3) "आर्थिक रूप से कमजोर वर्ग (ई.डब्ल्यू.एस. )" जो, संविधान के अनुच्छेद -341 एवं 342 के अंतर्गत मध्यप्रदेश राज्यके लिए अधिसूचित अनुसूचित जाति एवं अनुसूचित जनजाति तथा राज्य सरकार द्वारा समय-समय पर संशोधित अधिसूचना क्रमांक एफ 85-25-4-84, दिनांक 26.12.1984 द्वारा विर्निदिष्ट अन्य पिछडे. वर्ग को प्रदत्त आरक्षण की परिधि में नहीं आते हैं, के लिये 10 प्रतिशत आरक्षित रखे जाएंगे।

(4) इस प्रकार आरक्षित रिक्त स्थानों को भरते समय उन अभ्यर्थियों की, जो अनुसूचित जातियों तथा अनुसूचित जनजातियों, अन्य पिछड़े वर्ग एवं " आर्थिक रूप से कमजोर वर्ग ( ई.डब्ल्यू.एस. ) " के सदस्य हैं, नियुक्ति पर विचार उसी क्रम में किया जाएगा जिस क्रम में उनके नाम निर्दिष्ट सूची में आये हों, चाहे अन्य अभ्यर्थियों की तुलना में उनका सापेक्षित रैंक कुछ भी क्यों न हो।

(5) अनुसूचित जातियों, अनुसूचित जनातियों, अन्य पिछड़े वर्गों एवं "आर्थिक रूप से कमजोर वर्ग (ई.डब्ल्यू.एस. )" से संबंधित अभ्यर्थियों को, जिन्हें प्रशासन में दक्षता बनाए रखने का सम्यक ध्यान रखते हुए 110(5)

सेवा में नियुक्ति के लिये चुने जाते हैं, उप-नियम (2) के अधीन यथास्थिति, अनुसूचित जातियों तथा अनुसूचित जनजातियों, अन्य पिछड़ा वर्ग एवं "आर्थिक रूप से कमजोर वर्ग (ई.डब्ल्यू.एस. )" के अभ्यर्थियों के लिए आरक्षित रिक्तियों पर नियुक्त किये जा सकेंगे।

(6) यदि अनुसूचित जातियों, अनुसूचित जनजातियों से संबंधित अभ्यर्थी उनके लिये आरक्षित सभी रिक्तियों को भरने के लिये उपलब्ध न हों तो शेष रिक्तियां सरकार के पूर्व अनुमोदन के बिना अन्य अभ्यर्थियों से नहीं भरी जाएंगी और रिक्तियां अनुसूचित जातियों , अनुसूचित जनजातियों के अभ्यर्थियों के लिए अगले चयन हेतु आरक्षित रखी जाएंगी।

(7) मध्यप्रदेश सिविल सेवा ( महिलाओं की नियुक्ति के लिये विशेष उपबंध) नियम , 1997 के उपबंधो के अनुसार महिला अभ्यर्थियों के लिये पद आरक्षित रखे जाएंगे।

(8 ) विकलांगों के लिये 6 प्रतिशत पद आरक्षित रखे जाएंगे, बशर्ते कि वे जिस कार्य के लिये नियुक्त किये जा रहे हैं, उसे करने में सक्षम पाये जाएं।

12.परिवीक्षा-

सेवा में सीधी भर्ती से लिया गया प्रत्येक व्यक्ति सामान्य प्रशासन विभाग समय- समय पर अधिसूचित कालावधि के लिए परिवीक्षा पर नियुक्त किया जाएगा।

13. चयन समिति का गठन -

आयोग के अध्यक्ष की अध्यक्षता में सीधी भर्ती/पदोन्नति के माध्यम से अभ्यर्थियों के चयन हेतु एक चयन समिति अनुसूची- चार के कॉलम 5 अनुसार होगी । जिसमें अनुसूचित जाति, अनुसूचित जनजाति का प्रतिनिधित्व करने वाले किसी नामनिर्दिष्ट राजपत्रित स्तर के अधिकारियों को सदस्य के रूप में सम्मिलित किया जाएगा।

14. चयन समिति द्वारा सिफारिश किए गए अभ्यर्थियों की सूचीः-

(1 ) चयन समिति, अभ्यर्थियों की योग्यता क्रम में व्यवस्थित एक सूची तैयार करेगी जो ऐसे मानकों के अनुसार अर्ह हों जैसा कि समिति द्वारा अवधारित की जाए।

(2) इन नियमों तथा मध्यप्रदेश सिविल सेवा (सेवा की सामान्य शर्तें) नियम, 1961 के उपबंधों के अध्यधीन रहते हुए अभ्यर्थियों के उपलब्ध नामों पर उसी क्रम में विचार किया जाएगा जिस क्रम में उनके नाम सूची में आए हों।

(3) सूची में किसी अभ्यर्थी का नाम सम्मिलित कर लिए जाने से ही नियुक्ति का कोई अधिकार तब तक प्राप्त नहीं होगा, जब तक कि नियुक्ति प्राधिकारी का ऐसी जांच करने के बाद, जिसे वह आवश्यक समझे , यह समाधान नहीं हो जाता कि अभ्यर्थी सेवा में नियुक्ति के लिए सभी प्रकार से उपयुक्त है।

(4) चयन सूची जारी किये जाने की तारीख से एक वर्ष तक की कालावधि के लिये विधिमान्य होगी जिसे चयन समिति की सहमति से 6 माह की कालावधि के लिये बढाई जा सकेगी।

15. पदोन्नति द्वारा नियुक्ति -

(1) पात्र अभ्यर्थियों की पदोन्नति हेतु चयन करने के लिए नियम-13 अनुसार समिति होगी।

(2) समिति की बैठक सामान्यतः वर्ष में कम से कम एक बार होगी।

(3) पदोन्नति में आरक्षण के संबंध में वे प्रावधान लागू होंगे , जो सामान्य प्रशासन विभाग द्वारा समय - समय पर लागूकिए जाएं।

(4) पदोन्नति द्वारा अनारक्षित/ आरक्षित रिक्तियों को भरने के लिए अपनायी जाने वाली प्रक्रिया शासन के सामान्य प्रशासनविभाग द्वारा समय- समय पर जारी अनुदेशों के अनुसार होगी। मध्यप्रदेश राजपत्र, दिनांक 1 फरवरी 2021

16. पदोन्नति के लिए पात्रता संबंधी शर्तें -

(1 ) समिति उन सभी व्यक्तियों के मामलों पर विचार करेगी , जिन्होंने उस वर्षकी एक जनवरी को अनुसूची चार के कॉलम (4) में यथा विनिर्दिष्ट उन पदों पर, जिनसे कि पदोन्नति की जानी है या किसी अन्य पद या पदों पर जिन्हें शासन द्वारा उनके समतुल्य घोषित किया हो स्थानापन्न या मूल रूप में उतने वर्ष की सेवा पूर्ण कर ली हो और जो विचारण क्षेत्र में आते हों;

परन्तु किसी कनिष्ठ व्यक्ति को उसके द्वारा सेवा की विहित कालावधि पूरी कर लिए जाने के आधार पर उसे पदोन्नति के लिए अपने से वरिष्ठ व्यक्ति की तुलना में अधिमान देकर विचारण नहीं किया जायेगा।

17. उपयुक्त अभ्यर्थियों की सूची तैयार करना -

(1 ) समिति ऐसे व्यक्तियों की प्रवर्गवार एक सूची तैयार करेगी , जो निर्धारित शर्तों को पूरा करते हों तथा जिन्हें समिति, सेवा में पदोन्नति के लिए उपयुक्त समझे । इसके अतिरिक्त एक आरक्षित सूची भी तैयार होगी जिसमें दोलोक सेवकों अथवा 25 प्रतिशत व्यक्तियों के नाम , जो भी अधिक हो, उक्त चयन सूची में सम्मिलित होंगे। समिति, सूची में सम्मिलित करने के लिए प्रत्येक प्रवर्ग के लिए अपेक्षित संख्या में लोक सेवकों के नाम पर भी विचार करेगी।

(2) ऐसी सूची में नाम सम्मिलित करने के लिए किया जाने वाला चयन वरिष्ठता पर समुचित रूप से ध्यान देते हुए योग्यता तथा सभी दृष्टि से उपयुक्तता पर आधारित होगा।

(3) इस प्रकार तैयार की गई सूची का प्रतिवर्ष पुनर्विलोकन तथा पुनरीक्षण किया जाएगा।

(4) सामान्यतः सूची तब तक प्रवृत्त रहेगी जब तक कि उसका पुनर्विलोकन या पुनरीक्षण नहीं कर लिया जाता, किन्तु ऐसी सूची की विधिमान्यता उसके तैयार किए जाने की तारीख से 12 मास की कुल कालावधि के लिए मान्य होगी किंतु इसकी कालावधि 06 माह से अनधिक नहीं बढ़ाई जाएगी।

18. चयन सूची से सेवा में नियुक्ति-

चयन सूची में सम्मिलित अधिकारियों/कर्मचारियों की सेवा के संवर्ग के पदों पर नियुक्तियां उसी क्रम से की जाएंगी जिस क्रम से ऐसे अधिकारियों/कर्मचारियों के चयन सूची में आए हों।

19. परीक्षण-

सेवा में पदोन्नत प्रत्येक व्यक्ति दो वर्ष की कालावधि के लिये परीक्षण पर नियुक्त किया जाएगा।

20.निर्वचन-

यदि इन नियमों के निर्वचन के संबंध में कोई प्रश्न उद्भूत हो तो उसे शासन को निर्दिष्ट किया जाएगा और जिसका उस पर विनिश्चय अन्तिम होगा।

21. अन्य सेवा नियमों का लागू होना -

आयोग के अधिकारियों एवं कर्मचारियों पर मध्यप्रदेश सिविल सेवा ( वर्गीकरण, नियंत्रण तथा अपील) नियम , 1966, मध्यप्रदेश सिविल सेवा (आचरण) नियम, 1965, पेंशन, उपादान तथा भविष्य निधि से संबंधित नियम तथा अन्य नियम समय - समय पर यथा संशोधित रूप में निम्नलिखित शर्तों के अध्यधीन रहते हुए लागू होंगे: - (क) द्वितीय श्रेणी, तृतीय श्रेणी और चतुर्थ श्रेणी कर्मचारियों के मामले में आयोग का अध्यक्ष अनुशासनात्मक प्राधिकारी होगा और अध्यक्ष का पद रिक्त होने की दशा में आयोग के अध्यक्ष द्वारा नामांकित व्यक्ति गासनात्मक प्राधिकारी होगा;

(ख) खण्ड ( क) में वर्णित विहित प्राधिकारी द्वारा पारित किये जाने वाले आदेश के विरूद्ध प्रत्येक अपील राज्य शासनको कीजाएगी;

110 (7) (ग) जांच प्राधिकारी को संबंधित गवाहों या व्यक्तियों को नोटिस जारी करने की शक्ति होगी । वह उसके समक्ष उपस्थित होकर साक्ष्य अथवा अभिलेख प्रस्तुत करने को भी बाध्य होगा।

22.व्यावृत्ति -

इन नियमों की कोई भी बात, अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ा वर्ग एवं " आर्थिक रूप से कमजोर वर्ग (ई.डब्ल्यू.एस. ) " के लिए राज्य शासन द्वारा समय- समय पर इस संबंध में जारी किए गए आदेशों के अनुसार उपबंध किए जाने हेतु अपेक्षित आरक्षण तथा अन्य शर्तों को प्रभावित नहीं करेगी।

110(13) No. F- 2-10(7-1) 2019/29/2 - In exercise of the powers conferred by Section 102 of the Consumer Protection Act, 2019 ( No. 35 of 2019) the State Government, hereby makes the following Rules, namely:-

RULES

1 Short title and commencement -

(1) These Rules may be called the Madhya Pradesh Consumer Disputes Redressal Commission (Officer/ Employee) Service Recruitment Rules , 2021.

(2) It Shall come into force with effect from the date of its publication in the Madhya Pradesh Official Gazette .

Definition - In these Rules, unless the context otherwise requires, - 2.

(a) "Adhiniyam" means the Consumer Protection Act, 2019 ( No. 35 of 2019);

(b) "Appointing Authority " means the President (Chairperson) of the Madhya Pradesh State Consumer Disputes Redressal Commission or any other officer appointed by him;

(c) "President" ( Chairperson) means the President of the Commission or officiating President authorized under Section 42 of the Adhiniyam by the Madhya Pradesh Governor.

(d) "Commission " means Madhya Pradesh State Consumer Disputes Redressal Commission or District Consumer Disputes Redressal Commission , as the case may be;

(e) "Departmental Promotion / Direct Recruitment Committee" means a Committee constituted under these Rules .

(f) "Employee" means an employee of the Commission or an employee appointed by the Commission or absorbed from other Department, holding any post in the Commission .

(g) "Examination " means competitive examination or departmental examination conducted under these Rules.

(h) "Government" means the Government of Madhya Pradesh .

(i) "Member" means a Member appointed in the Commission under the Adhiniyam .

(i ) "Other Backward Classes " means the Other Backward Classes of citizen as specified vide No. F-8-5-XXV-4-84, Dated 26th December 1984 as amended from time to time (k) "Schedule" means a Schedule appendend to these Rules ;

(1) "Scheduled Castes " means any caste , race or tribe or part of or group within the caste, race or tribes specified as scheduled caste with respect to the State of Madhya Pradesh underArticle341 of the Constitution of India .

(m) "Scheduled Tribes " means any tribe, tribal community or part of or group within a tribe, tribal community specified as Scheduled Tribes with respect to the State of Madhya Pradesh under Article 342 of the Constitution of India .

(n) "Economically Weaker Section " ( EWS ) means a citizen who does not come under any reserved category such as Scheduled Castes and Scheduled Tribes declared by the State ofMadhya Pradesh under Article 341 and 342 of the Constitution of India and a citizen asspecified vide notification dated 26.12.1984 as amended from time to time .

(0) "Service" means service as specified in Schedule II of column (2) .

(p) "State" means the State of Madhya Pradesh .

(q) "Board" means the Professional Examination Board or any other Institution recognized for conducting competitive examination by the Government of Madhya Pradesh.

3 . Scopeand Application . - Without Prejudice to the generality of the provision contained in the MadhyaPradesh Civil Service (General Conditions of Service ) Rules , 1961 these Rules shall apply to every member of this service.

4. Constitution of the Service.- The Service shall consist of the following persons , namely:-

(1) Persons holding the post mentioned in Schedule I or officiating holding the post before coming into force of these Rules;

(2) Persons recruited to the service before commencement of these Rules ;

(3) Persons recruited to the service in accordance with the provisions of these Rules .

5. Classfication , Scale of Payetc. -

(1) TheClassification of the service , the scale of pay attached to them and the number of post included in the service shall be in accordance with the provisions contained in Schedule 1.

110 (15) Provided that the Government, in consultation with the President of the Commission may, from time to time, add to or reduce the number of various categories of posts included in the service either on a permanent or temporary basis .

(2) Persons in service shall be entitled to receive Samayman Vetanman (time scale pay) as percircular F 11-1/2008 /Niyam/Char dated 24.01.2008 issued by the Finance Department .

6. Methodof Recruitment . -

(1) Recruitment to the Service , after the commencement of these rules, shall be made by the following methods, namely :-

(a) By direct recruitment through competitive examination ;

(b) By Promotion of employees of the service as specified in column (2) of Schedule IV;

(2) Thenumber of persons recruited under Clause (a ) and (b) of Sub- rule (1) shall not at any time exceed the corresponding percentage number of such posts specified in Schedule - 11 .

7. Appointment to the Service . All appointments to the service after the commencement of these Rules shall be made by the President of the Commission or by the Officer authorized by the President of the Commission and no such appointment shall be made except after selection by one of the method of recruitment specified in Rule 6.

8. Condition of eligibility for direct recruitment . In order to be eligible to compete at the examination /selection , a candidate must satisfy the following conditions, namely: - (a) A citizen of India;

Age-

(b)

(i) The candidate must have attained the age specified in column (3 ) of Schedule III on the first day of January next following the date of commencement of selection process and must not have attained the age specified in column (4) of the aforesaid Schedule .

(ii) Theupper age limit shall be relaxable upto a maximum of 5 years, if a candidate belongs to a Scheduled castes or Scheduled Tribes .

(iii) The upper age limit shall be relaxable to the candidates, who are or have been employees of the Madhya Pradesh Government to the extent and subject to the conditions specified below, namely : -

(1) Acandidate holding a post temporarily and applying for another post should not be more than 45 (40+ 5 ) years of age . This concession shall also be available to the contingency paid employees and work-charged employees and of project implementation committee;

(2) A candidate who " retrenched government servant " shall be allowed to deduct from his age the period of all temporary service previously rendered by him up to a maximum limit of seven years even if it represents more than one spell , provided that the resultant age does not exceed the upper age limit of 45 years .

Explanation The term " retrenched government servant " denotes a personwho was in temporary Government service of this state or any constituent unit for a continuous period of not less than six months and who was discharged because of reduction in the establishment not more than three years prior to the dateof his registration at the employment exchange or of an application madeotherwise for employment in the service , in Government service.

(iv) A candidate who is an ex - serviceman will be allowed to deduct from his age the period of all defence service previously rendered by him , provided that the resultant age does not exceed the upper age limit of 45 years .

Explanation - The term " Ex- serviceman " denotes a person who belongs to any of the following categories and who was employed under the Government of India for a continuous period of not less than six months and who was retrenched or declared surplus as a result of the recommendation of the Economy unit and due to normal reduction in establishment not more than three years before the date of his registration at any Employment exchange or of an application made otherwise for employment in the Government service .

(1) Ex-serviceman released under mustering out consession ;

(2) Ex-serviceman enrolled for the second time and who after completion of short term engagement and fulfilling the conditions of enrolment, have been discharged;

Ex-servicemen of Madras Civil Unit . (3)

Ex-serviceman(military and civil ) including short service regular commissioned officers discharged on completion of their (4) contract;

(5) Ex-serviceman discharged after working for more than six months continously against leave vacancies .

(7) Ex-serviceman discharged on the ground that they are unlikely to become efficient soldiers

(8) Ex-serviceman who are medically boarded out on account of gunshot and wounds etc.

(5) Fordirect recruitment the upper age limit shall be relaxable upto a maximum of 5years for woman candidate.

(6) Incaseof divorcee woman the upper age limit shall be relaxable upto upper limit of45years.

(7) Theupper age limit shall be relaxable upto 5 years in respect of couple awarded superior caste under the inter-caste marriage incentive programme of the Tribal andScheduled Caste, Development Department .

(8) Theupper age limit shall be relaxable upto a maximum of 5 years in case of holder of"Vikram Award" .

(9) Theupper age limit shall be relaxable upto a maximum of 5 years in respect of candidates, who are the employees of M.P. Government / Corporation / Board.

(10) Theupper age limit shall be relexable to the Swayam Sevi Nagar Sainik and non- commissioned Officers of Nagar Sena ( Home Guards) for the service rendered by them, but in any case their age should not exceed to 45 years .

(11) Themaximum upper age limit shall not increase to 45 years even after availing thebenefit of age relaxation on the basis of one or more ground as above .

(12) Instructions regarding age limit issued from time to time by the General Administration Department, Madhya Pradesh shall remain applicable.

NOTE : The candidates, who are admitted to the selection under the relaxation mentioned in Clause (iii ) (1) above shall not be eligible for appointment, if after submitting the application they resign from service either before or after selection . They will, however continue to be eligible if they are retrenched from the service or post after submitting the application . Age limit shall not be relaxed in any other case . Departmental candidate has to obtain prior permission of his Appointing Authority to proceed for selection .

8(c)

Educational qualification :

A candidate must possess the educational qualification for the service as specified in Schedule -III .

To appear in the competitive examination for direct recruitment, candidate must pay fees prescribed by the Commission / Board .

9. Disqualification.-

(1) Any attempt on the part of candidate to obtain support for his candidature by any means may be held by the Appointing Authority to disqualify him for appearing in the examination /interview/ selection.

(2) Any candidate, who is married before attaining the minimum age as prescribed, shall not beeligible for appointment to any service or post;

(3) Any candidate who is having more than two child of which one of the child is born on orafter 26th January 2001, shall not be eligible for appointment to any service or post .

(4) Any candidate, who is convicted of criminal charges against woman shall not be eligible for appointment to any service or post;

(5) No malecandidate who has more than one wife living and no female candidate who has married a person having already a wife living shall be eligible for appointment to any service orpost.

10. Decision about the eligibility of the candidate :- The decision of the Appointing Authority as to the eligibility or otherwise of a candidate for appearing in the examination/interview shall be final and no candidate to whom a certificate of admission has not been issued by the Appointing Authority shall be allowed to appear in the examination/interview.

11. Direct Recruitment by competitive examination . -

(1) Competitive examination for recruitment to the service shall be held at such intervals as the Commission may, from time to time determine;

(2) Fordirect recruitment there shall be reservation of 16% and 20% respectively for the candidates belonging to the Scheduled Castes and Scheduled Tribes and of such percentage as notified, time to time, by General Administration Department, Government of Madhya Pradesh , for the candidates belonging to theOther Backward Class ;

(3) ForEconomically Weaker Section candidates there shall be reservation of 10% and the benefit to be provided to those candidates who do not come under any reserved category such as Scheduled Castes and Scheduled Tribes declared by the State ofMadhya Pradesh under Article 341 and 342 of the Constitution of India and candidates who do not come under the Other Backward Class as specified vide notification dated 26.12.1984 as amended from time to time .

(4) In filling up the vacancies so reserved , candidates who are members of the Scheduled Caste, Scheduled Tribe , Other Backward Class and Economically Weaker Section shall be considered for appointment in the order in which their names appear in thespecified list irrespective of their relative rank as compared with other candidates .

110(19) (5) Candidates belonging to the Scheduled Castes, Scheduled Tribes ,Other Backward Classes and Economically Weaker Section ( EWS) who found suitable for appointment to the service with due regard to the maintenance of effciency of administration may be appointed subject to Sub -Rule (2) as the case may be , to the vacancies reserved for the candidates of the Scheduled Castes, Scheduled Tribes , Other Backward Classes and Economically Weaker Section .

(6) Ifthe candidates belonging to Scheduled Caste and Scheduled Tribe are not available for filling up all the reserved posts, the remaining vacancies shall not be fulfilled by other candidates without obtaining prior sanction of the Government and shall be reserved till next selection for the candidates belonging to the Scheduled Caste and Scheduled Tribe .

(7) For woman candidate the post shall be reserved according to the provisions of M.P. Civil Services (Special Provision for Appointment of Women ) Rule 1997.

(8) There shall be 6% reservation for handicapped persons provided that they found competent to do the work for which they are appointed.

12. Probation - Every person directly recruited in the service shall be appointed on probation for a period as notified, time to time ,by General Administration Department, Government of Madhya Pradesh.

13. Constitution of Selection Committee:-

Under the Chairmanship of the President of the Commission for direct recruitment /by promotion a Selection Committee shall be constituted as per column 5 of Schedule IV. In the Selection Committee the Members belonging to Scheduled Caste / Scheduled Tribe of the rank ofGazztted Officer will be nominated .

14. Listofrecommended candidates by the Selection Committee:

(1) Selection Committee shall prepare a list in the order of merit of the candidates who have qualified by such standards as the Committee may determine.

(2) Subject to the provisions of these rules and of the M.P. Civil Services (General Condition of Service) Rules , 1961 the available candidates shall be considered for appointment in the order in which their names appear in the list.

(3) The inclusion of a candidate's name in the list confers no right to appointment unless the Appointing Authority is satisfied , after such enquiry, as may be considered necessary, that thecandidate is suitable in all respect for appointment to the service .

(4) The selection list prepared shall be valid for a period of one year from the date of issuance of such list and with the consent of the Selection Committee the list can be extended for a period of six months .

15.

Appointment by promotion : -

(1) There shall be a Committee to be constituted as per Rule 11 (13 ) for promotion of eligible candidates .

(2) The Committee shall ordinarily meet once in a year .

(3) Provisions relating to reservation in promotion shall be applicable which are issued by the General Administration Department of Madhya Pradesh from time to time.

(4) Procedure for making promotion in the unreserved / reserved vacancies shall be made in accordance with the instructions issued by the General Administration Department of the Government from time to time .

16.

Conditions of eligibility for promotion:

(1) The Committee shall consider the cases of all persons, who on the first day of January of that year had completed such number of years of service on the post from which promotion is to be made or any other post declared equivalent thereto as specified by the Government incolumn (4) of the Schedule IV.

Provided that no junior person shall be considered for promotion by giving preference over to his senior on the basis that he has completed such number of years of service on the post.

17. Preparation of the list of suitable candidates -

1. TheCommittee shall prepare a category wise list of such persons, who have fulfilled the prescribed conditions and found eligible for promotion by the committee . In addition to this a reserve list shall be prepared, in which two public servant or name of 25 % persons , which ever is higher , shall be included in the selection list . The Committee , to include expected number of each category in the list shall consider the name of public servants.

2. In order to include the name in the list in which the selection is to be made according to the seniority and eligibility in all aspects .

3. Thelist as prepared will be reviewed and revised every year .

4. Generally the list shall prevail unless it is reviewed or revised but validity of the list will remain in forcefor twelvemonths from the date it is prepared, but the validity of the list will not be extended for morethan six months .

18. Appointment to the service from the select list-

Appointment of the officers /employees included in select list for the post of service cadre shall bemade in accordance with the sequence of the select list of the officers/employees .

110(21) 19. Probation - Every person promoted to the service shall be appointed on probation for a period oftwo years.

20 . Interpretation - If any question arises relating to the interpretation of these rules, it shall be referred to Government whose decision thereon shall be final .

21. Application of other service rules - 1. TheMadhya Pradesh civil service (Classification , control and appeal ) rule 1966, Madhya Pradesh Civil services (conduct) rule 1965, pension , gratuity and provident fund rules and other rules which is as amended from time to time shall be applicable to officers and the employees of commission as per the condition mentioned below-

a) ThePresident of the Commission shall be Disciplinary Authority of Class II , Class III and Class IV employees, andwhere the post of the President is vacant, the person nominated by the President shall bethe Disciplinary Authority.

b) Appeal of every order passed by the Disciplinary Authority mentioned in clause 1(a ) will be filed before the State Government .

c) Enquiry Officer is empowered to issue notice to the concerning persons or witness, who will be bound to appear before him and produce record and evidence

22. Saving - Nothing in these rules shall affect reservation and other conditions required to be provided for the Scheduled Castes , Scheduled Tribes , Other Backward Classes and EconomicallyWeaker Section ( E.W.S. ) in accordance with the orders issued by the state government, from time to time, in this regard.
