MADHYA PRADESH BILL No. 10 OF 2021
PANDIT S. N. SHUKLA UNIVERSITY (AMENDMENT ) BILL , 2021 A Bill further to amend Pandit S. N. Shukla University Act, 2016 .
Be it enacted by the Madhya Pradesh Legislature in the seventy - second year of the Republic of India , as follows :-
1. ( 1 ) This Act may be called Pandit S. N. Shukla University (Amendment) Act , 2021 Short title and commencement .
(2) It shall come in to force from the date of its publication in the Madhya Pradesh Gazette .
Amendment of Section 2.
2. In Section 2 of Pandit S. N. Shukla University Act, 2016 ( No. 28 of 2016 ) ( hereinafter referred to as the principal Act ) , after clause (j ) , the following clause shall be inserted , namely :-
"(j - a) . Pro - vice - Chancellor " means Pro - vice - chancellor of the University nominated by the Vice- Chancellor as prescribed in Section 9A of the Act ; " .
3. After Section 9 of the principal Act , the following section shall be inserted , namely:-
Insertion Section 9A . of
Pro vice- Chancellor.
"9A. The Vice- Chancellor may nominate one of the Deans as Pro- Vice- Chancellor who shall hold office during the pleasure of the Vice- Chancellor and shall perform such function as may be assigned to him by the Vice - Chancellor. " .
4. For Section 10 of the principal Act , the following section shall be substituted , namely:-
Substitution of Section 10 .
Officers of the University.
"10. The officers of the University shall include Pro- Vice- Chancellor , Dean of Faculties . Dean Students Welfare , Registrar, Finance Comptroller and such other officers as may be declared by the Statutes to be the officers of the University. " .
Repeal and saving.
5. ( 1) Pandit S. N. Shukla University (Amendment ) Ordinance , 2021 (No. 6 of 2021 ) is hereby repealed .
(2) Notwithstanding the repeal of the said Ordinance , anything done or any action taken under the said Ordinance shall be deemed to have been done or taken under the corresponding provisions of this Act .
STATEMENT OF OBJECTS AND REASONS
There are 14 State Universities functioning under the Department of Higher Education , Out of 14 Universities there is a provision for rector in 08 State Universities under the provision of the Madhya Pradesh Vishwavidyalaya Adhiniyam , 1973 (No. 22 of 1973 ) and provision for Pro - Vice- Chancellor is in 03 State Universities viz Mahatma Gandhi Chitrakoot Gramodaya Vishwavidyala , Chitrakoot , Maharshi Panini Sanskrit and Vedic Vishwavidyalaya , Ujjain and Atal Bihari Vajpayee Hindi Vishwavidyalaya , Bhopal under the provision of their repsective Acts . There is neither a provision for the post of Rector nor for the post of Pro - Vice - Chancellor in the Acts of Madhya Pradeh Bhoj ( Open ) University , Bhopal , Pandit S. N. Shukla University, Shahdol and Dr. B. R. Ambedkar University of Social Sciences , Mhow.
2.All State Universities are ensuring their qualitative education by strengthening its academic and administrative controls . Pro- vice- Chancellor post shall be more effective to ensure the essential academic and administrative controls over these Universities .
3. In line with University Grants Commission , Regulation , dated 18th July, 2018 , provision for the post of Pro -Vice- Chancellor has been proposed in the three State Universities of Madhya Pradesh Bhoj ( Open ) University, Bhopal ; Pandit S. N. Shukla University , Shahdol and Dr. B. R. Ambedkar University of Social Sciences , Mhow. Therefore , it is proposed to amend Pandit S. N. Shukla University Act , 2016 (No. 28 of 2016) .

218 ( 1) 4. As the matter was urgent and the legislative Assembly was not in session, Pandit S. N. Shukla University ( Amendment ) Ordinance , 2021 (No. 6 of 2021 ) was promulgated for the purpose . It is now proposed to replace the said ordinance by an Act of the State Legislature without any modification.
5. Hence this Bill .
