DR . B. R. AMBEDKAR UNIVERSITY OF SOCIAL SCIENCES ( AMENDMENT ) BILL , 2021 ABill further to amend Dr. B. R. Ambedkar University of Social Sciences Act, 2015.
Be it enacted by the Madhya Pradesh Legislature in the seventy - second year of the Republic of India as follows :-
Short title and commencement .
1. (1 ) This Act may be called Dr. B. R. Ambedkar University of Social Sciences (Amendment ) Act, 2021 .
(2) It shall come in to force from the date of its publication in the Madhya Pradesh Gazette .
Amendment of Section 2.
2. In Section 2 of Dr. B. R. Ambedkar University of Social Sciences Act , 2015 (No. 2 of 2016) (hereinafter referred to as the principal Act) , after clause ( k) , the following clause shall be inserted , namely :-
"( k- a) Pro - Vice - Chancellor " means Pro- Vice- Chancellor of the University nominated by the Vice- Chancellor as prescribed in Section 9A of the Act ; " .
3.After Section 9 of the principal Act , the following section shall be inserted, namely :-
Insertion of Section 9A .
Pro-Vice- Chancellor
"9A . The Vice- Chancellor may nominate one of the Deans as Pro - Vice- Chancellor who shall hold office during the pleasure of the Vice- Chancellor and shall perform such function as may be assigned to him by the Vice - Chancellor. " .
Substitution of Section 10.
4. For Section 10 of the principal Act , the following section shall be substituted , namely:-
Officers of the University.
" 10. The officers of the University shall include Pro - Vice- Chancellor , Director , Dean of School , Dean Students Welfare , Registrar, Finance Comptroller and such other officers as may be declared by the Statutes to be the officers of the University. " .
Repeal and saving.
5. ( 1 ) Dr. B. R. Ambedkar University of Social Sciences (Amendment ) Ordinance , 2021 (No.7 of 2021 ) is hereby replealed .
(2) Notwithstanding the repeal of the said Ordinance , anything done or any action taken under the said Ordinance shall be deemed to have been done or taken under the corresponding provisions of this Act .
STATEMENT OF OBJECTS AND REASONS
There are 14 State Universities functioning under the Deparment of Higher Education . Out of the 14 Universities , there is a provision for Rector in 08 State Universities under the provision of the Madhya Pradesh Vishwvidyalaya Adhiniyam , 1973 ( No. 22 of 1973 ) and provision for Pro- Vice- Chancellor in 03 State Universities viz Mahatma Gandhi Chitrakoot Gramodaya Vishwvidyalaya , Chitrakoot , Maharshi Panini Sanskrit and Vedic Vishwvidyalaya, Ujjain and Atal Bihari Vajpayee Hindi Vishwvidyalaya , Bhopal under the provision of their respecitve Acts . There in neither a provision for the post of Rector nor for the post of Pro - Vice- Chancellor in the Acts of Madhya Pradesh Bhoj ( Open ) University, Bhopal ; Pandit S. N. Shukla . University, Shahdol and Dr. B. R. Ambedkar University of Social Sciences , Mhow.
2. All State Universities are ensuring their qualitative education by strengthening its academic and administrative controls . Pro- Vice- Chancellor post shall be more effective to ensure the essential academic and administration controls over these Universities .

3. In line with University Grants Commission , Regulation , dated 18th July, 2018 , provision for the post of Pro -Vice- Chancellor has been proposed in the three State Universities of Madhya Pradesh Bhoj ( Open) University, Bhopal , Pandit S. N. Shukla University , Shahdol and Dr. B. R. Ambedkar University of Social Sciences , Mhow . Therefore, it is proposed to amend Dr. B. R. Ambedkar University of Social Sciences Act , 2015 (No. 2 of 2016) .
4. As the matter was urgent and the legislative Assembly was not in session , Dr. B. R. Ambedkar University of Social Sciences (Amendment ) Ordinance , 2021 (No. 7 of 2021 ) was promulgated for the purpose . It is now proposed to replace the said ordinance by an Act of the State Legislature without any modification .
5. Hence this Bill.
