THE MADHYA PRADESH BHOJ ( OPEN) UNIVERSITY AMENDMENT BILL , 2021 A Bill further to amend the Madhya Pradesh Bhoj ( Open ) University Adhiniyam , 1991 .
Be it enacted by the Madhya Pradesh Legislature in the seventy - second year of the Republic of India as follows :-
Short title and commencement .
1. ( 1 ) This Act may be called the Madhya Pradesh Bhoj ( Open ) University Amendment Act, 2021 .
(2) It shall come in to force from the date of its publication in the Madhya Pradesh Gazette .
Amendment of section 2.
2. In Section 2 of the Madhya Pradesh Bhoj (Open ) University Adhiniyam , 1991 (No. 20 of 1991 ) ( hereinafter referred to as the principal Act) , after clause (j ) , the following clause shall be inserted , namely :-
"(j - a) Pro - Vice - Chancellor " means Pro- Vice -Chancellor of the University nominated by the Vice- Chancellor as prescribed in section 9A of the Act ; " .
3. for section 7 of the principal Act, the following section shall be substituted , namely :-
Substitution of Section 7 .
"7. The following shall be the officers of the University, namely :-
Officers of the University .
(1) The Kuladhipati
(2) The Kulpati
(3) The Pro-Vice- Chancellor
(4) The Directors
(5) The Registrars
(6) The Finance Officers and
(7) Such other officers as may be declared by the Statutes to be the officers of the University. " .
4. After section 9 of the principal Act , the following section shall be inserted, namely :-
Insertion of section 9A .
Pro-Vice- Chancellor.
"9A. The Kulpati may nominate one of the Professors as Pro - Vice- Chancellor who shall hold office during the pleasure of the Kulpati and shall perform such function asmay be assigned to him by the Kulpati . " .
Repeal and saving.
5. ( 1 ) The Madhya Pradesh Bhoj (Open ) University Amendment Ordinance, 2021 (No. 8 of 2021 ) is hereby replealed .
(2) Notwithstanding the repeal of the said Ordinance , anything done or any action taken under the said Ordinance shall be deemed to have been done or taken under the corresponding provisions of this Act .

STATEMENT OF OBJECTS AND REASONS
There are 14 State Universities functioning under the Department of Higher Education . Out of the 14 Universities , there is a provision for Rector in 08 State Universities under the provision of the Madhya Pradesh Vishwavidyalaya Adhiniyam , 1973 (No. 22 of 1973) and provision for Pro - Vice -Chancellor is in 03 State Universities viz Mahatma Gandhi Chitrakoot Gramodaya Vishwavidyalaya, Chitrakoot , Maharashi Panini Sanskrit and Vedic Vishwavidyalaya, Ujjain and Atal Bihari Vajpayee Hindi Vishwavidyalaya , Bhopal under the provision of their respecitve Acts . There in neither a provision for the post of Rector nor for the post of Pro - Vice- Chancellor in the Acts of Madhya Pradesh Bhoj (Open ) University , Bhopal ; Pandit S. N. Shukla University , Shahdol and Dr. B. R. Ambedkar University of Social Sciences , Mhow.
2. All State Universities are ensuring their qualitative education by strengthening its academic and administrative controls . Pro -Vice-Chancellor post shall be more effective to ensure the essential academic and administration controls over these Universities .
3. In line with University Grants Commission , Regulation, dated 18th July, 2018 , provision for the post of Pro -Vice-Chancellor has been proposed in the three State Universities of Madhya Pradesh Bhoj ( Open ) University , Bhopal , Pandit S. N. Shukla University , Shahdol and Dr. B. R. Ambedkar University of Social Sciences , Mhow . Therefore, it is proposed to amend Madhya Pradesh Bhoj ( open ) University Adhiniyam , 1991 ( No. 20 of 1991 ) .
4. As the matter was urgent and the legislative Assembly was not in session the Madhya Pradesh Bhoj ( Open ) University Amendment Ordinance , 2021 ( No. 8 of 2021 ) was promulgated for the purpose . It is now proposed to replace the said ordinance by an Act of the State Legislature without any modification.
5. Hence this Bill .
