क्र. एफ 3-1-2021- पैंतीस.- भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, मध्यप्रदेश के राज्यपाल , एतद्वारा , मध्यप्रदेश राज्य पशु चिकित्सा परिषद नियम 1993 में निम्नलिखित संशोधन करते हैं , अर्थात्:-
संशोधन
उक्त नियमों में , नियम 3 में, -
1. उप नियम ( 8 ) में , खण्ड ( क) में उप खण्ड ( एक) के स्थान पर निम्नलिखित उप- खण्ड स्थापित किए जाए अर्थात्ः-
" (एक) अभ्यर्थी के नामनिर्देशन के लिए ऑनलाईन प्रक्रिया अपनाई जाएगी' । नामनिर्देशन करने के लिए तारीख , उक्त अधिसूचना के प्रकाशन की तारीख के पश्चात सातवें दिन की होगी या यदि वह दिन सार्वजनिक अवकाश का दिन है, तो ठीक उत्तरवर्ती दिन, जो कि सार्वजनिक अवकाश न हो। "
2. उप नियम (9) में , खण्ड(क) के स्थान पर निम्न लिखित खण्ड स्थापित किए जाए अर्थातः- (क) नियम 3 (8) के खण्ड(क) के उप- खण्ड ( एक) के अधीन नियत तारीख को या उसके पूर्व प्रत्येक अभ्यार्थी रिटर्निग आफीसर को प्रारूप तीन में नामनिर्देशन ऑनलाईन प्रेषित करेगा। "
3. उप नियम ( 12 ) में, खण्ड ( क) के स्थान पर , निम्नलिखित खण्ड स्थापित किए जाए , अर्थातः

" (क) कोई अभ्यर्थी , नियम 3 (8 ) के खण्ड (क) के उपखण्ड ( तीन ) के अधीन नियत तारीख के पूर्व रिटर्निग आफीसर को सूचना द्वारा ऑनलाईन अपनी अभ्यर्थिता वापस ले सकेगा ।"

" ( 14)' मतदान-
उप नियम ( 14) के स्थान पर निम्नलिखित उप-नियम स्थापित किया जाए अर्थात्ः- (क) यदि निर्वाचन के लिए सम्यक् रूप से नामानिर्दिष्ट अभ्यर्थियों की संख्या निर्वाचित किए जाने वाले सदस्यों की संख्या से अधिक नहीं है , तो रिटर्निंग आफिसर तत्काल ऐसे अभ्यर्थियों को सम्यक् रूप से निर्वाचित घोषित करेंगा । (ख) यदि ऐसे अभ्यर्थियों की संख्या निर्वाचित किये जाने वाले सदस्यों की संख्या से अधिक है , तो रिटर्निंग आफिसर ऑनलाईन मतदान के माध्यम से सदस्यों के निर्वाचन के लिये सात दिनों से अनाधिक की कोई तारीख नियत करेंगा । (ग) ऑनलाईन मतदान के लिये पात्र मतदाता को निम्नलिखित प्रक्रिया का अनुसरण करना होगा , अर्थात्ः-
(एक) वह राज्य पशु चिकित्सा व्यवसायी रजिस्टर में अपने रजिस्ट्रीकृत नम्बर के साथ लॉगिन कर सकेगा;
(दो) लॉगिन के पश्चात्, उसे राज्य पशु चिकित्सा परिषद के साथ रजिस्ट्रीकृत अपने मोबाईल नंबर पर वन टाईम पासवर्ड ( ओटीपी) प्राप्त होगा;
(तीन) ऐसे वन टाईम पासवर्ड (ओटीपी) प्रविष्ट करने पर मतदाता, चुनाव लड़ने वाले अभ्यर्थियों की सूची देख सकेगा और तब वह उतने अभ्यर्थियों के लिये टिक ( V ) लगाकर मत दे सकेगा, जितने कि निर्वाचन द्वारा भरे जाने वाले स्थान है ;
(चार ) मतदान करने के पश्चात् मतदाता को एक अभिस्वीकृति प्राप्त होगी कि उसने मतदान की प्रक्रिया सफलतापूर्वक पूर्ण कर ली है;
(पांच ) मतदान के पश्चात् मतदाता स्वतः लॉगआऊट को जायेगा और पुनः मतदान संभव नहीं होगा।
( घ) मतदाता को निर्वाचत किए जाने वाले पद की संख्या के लिये आनलाईन मत देने का अधिकार होगा और मत अहस्तांतरणीय होगा । "
5. उप-नियम( 15) और उप- नियम ( 16 ) का लोप किया जाए । 270(1 )

6. उप नियम ( 17 ) के स्थान पर निम्नलिखित उप- नियम स्थापित किया जाए , अर्थातः- " ( 17 ) ( क) रिटर्निंग ऑफीसर ई. गणना द्वारा, इस प्रयोजन के लिये उसके द्वारा नियत तारीख और समय , पर पासवर्ड दर्ज करेगा और प्रत्येक चुनाव लड़ने वाले अभ्यर्थियों द्वारा प्राप्त मतों की संख्या प्राप्त करेगा ।
(ख ) कोई अभ्यर्थी अथवा उसके द्वारा लिखित में सम्यक् रूप से प्राधिकृत उसका प्रतिनिधि मतगणना की प्रक्रिया को देखने के लिये व्यक्तिगत रूप से उपस्थित रह सकेगा ।
(ग) रिटर्निंग आफिसर , ऐसे निर्देशों के अनुसार , जैसे कि राज्य सरकार द्वारा इस निर्मित किए जाएं, ऐसी संख्या में कंप्यूटर प्रोग्रामर नामनिर्देशित कर सकेगा , जैसा वह उचित समझें ।
उप नियम ( 18 ) के स्थान पर, निम्न लिखित उप-नियम स्थापित किए जाए अर्थातः-
" ( 18) परिणामों की घोषणाः-
(क) रिटर्निंग आफिसर डाले गए अधिकतम मतों के घटते क्रम में अभ्यर्थियो की एक सूचनी बनाएगा और भरे जाने वाले स्थानों की संख्या के अनुसार उस क्रम में अभ्यर्थियों को निर्वाचित घोषित करेगा ।
(ख) यदि इस प्रकार निर्वाचित घोषित किया गया कोई अभ्यर्थी निर्वाचन स्वीकार करने से रिटर्निग आफिसर को लिखित रूप से इंकार कर देता है तो उस अभ्यर्थी के स्थान पर घोषणा के दस मिनिट पश्चात् शेष अभ्यर्थियों में से उस अभ्यर्थी को , जिसे दूसरी बडी संख्या में मत पड़े हैं, निर्वाचित हुआ समझा जाएगा और जितनी बार इस प्रकार की रिक्ती हो, यही प्रक्रिया अपनाई जाएगी।
(ग) जब किन्ही दो या अधिक अभ्यर्थियों के बीच किसी पद के लिये मतों की समानता हो, तो अभ्यर्थी , जिन्हें निर्वाचित किया गया समझा जायेगा, रिटर्निंग आफिसर द्वारा ऐसी रीति में जैसे कि वह विनिश्चित करे , निकाले जाने वाले लाट द्वारा निर्धारित किया जाएगा।
(घ) रिटर्निंग आफिसर जेसे ही परिणाम की घोषणा की जाए , प्रत्येक सफल अभ्यर्थी को , उसके राज्य परिषद् के लिए निर्वाचित होने की सूचना देगा। " मध्यप्रदेश राजपत्र, दिनांक 9 मार्च 2021

8. उप नियम ( 19) के स्थान पर , निम्नलिखित उप- नियम स्थापित किए जाए , अर्थातः- "(19 ) निर्वाचन दस्तवेजों का धारण परिणामों की घोषणा के पश्चात्, रिटर्निंग आफिसर निर्वाचन से संबंधित सभी दस्तावेजों को, जिसमें सभी प्रकार की निर्वाचन सूचनाएं दर्ज किए हुए साफ्टवेयर सम्मिलित है, 6 माह की अवधि के लिए संरक्षित रखेगा और उपरोक्त अवधि के पश्चात् राज्य सरकार की पूर्व सहमति के बिना नष्ट नहीं करेगा। "

No. F - 3-1-2021 - XXXV. In exercise of the powers conferred by Section 309 of the Indian constitution , the Governor of Madhya Pradesh , hereby, makes the following further amendments in the Madhya Pradesh State Veteri- nary Council Rules , 1993 , namely :-
:: AMENDMENT ::
In the said rules , in rule 3 ,
1. in sub - rule (8) , in clause ( a) , for sub- clause ( i) , the following sub - clause shall be substituted namely : -
" (i ) online procedure will be adopted for nomination of candidate. The date for making nominations shall be the 7th day after the date of publication of the said notification or if that day is a public holiday , the next succeeding day which is not a public holiday . " .
2. in sub - rule ( 9) , for clause ( a) , the following clause shall be substituted , namely : -
" (a) On or before the date appointed under sub - clause ( i ) of clause ( a ) of rule 3 (8 ) , each candidate shall send online nomination to the Returning Officer , in Form III . " .
3. in sub - rule ( 12 ) , for clause ( a) , the following clause shall be substituted , namely : -
" ( a) Any candidate may withdraw his candidature online by notice to the Returning Officer before the date fixed under sub - clause ( III ) of clause ( a) of rule 3 ( 8 ) . " .

270( 3) 4. for sub - rule ( 14) , the following sub - rule shall be substituted , namely : -
"(14) The Poll
(a) If the number of duly nominated candidates for election does not exceed the number of members to be elected , the Returning Officer shall forthwith declare such candidates duly elected.
(b) If the number of such candidates exceeds the number of members to be elected , the Returning Officer shall fix a date of not exceeding seven days for election of members through online voting .
(c) For online voting, the eligible voter has to follw the following procedure , namely: -
(1) He may login with his registered number in the state veterinary practitioners register ;
( II) after login , he shall receive one time password ( OTP ) on his mobile number registered veterinary council ; with the state (III) on entering such one time password ( OTP ) , the voter shall be able to see a list of contesting candidates and then he may vote by ticking ( ✓ ) as many candidates as there are seats to be filled by the election ;
( IV) after voting , voter shall get an acknowledgment that he has completed the voting process successfully ;
(V) after voting , voter shall be automatically logged out and re - voting is not possible .
(d ) Voter has right to online voting for the number of post to be elected and vote will be non transferable . " .

5. sub - rule ( 15) and sub - rule ( 16 ) shall be omitted .
6. for sub - rule ( 17) , the following sub - rule shall be substituted , namely : -
" ( 17) ( a ) The Returning Officer shall , by.e- counting on the date and time fixed by him for this purpose , enter the password and get the number of votes received by each contesting candidates .
(b) Any candidate or his representative duly authorized in writing by him may remain present in person to watch the process of counting .
(c) The Returning Officer shall nominate such number of computer programmer as he deems fit in accordance with such directions as may be issued in this behalf by the State Governament . " .
7. for sub - rule ( 18 ) , the following sub - rule shall be substituted , namely: -
" ( 18 ) Declaration of result : -
(a) The Returnig Officer shall draw up a list of candidates in decreasing order of highest votes polled and declare the candidates elected , in that order according to the number of seats to be filled up.
(b) If any candidate thus declared elected refuses in writing to Returning Officer to accept the election , after 10 minutes of declaration then in the place of that candidate one of the remaining candidates to whom the next largest number of votes have been cast shall be deemed to have been elected , and the same procedure shall be adopted by as after as a vacancy is caused in this way .
(c) When there is equality of Votes to any post among any two or more candidates , the candidates who shall be deemed to have been elected shall be determined by lots to be drawn by the Returning Officer in such manner as he may decide .

(d) The Returning Officer shall , as soon as the result is declared , inform each successful candidate of his being elected to the state Council . " .
8 for sub - rule ( 19 ) , the following sub - rule shall be substituted , namely : -
"(19 ) Retaining of Election Documents. After declaration of results , the Returning Officer shall preserve all the documents relating to election including software entered with all types of election information for a period of 6 months and shall not destroy , after above said period , without the previous concurrence of the State Government . " .
