अधि.क्र . 05 एफ 1-02 / 2021 /18-3- मध्यप्रदेश नगर पालिक निगम अधिनियम 1956 (क्र . 23 सन् 1956 ) की धारा 427 की उपधारा ( 24 ) ( घ ) के साथ गठित धारा 430 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार , ने पुष्टि नगर पालिक निगम इंदौर के लिए प्लास्टिक अपशिष्ट प्रबंधन उपविधि-2021 प्रकाशित की जा रही है ।

यह उपविधियां , भारत सरकार , मध्यप्रदेश शासन , केन्द्रीय प्रदूषण नियंत्रण बोर्ड , मध्यप्रदेश प्रदूषण नियंत्रण बोर्ड , तथा अन्य संबंधित वैधानिक संस्था द्वारा प्लास्टिक संबंधी गतिविधियों हेतु बनाए जाने वाले नियम, अधिनियम , कानून व उनके समय - समय पर किए जाने वाले संशोधन द्वारा शासित रहेगी ।
1. संक्षिप्त नाम , विस्तार तथा प्रारंभ.
(1 ) इन उपविधियों का संक्षिप्त नाम इन्दौर नगर पालिक निगम प्लास्टिक अपशिष्ट प्रबंधन उपविधियां, 2021 है ।
( 2) ये मध्यप्रदेश राजपत्र में प्रकाशन की तरीख से प्रवृत्त होंगी ।
(3 ) ये नगर पालिक निगम इंदौर के सम्पूर्ण क्षेत्र पर लागू होंगी ।
2. परिभाषाएं :
( 1 ) जब तक सन्दर्भ से अन्यथा अपेक्षित न हो ,
(2) इन उपविधियों में तथा संलग्न अनुसूची में जो शब्द व अभिव्यक्तियां प्रयुक्त की गई है परन्तु यथा परिभाषित नही है, उनके वही अर्थ होगें जो कि नगर निगम अधिनियम, 1956 में दिए गए है: -
(क) " अधिनियम" से अभिप्रेत है , पर्यावरण ( संरक्षण ) अधिनियम, 1986 ( क्र . 29 सन् 1986 );
(ख ) " वैकल्पिक उपयोग " से अभिप्रेत है किसी सामग्री का उसके आशयित उपयोग से भिन्न उपयोग जो इस लिए लाभकारी है कि वह संसाधन दक्षता को बढ़ावा देता है । 320 ( 1 )

(ग) "ब्रांड मालिक " से अभिप्रेत है, ऐसा व्यक्ति अथवा कम्पनी जो किसी वस्तु का. एक पंजीकृत ब्रांड लेबल के तहत विक्रय करता है;
(घ) "थोक अपशिष्ट उत्पादक " से अभिप्रेत है, तथा उसमें सम्मिलित हैं ऐसे भवन , जो कि, केन्द्र सरकार के विभाग अथवा उपक्रम, राज्य सरकार के विभाग अथवा उपक्रम , स्थानीय निकाय , सार्वजनिक क्षेत्र के उपक्रम अथवा निजी कम्पनी , अस्पताल , नर्सिंग होम्स, विद्यालय, महाविद्यालय , विश्वविद्यालय, अन्य शैक्षणिक संस्थान, होस्टल , होटल, व्यावसायिक प्रतिष्ठान, बाजार, पूजास्थल , स्टेडियम तथा खेल हेतु धारित किए गए है तथा जो औसतन 100 किलोग्राम प्रतिदिन की दर से अपशिष्ट जनरेट करतें है;
(ङ) "उपविधियां" से अभिप्रेत है इंदौर नगर पालिक निगम प्लास्टिक अपशिष्टः प्रबंधन उपविधियां, 2021 ;
(च) (एक) "कैरी बैग्स" से अभिप्रेत है, प्लास्टिक से निर्मित थैली जो वस्तु के रखने एवं वितरण के लिए उपयोग की जाती है, जिसमें स्व - वहन विशेषता होती है , परन्तु उसके अन्तर्गत ऐसे थैले सम्मिलित नहीं है, जो किसी वस्तु की पैकिंग का अभिन्न अंग हैं तथा जिसमें वस्तु उपयोग के पहले सील कर दी जाती है । ये जी.ओ पर्यावरण तथा वन (ईसी. 2 ) विभाग , दिनांक 25/06/2018 द्वारा प्रतिबंधित है,
(दो) "कैरी बैग्स" से अभिप्रेत है कम्पोस्टेबल प्लास्टिक मटेरियल से निर्मित थैली जो वस्तु के रखने एवं वितरण के लिए उपयोग की जाती है , जिसमें स्व- वहन विशेषता होती है. पख्तु उसके अन्तर्गत वे बैग्स सम्मिलित नहीं है , जो किसी वस्तु की पैकिंग का अभिन्न अंग हैं तथा जिसमें वस्तु उपयोग के पहले सील कर दी जाती है, जो कि केन्द्रीय प्रदूषण नियंत्रण बोर्ड द्वारा विधिवत अनुमोदित है ।
(छ) "वस्तु" से अभिप्रेत है, कोई वास्तविक / मूर्त सामग्री जो खरीदी या बेची जाती है तथा इसके अन्तर्गत सभी विक्रय योग्य सामग्री एवं माल अभिप्रेत है;
(ज) "कम्पोस्टेबल प्लास्टिक" से अभिप्रेत है, पारंपरिक पेट्रो- आधारित प्लास्टिक को छोडकर ऐसे प्लारिटक जो अन्य ज्ञात कम्पोस्टेबल सामग्री के अनुरूप लगातार दर पर कार्बन डाई ऑक्साइड, पानी , अकार्बनिक यौगिको तथा बायोमास के उत्पादन के लिए जैविक प्रक्रियाओं द्वारा गिरावट से गुजरता है तथा दृश्यमान , विशिष्ट या विषाक्त अवशेष नही छोड़ता हैं;

(झ) "सहमति" से अभिप्रेत है, ऐसी सहमति जो स्थापित करने व संचालन हेतु जल (प्रदूषण निवारण एवं नियंत्रण ) अधिनियम, 1974 (1974 का 6) तथा वायु (प्रदूषण निवारण एवं नियंत्रण) अधिनियम, 1981 (1981 , का 14 ) के अन्तर्गत मध्यप्रदेश प्रदूषण नियंत्रण बोर्ड द्वारा प्रदान की गई है;
(ञ) "विघटन" से अभिप्रेत है , किसी पदार्थ के अनेक छोटे- छोटे टुकडो में टूट जाना;
(ट) "ऊर्जा पुनःप्राप्ति" से अभिप्रेत है , अपशिष्ट से प्राप्त ऐसी ऊर्जा जो विभिन्न प्रक्रियाओं जैसे ज्वलन, गैसीकरण , पायरोलाइजेशन, अवायवीय पाचन तथा लैंडफील गैस रिकवरी के माध्यम से अपशिष्टः पदार्थ के उपयोगी ऊष्मा , विद्युत व ईंधन के रूप में परिवर्तन के समय प्राप्त होती है;
(ठ) "आयोजन" से अभिप्रेत है, सार्वजनिक स्थान पर समारोह, उत्सव, सम्मेलन, बैठक, रैलियाँ, जुलूस, ओपन एयर थियेटर, सिनेमा, 'शूटिंग, के द्वारा होने वाला एकत्रीकरण;
(ड) "विस्तारित निर्माता का दायित्व" से अभिप्रेत है , किसी निर्माता का पर्यावरण की दृष्टि से किसी उत्पाद के अंत तक विस्तारित समुचित प्रबंधन का दायित्व;
(ढ) "खाद्य- सामग्री" से अभिप्रेत है, खाने के लिए तैयार फास्टफूड, प्रोसेस्ड तथा पकाया हुआ खाद्य, तरल , ठोस, पावडर अथवा अर्द्धठोस अवस्था का खाद्य;
(ण) "सुविधा" से अभिप्रेत है, ऐसा परिसर, जिसका उपयोग प्लास्टिक अपशिष्ट के एकत्रीकरण, भण्डारण, रिसाइकलिंग , प्रोसेसिंग तथा निपटान के लिए किया जाता है;
(त) " आयातक" से अभिप्रेत है , ऐसा व्यक्ति जो आयात करता है अथवा जिसका आशय आयात करने का है तथा जो आयातक- निर्यातक कोड नम्बर धारण करता है, जब तक कि उसके द्वारा अन्यथा विशिष्ट छूट प्राप्त न कर ली गई हो;

(थ) "संस्थागत अपशिष्ट जनरेटर" से अभिप्रेत है , तथा उसमें सम्मिलित है किसी संस्थागत भवन का ऐसा अभिधारी जो केन्द्र सरकार के विभाग , राज्य सरकार के विभाग, निजी अथवा सार्वजनिक क्षेत्र की कम्पनी, अस्पताल, विद्यालय, महाविद्यालय, विश्वविद्यालय या अन्य शैक्षणिक संस्थान , संगठन, अकादमी , होटल, रेस्टोरेंट, मॉल , शॉपिंग काम्पलेक्स हेतु भवन धारित करता हो;
(थ) "स्थानीय निकाय " से अभिप्रेत है, इन उपविधियों के उद्देश्य हेतु इन्दौर नगर निगम;
(द) "उत्पादक" से अभिप्रेत है, तथा उसमें अन्तर्गत सम्मिलित है कोई ईकाई या एजेंसी जो निर्माता द्वारा उपयोग किएजाने हेतु प्लास्टिक के कच्चे माल के उत्पादन के कार्य में संलग्न है;
(घ) "बहुस्तरीय पैकेजिंग " से अभिप्रेत है, कोई ऐसी सामग्री, जिसका उपयोग पैकेजिंग के लिए किया जाता है अथवा किया जाना है तथा जिसमें मुख्य सामग्री रूप में प्लास्टिक की कम से कम एक परत कागज, पेपर बोर्ड, बहुलक सामग्री, धातु परत या एल्युमिनियम पन्नी, के संयोजन के साथ (लेमिनेशन अथवा बाहरी आवरण के रूप में) हो;
(न) "न्यूसेंस डिटेक्टर्स" से अभिप्रेत है , इन्दौर नगर निगम के ऐसे कर्मचारी जिन्हें आयुक्त द्वारा प्लास्टिक अपशिष्ट प्रबंधन के संबंध में न्यूसेंस अर्थात बाधाकारक गतिविधियों का पता लगाने के लिएनियुक्त किया गया है;
(प) "प्लास्टिक" से अभिप्रेत है, ऐसा पदार्थ जिसमें आवश्यक घटक के रूप में उच्च बहुलक, जैसे पॉलीएथिलीन टेरेफ्थेलेट, उच्च घनत्व पॉलीएथिलीन , विनायल , निम्न घनत्व पॉलीएथिलीन , पॉलीप्रोपिलिन. पॉलीस्टाइरिन रेजीन, बहु सामग्री जैसे एक्रीलोनीट्राईल बुटाडिन, स्टाइरिन , पॉलीफिनाइलीन ऑक्साइड , पॉलीकार्बोनेट, पॉलीबुटालीन टेरेफ्थेलेट इत्यादि, मध्यप्रदेश राजपत्र , दिनांक 22 मार्च 2021

(फ) "प्लास्टिक शीट" से अभिप्रेत है, प्लास्टिक से निर्मित शीट , जो जी. ओ (एमएस) क्रमांक 84 पर्यावरण तथा वन (ईसी .2) विभाग , दिनांक 25/06/2018 के अनुसार प्रतिबंधित है;
(ब) "प्लास्टिक अपशिष्ट" से अभिप्रेत है, ऐसा प्लास्टिक जो छोड़ दिया गया हो अथवा उसके आशयित उपयोग की समाप्ति के पश्चात् छोड़ दिया गया हो;
(भ) "विहित प्राधिकारी " से अभिप्रेत है, प्लास्टिक अपशिष्ट प्रबंधन तथा संचालन नियम 2016 के खंड 12 के अन्तर्गत निर्दिष्ट प्राधिकारी तथा आयुक्त, इन्दौर नगर पालिक निगम;
:
(म) "निर्माता" से अभिप्रेत है , अर्थात वे व्यक्ति जो कैरी बैग्स अथवा बहुस्तरीय पैकेजिंग अथवा प्लास्टिक शीट या अन्य समान उत्पाद के निर्माण या आयात के कार्य में संलग्न हैं तथा इसमें सम्मिलित हैं कोई उद्योग या व्यक्ति जो प्लास्टिक शीटों या उस जैसे या प्लास्टिक शीट से बने आवरण या बहुस्तरीय पैकेजिंग का उपयोग किसी वस्तु की पैकेजिंग या उसके आवरण चढाने के कार्य में करते है;
(य) "रिसाइक्लिंग " से अभिप्रेत है, वह प्रक्रिया जिसके द्वारा छोड़े गए प्लास्टिक अपशिष्ट को नये उत्पाद में अथवा नया उत्पाद बनाने के लिएकच्चे माल में परिवर्तित किया जाता है;
(यक) 'पंजीयन" से अभिप्रेत है, मध्यप्रदेश प्रदूषण नियंत्रण बोर्ड अथवां इन्दौर नगर निगम अथवा संबंधित वैधानिक प्राधिकारी के समक्ष पंजीयन;
(यख) "पथ-विक्रेता" का वही अर्थ है , जैसा कि पथ- विक्रेता (जीविका सुरक्षा एवं पथ विक्रय विनियमन) अधिनियम, 2014 (क्र . 7 सन् 2014 ) की धारा 2 की उप धारा (1 ) के खण्ड (ठ) में दिया गया है,
(यग) "प्लास्टिक का उपयोग करना व फेंक देना" यह परिभाषा जी. ओ. क्रमांक 84 पर्यावरण तथा वन (ईसी .2 ) विभाग से ली गई है, जिसका अर्थ है सामग्री जैसे- प्लास्टिक कैरी बैग्स तथा 320 ( 5 )

प्लास्टिक के झंडे, खाद्य को लपेटने, डाइनिंग टेबल पर बिछाने, इत्यादि हेतु प्लास्टिक शीटों, प्लास्टिक प्लेटों, प्लास्टिक के आवरण वाले चाय के मग तथा प्लास्टिक के गिलास , पानी के पाउच तथा पैकेट्स, कितनी भी मोटाई की प्लास्टिक की स्ट्रॉ, जैसे कि जी.ओ. क्रमांक 84 पर्यावरण तथा वन (ईसी.2 ) विभाग , दिनांक 25.06.2018 में परिभाषित है, सभी प्रतिबंधित है जो निम्नानुसार है:-
(एक) खाद्य को लपेटने , डाइनिंग टेबल पर बिछाने, इत्यादि हेतु प्लास्टिक शीटें..
1. खाद्य पदार्थ को लपेटने हेतु प्लास्टिक शीट/चिपटने वाली फिल्म
2. डाइनिंग टेबल पर बिछने हेतु प्लास्टिक / प्लास्टिक कोटेड शीट
(दो) प्लास्टिक प्लेटें,
1. प्लास्टिक व थर्मोकोल प्लेटें
2. प्लास्टिक कोटेड पेपर प्लेटें
(तीन) प्लास्टिक कोटेड चाय के कप तथा प्लास्टिक के गिलास,
1. प्लास्टिक कोटेड पेपर कप
2. प्लास्टिक के चाय के कप
3. प्लारिटक गिलारा
4. थर्मोकोल कप
(चार) पानी के पाउच तथा पैकेट्स
(पांच) प्लास्टिक स्ट्रॉ
(छः) प्लास्टिक कैरी बैग्स तथा प्लास्टिक के झंडे
1. सभी आकार व मोटाई के प्लास्टिक कैरी बैग्स
2.प्लास्टिक कोटेड कैरी बैग्स
3. बगैर बुने हुए पॉलीप्रोपिलीन कैरी बैग्स

(यघ) "वर्जिन प्लास्टिक" से अभिप्रेत है, ऐसी प्लास्टिक सामग्री जो पहले कभी न तो उपयोग की गई है एवं न ही कभी स्क्रेप अथवा अपशिष्ट के साथ मिश्रित की गई है;
(यड़) "अपशिष्ट उत्पादक" रो अभिप्रेत है उसमें सम्मिलित हैं प्रत्येक व्यक्ति या व्यक्तियों का समूह अथवा संस्थान , आवासीय तथा व्यावसायिक स्थापना, जिसके अन्तर्गत भारतीय रेल, हवाई अड्डे, बंदरगाह तथा रक्षा स्थापनाएं भी है, पूजा स्थल , जो प्लास्टिक अपशिष्ट उत्पन्न करते है;
(यच) "अपशिष्ट प्रबंधन" से अभिप्रेत है पर्यावरण सुरक्षित तरीके से प्लास्टिक अपशिष्ट का एकत्रीकरण , भण्डारण , परिवहन, न्यूनकरण , पुनःप्रयोग , रिकवरी, रिसाइक्लिंग अथवा निपटान;
(यछ) "अपशिष्ट बीनने वाला " से अभिप्रेत है, व्यक्ति या एजेंसी, व्यक्तियों का समूह जो स्वेच्छया संलग्न है अथवा पुनर्चक्रण योग्य प्लास्टिक अपशिष्ट बीनने के लिए अधिकृत है;
3. शर्ते :-
(1 ) प्लास्टिक का उत्पादन, आयात, संग्रहण, वितरण, विक्रय व उपयोग निम्नलिखित शर्तों के अधीन किया जाएगा, अर्थात्: -
(क) प्लास्टिक पैकेजिंग या तो प्राकृतिक रंगों के अनुसार बिना किसी रंगद्रव्य के होगी अथवा केवल उन्ही रंगद्रव्यो एवं रंजको के उपयोग के साथ होगी जो भारतीय मानक आईएस 9833: 1981 शीर्षक "खाद्य सामग्री, दवाईयों तथा पेयजल के सम्पर्क में आने वाले प्लास्टिक में उपयोग किए जाने वाले रंगद्रव्यों एवं रंजको की समय - समय पर संशोधित सूची " कि;
(ख ) पुनर्निर्मित प्लास्टिक के उत्पादों का उपयोग , खाने-पीने के तैयार सामान के भण्डारण , लाने - ले जाने, वितरण तथा पैकेजिंग के लिए नहीं किया जाएगा;

(ग) प्लास्टिक शीट या उसके समान, जो कि बहुस्तरीय पैकेजिंग का अभिन्न अंग नहीं है तथा प्लास्टिक शीट से बने आवरण जो कि वस्तु की पैकेजिंग , रैपिंग के लिए उपयोग की जाती है की मोटाई पचास माइक्रोन से कम नही होनी चाहिए , सिवाय इसके कि इस तरह की प्लास्टिक शीट की मोटाई उत्पाद की कार्यक्षमता को बिगाड़ती है;
(घ) उत्पादनकर्ता ऐसे किसी निर्माता को कच्चे माल के रूप में प्लास्टिक, विक्रय अथवा उपलब्ध नहीं कराएगा, जिराके पास मध्यप्रदेश प्रदूषण नियंत्रण बोर्ड के समक्ष पंजीकरण नहीं है;
(ङ) प्लास्टिक मटेरियल से बने पाउच का उपयोग गुटखा, पान मसाला तथा तम्बाकू के भण्डारण , पैकिंग व विक्रय के लिएनही किया जाएगा;
(च) विनाइल एसिटेट- मेलिक एसिड-विनाइल क्लोराइड कोपोलिमर को सम्मिलित करते हुए किसी भी रूप में प्लास्टिक मटेरियल का उपयोग पान मसाल , गुटखा, तथा तम्बाकू के पैकेजिंग के लिएनही किया जाएगा;
(छ) प्लास्टिक अपशिष्ट की रिसाइक्लिंग भारतीय मानकः आईएस 14534:1998 शीर्षक प्लास्टिक के रिसाइक्लिंग की गाइडलाइन जो कि समय- समय पर संशोधित है, के अनुरूप ही किया जाएगा;
(ज) मोटाई से संबंधित प्रावधान कम्पोस्टेबल प्लास्टिक से बने कैरी बैग्स पर लागू नहीं होंगे । कम्पोस्टेबल प्लास्टिक से बने कैरी बैग्स पर "कम्पोस्टेबल " लेबल लगा होना चाहिए तथा जो कि भारतीय मानकः आईएस 17088: 2008 शीर्षक "कम्पोस्टेबल प्लास्टिक " के विनिर्देश के अनुरूप होगा । कम्पोरटेबल प्लास्टिक से निर्मित कैरी बैग के निर्माता व विक्रेता विपणन व विक्रय के पूर्व जैसा भी लागू हो, केन्द्रीय प्रदूषण नियंत्रण बोर्ड / मध्य प्रदेश प्रदूषण नियंत्रण बोर्ड से प्रमाण- पत्र प्राप्त करेंगे । मध्यप्रदेश राजपत्र , दिनांक 22 मार्च 2021

4. प्लास्टिक अपशिष्ट प्रबंधन. इन्दौर नगर पालिक निगम द्वारा अपने अधिकार क्षेत्र में प्लास्टिक अपशिष्ट प्रबंधन निम्नानुसार किया जाएगाः-
(क) प्लास्टिक अपशिष्ट जिसे रिसाईकिल किया जा सकता है कि रिसाइक्लिंग पंजीकृत प्लास्टिक अपशिष्ट रिसाईकलकर्ता के माध्यम से की जाएगी तथा रिसाईक्लिंग प्रक्रिया भारतीय मानकः आईएस 14533: 1998 शीर्षक प्लास्टिक के रिसाइक्लिंग हेतु गाइडलाइन, समय - समय पर संशोधित के अनुरूप होगी;
(ख) वह प्लास्टिक, जिसे रिसाईयकिल नहीं किया जा सकता, उसे व्युत्पन्न ईंधन प्लांट / सीमेन्ट प्लांट / या किसी अन्य तकनीकी उपयोग हेतु भेज दिया जाएगा । इन तकनीकों के उपयोग के लिए विहित प्राधिकारी द्वारा विनिर्दिष्ट् किएगएमानको तथा प्रदूषण नियंत्रण मापदण्डों का पालन किया जाएगा;
(ग) इन्दौर नगर पालिक निगम द्वारा प्लास्टिक अपशिष्ट (विशेषकर वह प्लास्टिक अपशिष्ट जिसे आगे और रिसाईकल नही किया जा सकता है) को भारतीय सड़क कांग्रेस गाइडलाईन अनुसार सड़क निर्माण हेतु प्रोत्साहित किया जाएगा;
(घ) थर्मोसेट प्लास्टिक का प्रसंस्करण तथा उसका निपटान भारतीय प्रदूषण नियंत्रण बोर्ड द्वारा समय - समय पर जारी की जाने वाली गाइडलाईन के अनुसार किया जायेगा; और
(ङ) प्लास्टिक अपशिष्ट के प्रसंस्करण व रिसाइक्लिंग से उत्पन्न होने वाले निष्क्रिय व अनुपयुक्त पदार्थो का निपटान ठोस अपशिष्ट प्रबंधन नियम, 2016 अथवा समय - समय पर उसमें किएजाने वाले संशोधन के अनुसार किया जायेगा ।
5. इन्दौर नगर पालिक निगम का दायित्व.-
(1) प्लास्टिक अपशिष्ट के पृथक्करण, एकत्रीकरण , भण्डारण , परिवहन , प्रसंस्करण तथा निपटान हेतु बुनियादी ढांव। अपने स्वयं के द्वारा या बाहरी एजेंसी या निर्माता नियुक्त कर स्थापित करना अथवा उसे विकसित करना इन्दौर नगर पालिक निगम का दायित्व होगा । 320 ( 9 )

(2) अपशिष्ट प्रबंधन प्रणाली तथा अन्य संबंधित कार्यो की स्थापना करना, संचालित करना तथा परिचालित करना इन्दौर नगर पालिक निगम का दायित्व होगा, तथा उससे संबंधित कार्य निम्न होंगे-
(क) प्लास्टिक अपशिष्ट का पृथक्करण, एकत्रीकरण, भण्डारण , पारेवहन, प्रसंस्करण तथा निपटान सुनिश्चित करना;
(ख) यह सुनिश्चित करना कि उपरोक्त प्रक्रिया के दौरान पर्यावरण को कोई क्षति न हो;
(ग) रिसाईकल योग्य प्लास्टिक अपशिष्ट को रिसाइक्लिंग हेतु भेजना सुनिश्चित करना;
(घ) रिसाईकल न किए जा सकने वाले प्लास्टिक अपशिष्ट को केन्द्रीय प्रदूषण नियंत्रण बोर्ड द्वारा जारी की गई गाइडलाईन के अनुसार प्रसंस्कृत करना अथवा उसका निपटान सुनिश्चित करना;
समस्त हितधारकों को उनके दायित्व के प्रति जागरूक करना;
(ङ)
(च) अपशिष्ट बीनने के कार्य में संलग्न समूहों व नगर समितियों को नियुक्त करना; तथा
(छ) यह सुनिश्चित करना कि प्लास्टिक अपशिष्ट को खुले स्थानों में जलाने जैसी कोई गतिविधि ना हो ।
(3) प्लास्टिक अपशिष्ट प्रबंधन नियम , 2016 अथवा अन्य प्रासंगिक विधियों एवं उनके संशोधन अनुसार प्लास्टिक अपशिष्ट प्रबंधन प्रणाली स्थापित करने हेतु इन्दौर नगर पालिक निगम निर्माताओं से सहायता प्राप्त करेगा ।
इन्दौर नगर पालिक निगम प्रयास तथा प्रोत्साहित करेगा-

(क) प्लास्टिक अपशिष्ट प्रबंधन नियम, 2016 व इन उपविधियों को लागू करने के लिएप्लास्टिक के उन्मूलन मे संलग्न नगर समितियों व संस्थाओं को संलग्न करेगा ,
(ख) अपशिष्ट प्रसंस्करण व पृथक्करण में संलग्न स्व- सहायता समूहों को तकनीकी मार्गदर्शन के साथ- साथ कार्यान्वयन हेतु उपयुक्त संगठनों के माध्यम से प्रोत्साहित किया जा सकता है । मध्यप्रदेश राजपत्र , दिनांक 22 मार्च 2021

(5) इन्दौर नगर पालिक निगम , योग्य समुदाय आधारित संगठनों (सीबीओ) /गैर- सरकारी संगठनों (एनजीओ) / स्वैच्छिक सेवा संगठनों (वीएसओ)/ स्व- सहायता समूहों (एसएचजी) या अन्य वैधानिक संगठनों की संभावित सहायता के साथ, अपने वार्डों के भीतर खुले क्षेत्रों में गंदी बस्तियों को गोद लेने के कार्यक्रम का विस्तार करेगा ।
(6) इन्दौर नगर पालिक निगम द्वारा जनप्रतिनिधियों, नागरिक संगठनों, शासकीय निकायों, कार्पोरेट्स, गैर - सरकारी संगठनों के सहयोग से गंदी बस्तियों के भीतर समय- समय पर स्वच्छता हेतु योग्य समुदाय आधारित संगठनों (सीबीओ) के सहयोग से स्वच्छता अभियान संचालित करेगा ।
6. अपशिष्ट उत्पादक का दायित्व.-
प्रत्येक अपशिष्ट उत्पादक -
(1)
(
क) जी.ओ.क्रमांक 84 पर्यावरण तथा वन (ईसी. 2 ) विभाग के अधीन प्रतिबंधित प्लास्टिक का उपयोग नहीं करेगा;
(
ख) ठोस अपशिष्ट प्रबंधन नियम, 2016 के अनुसरण में तथा प्लास्टिक अपशिष्ट प्रबंधन नियम , 2016 के अनुसरण में तथा इन नियमों में समय - समय पर होने वाले संशोधनों के अनुसरण में प्लास्टिक अपशिष्ट का उत्सर्जन कम करने तथा स्त्रोत पर ही प्लास्टिक अपशिष्ट पृथक्करण करने हेतु आवश्यक कदम उठाएगा;
(ग) प्लास्टिक अपशिष्ट का न तो ढेर लगाएगा न ही जलाएगा तथा स्त्रोत पर उसका पृथक भण्डारण सुनिश्चित करेगा तथा उस पृथक अपशिष्ट को इन्दौर नगर निगम अथवा उसके द्वारा नियुक्त एजेंसियों अथवा पंजीकृत रिसाइक्लर को हस्तांतरित कर देगा;
(2) 、 प्लास्टिक अपशिष्ट का प्रत्येक संस्थागत जनरेटर, ठोस अपशिष्ट प्रबंधन नियम, 2016 तथा उसमें समय - समय पर होने वाले संशोधनों के अनुसरण में अपने द्वारा उत्पादित अपशिष्ट का पृथक्करण एवं भण्डारण करेगा तथा पृथक्कृत अपशिष्ट को अधिकृत अपशिष्ट संधारित्र अथवा निपटान सुविध। अथवा निक्षेप केन्द्रों को या तो रवयं या अपशिष्ट संग्राहक एजेंसियों के माध्यम से सप्ताह में एक दिन अर्थात बुधवार या अन्य किसी निर्धारित दिन या समय पर , जैसा कि समय - समय पर विनिर्दिषः किया जाए के अनुसार हस्तांतरित कर देगा;

(3) समस्त अपशिष्ट उत्पादक , प्लास्टिक अपशिष्ट प्रबंधन हेतु एकीकृत उपयोगकर्ता शुल्क का भुगतान इन्दौर नगर पालिक निगम को करेगा, यह शुल्क ठोस अपशिष्ट प्रबंधन में सम्मिलित है ।
(4) प्रत्येक व्यक्ति खुली जगह मे किसी ऐसे कार्यक्रम के लिएदायित्वाधीन है, जिसमें प्लास्टिक या बहुस्तरीय पैकेजिंग में खाद्य सामग्री की सेवा शामिल है, उस कार्यक्रम के आयोजन के दौरान उत्पन्न होने वाले कचरे को ठोस अपशिष्ट प्रबंधन नियम, 2016 के प्रावधानों के अनुसार पृथक्कृत करने व उसका प्रबंधन करने हेतु जिम्मेदार है । इसके अतिरिक्त आयोजनकर्ता इस तरह खुले में कार्यक्रम करने हेतु इन्दौर नगर पालिक निगम द्वारा विनिर्दिष्ट शुल्क अदा करेगा तथा
(5) प्रत्येक थोक अपशिष्ट जनरेटर पीईटी की बोतलों की रिसाइक्लिंग के लिए , केन्द्रीय प्रदूषण नियंत्रण बोर्ड / मध्यप्रदेश प्रदूषण नियंत्रण बोर्ड द्वारा अनुमोदित रिवर्स वेंडिंग मशीन स्थापित करेगा व उसे बनाए रखेगा । ऐसा करने में असफल रहने पर संबंधित के विरूद्ध अनुसूची -1 में उल्लिखित किए गए अनुसार शास्ति अधिरोपित की जाएगी ।
7. उत्पादक, आयातक तथा ब्राण्ड मालिक का दायित्व. -
(1) उपयोग किएहुए बहुस्तरीय प्लास्टिक सैशे अथवा पाउच अथवा पैकेजिंग के एकत्रीकरण प्राथमिक जिम्मेदारी उन आयातकों , उत्पादकों तथा ब्राण्ड मालिकों की होगी, जिनके द्वारा उत्पाद मार्केट में उतारा गया है । उनके द्वारा उनके उत्पाद से उत्पन्न होने वाले प्लास्टिक अपशिष्ट को पुनः संग्रहण किएजाने हेतु प्रणाली स्थापित की जावेगी । संग्रहण प्रणाली की उक्त योजना मध्यप्रदेश प्रदूषण नियंत्रण बोर्ड के समक्ष स्थापना, संचालन तथा नवीनीकरण बावत् अनुमति प्राप्त करते समय प्रस्तुत की जावेगी । जिन ब्राण्ड मालिकों की अनुगति इन नियमों के अधिसूचित किएजाने से पूर्व ही नवीकृत हो चुकी है , वे ब्राण्ड मालिक इन उपविधियों की अधिसूचना से एक वर्ष के भीतर उपरोक्तानुसार योजना प्रस्तुत करेंगे । मध्यप्रदेश राजपत्र , दिनांक 22 मार्च 2021

(2) सभी निर्माता, विस्तारित निर्माता दायित्व के आधार पर अपशिष्ट संग्रहण प्रणाली के तौर - तरीकों पर कार्य करेंगें तथा तदनुसार , प्लास्टिक अपशिष्ट प्रबंधन उपविधियां, 2019 की अधिसूचना से छह मास के भीतर इन्दौर नगर पालिक निगम को सूचित करेंगे;
(3) बहुस्तरीय प्लास्टिक, जो कि रिसाइक्लिंग योग्य नहीं है तथा ना तो जिसकी ऊर्जा के रूप में पुनः प्राप्ति की जा सकती है एवं ना ही जिसका कोई वैकल्पिक उपयोग किया जा सकता है , ऐसे प्लास्टिक का उपयोग इन्दौर निगग की गीगा के भीतर नही किया जायेगा;
(4) प्रत्येक निर्माता द्वारा , प्लास्टिक निर्माण हेतु विधिवत पंजीयन प्राप्त करने के लिएमध्यप्रदेश प्रदूषण नियंत्रण बोर्ड के समक्ष आवेदन प्रस्तुत प्रस्तुत करेंगे;
(5) मध्यप्रदेश प्रदूषण नियंत्रण बोर्ड से पंजीयन प्राप्त किएबिना कोई भी निर्माता किसी भी प्रकार के प्लास्टिक अथवा बहु- स्तरीय पैकेजिंग का उपयोग वस्तुओं की पैकेजिंग के लिएनही करेगा ।
(6) प्लास्टिक अपशिष्ट प्रबंधन नियम, 2016 के अनुसार उपयोग किएहुए बहुस्तरीय प्लास्टिक सैशे अथवा पाउच अथवा पैकेजिंग के एकत्रीकरण प्राथमिक जिम्मेदारी उन आयातकों, उत्पादकों तथा ब्राण्ड मालिकों की होगी जिनके द्वारा उत्पाद मार्केट में उतारा गया है । चूंकि, इन्दौर नगर पालिक निगम द्वारा प्लास्टिक अपशिष्ट प्रणाली स्थापित की जा चुकी है, उस स्थिति में "विस्तारित निर्माता दायित्व (EPR) " के अन्तर्गत समस्त निर्माता इन्दौर नगर पालिक निगम को सहयोग प्रदान करेंगे;
(7) निर्माताओं को इन्दौर निगम द्वारा प्लास्टिक अपशिष्ट के संग्रहण तथा प्रसंरकरण हेतु स्थापित संग्रहण प्रणालियों, प्रसंस्करण सुविधाओं तथा रिसाइक्लिंग उद्योग को वित्तीय प्रोत्साहन प्रदान करना आवश्यक है, जिससे रारकार द्वारा स्थापित लक्ष्यों को प्राप्त किया जा सके;
(8) विस्तारित निर्माता दायित्व के लक्ष्यों को पूरा करने के लिएनिर्माता, मध्यप्रदेश प्रदूषण नियंत्रण बोर्ड द्वारा अधिकृत तथा इन्दोर नगर पालिक निगम की पैनल में के निर्माता दायित्व संगठन सेवाओं का उपयोग करेंगे । 320 ( 13)

8. कम्पोस्टेबल प्लास्टिक सामग्री के लिएप्रोटोकॉल.- प्लास्टिक सामग्री की गिरावट की डिग्री तथा विघटन की डिग्री का निर्धारण इन उपविधियों की अनुसूची-3 में सूचीबद्ध भारतीय मानकों के प्रोटोकॉल के अनुसार किया जाएगा ।
9. मार्केटिंग अथवा लेबलिंग.-
(1) कम्पोस्टेबल प्लास्टिक से निर्मित प्रत्येक कैरी बैग तथा प्रत्येक बहुस्तरीय पैकेजिंग पर निग्नानुसार जानकारी अनिवार्य रूप से अंग्रेजी भाषा में तथा विकल्प के रूप में अन्य कई भाषाओं में निम्नानुसार मुद्रित की जाएगी- (क) बहुस्तरीय पैकेजिंग की दशा उत्पादक / निर्माता का नाम तथा पंजीयन क्रमांक; तथा
(ख) कम्पोस्टेबल प्लास्टिक से बने कैरी बैग की दशा में उत्पादक / निर्माता का नाम तथा प्रमाणपत्र क्रमांक (इन उपविधियों में उल्लेखित 4 (छ) के अनुसार
(2) कम्पोस्टेबल प्लास्टिक से बने प्रत्येक कैरी बैग पर " कम्पोस्टेबल " लेबल लगा होगा तथा उसें भारतीय मानक आईएस अथवा आईएसओ 17088: 2008 शीर्षक कम्पोस्टेबल प्लास्टिक हेतु विनिर्देश के अनुरूप होगा तथा उस पर केन्द्रीय प्रदूषण नियंत्रण बोर्ड का लायसेंस नम्बर भी उल्लेखित हो होगा । 10. निर्माता, रिसाईक्लिंगकर्ता तथा उत्पादक का पंजीयन.-
कोई भी व्यक्ति मध्यप्रदेश प्रदूषण नियंत्रण बोर्ड से पंजीयन प्राप्त किएबिना कम्पोस्टेबल प्लास्टिक के कैरी बैग / बहुस्तरीय पैकेजिंग का उत्पादन, इन्दौर नगर पालिक निगम की सीमा के भीतर, नहीं करेगा ।
11. खुदरा विक्रेताओं तथा पथ- विक्रेताओं का दायित्व-
(1) कोई भी खुदरा विक्रेता अथवा पथ- विक्रेता, किसी भी उपभोक्ता को कोई वस्तु, कम्पोस्टेबल प्लास्टिक से बने ऐसे कैरी बैग अथवा बहुस्तरीय पैकेजिंग में न तो विक्रय करेगा ना ही उपलब्ध करवायेगा, जो प्लास्टिक अपशिष्ट प्रबंधन नियम , 2016 तथा प्लास्टिक अपशिष्ट प्रबंधन उपविधिया , 2018 के अन्तर्गत निर्धारित नियमों के अनुसार निर्मित, लेबल तथा चिन्हित नहीं की गई है । मध्यप्रदेश राजपत्र , दिनांक 22 मार्च 2021

(2) प्रत्येक ऐसा खुदरा विक्रेता अथवा पथ- विक्रेता जो किसी वस्तु को ऐसी कम्पोस्टेबल प्लास्टिक से बनी कैरी बैग अथवा बहुस्तरीय पैकेजिंग में विक्रय् अथवा उपलब्ध करेगा, जो कि उन उपविधियों के अनुसार निर्मित या लेबल की हुई या चिन्हित नहीं है तो वह इन उपविधियों की अनुसूची-1 में सूचीबद्ध शास्ति के भुगतान के दायित्वाधीन होगा ।
12. इन उपविधियों के उल्लंघन के लिएशास्ति.-
(1) इन उपविधियों के अधिसूचित होने की तिथि पर तथा उसके पश्चात 30 दिन की जागरूकता कालावधि होगी जिसके पश्चात् इन उपविधियों का किसी भीं प्रकार से उल्लंघन , शास्ति अनुसूची (अनुसूची-1 ) के अनुसार इन उपविधियों के उल्लंघन के प्रत्येक अवसर पर दण्डनीय होगा । प्रथम उल्लंघन को छोड़कर बाद के प्रत्येक उल्लंघन के लिएप्रत्येक आपराधिक कृत्य के लिएन्यूनतम दुगुनी तथा अधिकतम दस गुना शास्ति अधिरोपित की जा सकेगी ।
(2) किसी अपराधी द्वारा अनुसूची-2 के अनुसार अर्थदण्ड भुगतान करने में असफलता की दशा में ऐसे अपराधी के विरूद्ध नगर पुलिस अधिनियम तथा जिला पुलिस अधिनियम / भारतीय दण्ड संहिता / तथा अन्य लागू विधि के प्रावधानों के अन्तर्गत अभियोग गठित किया जा सकेगा ।
इन्दौर नगर पालिक निगम का प्रवर्तन तंत्र.-
13.
( 1 ) आयुक्त , इन्दौर नगर पालिक निगम, अपशिष्ट जनरेटर द्वारा प्लास्टिक अपशिष्ट प्रबंधन से संबंधित इन नियमों के उपबंधों को लागू करने का प्राधिकारी होगा ।
(2) आयुक्त, इन्दौर नगर पालिक निगग इन उपविधियों के उपबंधों को लागू करने में इन्दौर नगर पालिक निगम की अधिकारिता के भीतर उपायुक्त की सहायता प्राप्त करेगा ।
(3 ) • सार्मायेक तथा आर्कास्मक निरीक्षणः आयुक्त, इन्दौर नगर पालिक निगम अथवा उसके द्वारा यथा प्राधिकृत कोई अन्य अधिकारी निगम की सीमा में वार्डो के विभिन्न भागों के भीतर उपविधियों के प्रावधानों को प्रवर्तित करवाने के लिए किसी भी समय आकस्मिक निरीक्षण कर सकेगा । इन उपविधियों के किसी भी उपबंध का उल्लंघन उप-विधि की अनुसूची-1 के अनुसार शास्ति के दायित्वाधीन होगा । 320( 15)

(4) आयुक्त, इन्दौर नगर पालिक निगम प्रत्येक वार्ड / झोन में प्रवर्तन दस्ते तैनात / नियुक्त करेगा , जो प्लास्टिक अपशिष्ट प्रबंधन उपविधि, 2021 का प्रवर्तन करवाएंगे ।
14. एक बार उपयोगी तथा फेंकने योग्य प्लास्टिक पर प्रतिबंध.-
(1) जी.ओ. (एमएस) क्रमांक 84 , पर्यावरण तथा वन (ईसी. 2 ) विभाग , दिनांक 25/06/2016 के अनुसार, आयुक्त इन्दौर नगर पालिका निगम उसे प्राप्त शक्तियों का उपयोग करते हुए अपने क्षेत्राधिकार की सीमाओं के भीतर "वन टाईम यूज एण्ड थ्रोअवे प्लास्टिक बेन (एक बार उपयोगी तथा फेंकने योग्य प्लास्टिक प्रतिबंधित) " के निर्देश का प्रवर्तन करवायेगा । यह अधिसूचना 1 जनवरी 2019 से लागू है ।
(क) कोई भी व्यक्ति या उद्योग परिभाषा में यथा वर्णित एक बार उपयोगी तथा फेंकने योग्य प्लास्टिक का निर्माण , भण्डारण, आपूर्ति, परिवहन, विक्रय या वितरण नही करेगा ।
(ख) कोई भी दुकानदार, विक्रेता, थोक विक्रेता , खुदरा विक्रेता, व्यापारी, पथ-विक्रेता, या सेल्समेन एक बार उपयोगी तथा फेंकने योग्य प्लास्टिक का उपयोग नही करेगाः
परन्तु निम्नलिखित के लिए उपयोग में लाए जाने वाले प्लास्टिक के लिए छूट रहेगी-
(क) ऐसे प्लास्टिक कैरी बैग्स , जो विशेषतया किसी निर्यात आदेश के लिएनिर्यात के उद्देश्य से किसी प्लास्टिक उद्योग द्वारा बनाये गएहै, जो कि स्पेशल इकानामिक झोन (सेज) तथा निर्यातोन्मुख इकाई में स्थित है ।
(ख) प्लास्टिक बैग , जो पैकेजिंग का एक अभिन्न अंग है या अभिन्न अंग बनता हो, जिसमें विनिर्माण / प्रसंस्करण इकाईयों में उपयोग करने से पहले माल सील किया जाता है ।
(ग) शासकीय विभागों के आदेश के विरूद्ध वानिकी और बागवानी में उपयोग में लाई गई प्लास्टिक थैलियां या चादरें ।
(घ) दुग्ध एवं दुग्ध उत्पादों ( डेयरी उत्पादों) , तेल, दवाईयों तथा चिकित्सा उपकरणों में उपयोग होने वाले प्लास्टिक । मध्यप्रदेश राजपत्र, दिनांक 22 मार्च 2021

(2) एक बार उपयोगी तथा फेंकने योग्य प्लास्टिक हेतु प्रवर्तन तंत्र निग्नानुसार है--
(क) राागयिक तथा आकरिगक जांचः आयुक्त , इन्दौर नगर पालिक निगम अथवा आयुक्त द्वारा यथा प्राधिकृत कोई अन्य अधिकारी , निगम की सीमा में वार्डो के विभिन्न भागों के भीतर जी.ओ. 84 के पालन प्रवर्तन हेतु किसी भी समय आकस्मिक जांच कर सकेगा । इन उपविधियों के किसी भी उपबंध का उल्लंघन अनुसूची-1 के अनुसार शास्ति के दायित्वाधीन होगा ।
(ख) निरीक्षण प्राधिकारीः स्वच्छता निरीक्षक "निरीक्षण प्राधिकारी " के रूप में कार्य करेगा । शास्ति अधिरोपित करने वाले प्राधिकारी अर्थात संबंधित प्रभाग के स्वच्छता प्राधिकारी को अपने निर्धारित क्षेत्राधिकार में जी.ओ तथा उपविधियों की अनुसूची 2 में उद्धृत अधिसूचना के उल्लंघन पर शास्ति अधिरोपित करने हेतु अधिकृत किया जाता है । शास्ति उद्ग्रहित करने वाले प्राधिकारी द्वारा एक रजिस्टर बनाया जाएगा, जिसमें व्यावसायिक स्थापना का नाम, अपराध क्रमांक , शास्ति की राशि, निगम व्यापार लायसेंस क्रमांक तथा पथ- विक्रेताओं के लिए पथ- विक्रेता पहचान- पत्र क्रमांक उल्लेखित होगा । शास्तिं उद्ग्रहित करने वाला प्राधिकारी शास्ति की राशि (अर्थात प्रथम/ द्वितीय / तृतीय अवसर पर) चालान के माध्यम से जीसीसी कोषालय में उपविधियों की अनुसूची-2 के अनुसार चौबीस घंटे के भीतर / अगले कार्यदिवस पर जमा करेगा ।
(ग) निगरानी के लिए क्षेत्रीय स्तर समितिः क्षेत्रीय अधिकारी (मुख्य) की अध्यक्षता में कार्यपालक अभियंता, क्षेत्रीय स्वास्थ अधिकारी तथा सहायक राजस्व अधिकारी को सम्मिलित करते हुए एक समिति बनाई जाएगी । यह समिति समय - समय पर क्रियान्वयन की निगरानी करेगी । 320 ( 17)

(घ) अपीलीय प्राधिकारीः जोनल अधिकारी, अपीलीय अधिकारी की हैसियत से कार्य करेगा । यदि कोई उल्लंघनकर्ता विभागीय अधिकारी द्वारा अधिरोपित की गई शास्ति से अंसतुष्ट है तो ऐसा उल्लंघनकर्ता शारित की राशि का भुगतान करने के बाद विभागीय अधिकारी द्वारा प्रदान की गई शास्ति जमा की रसीद प्राप्ति से 15 दिवस के भीतर अपीलीय प्राधिकारी अर्थात झोनल अधिकारी को अपील कर सकेगा। ऐसी किसी भी अपील की प्राप्ति पर अपीलीय प्राधिकारी उसकी जांच करेगा तथा बोले गए आदेश द्वारा अपील का निपटान करेगा । यदि अपीलार्थी द्वारा प्रस्तुत प्रमाण से अपीलीय प्राधिकारी संतुष्ट है कि गलत या अधिक शास्ति अधिरोपित की गई है तो वह उसे तुरंत उसमें सुधार करेगा तथा भुगतान की गई शास्ति की राशि लौटा दी जाएगी।
(ड.) पुनरीक्षण प्राधिकारीः क्षेत्रीय उपायुक्त " पुनरीक्षण प्राधिकारी " के रूप में कार्य करेगा । इसके अतिरिक्त अपीलार्थी, अपीलीय प्राधिकारी के आदेश के विरूद्ध पुनरीक्षण प्राधिकारी के समक्ष पुनरीक्षण आवेदन प्रस्तुत कर सकेगा, जो कि क्षेत्रीय उपायुक्त (उत्तर, मध्य, तथा दक्षिण क्षेत्र) होगा तथा ऐसा पुनरीक्षण आवेदन अपीलीय प्राधिकारी के आदेश से 15 दिवस के भीतर प्रस्तुत किया जाएगा । पुनरीक्षण प्राधिकारी के पश्चात् जांच अपील का अंतिम आदेश के रूप में निपटान करेगा । यदि अपीलार्थी द्वारा प्रस्तुत प्रमाण से पुनरीक्षण प्राधिकारी संतुष्ट है कि गलत या अधिक शास्ति अधिरोपित की गई है तो वह उसे तुरंत उसमें सुधार करेगा तथा भुगतान की गई शास्ति की राशि लौटा दी जाएगी ।

(छ) शास्तियों का संग्रहणः शास्ति की प्रत्येक राशि इन्दौर नगर निगम के कोषालय में जमा की जाएगी । इस हेतु विशेष बजट कोड की स्थापना की जाएगी ।
15. वार्षिक प्रतिवेदन. -
(1) प्रत्येक व्यक्ति जो प्लास्टिक अपशिष्ट के रिसाइकिलिंग तथा प्रसंस्करण में संलग्न है,-
क) इन्दौर नगर निगम के लोक स्वास्थ विभाग के समक्ष पंजीयन (
प्ररूप -1 के अनुसार पंजीयन करवाएगा ।

) प्ररूप-4 के अनुसार मध्यप्रदेश प्रदूषण नियंत्रण बोर्ड को सूचित करते हुए इन्दौर नगर पालिक निगम को प्रतिवर्ष 30 अप्रैल तक वार्षिक प्रतिवेदन प्रेषित करेगा ।
(2) इन्दौर नगर पालिक निगम प्ररूप -5 में एक वार्षिक प्रतिवेदन तैयार करेगा तथा मध्यप्रदेश प्रदूषण नियंत्रण बोर्ड को सूचित करते हुए उसे संबंधित सचिव आवारा और शहरी कार्य मंत्रालय को प्रतिवर्ष 30 जून तक प्रेषित करेगा ।
16. न्यायालयों का क्षेत्राधिकार. - इन उपविधियों के विरूद्ध कोई प्रकरण प्रस्तुत करने हेतु क्षेत्राधिकार केवल इन्दौर रहेगा । मध्यप्रदेश राजपत्र , दिनांक 22 मार्च 2021

Not No. 05 - F 1-02 / 2021 / 18-3 In exercise of the powers conferred by sub- section ( 1 ) of Section 430 read with sub - section ( 24 ) ( d ) of Section 427 of Madhya Pradesh Municipal Corporation Act , 1956 ( No. 23 of 1956 ) , Madhya Pradesh Government has confirmed the Byelaws , namely Indore Municipal Corporation , plastic waste management bye - laws 2021 and same are being published as per provision of Section 431 us the Act .
The bye - laws are governed by all the activities related to plastics as amended from time to time by Government of India, Government of Madhya Pradesh, Central Pollution Control Board , Madhya Pradesh Pollution Control Board and other related statutory organizations and their Acts and laws .
1. Short title , extent and commencement .
( 1 ) These byelaws shall be called as Plastic Waste Management Byelaws , 2021 of Indore Municipal Corporation.
(2) It shall come into force with effect from the date of publication in the Madhya Pradesh Gazette .
3 ) This shall apply to whole area of Municipal Corporation, Indore .

2. Definitions.- In these bye - laws and the Schedule attached thereto , the words and expressions used but not defined shall have the same meanings respectively assigned to them in the Indore City Municipal Act , 1919 unless the context otherwise requires , - मध्यप्रदेश राजपत्र, दिनांक 22 मार्च 2021

(a) " Act " means the Environment ( Protection) Act , 1986 (29 of1986);
(b) " alternate use " means use of a material for a purpose other than for which it was conceived , which is beneficial because it promotes resource efficiency ;
(c) "brand owner " means a person or company who sells any commodity under a registered brand label ;
or (d) " bulk waste generator " means and includes buildings occupied by the Central government departments or undertakings , State government departments undertakings , local bodies , public sector undertakings or private companies , hospitals , nursing homes , schools , colleges , universities , other educational institutions , hostels , commercial establishments , markets , places of worship , stadium and sports complexes having an average waste generation rate exceeding 100kg per day ;
(e) " Bye - laws " means Plastic Waste Management Bye - laws - 2021 of Indore Municipal Corporation ;
(f) (i) " carry bags " means bags made from plastic material , used for the purpose of carrying or dispensing commodities which have a self- carrying fcature but do not include bags that constitute or form an integral part of the packaging in which goods are scaled prior to use . These are banned as per G.O. Environment and Forests (EC.2 ) Department , dated 25.06.2018 ;

( ii) " carry bags " means bags made from compostable plastic material , used for the purpose of carrying or dispensing commodities which have a self- carrying feature but do not include bags that constitute or form an integral part of the packaging in which goods are sealed prior to use , duly approved by Central Pollution Control Board;
(g) " commodity " means tangible item that may be bought or sold and includes all marketable goods or wares ;
(h) " compostable plastics " mean plastic that undergoes degradation by biological processes during composting to yield CO2 , water , inorganic compounds and biomass at a rate consistent with other known compostable materials , excluding conventional Petro- based plastics , and does not leave visible , distinguishable or toxic residue ;
(i) " consent " means the consent to establish and operate from Madhya Pradesh Pollution Control Board granted under the Water ( Prevention and Control of Pollution ) Act , 1974 ( 6 of 1974), and the Air ( Prevention and Control of Pollution ) Act , 1981 ( 14 of 1981 ) ;
(j ) " disintegration " means the physical breakdown of a material into very small fragments ;
(k) " energy recovery " means energy recovery from waste that is conversion of waste material into usable heat , electricity or fuel through a variety of processes including combustion , gasification , pyroliation , anaerobic digestion मध्यप्रदेश राजपत्र, दिनांक 22 मार्च 2021

and landfill gas recovery ;
(1) "event" means any gathering for the purpose of functions , celebrations , meetings , rallics , processions , open air theatre activities , cinema shootings in public places etc .;
(m) " extended producer's responsibility " means the responsibility of a producer for the environmentally sound management of the product until the end of its life;
(n) " food - stuffs " mean ready to eat food products , fast food, processed or cooked food in liquid , powder , solid or semi - solid form;
(o) " facility " means the premises used for collection, storage , recycling , processing and disposal of plastic waste ;
(p) " importer " means a person who imports or intends to import and holds an Importer -Exporter Code number , unless otherwise specifically exempted .
(৭) " institutional waste generator " means and includes occupier of the institutional buildings such as building occupied by Central Government Departments , State Government Departments , public or private companies , hospitals , schools , colleges , universities or other places of education , organization , academy , hotels , restaurants , malls and shopping complexes ; sector (r) " local body " for the purpose of these Bye - laws means Indore Municipal Corporation;
(s) "manufacturer " means and includes a person or unit, or agency engaged in production of plastic raw material to be used as raw material by the producer ;

(t) " multilayered packaging " means any material used or to be used for packaging and having at least one layer of plastic as the main ingredients in combination with one or more layers of materials such as paper , paper board, polymeric materials , metalized layers or aluminum foil , either in the form of a laminate or co - extruded structure ;
(u) "Nuisance Detectors " (NDs ) means those employees of the Indore Municipal Corporation who are appointed by the Commissioner to detect the acts of nuisance etc. related to plastic waste management;
(v) " plastic " means material which contains as an essential ingredient a high polymer , such as polyethylene terephthalate , high density polyethylene , Vinyl , low density polyethylene , polypropylene , polystyrene resins , multi - materials like acrylonitrile butadiene styrenc , polyphenylene oxide , polycarbonate , polybutylene terephthalate etc .;
(w) " plastic sheet " means plastic sheet is the sheet made of plastic , which are banned as per G.O. (Ms ) No. 84 Department , Environment and Forests (EC.2 ) dated25.06.2018 ;
(x) " plastic waste " means any plastic discarded after use or after their intended use is over ;
(y) " prescribed authority " means the authorities specified in clause 12 of Plastic Waste Management and Handling Rules 2016 and Commissioner , Indore Municipal मध्यप्रदेश राजपत्र , दिनांक 22 मार्च 2021

(z) " producer " means persons engaged in inanufacture or import of carry bags or multilayered packaging or plastic sheets or like , and includes industries or individuals using plastic sheets or like or covers made of plastic sheets or multilayered packaging for packaging or wrapping the commodity;
(za ) " recycling " means the process of transforming segregated plastic waste into a new product or raw material for producing new products ;
(zb) " registration " means registration with the Madhya Pradesh Pollution Control Board or Indore Municipal Corporation or statutory authority concerned, as the case maybe ;
( zc) " street vendor " shall have the same meaning as assigned to it in clause ( 1 ) of sub - section ( 1 ) of Section 2 of the Street Vendors ( Protection of Livelihood and Regulation of Street Vending) Act , 2014 (7 of 2014 ) ;
(zd) " use and throwaway plastics " This definition is adopted from G.O. No. 84 Environment and Forests ( EC.2 ) Department , which means items such as plastic carry bags or plastic flags , plastic sheets used for food wrapping , spreading on dining table etc. plastic plates , plastic coated tea cups and plastic tumbler, water pouches and packets , plastic straw irrespective of thickness as defined in G.O.No.84 Environment and Forests ( EC.2 ) Department, dated 25.06.2018 are banned as follows:

(zg) " waste management " means the collection , storage, transportation reduction, re - use , recovery , recycling , composting disposal of plasticor environmentally safe manner ; waste in (zh) " waste pickers " mean individuals or agencies , groups of individuals voluntarily engaged or authorized for picking of recyclable plastic waste .
3. Conditions.-
(1) The manufacture , import , stocking , distribution , sale and use of plastic shall be subject to the following conditions , namely: -
(a) plastic packaging shall cither be in natural shade which is without any pigınents or made using only those pigments and colorants which are in conformity with Indian Standard : IS 9833 : 1981 titled as " List of pigments and colorants for use in plastics in contact with foodstuffs , pharmaceuticals and drinking water " as amended from time to time ;
(b) products made of recycled plastics shall not be used for storing, carrying , dispensing or packaging ready to eat or drink stuffs ;
(c) plastic sheet or like , which is not an integral part of Multi - layered packaging and cover made of plastic sheet used for packaging , wrapping the commodity shall not be less than fifty microns in thickness except whether thickness of such plastic sheets 320 ( 35)

impair the functionality of the product ;
(d) the manufacturer shall not sell or provide or arrange plastic to be used as raw material to a producer , not having valid registration from Madhya Pradesh Pollution Control Board;
(e) sachets using plastic material shall not be used for storing , packing or selling gutkha , pan masala and tobacco;
(f) plastic material , in any form including Vinyl Acetate- Maleic Acid Vinyl Chloride Copolymer , shall not be used in any package for packaging gutkha, pan masala and tobacco in all forms .
(g) recycling of plastic waste shall conform to the Indian Standard: IS 14534: 1998 titled as Guidelines for Recycling of Plastics , as amended from time to time ;
(h) the provision of thickness shall not be applicable to carry bags made up of compostable plastics . Carry bags made from compostable plastics bearing a label "compostable " shall conform to the Indian Standard : IS for 17088 : 2008 titled as Specifications "Compostable Plastics " . 4. Plastic waste management.- ( 1 ) The plastic waste management by Indore Municipal Corporation in its jurisdiction shall be as under: -
(a) plastic waste , which can be recycled, shall be channelized to registered plastic waste recycler and recycling of plastic shall conform to the Indian Standard : IS 14534 : 1998 titled as Guidelines for Recycling of Plastics , as amended from time to time;
(b) plastic waste, which cannot be recycled, shall be channelized to Refuse Derived Fuel (RDF ) plants / cement plants / pyrolysis plants or any other technologies . The standards and pollution control norms specified by the prescribed authority for these technologies shall be complied with ;
(c) Indore Municipal Corporation shall encourage the use of plastic waste (preferably the plastic waste which cannot be further recycled ) for road construction as per Indian Road Congress guidelines ;
(d) thermo set plastic waste shall be processed and disposed of as per the guidelines issued from time to time by the Central Pollution Control Board ; and
(e) the inert from recycling or processing facilities of plastic waste shall be disposed of in compliance with the Solid Waste Management Rules , 2016 or as amended from time to time.

5. Responsibility of Indore Municipal Corporation.-
(1) The Indore Municipal Corporation shall be responsible for development and setting up of infrastructure for segregation , collection , storage , transportation , processing and disposal of the plastic waste either on its own or by engaging agencies or producers .
(2) The Indore Municipal Corporation shall be responsible for setting up , operationalization and co - ordination of the waste management system and for performing the associated functions , shall be as follows .
(a) ensuring segregation , collection , storage, transportation, processing and disposal of plastic waste;
(b) ensuring that no damage is caused to the environment during this process ;
(c) ensuring channelization of recyclable plastic waste fraction to recyclers ;
(d) ensuring processing and disposal on non - recyclable fraction of plastic waste in accordance with the guidelines issued by the Central Pollution Control Board;
(e) creating awareness among all stakeholders about their responsibilities ;
(f) engaging civil societies or groups working with waste pickers ; and
(g) ensuring that open burning of plastic waste does not take place.

(3) Indore Municipal Corporation shall seek assistance of producers setup a system of plastic waste management as per of Plastic Waste Management Rules , 2016 or any other relevant law amended from time to time.
(4) Indore Municipal Corporation shall endeavor and encourage
(a) civil society organizations involved in plastic eradication in order to implement Plastic Waste Management Rules , 2016 and these By- laws ;
(b) Self Help Groups (SHG ) involved for segregation of waste processing . It may be encouraged for the purpose of Technical guidance as well as implementation through appropriate organizations .
(5) Indore Municipal Corporation , shall extend the Slum adoption programme to the uncovered areas within their wards for solid waste management and plastic waste management with the possible assistance of qualified Community Based Organizations (CBOs) / Government organizations (NGO's )/ Voluntary Service Organizations ( VSO's ) / Self Help Groups (SHG ) or other Organizations holding statutory validations . Non- (6) Cleanliness drives shall be conducted by the Indore Municipal Corporation in association with public representatives , citizen organizations , government bodies , corporates , NGOs for the cleanliness of areas inside the slums , from time to time , in association with CBOs participating in the Slum Adoption Program .
i. Responsibilities of waste generator.-

(a) not use plastic items banned under G.O.No.84 Environment and Forests ( EC.2 ) Department ;
(b) take steps to minimize generation of plastic waste and segregate plastic waste at source in accordance with the Solid Waste Management Rules 2016 , and in accordance with the Plastic Waste Management Rules 2016 , and amendments made in these rules from time to time ;
(c) not litter or burn the plastic waste , and ensure segregated storage of waste at source and handover segregated waste to Indore Municipal Corporation or agencies appointed by them or registered recyclers .
(2) All institutional generators of plastic waste shall segregate and store the waste generated by them in accordance with the Solid Waste Management Rules , 2016 as amended from time to time and handover segregated wastes to authorized waste processing or disposal facilities or deposition centers either on its own or through the authorized waste collection agency once in a week on Wednesday or any other designated day or periodically as specified from time to time .
(3) All the waste generator shall pay integrated user fee for plastic waste management which is included in the solid waste management user fee notified by Indore Municipal Corporation.

space which involves service of food stuff in plastic or multilayered packaging shall segregate and manage the waste generated during such events in accordance with the Solid Waste Management Rules , 2016. Further the organizers shall pay the user fee prescribed by Indore Municipal Corporation for events in open public places .
(5) All bulk waste gencrators shall install and maintain Reverse Vending Machine , or any other appropriate system of recycling PET bottles as approved by Central Pollution Control Board / Madhya Pradesh Pollution Control Board. If not, penalty will be levied as per Schedule - I .
7. Responsibility of Producers , Importers and Brand Owners . - (1) Primary responsibility for collection of used multi - layered plastic sachet or pouches or packaging is of Producers , Importers and Brand Owners who introduce the products in the market . They need to establish a system for collecting back the plastic waste generated due to their products . This plan of collection to be submitted to the Madhya Pradesh Pollution Control Board while applying for Consent to establish or operate or renewal . The Brand Owners whose consent has been renewed before the notification of these rules shall submit such plan within one year from the date of notification of these Bye - laws ;
(2) The producers shall work out modalities for waste collection system based on Extended Producers responsibility and inform Indore Municipal Corporation according within 6 months from the notification of Plastic Waste Management Bye - Laws , 2019 .

(3) Multilayered plastic which is non - recyclable or non - energy recoverable or with no alternate use of plastic shall not be used in Indore Municipal Corporation limits ;
All producers shall submit an application to the Madhya Pradesh Pollution Control Board for grant of registration , for production of plastics ; and (4)
(5) No producer shall use any plastic or multilayered packaging for packaging of commodities without registration from the Madhya Pradesh Pollution Control Board;
(6) As per Plastic Waste Management Rules , 2016 the primary responsibility for collection of used multi - layered plastic sachet or pouches or packaging is of Producers , Manufacturers , Importers and Brand Owners who introduce the products in the market . Since Indore municipal Corporation has set up of system for plastic waste management, the producers shall support IMC under "Extended Producer Responsibility " (EPR ) ;
(7) The producers are required to provide financial incentive to the collection systems , processing facilities and the recycling industry set up by IMC to collect and process plastic waste in order to meet the targets set out by the Government;
(8) The Producers shall utilize the services of Producer Responsible Organizations ( PRO ) authorized by M.P. Pollution Control Board and empanelled by IMC to achieve the targets under "Extended Producer Responsibility . " .

8. Protocols for compostable plastic materials.- Determination of the degree of degradability and degree of disintegration of plastic material shall be as per the protocols of the Indian Standards listed in Schedule III of these Bye - laws . " .
9. Marking or labelling.-
(1) Each carry bag made from compostable plastics , and multilayered packaging shall have the following information printed in English mandatorily and any number of other languages as optional , namely: -
(a) name and registration number of the manufacturer in case of multilayered packaging ; and
( b) name of the manufacturer and certificate number [4 (g) of these By - laws ] in case of carry bags made from compostable plastics.
(2) Each carry bag made from compostable plastics shall bear a label " compostable " and shall conform to the Indian Standard: IS or ISO 17088 : 2008 titled as specifications for "Compostable Plastics " and Central Pollution Control Board License number shall also be mentioned .
10. Registration of producer , recyclers and manufacturers . -
No person shall manufacture carry bags made from compostable plastics/ multilayered packaging without obtaining registration with Madhya Pradesh Pollution Control Board within Indore Municipal Corporation limits.
11. Responsibility of retailers and street vendors.- 320 (43 )

(1) Retailers or street vendors shall not sell or provide commodities to consumer in carry bags made with compostable plastics or multilayered packaging , which are not manufactured and labelled or marked , as prescribed under the Plastic Waste Management Rules , 2016 and Plastic Waste Management Bye - laws , 2019 .
(2) Every retailer or street vendor selling or providing commodities in carry bags made with compostable plastics or multilayered packaging which are not manufactured or labelled or marked in accordance with these Bye - laws shall be liable to pay such fines us specified under the Bye - laws listed in Schedule I.
12. Penalties for contravention of these Bye - laws.-
(1 ) On and after the date of notification of these Bye - laws , there will be a familiarization/ awareness period of 30 days , after which , any contravention of these Bye - laws shall be punishable with fines as per the Schedule I for every instance of breach of these Bye - laws . Subsequent contravention apart from first time will attract fine amount of minimum two times to maximum ten times for each and every act of offence .
(2) In case of an offender not able to pay the fine as mentioned in Schedule II , prosecution may be instituted under the provisions made in City Police Act & District Police Act/ Indian Penal Code / and other applicable Acts / Laws .
13. Enforcement mechanism for Indore Municipal Corporation.- (1 ) The Commissioner , Indore Municipal Corporation , shall be मध्यप्रदेश राजपत्र , दिनांक 22 मार्च 2021

the authority for enforcement of the provisions of these rules relating to plastic waste management by waste generator .
(2 ) The Commissioner, Indore Municipal Corporation , shall take the assistance of the Deputy Commissioner within the territorial limits of the jurisdiction of the Indore Municipal Corporation in the enforcement of the provisions of these Bye- laws .
(3) Periodical and Surprise checks : The Commissioner , Indore Municipal Corporation or any other officer as authorized by the Commissioner will conduct surprise checks in various parts of the wards in the corporation limits at any point of time to enforce compliance of the Bye - laws . Any contravention of any clause of this Bye - laws shall attract a fine as per Schedule I of the Bye - laws .
(4) The Commissioner Indore Municipal Corporation shall deploy/ appoint enforcement squad in each ward/ zone who shall enforce the Plastic Waste Management byelaws 2019 .
14. Ban on one time use and throwaway plastics.-
(1) As per G.O. ( Ms ) No. 84 Environment and Forests ( EC.2 ) Department, dated 25.06.2018 , the Commissioner , Indore Municipal Corporation , shall enforce the direction of " one time use throw away plastic ban " in exercise of power conferred on him/her by law in their jurisdiction . The notification came into effect on 1 January , 2019 .

(b) No person including shopkeeper , vendor , wholesaler , retailer , trader , hawker or sales men shall use, ' use and throwaway plastics ' :
Provided that the plastic used for the following purposes are exempted: -
(a) The plastic carry bags , manufactured exclusively for export purpose against any export order in a plastic industry located in Special Economic Zone ( SEZ) and Export Oriented Units ( EOU ) .
(b) The plastic bags which constitute or form an integral part of packaging in which goods are sealed prior to use at manufacturing/processing units .
(c) The plastic bags and sheets used in Forestry and Horticulture nurseries against the orders from the Government Departments .
(d) The plastic used for packing of milk and milk products ( dairy products ) , oil, medicine and medical equipment's .
(2) Enforcement mechanism for ban on one time use and throwaway plastics is as follows : -
(a) Periodical and Surprise checks : The Commissioner , Indore Municipal Corporation or any other officer as authorized by the Commissioner will conduct surprise checks in various parts of the wards in the corporation limits at any point of time to enforce compliance of G.O. 84. clause of this Bye - law shall attract a penalty as per Schedule I of the Bye- laws .
(b) Inspection Authority: Sanitary Inspector shall serve in the capacity of " Inspection Authority " . Finc levying authorities i.e. , the concerned division Sanitary Inspector is hereby authorized to levy fines for violation of G.O. and notification cited in Schedule II of the Bye - laws in their respective jurisdictions . The fine levying authority shall maintain a register mentioning details of commercial establishment name , offence number , fine amount , corporation trade license number and for street vendors , street vending ID card number. The fine levying authority shall deposit the fine amount (i.e.1st/ 2nd/ 3rd instances ) in GCC Treasury through challan within 24 hours /next working day as per Schedule II of the Bye - laws .
(c) Zonal Level Committee for monitoring: Zonal Level Committee headed by Zonal Officer (Head) , Executive Engineer , Zonal Health Officer and Assistant Revenue Officer . This Committee shall periodically monitor the implementation.
(d) Appellate Authority: The Zonal Officers shall serve in the capacity of " Appellate Authority " . If the violator has any grievances related to the fines levied by the divisional authority , the violator after payment of fine may appeal to the Appellate authority i.e. , Zonal officer within 15 days of receipt 320 (47)

of fine imposition challan from Divisional Authority . Upon receipt of such appeals , the Appellate authority shall enquire and dispose the appeal by passing speaking orders . If the appellant submits evidence and Appellate authority is convinced that fine is levied wrongly or in excess , it may be rectified immediately and fine levied and paid may be returned.
(e) Revision Authority: The Regional Deputy as the "Revision Commissioners shall serve Authority " . Further , against the orders of the Appellate Authority, Appellants can file review petition with the Revision Authority i.e. , respective Regional Deputy Commissioner ( North , Central and South) within 15days of receipt of orders by Appellate authority. The Revision authority shall enquire and dispose the appeal with final orders . If the appellant submits evidence and Revision authority is convinced that fine is levied wrongly or in excess , it may be rectified immediately and fine levied and paid may be returned forthwith.
(f) Penalties: Penalty will be levied as per Indore City Municipal Corporation Act, 1919 as per Schedule - II in these Bye - laws .

15. Annual Reports.-
(1 ) Every person engaged in recycling or processing of plastic waste shall-
(a) Register with the Public Health Department of Indore Corporation in Registration Form - I for waste channelizers Rs.300/- for Recyclers / Processors / Dealers Rs.500/- ;
(b) Submit an annual report in Form IV to Indore Municipal Corporation under intimation to the Madhya Pradesh Pollution Control Board by the 30th April of every year .
(2) Indore Municipal Corporation shall prepare and submit an annual report in Form V to the concerned Secretary - in- charge of the Urban Development Department under intimation to the concerned Madhya Pradesh Pollution Control Board by the 30th June , every year .
16. Jurisdiction of Courts.- For filing cases against the Bye - laws , the jurisdiction is Indore only .
