क्रमांक एफ-1 (बी ) 23 / 2021 /बी-4/दो :- पुलिस अधिनियम , 1861 ( 1861 का 5 ) की धारा 2 के साथ सहपठित धारा 46 की उप -धारा (2 ) एवं (3 ) द्वारा प्रदत्त शक्तियों तथा इस निमित्त समस्त शक्तियों को प्रयोग में लाते हुए , मध्य प्रदेश के राज्यपाल , एतदद्वारा , मध्य प्रदेश पुलिस विनियम , 1861 में निम्नलिखित संशोधन करते हैं , अर्थात्: -

उक्त विनियम में , विनियम 45 के पश्चात्, निम्नलिखित विनियम जोड़ा जाए , अर्थात : - " 45 -क. कार्यवाहक उप पुलिस अधीक्षक के रूप में निरीक्षक की नियुक्ति: -
" यदि उप पुलिस अधीक्षक की रिक्तियों को भरने की तत्काल आवश्यकता है और फीडर संवर्ग में अर्ह निरीक्षक उपलब्ध हैं , तब पुलिस महानिदेशक , राज्य सरकार की पूर्व अनुमति से, उप पुलिस अधीक्षक के रूप में ऐसे निरीक्षक को कार्य करने के लिये आगामी आदेश तक कार्य करने हेतु आदेशित कर सकेगा ।

कार्यवाहक उप पुलिस अधीक्षक के रूप में पद पर कार्य करने वाले निरीक्षक, उप पुलिस अधीक्षक पद पर वरिष्ठता या वेतन या भत्ते का दावा भी नहीं करेगा। परन्तु जब तक वह इस पद पर कार्य करेगा तब तक उप पुलिस अधीक्षक की श्रेणी का गणवेश धारित कर सकेगा । ऐसा कार्यवाहक उप पुलिस अधीक्षक, उप पुलिस अधीक्षक की समस्त शक्तियों का प्रयोग करेगा, जब तक वह उस पद पर कार्यरत है । "
No.F - 1 ( B ) 23 / 2021 /B - 4/Two , : - In exercise of the powers conferred by sub- Section (2) and (3 ) of section 46 read with section 2 of Police Act , 1861 ( V of 1861 ) and all other powers enabling in this behalf, the Governor of Madhya Pradesh , hereby , makes the following amendment in the Madhya Pradesh Police Regulation , 1861 namely : -
Amendment
In the said regulations , after regulation 45 , the following regulation shall be inserted , namely : -
" 45 - A . Appointment of Inspectors as officiating Deputy Superintendent of Police : -
" If there is an urgent need to fill the vacancies of Deputy Superintendent of Police and in the feeder cadre , the eligible Police Inspectors are available , then the Director General of Police with the prior approval of the State Government may order such Inspector to officiate as Deputy Superintendent of Police until futher orders .
The Inspector working as officiating Deputy Superintendent of Police shall have no claim of seniority or pay or allowances of Deputy Superintendent of Police but may wear the uniform of the rank of Deputy Superintendent of Police till he or she officiates this post . Such officiating Deputy Superintendent of Police shall exercise all the powers of Deputy Superintendent of Police till he or she officiates, on the post . "
