2. पथकर , महाप्रबंधक/संभागीय प्रबंधक, मध्यप्रदेश सड़क विकास निगम के माध्यम से मध्यप्रदेश सड़क विकास निगम द्वारा संग्रहीत किया जाएगा । प्रत्येक पथकर प्लाजा पर पथकर की दरें , उपरोक्त दरों के आधार पर, मध्यप्रदेश सड़क विकास निगम लिमिटेड द्वारा विनिर्दिष्ट की जाएंगी। 3. उपरोक्त दरें प्रत्येक वर्ष थोक मूल्य सूचकांक के आधार पर बढ़ायी जाएगी तथा निकटतम पांच रूपये में पूर्णांकित की जाएंगी । वृद्धि 31 मार्च को समाप्त होने वाले वर्ष के लिए थोक मूल्य सूचकांक के आधार पर प्रत्येक वर्ष की 1 सितंबर से प्रभावी की जाएंगी। पथकर की मूल दरें दिनांक 01.09.2007 को प्रभावी होने के लिए अधिसूचित दरों के अनुसार होंगी । प्रतिवर्ष बढ्‌ने वाले पथकर की गणना नीचे दिए गए सूत्र (उदाहरण ) के अनुसार की जाएगी:

मूल थोक मूल्य सूचकांक थोक मूल्य सूचकांक ( डबल्यू पी आई ) (ख ) (दिनांक 31 मार्च , 2008 को समाप्त होने वाले वर्ष के लिए)

गणना सूत्र :

नवीन पथकर दर ( दिनांक 01.09.2008 से प्रभावी) = मूल पथकर दर x थोक मूल्य सूचकांक (ख) थोक मूल्य सूचकांक (क) आगामी वर्षों के लिए गणना उपरोक्तानुसार नये थोक मूल्य सूचकांक के आधार पर ही की जाएगी। मूल थोक मूल्य सूचकांक 31 मार्च , 2007 को समाप्त होने वाले वर्ष का होगा ।

4. महाप्रबंधक/संभागीय प्रबंधक , मध्यप्रदेश सड़क विकास निगम किसी व्यक्ति के अनुरोध पर संबंधित वाहन के लिए देय शुल्क के 150 प्रतिशत (एक सौ पचास प्रतिशत) के बराबर राशि के भुगतान पर, लिखित पार पत्र जारी करेगा , यदि वह परियोजना राजमार्ग पर एक तरफ की यात्रा करने वाला हो । ऐसा लिखित पार पत्र , शुल्क के संदाय के समय से 24 घंटे (चौबीस घंटे) के भीतर वापसी यात्रा करने के लिए विनिर्दिष्ट वाहन को हकदार बनाएगा ।

5. 50 (पचास) या उससे अधिक एक तरफ की यात्रा का पथकर टिकिट जारी करने के लिए किसी व्यक्ति के अनुरोध पर महाप्रबंधक/संभागीय प्रबंधक, मध्यप्रदेश सड़क विकास निगम संबंधित वाहन के लिए देय शुल्क के दो तिहाई के बराबर रियायती दर पर ऐसे टिकिट जारी करेगा । ऐसे रियायती टिकिट शुल्क के संदाय की तारीख से एक मास की कालावधि के दौरान , किसी भी समय एक तरफ की यात्रा के लिए एक टिकिट के उपयोग द्वारा परियोजना राजमार्ग पर आवागमन के लिए विनिर्दिष्ट वाहन के लिए विधिमान्य होंगे ।

6. स्थानीय यातायात को पथकर के भुगतान से छूट प्राप्त होगी । ऐसे वाहनों को महाप्रबंधक/संभागीय प्रबंधक, मध्यप्रदेश सड़क विकास निगम द्वारा मासिक पार पत्र जारी किये जायेंगे। पात्र वाहन स्वामियों को ऐसे पार पत्र , महाप्रबंधक/ संभागीय प्रबंधक द्वारा , आवश्यक दस्तावेज प्रस्तुत किए जाने पर 31 मार्च, 2007 को समाप्त वर्ष के थोक मूल्य सूचकांक की तुलना में, थोक मूल्य सूचकांक में परिवर्तन दर्शाने के लिए प्रत्येक वर्ष की 1 सितम्बर से लागू होने वाले, और तब निकटतम पांच रूपये में पूर्णांकित किए जाने वाले, वार्षिक रूप से पुनरीक्षित किए जाने वाले 85.00 रूपये (रूपये पिच्यासी मात्र) के मासिक मध्यप्रदेश राजपत्र, दिनांक 27 मई 2021

शुल्क के भुगतान के पश्चात् जारी किये जायेंगे । ऐसी छूट के प्रयोजन के लिए स्थानीय यातायात से अभिप्रेत होगा, किसी निजी कार/जीप अथवा समतुल्य वाहन से परियोजना राजमार्ग के माध्यम से आवागमन करे; परन्तु ऐसी निजी कार किसी ऐसे व्यक्ति के स्वामित्व की हो, जो पथकर प्लाजा से 20 (बीस) किमी. की दूरी के भीतर निवास करता होः

: परन्तु कोई वाहन , जो परियोजना राजमार्ग के एक भाग का तो उपयोग करता हो, किन्तु एक से अधिक पथकर प्लाजा पार करता हो, स्थानीय यातायात के रूप में नहीं माना जाएगा । इसी प्रकार ऐसे स्थानीय यातायात से किसी पार पत्र की अपेक्षा नहीं की जाएगी या कोई फीस संग्रहीत नहीं की जायेगी , जो परियोजना राजमार्ग के एक भाग का तो उपयोग करते हैं और कोई पथकर प्लाजा पार नहीं करते ।

7. सर्विस लेन निर्मित होने पर स्थानीय यातायात और अन्य वाहन , सर्विस लेन का निशुल्क उपयोग करने के लिए हकदार होंगे तथा महाप्रबंधक/संभागीय प्रबंधक, मध्यप्रदेश सड़क विकास निगम ऐसी फीस के भुगतान करने के सिवाय , जो कि इस अधिसूचना के निबंधनों के अनुसार प्रयोज्य हो , परियोजना राजमार्गों पर ऐसे वाहनों को प्रवेश देने से इंकार करने का हकदार होगा।

8. किसी मार्ग के पथकर का उद्‌ग्रहण और संग्रहण उपभोक्ता शुल्क संग्रहण अभिकरण की नियुक्तिकी तारीख से प्रारंभ होगा ।

9. महाप्रबंधक/संभागीय प्रबंधक, मध्यप्रदेश सड़क विकास निगम , परियोजना राजमार्ग के प्रवेश स्थल पर और प्रत्येक पथकर प्लाजा के दोनों ओर , परियोजना राजमार्ग के दोनों तरफ से आने वाले उपयोगकर्ताओं की जानकारी के लिए , लागू पथकर प्रभार, हिन्दी और अंग्रेजी दोनों भाषा में संप्रदर्शित करेंगें। 10. अप्राधिकृत संग्रहण: -

1) यदि महाप्रबंधक/संभागीय प्रबंधक, किसी व्यक्ति से ऐसी राशि संग्रहीत करता है , जो इसके अधीन शोध्य और देय नहीं है, तो संभागीय प्रबंधक संग्रहण की तारीख से वापसी की तारीख तक प्रत्येक दिन के लिए , इस प्रकार संग्रहीत रकम के 3 % तीन प्रतिशत की दर से संग्रहीत राशि के साथ इस प्रकार संग्रहीत रकम तुरंत ही नुकसानी के रूप में ऐसे व्यक्ति को वापस करने का दायी होगा। यथा पूर्वोक्त रीति में संगणित नुकसान के साथ ऐसी रकम के किसी भी कारण से ऐसे व्यक्ति को संदत्त न किए जाने की दशा में, उसे ऐसे संग्रहण की तारीख से 15 ( पन्द्रह ) दिनों मध्यप्रदेश राजपत्र, दिनांक 27 मई 2021

466(3) की कालावधि के भीतर, मध्यप्रदेश सड़क विकास निगम में निक्षिप्त किया जायेगा ।

2) उप-खण्ड 10.1 के अधीन महाप्रबंधक/संभागीय प्रबंधक, द्वारा देय रकम से संबंधित कोई विवाद मुख्य अभियंता , मध्यप्रदेश सड़क विकास निगम , भोपाल द्वारा लिखित में आदेश द्वारा निपटाया जाएगा और ऐसे आदेश के विरुद्ध अपील, यदि कोई हो, प्रमुख अभियंता, मध्यप्रदेश सड़क विकास निगम , भोपाल को होगी।

3 ) पथकर के संग्रहण के संबंध में व्यथित कोई भी व्यक्ति, महाप्रबंधक/ संभागीय प्रबंधक, मध्यप्रदेश सड़क विकास निगम को अपनी शिकायत दर्ज करा सकेगा और महाप्रबंधक/संभागीय प्रबंधक, 15 (पन्द्रह ) दिनों की कालावधि के भीतर ऐसी शिकायत पर आदेश पारित करेगा और ऐसे आदेश के विरुद्ध अपील, मुख्य अभियंता, मध्यप्रदेश सड़क विकास निगम , भोपाल को होगी।

11. यह अधिसूचना टोल संग्रहण अभिकरण की नियुक्ति की तारीख से प्रारंभ होकर निवेशकर्ता/ ठेकेदार की नियुक्ति की तारीख तक प्रभावी समझी जाएगी ।

12. राज्य सरकार यह और घोषित करती है , कि वाहनों की निम्नलिखित श्रेणियों को इन सड़कों को पार करते समय पथकर के भुगतान से छूट प्राप्त होगी : - ( 1) भारत सरकार तथा मध्यप्रदेश सरकार के समस्त वाहन और वे वाहन जो सरकारी कर्तव्य पर हों ;

(2) माननीय संसद सदस्य तथा विधानसभा के सदस्यों से संबंधित वाहन ;

(3) भारतीय सेना से संबंधित समस्त वाहन ;

(4) एम्बुलेंस ;

(5) फायर बिग्रेड ;

(6 ) भारतीय डाक तथा तार विभाग से संबंधित वाहन ;

(7) भूतपूर्व सांसदों एवं विधायको से संबंधित वाहन ;

(8 ) कृषि प्रयोजन के लिए उपयोग की जाने वाली ट्रैक्टर- ट्राली ;

(9 ) आटो रिक्शा, दुपहिया तथा बैलगाड़ियों ;

( 10) स्वतंत्रता संग्राम सेनानी तथा मान्यता प्राप्त पत्रकार ;

No.F - 23-04-2020/G / 19 In exercise of the powers , conferred by Section - 2 of the Indian Tolls Act, 1851 ( No. VIII of 1851 ) in its application to the State of Madhya Pradesh , State Governments is pleased to grant sanction for levying toll on the following Basic Rates on 13 roads shown as below in the table on a per trip per vehicle basis for road or part thereof (Homogeneous Section) with effect from appointment of Toll Collection Agency , namely: -

2. The toll will be collected by Madhya Pradesh Road Development Corporation, through the General Manager/Divisional Manager, Madhya Pradesh Road Development Corporation . The rates of toll on each toll plaza will be specified by Madhya Pradesh Road Development Corporation Ltd. on the basis of above Rates .

3. The above rates will increase every year on the basis of Wholesale Price Index and will be rounded off to the nearest five rupees . The increase will be made effective from 1st September of every year, based on the Wholesale Price Index for the year ending 31st March . The Basic Toll Rates will be as per the rates notified to be effective as on 01.09.2007 . The toll increased every year shall be calculated as per the formula (example ) given below : -

For the coming years , the calculations will be done as per the above based on new Wholesale Price Index . Basic Wholesale Price Index shall be of the year ending on 31st March , 2007 .

4. The General Manager/Divisional Manager , Madhya Pradesh Road Development Corporation shall , request from any person , issue a written pass on payment of a sum equal to 150% ( one hundred and fifty percent) of the fee payable for the respective vehicle if it were to undertake a single one way trip on the Project Highway. Such written pass shall be entitled the specified vehicle to undertake a return journey within 24 hrs ( twenty four hours) from the time of payment of Fee.

5. Upon request from any person for issuance of fifty or more one way toll tickets, the General Manager/Divisional Manager, Madhya Pradesh Road Development Corporation shall , issue such tickets at a discounted rate equivalent to two - thirds of the Fee payable for the respective vehicle . Such discounted tickets shall be valid for the specified vehicle to commute on the Project Highway by using one ticket for a single one - way trip at any time during a period of one month from the date of payment of Fee .

6. Local Traffic shall be exempted from payment of toll . Such vehicles will be issued monthly passes by the General Manager/Divisional Manager , MP Road Development Corporation . Such passes will be issued to eligible vehicle owners , by the General Manager/Divisional Manager on production of necessary documents and after payment of monthly fee of Rs . 85.00 (Rupees Eighty five only) to be revised annually , applicable from 1st September of every year to reflect the variation in WPI as compared to WPI of year ended 31st March , 2007 and then rounded off to nearest five rupees . For the purpose of such exemption , Local Traffic will mean the traffic on account of commuting by a private Car/ Jeep or equivalent vehicle by means of the Project Highway; provided that such private Car is owned by a person who resides within a distance of 20 (twenty) Km from the Toll Plaza;

Provided that any vehicle that uses the part of Project Highway but crosses more than one Toll Plaza will not be reckoned as Local Traffic . Similarly no passes will be required or fee will be collected from such Local Traffic that uses part of the Project Highway and does not cross a Toll Plaza .

7. Upon construction of service lanes , the local Traffic and other vehicles , shall be entitled for free use of service lanes and the General Manager/Divisional Manager , Madhya Pradesh Road Development Corporation , may refuse entry of such vehicles on Project Highway except upon payment of fee , as is applicable as per the terms of the notification .

8. Levy and collection of toll of the road shall commence from the date of appointment of User Fee Collection Agency.

9. The General Manager /Divisional Manager , Madhya Pradesh Road Development Corporation, shall display the applicable toll charges at entry point of the Project मध्यप्रदेश राजपत्र, दिनांक 27 मई 2021

Highway and at each Toll Plaza on both sides for information of users approaching from either side of the Project Highway in both Hindi & English Language .

10. Unauthorized Collection: -

1. In the event that the General Manager/Divisional Manager , collects from any person a sum of money not due and payable hereunder , the Divisional Manager shall be liable to refund to such person forthwith the amount so collected along with a sum computed @ 3 % (three percent ) of the amount so collected, for each day from the date of collection till the date of refund, by way of damages . In the event that such amount together with damages computed in the manner as aforesaid is not paid to such person for any reason whatsoever , the same shall be deposited with MPRDC within a period of 15 ( fifteen) days from the date of such collection .

2. Any dispute relating to amounts payable by the General Manager /Divisional Manager under Sub- clause 10.1 shall be settled by the Chief Engineer , MPRDC, Bhopal , by an order in writing and appeal , if any , against such order shall lie with the Engineer - in-Chief, MPRDC Bhopal .

3. Any person aggrieved in connection with collection of the toll may lodge a complaint to the General Manager/Divisional Manager , MPRDC and the General Manager /Divisional Manager shall pass order on such complaint within a period of fifteen days and appeal , against such order shall lie with the Chief Engineer , MPRDC , Bhopal .

11. This notification shall be deemed to be effective from date of appointment of User Fee Collection Agency to till date of appointment of Concessionaire/Contractor .

12. The State Government further declares that following categories of vehicle will be exempted from payment of toll while crossing these roads .

1) All vehicles belonging to the Government of India, Government of Madhya Pradesh and those on Government duty.

2) Vehicle belonging to the Hon'ble Member of Parliament and Member of Legislative Assembly.

3) All vehicles belonging to the Indian Army .

4) Ambulances

5) Fire Brigades

6) Vehicles belonging to the Indian Posts and Telegraph Department

7) Vehicles belonging to Ex-Member of Parliament and Legislative Assembly .

8 ) Tractor - Trolleys used for agriculture purpose.

9) Auto Rickshaws , Two wheeler and bullock carts .

10) Freedom fighters and Accredited Journalists .

Note: Thedriver of the vehicle/ van so exempted from payment of toll shall state his name, rank and name of duty on which he is engaged.
