एफ 5-4-2020- उन्तीस- 2.- उपभोक्ता संरक्षण अधिनियम, 2019 ( 2019 का 35 ) की धारा 102 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, राज्य सरकार , एतद्वारा निम्नलिखित नियम बनाती है , अर्थात्:-
नियम
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम मध्यप्रदेश उपभोक्ता संरक्षण ( राज्य आयोग और जिला आयोग के अध्यक्ष और सदस्यों का वेतन, भत्ते एवं सेवा की शर्तें ) नियम , 2021 है.
(2 ) ये नियम " मध्यप्रदेश राजपत्र " में प्रकाशन की दिनांक से प्रवृत्त होंगे.
2. परिभाषाएँ.-( 1 ) इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-
(क) ' अधिनियम' से अभिप्रेत है उपभोक्ता संरक्षण अधिनियम 2019 ( 2019 का 35 ) ;
(ख) 'जिला आयोग ' से अभिप्रेत है, जिला उपभोक्ता विवाद प्रतितोषण आयोग ;
(ग) ' सदस्य' से अभिप्रेत है, यथास्थिति, जिला आयोग अथवा राज्य आयोग का सदस्य;
(घ) ' अध्यक्ष ' से अभिप्रेत है, यथास्थिति, जिला आयोग अथवा राज्य आयोग का अध्यक्ष;

(ङ) ' राज्य आयोग ' से अभिप्रेत है , मध्यप्रदेश राज्य उपभोक्ता विवाद प्रतितोषण आयोग;
(च) ' राज्य सरकार " से अभिप्रेत है , मध्यप्रदेश सरकार ;
(2) उन शब्दों और अभिव्यक्तियों के , जो इसमें प्रयुक्त हैं , और परिभाषित नहीं है किन्तु अधिनियम में परिभाषित है , वही अर्थ होंगे , जो अधिनियम में उनके लिये समनुदेशित हैं.
3. जिला आयोग के अध्यक्ष एवं सदस्यों को देय वेतन एवं भत्ते.-( 1 ) अध्यक्ष ऐसे वेतन, भतों और समस्त सुविधाओं का हकदार होगा, जो किसी प्रमुख जिला न्यायाधीश/जिला न्यायाधीश के लिये राज्य सरकार द्वारा अनुज्ञेय हैं.
( 2 ) सदस्य, राज्य सरकार के किसी अवर सचिव के वेतनमान के न्यूनतम स्तर के वेतन तथा उस अधिकारी को अनुज्ञेय अन्य भत्तों के बराबर वेतन प्राप्त करेगा.
( 3 ) अध्यक्ष अथवा सदस्य के रूप में नियुक्त किया गया कोई ऐसा व्यक्ति जो पेंशनभोगी है , के वेतन में उसके द्वारा आहरित पेंशन की राशि की कटौती की जाएगी और उसे कार्यकाल के दौरान पेंशन पर राहत की पात्रता नहीं होगी.
(4) अध्यक्ष और सदस्य का वेतन 3 % की दर से वार्षिक उत्तरोत्तर वृद्धि की जाएगी .
4. राज्य आयोग के अध्यक्ष एवं सदस्यों को देय वेतन एवं भत्ते .-( 1 ) राज्य आयोग का अध्यक्ष ऐसे वेतन , अन्य भत्तों और सभी सुविधाओं का हकदार होगा, जो राज्य के उच्च न्यायालय के पीठासीन न्यायाधीश को अनुज्ञेय है .
( 2 ) राज्य आयोग का सदस्य, राज्य शासन के उप सचिव के वेतनमान के न्यूनतम स्तर के वेतन बराबर वेतन तथा ऐसे अधिकारी को अनुज्ञेय अन्य भत्ते वेतन प्राप्त करेगा.
(3 ) अध्यक्ष अथवा सदस्य के रूप में नियुक्त किया गया कोई ऐसा व्यक्ति, जो पेंशनभोगी है , के वेतन में उसके द्वारा आहरित पेंशन की राशि की कटौती की जाएगी और उसे कार्यकाल के दौरान पेंशन पर राहत की पात्रता नहीं होगी.
(4) सदस्य के वेतन में 3 % की दर से वार्षिक उत्तरोत्तर वृद्धि की जाएगी .
5. चिकित्सीय उपयुक्तता.-किसी भी व्यक्ति को तब तक अध्यक्ष अथवा सदस्य के रूप में नियुक्ति नहीं किया जाएगा जब तक कि उसे संबंधित सिविल सर्जन/जिला चिकित्सा अधिकारी द्वारा चिकित्सीय रूप से स्वस्थ घोषित नहीं किया जाता.
6. आकस्मिक रिक्ति. -( 1 ) राज्य आयोग में अध्यक्ष के पद पर आकस्मिक रिक्ति के मामले में राज्य शासन को ज्येष्ठतम सदस्य को अध्यक्ष के रूप में कार्य करने के लिये नियुक्त करने का अधिकार होगाः
परन्तु जहां कोई राज्य का सेवानिवृत्त न्यायिक अधिकारी , राज्य आयोग का सदस्य है , या जहां ऐसे सदस्यों की संख्या एक से अधिक है, वहां ऐसे सदस्यों में से ज्येष्ठतम व्यक्ति को राज्य शासन द्वारा आयोग के अध्यक्ष के रूप में कार्य करने के लिए नियुक्त किया जाएगा.
(2) यदि किसी समय जिला आयोग के अध्यक्ष या सदस्य के पद की रिक्ति होती है तो अध्यक्ष राज्य आयोग किसी अन्य जिला आयोग के अध्यक्ष या सदस्य को उस जिला आयोग के अध्यक्ष या सदस्य की शक्तियों का उपयोग करने और कृत्यों के निर्वहन करने का निर्देश दे सकेंगे . जब तक कि रिक्त पद की पूर्ति राज्य शासन द्वारा की जाती है.

7. मकान किराया भत्ता.- ( 1 ) राज्य आयोग में अध्यक्ष, शासकीय बंगला उपलब्ध न होने की दशा में राज्य के उच्च न्यायालय के पीठासीन न्यायाधीश को अनुज्ञेय दर के समान दर पर मकान किराया भत्ते के हकदार होंगे .
(2) जिला आयोग के अध्यक्ष, शासकीय बंगला उपलब्ध न होने की दशा में प्रमुख जिला न्यायाधीश/जिला न्यायाधीश को मकान किराया भत्ते के हकदार होंगे .
(3 ) राज्य आयोग एवं जिला आयोग के सदस्य, राज्य सरकार के समूह ' क ' के अधिकारी को अनुज्ञेय दर के समान दर पर मकान किराया भत्ते के हकदार होंगे.
8. परिवहन भत्ता.- ( 1 ) राज्य आयोग के अध्यक्ष , राज्य के उच्च न्यायालय के पीठासीन न्यायाधीश को अनुज्ञेय परिवहन भत्ते के हकदार होंगे.
(2 ) जिला आयोग के अध्यक्ष, प्रमुख जिला न्यायाधीश/जिला न्यायाधीश को अनुज्ञेय परिवहन भत्ते के हकदार होंगे.
(3 ) राज्य आयोग एवं जिला आयोग के सदस्य, राज्य सरकार के समूह ' क ' के अधिकारी को अनुज्ञेय दर के समान दर पर परिवहन भत्ते के हकदार होंगे.
9. छुट्टी और चिकित्सा उपचार तथा अस्पताल सुविधाएं. - ( 1 ) राज्य आयोग के अध्यक्ष, राज्य के उच्च न्यायालय के पीठासीन न्यायाधीश को अनुज्ञेय छुट्टी, छुट्टी यात्रा रियायत , चिकित्सा उपचार और अस्पताल सुविधाओं के हकदार होंगे.
(2 ) जिला आयोग के अध्यक्ष, प्रमुख जिला न्यायाधीश/जिला न्यायाधीश को अनुज्ञेय छुट्टी , छुट्टी यात्रा रियायत, चिकित्सा उपचार और अस्पताल सुविधाओं के हकदार होंगे .
(3 ) राज्य आयोग एवं जिला आयोग के सदस्य, राज्य सरकार के समूह ' क ' के अधिकारी को लागू उपबंधों के अनुसार छुट्टी , छुट्टी यात्रा रियायत , चिकित्सा उपचार और अस्पताल सुविधाओं के हकदार होंगे .
10. वित्तीय एवं अन्य लाभों की घोषणा.- अध्यक्ष अथवा सदस्य अपना पद ग्रहण करने से पहले अपनी आस्तियों , और अपने दायित्वों तथा वित्तीय और अन्य लाभों की घोषणा करेगा.
11. सेवा की अन्य शर्तें.-( 1 ) अध्यक्ष अथवा सदस्य की सेवा के निबंधन और शर्तें, जिनके संबंध में इन नियमों में कोई स्पष्ट उपबंध नहीं किया गया है, निम्नानुसार होंगी :-
(क) राज्य आयोग के अध्यक्ष के मामले में राज्य के उच्च न्यायालय के पीठासीन न्यायाधीश के लिये उपबंधित हैं ;
(ख) जिला आयोग के अध्यक्ष के मामले में प्रमुख जिला न्यायाधीश/जिला न्यायाधीश के लिये उपबंधित है;
(ग) राज्य आयोग एवं जिला आयोग के सदस्य के मामले में तत्स्थानी प्रास्थिति के राज्य सरकार के समूह ' क ' के अधिकारी को अनुज्ञेय है.
(घ) अध्यक्ष या सदस्य के पद पर पुनर्नियुक्ति के मामले में उनका वेतन प्रावधानित वेतनमान के न्यूनतम स्तर पर निर्धारित किया जाएगा.
(ङ) कार्यकाल समाप्त होने के पूर्व किसी अध्यक्ष या सदस्य की पुनर्नियुक्ति के मामले में उस अध्यक्ष या सदस्य को पूर्व कार्यकाल समाप्ति के एक माह पश्चात् कार्यभार ग्रहण करने की पात्रता होगी.
(2 ) अध्यक्ष अथवा सदस्य, यथास्थिति , राज्य आयोग अथवा जिला आयोग , से कार्यकाल समाप्त होने के पश्चात् राष्ट्रीय आयोग , राज्य आयोग अथवा जिला आयोग में वकालत नहीं करेगा.

( 3) अध्यक्ष अथवा सदस्य, यथास्थिति, राज्य आयोग अथवा जिला आयोग में इन क्षमताओं में कार्य करते समय किसी प्रकार का मध्यस्थता कार्य नहीं करेगा.
(4 ) यथास्थिति, राज्य आयोग अथवा जिला आयोग , का अध्यक्ष अथवा सदस्य उस तारीख से जिससे वे पद पर नहीं रह जाते हैं, दो वर्षों की अवधि तक किसी भी ऐसे व्यक्ति के प्रबंधन अथवा प्रशासन में अथवा उससे संबंधित किसी भी रोजगार को स्वीकार नहीं करेगा जो राज्य आयोग अथवा जिला आयोग के समक्ष किसी कार्यवाही में कोई पक्षकार रहा हो :
परंतु इन नियमों में अन्तर्विष्ट कोई बात, केन्द्रीय शासन अथवा किसी राज्य शासन अथवा किसी स्थानीय प्राधिकारी अथवा किसी कानूनी प्राधिकारी या किसी केन्द्रीय , राज्य या प्रांतीय अधिनियम के अधीन स्थापित किसी निगम अथवा कंपनी अधिनियम, 2013 ( 2013 का 18 ) की धारा 2 के खण्ड ( 45 ) में यथापरिभाषित किसी सरकारी कंपनी के अधीन किसी नियोजन पर लागू नहीं होगी.
12. पद और गोपनीयता की शपथ.-अध्यक्ष अथवा सदस्य नियुक्त किये जाने वाला प्रत्येक व्यक्ति, अपना पद ग्रहण करने से पहले, इन नियमों के साथ संलग्न परिशिष्ट -1 में प्ररूप 1 में दी गई पद की शपथ तथा प्ररूप 2 में दी गई गोपनीयता की शपथ ग्रहण करेगा तथा उन पर हस्ताक्षर करेगा.
13. वेतन, पारिश्रमिक और अन्य भतों की अदायगी राज्य सरकार की संचित निधि से की जाएगी.
14. जिला आयोग और राज्य आयोग के अध्यक्ष और सदस्यों की सेवा के निबंधन और शर्तों में उनकी पदावधि के दौरान अलाभकारी परिवर्तन नहीं किया जाएगा.

राज्य आयोग और जिला आयोग के अध्यक्ष और सदस्य के लिए पद की शपथ का प्ररूप मैं, (नाम ) , राज्य उपभोक्ता विवाद प्रतितोषण आयोग (स्थान ) /जिला उपभोक्ता विवाद प्रतितोषण आयोग ( स्थान ) का अध्यक्ष/ सदस्य के रूप में नियुक्त किए जाने पर, सत्यनिष्ठा से प्रतिज्ञा करता हूँ/ईश्वर के नाम से शपथ लेता हूँ कि मैं अपनी सर्वोत्तम क्षमता , ज्ञान और विवेकबुद्धि से राज्य आयोग/जिला आयोग के अध्यक्ष/सदस्य के रूप में अपने कर्त्तव्यों का निष्ठापूर्वक और ईमानदारी से निर्वहन करूँगा तथा किसी भय अथवा पक्षपात, राग अथवा द्वेष के बिना निर्णय दूँगा तथा मैं संविधान और देश की विधि की रक्षा करूँगा.

राज्य आयोग और जिला आयोग के अध्यक्ष और सदस्य के लिए गोपनीयता की शपथ का प्ररूप मैं, (नाम) , राज्य उपभोक्ता विवाद प्रतितोषण आयोग (स्थान )/जिला उपभोक्ता विवाद प्रतितोषण आयोग (स्थान ) का अध्यक्ष/सदस्य के रूप में नियुक्त किए जाने पर, सत्यनिष्ठा से प्रतिज्ञा करता हूँ/ईश्वर के नाम से शपथ लेता हूँ कि मैं अध्यक्ष/ सदस्य के रूप में मेरे कर्त्तव्यों के उचित निर्वहन के लिये यथाअपेक्षित के सिवाय , मेरे विचाराधीन प्रस्तुत किए गए अथवा राज्य आयोग/जिला आयोग के अध्यक्ष सदस्य के रूप में मुझे ज्ञात हुए किसी मामले को किसी व्यक्ति अथवा व्यक्तियों को प्रत्यक्ष अथवा अप्रत्यक्ष रूप से संसूचित अथवा प्रकट नहीं करूँगा.

एफ 5-4-2020 - उन्तीस- 2.- भारत के संविधान के अनुच्छेद 348 के खण्ड ( 3 ) के अनुसरण में, इस आशय की अधिसूचना क्रमांक एफ 5-4-2020- उन्तीस -2 , दिनांक 17 अगस्त 2021 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्वारा प्रकाशित किया जाता है.

F. 5-4-2020 - XXIX- 2.- In exercise of the powers conferred under Section 102 of the Consumer Protection Act , 2019 (35 of 2019) , the State Government hereby makes the following rules , namely : -
RULES
1. Short title and commencement .-( 1 ) These rules may be called the Madhya Pradesh Consumer Protection (Salary, allowances and conditions of service of President and Members of the State Commission and District Commission) Rules , 2021 .
(2) They shall come into force with effect from the date of their publication in the Madhya Pradesh Gazette.
2. Definitions .-( 1 ) In these rules , unless the context otherwise requires ,-
(a) 'Act' means the Consumer Protection Act, 2019 (35 of 2019) ;
(b) 'District Commission' means District Consumer Disputes Redressal Commission;
(c) 'Member' means a Member of the District Commission or the State Commission as the case may be;
(d) 'President' means the President of the District Commission or the State Commission , as the case may be;
(e) 'State Commission ' means The Madhya Pradesh State Consumer Disputes Redressal Commission ;
(f) 'State Government' means the Government of Madhya Pradesh ;
(2) The words and expressions used herein and not defined but defined in the Act shall have the same meaning respectively assigned to them in the Act.
3. Salaries and allowances payable to President and members of District Commission. ( 1 ) The President shall be entitled to the salary, allowance and all the facilities as are admissble to a Principal District Judge/District Judge prescribed by the State Government .
(2) A Member shall received a pay equal to the pay at the minimum of the scale of pay of a Under Secretary of the State Government and other allowances as admissible to such officer .
(3) The pay of a person appointed as President or member , who is in receipt of any pension , shall be reduced by the amount of pension drawn by him during his /her entire service as President or Member shall not claim relief on the pension drawn by him/her.

(4) There shall be an annual upward revision of the pay of the President and member at the rate of 3 %.
4. Salaries and allowances payable to President and members of the State Commission ( 1 ) The President of the State Commission shall be entitled to the salary, other allowances and all the facilities as are admissible to a sitting judge of the High Court of the State .
(2) A Member of the State Commission shall receive a pay equivalent to the pay at minimum of the scale of pay of a Deputy Secretary of the State Government and other allowances as are admissible to such officer.
(3) The pay of a person appointed as President or member, who is in receipt of any pension , shall be reduced by the amount of pension drawn by him during his/her entire service as President or Member, shall not claim relief on the pension drawn by him/her .
(4) There shall be an annual upward revision of the pay of a member at the rate of 3% .
5.Medical fitness . No person shall be appointed as President or Member unless he/ she is declared medically fit by the concerned Civil Surgeon/District Medical Officer .
6. Casual Vacancy.-( 1) In case of a casual vacancy in the office of President in the State Commission , the State Government shall have the power to appoint the senior most Member to officiate as President .
Provided that where a retired Judicial Officer of the State is a member of the State Commission , or where the member of such members is more than one , the senior- most person amongst such members , shall be appointed by the State Government to officiate as President .
(2) If, at any time , there is a casual vacancy in the office of President or Member of a District Commission, the President of the State Commission shall have the power to direct the President or a Member of any other District Commission to exercise the powers and discharge the functions of the President or Member of that District Commission till appointment against the vacant post is made by the State Government .
7. House rent allowance .-( 1 ) The President of the State Commission , in case of non - availability of official bungalow, shall be entitled to house rent allowance as is admissible to a sitting Judge of the High Court of the State .
(2) The President of the District Commission, in case of non - availability of official bungalow shall be entitled to house rent allowance as is admissible to a District Judge .
(3 ) The Members of the State Commission and District Commission shall be entitled to house rent allowance at the same rate as are admissible to Group 'A' Officer .
8. Transport allowance .-( 1) The President of the State Commission , shall be entitled to transport allowance as is admissible to a sitting Judge of the High Court of the State .
(2) The President of the District Commission shall be entitled to transport allowance as is admissible to a Principal District Judge/District Judge.
(3) The Members of the State Commission and District Commission shall be entitled to transport allowance at the same rate as are admissible to Group ' A' Officer of the State Government .
9. Leave and medical treatment and hospital facilities .-( 1 ) The President of the State Commission shall be entitled to leave , leave travel concession , medical treatment and hospital facilities as are admissible to a sitting Judge of the High Court of the State.

(2) The President of the District Commision shall be entitled to leave , leave travel concession , medical treatement and hospital facilities as are admissible to a Principal District Judge/District Judge.
(3) The Members of the State Commission and District Commission shall be entitled to leave , leave travel concession , medical treatment and hospital facilities as per the provisions applicable to Group 'A' Officer of the State Government .
10. Declaration of Financial and other Interest . The President or member shall , before entering upon his office , declare his assests , and his liabilities and financial and other interests .
11. Other conditions of service . ( 1 ) The terms and conditions of service of the President or Member with respect to which no expressed provision has been made in these Rules , shall be as follows :
(a) In case of the President of the State Commission it shall be such as are provided to a sitting Judge of the High Court of the State .
(b) In case of the President of the District Commission it shall be such as are provided to a principal District Judge/District Judge.
(c) In case of the Members of the State Commission and District Commission it shall be such as are admissible to Group 'A' Officer of the State Government of a corresponding status .
(d) In case of re - appointment of president or members , the salary shall be fixed at the minimum of prescribed pay scale .
(e) In case of re - appointment of a president or member before the end of the tenure , that president or member shall be eligible to join after one month of the completion of the prior tenure .
(2) The President or member shall not practice before the National Commission, the State Commission or the District Commission after expiration of tenure from the service of the State Commission or the District Commission , as the case may be .
(3) The President or member shall not undertake any arbitration work while functioning in these capacities in the State Commission or the District Commission , as the case may be .
(4) The President or member of the State Commission or the District Commission , as the case may be , shall not , for a period of two years from the date on which they cease to hold office , accept any employment in , or connected with the management or administration of, any person who has been a party to a proceeding before the State Commission or the District Commission:
Provided that nothing contained in this rule shall apply to any employment under the Central Government or a State Government or a local authority or in any statutory authority or any corporation established by or under any Central , State or Provincial Act or a Government company as defined in clause (45) of Section 2 of the Companies Act, 2013 (18 of 2013) .
12. Oaths of office and secrecy. Every person appointed to be the President or member shall , before entering upon his office, make and subscribe an oath of office in Form I and oath of secrecy in Form II annexed to these rules in annexure I.
13. The Salary, remuneration and other allowances shall be defrayed out of the Consolidated Fund of the State Government.

14. The terms and conditions of the service of the President and the members of the Distrct Commission and the State Commission shall not be varied to their disadvantage during their tenure of office.
